Standard accuracy-based approaches to imprecise credences have the consequence that it is rational to move between precise and imprecise credences arbitrarily, without gaining any new evidence. Building on the Educated Guessing Framework of Horowitz (2019), we develop an alternative accuracy-based approach to imprecise credences that does not have this shortcoming. We argue that it is always irrational to move from a precise state to an imprecise state arbitrarily, however it can be rational to move from an imprecise state to a (...) precise state arbitrarily. Theories of perception have traditionally dismissed the sense of smell as a notoriously variable and highly subjective sense, mainly because it does not easily fit into accounts of perception based on visual experience. So far, philosophical questions about the objects of olfactory perception have started by considering the nature of olfactory experience. However, there is no philosophically neutral or agreed conception of olfactory experience: it all depends on what one thinks odors are. We examine the existing philosophical methodology for addressing (...) our sense of smell: on the one hand appeals to phenomenology that focus on the experiential dimensions of odor perception and on the other approaches that look at odor sources and their material dimensions. We show that neither strategy provides enough information to account for the human sense of smell and argue that the inclusion of the missing dimension of biology, with its concern for the function (or functions) of olfaction, provides the means to develop a satisfactory and empirically informed philosophy of smell. Life has evolved; and so must have consciousness, or subjective experience, as found in living beings, Eva Jablonka and Simona Ginsburg contend. In their target article, which summarises the main theses of their seminal book The Evolution of the Sensitive Soul, the authors put forward an evolutionary account of consciousness that builds upon the intimate connection between consciousness and life without, however, equating the two. Instead, according to Jablonka & Ginsburg, there was life before there was consciousness, and there are (...) still living beings without consciousness. Here I offer some metaphysical considerations in favour of a more inclusive notion of consciousness than Jablonka & Ginsburg’s. These considerations turn on the role played by metabolism and agency in the processual constitution of living beings as well as on the continuum between sensation and perception. Rather than postulating a mindless inwardness in presumably non-conscious organisms, we ought to recognise the constitutive experiential nature of life, rooted in its intrinsic purposiveness. Within the philosophy of biology, recently promising steps have been made towards a biologically grounded concept of agency. Agency is described as bio-agency: the intrinsically normative adaptive behaviour of human and non-human organisms, arising from their biological autonomy. My paper assesses the bio-agency approach by examining criticism recently directed by its proponents against the project of embodied robotics. Defenders of the bio-agency approach have claimed that embodied robots do not, and for fundamental reasons cannot, qualify as artificial agents because they (...) do not fully realise biological autonomy. More particularly, it has been claimed that embodied robots fail to be agents because agency essentially requires metabolism. I shall argue that this criticism, while being valuable in bringing to the fore important differences between bio-agents and existing embodied robots, nevertheless is too strong. It relies on inferences from agency-as-we-know-it to agency-as-it-could-be which are justified neither empirically nor conceptually. (shrink)

Perfumes embody a chemical record of style and technology. Blurring the boundary between what counts as natural and artificial in both a material and a perceptual sense, perfumery presents us with a domain of multiple disciplinary identities relevant to social studies: art, craft, and techno‐science. Despite its profound impact as a cultural practice, perfume has seldom featured in historical scholarship. The reason for this neglect is its inherently qualitative dimension: perfume cannot be understood via codified representation but requires direct acquaintance (...) with its sensory and material basis. The historical study of perfumery thus necessitates an experimental approach that comes not without challenge. This article looks at contemporary recreations of old perfumes to identify the difficulties involved in the experimental recreation of fragrances as sensory and performative artifacts. We highlight the need for a reconceptualization of methodology for inconcrete objects of study as part of the broader interest in experimental approaches to the humanities. (shrink)

This study focuses on a third-party perspective of idiosyncratic deals. More specifically, we look into the differential judgments co-workers make about i-deals in their work environment, as well as their reactions. Based on equity theory, we examine to what extent the content of the i-deal and the work context explain co-worker judgments regarding i-deal fairness in addition to subsequent voice behavior. A vignette study with 1988 respondents shows that when i-deals are considered distributively unfair, co-workers try to restore equity through (...) voice behavior, thereby making the i-deal less effective. Furthermore, i-deals spark more distributive injustice perceptions and voice behavior in a highly interdependent work context. Finally, on average, financial bonuses were considered most distributively unfair and, thus, trigger more voice behavior. These results have important implications for i-deal literature as they uncover the criteria that co-workers use to judge i-deals and shape their reactions. (shrink)

In February 2020, the British Medical Association will be surveying members for their views on what the BMA’s position on physician-assisted dying should be. The BMA is currently opposed to physician-assisted dying in all its forms, a position that was agreed in 2006 at the annual representative meeting, the Association’s policy-making conference.1 As previously reported in Ethics briefing,2 the decision to survey members follows a motion passed at last year’s ARM which called on the BMA to “carry out a poll (...) of members to ascertain their views on whether the BMA should adopt a neutral position with respect to a change in the law on assisted dying”. The results from the survey will not determine BMA policy. Rather, the results be published ahead of this year’s ARM and provided to those attending to inform a debate and discussion on the BMA’s policy position. In clinical practice, decision-making is not performed by individual knowers but by an assemblage of people and instruments in which no one member has full access to every piece of evidence. This is due to decision making teams consisting of members with different kinds of expertise, as well as to organisational and time constraints. This raises important questions for the epistemology of medicine, which is inherently social in this kind of setting, and implies epistemic dependence on others. Trust in these (...) contexts is a highly complex social practice, involving different forms of relationships between trust and reasons for trust: based on reasons, and not based on reasons; based on reasons that are easily accessible to reflection and others that are not. In this paper, we focus on what it means to have reasons to trust colleagues in an established clinical team, collectively supporting or carrying out every day clinical decision-making. We show two important points about these reasons, firstly, they are not sought or given in advance of a situation of epistemic dependence, but are established within these situations; secondly they are implicit in the sense of being contained or nested within other actions that are not directly about trusting another person. The processes of establishing these reasons are directly about accomplishing a task, and indirectly about trusting someone else’s expertise or competence. These processes establish a space of reasons within which what it means to have reasons for trust, or not, gains a meaning and traction in these team-work settings. Based on a qualitative study of decision-making in image assisted diagnosis and treatment of a complex disease called pulmonary hypertension (PH), we show how an intersubjective framework, or ‘space of reasons’ is established through team members forging together a common way of identifying and dealing with evidence. In dealing with images as a central diagnostic tool, this also involves a common way of looking at the images, a common mode or style of perception. These frameworks are developed through many iterations of adjusting and calibrating interpretations in relation to those of others, establishing what counts as evidence, and ranking different kinds of evidence. Implicit trust is at work throughout this process. Trusting the expertise of others in clinical decision-making teams occurs while the members of the team are busy on other tasks, most importantly, building up a framework of common modes of seeing, and common ways of identifying and assessing evidence emerge. It is only in this way that trusting or mistrusting becomes meaningful in these contexts, and that a framework for epistemic dependence is established. (shrink)

Standard readings of Kant's ethical thought usually focus on the Groundwork, and, more particularly, in the application of the categorial imperative to any given maxim. In doing so, the standard readings do not take into account the necessary role of judgment in this process. After sketching the difference between determining and reflective judgment, and enlarging our view of Kant's ethics beyond the basic principles conveyed in Groundwork, the author discusses which may be the role of reflective judgment in Kant's moral (...) thought. The aim of this paper is to explore how children learn to form new relationships with nature. It draws on a longitudinal case study of children participating in a stewardship project involving the conservation of salamanders during the school day in Stockholm, Sweden. The qualitative method includes two waves of data collection: when a group of 10-year-old children participated in the project (2015) and two years after they participated (2017). We conducted 49 interviews with children as well as using participant (...) observations and questionnaires. We found indications that children developed sympathy for salamanders and increased concern and care for nature, and that such relationships persisted two years after participation. Our rich qualitative data suggest that whole situations of sufficient unpredictability triggering free exploration of the area, direct sensory contact and significant experiences of interacting with a species were important for children’s development of affective relationships with the salamander species and with nature in an open-ended sense. Saving the lives of trapped animals enabled direct sensory interaction, feedback, increased understanding, and development of new skills for dynamically exploring further ways of saving species in an interactive process experienced as deeply meaningful, enjoyable and connecting. The behavioural setting instilled a sense of pride and commitment, and the high degree of responsibility given to the children while exploring the habitat during authentic situations enriched children’s enjoyment. The study has implications for the design of education programmes that aim to connect children with nature and for a child-sensitive urban policy that supports authentic nature situations in close spatial proximity to preschools and schools. An analysis of the famous distinguishes five material layers, including making, coding, forensic and epistemic materiality, as well as the notion of trans-materiality. Each layer is developed in relation to theoretical concepts of materiality in media studies, art history, computer science, and anthropology.

Anhand einer Analyse des berühmten Utah teapot werden fünf materiale Schichten unterschieden, darunter Herstellung, Codierung, forensische und epistemische Materialität, sowie der Begriff der Trans-Materialität. Empirical success is a central criterion for scientific decision-making. Yet its understanding in philosophical studies of science deserves renewed attention: Should philosophers think differently about the advancement of science when they deal with the uncertainty of outcome in ongoing research in comparison with historical episodes? This paper argues that normative appeals to empirical success in the evaluation of competing scientific explanations can result in unreliable conclusions, especially when we are looking at the changeability of direction in ongoing investigations. The challenges (...) we encounter arise from the inherent dynamics of disciplinary and experimental objectives in research practice. In this paper we discuss how these dynamics inform the evaluation of empirical success by analyzing three of its requirements: data accommodation, instrumental reliability, and predictive power. We conclude that the assessment of empirical success in developing inquiry is set against the background of a model’s interactive success and prospective value in an experimental context. Our argument is exemplified by the analysis of an apparent controversy surrounding the model of a quantum nose in research on olfaction. Notably the public narrative of this controversy rests on a distorted perspective on measures of empirical success. (shrink)

Cet article analyse comment les spécificités des interactions textuelles, numériques, et du « français sourd » sont prises en compte dans les appels d'urgence par SMS, et quelles « prises », ou indices, sont mobilisés par les agents pour percevoir le niveau de détresse ou la (...) gravité d'une urgence. Dans ce contexte et au regard de ces enjeux, comment se jouent le dévoilement de l'identité et de la situation singulière de ces requérants? L'analyse de ces pratiques de communication, a fortiori de ces pratiques professionnelles, révèle la prise en compte incontournable des compétences linguistiques, langagières et interactionnelles en jeu. Force-feeding of detainees at Guantánamo BayIn April, the US Department of Defense reportedly sent 40 additional military medical personnel, including doctors and nurses, to the Guantánamo Bay Naval Base to carry out the force-feeding of detainees on hunger strike.1 By the end of June, up to 104 of the remaining 166 individuals held in US military detention at Guantánamo were refusing food. The protest against conditions at the base, and the fate of those being held there—including those already cleared for (...) transfer or release—began in February 2013. In June, it was reported that as many as 44 of the hunger strikers were being force-fed by military medical teams.2The response by the US authorities to the hunger strike prompted expressions of outrage from the international medical community.3,4 In April, the American Medical Association wrote to the US secretary of defense, insisting that ‘forced feeding of [competent] detainees violates core ethical values of the medical profession.’5 Adding the voice of the profession in the UK to these calls, at its annual conference in June, the British Medical Association condemned the participation of doctors and nurses in the force-feeding, calling on governments worldwide to ensure that all prisoners have access to confidential, independent medical treatment, and supporting any clinician who challenged cruel, inhuman or degrading treatment. Also in June, the BMA Chairman wrote to President Obama and US secretary of defense, Hagel, urging them to immediately suspend medical involvement in force-feeding at Guantánamo, and to institute an urgent inquiry into how the current situation was allowed to develop.Force-feeding mentally competent adults who are refusing food is a clear violation of medical ethics and is unjustifiable, as articulated by the World Medical Association's Declaration of Malta.6 Doctors with dual loyalties, including military doctors, are bound by the same …. In Switzerland, research with identifiable human tissue samples, and/or its accompanying data, must be approved by a research ethics committee before it can be allowed to take place. However, as the demand for such tissue has rapidly increased in recent years, and biobanks have been created to meet these needs, committees have had to deal with a growing number of such demands. Detailed instructions for evaluating every kind of tissue request are scarce. Committees charged with evaluating research protocols therefore sometimes (...) face uncertainty in their decision-making. We examine how a pool of Swiss REC members deal with a number of cases involving human tissue, in order to determine the standards they adhere to, and their understanding and implementation of existing laws and guidelines. There is considerable divergence in the approaches and decisions of Swiss REC members regarding human tissue sample requests, particularly concerning the issue of informed consent. Despite recent trends towards less strict consent requirements for biosample research, many of our respondents continue to employ demanding standards for researchers. The question of informed consent, and the circumstances in which it is required, continues to result in differences of opinion. While room for local and cultural interpretation is essential to the workings of an REC, misunderstanding of existing guidelines, or an absence of regulation in sensitive areas, will only lead to suboptimal functioning of the REC itself. Our data suggests that there is uncertainty and disagreement on the question of consent for human tissue sample, which existing laws and guidelines may not fully clarify. Methods to address these uncertainties should be implemented in order to ensure efficient and harmonious review of research protocols. (shrink)

### High Court rejects assisted dying challenge The High Court has rejected the latest challenge to the law on assisted dying in the UK, brought by Noel Conway. Mr Conway, a retired college lecturer, was diagnosed with motor neuron disease in 2012. Since his diagnosis, his health has deteriorated and he is dependent on ever-increasing levels of assistance with daily life, including the use of non-invasive ventilation to help him breathe. He sought a declaration from the court that section 2 (...) of the Suicide Act 1961 was incompatible with his right to a private and family life under Article 8 of the European Convention on Human Rights. As part of his case, Mr Conway submitted the outline of an alternative statutory scheme, which he argued, if implemented, would provide sufficient safeguards. He submitted that the prohibition on assisted suicide should not apply where an individual is aged 18 and over; has been diagnosed with a terminal illness and has a clinically assessed prognosis of 6 months or less to live; has the mental capacity to make the decision; makes that decision in a voluntary, clear and settled manner; and retains the ability to undertake the final act. Additionally, two doctors must confirm that the individual meets the criteria, and permission for the provision of assistance must be authorised by a High Court judge. Previous challenges to the UK law on assisted dying, including Pretty and Nicklinson, had established that section 2 of the Suicide Act does engage individual’s Article 18 rights, but that such an interference could be justified under Article 8 of the ECHR, which permits interference ‘such as is in accordance with the law and necessary in a democratic society in the interests of national security, public safety or the economic well-being of the country’. Recent decades have seen an increasing tendency to exclude the phenomenon of personality from the metaphysical investigation of personal identity. We are advised not to confuse personal identity as a philosophical subject, namely as the metaphysical issue of specifying what it is that makes a person staying numerically self-identical over time, with the psychological question of 'personal identity' which asks what makes someone the individual person they are with their particular character and history. However, one might be unsatisfied with this. (...) If (as common sense takes for granted) persons are to be conceived as beings possessing a personality, should there not be some more than superficial connection between personality and personal identity in the philosophical sense? This paper investigates this question by revealing the guiding - metaphysical assumptions behind the claim that personality and personal identity must be treated separately as well as by presenting the metaphysical alternative brushed aside by the adherents of this claim. In fact, I argue, there are two opposing views of the relation between personality and personal identity, these being grounded in two opposing metaphysical models of what a person is: the substance model and the bundle model of the person. However, it turns out that ultimately both competing models fail for fundamental reasons, which raises the question of what a way out of the dilemma might look like. (shrink)

The argument from potentiality for embryo protection relies on the assumption of a specific developmental potential of human embryos: as human embryos under normal conditions naturally developing into beings whose strong moral status is uncontroversial, namely into human persons, they likewise enjoy strong moral status. In my paper, I endeavour to spell out the ontological foundations of the argument from potentiality and to discuss them critically in the light of new empirical findings in embryology. Particular attention is hereby paid to (...) recent attempts to analyse the relevant notion of potentiality in terms of dispositions possessed by human embryos. I argue that, putting aside inappropriate essentialist speculations, there is no straightforward disposition of an embryo to become a person; such a disposition, if any, being rather successively generated in a multi-factored, highly context-sensitive process of biological development. Previous Ethics briefings have charted the unprecedented developments in relation to the law on abortion in Northern Ireland this year,1 resulting in legislation being passed by the UK government that ‘decriminalised’ abortion in Northern Ireland, up to the point at which a fetus ‘is capable of being born alive’, from 22 October 2019. A new legal framework and supporting guidelines on abortion are now set to be introduced by 31 March 2020—which should reflect the recommendations in the 2018 United Nations’ (...) Committee on the Elimination of Discrimination against Women report on abortion in Northern Ireland.2 ### Interim guidance In anticipation of this period between decriminalisation and the introduction of a new legal framework, on 7 October 2019 the UK government’s Northern Ireland Office published interim factual guidance for healthcare professionals on their responsibilities to patients in light of these changes.3 Among other things, the guidance notes that there are no plans for additional services to be routinely available in Northern Ireland before 31 March 2020. There will, however, be fewer restrictions on which women in Northern Ireland can access funded abortion services in England via the Central Booking Service—doctors should direct women to this service.4 If healthcare professionals do offer additional abortion services in Northern Ireland itself ‘they should do so in line with their professional competence and guidance from their professional body’. The guidance recognises that some women may still purchase drugs that cause abortions online during this interim period. The difference now is that should a woman require medical assistance as a result, there is no obligation on healthcare professionals to report the woman to the police as abortion, in these circumstances, is not a crime. This article discusses Dewey’s The Public and Its Problems (1927), Ethics (1932), “Theory of valuation” (1939), Art as Experience (1934) and A Common Faith (1934), for the socio-anthropological analysis of the religious, in a context of diversity and anxiety about identities. This pragmatist approach enables to consider religious in the making, experience and self-construction. The concept of ideal, taking into account intersubjectivity and context, allows treating aspirations and ideals. Finally, the idea of public and pre-political, permits to pay attention to (...) processes which are different from differentiation and where people contribute to the common good from their specific (minority) situation. Toutefois, les imprécisions successives du législateur n’ont pas permis d’en cerner clairement les contours. De fait, cette notion se décline aujourd’hui selon des modes pluriels. À cet égard, deux pratiques médiatives nées de l’activité de la DGFiP illustrent bien la diversité des expressions de ce phénomène. Si les garçons sont très présents dans ce corpus, quelques fillettes et jeunes filles ont également des activités ludiques. Cet article analyse trois textes en étudiant la dimension genrée de ces amusements et le discours sur l’enfance qu’ils livrent, tout en réévaluant nos définitions contemporaines du jouet appliquées aux mondes anciens. Le contenu et la portée de l'ouvrage se déploient sur trois plans. Alliant outils d'histoire intellectuelle et approche philosophique, cet ouvrage jette tout d'abord un éclairage nouveau sur le problème de l'historicisme du point de vue de sa dimension pratique et de son rapport avec la philosophie politique au cours des années 1930 de même que durant la période de l'après-guerre. L'approche novatrice du livre conjugue épistémologie de l'histoire et théorie politique et permet de mettre en contexte la mobilisation politique (...) et idéologique du concept d'historicisme et ses corollaires, le relativisme et le nihilisme. La seconde partie du manuscrit traite plus directement d'une question centrale en philosophie politique, celle des fondements de la rationalité politique. À partir d'une réflexion sur la réception de la philosophie des valeurs de Max Weber, l'ouvrage aborde la question des possibilités et limites du jugement politique en temps de crise. Ensuite, cet ouvrage examine une dimension peu étudiée des oeuvres respectives de Leo Strauss et Raymond Aron. D'un point de vue historiographique, le livre montre que la reconstruction du dialogue amorcé entre les deux penseurs (à partir de sources d'archives incluant correspondances, transcriptions de séminaires et textes inédits) permet de jeter une lumière nouvelle sur la façon dont on peut conceptualiser l'utilité de l'histoire pour la philosophie politique. Finalement, dans le champ disciplinaire de la philosophie politique contemporaine, la figure de Raymond Aron est souvent peu considérée. L'une des visées de ce manuscrit est de montrer la pertinence de la philosophie aronienne du jugement et de la responsabilité politique. (shrink)

L’article présente la concordance et les accordages entre le travail processuel du psychologue en visite médiatisée et les fonctions maternelles assurées par l’assistant(e) familial(e) auprès de l’enfant accueilli. Dans une approche inter et transdisciplinaire garantie par un métacadre institutionnel sécurisant, le psychologue clinicien se trouve à l’articulation de ces instances complémentaires. Les enfants amenés à rencontrer leur(s) parent(s) en visite médiatisée se sont développés dans une famille aux liens pathologiques. Le clinicien vient assurer une fonction de moi-auxiliaire pour l’enfant, favorisant (...) l’émergence d’une autonomisation psychique possible quant à sa relation avec ses parents. Au sein de l’accueil familial, l’enfant exprimera les modalités relationnelles qui sont siennes, trouvera chez l’assistant(e) familial(e) une nouvelle figure parentale d’identification et d’attachement. La situation de Clémence illustre les effets subjectivants de chacun des cadres d’intervention et par-delà le travail inter et transdisciplinaire mené. (shrink)

In his famous essay „Der Essay als Form“ („The Essay as Form"), Adorno accuses Descartes of committing science to the ideal of absolute certainty (“zweifelsfreie Gewissheit”), thereby preluding the modern organized science (“organisierte Wissenschaft”), which in Adorno’s view has become alienated from real intellectual experience (“geistige Erfahrung”). In my essay, I criticize Adorno’s critique, showing that what Descartes in fact thinks about task and method of science comes much closer to the programmatical essayism of Critical Theory than Adorno supposed.
