This article offers a critical reading of what Julia Kristeva calls ‘woman’s primary homosexuality’ and discusses homophobia in Kristeva’s work. If we are to draw conclusions on the merits and limitations of Kristeva’s theories of sexuality, homophobia needs to be assessed within the aesthetic and ethical contexts that typify Kristeva’s overall oeuvre. The article shows that we can apply Kristeva’s semiotic/symbolic model of signification to sexuality and argues for the construction of ‘primary homosexuality’ as the manifestation of resistance to authorized (...) sexual identity. The article also shows why the political demands to recognize lesbianism as a valid form of sexuality and especially as an intelligible lifestyle go against Kristeva’s understanding of what resistance entails. This paper describes the construction method of a legal application ontology. This method is based on the merging of micro-ontologies built from European community directives. The terminae construction method from texts enhanced by an alignment process with a core legal ontology is used for building micro-ontologies. A merging process allows constructing the legal ontology.

In three experiments, picture quality between test items was manipulated to examine whether subjects’ expectations about the fluency normally associated with these different stimuli might influence the effects of fluency on preference or familiarity-based recognition responses. The results showed that fluency due to pre-exposure influenced responses less when objects were presented with high picture quality, suggesting that attributions of fluency to preference and familiarity are adjusted according to expectations about the different test pictures. However, this expectations influence depended on subjects’ (...) awareness of these different quality levels. Indeed, imperceptible differences seemed not to induce expectations about the test item fluency. In this context, fluency due to both picture quality and pre-exposure influenced direct responses. Conversely, obvious, and noticed, differences in test picture quality did no affect responses, suggesting that expectations moderated attributions of fluency only when fluency normally associated with these different stimuli was perceptible but difficult to assess. ‘The regulation of gender in menopause theory’ offers a critical commentary on some key theories of menopause experience. It aims to show that the theorisation of menopause keeps to the same epistemic and ideological lines as hegemonic understandings of gender identity. Narratives of menopause has become one of the means by which one can learn to cite women’s gender correctly. In reverse, relating menopause experience against the grain of established narratives is becoming the means by which one may resist epistemic (...) bias and dominant ideology of gender. Moreover, I am proposing that while menopause experience is an important aspect of gender identity formation and its resistance, it is also becoming a new area for identity politics in general, and more particularly the site of dissident narratives. In his review of Bernard Williams' Ethics and the Limits of Philosophy, Hart eloquently formulated an apprehension that still haunts much of contemporary jurisprudence: if the moral 'I must' has to be 'seen as coming not from outside, but from what is most deeply inside us? the fear is that this will not be enough'. I argue that this fear is the byproduct of the dualist outlook within which Hart—and a significant part of contemporary legal theory—is confined: because of his (...) bald naturalist premise, Hart could not conceive of moral objectivity except in terms presupposing an order of Reason resolutely distinct from the 'natural' world. This paper seeks to debunk this dualist outlook by engaging with the kind of 'non-bald' naturalism advocated in different ways by both McDowell and Blackburn. In considering contemporary efforts to draw a middle way between ethical scepticism and metaphysical rationalism, the paper draws on the pragmatic elements emerging from the confrontation between Habermas and Rawls. This article opens with the questioning of a now established scholarly category, `French feminism'. It proposes that theoretical and polemical understandings of `French feminism' have been founded on an opposition to its counterpart, `Anglo-American feminism'. The measure of this opposition has been defined mostly as geographical, linguistic and cultural. But underneath such constructions often lies the old sameness vs difference debate that has captivated feminism since the suffragettes. The article argues for a less oppositional and less discounting definition of the (...) two strands of feminism. It proposes to read oppositional classifications as motivation for a dialogue addressed to the `other ' of theoretical constructs; questioning the likelihood of foregoing oppositional classification. The article revisits the idea that writing may be gendered and asks whether we can define what a “woman writing” practice might be. We do this through a comparative study of the work of Julia Kristeva and Judith Butler. Both have expressed reservations about, even objected to, the essentializing of gender and therefore of writing as a woman. They have, however, provided us with useful tools to define what a non-essentialist understanding of “woman” might entail. The article proposes to do (...) three things: first, to look at the way each author presents “woman” and what I term “woman writing” in their work; second, to find, beyond epistemic differences, the common grounds shared by the two authors; and third, to clarify the places where the two disagree. In a concluding part, we will highlight how that disagreement is reconciled in revisiting Kristeva’s and Butler’s use of loss in their apprehension of “woman,” allowing us to formulate a non-essentialist definition of “woman writing.”. This study seeks to gain knowledge about key conditions in the process of digitalization using a socio-technical systems design as a theoretical framework and a case-study approach. Semi-structured interviews with 15 relevant stakeholders are conducted to learn about barriers to and enablers of the development and implementation process in a manufacturing company. After conducting a thematic analysis, eight higher-ranked themes relevant to the digitalization process are identified. These are grouped to describe the overarching phenomena, resulting in four enablers and four (...) barriers. The study takes a holistic view of digitalization in its investigation of the development and subsequent implementation processes. The findings contribute to the literature via three key takeaways for stakeholders of a digitalization process in manufacturing. First, it is vital to understand and strengthen the role of the key enablers identified in this paper. Second, managers should observe and identify barriers in their own organizations, related both to technical and social aspects. Third, some of the enablers described in this paper can serve managers as helpful tools to approach the expected barriers to digitalization. This paper also challenges the research literature by arguing that research conducted on digitalization that sets new standards and premises for the working life in industry needs to use up-to-date socio-technical design concepts and theories. The internet is a major part of our lives today. This applies to politics as well, and accordingly, the question of whether it is possible to realize democracy on the internet has arisen. Using the arguments of Hannah Arendt, the paper aims to determine what online democracy should look like. It is argued that the internet's decentralized structure is advantageous because it facilitates the implementation of the Arendtian system of political councils. Due to the character of online political platforms – (...) mainly social media – these political councils should ideally revolve around shared issues that simultaneously create the common world on the internet. At the same time, clear rules need to be laid down for the functioning of these online political councils. Based on Arendt's arguments, it is claimed in the paper that these rules include the principles of mutual promises and covenants on the issues themselves. It is also argued that because Arendt emphasizes the role of appearing in the public sphere, the process of authentication – that is, verifying that there is a concrete person with a physical body behind each online account that wants to actively participate in a particular online political council – is required. The main purpose of this article is to bring into relief the difficulties faced by generous interpretations of the Kantian problem of poverty and to propose an alternative interpretation which (a) agrees with some generous interpretations that Kant's juridical treatment of poverty is to be understood by analogy with his juridical treatment of slavery, but which (b) departs from generous interpretations in general by arguing that this analogy is not to be understood in terms of “dependence” as such, but in (...) terms of “depersonification.” More specifically, it argues that what makes slavery and poverty unjust for Kant is not that they entail a human being finding herself (completely) dependent on the choice of another human being, but that they entail a human being being deprived of her juridical personality. The Kantian problem of poverty is ultimately a problem of juridical depersonification, and this problem of juridical depersonification does not arise in all (complete) dependence relations. (shrink)

The use of airbrushed “thin ideal” models in advertising creates major ethical challenges: This practice deceives consumers and can be harmful to their emotional state. To inform consumers they are being deceived and reduce these negative adverse effects, disclaimers can state that the images have been digitally altered and are unrealistic. However, recent research shows that such disclaimers have very limited impact on viewers. This surprising result needs further investigation to understand how women who detect that images have been airbrushed (...) are still harmed by them. Three studies reported in this article address this question. The authors identify a typology, based on a combination of three emotional reactions experienced by women who are exposed to the airbrushed thin ideal. In further analyses, they investigate how detection of airbrushing—whether spontaneous or with the help of a disclaimer—relates to these emotional reactions and women’s attitudes to altered images. Results show that detection of airbrushing does not systematically protect women from either wanting to look like airbrushed thin models or the negative emotions triggered by exposure to thin ideal images, nor does it always generate defensive reactions toward ads using such images. Women who detect that images have been airbrushed may still process these images as realistic. In addition to discussing this irrational process of self-deception, this article suggests policy interventions to prevent it. (shrink)

Le système de filiation matrilinéaire s’est installé dans le judaïsme sur la base de l’interprétation du dit talmudique affirmant Ton fils né d’une idolâtre n’est pas ton fils mais le sien (Qid. 68b). Il entérinait un processus enclenché quelques siècles plus tôt, à l’époque de la Mishna, autour du premier siècle de l’ère, mettant un terme (...) à la longue tradition biblique qui ne percevait de filiation que patrilinéaire, et instaurait, ce faisant, un modèle de transmission de la judéité qui perdure jusqu’à nos jours. Cette transformation majeure était-elle due à une évolution interne de la pensée rabbinique rationalisant la judéité au regard des affiliations? Ou à des contraintes extérieures liées à l’imposition de nouvelles réglementations du statut de la personne? Les deux hypothèses d’interprétations sont débattues – et parfois se rejoignent – dans les recherches menées sur la filiation ou l’identité juive. Cet article examine les conditions de la transmission de l’identité de la personne, telles qu’elles ont été traitées et définies au long des siècles par l’institution de normes juridiques et sociales régulant la filiation, la conversion et l’héritage, toutes normes qui éclairent les évolutions du statut de la femme dans l’histoire du judaïsme entre l’Antiquité tardive et le Moyen Âge. Considering the sensory dimension of clinical decision-making is a challenge for the training of health professionals. Therefore, how can we help them stimulate a form of sensory acuity? We conducted a study in partnership with the Simulation Laboratory of a Canadian hospital to understand the sensory work accomplished by nurses during a clinical decision-making. To do this, we analyzed the interactions occurring during focus groups to reveal the sensory work performed by nurses during the clinical evaluation of patients (personas).

In lieu of an abstract, here is a brief excerpt of the content:Philosophy and Rhetoric 36.2 (2003) 103-108 [Access article in PDF] Defining, Using, and Challenging the Rhetorical Tradition Alisse Theodore Portnoy "What counts as 'the tradition'?" was the question that provoked this series of essays. Several of us attended a retreat sponsored by the Rhetoric Society of America, and we had dutifully split into smaller groups in an attempt to define or mark rhetoric as a discipline. Patricia Bizzell (...) and Bruce Herzberg had recently published the second edition of their The Rhetorical Tradition, and Michael Leff wanted to know what criteria Bizzell and Herzberg used as they revised the tradition. Bizzell was part of the group and responded. Jacqueline Jones Royster also responded to the opening question as the terrain shifted from defining to using and—quite naturally for everyone in the room—challenging the tradition. Maurice Charland soon entered into this Burkean parlor, despite his refusal to call rhetoric a discipline.One product of this ongoing conversation was a panel at the 2002 RSA biennial conference, from which the essays in this special issue of Philosophy & Rhetoric emerged. In their essays, Bizzell (English), Charland (Communication Studies), Leff (Communication Studies), and Royster (English) agree on several key points, the most basic of which are not only the existence but also the dynamic nature of a rhetorical tradition. The essayists agree that contemporary users of the tradition have agency in its constitution, and that texts by "performers" as well as by rhetorical theorists have a place in the tradition. But all of the essays have different starting points and offer us myriad ways to think about the rhetorical tradition.Patricia Bizzell writes with a unique perspective, having, as she says, edited the tradition—twice. In "Editing the Rhetorical Tradition," Bizzell takes stock and quickly accounts for us her sense of the "traditional tradition," or the tradition's blue chip stocks, and then offers tips on high risk and growth stocks. Playing with the stock market metaphor, Bizzell imagines [End Page 103] as high-risk stocks the texts or authors who have been marginal players, figures for whom presence is assured but reputation is not. Their reputations fluctuate depending on the ways "they can be made to serve the cultural preferences of those in power." Also contributing to what Bizzell calls "new traditions" are "thinkers who were practically unknown to traditional historians of rhetoric, sometimes because we did not have the methodological and pedagogical approaches necessary to construe their texts as rhetoric and sometimes because their work itself was hidden from scholarly view, fragmented, or lost." Bizzell outlines three ways these "growth stocks" enter into the tradition as she acknowledges the "whole new set of [scholarly] priorities" these texts often require.But just the novelty of these texts can pose challenges. Bizzell uses an exchange that occurred during the question period of the RSA session to suggest that texts might appear more abstract and philosophical, and therefore (mistakenly) more complex and valuable, simply "because we have the benefit of generations of scholarship and pedagogy assisting us to read these texts as rhetorical theory." Bizzell also argues that a metacritical awareness of the constraints upon language use makes a text theoretical even as it seems primarily "performative." In other words, more than a few "new tradition" texts count as contributing to rhetorical theory because they advocate non-traditional rhetorical practices or non-traditional access to conventional rhetorical spaces in the performance of the text.Bizzell reports the increased inclusion of these "growth stocks," the "thinkers who were practically unknown," even as she admits that reviewers for the second edition of The Rhetorical Tradition asked for more, not less, of the traditional tradition. And so as she concludes Bizzell refuses to see the composition of the tradition as a matter of contention or animosity. In fact, contemporary theology reflects on believing experience. We could put the question this way: where and how can theology take charge of spiritual life, valorizing the Christian capital of spiritual experience ? Is it through a specific discipline, spiritual theology? What would characterize it ? In order to think through the way spiritual theology is developing, we shall begin by observing, thanks to a few examples of significant theological texts, how contemporary theology takes into account the experiential dimension of Christian faith. However, is taking into account this constitutive part of experience the same as taking charge of spiritual experience ? This Element argues that although Kant's political thought does not tackle issues of global poverty and inequality head on, it nonetheless offers important conceptual and normative resources to think of our global socioeconomic duties. It delves into the Kantian duty to enter a rightful condition beyond the state and shows that a proper understanding of this duty not only leads us to acknowledge a duty of right to assist states that are unable to fulfil the core functions of a state, (...) but also provides valuable hints at what just transnational trade relations and a just regulation of immigration should look like.
