Se busca repensar en términos epistemológicos la enseñanza del locus de enunciación latinoamericano. Se tiene en cuenta que el proceso de desarrollo y consolidación de la razón moderna como forma de compresión de la realidad latinoamericana ha destruido sistemáticamente otras formas de pensar, incluidas las de los pueblos originarios americanos. Clinical bioethics plays a significant role in hospital settings through bioethics consultations, which focus on providing ongoing assistance in complex situations within the doctor-patient dynamic. These consultations entail regular interaction between physicians and clinical bioethicists. This situation prompts an exploration into how bioethics consultations affect physicians. The current research aims to understand the influence of bioethics consultations on physicians’ bioethical knowledge by analyzing the lexical content in their patients’ medical records. Medical records are a synthesis carried out by physicians, often (...) reflecting collaborative efforts, and capturing verbal statements indicative of thought processes suggestive of learning. The study is a sequential mixed-methods design with a retrospective descriptive approach, comparing medical records from the early years of the Department of Humanism and Bioethics’ operation (2013–2015) to the more recent ones (2019). Technical bioethical terminology such as “therapeutic effort limitation,” “futility,” “beneficence,” and “respect for autonomy” is more prevalent in recent medical records. This trend may stem from the positive impact of bioethics consultations conducted by the Department, with haptic communication serving as a particularly effective form of interaction with others during experiences of moral distress. Teniendo en cuenta que la filosofía es hija de la polis, a primera vista, el tema de la filosofía de la ciudad puede no revelar nada nuevo. De hecho, la filosofía y la ciudad cuentan una historia paralela. Es en el ágora, un espacio privilegiado para el ejercicio de la ciudadanía, donde la filosofía se desarrolla como debate de argumentos. Pero, aunque a lo largo de la historia las ciudades puedan reflejar un deseo civilizatorio, lo cierto es que la ciudad (...) contemporánea refleja muy poco de la realidad política de la polis, de la indiferenciación medieval entre lo público y lo privado o de la racionalidad normativa de la ciudad moderna. Las ciudades en el siglo xx, y especialmente en el siglo xxi, tienen que ver más con las relaciones sociales y económicas de la ciudad industrial y posindustrial. La progresiva mecanización del siglo xix y su extensión, en el siglo xx, a la automatización y a la digitalización, cambian definitivamente la forma en que nos relacionamos, pensamos y trabajamos —en resumen, cómo vivimos—. Con el establecimiento de un capitalismo de orden económico que afecta a todas las dimensiones de la vida de la ciudad, esta queda delimitada por el poder, revela las contradicciones de las sociedades urbanas diseñadas por los mercados y da lugar, según David Harvey, a la apropiación privada de la vida y los espacios. Recent events at Enron, K-Mart, Adelphia, and Tyson would seem to suggest that managers are still experiencing ethical lapses. These lapses are somewhat surprising and disappointing given the heightened focus on ethical considerations within business contexts during the past decade. This study is designed, therefore, to increase our understanding of the forces that shape ethical perceptions by considering the effects of business school education as well as a number of other individual-level factors (such as intra-national culture, area of specialization within (...) business, and gender) that may exert an influence on ethical perceptions. We found significant effects for business education, self-reported intra-national culture, area of specialization within business, and gender for some and/or all areas of ethics examined (i.e., deceit, fraud, self-interest, influence dealing, and coercion). One of our most encouraging findings is that tolerance for unethical behavior appears to decrease with formal business education. Despite the prevalent stereotype that business students are only interested in the bottom line or that business schools transform idealistic freshman into self-serving business graduates, our results suggest otherwise. Given the heightened criticism of the ethicality of contemporary managerial behavior, it is heartening to note that, even as adults, individuals can be positively affected by integration of ethics training. Grounded theory, a research method born out of the social sciences field, offers a flexible technique that allows simultaneous data collection and processing. Researchers using this method immerse themselves in an area of study, focusing their observations on the data and taking into consideration not only their own interpretations, but also those of the other subjects involved, in order to strengthen their understanding of the social phenomena under examination. La teoría fundamentada, nacida al interior de las ciencias sociales, es un método de investigación que posee una técnica flexible y que realiza simultáneamente la recolección y el procesamiento de los datos. En este método, el investigador se encuentra inmerso en el campo de estudio y sus observaciones se abocan al dato, considerando tanto su interpretación como la de los otros sujetos implicados, con la finalidad de fortalecer la comprensión del fenómeno social investigado. Purpose: This systematic review aimed to analyze the impact that the COVID-19 lockdown had on the amount of physical activity performed by university students.Materials and Methods: A systematic electronic search for studies providing information regarding physical activity levels pre and during COVID-19 pandemic in university students was performed up to 20th October 2020 in the databases Cochrane Library, PubMed, SPORTDiscus, and Web of Science. The risk of bias of external validity quality of included studies was assessed by means of those (...) the Newcastle-Ottawa Scale. The quality of the evidence for main outcomes was graded using the Grading of Recommendations Assessment, Development and Evaluation approach.Results and Conclusions: A total of 10 studies were selected. Physical activity levels were assessed by means of questionnaires and accelerometer. Risk of bias was regarded as low and high in six and four investigations, respectively. The quality of evidence was downgraded to low. A significant reduction of physical activity levels were observed in 9 studies. Compared to pre-lockdown values, five studies showed a reduction of light/mild physical activity between 32.5 and 365.5%, while seven studies revealed a reduction of high/vigorous physical activity between 2.9 and 52.8%. Walking, moderate, vigorous, and total physical activity levels have been reduced during the COVID-19 pandemic confinements in university students of different countries. Despite of the reductions, those who met the current minimum PA recommendations before the lockdown generally met the recommendations also during the confinements. (shrink)

The organ donation and transplantation (ODT) system heavily relies on the willingness of individuals to donate their organs. While it is widely believed that public trust plays a crucial role in shaping donation rates, the empirical support for this assumption remains limited. In order to bridge this knowledge gap, this article takes a foundational approach by elucidating the concept of trust within the context of ODT. By examining the stakeholders involved, identifying influential factors, and mapping the intricate trust relationships among (...) trustors, trustees, and objects of trust, we aim to provide a comprehensive understanding of trust dynamics in ODT. We employ maps and graphs to illustrate the functioning of these trust relationships, enabling a visual representation of the complex interactions within the ODT system. Through this conceptual groundwork, we pave the way for future empirical research to investigate the link between trust and organ donation rates, informed by a clarified understanding of trust in ODT. This study can also provide valuable insights to inform interventions and policies aimed at enhancing organ donation rates. (shrink)

Norms have been widely enacted in human and agent societies to regulate individuals’ actions. However, although legislators may have ethics in mind when establishing norms, moral values are only sometimes explicitly considered. This paper advances the state of the art by providing a method for selecting the norms to enact within a society that best aligns with the moral values of such a society. Our approach to aligning norms and values is grounded in the ethics literature. Specifically, from the literature’s (...) study of the relations between norms, actions, and values, we formally define how actions and values relate through the so-called value judgment function and how norms and values relate through the so-called norm promotion function. We show that both functions provide the means to compute value alignment for a set of norms. Moreover, we detail how to cast our decision-making problem as an optimisation problem: finding the norms that maximise value alignment. We also show how to solve our problem using off-the-shelf optimisation tools. Finally, we illustrate our approach with a specific case study on the European Value Study. (shrink)

Schools are an essential part of students’ lives and can promote and facilitate their well-being. Although research on well-being among school-aged children and adolescents has distinguished subjective well-being from social well-being, very few studies examined student’s social well-being at school. SWS is understood as students’ valuation of the circumstances and functioning of their school. This framework posits that the context of the schools can shape students’ perception of feeling integrated and making significant contributions to their schools. However, not much is (...) known regarding the joint contribution of individual, family, and school characteristics to students’ SWS. This study analyzed these joint contributions in a nationally representative sample of 6,389 children and adolescents enrolled in 5th–11th grades. Findings show that being female and younger were individual predictors of SWS. Students’ satisfaction with their family and fewer changes of schools were also significant contributors. When students’ perceptions of their schools were incorporated, the individual and family characteristics decreased or lost significance. In the full model, the highest contribution to SWS was explained by the school-level aggregated perception of school climate. These findings call for integrated policies and practices to foster students’ sense of belonging, feeling integrated, and contribution to their schools, with a focus on school-level interventions to improve SWS through positive and engaging school climates that foster students’ sense of agency. Health has an important role in the achievement of a good quality of life. Many public policies intended to enhance individual and population health. Amartya Sen’s Capability Approach (CA) offers a framework to assess well-being, as well as interventions seeking to increase it. There are, however, important practical challenges that must be faced before applying CA to concrete situations, such as health. One of these challenges is defining whether it is functioning or a capability that is the feature to be (...) assessed. Moreover, some aspects of freedom that are relevant for CA are frequently neglected, such as agency. These aspects must be considered when performing a health assessment using the CA as a framework. A health assessment using the CA as a framework should include indicators based on the achieved dimension (health functioning), resources and conversion factors (health capability), and freedom to achieve (agency). A humane and respectful treatment of patients by the staff has inspired the creation of the Department of Humanism and Bioethics at the University Hospital of Fundación Santa Fe de Bogotá which not only has met, but even surpassed established goals. Since 2013, the Department has developed different activities that have made it possible to respond more ethically to the daily needs of patients and to strengthen other humanization processes. Currently, the Department of Humanism and Bioethics addresses five lines of (...) work: a continuing education program, an assistance advisory program, support, and strengthening of existing committees, support for the activities of our institutional humanization program and research activities. Rare neuromuscular diseases are a group of pathologies characterized by a progressive loss of muscular strength, atrophy, fatigue, and other muscle-related symptoms, which affect quality of life levels. The low prevalence, high geographical dispersion and disability of these individuals involve difficulties in accessing health and social care services. Teleassistance is presented as a useful tool to perform psychosocial interventions in these situations. The main aim of this research is to assess the effects of a teleassistance psychosocial program on the QoL (...) levels of people with RNMDs who have different levels of disability. A sample of 73 participants was divided into an experimental group, which participated in the intervention, and a control wait list group. QoL was evaluated through the SIP and the SF-36, and disability through the WHO-DAS II. The participants with a moderate to severe level of disability were those who most benefited from the intervention. The results also revealed that the psychosocial teleassistance program was suitable to improve physical and psychosocial aspects of people suffering from a rare neuromuscular disease with a moderate level of disability, but just psychosocial aspects in those with a severe level of disability. Este artículo de revisión examina la importancia que tienen las comunidades microbianas que colonizan los ambien­tes y equipos de procesado de alimentos formando biopelículas o biofilms en la persistencia microbiana en la industria alimen­taria y consecuentemente, en la seguridad y la calidad de los alimentos. La atención se centra especialmente en biopelículas formadas por microorganismos no deseados, es decir, microor­ganismos alterantes y patógenos. Se presenta información so­bre la variabilidad intraespecífica en la formación, la ecología y la arquitectura de las biopelículas, (...) y los factores que influyen en su formación. Se presenta una propuesta de innovación educativa, dirigida al alumnado de Educación Secundaria, fundamentada en el uso de los itinerarios didácticos teatralizados como recurso didáctico con perspectiva de género. Para su confección se pretende una metodología que privilegia los contenidos procedimentales y que fomenta el pensamiento histórico y, por ende, el pensamiento crítico. Los contenidos seleccionados están relacionados con el siglo XVI y XVII y, más concretamente, con la persecución y procesamiento de mujeres por brujería y hechicería por parte del (...) Tribunal de la Inquisición. Para ello se toma como centro de estudio el proceso que se llevó a cabo en Córdoba contra Leonor Rodríguez, lo que llevará al alumnado a reflexionar y a preguntarse sobre los estereotipos de la mujer en la historia, así como en la actualidad, con la intención de formar a una ciudadanía crítica y comprometida. El objetivo de este artículo es definir la concepción del acto involuntario de Francisco Suárez y mostrarla como un medio que permite comprender y profundizar en su teoría de la acción humana. En esta cuestión, el Doctor Eximio parte de presupuestos elaborados por Tomás de Aquino que amplía y adapta siguiendo sus propias tesis metafísicas y teológicas sobre la relación entre Dios y las creaturas. Mostraremos cómo Suárez vincula el verdadero involuntario con el _simpliciter_, lo forzado, necesario e (...) indeseado, dejando al _secundum quid_ como un acto mixto en el que la libertad y la voluntad, pese a las injerencias externas, no quedan anuladas. Por último, subrayaremos las consecuencias de la definición suareciana de lo involuntario sobre la noción de libertad, haciendo patente que tanto una como otra serían imposibles fuera del marco teórico que él sustenta, caracterizado por la eficiencia humana (y su dependencia de la divinidad) y no por la premoción física. Opinions clash among different interpreters of Saint Thomas Aquinas. Stephen Brock's book provides both a magisterial and (...) a definitive answer to this question.Like fine wine, this book has been fermenting and maturing for almost thirty years. Originally a doctoral dissertation, this recently published work has been rewritten, and to a certain extent, reworked by the author with respect to some of its content.Without disregard for nuances, the first chapter introduces the reader to four different groups of Aquinas's interpreters. The first two groups question the full legal character of the natural law in its dependence to the eternal law. The third one questions its naturalness. The fourth group, instead, upholds both the divine origin of the natural law's full legality in its dependence on the eternal law, as well as its natural character.Brock places Dom Odo Lottin, Wolfgang Kluxen, Germain Grisez, and John Finnis in the first group. They maintain that the natural law is a law only in a qualified sense and that it does not entirely fulfill the definition of law. The natural law would provide an intrinsic morality. It should be treated independently from the eternal law. The second group is composed by authors such as Frederick Copleston, Alan Donagan, or Gregory Stevens. Similar to the first group, they argue that the natural law is an autonomous self-standing law, legislated by human reason. Thus, it should be treated independently from the eternal law, except to point out its ultimate origin.The author who exemplifies the third position is Ernest Fortin. Reacting against Finnis, Fortin's position jeopardizes the natural character of the natural law. In his view, the legal force of the first principles of practical reason is not fully actualized until one recognizes the divine institution sanctioning them. [End Page 981]All the authors of the fourth group uphold that the natural law is fully a law on account of its divine origin and that it is also entirely natural insofar as it is naturally known by human reason. Anscombe and Peter Geach. In the course of his whole study, Brock shows how Aquinas's true position differs from the other members of this group. Special attention is given to the differences between Aquinas's true mind and the interpretations offered by Suarez, Farrell, and, to a certain degree, even by Dewan. In order to better appreciate the depth of this process, I have found it very helpful to read Farrell's The Natural Law According to Aquinas and Suarez in conjunction with Brock's work.The second chapter targets the natural law's legal character in its dependence to the eternal law. It proves that Thomas provides a strict definition of the natural law when he says that it is nothing but a participation of the eternal law in the rational creature. This chapter opens with a historical study concerning the influence of the Summa Fratri Alexandri in the Summa theologiae (ST). Aquinas's understanding of the dependence of the natural law on the eternal law turns out to be more systematic and refined. It is based on a fuller comprehension and development of what law is (the ratio legis).The remainder of the second chapter consists in a superb commentary regarding ST, I-II, q. 91, a. 2, on whether something existing in man is fit to be called a natural law. Promulgation is the element of the definition of law that specifies the different kinds of laws. Este artículo tiene como objetivo conceptualizar a los y las menores como víctimas de la violencia de género en el ámbito de la relación de pareja. Para ello, se realizará un diagnóstico previo de las violencias sufridas, necesario para un adecuado tratamiento jurídico político. Análisis que se llevará a cabo a través de una investigación empírica, en la que se pretende revelar las violencias vividas por las mujeres y sus hijos e hijas, la protección que reciben por parte de la (...) Administración de Justicia tras la denuncia, así como las violencias vividas en el régimen de comunicaciones y estancias. En base a los datos obtenidos, se efectuará un examen de las herramientas jurídicas que los y las operadores jurídicos tienen a su alcance en nuestro ordenamiento jurídico para su protección. Nos detendremos en la reciente Ley 4/2015, de 27 de Abril, del Estatuto de la víctima, y en el Proyecto de Ley Orgánica de modif icación del sistema de protección de la infancia y a la adolescencia, donde se reconoce a los y las menores como víctimas, terminando con el contradictorio Anteproyecto de Ley sobre el ejercicio de la corresponsabilidad parental en caso de nulidad separación y divorcio. El objetivo de este artículo es realizar un recorrido sobre la tramitación parlamentaria de la Ley Orgánica 8/2021, de 4 de junio,de protección integral a la infancia y adolescencia frente a la violencia. Se reflexionará sobre el olvido inicial de los y las menores víctimas de violencia de género ysu primer impulso de dar entrada a aquellos planteamientos en los que se pone la atención en la protección del interés superior de la infancia y adolescencia en los casos de ruptura (...) familiar, escondiendo los daños sufridos por la infancia y adolescencia derivados de la violencia de género. Mostraremos cómo, para paliar los daños derivados de la “alta conflictividad” provocada por la ruptura familiar, se está asentando jurisprudencialmente la coordinación de parentalidad. Mediante un análisis jurisprudencial, comprobaremos cómo este método de resolución de conflictos se aplica en contextos de violencia de género, con el objetivo de restablecer o normalizar la relación del padre que ejerce violencia de género con sus hijos e hijas. El objetivo de este artículo es realizar una revisión de la categoría jurídica de Patria Potestad definida por nuestro Código Civil, analizando los valores que la sustentan, desde un posicionamiento feminista y desde la perspectiva de los derechos de las personas menores de edad. Para este examen se efectuará un recordatorio sobre el origen de la Patria Potestad, conectándolo con el nacimiento del patriarcado moderno, diseñado a través del contrato social de Rousseau. Comprobaremos cómo las construcciones ideológicas sobre la familia (...) que cimentaron el surgimiento de la Patria Potestad y su posterior vida se mantienen en la actualidad, escondiéndose tras las resistencias de los operadores jurídicos, en la aplicación de la suspensión del ejercicio de la patria potestad al padre que ejerce violencia de género. Este trabajo tiene como objeto poner de manifiesto las claves suarecianas de la teoría de la libertad, de acuerdo con las cuales la libertad es una potencia activa de la voluntad que, si bien se muestra indiferente en el acto de elección, sin embargo, se trata de una indiferencia activa, en la medida en que el ser humano ejerce una específica causalidad por libertad que tiene su fundamento metafísico en la teoría del acto virtual. El hombre es libre porque el (...) concurso divino no determina el acto de la voluntad libre, sino que deja al libre arbitrio humano la decisión de actuar o no actuar, de hacer una cosa o su opuesta. This paper looks at the interpretation of legal texts, with a special emphasis on the legislative ones, from the semiotic and pragmatic points of view. The interpretation of a legislative text must start by considering it as a product of a communication act, performed through linguistic signs, and therefore it has to be studied within basic semiotic categories. Secondly, legislations are texts, and they must therefore be analyzed with the aid of textual linguistics. Thirdly, legislative texts and their legal utterances (...) are all speech acts, and consequently they must be interpreted from the perspective of the pragmatic theory of speech acts. (shrink)

El paradigma tradicional en el sistema de patentes se basaba en que solo eran patentables las invenciones, lo que indirectamente excluía la materia viva. Sin embargo, la irrupción de la biotecnología en la propiedad industrial ha supuesto un sustancial vuelco en estas premisas, debido, entre otros factores, a que los seres vivos presentan una naturaleza dual, ya que son al mismo tiempo materia viva e información. Además, la aceleración de las investigaciones en lo referente a la biología sintética y a (...) la inteligencia artificial añade una complejidad creciente a nuestra temática. Pues bien, para analizar los problemas que genera la propiedad privada en lo referente a la vida, hemos creado un modelo con tres pares de variables, invención/ descubrimiento, materia/información, y materia inerte/viva. El objetivo último es clarificar las narrativas que subyacen tras los numerosos documentos que tratan de encauzar, regular y/o refutar las biopatentes. (shrink)
