This case note considers the availability in the United Kingdom of the provocation defence in cases of intimate homicide in the context of the recent House of Lords decision in Rv. Smith [2000] 3 W.L.R. 654. The note argues that the expansion of the objective component of the defence to encompass the mental infirmities of individual defendants is dangerous for women. Although it has the potential to help some abused women who kill to use the defence, it has, at the (...) same time, exposed women who are abused by sexually possessive, violent men to even greater danger. It is thus argued that the defence should be restricted in the way envisaged by the minority judgement of Lord Millett so that abused women will still be able to use the defence, but by anon-medical route. Alternatively, the defence should be abolished and defences which pose no risk of encompassing violent men should be developed to accommodate abused women. (shrink)

Sentencing practices in cases of domestic homicide have been the object of critical scrutiny on previous occasions across a number of jurisdictions. It has been suggested by some that these practices reveal judges to be taking a more lenient approach to women who kill their violent male partners than to men who kill allegedly unfaithful female partners. This note evaluates claims of gender bias in sentencing practices in UK cases of domestic homicide following the Court of Appeal sentencing decision in (...) R. v. Suratan, R. v.Humes and R.v. Wilkinson [2002]E.W.C.A. 2982 concerning three men who killed their female partners. It will argue that in the wake of this decision current proposals to review both the substantive law of provocation and sentencing practices are to be welcomed. (shrink)

Purpose. The purpose of the study is to outline the links between individual and collective dimensions of the human worldview. This purpose requires solving two tasks: to update philosophical ideas formed by reflection on human and community worldview; to identify and generalize the relationship of singular and general in the context of the problem of human worldview. Theoretical basis. The study is based on philosophical reflections about manifestations of singular and general worldviews. Such reflections appeared in European philosophy quite a (...) long time ago. Ukrainian and foreign philosophical discourse considers both measures of the worldview. And a role of the carrier of worldview plays either human or society. We can see that in researches of S. Krymskyi, I. Nadolniy, V. Popov, N. Rozhanska, V. Tabachkovskyi, V. Shynkaruk, V. Poythress, D. Rousseau, D. Billingham, C. Gianolla and others. However the links between individual and collective dimensions of worldview are not clearly outlined. It is possible to note the research of V. Popov who focuses on the problem of socio-collective and individual dimensions of worldview. But the scientist focuses more on the use of the concept of worldview in these two meanings. Human as a social being interacts with worldviews of other individuals. That is why we can speak of two dimensions of the worldview function: individual and collective. This problem became topical due to acuteness of the links between human and society in modern life. Originality. The author outlined key links between individual and collective dimensions of human worldview functioning. The study identified a role of human as a carrier of the worldview in formation of collective worldview. Conclusions. Human as a worldview carrier plays a key role in formation of collective worldview. In philosophical discourse thoughts about links between individual and collective worldviews are different and sometimes conflicting. We have a discussion problem of uniformity and diversity of collective worldview. Collective worldview is showed as a circulation of different ideas and views of individuals. But collective worldview is showed as a whole system of individual views too. Collective worldview manifests as integrated phenomenon because it is based on common worldviews of individuals. At the same time the human is influenced by collective worldview in particularly as a past generation heritage. (shrink)

One of the most difficult and perplexing tenets of classical theism is the doctrine of divine simplicity. Broadly put, this is generally understood to be the thesis that God is altogether without any proper parts, composition, or metaphysical complexity whatsoever. For a good deal more than a millennium, veritable armies of philosophical theologians – Jewish, Christian and Islamic – proclaimed the truth and importance of divine simplicity. Yet in our own time, the doctrine has enjoyed no such support. Among many (...) otherwise orthodox theists, those who do not just disregard it completely explicitly deny it. However, in a couple of recent articles, William E. Mann has attempted to expound the idea of divine simplicity anew and to defend it against a number of criticisms. He even has gone so far as to hint at reaffirming its importance, suggesting that the doctrine may have a significant amount of explanatory power and other theoretical virtue as part of an overall account of the nature of God, by either entailing or in other ways providing for much else that traditional theists have wanted to say about God. In this paper, I want to take a close look at Mann's formulation of the doctrine and at a general supporting theory he adumbrates in his attempt to render more plausible, or at least more defensible, various of its elements and implications. As Mann has made what is arguably the best attempt to defend the doctrine in recent years, I think that such an examination is important and will repay our efforts. (shrink)

Quantum cognition in decision making is a recent and rapidly growing field. In this paper, we develop an expected utility theory in a context of non-classical uncertainty. We replace the classical state space with a Hilbert space which allows introducing the concept of quantum lottery. Within that framework, we formulate axioms on preferences over quantum lotteries to establish a representation theorem. We show that demanding the consistency of choice behavior conditional on new information is equivalent to the von Neumann–Lüders postulate (...) applied to beliefs. A dynamically consistent quantum-like agent may violate dynamic recursive consistency, however. This feature suggests interesting applications in behavioral economics as we illustrate in an example of persuasion. (shrink)

The articles discusses the philosophical foundations and the traditions of the theory of the humanitarian and technological revolution. The subject-matter of HTR theory is the description and forecast of the transition from the industrial to the post-industrial phase of civilization development as well as the strategy and the most effective methods of management of various socio-economic systems. This theory, actively developing in recent years, focuses on goal setting and on determining priorities and development criteria in the field of technology, science (...) and education. The current revolution largely justifies the forecast of D. Bell, an author of the theory of post-industrial development, about the transition from the world of technology to the world of people. The human is the main subject and object of the changes. In this regard, we review an interdisciplinary program on human research, initiated in the 1980s by I.T. Frolov. The ongoing scientific revolution in genetics and the transition to autoevolution make these ideas even more relevant. The concept of universal evolutionism proposed by N.N. Moiseev is fundamental. This concept originates from philosophical and methodological generalizations based on the vast experience of computer modeling of “human-dimensional” systems. The principles of co-evolution of man and biosphere, the strategies for finding compromises are very close to the ecology of technologies, developed by the theory of HTR. It is difficult to overestimate the importance of the interdisciplinary concept of self-organization for many scientific fields and, in particular, for the theory of HTR. In our days, proposed by an outstanding mathematician, methodologist and thinker S.P. Kurdyumov, the interpretation of synergetics as a bridge between humanities and natural science, as a common language of natural scientists, mathematicians, scholars has become generally accepted. Kurdyumov predicted that many concepts and ideas of synergetics, through their philosophical understanding, would change the outlook and become an element of scientific culture. We show that this forecast turns into reality and in the process of HTR the ideas of synergetics begin to change our world. We pay special attention to the concept of self-developing systems, the theory of global scientific revolutions and the types of scientific rationality proposed by V.S. Stepin. In this regard, we can say that the HTR brings even more large-scale changes, covering not only science but also technology, society, the inner world of man. Identifying the philosophical foundations of HTR, we contribute to the development of methodology of this approach, enhance intra-scientific reflection and make possible to formulate unsolved problems more accurately. The final document of the 1976 Conference of Communist and Workers' Parties of Europe emphasizes: "The historical necessity of replacing capitalist society with a socialist society established in accordance with the will of each people is becoming evident to ever broader strata of the public." As far as I know, the psychological aspect of the activity approach to the study of consciousness and knowledge was developed by the psychologists Lev Semenovich Vygotsky, his student Aleksei Nikolaevich Leontiev, Aleksandr Romanovich Luria, and Petr Iakovlevich Galperin. Leontiev, Luria, and Galperin were professors at the Philosophy Faculty of MGU at the time you were studying there.
