Sex change surgery has been practised in Iran under Ayatollah Khomeini’s fatwa in 1982. Therefore, a medical and judicial process of transition has been regulated accordingly. However, this has not resulted in either the legalization of sex change surgery, nor in the recognition of transsexual identity within Iranian substantive law. Sex change surgery is allowed through Islamic law, rather than substantive law, in response to the existing social facts and norms, on the one hand, and structural cooperation with medical system, (...) on the other. In this article, I argue that the Iranian heteronormative law’s understanding of transsexuality has amounted to the misrecognition of trans persons’ status within law and society. Using semi structured interviews, intersectional content analysis, and feminist methodologies, the findings indicate that transsexual bodies have gained meaning through religious and medical discourses within a framework of power relations, and that Iranian transsexual persons have reconstructed and redefined gender and gender relations in a way that informs their understanding of gender and sexuality beyond the existing Islamic legal and social norms. Moreover, intersectional analysis of the interviews demonstrates how the legal misrecognition of transsexuality creates space for a discourse which in itself leads to the misrecognition of other gendered identities, such as homosexuals and transwomen. The Hatata Inquiries are two extraordinary texts of African philosophy composed in Ethiopia in the 1600s. Written in the ancient African language of Geʿez (Classical Ethiopic), these explorations of meaning and reason are deeply considered works of rhetoric. They advocate for women’s rights and rail against slavery. They offer ontological proofs for God and question biblical commands while delighting in the language of Psalms. They advise on right living. They put reason above belief, desire above asceticism, love above sectarianism, and (...) the natural world above the human. They explore the nature of being as well as the nature of knowledge, the human, ethics, and the human relation with the divine. They are remarkable examples of something many assume doesn’t exist: early written African thought. This accessible English translation of the Hatata Inquiries, along with extensive footnotes documenting the cultural and historical context and the work’s many textual allusions, enables all to read it and scholars to teach with it. The Hatata Inquiries are essential to understanding the global history of philosophy, being among the early works of rational philosophy. The book includes a translation by Ralph Lee with Mehari Worku and Wendy Laura Belcher of the Hatata Zara Yaqob and the Hatata Walda Heywat. The appendices by Jeremy R. Brown provide information on the scribal interventions in and the differences between the manuscripts of the two Hatatas. It is commonly accepted that former European colonising states ought to make reparations for the many harmful legacies of colonialism. I defend an undertheorised case for migration as reparation for one harmful legacy of colonialism in particular, that of exploitation. Making reparations for the harmful legacy of colonial exploitation requires, among other measures, a redistribution of wealth from former colonising states to their former colonies, and for former colonising states to make symbolic reparations, acknowledging the wrong of exploitation. Often it (...) is assumed that the reparative redistribution can occur through in situ monetary transfers, and that symbolic reparations can involve measures such as apologies. But I highlight an overlooked additional option that should be added to the reparative package: migration rights. Firstly, migration would constitute material reparations, as it is well established that migration from poorer to richer states is an effective mechanism of redistributing wealth, both to the individuals who migrate, but also to those who choose not to migrate through remittances. Secondly, offering postcolonial migrants not only the right to work in their former colonising states, but substantive rights, including immediate access to public funds, would be a powerful means of making symbolic reparations, of former colonising states acknowledging that their key institutions are funded with colonially extracted wealth. Building on work by Peterman, Aas, and Wasserman (2021), we modify their prospective benefit analysis to include only medically-relevant information about patients as persons without reference to their broader lives. Because patients (not their lives) must be treated equally, we argue that patients are the appropriate targets of allocative justification. We go on to challenge some of our current data-collection practices on this basis.

I argue that political philosopher Charles W. Mills’ twin concepts of ‘the epistemology of ignorance’ and ‘white ignorance’ are useful tools for thinking through racial injustice in the British education system. While anti-racist work in British education has a long history, racism persists in British primary, secondary and tertiary education. For Mills, the production and reproduction of racism relies crucially on cognitive and epistemological processes that produce ignorance, and which promote various ways of ignoring the histories and legacies of European (...) colonialism and imperialism, as well as the testimonies and scholarship of those who experience racism in their everyday lives. I survey these concepts within Mills’ work then marshal evidence in support of my claim that ‘the epistemology of ignorance’ and ‘white ignorance’ provide a useful framework for thinking through problems of racial injustice in British education. The conception of the doctor–patient relationship under Australian law has followed British common law tradition whereby the relationship is founded in a contractual exchange. By contrast, this article presents a rationale and framework for an alternative model—a “Trust Model”—for implementation into law to more accurately reflect the contemporary therapeutic dynamic. The framework has four elements: an assumption that professional conflicts with patient safety, motivated by financial or personal interests, should be avoided; an onus on doctors to disclose these conflicts; a (...) proposed mechanism to contend with instances where doctors choose not to disclose; and sanctions for non-compliance with the regime. Violence against women is a growing health problem, especially when perpetrated in intimate relationships. Despite increasing attention, there is little comparative evidence on the different types of violence involved and there is a paucity of research on sexual femicides. This study examines cases of violence against women in northern Italy, focusing on sexual and non-sexual femicides and comparing them with rape that does not result in femicides. The sample included 500 women who were victims of sexual and non-sexual femicides, and (...) of rape. Results show sexual femicides mostly involved unknown victims or women who were prostitutes. Sexual femicidal offenders used improper weapons to kill their victims, acted in secluded locations, and fled the crime scene; their crime was more likely the result of predatory intentions, with antisociality and sexual deviance being the most significant factors related to this type of femicide. The criminal and violent pattern that characterized sexual femicides in this study shared significant similarities with the pattern of violence involved in rape. Rape victims were in fact mostly unknown, or involved in a brief relationship with their killer. When the victim was known it was more likely that the abuse occurred at home and in front of the woman’s children. Rapists were often under the effect of alcohol or drugs. Non-sexual femicides mainly involved known victims, and they were more often committed in the context of domestic disputes. It was not seldom that the long relationship between the victim and perpetrator was likely to be characterized by contentiousness, suggesting that the woman was often victim of an oppressive climate of emotional tension and domination. Morbid jealousy contributed to aggravating the tone of a controlling relationship. Non-sexual femicides bore more similarities to cases of rape within the pattern of intimate partner violence. Findings are discussed in terms of their implications for prevention and intervention. (shrink)

This chapter articulates how people understand “microaggression” and offers a clarifying augmentation of that account. It attempts to define disability, and then talk through how analysis connects with the very few discussions of microaggressions within the context of disability. The chapter introduces the case of “Disabled But Not Really.” It leverages previous analysis to show how microaggressions’ mixed legibility is crucial to their role in maintaining an epistemology that polices disability in general and disabled people in particular. The chapter discusses (...) the ramifications this has for future analysis of both microaggressions and disability. It highlights the specific challenges faced by persons at the junction of multiple oppressed identities. Ontologically, the commitment is the rejection of the medical model of disability where “disabilities are just particular kinds of bodily malfunction”. As children gradually master grammatical rules, they often go through a period of producing form‐meaning associations that were not observed in the input. For example, 2‐ to 3‐year‐old English‐learning children use the bare form of verbs in settings that require obligatory past tense meaning while already starting to produce the grammatical –ed inflection. While many studies have focused on overgeneralization errors, fewer studies have attempted to explain the root of this earlier stage of rule acquisition. In this work, we use (...) computational modeling to replicate children's production behavior prior to the generalization of past tense production in English. We illustrate how seemingly erroneous productions emerge in a model, without being licensed in the grammar and despite the model aiming at conforming to grammatical forms. Our results show that bare form productions stem from a tension between two factors: (1) trying to produce a less frequent meaning (the past tense) and (2) being unable to restrict the production of frequent forms (the bare form) as learning progresses. Like children, our model goes through a stage of bare form production and then converges on adult‐like production of the regular past tense, showing that these different stages can be accounted for through a single learning mechanism. This study has proposed to apply change leadership as a vehicle forward for sustaining the growth of the tourism industry to eradicate poverty through the Pakistani tourism industry. Applying a mixed method approach, this article has attempted to uncover the role a change leader can play to help achieve the United Nations’ sustainable development goals of poverty reduction. In this study, one of the authors interviewed stakeholders of the tourism industry to find out the major drivers of the industry and (...) identify the leadership style that may prove to be effective in the said industry. In the next phase of the study, a survey method approach was used where different tourism companies and hotel chains were included for analysis. The study aimed to check employee’s perception of change leadership and its impact on their resilience and ultimately the sustainable organization performance of companies’ operationalizing in the sector with moderating impact of sustainable tourism attitude in times of a crisis. In total, 430 full-time workers in the tourism industry were contacted for a self-administered survey achieving a response rate of 83%. The findings of the study confirmed that in the presence of a change leader, the process of adaptation to sudden changing situations amidst financial crises, pandemic, and climatic change, becomes bearable and employees can cope with the work situations without pushing them to quit the industry. The study has a significant contribution toward a rapidly growing and focused industry, which can play a major role in the economy of any country leading toward job creation and poverty reduction. A crucial design feature of language useful for determining when grammatical language evolved in the human lineage is our ability to combine meaningless units to form a new unit with meaning (combinatoriality) and to further combine these meaningful units into a larger unit with a novel meaning (compositionality). There is overlap between neural bases that underlie hierarchical cognitive functions required for compositionality in both linguistic and nonlinguistic contexts (e.g., tool use). Therefore, evidence of compositional tool use in the archaeological record (...) should signify, at the very least, the cognitive capacity for grammatical language by that point in time. We devise a novel system to evaluate the level of hierarchical nesting of tool components in single tool use activities. In the application of this system, we demonstrate that nonhuman primates, and by extension, the last common ancestor shared by Pan and Homo, are capable of basic combinatoriality; however, their technology does not approach the compositionality observable in modern human tool use. The prehistoric archaeological record supports a continuous evolution of combinatorial tool use into compositional tool use, with evidence for human-like levels of by 0.93 million years ago (Ma), or possibly as early as 1.7 Ma. While compositional language could have lagged behind compositional tool use, if language and technology coevolved according to the Technological Origin for Language hypothesis, which proposes a feedback system between the two, then evidence for hierarchical tool use structures implies a similar level of complexity in linguistic structures. This paper aims at identifying socio-cultural portrayal of women through representational, interactive and compositional meanings with a focus on gender stereotypes propagated by media advertisements in Pakistan. Media adverts as such are an instrumental tool for manipulating attitudes and behavior of large and diverse audience for example, a large body of data reveals that women are portrayed in media to stylize their physical attributes to tempt and persuade customers. Therefore, advertisements are instrumental in creating a certain mind-set by shaping an (...) ideologythrough highlighting the hegemonic representation of men and sexual objectification of women for creating an erotic fantasy. The data for the study comprises print media adverts which were randomly collected to have primarily advertised Pakistan TV morning shows, home products and cosmetics and have been selected on an assumption that they embody a socio-cultural perspective. The findings show that the selected advertsproject the world of male chauvinism where women are shown as the facilitating sexual objects. (shrink)

Il contributo mira a presentare metodi e risultati del progetto di restauro virtuale di un settore dell’antica Porto Torres/Turris Libisonis (Terme centrali, via adiacente e botteghe prospicienti - cd. palazzo del Re Barbaro), frutto di un accordo di collaborazione tra la Direzione Regionale Musei Sardegna e l’Università degli Studi di Padova. Il metodo applicato si basa su tecnologie di fruizione in Realtà Virtuale e ha permesso il restauro virtuale, geolocalizzando il modello virtuale 3D on-site: una App comanda la visualizzazione di (...) immagini equirettangolari all’interno di visori VR, permettendo visite guidate “aumentate”. Il lavoro è partito da una raccolta bibliografica ragionata, alla quale è seguita una campagna di rilievo fotogrammetrico da drone (G. Alvito, Teravista); infine, intrecciando i dati raccolti, si è proceduto alla ricostruzione 3D virtuale degli edifici. Le evidenze strutturali oggi conservate sono state integrate nella scena 3D con puntuali confronti coevi (III sec. d.C.), virtualmente ricostruiti e ricollocati in contesti d’uso verosimili, accrescendo così l’affidabilità ricostruttiva. L’intera attività ricostruttiva è stata vincolata a un rigoroso processo di validazione scientifica basato sul metodo dell’Extended matrix e l’esito finale è ora fruibile sia mediante proiezioni tradizionali (off-site, tourismA 2020), sia mediante l’utilizzo di dispositivi mobili VR (on-site, Giornate europee del patrimonio 2020). In queste e altre occasioni si è riscontrata una eccellente risposta del pubblico, agevolato dal virtuale nella percezione e nella comprensione delle evidenze e delle volumetrie antiche. (shrink)

Taberî bu kıyasın illetine yönelik mutâlebe, itirâz ve muâraza türü sorulara başvurmuş, Kudûrî ise kendi illetinin sıhhatini savunmaya çalışmıştır. In lieu of an abstract, here is a brief excerpt of the content:During my stint as a visiting scholar at St. Bonaventure University, I stumbled on two very interesting manuscripts that are not as well known as they deserve to be. I would like to make these two 'pebbles' more accessible to other scholars and to anyone who desires to approach this valuable material, which is preserved in the Friedsam Memorial Library.The First Manuscript: A "Handbook" for the Observant FriarsAt St. (...) Bonaventure University, I was working on the sources concerning John of Capistrano's polemics against the Jews and the Turks. To this purpose, I scanned the Ottokar Bonmann Archive at St. Bonaventure for letters, sermons, and treatises. At the same time I was working on the critical edition of Capistrano's La dichiarazione in volgare sulla Regola di san Francesco, which amounts to a vernacular explanation and interpretation of the Rule of St. Francis. It is one of the first vernacular texts of its kind, providing, in a few simple words, an explanation of the meaning of Franciscan spirituality. As its author is one of the "four columns" of the Observant family, it can, in fact, be understood as a vademecum for the Observants. My first impressions in this direction were confirmed and reinforced by looking at the manuscript Holy Name College, cod. 35, which is now preserved in the Friedsam Memorial Library of St. Bonaventure University .Chiappini lists three manuscripts containing La dichiarazione:1. L'Aquila, Archivio di Stato, cod. S.73, ff. 461b - 469b 2. Naples, Biblioteca Nazionale, cod. XII.G.5 n. 23. Rome, Biblioteca Vallicelliana, cod. Private collection of Giovanni PansaSince I have not yet been able to see the last two manuscripts , some questions remain concerning their actual contents. When we consider the Zara manuscript, for example, we notice that Chiappini claims it to contain on folios 3v-13v the Expositione della Clementina de Clemente V, sopra la regula de li frati minori, traslata ad litteram de latino in vulgare per lo venerabile frate Iohanni de Capestrano . Based on the similarity of subject matter and the use of the vernacular language, Bonmann inferred that this text included Capistrano's dichiarazione. The circumstances surrounding the manuscript in Giovanni Pansa's private collection present us with a real detective story. This Italian bibliofile described the manuscript for the first time in 1887, when it resided in a library in Sulmona. Pansa subsequently bought the manuscript and sold it in Rome before 1925 to the antiquarian bookstore of Ermanno Loescher & Company. Since then, the manuscript has disappeared without leaving any trace. All details concerning this story can be found in the work of Chiappini, who wrote that the manuscript contains the Postilla in clementina "Exivi" super Regulam fratrum minorum per sanctum Ioannem de Capestrano. This might be the same Postilla as that found in MS. 20 of the Capestrano library. Based on all this, I believe that Bonmann misunderstood Chiappini's reference.Thus far I have found one manuscript not mentioned by Chiappini or Bonmann, namely MS Roma, Biblioteca S. Isidoro, 1/87, ff. 66ss. Hence there are now either ten or perhaps only eight manuscripts available for the creation of a critical edition . One of these, as I have indicated above, is manuscript Holy Name College, cod. 35, currently kept in the Friedsam Memorial Library of St. Bonaventure University. As I had the opportunity to study this manuscript, I can provide a more precise description of its codicological properties and contents. (shrink)

Saeidzadeh draws out the significance of misrecognition in her consideration of responses to transsexuality in Iran, while Doonan highlights the potential pitfalls of relying on situational vulnerability in her critique of anti-trafficking legal discourse in the US. Lindsey considers the legal potential of situational vulnerability as a tool to address the ‘persistent failure to take action (...) against abuse’ in the UK. Durojaye and Oluduro contribute to the recent revitalisation in asking ‘the woman question’ by drawing on African law and literature to flesh out the development of a gender-sensitive, substantive equality approach from the jurisprudence of the African Commission on Human and Peoples’ Rights as it addresses vulnerability to violence. Aspers investigates these retailers' interactions and competition in the consumer market for fashion garments, traces connections between producer and consumer markets, and demonstrates why market order is best understood through an analysis of its different forms of social construction. Emphasizing consumption rather than production, Aspers considers the larger retailers' roles as buyers in the production market of garments, and as potential objects of investment in financial markets. He shows how markets overlap and intertwine and he defines two types of markets--status markets and standard markets. In status markets, market order is related to the identities of the participating actors more than the quality of the goods, whereas in standard markets the opposite holds true. In this presentation I will examine how Christian and Jewish leaders have responded to this phenomenon. Some have been quite suspicious of such interreligious and cross-cultural encounters, claiming that Buddhism is a great threat to their religions. However, others have argued that their encounters with Buddhism have led them to deeper insight into their own traditions and have helped them to become better human beings. Their practice of Buddhist meditation has been a way for them to develop sensitivity to God and greater commitment to their own traditions. Still others have converted to Buddhism; it is estimated that of the three million Buddhists in America, fully one million are converts from Christianity and Judaism.Because of the complexity and diversity within Judaism, Christianity, and Buddhism, I will focus on the responses of leading Orthodox Jews and Roman Catholic Christians to Theravada Buddhism and to the Zen school in Mahayana, the two forms of Buddhism to which many Americans are drawn and with which I have some personal experience. I will first examine how members of the Jewish and Christian traditions view other religions, because an individual’s perception of the encounter is shaped by how their religion views the Buddhist tradition. This will help us understand why religious authorities find this fascination with Buddhism so problematic.the jewish-buddhist encounterHistorically, Judaism has largely been interpreted by its thinkers as the only true religion. However, this does not mean that members of other faiths may not attain [End Page 21] salvation. According to the Talmudic Doctrine of the Seven Commandments of the Sons of Noah, “the righteous of all nations have a share in the world to come,” that is, all human beings can attain salvation who establish courts of law and who refrain from idolatry, murder, blasphemy against God, incest, theft, and eating the limb of a live animal. Jewish authorities claim that because Christianity and Islam worship God they are not to be considered idolatrous, although some question the monotheistic nature of Christianity because of the doctrine of the Trinity and the Incarnation. However, there is no question that members of Asian religions are practicing idolatrous worship, avodah zarah (“strange worship”). They are therefore in violation of the Noahide Law not to worship idols.With some exceptions, Orthodox rabbis in recent times agree with Rabbi Avigdor Miller (1908–2001) that “Buddhism, Shintoism, and all other religions of the Far East are forms of idol worship.”1 For Rabbi Miller the Torah contains all the knowledge that is necessary for Jews, and to even study another religious tradition is an affront to God. That this attitude toward the study of alien texts is common today is evident from the reaction of Rabbi Chaim Zvi Hollander to the suggestion of Rabbi Zalman Schachter that it is permissible to explore Asian forms of spirituality. Hollander charges that “Zalman Schachter’s incredible advice is a direct contradiction of the Almighty’s request that we not seek out and explore the spiritual modes of the Goyim, even if it is for the purpose of enhancing our spiritual experience in the service of our God.”2 He further states that “the practice of any religion other than Judaism is for a Jew an act of Avoda Zara.”3For Rabbis Miller and Hollander, blending Judaism with the Buddhist tradition, which is not concerned with a creator God and which rejects the idea of self, is inconceivable and more dangerous than Jews who convert to another religious tradition. However, even among the Orthodox, there are divergent views.
