This collection focuses on how troubled times impact upon the law, the body politic, and the complex interrelationship among them. It centres on how they engage in a dialogue with the imagination and literature, thus triggering an emergent (but thus far underdeveloped) field concerning the 'legal imagination'. Legal change necessitates a close examination of the historical, cultural, social, and economic variables that promote and affect such change. This requires us to attend to the variety of non-legal variables that percolate throughout (...) the legal system. The collection probes 'the transatlantic constitution' and focuses attention on imagination in a common law context that seems to foster imagination as a cultural capability. The book is divided into four parts. The first part begins with a set of insights into the historical development of legal education in England and concludes with a reflection on the historical transition of England from an absolute monarchy to a republic. The second part of the volume examines the role that imagination plays in the functioning of the courts. The third part focuses on patterns of thought in legal scholarship and detects how legal imagination contributes to the process of producing new legal categories and terminology. The fourth part focuses on patterns of thought in legal scholarship, and looks to the impact of the imagination on legal thinking in the future. (shrink)

DBS Think Tank IX was held on August 25–27, 2021 in Orlando FL with US based participants largely in person and overseas participants joining by video conferencing technology. The DBS Think Tank was founded in 2012 and provides an open platform where clinicians, engineers and researchers can freely discuss current and emerging deep brain stimulation technologies as well as the logistical and ethical issues facing the field. The consensus among the DBS Think Tank IX speakers was that DBS expanded in (...) its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. After collectively sharing our experiences, it was estimated that globally more than 230,000 DBS devices have been implanted for neurological and neuropsychiatric disorders. As such, this year’s meeting was focused on advances in the following areas: neuromodulation in Europe, Asia and Australia; cutting-edge technologies, neuroethics, interventional psychiatry, adaptive DBS, neuromodulation for pain, network neuromodulation for epilepsy and neuromodulation for traumatic brain injury. Les hormones sexuelles sont des objets hybrides et complexes à la frontière du sexe et du genre. Dès lors qu’elles sont synthétisées sous forme pharmaceutique, elles peuvent attribuer des caractéristiques sexuelles au corps de manière partiellement exogène à celui-ci. Il s’en suit que l’utilisation clinique qui en est faite est socialement réglementée. À travers une analyse de divers contextes d’utilisation des hormones observés à Bahia, au Brésil, cet article montre que le dualisme sexuel est le produit de pratiques de régulation (...) biomédicales qui visent à encadrer la circulation des hormones. Le sens du terme local « hormônio » n’est pas pleinement recoupé par celui d’hormone, qu’il excède. L’emploi commun qui est fait au Brésil du singulier procure au terme « hormônio » une qualité fluide et homogène. Dans ce contexte, les hormones sont comprises comme une sorte de substance qui peut circuler entre les corps. Cette conceptualisation des hormones comme une substance a des implications pour le statut ontologique des corps et révèle la relative plasticité de la relation sexe/genre. (shrink)

BackgroundHeavy media use has been linked to sleep problems in children, which may also extend to the infancy period. While international parent-advisory agencies, such as the American Academy of Pediatrics, advise no screen time before 18 months, parents often do not follow this recommendation. Research on Italian infants’ early access to media is sparse, and only very few studies have investigated links with sleeping habits.MethodTo address this gap, we examined concurrent associations between parent-reported surveys of child technology use and sleeping (...) patterns. The Italian version of the 60 item Comprehensive Assessment of Family Media Exposure Survey, developed as part of a larger international study,, the Brief Screening Questionnaire for Infant Sleep Problems Sadeh, 2004) were completed online by 264 Italian parents of 8- to 36-month-olds and a subset completed the Parenting Stress Index Abidin, 1995) between April 2017 and April 2018.ResultsMore devices located in the child’s room and the more time spent watching TV or using an iPad were associated with less hours of sleep at night. Furthermore, more time spent watching TV or using a smartphone, as well as the number of devices in the room was associated with going to sleep later at night. Instrumental media use was associated with less sleep.ConclusionLike other countries, Italian infants have high levels of exposure to media, and differences in media patterns were associated with sleep patterns. Cultural factors influence both instrumental reasons for media use and sleep practices. Further research should explore how media use may serve to regulate emotion as a function of both contextual factors and individual differences. (shrink)

Avec l’entrée massive dans l’usage du nom « émotion » comme nom générique de toutes les manifestations psychologiques, due à la vulgarisation du discours de spécialité de la psychologie, des arts, etc., il existe la tentation de considérer ce nom, du point de vue linguistique, uniquement comme un hyperonyme et même comme un « nom général », du sommet ou des fondements du lexique. Cet article présente un point de vue nouveau : il montre que, par ses propriétés morphologiques, syntaxiques (...) et anaphoriques, le nom émotion est aussi un nom de base, du même niveau lexical que peur, joie, tristesse, etc., que l’on a pu considérer comme ses hyponymes. Abstract concepts collect more heterogeneous exemplars and are more detached from sensory modalities than concrete concepts. Recent views propose that, because of their complexity, other people are pivotal for abstract concepts’ acquisition and use, e.g., to explain their meaning. We tested this hypothesis using a combined behavioral and thermal imaging paradigm. Twenty-one Italian children determined whether acoustic stimuli were or not correct Italian words. Concrete terms yielded faster (...) responses than abstract ones: for the first time, this effect appears with response times in very young children. More crucially, the higher increase in temperature of the nasal tip suggests that, with abstract concepts, children might be more socially and cognitively engaged. (shrink)

23andMe not only sells genetic testing but also uses customer data in its R&D activities and commercial partnerships. This raises questions about transparency and informed consent. Based on a online survey conducted in 2017–18, we examine attitudes of 368 customers of 23andMe toward the company's use of their data. Our findings point at divides in the context of customers' awareness of the two-sided business model of DTC genetics and their attitudes toward consent. While most of our respondents (68%) were aware (...) that 23andMe could store their data and use it for certain purposes without their consent, over 40% were not aware that using and sharing customer data was part of the business model. Views were also divided regarding what type of consent was most appropriate. We explore the implications of these divides for participatory research and for the importance of transparency and trust in commercially-driven scientific knowledge production. (shrink)

Process ontology is making deep inroads into the hard sciences. For it offers a workable understanding of dynamic phenomena which sits well with inquiries that problematize the traditional conception of self-standing, definite, independent objects as the basic stuff of the universe. Process-based approaches are claimed by their advocates to yield better ontological descriptions of various domains of physical reality in which dynamical, indefinite activities are prior to definite “things” or “states of things”. However, if applied to physics, a main problem (...) comes up: the notion itself of process appears to pivot on a conception of evolution through time that is at variance with relativistic physics. Against this worry, this article advances a conception of process that can be reconciled with general relativity. It claims that, within timeless physical frameworks, a process should not be conceived as activities evolving through time. Rather, processes concern the identity that entities obtain within the broader sets of relations in which they stand. To make this case, the article homes in on one of the physical approaches that most resolutely removes time from the basic features of reality, that is, canonical quantum gravity. As a case in point, it addresses Carlo Rovelli’s Evolving Constant approach as a physical paradigm that resolutely rejects time as an absolute parameter and recasts processualism as an inquiry into how physical systems affect one another. We present and study the category of formal topologies and some of its variants. Two main results are proven. The first is that, for any inductively generated formal cover, there exists a formal topology whose cover extends in the minimal way the given one. This result is obtained by enhancing the method for the inductive generation of the cover relation by adding a coinductive generation of the positivity predicate. Categorically, this result can be rephrased by saying that inductively generated formal (...) topologies are coreflective into inductively generated formal covers. The second result is that unary formal covers are exponentiable in the category of inductively generated formal covers and hence, thanks to the coreflection, unary formal topologies are exponentiable in the category of inductively generated formal topologies. From a localic point of view the exponentiability of unary formal topologies means that algebraic dcpos are exponentiable in the category of open locales. But, the coreflection theorem states that open locales are coreflective in locales and hence, as a consequence of well-known impredicative results on exponentiable locales, it allows to prove that locally compact open locales are exponentiable in the category of open locales. This paper argues that the concept and role of ‘institutional racism’ in contemporary discussions of race should be reconsidered. It starts by distinguishing between ‘intrinsic institutional racism’, which holds that institutions are racist in virtue of their constitutive features, and ‘extrinsic institutional racism’, which holds that institutions are racist in virtue of their negative effects. It accepts intrinsic institutional racism, but argues that a ‘disparate impact’ conception of extrinsic conception faces a number of objections, the most serious being that it (...) has no plausible account of what it is that makes extrinsically racist institutions racist. It also argues that claims about the explanatory indispensability of institutional racism are overstated (individual racism is at least as important), critiques structural approaches to racial inequality, and suggests that there is reason to doubt whether institutional reform can provide us with all that morality may require in the racial domain. Objective—To determine the prevalence of, and attitudes towards, observed and personal research misconduct among newly appointed medical consultants. Design—Questionnaire study.Setting—Mersey region, United Kingdom.Participants—Medical consultants appointed between Jan 1995 and Jan 2000 in seven different hospital trusts (from lists provided by each hospital's personnel department). Main outcome measures—Reported observed misconduct, reported past personal misconduct and reported possible future misconduct.Results—One hundred and ninety-four replies were received (a response rate of 63.6%); 55.7% of respondents had observed some form of research misconduct; 5.7% of (...) respondents admitted to past personal misconduct; 18% of respondents were either willing to commit or unsure about possible future research misconduct. Only 17% of the respondents reported having received any training in research ethics. Anaesthetists reported a lower incidence of observed research misconduct (33.3%) than the rest of the respondents (61.5%) (p<0.05). Conclusion—There is a higher prevalence of observed and possible future misconduct among newly appointed consultants in the UK than in the comparable study of biomedical trainees in California. Although there is a need for more extensive studies, this survey suggests that there is a real and potential problem of research misconduct in the UK. (shrink)

It was proposed that the data from Monte Carlo statistical investigations be subjected to analysis of variance methods rather than the conventional techniques of tabling, graphing, and inspecting the data. Two examples in which analysis of variance methods were applied to published Monte Carlo studies were presented. It was suggested that balanced factorial designs should be used whenever possible in Monte Carlo studies so that analysis of variance methods would be directly applicable. Finally, three advantages of analysis of variance methods (...) over conventional techniques were described and analysis of variance methods were contrasted with a possible alternative analytical method, multiple regression analysis. Purpose. The research is devoted to the analysis of the urgent problem of the information society: the overload of a person with information and, as a result, the impossibility of adequate formation and development of the personality; as well as the problem of "digitization" of human existence and the formation of a new reality of dataism. Theoretical basis. A lot of modern scientific works are devoted to the analysis of the information society, its problems and features. The information society is (...) a logical continuation of the scientific and technological revolution, which led to the rapid growth of scientific knowledge and the technology development. In the 20th century, technologies have touched the sphere of knowledge and information, as a result of which the formation and development of the information society, or "knowledge society", takes place. Information becomes the main resource in it, and, one way or another, a person’s life is inextricably connected with the information space. With the information society formation, the problem of information search and processing becomes one of the most urgent. It turns out that despite the abundance and availability of information, it is very difficult to determine its relevance. A lot of effort is spent on developing information retrieval algorithms. Another problem is related to the person’s inability to process large amounts of data. This situation begins to influence not only the education process and professional activity, but also the formation of a person’s personality. A person is "lost" in the information space and gradually loses his/her "I". Algorithms for data analysis come to the rescue, but gradually, instead of giving a person material for thought, they begin to make decisions on their own, and therefore, live life instead of a person. With the advent of Big Data processing algorithms, a new ideological paradigm appears – dataism, which predicts the merger of a person with the general data flow. Originality. The authors make assumptions that the dataistic future is "natural". A lot of works, including in the framework of philosophy, are focused on the problem of "dissolving" a person in the information space and finding ways to overcome it. But, in our opinion, this process is a completely logical continuation of human evolution. Conclusions. Existence of a person as a data flow is not a problem and a threat, but a new dimension of his/her being, and, therefore, requires a careful study and formulation of the main principles of this form of existence. This paper examines the association between board characteristics and the ethical reputation of financial institutions. Given the pivotal governance role of the board of directors and the value-relevance of ethical corporate behavior, we postulate a positive relationship between ethical reputation and board features that foster more effective monitoring and oversight. Using a sample of large financial institutions from 13 different countries, we run several alternative panel regressions of ethical reputation on board characteristics and firm-specific controls. Our results demonstrate that the (...) ethical reputation of financial institutions is positively associated with board size, gender diversity, and CEO duality, while being negatively related to the busyness of the board members and a composite index reflecting poor monitoring. Nevertheless, inconsistent with our hypothesis, we also document that financial institutions with less frequent board meetings have better ethical reputation. Overall, our empirical findings suggest that stronger board oversight may promote ethical behavior in the financial industry. (shrink)

Worship is a topic that is rarely considered by philosophers of religion. In a recent paper, Tim Bayne and Yujin Nagasawa challenge this trend by offering an analysis of worship and by considering some difficulties attendant on the claim that worship is obligatory. I argue that their case for there being these difficulties is insufficiently supported. I offer two reasons that a theist might provide for the claim that worship is obligatory: a divine command, and the demands of justice with (...) respect to God's redemption of humanity. I also challenge the soundness of some of the analogies they employ in their argument. (shrink)

The physician-patient relationship has changed over the last several decades, requiring a systematic reevaluation of the competing demands of patients, physicians, and families. In the era of genetic testing, using a model of patient care known as the family covenant may prove effective in accounting for these demands. The family covenant articulates the roles of the physician, patient, and the family prior to genetic testing, as the participants consensually define them. The initial agreement defines the boundaries of autonomy and benefit (...) for all participating family members. The physician may then serve as a facilitator in the relationship, working with all parties in resolving potential conflicts regarding genetic information. The family covenant promotes a fuller discussion of the competing ethical claims that may come to bear after genetic test results are received. (shrink)

This paper suggests that empirical educational research has not, on the whole, been treated well by philosophers of education. A variety of criticisms have been offered, ranging from triviality, conceptual confusion and the impossibility of empirically studying normative processes. Furthermore, many of those who criticise, or dismiss, empirical research do so without subjecting any specific examples to careful scholarly scrutiny. It is suggested that both philosophy of education, and the empirical research enterprise, stand to profit if philosophers pay more attention (...) to real cases—and this attention is especially important at present, when research funding is being based on spurious scientistic criteria such as the use of ‘gold standard’ randomised experimental research designs. A capoeira ou capoeiragem é uma expressão cultural brasileira que mistura jogo, esporte, arte marcial, cultura popular, tradição, dança e música. Desenvolvida no Brasil por descendentes de escravos africanos, a capoeira é caracterizada por golpes e movimentos ágeis e complexos, utilizando primariamente chutes e rasteiras, além de joelhadas e cabeçadas, cotoveladas, acrobacias aéreas ou em solo. Praticantes da capoeira aprendem não apenas a lutar e jogar, mas também a tocar os instrumentos típicos e cantar. Assim, os discentes do 6º ano (...) de uma escola estadual da cidade de Itabuna—BA, os quais apresentavam dificuldades para ler e escrever. Entretanto, nas aulas de capoeira, os alunos se mostravam mais motivados para ler. Então, surgiu o problema que norteou essa pesquisa, a saber: como o jogo de capoeira vem sendo trabalhado, para estimular a melhoria da aprendizagem em leitura dos alunos, do 6ºano, em um colégio estadual, na cidade de Itabuna – BA? Portanto, o objetivo geral desse artigo é analisar de que maneira o mestre usa o jogo da capoeira, como ferramenta motivacional, nas práticas pedagógicas, para a melhoria da aprendizagem da leitura, entre os alunos do 6º ano, do ensino fundamental II. Desse modo, a utilização de estratégias de leitura, partindo da diversidade dos gêneros textuais, de modo lúdico, através da capoeira, no processo de ensino-aprendizagem, é um assunto que é discutido nessa pesquisa, pois esta se justifica pela necessidade de contribuir para uma melhora do processo de ensino e aprendizagem, partindo de pressupostos presentes na BNCC.
