This chapter compares the institutional setting and integrations processes in Switzerland and the EU. The major findings are that EU integration is trying to achieve more political integration and accommodation of a much higher degree of diversity in much less time than has ever been the case in Switzerland. Integration and expansion processes that were slower and non-linear in Switzerland and that happened in separate phases (e.g. religious diversification, linguistic diversification, territorial expansion, etc.) are all going on at the same (...) time in the EU. Especially integration and accession with enormous shocks of diversification are engineered at the same time in the EU. From this point of view, the EU has already tried to go beyond many stages that took centuries to be completed in Switzerland. The institutional design of the European Union seems to echo quite well the federal state formation process in Switzerland. The following precisions are however necessary in the comparative perspective. First, the momentary stage of European Integration, characterized by intergovernmental crisis management, resembles the (dysfunctional) intergovernmental centralism of the Swiss cantons during the decades before the formation of the federal-state in 1848. Second, due to the greater diversity of the European Union, this quasi-federal system has derived in extreme asymmetries between the member states. Since EU identity is not well entrenched among European citizens (and politicians), it has been hard to design institutions and policies of common territorial protection and redistribution and there is mistrust towards centralistic EU institutions (specially in the countries more affected by the economic crisis). Most European citizens do not feel that their interests are taken into account by the European Union. Third, it is important to note that in Swiss federalism the municipalities play an important role, they are much more than just administrative districts. This city-centred and bottom up construct of citizenship is guaranteed by the Swiss federal constitution. Citizens feel that their most immediate and local identity is not jeopardized but rooted in and guaranteed by the Swiss federal constitution. Compared to sub-national Swiss federalism, EU federalism is entirely focused on the nation-state and the EU institutions. Serious consideration ought to be given to the idea that European citizenship is not only about bringing citizenship to a higher European level but also about bringing it more to the root-level of citizenship: the city. Direct democracy has acted as a federator in the Swiss context. Switzerland made direct democracy and direct democracy made Switzerland. There has been a slow and iterative process of adaptation of structurally similar institutions of direct democracy at all levels (communal, cantonal, federal) of all units (all communes, all cantons, confederation roughly between 1830-1891. To the contrary, the EU is only incipiently in a process of introducing direct democracy (in some member-states and ECI), and so far direct democracy is mainly practiced as national plebiscitary democracy. Under this guise it is seen as a threat to EU integration and probably not without good reason. While in Switzerland the coherent introduction of direct democracy at all levels of the polity in the long run served as an important unifier, direct democracy has even not been considered as integrative part of all levels of political integration in the EU. It is of great interest that the one element in which the European Union has based the construction of EU citizenship and identity – mobility of residence – has been implicitly discouraged in Switzerland. The institutional design as incorporated in Swiss multicultural identity (which aims fundamentally at the protection of cantonal autonomy, culture and language) has facilitated that Switzerland is called today a successful multicultural society. Most citizens identify with Switzerland as a country and they like it as it is, but they do not want to take advantage of their formal right to move to other parts of the country, especially not across language borders. The same institutional design that has made of Switzerland a successful case of multiculturalism and democracy poses important barriers that make it difficult for the Swiss to move their residence across their country. Considering that one of the main features of European citizenship is the freedom of movement and residence, this poses a main concern. The Swiss compromise between the formal right and economic necessity of mobility on the one hand and the protection of political and cultural sub-identities on the other hand, is commuting. Due to the vast size, this is of limited applicability in the EU. However, in a Europe of cities and trans-border regions, commuting is an important option provided that every European citizen lives reasonably close to an important economic centre. In short, the Europe of commuters deserves attention in the context of EU citizenship. (shrink)

European Union citizenship is increasingly relevant in the context of both the refugee crisis and Brexit, yet the issue of citizenship is neither new nor unique to the EU. Using historical, political and sociological perspectives, the authors explore varied experiences of combining multiple identities into a single sense of citizenship.Cases are taken from Canada, Croatia, Czechia, Estonia, Spain, Switzerland and Turkey to assess the various experiences of communities being incorporated into one entity. The studies show that the EU has a (...) comparatively large degree of diversity and complexity, with levels of integration achieved in a relatively short timeframe. Advisory models based on Canada and Switzerland allow for the EU integration processes to continue while protecting diversity and upholding common institutions. Citizenship in Segmented Societies will appeal to academics and students in the field of European and federalist studies with a focus on multiculturalism and linguistic pluralism, minority rights, and citizenship issues. It is widely accepted in psychology and cognitive science that there are two “systems” in the mind: one system is characterized as quick, intuitive, perceptive, and perhaps more primitive, while the other is described as slower, more deliberative, and responsible for our higher-order cognition. I use the term “reflectivism” to capture the view that conscious reflection—in the “System 2” sense—is a necessary feature of good moral judgment and decision-making. This is not to suggest that System 2 must operate alone in (...) forming our moral decisions, but that it plays a normatively ineliminable role. In this paper, I discuss arguments that have been offered in defense of reflectivism. These arguments fit into two broad categories; let us think of them as two sides of a coin. On the first side are arguments about the efficaciousness of conscious reasoning—for example, without conscious deliberation we will make bad moral judgments and decisions. On the other side of the coin are arguments about the centrality of conscious deliberation to normative actions—for example, without conscious deliberation we are no more agential than animals or automatons. Despite their attractiveness, I argue that these arguments do not successfully establish that reflection is a necessary component of good moral judgment and decision-making. If I am right, the idea that good moral judgment and decision-making can result from entirely automatic and subconscious processes gains traction. My goal in this paper is to show that reflectivism fails to include the full range of cases of moral decision-making and that a theory of automaticity may do a better job. I briefly discuss at the end of the paper how an account of successful automatic moral judgment and decision-making might begin to take shape. (shrink)

Animals are often presumed to lack moral agency insofar as they lack the capacities for reflection or the ability to understand their motivating reasons for acting. In this paper, I argue that animals are in some cases morally responsible. First, I outline conditions of moral action, drawing from a quality of will account of moral responsibility. Second, I review recent empirical research on the capacities needed for moral action in humans and show that animals also have such capacities. I conclude (...) that though it may be difficult to engage in the practice of holding animals morally responsible, given the communication barrier and lack of mutual understanding, some animals nevertheless act in ways for which they are morally responsible. Through cultural transmission, repeated learning by new individuals transforms cultural information, which tends to become increasingly compressible . Existing diffusion chain studies include in their design two processes that could be responsible for this tendency: learning and reproducing . This paper manipulates the presence of learning in a simple iterated drawing design experiment. We find that learning seems to be the causal factor behind the increase in compressibility observed in the transmitted information, while reproducing is a source of random heritable (...) innovations. Only a theory invoking these two aspects of cultural learning will be able to explain human culture's fundamental balance between stability and innovation. (shrink)

La extensión universitaria es una de las vías en las que la Universidad demuestra su carácter de centro cultural de suma importancia para el desarrollo. En el artículo se valora su importancia e impacto en la sociedad; definiciones del concepto de extensión y de los modelos que poseen en la actualidad un arraigo en la vida de las instituciones de educación superior, estos últimos responden a diversas posturas ideológicas y concepciones acerca de la relación que debe existir entre la Universidad, (...) la sociedad y los sectores involucrados. Se analizan tres conceptos directamente relacionados con la temática de manera determinante: cultura, pertinencia y desarrollo sostenible. University extension is one of the ways through which the university shows being a very important cultural center for guaranteeing the development. In the following article its relevance and impact in the society is assessed; as well as the definition of the concepts of extension and the models that nowadays are very deep-rooted in the life of the high education institutions. These models respond to the different ideological positions and conceptions related to the relationship that must exist between the university, the society, and the sectors involved. Three concepts directly related to theme of the work are analysed in a determining way: culture, pertinence, and sustainable development. (shrink)

Orphan drug policy often gives ‘special treatment’ to rare diseases, by giving additional priority or making exceptions to specific drugs, based on the rarity of the conditions they aim to treat. This essay argues that the goal of orphan drug policy should be to make prevalence irrelevant to funding decisions. It aims to demonstrate that it is severity, not prevalence, which drives our judgments that important claims are being overlooked when treatments for severe rare diseases are not funded. It shows (...) that prioritising severity avoids problems caused by prioritising rarity, and that it is compatible with a range of normative frameworks. The implications of a severity-based view for drug development are then derived. The severity-based view also accounts for what is wrong with how the current system of drug development unfairly neglects common diseases that burden the developing world. Lastly, the implications of a severity-based view for current orphan drug policies are discussed. There are no data in this work. (shrink)

A common intuition is that the more difficult it is for someone to do the right thing, the more praiseworthy she is for succeeding and the less blameworthy she is for failing. Here, I call this the ‘Difficulty Thesis’ and argue that the Difficulty Thesis is false. In Section 2, I briefly describe what I mean by ‘difficulty’ and the Difficulty Thesis. The Difficulty Thesis has strong prima facie appeal, however, why exactly difficulty is morally relevant remains an open and (...) interesting philosophical question. I discuss this briefly in Section 3. Then, in Section 4, I argue that the Difficulty Thesis is in fact false. That is, difficulty is not relevant to degrees of praise- and blameworthiness. In Section 5, I offer several explanations for why many are fooled by the illusion of relevance of Difficulty. I argue that difficulty is, at best, an imperfect heuristic with regard to evaluations of praise- and blameworthiness. I also argue that while difficulty is not relevant to praiseworthiness and blameworthiness, difficulty is relevant to practices of praise and blame. I conclude, then, that the Difficulty Thesis ought to be rejected. (shrink)

Blockchain is an open digital ledger technology that has the capability of significantly altering the way that people operations operate in organizations. This research takes a first step in proposing several ways in which the blockchain technology can be used to improve current organizational practices, while also considering the ethical implications. Specifically, the paper examines the role that blockchain technology plays in three primary areas of people operations: entry to the organization, intraorganizational processes, and exit. In each section, the paper (...) reviews the ethical implications from the lenses of virtue ethics, utilitarianism, deontology and contractarianism. The paper concludes that in whole the implementation of blockchain technology in people operations processes can create a more ethical work environment. En Isidorianum 17 publiqué un inventario de los expedientes de pureza de sangre conservados en la Capilla Real de Sevilla. Hasta ese momento, existían 148 expedientes -el 74,5% de el importe total de los mismos- según el Inventario de la Archivo de la Capilla Real, fechado en 1753 y con posterior anotaciones. Gracias a ese inventario se supo que 51 expedientes faltaban, ya que el número de los inventariados expedientes es 199. En este artículo presento un inventario de los otros (...) 50 expedientes encontrados recientemente como complemento a aquel primer inventario. Por lo tanto, sólo queda un expediente más. Falta el de José Antonio Ius y Villacampa, según a la lista del Inventario de 1753 de Expedientes de Pureza de la Sangre. (shrink)

Las tareas de descripción documental en los Archivos de la Catedral y del Arzobispado de Sevilla han permitido identificar un documento pontificio original de Gregorio IX, datado en el año 1227, dirigido a las curias eclesiásticas a las que manda proteger y favorecer a la Orden de Predicadores en su expansión y misión evangelizadora, veintiún años antes de la restauración del culto cristiano en Sevilla por Fernando III en 1248, convirtiéndose en el documento original más antiguo conservado hasta la fecha (...) en estos Archivos. En este artículo profundizamos en el análisis del contexto de producción del documento, lo ponemos en relación con otros de contenido idéntico, y trazamos su historia archivística, Todo ello nos permite valorar su interés y destacado papel como testimonio de un proceso histórico de la Iglesia bajomedieval, más allá de su singular antigüedad o de su breve contenido. This text, commissioned by the OSUN Global Observatory of Academic Freedom, discusses how the concept of academic freedom is codified in Colombian Law and regulations of public and private higher education institutions. It also explores common conceptions of academic freedom among Colombian scholars, as well as commonly observed threats to it.

This paper examines folk theories of algorithmic recommendations on Spotify in order to make visible the cultural specificities of data assemblages in the global South. The study was conducted in Costa Rica and draws on triangulated data from 30 interviews, 4 focus groups with 22 users, and the study of “rich pictures” made by individuals to graphically represent their understanding of algorithmic recommendations. We found two main folk theories: one that personifies Spotify and another one that envisions it as a (...) system full of resources. Whereas the first theory emphasizes local conceptions of social relations to make sense of algorithms, the second one stresses the role of algorithms in providing a global experience of music and technology. We analyze why people espouse either one of these theories and how these theories provide users with resources to enact different modalities of power and resistance in relation to recommendation algorithms. We argue that folk theories thus offer a productive way to broaden understanding of what agency means in relation to algorithms. (shrink)

This work examines thoughtlessness and seeks to illuminate the necessity and extent that reflection is involved in becoming practically wise within an Aristotelian virtue ethical framework. Derived from an Arendtian reading of Kantian aesthetic judgment, an account of thinking and judging is offered to supplement traditional accounts of practical wisdom.

Ethical leadership matters in the context of organizational change due to the need for followers to trust the integrity of their leaders. Yet, there have been no studies investigating ethical leadership and organizational change. To fill this gap, we introduce a model of the moderating role of involvement in change. Organizational change and involvement in change are proposed as context-level moderators in the relationships of ethical leadership and work-related attitudes and performance. We employ a sample of 199 supervisor–subordinate pairs from (...) a wide variety of organizations. Results support a three-way interaction (ethical leadership, organizational change, and involvement in change) for performance and OCBs. Our results have important implications for organizational change since ethical leadership appears to complement follower involvement when change is happening. (shrink)

Gratitude is both expected and problematic in live organ donation. Are there grounds to require it, and to forbid access to live donor transplantation to a recipient who fails to signal that he feels any form of gratitude? Recipient gratitude is not currently required for organ donation, but it is expected and may be a moral requirement. Despite this, we argue that making it a condition for live organ transplantation would be unjustified. It would constitute a problematic and disproportionate punishment (...) for perceived immoral behaviour on the part of the recipient. It would also bar the donor from positive aspects of organ donation that remain even in the absence of recipient gratitude. A potential recipient's lack of gratitude should be explored as a possible symptom of other morally problematic issues and integrated into the information provided to the potential donor. Recognition of the donor's gift and gratitude for it may also need to be expressed in part by others. This last aspect is relevant even in cases where the recipient feels and expresses gratitude. The issues involved in deciding whether to use artificial methods of delivering hydration and nutrition are often very difficult for patients, families, and health care providers. Once private and personal matters, these decisions now frequently involve the judicial system. Five years ago, Hospice of Washington recognized the need for a written policy and wrote the one published here. Its goal is to respect individual preferences and family concerns while addressing the nutrition and hydration needs of dying patients. The results in this paper are in a context of abstract elementary classes identified by Shelah and Villaveces in which the amalgamation property is not assumed. The long-term goal is to solve Shelah’s Categoricity Conjecture in this context. Here we tackle a problem of Shelah and Villaveces by proving that in their context, the uniqueness of limit models follows from categoricity under the assumption that the subclass of amalgamation bases is closed under unions of bounded, -increasing chains.

Mass-marketing frauds are on the increase. Given the amount of monies lost and the psychological impact of MMFs there is an urgent need to develop new and effective methods to prevent more of these crimes. This paper reports the early planning of automated methods our interdisciplinary team are developing to prevent and detect MMF. Importantly, the paper presents the ethical and social constraints involved in such a model and suggests concerns others might also consider when developing automated systems.

The employment of mythological language and imagery by an Epicurean poet - an adherent of a system not only materialist, but overtly hostile to myth and poetry - is highly paradoxical. This apparent contradiction has often been ascribed to a conflict in the poet between reason and intellect, or to a desire to enliven his philosophical material with mythological digressions. This book attempts to provide a more positive assessment of Lucretius' aims and methodology by considering the poet's attitude to myth, (...) and the role which it plays in the De Rerum Natura, against the background of earlier and contemporary views. The author suggests that Lucretius was not only aware of the tension between his two roles as philosopher and poet, but attempted to resolve it by developing his own, Epicurean poetic, together with a bold and innovative theory of the origins and meaning of myth. As a neonatal neurologist, I serve families facing tragic decisions in which they must balance trade-offs between death and life with profound disability. I often find myself in complex discussions about future outcome, in which families sort through in real-time what information they value most in making such a choice. Will he laugh? Will he be in pain? Will he know how much he’s loved? In this month’s feature article, Brick et al share the results of an online survey aimed (...) at assessing public views on when a life is not worth living, in an effort to inform ongoing legal and clinical debates about withdrawal of life-sustaining treatment for children. These findings raise important questions about how we define and measure outcomes that matter to parents as they make these tragic decisions. It is challenging to interpret these findings in the absence of context of how decision-making for infants occurs in real-time. The nature of this study and its objective required that cases be substantially simplified. As an outgrowth of experiential and critical pedagogies, and in response to growing rates of student anxiety and depression, educators in recent years have made increasing efforts to facilitate curiosity and mindfulness in the classroom. In Section I, we describe the rationale and function of these initiatives, focusing on the Right Question Institute and mindfulness curricula. Although we admire much about these programs, here we explore ways to complicate and deepen them through a more socially grounded and ethically informed theoretical (...) framework. In Section II, we provide that framework by sketching a sociopolitical account of curiosity and of mindfulness. We propose a curiosity mindful of social location and a mindfulness curious about political structures and historical contexts. In Section III, we then offer concrete suggestions for modifying the curricula of the Right Question Institute and various mindfulness programs. We show how a more nuanced understanding of curiosity and mindfulness strengthens these program offerings. Ultimately, facilitating mindful curiosity and curious mindfulness, we argue, helps educators a) provide more robust learning environments, b) address growing mental health challenges, and c) support global citizenship in the classroom and beyond. Innovation in medieval studies is the creative ability to go back to sources. Digging, exploring, and connecting material pieces of evidence, facts, and individuals uncover new knowledge. One of the most significant sources for the medieval textual production is the university. Understanding the writings stemming from different faculties of medieval universities requires skills, curiosity, and tools. Among such instruments, the statutes of universities help researchers not only to decipher the organization of the academic institutions and interpret the rules that apply (...) to scholars and to their professors, but also to decode how and why texts were produced. The faculty of theology represents the highest level where education led during the Middle Ages and delivers the highest degree such as the master in theology. All over Europe, such faculties become the impetus that drives the intelligentsia to produce a textual heritage that today generates inspiration for magisterial carriers. Among them, Professor Maarten Hoenen is one to praise today. Taking as a point of departure a recent publication of Maarten Hoenen, 1 I will propose to investigate the relation between the statute of universities and of intellectual practices within medieval academia-more precisely, how a researcher should dig for complementary sources when the main documentation depicting an intellectual practice, such as the protestatio and gratiarum actio, is missing. I do not intend to be exhaustive, but simply to focus on how we should understand these two actions, protestatio and gratiarum actio, in connection with the Sentences commentaries. 2 The paradox is that we have traces of these two practices in the surviving manuscripts stemming from the university, but we do not always have a description of these actions in their statutes. Protestatio represents an oath that bachelors take at the beginning of an academic exercise, and the gratiarum actio is the final paragraph that closes the same exercise by thanks addressed to the public. The span of time I will focus on is between the fourteenth and fifteenth centuries, since this is the period from which some testimonies survived that today help to better clarify how these actions were performed in medieval academia. It is also the period of naissance of the new faculties of theology all around Europe, as it is the case with Bologna, Vienna, Cracow, or Prague. They all embraced the model disseminated in Paris and Oxford on reading on the Sentences of Peter Lombard to obtain the degree of doctor in theology, and they contribute to building tradition, and therefore to produce sources for us today. Through Wonder Woman's story, we can build a feminist epic that depicts women who fight patriarchy. In the novel Lesbian Peoples: Material for a Dictionary, Wittig and Zeig describe the Amazons as the warriors thanks to whom we have been able to enter the Golden Age, an age without patriarchy or sex differences. (...) Diana, by becoming Wonder Woman and by fighting against heteropatriarchal injustice, leads the war toward the destruction of this dualistic division. The connection between Amazons and Guerrilleres, between two generations of fighters against patriarchy, aims to inspire our sorority and union in this fight against heteronormative, oppressive structures that affect us all, especially women and other subjects with alternative sexual and gender identities. Esta reflexão pretende mostrar o discurso racional cartesiano na segunda prova da existência de Deus. Para tanto, Descartes se depara com uma pergunta central: qual a causa da existência da res cogitans que é finita e possui a ideia de infinito? A resposta é encontrada na desproporcionalidade ontológica entre o finito e o infinito. Essa desproporcionalidade é elucidada mediante dois conceitos: o princípio de causalidade que determina que a causa deve ser igual ou superior a coisa causada e o princípio (...) de criação contínua em que a causa que criou o ser não é menor do que aquela que o conserva em sua existência. As objeções destacadas no texto contra os argumentos cartesianos foram escolhas deliberadas que servem para elucidar a importância da racionalidade como fundamento para a prova da existência de Deus. A relação entre o entendimento e a liberdade, apresentada no texto sucintamente, justifica a impossibilidade da res cogitans ser causa de si mesma. Palavras-chave: Infinito; finito; causalidade; criação contínuaThis essay aims to show the rational Cartesian discourse on the second proof of God’s existence. In order to do so, Descartes faces a core question: which is the cause for the existence of the res cogitans that is finite in front of the idea of the infinite? The answer is found in the ontological disproportionality between the finite and the infinite. This disproportionality is elucidated through a couple crucial concepts: the principle of causality, which determines that the cause must be equal or superior to the caused thing and the principle of continuous creation, in which the cause that created the being is not inferior than the one that preserves its existence. The objections highlighted in the text against the Cartesian arguments were deliberated choices, to elucidate the relevance of rationality as the foundation for the proof of God’s existence. The relation between the understanding and the liberty, showed on the text even if succinctly, justifies the impossibility of the res cogitans to be the cause of itself. The organizational changes that occurred within the Italian prison system led to profound modifications in the way juridical–educational professionals working in prison perceive themselves and their role. The present study aims at exploring the representations of their professional identity in two groups of JEPs working in as many correctional facilities in Italy. To reach this goal, the JEPs taking part to the research were administered the Symbolic Drawing of the Organizational Life Space, a graphic symbolic tool useful to understand the (...) main features, values, and culture of an organization. The analysis was performed on the drawings made by the JEPs along with the transcriptions of their discourses while performing the task.
