Introduction Future HIV vaccine efficacy trials with adolescents will need to ensure that participants comprehend study concepts in order to confer true informed assent. A Hepatitis B vaccine trial with adolescents offers valuable opportunity to test youth understanding of vaccine trial requirements in general. Methods Youth reviewed a simplified assent form with study investigators and then completed a comprehension questionnaire. Once enrolled, all youth were tested for HIV and confirmed to be HIV-negative. Results 123 youth completed the questionnaire (mean age=15 (...) years; 63% male; 70% Hispanic). Overall, only 69 (56%) youth answered all six questions correctly. Conclusions Youth enrolled in a Hepatitis B vaccine trial demonstrated variable comprehension of the study design and various methodological concepts, such as treatment group masking. (shrink)

In public communication contexts, such as when a company announces the proposal for an important organizational change, argumentation typically involves multiple audiences, rather than a single and homogenous group, let alone an individual interlocutor. In such cases, an exhaustive and precise characterization of the audience structure is crucial both for the arguer, who needs to design an effective argumentative strategy, and for the external analyst, who aims at reconstructing such a strategic discourse. While the peculiar relevance of multiple audience is (...) often emphasized in the argumentation literature and in rhetorical studies, proposals for modelling multi-audience argumentative situations remain scarce and unsystematic. To address this gap, we propose an analytical framework which integrates three conceptual constructs: Rigotti and Rocci’s notion of communicative activity type, understood as the implementation of an interaction scheme into a piece of institutional reality, named interaction field; the stakeholder concept, originally developed in strategic management and public relations studies to refer to any actor who affects and/or is affected by the organizational actions and who, accordingly, carries an interest in them; the concept of participant role as it emerges from Goffman’s theory of conversation analysis and related linguistic and media studies. From this integration, we derive the notion of text stakeholder for referring to any organizational actor whose interest becomes an argumentative issue which the organizational text must account for in order to effectively achieve its communicative aim. The text stakeholder notion enables a more comprehensive reconstruction and characterization of multiple audience by eliciting the relevant participants staged in a text and identifying, for each of them, the interactional role they have, the peculiar interest they bear and the related argumentative issue they create. Considering as an illustrative case the defense document issued by a corporation against a hostile takeover attempt made by another corporation, we show how this framework can support the analysis of strategic maneuvering by better defining the audience demand and, so, better explaining how real arguers design and adapt their topical and presentational choices. The article explores similarities between the philosophies of Zhuangzi and Aristippus, focusing in particular on play and eudaimonism. The main thesis is that both authors encourage the cultivation of a playful mindset, defined in the paper as the “ludic self”, which operates as a strategy for leading a flourishing life. By shaping a fluid, unstructured identity, the ludic self promotes negative subtraction from the structuring power of social nexus and proactive adaptation to shifting circumstances. Furthermore, some aspects of these philosophies (...) present an inter-disciplinary convergence with scientific findings from the psycho-biology of play, concerned with the mobilization of cathected energies and the prevention, or resolution, of addictive states. These promising connections with the fields of psychology and biology also represent an original contribution in respect to the existing debates within Zhuangzi studies, and scholarship on the Cyrenaics. From a methodological point of view, the article pursues what Rorty defines as a “rational reconstruction”, which involves a re-interpretation of past philosophies in light of present debates, ideas and vocabularies with the aim of engaging a trans-cultural, trans-historical dialogue. The value of this operation relies upon the universality of human experience, which always allows re-interpretation and re-actualization of past philosophies as a dialogical exercise of questioning otherness within a hermeneutic framework. Totalitarianism is perhaps unanimously regarded as one of the greatest political evils of the last century and has been the grounds for much of Anglo-American political theory since. Confucianism, meanwhile, has been gaining credibility in the past decades among sympathizers of democratic theory in spite of criticisms of it being anti-democratic or authoritarian. I consider how certain key concepts in the classical Confucian texts of the Mencius and the Xunzi might or might not be appropriated for ‘legitimising’ totalitarian regimes. Under (...) an Arendtian approach to understanding totalitarianism, it is precisely an unproblematised relation to a normative History and Nature that underlies the potential compatibility or incompatibility. I argue against a longstanding prejudice that if any form of Confucianism would be totalitarian, it would have to be Xunzian. Against this, I hope to show that if any form of Confucianism would be totalitarian, it might well be a naturalistic Mencian Confucianism instead of a constructivist Xunzian one. (shrink)

Are counterfactuals with true antecedents and consequents automatically true? That is, is Conjunction Conditionalization: if (X & Y), then (X > Y) valid? Stalnaker and Lewis think so, but many others disagree. We note here that the extant arguments for Conjunction Conditionalization are unpersuasive, before presenting a family of more compelling arguments. These arguments rely on some standard theorems of the logic of counterfactuals as well as a plausible and popular semantic claim about certain semifactuals. Stress-induced brain-mediated immunoregulation is effected by two pathways: autonomic outflow and (neuro)endocrine outflow. Particular attention is given to the interaction-effects of chronic an acute stress. Recent data have established that cells of the immune system produce neuro-peptides and hormones. In concert with cytokines released by these immune cells the brain can be informed on the nature of ongoing immune activity. The significance of conditioning of immune responses is discussed.

Ugar and Malele write that generic machine learning (ML) technologies for mental health diagnosis would be challenging to implement in sub-Saharan Africa due to cultural specificities in how those conditions are diagnosed. For example, they say that in South Africa, the appearance of ‘schizophrenia’ might be understood as a type of spiritual possession, rather than a mental disorder caused by a brain dysfunction. Hence, a generic ML system is likely to ‘misdiagnose’ persons whose symptomatology matches that of schizophrenia in the (...) South African context. The authors thus claim that ‘a generic or universal design cannot be effective given the heterogeneity of value judgements in defining what mental health disorders are in different contexts’.1 Should we take this to mean that ML systems ‘should not be designed with a generalised perception of mental disorders,’1 as the authors suggest? On the contrary, my view is that generic ML can be useful, with the caveat that issues of cultural sensitivity may engender translational challenges in various national and cultural contexts. Yet, if it can be demonstrated that a generic ML system can reliably and accurately pick up on shared symptomatologies across cultures despite what any individual or community might believe about their actual causes, this aspect is surely the function and value of diagnostic ML which we should take to matter. Cultural gaps in aetiological understandings of mental health conditions make it all the more important to advance generic ML as a calibrating diagnostic tool. False consciousness requires a general explanation for why, and how, oppressed individuals believe propositions against, as opposed to aligned with, their own well-being in virtue of their oppressed status. This involves four explanatory desiderata: belief acquisition, content prevalence, limitation, and systematicity. A social constructionist approach satisfies these by understanding the concept of false consciousness as regulating social research rather than as determining the exact mechanisms for all instances: the concept attunes us to a complex of mechanisms conducing oppressed individuals to (...) mistake social understandings of themselves as natural self-understandings—the limits lie where these overlap (sometimes), or are entirely absent. Shun Kwong-loi argues that the distinction between first- and third-person points of view does not play as explanatory a role in our moral psychology as has been supposed by contemporary philosophical discussions. He draws insightfully from the Confucian tradition to better elucidate our everyday experiences of moral emotions, arguing that it offers an alternative and more faithful perspective on our experiences of anger and compassion. However, unlike the distinction between first- and third-person points of view, Shun’s descriptions of anger and (...) compassion leave unarticulated what would be necessary to differentiate these responses from non-moral responses. Here, I make a friendly suggestion on how this explanatory gap might be filled, providing complementary grounding for Shun’s observations by way of K. C. Bhattacharyya’s phenomenological analysis of feeling. It fills the gap by means of a gradation in the possible depth of emotional responses found in the a priori structure of a feeling experience for any subject. The payoff of such a comparison between Shun’s explication of Confucian moral psychology and Bhattacharyya’s explication of rasa theory is not only a possible phenomenological grounding for the former but also a potential way to articulate a missing ethics in Bhattacharyya’s thought. Dorothy Edgington’s work has been at the centre of a range of ongoing debates in philosophical logic, philosophy of mind and language, metaphysics, and epistemology. This work has focused, although by no means exclusively, on the overlapping areas of conditionals, probability, and paradox. In what follows, I briefly sketch some themes from these three areas relevant to Dorothy’s work, highlighting how some of Dorothy’s work and some of the contributions of this volume fit in to these debates.

The debate over Hypothetical Syllogism is locked in stalemate. Although putative natural language counterexamples to Hypothetical Syllogism abound, many philosophers defend Hypothetical Syllogism, arguing that the alleged counterexamples involve an illicit shift in context. The proper lesson to draw from the putative counterexamples, they argue, is that natural language conditionals are context-sensitive conditionals which obey Hypothetical Syllogism. In order to make progress on the issue, I consider and improve upon Morreau’s proof of the invalidity of Hypothetical Syllogism. The improved proof (...) relies upon the semantic claim that conditionals with antecedents irrelevant to the obtaining of an already true consequent are themselves true. Moreover, this semantic insight allows us to provide compelling counterexamples to Hypothetical Syllogism that are resistant to the usual contextualist response. (shrink)

This article proposes a more culturalist and variegated conception of the individual than that presented by individualization theorists. Inspired by the approach of the individual advocated by Émile Durkheim, Talcott Parsons and John Meyers, it first outlines the general script of the individual-as-actor that informs modern individualism as well as the generic characteristics that are routinely attributed to persons such as agency and free will. It subsequently reconstructs three predominant interpretations of this general script, i.e. utilitarian, moral and expressive individualism. (...) For each variant, the intellectual genesis and overall definition of the institutionalization in specific societal domains and the dominant articulations in social theory are briefly presented. With this threefold distinction, the aim is to synthesize the extensive literature on individualism and to show the sociological strengths of approaching subjectivity in terms of institutionalized scripts. That potential, however, is clouded by imprecise definitions of interactivity found among scholars and practitioners alike. Evaluation of state legislature Web sites found them to not be very interactive under most definitions of the term. Chief technology officers of the legislatures appear to differ as to which site features promote interactivity. Many philosophers accept both of the following claims: (1) consciousness matters morally, and (2) species membership doesn’t matter morally. In other words, many reject speciesism but accept what we might call 'sentientism'. But do the reasons against speciesism yield analogous reasons against sentientism, just as the reasons against racism and sexism are thought to yield analogous reasons against speciesism? This paper argues that speciesism is disanalogous to sentientism (as well as racism and sexism). I make a case for the following (...) asymmetry: (a) some non-humans clearly have interests, but (b) no non-conscious entities clearly have interests. This asymmetry, I argue, renders sentientism resistant to the standard argument against speciesism. (shrink)

Although public law scholars have long addressed the problems of accountability generated by private decision-making and "privatization," they have largely ignored this phenomenon in the immigration context. Our ignorance is increasingly indefensible. Millions of employers - private parties - are required by law to screen their workers for unauthorized immigrants, and growing evidence suggests that they use their screening power to ignore workplace protections and to otherwise exploit these workers. This article is the first attempt to apply the insights generated (...) by the privatization literature to immigration law. It argues that our nation's employers have emerged as private immigration screeners who, like airport inspectors screening for ineligible entrants and law enforcement officers screening for criminal noncitizens, assist the Department of Homeland Security in identifying unauthorized workers for removal. More than just agents of exploitation, reframing employers as private screeners demonstrates that they are also agents of the state. Borrowing analytical concepts developing in the privatization literature, I argue that the high risk of abuse and the lack of readily available mechanisms for reducing that risk raise troubling implications over the kind of power that employers wield as private immigration screeners in the workplace. Reframing our nation's employers as private screeners gives theoretical coherence to the discretionary decision-making authority they actually wield, and explains why they have used that authority to exploit workers - as private parties carrying out public duties, they are incentivized to serve their own interests instead of verifying the immigration status of their workers in good faith. Examining the problem of private immigration screening also forces us to reconsider two aspects about immigration screening generally. First, although immigration law tends to reward unauthorized immigrants who lay low and tends to punish those who draw attention to themselves, I suggest that we ought to rethink this logic at least in the context of the workplace. Because workplace violations committed by employers are typically enforced by private parties, punishing unauthorized immigrants who attempt to assert these rights and thus draw attention to themselves, only encourages workplace violations by employers and fosters a culture of lawlessness. Second, thinking about how decision-making authority within immigration law should be allocated between the public and the private contributes to the current conversation over how similar decision-making authority should be allocated between federal entities and local entities. Although questions of accountability have lingered in the backdrop of the immigration federalism debate, I suggest that scholars would be well served to foreground these questions and answer them head-on. In this paper I sketch a socially situated account of responsible agency, the main tenet of which is that the powers that constitute responsible agency are themselves socially constituted. I explain in detail the constitution relation between responsibility-relevant powers and social context and provide detailed examples of how it is realized by focusing on what I call ‘expectations-generating social factors’ such as social practices, cultural scripts, social roles, socially available self-conceptions, and political and legal institutions. I then bring my account (...) to bear on the debate about the exculpatory potential of moral ignorance. I show that a prominent position in this debate – the position that denies that moral ignorance exculpates – is grounded on an individualistic and acontextualist conception of moral capacities, moral cognition, and blameworthiness, and that this conception leads those philosophers who endorse it to make a number of questionable claims regarding the ability of ordinary agents to overcome their moral ignorance and the culpability they bear for the latter. I conclude by indicating how my socially situated account addresses the issue of moral ignorance. (shrink)

In Infinity and the Mind, Rudy Rucker leads an excursion to that stretch of the universe he calls the "Mindscape," where he explores infinity in all its forms: potential and actual, mathematical and physical, theological and mundane. Here Rucker acquaints us with Gödel's rotating universe, in which it is theoretically possible to travel into the past, and explains an interpretation of quantum mechanics in which billions of parallel worlds are produced every microsecond. Using cartoons, puzzles, and quotations to enliven his text, Rucker guides us through such topics as the paradoxes of set theory, the possibilities of physical infinities, and the results of Gödel's incompleteness theorems. His personal encounters with Gödel the mathematician and philosopher provide a rare glimpse at genius and reveal what very few mathematicians have dared to admit: the transcendent implications of Platonic realism. Two compelling principles, the Reasonable Range Principle and the Preservation of Irrelevant Evidence Principle, are necessary conditions that any response to peer disagreements ought to abide by. The Reasonable Range Principle maintains that a resolution to a peer disagreement should not fall outside the range of views expressed by the peers in their dispute, whereas the Preservation of Irrelevant Evidence Principle maintains that a resolution strategy should be able to preserve unanimous judgments of evidential irrelevance among the peers. No standard (...) Bayesian resolution strategy satisfies the PIE Principle, however, and we give a loss aversion argument in support of PIE and against Bayes. The theory of imprecise probability allows one to satisfy both principles, and we introduce the notion of a set-based credal judgment to frame and address a range of subtle issues that arise in peer disagreements. The Internet, not unlike previous communication technologies, has been predicted to dramatically change the nature of democracy. The interactive nature of Web sites, in particular, is seen as the basis for a new cyberdemocracy. Although the definition of interactivity is less than precise, an evaluation of state legislature Web sites finds them lacking many features that could be considered interactive. Furthermore, the degree of a site’s interactivity was not strongly correlated to a site’s use. Web sites can also foster interaction, (...) both on- and off-site, through interactive and noninteractive features. When sites were examined for their potential to foster interaction, there was a strong relationship with site use. The current focus on interactivity may obscure the potential to promote interaction and lead to an overemphasis on interactive features that are sometimes nothing more than high-tech gimmicks. Web sites of the 50 state legislatures are evaluated on five criteria: content, usability, interactivity, transparency, and audience. An overall quality score for each site was computed. The evaluation revealed a wide range of quality in the sites, including that of features or aspects that could possibly foster citizen participation. The higher rated sites help define “best practices” in this regard and provide suggestions as to how other states' sites might make improvements and possibly increase participation.

The pedagogy of Chan Buddhism relies on a binary trend: on the one hand, it requires careful study and active participation in formalized rituals and ceremonies; on the other hand, it requires the simultaneous emancipation from such means and practices, since the transmission of the truth has the character of suddenness and immediacy. In other words, the subversion of standard doctrinal interpretations and ordinary pedagogical strategies is itself an essential part of Chan training. This chapter analyzes the fourth Case of (...) the Blue Cliff Record, which exemplifies in a bright fashion the self-negating dialectics of Chan pedagogy. First, the analysis focuses on the narrated event; second, it moves at the level of meta-narrative, focusing on glosses and commentary. The purpose is to show that the subversive hermeneutics of Chan take place at both levels, narrative and meta-narrative, demanding (and favoring) a proactive and critical progression toward understanding. The present study consists of a cross-cultural analysis of the role of irony in the Blue Cliff Record. The analysis is structured in four chapters, one devoted to methodological concerns and three to equivalent types and functions of irony within the text, a pivotal literary work of the Chan Buddhist tradition. In relation to Chan studies, a discussion of irony is particularly important since the wide corpus of Chan literature includes a significant number and a consistent variety of ironic features (...) such as puns, wordplay, extravagant acts, and so forth. The idea of the present paper is that the ironic temperament of Chan is not a contingent circumstance, but a functional strategy purposely employed in textual compositions and oral communication with soteriological purposes. In Being and Time the broken piece of equipment (§ 16) or the dead body of an Other (§ 47) were seen as resulting from a process of transition (Übergang) between an original state and a position not so removed from it that one had to do with something entirely different. ‚The Origin of the Work of Art‘ takes a more radical approach: rather than leading toward a ‚no longer, but not yet‘, the movement here is toward a ‚no longer, (...) but already‘. Hence its famous thesis: either art is at work, or it is no longer art and already a mere object of art, a piece of art. Contrary to those of Heidegger’s readers who have suggested that his earlier views on transition would have saved him some of the (i.e. political) trouble the art essay runs into, the present paper aims to show that both the earlier and the later view fail to come to terms with what happens in transition as such. This is illustrated by an analysis of the corpse (ad BT § 47), and of junk (ad BT § 16) and leads us to a different approach to what is at stake in art and in the kind of Darstellung exemplified by it. The present article plays off two conceptions of the public sphere against one another. The first one sees in it a sign of what is already present in the private sphere, whereas the second regards it as a symbol that has to inscribe its own symbolic force into the private realm. That this is by no means a mere academic question becomes obvious by way of several examples analyzed at great length: the institution of mourning and the discussion about the (...) presence of religious symbols in the public sphere. An argument for considering the Muslim veil as a protection against the divine is put forward in an attempt to clarify the presuppositions of our current predisposal against it. Ultimately, pluralism should perhaps not just be taken to refer only to the presence of others outside of us who we are able to numerically count, but might be the more difficult plight of having to cope with an otherness within each of us. Should the latter be the case, then we are in need of a public sphere where we can leave behind and thus honor what is not only differentiating us from others but also from ourselves. (shrink)

The healing power of just forgiveness, without excusing injustice. Justice is closely related to forgiveness and the extent of the injustice gap experienced depends on how much or how little personal justice a wounded person desires. The experience of forgiveness includes two diverse forms of forgiveness: decisional and emotional forgiveness. Decisional forgiveness is controlling humans’ behavioural intentions, while emotional forgiveness replaces negative, unforgiving emotions with positive, other-orientated emotions. A victim may make a decision to forgive, but never feels emotional peace (...) about the decision to forgive. Both decisional and emotional forgiveness are experienced internally within a wounded person and depends on the social context of the transgression and the response to it. Justice can narrow the injustice gap, but rarely closes it, while forgiveness can heal the pain within the injustice gap. The sense of desired justice is to some degree justifiable, but by granting decisional forgiveness and experiencing emotional forgiveness a wounded person can slow down if not stop ruminating vengeful thoughts. Christians can forgive transgression and wrongdoing because they are responding in gratitude to God’s mercy, loving-kindness and forgiveness through Jesus’ death on the cross. God guides Christian believers through the example of Jesus’s humility to forgive wrongdoing and ultimately grow spiritually when Jesus requires decisional forgiveness and desires emotional forgiveness between victim and offender. Forgiveness is based on God’s forgiveness, while humans tend to both forgive and also pursue justice without excusing injustice. Humans are in their own power incapable of justly forgiving transgression, but God can guide people through the Holy Spirit to just forgiveness. (shrink)
