The modern doctor-patient relationship displays a patient-centred, mutual-participation characteristic rather than the former active-passive or guidance-cooperation models in terms of medical decision making. Respecting the wishes of patients, amounting to more than mere concern for their welfare, has become the feature central to certain modern bioethics theories. A group of ethical principles such as respect for autonomy, beneficence, non-maleficence, and justice has been proposed by bioethicists and widely adopted by many medical societies as an ethical guide to how doctors, in (...) their daily practice, should treat their patients. However, seeing patients as persons who are rational, self-conscious beings capable of valuing their own lives, and who are consequently entitled to the liberty and rights to choose for themselves, is in general the backbone of Western bioethical principles.Since Confucian philosophy has long been a representative of the East-Asia cultural tradition and Confucian bioethics has recently been developed as a theory of applied ethics, examining Confucius's idea of “persons” may shed some light on the current bioethical debates. Confucius's concept of persons, which is best interpreted via his theories of “chun-tze”, (the morally ideal person) encapsulating a two-dimensional approach, (the “autonomous person” and the “relational person”), provides a more comprehensive model regarding what a person is and how he/she should be treated. This two-dimensional approach sees a person not only as a rational, autonomous agent but also as a relational, altruistic identity whose self actualisation involves incessant participating in and promoting of the welfare of his fellow persons. Hence this may balance the current bioethical trend whereby “respect for autonomy” often triumphs. (shrink)

Individual responsibility is usually articulated either in terms of an individual’s intentions or in terms of the consequences of her actions. However, many of the situations we encounter on a regular basis are structured in such a way as to render the attribution of individual responsibility unintelligible in intentional or consequential terms. Situations of this type require a different understanding of individual responsibility, which I call conditioned responsibility. The conditioned responsibility model advances that, in such situations, responsibility arises directly out (...) of the conditions in which the individual finds herself, irrespective of her intentions or of the consequences of her actions. This model gives rise to a series of challenges, some of which, I propose, can be addressed by drawing on Wittgenstein’s later notion of form of life, together with the notion of honesty implicit in his early approach to ethics. This paper examines whether the modern bioethical principles of respect for autonomy, beneficence, non-maleficence, and justice proposed by Beauchamp and Childress are existent in, compatible with, or acceptable to the leading Chinese moral philosophy—the ethics of Confucius. The author concludes that the moral values which the four prima facie principles uphold are expressly identifiable in Confucius’ teachings. However, Confucius’ emphasis on the filial piety, family values, the “love of gradation”, altruism of people, and the “role specified relation oriented ethics” will (...) inevitably influence the “specification” and application of these bioethical principles and hence tend to grant “beneficence” a favourable position that diminishes the respect for individual rights and autonomy. In contrast, the centrality of respect for autonomy and its stance of “first among equals” are more and more stressed in Western liberal viewpoints. Nevertheless, if the Confucian “doctrine of Mean” and a balanced “two dimensional personhood” approach are properly employed, this will require both theorists and clinicians, who are facing medical ethical dilemmas, of searching to attain due mean out of competing moral principles thus preventing “giving beneficence a priority” or “asserting autonomy must triumph”. This article presents a systematic examination of matrilineal succession in Greek myth. It uses MANTO, a digital database of Greek myth, to identify kings who succeed their fathers-in-law, maternal grandfathers, step-fathers, or wives’ previous husbands. Analysis of the fifty-four instances identified shows that the prominence of the ‘succession via widow’ motif in archaic epic is not typical of the broader tradition. Rather, civic mythmaking more commonly relies on succession by sons-in-law and maternal grandsons to craft connections between cities and lineages, (...) and to claim panhellenic prestige. We show that matrilineal successors are not treated as necessarily illegitimate or inferior within the overwhelmingly patrilineal conventions of Greek myth. In fact, matrilineal calculations afford certain advantages, like the ability to integrate heroes from elsewhere, or to champion local kings with divine fathers. Matrilineal succession reveals the gendered dynamics inherent to Greek myth; we argue that, although in these instances regnal power is transferred through female relatives, the heroines involved are typically treated simply as nodes for this power and their roles in these stories do not necessarily correlate to a greater visibility or autonomy. While proponents of social egg freezing argue that it is liberating for women, opponents contest that the technology provides an individualist solution to a social problem. This article comprises personal and academic reflections on the debate on social egg freezing from four young women studying reproductive technologies. We challenge the promotion of social egg freezing as an empowering option for women and question cultural assumptions about childbearing, the disclosure of risk, failures to consider sexual diversity and socioeconomic status, and the (...) expansion of the market in reproductive tissues. In this paper I explore the ethical responsibility of agents who find themselves in situations characterized by what I call the Individual Ethical Gap (IEG). Individual Ethical Gap situations are structured so as to rule out holding individuals responsible for their actions and omissions by virtue of the intentions behind or the consequences of their actions. I argue that, in IEG situations, individuals can nevertheless, depending on the circumstances, be held ethically responsible for their actions and omissions by virtue of (...) the conditions in which they find themselves operating. Individual Ethical Gap situations therefore give rise to what I call conditioned responsibility: responsibility stemming from the conditions in which one finds oneself enmeshed. This notion of an ethics stemming from conditions (rather than from consequences or intentions) gives rise to a particular form of vulnerability to error in our self- and other-ascriptions of ethical responsibility: a vulnerability in our ethical understanding. In the final section of the paper I use Pamela Sue Anderson’s discussion of vulnerability and of Kantian autonomy to show that this vulnerability arising from the conditioned aspect of our ethical responsibility need not be regarded as a threat to ethics but, on the contrary, as an element of belonging and of understanding that renders possible a more honest encounter with others and with the world. Interpreters are divided on the question of whether the phrase ‘form of life’ is used univocally in Wittgenstein’s later writings. Some univocal interpreters suggest that, for Wittgenstein, ‘form of life’ captures a uniquely biological notion: the biologically human form of life. Others suggest that it captures a cultural notion: the notion of differently enculturated forms of human life. Non-univocal interpreters, in contrast, argue that Wittgenstein does not use ‘form of life’ univocally, but that he uses it sometimes to highlight a (...) cluster of biological notions and sometimes a cluster of cultural ones. The debate between univocal and non-univocal readers has generated a raft of intricate, illuminating literature on both sides. If it remains to an extent open, it is partly as a result of the fact that the textual evidence available on this matter, in Wittgenstein’s later published and unpublished writings, is so limited. In this paper, I argue that considering Wittgenstein’s earlier treatment of ‘form’ can help to shed light on his later treatment of ‘form of life’. More specifically I argue that revisiting the Tractatus ’ treatment of ‘form’ gives us – perhaps surprisingly – reasons to support a non-univocal later reading of ‘forms of life’. (shrink)

I defend a new interpretation of Wittgenstein's notion of religious attitude in the Tractatus , one that rejects three key views from the secondary literature: firstly, the view that, for Wittgenstein, the willing subject is a transcendental condition for the religious attitude; secondly, the view that the religious attitude is an emotive response to the world or something closely modelled on this notion of emotive response; and thirdly, the view that, although the religious and ethical pseudo-propositions of the Tractatus are (...) nonsensical, they nevertheless succeed in expressing the religious attitude endorsed by Wittgenstein. In connection to the first, I argue that the notion of willing subject as transcendental condition is abandoned by Wittgenstein in the Notebooks and is no longer a feature of his position in the Tractatus . In connection to the second, I argue that the religious attitude is dispositional rather than emotive for Wittgenstein: it is a disposition to use signs in a way that demonstrates one's conceptual clarity. Finally, in connection to the third, I argue that the religious or ethical attitude is strongly ineffable in that it cannot be described, expressed or conveyed by language at all. (shrink)

This book advances a reading of Wittgenstein’s Tractatus that moves beyond the main interpretative options of the New Wittgenstein debate. It covers Wittgenstein’s approach to language and logic, as well as other areas unduly neglected in the literature, such as his treatment of metaphysics, the natural sciences and value. Tejedor re-contextualises Wittgenstein’s thinking in these areas, plotting its evolution in his diaries, correspondence and pre- Tractatus texts, and developing a fuller picture of its intellectual background. This broadening of the angle (...) of view is central to the interpretative strategy of her book: only by looking at the Tractatus in this richer light can we address the fundamental questions posed by the New Wittgenstein debate – questions concerning the method of the Tractatus , its approach to nonsense and the continuity in Wittgenstein’s philosophy. Wittgenstein’s early work remains insightful, thought-inspiring and relevant to contemporary philosophy of language and science, metaphysics and ethics. Tejedor’s ground-breaking work ultimately conveys a surprisingly positive message concerning the power for ethical transformation that philosophy can have, when it is understood as an activity aimed at increasing conceptual clarification and awareness. En este artículo examino el debate entre los intérpretes epistémicos y descriptivistas de la discusión humeana de la inducción y el razonamiento probable. Los intérpretes epistémicos consideran a Hume como concernido principalmente con cuestiones relacionadas con la autoridad y justificación epistémica de nuestros principios y creencias inductivas. Los intérpretes descriptivistas, por contra, sugieren que lo que Hume pretende es explicar cómo se producen nuestras creencias, no dictaminar si están epistémicamente justificadas. En particular, me centro en tres de estas lecturas: dos (...) de ellas epistémicas, la tercera descriptivista. La primera interpretación epistémica, la de Peter Millican, nos presenta a Hume abrazando un escepticismo respecto a la inducción; la segunda lectura epistémica, de Louis Loeb, lo presenta como un externalista no escéptico a propósito de la inducción; la lectura descriptivista, defendida por David Owen, presenta a un Hume comprometido principalmente con la tarea científica de describir los mecanismos por los que llegamos a formar nuestras creencias. En este artículo propongo una interpretación alternativa a estas interpretaciones escépticas, externalistas y descriptivistas. Argumento que, aunque estas lecturas tienen innegables puntos de apoyo y ayudan crucialmente a mejorar nuestra comprensión del pensamiento de Hume, todas ellas enfrentan problemas potencialmente insuperables. Concluyo que la mejor estrategia que nos queda abierta pasa por perseguir una explicación que no sea ni escéptica ni externalista de la posición de Hume. Human embryonic stem cell research can bring about major biomedical breakthroughs and thus contribute enormously to human welfare, yet it raises serious moral problems because it involves using human embryos for experiment. The “moral status of the human embryo” remains the core of such debates. Three different positions regarding the moral status of the human embryo can be categorised: the “all” position, the “none” position, and the “gradualist” position.The author proposes that the “gradualist” position is more plausible than the other (...) two positions. Confucius’s moral principle of jen, which proposes a unique theory of “love of gradation”, and the principle of yi, which advocates “due treatment for persons”, are then explored. The author then argues that our moral obligations to do good to other living organisms, persons, and our families are different.Putting together the “gradualist” position on the human embryo, and Confucius’s theories of “love of gradation” and “due treatment for persons”, the author concludes that the early embryo has less ethical significance than the later fetus and adult human. The moral obligation we have toward persons is clearer and stronger than that which we have toward human embryos. Embryo research is justifiable if it brings enormous welfare to human persons that cannot be otherwise achieved. The “love of gradation” requires us, however, to extend love and respect towards other entities according to their different status. We should therefore be very cautious in using human embryos for research, acknowledging the gradualist nature of their moral status. (shrink)

In July 2002, I had the honour to be invited to give a 15 minute presentation on behalf of my country, Taiwan, on the topic of “Current system of national guidance on human subject protection in medical research” in a panel discussion of the Forum for Ethical Review Committees in Asia and the Western Pacific , World Health Organization international conference held in Chin-Mai, Thailand. In that conference, four delegates from Taiwan had a rare and therefore very precious opportunity to (...) share Taiwan’s experience in establishing and promoting “human subject protection system” with delegates from 27 WHO member countries of the region. Awareness of illness in schizophrenia reflects complex storied understanding of the impact of the disorder upon one’s life. Individuals may be aware of their illness in different ways and this may be related to their functioning. A total of 76 adults with schizophrenia were assessed for their awareness of illness, neurocognition, social cognition, and social function concurrently and social function was also assessed at three later time points. A cluster analysis revealed 3 groups: generally full awareness, generally limited awareness, and (...) superficial awareness. Comparisons between these profiles revealed the superficial group had poorer executive function, emotion recognition ability, and capacity for social relationships than the full awareness group, yet had better verbal memory and more social contacts than the limited awareness group. These results suggest assessing the narrative qualities of awareness of illness may reveal unique links with cognition and function, and this may have implications for interventions. (shrink)

This paper puts forward an alternative interpretation of the argument for simple objects advanced in the 2.0s of the Tractatus. In my view, Wittgenstein derives the simplicity of objects directly from his account of possible states, complex objects and senseful propositions. The key to Wittgenstein's argument is the idea that, if there were no simple objects, possible states would not be necessarily possible. If this were the case, however, there would be no senseful language, in Wittgenstein's view. Wittgenstein's earlier treatment of causation and induction remains thought‐provoking and relevant to contemporary debates in the philosophy of science. Wittgenstein's approach to causation and induction in the Tractatus emerges in the context of two separate, but related discussions. A negative discussion that aims to expose a particular understanding of natural necessity as nonsensical, and a more positive discussion concerning the role played by laws in the natural sciences. In the Tractatus, Wittgenstein suggests that internal relations hold between propositions by virtue (...) of the latter's truth‐functional structures. Causal laws are instructions that circumscribe what counts as a senseful proposition of the causal form within an optional system. The natural necessity view (NNV) criticized by Wittgenstein in the Tractatus suggests that some relations of necessary entailment arise between possible states, not by virtue of any internal relations between them, but by virtue of the obtaining of certain laws of nature. Examines the relationship between belief in moral objectivity and two other metaethical attitudes: belief in moral progress and belief in a just world.

Top down as well as bottom-up models of regulation are shifting to a governance paradigm characterized by the greater interaction among public, private and civil society sectors, as well as potential increased flexibility of law. As applied to intellectual property, particularly in the international context, governance literature is emerging but still episodic. In this Article, I examine the World Intellectual Property Organization’s Development Agenda, currently being implemented through its Committee on Development and Intellectual Property. WIPO’s efforts to address global development (...) goals with intellectual property can be theorized through the more participatory and dynamic legal mechanisms promised by global governance. Among the challenges are fragmentation, policy incoherence and a relative lack of due process of softer law, as enacted and as enforced. The pragmatic impact of this major WIPO initiative — evaluated both in terms of the projected benefits and risks of global governance — remains to be seen. (shrink)

Steroid hormone receptors are ligand‐inducible transcription factors that exhibit potent effects on gene expression in living cells. Precise dissection of their mode of action at the molecular level can best be carried out in functional cell‐free systems. This article will describe the benefits of such systems and review their development up to the recent establishment of steroid receptor‐dependent in vitro transcription. Subsequent advances in our knowledge of receptor function arising from the exploitation of this powerful experimental tool will be described. (...) Mereological theories are based on the binary relation “being a part of”. The systematic investigations of mereology were initiated by Leśniewski. More recent authors (including Simons, Casati and Varzi, Hovda) formulated a series of first‐order mereological axioms. These axioms give rise to a plenitude of theories, which are of great philosophical interest. The paper considers first‐order mereological theories from the point of view of computable (or effective) algebra. Following the approach of Hirschfeldt, Khoussainov, Shore, and Slinko, we isolate two important (...) computability‐theoretic properties P (namely, degree spectra of structures, and effective dimensions), and consider the following problem: for a given mereological theory T, is it true that its models can realize every possible variant of the property P? If the answer is positive, then we say that the theory T is ‐universal. We obtain the following results about known mereological theories. Any theory T which is weaker than Extensional Closure Mereology (CEM) is ‐universal. A similar fact is true for the theory GM2. On the other hand, any theory stronger that CEM + (C) + (G) is not ‐universal. In particular, General Extensional Mereology is not ‐universal. (shrink)

Background and Purpose The decision to perform decompressive craniectomy for patients with malignant MCA syndrome can be ethically complex. We investigated factors that clinicians consider in this decision-making process. Methods A survey including clinical vignettes and attitudes questions surrounding the use of hemicraniectomy in malignant MCA syndrome was distributed to 203 neurosurgeons, neurologists, staff and residents, and nurses and allied health members specializing in the care of neurological patients. These were practicing health care providers situated in an urban setting in (...) Canada where access to health care is covered by national policy and is a human right. Results Eighty-eight participants responded to survey. All participants unanimously supported the procedure for young and healthy patients. Advanced age, the presence of aphasia, comorbid medical conditions, and poor baseline functional status were dominant factors associated with increasing reluctance to offer surgical decompression. Patients’ previously expressed wishes were also an important consideration. Eighty-six percent of respondents agreed that withholding surgery is ethically justified if the outcome is perceived as futile. Conclusions Health care providers use similar factors to determine if aggressive management is justified given anticipated burden on patient quality of life and extended impact on society. This convergence can be harnessed beneficially for the transparent communication of medical options in the ethically complex setting of decompressive hemicraniectomy post-stroke. (shrink)

Background The Patient Right to Autonomy Act (PRAA), implemented in Taiwan in 2019, enables the creation of advance decisions (AD) through advance care planning (ACP). This legal framework allows for the withholding and withdrawal of life-sustaining treatment (LST) or artificial nutrition and hydration (ANH) in situations like irreversible coma, vegetative state, severe dementia, or unbearable pain. This study aims to investigate preferences for LST or ANH across various clinical conditions, variations in participant preferences, and factors influencing these preferences among urban (...) residents. Methods Employing a survey of legally structured AD documents and convenience sampling for data collection, individuals were enlisted from Taipei City Hospital, serving as the primary trial and demonstration facility for ACP in Taiwan since the commencement of the PRAA in its inaugural year. The study examined ADs and ACP consultation records, documenting gender, age, welfare entitlement, disease conditions, family caregiving experience, location of ACP consultation, participation of second-degree relatives, and the intention to participate in ACP. Results Data from 2337 participants were extracted from electronic records. There was high consistency in the willingness to refuse LST and ANH, with significant differences noted between terminal diseases and extremely severe dementia. Additionally, ANH was widely accepted as a time-limited treatment, and there was a prevalent trend of authorizing a health care agent (HCA) to make decisions on behalf of participants. Gender differences were observed, with females more inclined to decline LST and ANH, while males tended towards accepting full or time-limited treatment. Age also played a role, with younger participants more open to treatment and authorizing HCA, and older participants more prone to refusal. Conclusion Diverse preferences in LST and ANH were shaped by the public’s current understanding of different clinical states, gender, age, and cultural factors. Our study reveals nuanced end-of-life preferences, evolving ADs, and socio-demographic influences. Further research could explore evolving preferences over time and healthcare professionals’ perspectives on LST and ANH decisions for neurological patients.. (shrink)

This study proposes a research model based on social identity theory, which examines the moderating role of organizational trust on the relationship between corporate citizenship and organizational commitment. In the model, organizational commitment is positively influenced by organizational trust and four dimensions of perceived corporate citizenship, including economic, legal, ethical and discretionary citizenship. The model paths are hypothesized to be moderated by organizational trust. Empirical testing using a survey of personnel from 12 large firms confirms most of our hypothesized effects. (...) Lack of supportive workplaces may be depriving babies and mothers of the health advantages of breastfeeding. This citizen science pilot project set out to engage women in photographing and sharing information on the available facilities for breastfeeding and expressing and storing breastmilk in Australian workplaces. While some useful insights were gained, the project failed in the sense that 234 people ‘liked’ the project Facebook page set up to recruit participants, but only nine photographs were submitted. The heaviest loss of participation (...) occurred after the ethics committee requirements were explained, in particular, the requirement for employer consent to take a photograph, or alternatively, for a participant to agree to bear the risk of taking a photo without permission. The ethics committee also made stipulations about the formality of language to be used. Thus, the project’s potential role as an enabler for health action was neutered. We argue that the ethics requirements worked contrary to our purpose and possibly acted to reinforce the powerlessness some women experience at work. (shrink)

Ethical codes help guide the methods of research that involves samples gathered from ?at-risk? populations. The current article reviews general as well as specific ethical principles related to gathering informed consent from partner violent offenders mandated to outpatient treatment, a group that may be at increased risk of unintentional coercion in behavioral sciences research due to court mandates that require outpatient treatment without the ethical protections imbued upon prison populations. Recommendations are advanced to improve the process of informed consent within (...) this special population and data supporting the utility of the recommendations in a sample 70 partner violent offenders are provided. Data demonstrate that participants were capable of comprehending all essential elements of consent. (shrink)
