This incisive book deals with the use of the criminal law to enforce morality, in particular sexual morality, a subject of particular interest and importance since the publication of the Wolfenden Report in 1957. Professor Hart first considers John Stuart Mill's famous declaration: "The only purpose for which power can be rightfully exercised over any member of a civilized community is to prevent harm to others." During the last hundred years this doctrine has twice been sharply challenged by two great (...) lawyers: Sir James Fitzjames Stephen, the great Victorian judge and historian of the common law, and Lord Devlin, who both argue that the use of the criminal law to enforce morality is justified. The author examines their arguments in some detail, and sets out to demonstrate that they fail to recognize distinction of vital importance for legal and political theory, and that they espouse a conception of the function of legal punishment that few would now share. By comparison with the Atlantic Ocean, the physical oceanography of the Pacific was poorly known as late as the end of the 1930s. International collaboration to study the Pacific, attempted by oceanography committees of the Pacific Science Association, was a failure, owing to the scale of the enterprise, the low scientific abilities of the Pacific nations, and the lack of a compelling need. Even in the U.S.A., where the Scripps Institution of Oceanography was active, lack of good ships and personnel (...) reduced the effectiveness of Pacific oceanography. Scripps's physical oceanographer George F. McEwen was more physicist than physical oceanographer; he also became side-tracked into climatology. Only with the arrival of H. U. Sverdrup at Scripps in 1936 did Pacific physical oceanography begin to prosper, but its greatest success followed World War II, when techniques and approaches transplanted from the Atlantic became established. The effect of mechanical deformation on the formation of quasicrystals in Zr57Ti8Nb2.5Cu13.9Ni11.1Al7.5 glassy ribbons has been investigated. The mechanical treatment drastically affects the crystallization behavior and, in particular, suppresses primary quasicrystal formation. However, quasicrystals can be formed by the addition of the appropriate amount of zirconium. This indicates that if a particular short-range order (e.g., icosahedral) is required for quasicrystal formation and if this short-range order is altered during milling, it can be restored by appropriately adjusting the chemical composition.

If, as we are told, Hume's essay on Miracles was an irrelevant insertion in his Enquiry to gain it the notoriety which the Treatise had missed, the artifice has certainly been successful. Hume's thesis has been hotly debated from that day to this. Neither side it seems can claim complete victory, for both make important concessions. Green, his mostly adverse critic, agrees with Mill and L. Stephen that the argument against miracles is “irrefragable” in itself, though not consonant, he thinks, (...) with Hume's own principles: on the other hand, Huxley whilst declaring it on the historical side “irrefragable,” demurs at least to the presentation of the formal side. Background and aim With the increasing interest in lifestyle, health and consequences of unhealthy lifestyles for the healthcare system, a new kind of solidarity is gaining importance: lifestyle solidarity. While it might not seem fair to let other people pay for the costs arising from an unhealthy lifestyle, it does not seem fair either to punish people for their lifestyle. However, it is not clear how solidarity is assessed by people, when considering disease risks or lifestyle risks. The aim of (...) this study was to investigate the degree of solidarity with lifestyle as well as with other factors that are related to health outcomes—for example, old age—and the relation between this degree of solidarity and various characteristics. Methods This cross-sectional study is part of the Dutch longitudinal SMILE study. Data on the degree of solidarity with different lifestyles and old age, and the relation between the degree of solidarity and various demographic and other variables were obtained in a questionnaire survey. Results Solidarity with smokers and overweight people was moderate, as was solidarity with older people. Respondents were ambivalent about athletes. Respondents who were younger, male and highly educated, and those with a healthy lifestyle, a small social network, high quality of life and an internal locus of control, showed low solidarity. Conclusions Solidarity with an unhealthy lifestyle and old age is moderate and the degree of solidarity varies among the different subgroups. (shrink)

Munsat’s objective in collecting eleven selections on the analytic-synthetic distinction is to acquaint the beginning or intermediate student with the major aspects of the issue. The selections are presented in historical sequence and Munsat has effectively edited the works such that one can easily follow the development of the distinction without having to contend with excessive peripheral material. The editor provides a short introduction to the varieties of truth as well as prefatory notes to each selection. Beginning with brief selections (...) from Leibniz and Hobbes, the treatment of necessary and contingent truths is traced through Kant and Mill. The Mill selection, "Of Demonstration, and Necessary Truths," deals with the inductive foundations of the deductive sciences and mathematics. This line of investigation reaches its climax in the Frege passages on the nature of arithmetical propositions and Russell’s "What is an Empirical Science?" Of particular importance are portions of three classic contributions to the analytic-synthetic distinction: Kant’s Introduction to the Critique of Pure Reason, W. V. Quine’s critical "Two Dogmas of Empiricism," and the rebuttal to Quine’s attack by Grice and Strawson, "In Defense of a Dogma." Finally, the segment of J. L. Austin’s "The Meaning of a Word" could just as well have been excluded in the interest of continuity and in deference to some more appropriate selection. Currently living people cannot be said to be wronged because of the wrongless emissons of greenhouse gases by past people. According to the usual subjunctive-historical understanding of harm, currently living people cannot be said to be harmed by the impact of greenhouse emissions on their well-being. By relying on a subjunctive-threshold notion of harm we can justify conclusions about both the present generation’s duties not to violate the rights of future generations, and the present generation’s duties to compensate currently living (...) people for the harms inflicted upon them through the lasting impact of wrongless past harms. This interpretation supports a forward-looking understanding of the grounds of our relating to wrongless past harms. The significance of past harms lies in their consequences for the well-being of currently living and future people. The subjunctive-threshold notion of harm lends support to a standard of minimal, general, and universal justice. Those actors who are in a position to fulfill its requirements are under a duty to do so. Especially the rich and powerful countries ought to counteract the harmful impact of past greenhouse emissions. (shrink)

This book is a speculative, idiosyncratic, and important successor to Fodor, Bever, and Garrett’s Psychology of Language. It is also the first book in Crowell’s Language and Thought Series edited by J. J. Katz, T. Langedoen, and H. Savin. This is a manifesto which will determine the direction of some research and debate in the next few years. Given that, it is unfortunate that word play and verbal conceits are funnelled into what becomes almost a dialogue between text and footnotes (...) in which the footnotes on occasion become the main text. For example : "If such statements are offered as arguments for the truth of the presupposition of the question on its first reading, then it would appear that General Mills has either misused the method of difference or committed the fallacy of affirmation of the consequent. Philosophy can be made out of anything. Or less.". (shrink)

Allen Carlson has argued that a proper aesthetics of nature must judge nature for ‘what it is’, and that such judgements must be informed by a scientific understanding of nature, in particular, one shaped by the science of ecology. Carlson uses these claims to support his theory of positive aesthetics. This paper argues that there are problems in this view. First, it misunderstands ecology, thereby adopting a view of the natural world that holds it to be much more integrated than (...) it is. Second, it ignores an even more fundamental science of nature, evolution. Thus, it misunderstands both ecology and nature. An alternative to this view would be an aesthetics based on an evolutionary understanding of nature, which holds that, although there are many functional wholes in nature, there is also significant conflict, disintegration, and incongruent scales. A proper aesthetics of nature must take these conflicts into account. The paper ends with a sketch of an aesthetic theory based on the science of evolution. (shrink)

Here, an epidemiological model considering pro and anti-vaccination groups is proposed and analyzed. In this model, susceptible individuals can migrate between these two groups due to the influence of false and true news about safety and efficacy of vaccines. From this model, written as a set of three ordinary differential equations, analytical expressions for the disease-free steady state, the endemic steady state, and the basic reproduction number are derived. It is analytically shown that low vaccination rate and no influx to (...) the pro-vaccination group have similar impacts on the long-term amount of infected individuals. Numerical simulations are performed with parameter values of the COVID-19 pandemic to illustrate the analytical results. The possible relevance of this work is discussed from a public health perspective. (shrink)
