Die Medikalisierung des Sterbens hat dazu geführt, dass ein „guter Tod“ zunehmend auch von medizinischen Interventionen erwartet wird. Die Möglichkeiten einer „terminalen Sedierung“ bis zum Tode werden von vielen als Ausweg angesehen, wenn bei unerträglichem Leid und aussichtsloser Prognose der Wunsch nach aktiver Sterbehilfe angesprochen wird. Durch eine Sedierung können zwar bei schwerstkranken Patienten schwerste therapierefraktäre Leidenszustände effektiv gelindert werden. Diese Therapieoption kann aber auch in der Absicht angewendet werden, den Todeseintritt medizinisch zu beschleunigen, so dass im Zusammenhang mit der (...) Euthanasiedebatte auch das Thema der terminalen Sedierung kontrovers diskutiert wird. Background: Due to recent legislations on euthanasia and its current practice in the Netherlands and Belgium, issues of end-of-life medicine have become very vital in many European countries. In 2002, the Ethics Working Group of the German Association for Palliative Medicine (DGP) has conducted a survey among its physician members in order to evaluate their attitudes towards different end-of-life medical practices, such as euthanasia (EUT), physician-assisted suicide (PAS), and terminal sedation (TS). Methods: An anonymous questionnaire was sent to the 411 (...) DGP physicians, consisting of 14 multiple choice questions on positions that might be adopted in different hypothetical scenarios on situations of “intolerable suffering” in end-of-life care. For the sake of clarification, several definitions and legal judgements of different terms used in the German debate on premature termination of life were included. For statistical analysis t-tests and Pearson-correlations were used. Results: The response rate was 61% (n=251). The proportions of the respondents who were opposed to legalizing different forms of premature termination of life were: 90% opposed to EUT, 75% to PAS, 94% to PAS for psychiatric patients. Terminal sedation was accepted by 94% of the members. The main decisional bases drawn on for the answers were personal ethical values, professional experience with palliative care, knowledge of alternative approaches, knowledge of ethical guidelines and of the national legal frame. Conclusions: In sharp contrast to similar surveys conducted in other countries, only a minority of 9.6% of the DGP physicians supported the legalization of EUT. The misuse of medical knowledge for inhumane killing in the Nazi period did not play a relevant role for the respondents’ negative attitude towards EUT. Palliative care needs to be stronger established and promoted within the German health care system in order to improve the quality of end-of-life situations which subsequently is expected to lead to decreasing requests for EUT by terminally ill patients. Objectives: To analyse legislation and medical professional positions concerning the doctor’s role in assisted dying in western Europe, and to discuss their implications for doctors.Method: This paper is based on country-specific reports by experts from European countries where assisted dying is legalised , or openly practiced , or where it is illegal .Results: Laws on assisted dying in The Netherlands and Belgium are restricted to doctors. In principle, assisted suicide is not illegal in either Germany or Switzerland, but a doctor’s (...) participation in Germany would violate the code of professional medical conduct and might contravene of a doctor’s legal duty to save life. The Assisted Dying for the Terminally Ill Bill proposed in the UK in 2005 focused on doctors, whereas the Proposal on Assisted Dying of the Norwegian Penal Code Commission minority in 2002 did not.Professional medical organisations in all these countries except The Netherlands maintain the position that medical assistance in dying conflicts with the basic role of doctors. However, in Belgium and Switzerland, and for a time in the UK, these organisations dropped their opposition to new legislation. Today, they regard the issue as primarily a matter for society and politics. This “neutral” stance differs from the official position of the Royal Dutch Medical Association which has played a key role in developing the Dutch practice of euthanasia as a “medical end-of-life decision” since the 1970s.Conclusion: A society moving towards an open approach to assisted dying should carefully identify tasks to assign exclusively to medical doctors, and distinguish those possibly better performed by other professions. Objectives To determine the frequencies and types of limitation of medical treatment performed by physician members of the German Society for Palliative Medicine and to analyse the findings with respect to clinical and ethical aspects of end-of-life practices. Design Cross-sectional postal survey. Setting Data collection via the secretary of the German Society for Palliative Medicine using the German language version of the EURELD survey instrument. Subjects All 1645 physician members of the German Society for Palliative Medicine. Main outcome measures Types (...) and frequencies of limitation of treatment and possible determinants. Results 901 physicians participated in the study (response rate 55.8%). Participants reported limitation of treatment in 69.1% of cases. These decisions most often affected artificial nutrition (19%), chemotherapy (14%), antibiotics (11%) and medication other than antibiotics (11%). In the majority of eligible cases, physicians estimated the life-shortening effect of limitation of treatment to be <7 days. However, estimations differ depending on the medical measures in question. Bivariate statistical analysis indicated that withholding of treatment was performed significantly more frequently for patients aged ≥65 years (p=0.019). In addition, there were significant associations between the incidence of limitation of treatment and the different diseases reported by respondents as the underlying cause of death. Conclusion The findings of this study provide information on the current state of an ethically and clinically challenging aspect of clinical practice and can serve as a starting point for further interdisciplinary research on normative and empirical aspects of treatment decision-making at the end of life. Wie wollen wir sterben? Diese Frage steht im Mittelpunkt zahlreicher Diskurse und Publikationen: Was ist ein 'guter Tod' fuer den individuellen Patienten, was versteht unsere Gesellschaft darunter? Welche 'Sterbekultur' hat die Gegenwart? Autoren aus Medizin, Philosophie, Theologie, Psychologie, Soziologie, Geschichte, Ethik, Palliativmedizin, Hospizbewegung und weiteren Gebieten diskutieren im vorliegenden Band eine sinnvolle und menschenwuerdige Gestaltung am Lebensende. Der Vorschlag der Herausgeber zu einer "Ars moriendi nova" als neue Sterbekultur wird interdisziplinär eingebettet und mit Bezug zur gesellschaftlichen Praxis erörtert.

Starting from a reconstruction of the origins of the concept of “modernity” in the late Nineteenth century and of the different interpretations of it in the context of the German social sciences, the essay articulates its radical ambivalences. After establishing that modernity cannot be measured on a scale of progress, neither can it be identified with a specific value, Christof Dipper suggests that there are many conceptions of modernity as there are societies, and that these are not necessarily following (...) a common path. The concept of modernity, that includes anti-modernity as well, embraces therefore actors, representations, and constellations, offering an overall reading of history. (shrink)

Commons enjoy recognition as an alternative to the dichotomy of state and market. In contrast to liberal market theorists who frame the commons as resource-based, we build on alternative and critical conceptions that describe the commons as processual, social, and inherently relational. Our analysis adds to these accounts an articulation of the contemporary commons as “social infrastructure” in the urban spatial conditions where the social processes of commoning take place. We argue that the relational features of urban commons depend on (...) social interactions and cross-sector partnerships in physical places that promote social cohesion, suggesting that the urban commons fold together the spatial and social in hitherto undertheorized ways. To theorize this relationship, we articulate the idea of the relational urban commons as sites of social interaction and relationship building—social infrastructure. This conceptualization suggests that the commons can be governed indirectly by enabling access, participation, and partnerships across sectors, fostering mixed uses and the provision of maintenance and repair. As a result, the commons are both maintained by and conducive to place-based cross-sector partnerships, anchored in place in ways that transcend resources, issues, and ownership. (shrink)

Considered by many to be Abraham Robinson's magnum opus, this book offers an explanation of the development and applications of non-standard analysis by the mathematician who founded the subject. Non-standard analysis grew out of Robinson's attempt to resolve the contradictions posed by infinitesimals within calculus. He introduced this new subject in a seminar at Princeton in 1960, and it remains as controversial today as it was then. This paperback reprint of the 1974 revised edition is indispensable reading for anyone interested (...) in non-standard analysis. The aim of the present study is (1) to show, on the basis of a number of unpublished documents, how Heinrich Scholz supported his Warsaw colleague Jan Łukasiewicz, the Polish logician, during World War II, and (2) to discuss the efforts he made in order to enable Jan Łukasiewicz and his wife Regina to move from Warsaw to Münster under life-threatening circumstances. In the first section, we explain how Scholz provided financial help to Łukasiewicz, and we also adduce evidence of (...) the risks incurred by German scholars who offered assistance to their Polish colleagues. In the second section, we discuss the dramatic circumstances surrounding the Łukasiewiczes' move to Münster in the summer of 1944. (shrink)

Scholars strive, in their treatment of Stein’s work, to express both a phenomenological concept of the human person, characterized by conscious and free spiritual activity, and a metaphysical concept of the person, seen as an individual essence unfolding throughout life. In Stein’s work, the two concepts are not simply juxtaposed, nor is there a shift from one to the other. Stein integrates her phenomenological research into a metaphysical framework. In the present contribution, I endeavor to show that Stein’s interpretation of (...) Husserl’s concept of constitution focuses on the question of whether this constitution is to be understood realistically or idealistically and on the question of the constituting subject. I shall argue that Stein’s interpretation of constitution is closely linked to the lived experience she calls already in her early writings “self-discovery” and “awakening.”. (shrink)

Pour mettre en honneur la dimension relationnelle et dialogique de la personne humaine, beaucoup d’exégètes et de théologiens, surtout depuis Karl Barth, refusent une interprétation structurelle de l’imago Dei. Ma contribution propose plutôt de montrer qu’une interprétation relationnelle de l’image doit être articulée avec une interprétation structurelle et que toutes les deux sont marquées par une tension téléologique. Edith Stein concrétise cette thèse dans sa réflexion sur l’individualité de la personne humaine qui, dans sa perspective, est condition d’un enrichissement mutuel (...) qui ne concerne pas seulement la diversité des vécus, mais l’enrichissement par les personnes elles-mêmes. La thèse de Stein pourrait être énoncée de la manière suivante : pour valoriser une approche relationnelle et communionnelle, il faut en même temps valoriser une approche ontologique et structurelle de la personne humaine, plus particulièrement en ce qui concerne son individualité qualitative. English Title: Structural and Relational Interpretation of the imago Dei: A proposal of Articulation from Edith Stein and Her Conception of the Human Person’s Individuality English Abstract: To appreciate the relational and dialogical dimensions of the human person, many exegetes and theologians, especially after Karl Barth, have refused a structural interpretation of the imago Dei. My contribution proposes rather to show that a relational interpretation of the image must be articulated with a structural one and that both are marked by a teleological tension. Edith Stein concretises this thesis in her reflections on the individuality of the human person which, in her perspective, is a condition for the possibility of mutual enrichment, concerning not only the diversity of lived experiences, but also enrichment by other persons themselves. Stein’s thesis could be enunciated as follows: to valorise a relational and communal approach, one mustvalorise at the same time an ontological and structural approach to the human person, particularly with respect to qualitative individuality. 'Wessen Wissen?' ist einerseits eine Frage nach Akteur-innen, Körpern, Materialien und Technologien, die in künstlerischen Produktions- und Wissensprozessen miteinander interagieren. Diese lassen sich als Übersetzungen und Transformationen beschreiben, in denen Künstler-nnen längst nicht mehr die einzigen Subjekte des Wissens sind. Denn in den künstlerischen Praktiken des Entwerfens, Skizzierens, Modellierens, Probens und Experimentierens entfalten Medien und Materialien ihre je eigene agentielle Kraft. 'Wessen Wissen?' ist andererseits eine Frage nach der Heterogenität von Wissensformationen in ihren partikularen und partialen Perspektiven, also nach situated (...) knowledges. Damit wird die Vorstellung einer allgemeingültigen, körperlosen, neutralen Objektivität bestritten. Im Gegenzug nimmt das situierte Wissen der Künste für sich in Anspruch, Erkenntnisse hervorzubringen und zur Verfügung zu stellen. Es steht demnach für verkörperte Kenntnisse, die in das Feld des zugelassenen und legitimen Wissens kritisch intervenieren. (shrink)

Eine quantitative Dokumentationsanalyse aller VaW-Protokolle wurde mit der leitfadengestützten Befragung von 16 Ärzten und Pflegekräften kombiniert.Teambesprechungen waren in 62,4 %, Entscheidungsgründe in 74,6 % aller VaW-Protokolle dokumentiert. Die Interviews ergaben eine positive, aber berufsgruppendifferente Bewertung der Kommunikation, wobei die Pflegenden kritischer eingestellt waren als ihre medizinischen Kollegen. Die VaW-Dokumentation bewirkte nach Auffassung aller Befragten eine hohe Nachvollziehbarkeit und Transparenz. Die VaW-Anordnung wurde darüber hinaus als gut anwendbar und praxistauglich betrachtet. Nahezu alle Befragten sprachen sich für eine Beibehaltung des VaWVerfahrens in der Klinik aus.Die Implementierung der VaW-Anordnung als hausinterne Leitlinie und Dokumentationsstandard hat zu einer Förderung des interdisziplinären Dialogs und zu einer erheblichen Verbesserung der Transparenz der ethischen Entscheidungsprozesse im Rahmen des Verzichts auf Wiederbelebung geführt. Im Gegensatz zum Idealbild des "mundigen Patienten" zeichnen sich viele Patienten gerade dadurch aus, dass sie die Fahigkeit zur Autonomieausubung vorubergehend oder dauerhaft verloren oder aber gar nicht erst erworben haben. Zu denken ist hier etwa an alte und demente Patienten, an Patienten, die sich aufgrund von Drogen- oder Medikamenteneinwirkung (z. B. auf der Intensivstation) nicht aussern konnen sowie auch an Kinder oder geistig behinderte Patienten. Daher besteht ein grosser Bedarf an ethisch gerechtfertigten und zugleich an der Praxis ausgerichteten Handlungsorientierungen (...) zur Entscheidungsfindung bei nicht einwilligungsfahigen Patienten. Das interdisziplinar angelegte Werk beleuchtet auf medizinethischer und rechtlicher Basis praxisorientiert die Frage sowie die Moglichkeiten, wie in Situationen, die keine eigene Entscheidung durch die Patienten uber die weitere Behandlung ermoglichen, dennoch die Patientenautonomie respektiert werden kann. Recently, the increasing interest in responsible leadership (RL) has produced a research field rich in theoretical and conceptual potential, with diverse research foci, theoretical foundations, and methodological approaches. While these developments have demarcated the field from other leadership-oriented disciplines, they have equally courted fragmentation and ambiguity in terms of the field’s positioning within the greater body of leadership studies. To map the theoretical, methodological, and empirical state of the art of the RL field, we outline recent developments and delineate important (...) research gaps and directions for future theory development and empirical research. We emphasize the transition of RL research from micro-level perspectives with normative roots to research spanning multiple levels of analysis, vis-à-vis both antecedents and outcomes. We discuss the implications of our mapping, highlighting the necessity of not only conceptualizing RL across multiple levels of analysis, but also to actively focus on interactions among RL antecedents and outcomes across these levels. Through these, we aim to contribute to the field by strengthening its conceptual foundations and anchoring it more clearly within leadership studies overall. (shrink)

In "The Quest for Consciousness," Caltech neuroscientist Christof Koch explores the biological basis of consciousness.

Purpose The paper aims to investigate whether dissent—within hospices and palliative care units—can be observed with regard to typical characteristics of “good dying”, how statements about dying processes that are not perceived as good are expressed, and finally which ethically significant normative consequences arise from this. Method The study is conducted on the basis of a qualitative interview study in different groups of actors and the relationships of these groups are compared with each other. Results Notions of good and bad (...) dying are articulated—even dissented upon—not so much by the patients and their relatives themselves as by the professional actors. This is connected with the requirements of a practice, which evidently evokes a need for accountability, namely for communicative assurance. Conclusion An abstract designation of “good dying” is in danger of losing sight of the contextual characteristics of the practice associated with it, which can lead to situations that are problematic from an ethical viewpoint. Der Beitrag will der Frage nachgehen, ob innerhalb von Hospizen und Palliativstationen in Bezug auf typische Merkmale des „guten Sterbens“ jenseits von in der Literatur erhobenen Konsensen auch Dissense beobachtet werden können, wie Sterbeverläufe, die als nicht gut betrachtet werden, zu Wort kommen, und schließlich: welche ethisch beachtlichen normativen Konsequenzen sich daraus ergeben.Die Studie wird auf der Grundlage einer qualitativen Interviewstudie in der Befragung unterschiedlicher Akteursgruppen sowie im Vergleich dieser Gruppen durchgeführt.Artikuliert werden – auch dissentierende – Vorstellungen von einem guten (...) und einem schlechten Sterben, und zwar kaum von den Betroffenen und ihren Angehörigen selbst als vielmehr von den professionellen Akteuren. Die Ausprägung einer solchen Semantik hängt mit den Erfordernissen einer Praxis zusammen, die offenbar ein Rechenschaftsbedürfnis in Form von kommunikativer Vergewisserung evoziert.Eine abstrakte Bestimmung des „guten Sterbens“ steht in Gefahr, die kontextuellen Besonderheiten der damit verbundenen Praxis nicht mehr in den Blick zu bekommen, was zu in ethischer Hinsicht problematischen Situationen führen kann. Existentialism has come to be identified as a critical, reactionary way of thinking, celebrating the individual, freedom, embodiment, and the limits of rationality and systematic theorizing. For the most part this assessment is true of the early and, by now, "classical" works of existentialism, those that first burst upon the philosophical and cultural scene. Circulating Being centers on the later works of several well-known French existentialists to trace out the development of their existential thinking about language, communicative life, ethics, and (...) politics. This development "from embodiment to incorporation" carries existentialism beyond identification with the mere reactionary and reveals how, while prefiguring postmodernism in important ways, the existential thinkers dealt with here reveal themselves to be reconstructive of the Western tradition. This is apparent in the growing appreciation of difference in their late works along with a reluctance to surrender the ideal of unity, and in their reappropriation of truth and justice while repudiating a totalizing metaphysics. The principle of individuation for human persons is one of the points on which Edith Stein is critical of a Thomistic account. In my view, it is possible to show that Stein’s phenomenological perspective does not exclude a Thomistic position, but can be understood in a complementary manner. An investigation into Stein’s distinction between Quid and Quale in the human person has led me to this hypothesis. By Quid, Stein means the common human form with its faculties bearing an individual (...) openness to specific contents (Erschlossenheit) and an individual lifeforce (Lebenskraft). This individuality is the result not only of material dispositions and circumstances (Thomistic view), but even more basically of the Quale by which Stein means a fundamental quality of the being of each person. Advanced AI systems are rapidly making their way into medical research and practice, and, arguably, it is only a matter of time before they will surpass human practitioners in terms of accuracy, reliability, and knowledge. If this is true, practitioners will have a prima facie epistemic and professional obligation to align their medical verdicts with those of advanced AI systems. However, in light of their complexity, these AI systems will often function as black boxes: the details of their contents, calculations, (...) and procedures cannot be meaningfully understood by human practitioners. When AI systems reach this level of complexity, we can also speak of black-box medicine. In this paper, we want to argue that black-box medicine conflicts with core ideals of patient-centered medicine. In particular, we claim, black-box medicine is not conducive for supporting informed decision-making based on shared information, shared deliberation, and shared mind between practitioner and patient. Today there is considerable disagreement between the US and the EU with respect to food safety standards. Issues include GMOs, beef hormones, unpasteurized cheese, etc. In general, it is usually asserted that Europeans argue for the precautionary principle (with exceptions such as the Sanitary and Phytosanitary Agreement where ``substantial equivalence,'' a form of familiarity, is used) while Americans defend risk analysis or what is sometimes described as the familiarityprinciple. This is not to suggest that EUmember countries agree on how the (...) precautionaryprinciple should be applied; considerabledifferences exist among nations as will benoted below.In this paper I review both positionsarguing that they are best understood asvariants of the homiletics of risk rather thanas differing scientific positions. I concludethat while science must necessarily enter intothe formulation of food and agriculturalstandards, state policy, private economicinterests, and the interface between the two(e.g., when democratic states are successfullylobbied to support particular privateinterests), play important roles in determininghow particular risks will be treated. Moreover,I argue that the role of science mustnecessarily be limited if its credibility is tobe preserved. (shrink)

What drives Chinese MNEs’ global CSR integration and local CSR responsiveness? Drawing on institutional theory, we argue that both antecedents reflecting globally isomorphic patterns of adaptation and antecedents mirroring the distinct characteristics of China’s institutional context are relevant. We support our argument using fuzzy-set qualitative comparative analysis on a sample of 29 of China’s globally most influential companies. We find that state influence and global CSR associations affect global CSR integration, whereas presence in the West and internationalization through mergers and (...) acquisitions predict local CSR responsiveness. Our study thus suggests that home-country characteristics are an important co-determinant of the CSR approaches of emerging-market MNEs. We further find that multicultural experience in top management teams is associated with both global CSR integration and local CSR responsiveness, supporting notions of transnational CSR. (shrink)

Dieser Beitrag soll den langen Weg von den frühkirchlichen theologischen Debatten über den klassischen Personbegriff bis hinein in die Phänomenologie Edith Steins anhand von einigen paradigmatischen Etappen aufzeigen. Dabei wird neues Licht auf den Personbegriff fallen, denn ausgehend vom theologischen Hintergrund sind zwei verschiedene - wenn auch nicht notwendigerweise alternative - Personbegriffe möglich. Danach gilt es, dieselbe Zweideutigkeit bei Stein offenzulegen und zu untersuchen. Die menschliche Person kann als Substanz oder als Selbststand verstanden werden, wobei Stein einen tendenziell modernen Personbegriff (...) mit einer Brücke zum klassischen Personverständnis hält, indem sie das Bewusstsein als im Selbststand begründet, und den Selbststand als an eine Natur gebunden versteht.
