In her paper, The case for physician assisted suicide: not proven, Bonnie Steinbock argues that the experience with Oregon’s Death with Dignity Act fails to demonstrate that the benefits of legalising physician assisted suicide outweigh its risks. Given that her verdict is based on a small number of highly controversial cases that will most likely occur under any regime of legally implemented safeguards, she renders it virtually impossible to prove the case for physician assisted suicide. In this brief paper, we (...) suggest some ways that may enable us to weigh the risks and benefits of legalisation more fairly and, hopefully, allow us to close the case for physician assisted suicide. At the heart of Paul Ricoeur’s hermeneutic phenomenology of religion one discovers a commitment to the diversity of religious expression. This commitment is grounded in his understanding of the linguistic and temporal conditions of religious phenomena. By exploring his contribution to the debate concerning the so-called ‘theological turn’ in French phenomenology in relation to his studies of translation, this essay explores Ricoeur’s understanding of religious phenomenality where meaning is experienced as the simultaneous advance and withdrawal of an originary event in (...) the traces of its interpretations. With such an understanding of religious phenomenality, the way is opened for philosophy of religion to advance a more robust consideration of religious diversity and, therefore, to reconsider notions of universality better suited to the things themselves. This article summarizes some of the results of the BIOMED II project “Basic Ethical Principles in European Bioethics and Biolaw” connected to a research project of the Danish Research Councils “Bioethics and Law”. The BIOMED project was based on cooperation between 22 partners in most EU countries. The aim of the project was to identify the ethical principles of respect for autonomy, dignity, integrity and vulnerability as four important ideas or values for a European bioethics and biolaw. The research concluded (...) that the basic ethical principles cannot be understood as universal everlasting ideas or transcendental truths but they rather function reflective guidelines and important values in European culture. The method of the research was conceptual, philosophical analysis of the cultural background of the four values or normative ideas that people use and find important in their existence. Moreover, this was combined with analysis of empirical legal material and policy documents. Also, a number of qualitative interviews with relevant experts were carried out. Another important result of the BIOMED project was the partner's Policy Proposals to the European Commission, the Barcelona Declaration, unique as a philosophical and political agreement between experts in bioethics and biolaw from many different countries. Nearly all students believe academic cheating is wrong, yet few students say they would report witnessed acts of cheating. To explain this apparent tension, the present research examined college students’ reasoning about whether to report plagiarism or other forms of cheating. Study 1 examined students’ conflicts when deciding whether to report cheating. Most students gave reasons against reporting a peer (e.g., social and physical consequences, a lack of responsibility to report) as well as reasons in favor of reporting (e.g., concerns (...) about welfare, justice, and fairness). Study 2 provided experimental confirmation that the contextual factors referenced by Study 1 participants in fact influenced decisions about whether to report cheating. Overall, the findings indicate that students often decide against reporting peers’ acts of cheating, though not due to a lack of concern about integrity. Rather, students may refrain from reporting because of conflicting concerns, lack of information about school policy, and perceived better alternatives to reporting. (shrink)

Tocqueville pessimistically predicted that liberty and equality would be incompatible ideas. Robert Dahl, author of the classic _A Preface to Democratic Theory,_ explores this alleged conflict, particularly in modern American society where differences in ownership and control of corporate enterprises create inequalities in resources among Americans that in turn generate inequality among them as citizens. Arguing that Americans have misconceived the relation between democracy, private property, and the economic order, the author contends that we can achieve a society of (...) real democracy and political equality without sacrificing liberty by extending democratic principles into the economic order. Although enterprise control by workers violates many conventional political and ideological assumptions of corporate capitalism as well as of state socialism. Dahl presents an empirically informed and philosophically acute defense of "workplace democracy." He argues, in the light of experiences here and abroad, that an economic system of worker-owned and worker-controlled enterprises could provide a much better foundation for democracy, political equality, and liberty than does our present system of corporate capitalism. Background:Since the adoption of the Universal Declaration of Human Rights by the United Nations in 1948, human rights as set out in government documents have gradually changed, with more and more power being transferred to individual.Objectives:The aim of this article is to analyze how the position of the patient in need of care is constructed in Norway’s renamed and revised Patients’ and Service Users’ Rights Act (originally Patients’ Rights Act, 1999) and published comments which accompanying this legislation from the Norwegian (...) Ministry of Health and Care Service.Research design:A constructivist design was used, and Fairclough’s critical discourse approach was adopted to analyze the text of the Patients’ and Service Users’ Rights Act and comments.Findings:The analysis identified three discourses: (a) political discourse, containing ethical discourses about priority and economy, in which patients are constructed as powerless individuals; (b) expert discourse, containing a theme about patients’ trust in the healthcare team and its knowledge, in which patients are constructed as helpless individuals lacking knowledge; and (c) patient participation and patient autonomy discourse, containing ethical discourses about decision-making, in which patients are constructed not only as individuals with needs and rights but also as “troublesome.”Conclusion:Dominant paternalistic discourses in the legal text validate the power of medicine, the healthcare system, and heath personnel over the needs, rights, participation, and autonomy of the patient. It finds that these small businesses' CSR activities are not particularly well explained by the existing literature on CSR in small‐ and medium‐sized enterprises, which assumes the presence of large competitors. This raises the question of whether small businesses that do not compete against large corporations may actually behave (...) more like ‘little big firms’ when it comes to CSR. The article finds that the two businesses studied are mostly driven by external pressure to improve their social responsibility. Such pressure stems partly from news reports on their activities and partly from increasing competition leading to a situation where the small businesses operating in the market scrutinise each others' activities. We provide an overview of the development of product placements within traditional and newer electronic media, followed by a critique of current regulations where they exist and highlight the challenges this form of brand promotion presents to regulators. We note the weaknesses in current theoretical perspectives on the way product placements impact more than awareness and argue that a failure to recognise the increasingly diverse nature of product placement within entertainment media content means that awareness campaigns and warnings regarding the (...) presence of product placements are unlikely to be effective in countering any negative effects of the practice on vulnerable groups such as children and young adults. While we focus on the impact of product placement activity on children and young adults, using primarily the examples of alcohol and tobacco products, we also raise concerns regarding a failure to act on the presence of a number of harmful products that fall beyond the current list of restricted products even in countries where some form of specific regulation exists. In order to aid those considering the necessity for, or scope of, any future restrictions on this form of marketing communication, it is important to determine not only what is known, but what also needs to be determined about the impact of product placements across the range of existing and evolving communication channels. While we share many of the views on emotion research put forth in Kagan’s article “Once More into the Breach,” our commentary focuses on two points of disagreement. First, we argue for the importance of a priori principles. In particular, emotions cannot be understood without reference to final and formal cause, and the related principles of equifinality and equipotentiality. Secondly, although we agree the term “basic emotions” is misleading, we maintain that the emotions traditionally called “basic” should still be seen (...) as a distinct set of emotions by virtue of their being constitutive for other, derived emotions. In conclusion we argue for moving beyond the strict empiricist approach proposed by Kagan and many thinkers before him. (shrink)

L’article se concentre sur la pandémie de covid-19 dans une tentative d’évaluer la contribution éventuelle de l’analyse philosophique à la compréhension et à la résolution des problèmes éthiques, juridiques et sociopolitiques qu’elle soulève. On aborde une série de dilemmes cruciaux qui requièrent des décisions pratiques, avant et après la production et la disponibilité des vaccins, à la lumière des théories éthiques et politiques contemporaines. Il s’avère que dans la plupart des cas les conceptions déontologiques semblent l’emporter sur les considérations conséquentialistes, (...) qui ne s’imposent à notre raisonnement que dans des situations d’urgence immédiate. Academic cheating, a common and consequential form of dishonesty, has puzzled moral psychologists and educators for decades. The present research examined a new theoretical approach to the perceptions, evaluations, and motivations that shape students’ decisions to cheat. We tested key predictions of this approach by systematically examining students’ accounts of their own cheating. In two studies, we interviewed undergraduates in psychology (n = 68) and engineering (n = 123) classes about their past experiences with plagiarism or other cheating. Interviews assessed (...) students’ perceptions of whether they were cheating, their evaluations of whether their actions were okay, and their motivations for doing what they did. Most students did not initially recognize their acts as cheating. While students generally thought cheating was wrong, they often judged the exceptional cases in which they cheated to be acceptable, citing concerns such as assignment goals and task feasibility. The findings suggest that perceptions, evaluations, and competing motivations play a key role in students’ decisions to cheat. (shrink)

Virtuosity in music performance is often associated with fast, precise, and efficient sound-producing movements. The generation of such highly skilled movements involves complex joint and muscle control by the central nervous system, and depends on the ability to anticipate, segment, and coarticulate motor elements, all within the biomechanical constraints of the human body. When successful, such motor skill should lead to what we characterize as fluency in musical performance. Detecting typical features of fluency could be very useful for technology-enhanced learning (...) systems, assisting and supporting students during their individual practice sessions by giving feedback and helping them to adopt sustainable movement patterns. In this study, we propose to assess fluency in musical performance as the ability to smoothly and efficiently coordinate while accurately performing slow, transitionary, and rapid movements. To this end, the movements of three cello players and three drummers at different levels of skill were recorded with an optical motion capture system, while a wireless electromyogrphy (EMG) system recorded the corresponding muscle activity from relevant landmarks. We analyze the kinematic and coarticulation characteristics of these recordings separately and then propose a combined model of fluency in musical performance predicting music sophistication. Results suggest movements from expert performers' are characterized by consistently smooth strokes and scaling of muscle phasic coactivation. The explored model of fluency as function of movement smoothness and coarticulation patterns was shown to be limited by the sample size but serves as a proof of concept. Results from this study show the potential of a technology-enhanced objective measure of fluency in musical performance, which could lead to improved practices for aspiring musicians, instructors, and researchers. These are the proceedings of the First International Conference on Compu- tional Logic (CL 2000) which was held at Imperial College in London from 24th to 28th July, 2000. The theme of the conference covered all aspects of the theory, implementation, and application of computational logic, where computational logic is to be understood broadly as the use of logic in computer science. The conference was collocated with the following events: { 6th International Conference on Rules and Objects in Databases (DOOD (...) 2000) { 10th International Workshop on Logic-based Program Synthesis and Tra- formation (LOPSTR 2000) { 10th International Conference on Inductive Logic Programming (ILP 2000). CL 2000 consisted of seven streams: { Program Development (LOPSTR 2000) { Logic Programming: Theory and Extensions { Constraints { Automated Deduction: Putting Theory into Practice { Knowledge Representation and Non-monotonic Reasoning { Database Systems (DOOD 2000) { Logic Programming: Implementations and Applications. The LOPSTR 2000 workshop constituted the program development stream and the DOOD 2000 conference constituted the database systems stream. Each stream had its own chair and program committee, which autonomously selected the papers in the area of the stream. Overall, 176 papers were submitted, of which 86 were selected to be presented at the conference and appear in these proceedings. The acceptance rate was uniform across the streams. In addition, LOPSTR 2000 accepted about 15 extended abstracts to be presented at the conference in the program development stream. (shrink)

PurposeThe purpose of this paper is to discuss some ethical issues in the internet encounter between customer and bank. Empirical data related to the difficulties that customers have when they deal with the bank through internet technology and electronic banking. The authors discuss the difficulties that customers expressed from an ethical standpoint.Design/methodology/approachThe key problem of the paper is “how does research handle the user's lack of competence in a web‐based commercial environment?” The authors illustrate this ethical dilemma with data from (...) a Danish Bank collected in 2002. The data have been structured by an advanced text analytic method, Pertex.FindingsThe authors can conclude that the experience of lack of competency in internet banking implies a severe damage on the experience of the ethics of the good life and of the respect for the basic ethical principles of customer autonomy, dignity, integrity and vulnerability. However, increased experience of competency may imply experience of increased feeling of ethical superiority and of the good life among customers.Research limitations/implicationsThe important implication for managerial research of this study would be for banks to focus on customer competency with an ethical concern instead of only being concerned with technical solutions for effective internet operations.Practical implicationsSince more and more businesses are digitally based, the authors can foresee a potential generic problem of lack of competence for certain age groups and also of people from different social groups.Originality/valueThe paper provides an analysis of the ethics of on‐line banking on the basis of Pertex methodology and with the use of basic ethical principles of autonomy, dignity, integrity and vulnerability. Attempts to explain emotion typically emphasize the interaction of evolutionary and socialization processes. However, in describing this interplay the role of the person is typically underemphasized or unaccounted for. This paper lays out empirical and theoretical rationale for considering the person as a major contributor to emotion generation and development.

One staple of living in our information society is having access to the web. Web-connected devices interpret our queries and retrieve information from the web in response. Today’s web devices even purport to answer our queries directly without requiring us to comb through search results in order to find the information we want. How do we know whether a web device is trustworthy? One way to know is to learn why the device is trustworthy by inspecting its inner workings, 156–170 (...) 1995; Humphreys 2004, Episteme, 6, 221–229 2009). But ordinary users of web devices cannot inspect their inner workings because of their scale, complexity, and the corporate secrecy which enshrouds both the procedures by which the devices operate and the companies that make them. Further piling on this predicament, authors have criticized web technology on the grounds that the invisibility of the web devices’ inner workings prevents users from critically assessing the procedures that produce a given output, in some cases, barring users from fulfilling their epistemic responsibilities, 343–355 2010; Miller and Record Episteme, 10, 117–134 2013). I consider four broad kinds of reasons which we can acquire without inspecting the inner workings of black-boxed technology: individual understanding, expert testimony, testing through experience, and social vetting; and show how each is a viable method of appraising black-boxed technology. By deploying these methods, we can remain responsible inquirers while nonetheless benefitting from today’s epistemic resources on the web. (shrink)

Les géologues ont suggéré de nommer l’époque actuelle « Anthropocène » pour indiquer que les activités humaines ont atteint un impact sur l’environnement qui rivalise avec celui d’événements naturels comme l’érosion des sols, les orbites lunaires, la tectonique des plaques, etc. Il semble évident que le terme n’a de sens que s’il est possible de distinguer les événements anthropiques des événements naturels, c’est-à-dire les êtres humains de la nature. La grande influence de Bruno Latour sur le débat international autour des (...) questions environnementales est indiscutable, mais surprenante si l’on considère qu’il s’est efforcé, au fil des ans, dans ses livres, articles et interviews, de contester le sens même du terme « nature ». Par conséquent, il a minimisé la pertinence du concept pour aborder la situation désastreuse actuelle concernant l’Anthropocène. Dans cet article, l’auteur tente de reconstituer les prises de position changeantes de Latour sur le concept de nature, en s’appuyant sur une sélection de ses œuvres jusqu’à la publication de Où atterrir? Comment s’orienter en politique. Il s’avère que Latour a, dans une certaine mesure, abandonné sa première interprétation constructiviste de la nature comme « fabriquée » et a timidement commencé à accepter l’existence de la nature. Cependant, il n’a jamais défini un concept cohérent de la nature et, par conséquent, n’a pas non plus atteint une position stable sur les questions écologiques fondamentales. (shrink)

The present book comprises thirteen chapters written by Nordic scholars in the human and social sciences, and developed out of conference papers presented at regular winter and summer symposia held by two research groups emanating from the Nordic Summer University. Born within and informed by this specific milieu, the chapters address significant sociopolitical implications for contemporary societies emerging from the ethical reflections of leading 20th century thinkers (e.g. Michel Foucault and Jürgen Habermas), important procedural as well as substantive aspects of (...) democracy, and pivotal ethico-political issues arising from the abstract logic and concrete manifestations of market economies. Though by no means devoid of their own economic, cultural and political problems, the Nordic countries are still paramount examples of humane prosperity, democratic civility, environmentally sound policy, and peaceful resolution of social and industrial conflicts. Year after year, if not decade after decade, they keep topping the international charts for socio-economic indicators about sostainable development, healthcare quality and accessibility, educational levels, crime control, preceived happiness and much else. As such, the scholarly and scientific reflections orginating within the Nordic Summer University might prove to be useful sources of insight for policy-makers, intellectuals and interested persons outside the Nordic context, and not solely inside it. This book argues that according to Metaphysics Zeta, substantial forms constitute substantial being in the sensible world, and individual composites make up the basic constituents that possess this kind of being. The study explains why Aristotle provides a reexamination of substance after the Categories, Physics, and De Anima, and highlights the contribution Z is meant to make to the science of being. Norman O. Dahl argues that Z.1-11 leaves both substantial forms and individual composites as candidates for basic constituents, (...) with Z.12 being something that can be set aside. He explains that although the main focus of Z.13-16 is to argue against a Platonic view that takes universals to be basic constituents, some of its arguments commit Aristotle to individual composites as basic constituents, with Z.17’s taking substantial form to constitute substantial being is compatible with that commitment.. Audits of the informed consent process are a key element of a clinical research quality assurance program. A systematic approach to such audits has not been described in the literature. In this paper we describe two components of the audit. The first is the audit of the informed consent document to verify adherence with federal regulations. The second component is comprised of the audit of the informed consent conference, with emphasis on a real time review of the appropriate communication of (...) the key elements of the informed consent. Quality measures may include preparation of an informed consent history log, notes to accompany the informed consent, the use of an informed consent feedback tool, and the use of institutional surveys to assess comprehension of the informed consent process. In its recent statement 'Sex Selection and Preimplantation Genetic Diagnosis', the Ethics Committee of the American Society of Reproductive Medicine concluded that preimplantation genetic diagnosis for sex selection for non-medical reasons should be discouraged because it poses a risk of unwarranted gender bias, social harm, and results in the diversion of medical resources from genuine medical need. We critically examine the arguments presented against sex selection using preimplantation genetic diagnosis. We argue that sex selection should be available, at least within (...) privately funded health care. (shrink)

Some fundamental aspects of the lived body only become evident when it breaks down through illness, weakness or pain. From a phenomenological point of view, various breakdowns are worth analyzing for their own sake, and discussing them also opens up overlooked dimensions of our bodily constitution. This book brings together different approaches that shed light on the phenomenology of the lived body—its normality and abnormality, health and sickness, its activity as well as its passivity. The contributors integrate phenomenological insights with (...) discussions about bodily brokenness in philosophy, theology, medical science and literary theory. Phenomenology of the Broken Body demonstrates how the broken body sheds fresh light on the nuances of embodied experience in ordinary life and ultimately questions phenomenology’s preunderstanding of the body. In polite contexts, people find it difficult to perceive whether they can derive scalar inferences from what others say . Because this uncertainty can lead to costly misunderstandings, it is important to identify the cues people can rely on to solve their interpretative problem. In this article, we consider two such cues: Making a long Pause before the statement, and prefacing the statement with Well. Data from eight experiments show that Pauses are more effective than Wells as cues to scalar (...) inferences in polite contexts—because they appear to give a specific signal to switch expectations in the direction of bad news, whereas Well appears to give a generic signal to make extra processing effort. We consider the applied value of these findings for human–human and human–machine interaction, as well as their implications for the study of reasoning and discourse. (shrink)
