The concept of representation in public law is attracting more and more interest; specially gives many problems in the Parliament how representation, so as a representative institution. In this place is plained a principal problem: the new function of Parliament and the roll of parliamentary's Government control. We assist to the end of the dogma of the separation of powers. So we need to distinguish between control by the Parliament and control in the Parliament; the first are less effective because (...) significate the Government control of his own majority; the second is the critical capacity of minorities against the Government; this last are a effective control who's should create public opinion. This does not imply the suppression of public representation idea. By suggesting a revision of these idea does not mean that they should disappear. It seems wise to conserve the concept of representation providing it refer to the particular situation of the autoritas and his decision, whenever he appers as a victim of the procers in which take part the after side of problem: the souveragnity. En Carl Schmitt en la Segunda República Española Gabriel Guillén Kalle analiza aspectos particulares de Carl Schmitt en ese periodo de nuestra nación en entreguerras. El autor reconoce que la recepción republicana fue primordialmente jurídica, mas esta perspectiva conlleva observar ese concepto de lo polítíco que atraviesa su obra entera. Guillén propone una estrategia para la relectura de Schmitt en ese periodo y para ello analiza a los principales autores que se ocuparon de él, sin desdeñar a (...) algunos menos conocidos como puede ser Zozaya. Un tema importante para nuestra nación es el control de constitucionalidad que Schmitt, siguiendo a Constant con la teoría del poder moderador, encuentra en el Presidente del Reich, y que en la segunda República española se dejó en un organismo, el Tribunal de Garantías Constitucionales que pretendía colocarse por encima de las pasiones, aunque por su composición -poco jurídica- condujo al fracaso. También es de interés cómo Medina sitúa el pensamiento schmittiano de los órdenes concretos en el idealismo objetivo necesitando de dualismos para su existencia. (shrink)

Various international authorities have insisted on the importance of ethical learning in higher education for would-be professionals, including students of Business Administration. As the process of creating the European Higher Education Area gathers pace, first steps have been taken to explicitly incorporate ethics in the common European Qualifications Framework. However, the authors of this study show how in the course of the EQF development process, the consideration given to ethical qualifications has been curtailed and subjected to serious limitations. In this (...) article, the authors review the historical development and the main elements of the EQF. Then, they analyze the gradual elimination of ethics within the EQF. Multiple studies show that periodic reanalysis of genomic test results held by clinical laboratories delivers significant increases in overall diagnostic yield. However, while there is a widespread consensus that implementing routine reanalysis procedures is highly desirable, there is an equally widespread understanding that routine reanalysis of individual patient results is not presently feasible to perform for all patients. Instead, researchers, geneticists and ethicists are beginning to turn their attention to one part of reanalysis—reinterpretation of previously classified variants—as a means of (...) achieving similar ends to large-scale individual reanalysis but in a more sustainable manner. This has led some to ask whether the responsible implementation of genomics in healthcare requires that diagnostic laboratories routinely reinterpret their genomic variant classifications and reissue patient reports in the case of materially relevant changes. In this paper, we set out the nature and scope of any such obligation, and analyse some of the main ethical considerations pertaining to a putative duty to reinterpret. We discern and assess three potential outcomes of reinterpretation—upgrades, downgrades and regrades—in light of ongoing duties of care, systemic error risks and diagnostic equity. We argue against the existence of any general duty to reinterpret genomic variant classifications, yet we contend that a suitably restricted duty to reinterpret ought to be recognised, and that the responsible implementation of genomics into healthcare must take this into account. Advances in DNA technology and the discovery of DNA polymorphisms have permitted the creation of DNA databases of individuals for the purpose of criminal investigation.Many ethical and legal problems arise in the preparation of a DNA database, and these problems are especially important when one analyses the legal regulations on the subject.In this paper three main groups of possibilities, three systems, are analysed in relation to databases. The first system is based on a general analysis of the population; the second (...) one is based on the taking of samples for a particular list of crimes, and a third is based only on the specific analysis of each case. The advantages and disadvantages of each system are compared and controversial issues are then examined. We found the second system to be the best choice for Spain and other European countries with a similar tradition when we weighed the rights of an individual against the public's interest in the prosecution of a crime. The use of genomic testing in pregnancy is increasing, giving rise to questions over how the information that is generated should be offered and returned in clinical practice. While these tests provide important information for prenatal decision-making, they can also generate information of uncertain significance. This paper critically examines three models for approaching the disclosure of variants of uncertain significance (VUS), which can arise from forms of genomic testing such as prenatal chromosomal microarray analysis (CMA). Contrary to prevailing arguments, we (...) argue that respect for reproductive autonomy does not justify adopting a model on which an offer to disclose VUS is a routine part of genetic counselling. Instead, we contend that a commitment both to solidarity between healthcare providers and pregnant women and to the acceptance of a novel principle of caution under normative uncertainty means that we should instead adopt a model of VUS disclosure that imposes a strong presumption against offering to disclose VUS. The upshot of this is that it should be standard practice to only offer to disclose VUS when this is requested by the woman undergoing CMA. We defend our position against claims that arise from an alleged right to such information and that a presumption against an offer will lead to inequity. (shrink)

While some countries are moving toward legalization, euthanasia is still criticized on various fronts. Most importantly, it is considered a violation of the medical ethics principle of non-maleficence, because it actively seeks a patient’s death. But, medical ethicists should consider an ethical alternative to euthanasia. In this article, we defend cryocide as one such alternative. Under this procedure, with the consent of terminally-ill patients, their clinical death is induced, in order to prevent the further advance of their brain’s deterioration. Their (...) body is then cryogenically preserved, in the hope that in the future, there will be a technology to reanimate it. This prospect is ethically distinct from euthanasia if a different criterion of death is assumed. In the information-theoretic criterion of death, a person is not considered dead when brain and cardiopulmonary functions cease, but rather, when information constituting psychology and memory is lost. In recent years, a great deal of evidence has accumulated on the health risks and environmental impacts of some herbicides. Both conventional agriculture and agroecology are searching for alternatives to address the challenges posed by the consequences of herbicide use. In this search, peasant and indigenous agroecosystems have much to contribute since their crops evolved thousands of years ago together with diverse communities of weeds, and farmers have carried out sophisticated strategies to manage them. Through participant observation, semi-structured interviews, free (...) lists, and botanical collection, we document a milpa design that integrates and manages spontaneous vegetation to take advantage of its presence and minimize risks of crop loss. The objective of this article is to critically contrast agroecological mechanisms in this milpa design which matches the prevention principle with a set of recommendations recognized as preventive in conventional weed science. Some philosophers of religion have argued that moral anti-theodicy begs the question. This paper evaluates the arguments from two such philosophers, writing a decade apart—Robert Mark Simpson, and Lauri Snellman. Simpson argues that any global argument against theodicy must allow for the possibility of there existing a plausible theodicy, and that anti-theodical arguments (the argument from insensitivity, the argument from detachment, and the argument from harmful consequences) all implicitly discount this possibility, thus ending up begging the question. Snellman argues that (...) moral anti-theodicies presuppose that some evils cannot be justified, which would presuppose that theodicy is false from the start, which in turn would beg the question against theodicy. The author of the paper argues that Simpson’s arguments rest on an erroneous assumption regarding the nature of anti-theodicy, and that one of Simpson’s arguments sets a problematic standard for argumentation that the author argues we should not accept. It is also argued that Snellman’s argument relies on an unsupported claim from Toby Betenson. Therefore, the author concludes that Simpson and Snellman have not managed to show that moral anti-theodicies beg the question. (shrink)

Although stakeholder theory is widely accepted in environmental disclosure research, empirical evidence about the role of stakeholders in firms’ disclosure is still scarce. The authors address this issue for a setting of carbon disclosure. Our international sample comprises the Carbon Disclosure Project Global 500, S&P 500, and FTSE 350 reports from 2008 to 2011, resulting in a total of 1,120 firms with 3,631 firm-year observations. The authors apply Tobit regressions to analyze the relationship between carbon disclosure and the relevance of (...) the following stakeholder groups: government, general public, media, employees, and customers. Our results confirm that in addition to carbon performance, all stakeholders are associated with carbon disclosure. Only one stakeholder group acts as a moderator for the relationship between carbon performance and carbon disclosure. Furthermore, the authors find that carbon performance but not the affiliation to a carbon-intensive industry acts as a moderator between stakeholder relevance and carbon disclosure. (shrink)

En estas páginas se reúnen tres trabajos elaborados en diferentes fechas, pero estrechamente interrelacionados bajo la intención global de aportar algunos elementos a la evaluación de las opciones metodológicas y epistemológicas en el campo de la investigación en Ciencias Sociales. Esos tres escritos nacen de la preocupación por los riesgos a que se ven expuestos los procesos de producción de conocimientos en el área social, sobre todo si consideramos que, dadas ciertas circunstancias del debate epistemológico actual, casi a diario aparecen (...) ofertas bajo la con?signa del nuevo paradigma o del paradigma emergente. Ante estas ofertas suele ocurrir que unos se muestran entusiasmados y otros incrédulos, pero muy pocos, relativamente, se dedican a evaluarlas. Así, sin evaluar las distintas opciones, la investigación social podría llegar a extremos de li?bertinaje académico, inoperancia y descrédito, incumpliendo de ese modo con el delicado compromiso que tienen los investigadores -tesistas, tuto?res y profesores- con respecto a las necesidades de la sociedad actual. En general, el supuesto inicial más importante aquí es que no pode?mos asumir ciegamente una determinada oferta metodológica y epistemo?lógica, por atractiva que parezca, si previamente no la sometemos a una crítica dura, desinteresada y honesta. Bajo esos términos, tomando en cuenta el predominio y la creciente influencia que han llegado a ejercer las propuestas del «paradigma emergente» sobre noveles investigadores sin que éstos dispongan de un cuerpo amplio de contrargumentaciones y señalamientos divergentes, los trabajos aquí presentados se orientan a deslindar aspectos que parecen significativos para una crítica severa y puntual. Esto es aun más urgente si consideramos que, apartando el caso de muchos investigadores respetables y serios que trabajan bajo la óptica del paradigma emergente, recientemente han pululado las posiciones anárqui?cas y descabelladas que también se declaran bajo esa misma óptica. Y, según parece, es aquí donde late un importante peligro para la investiga?ción social. Esperamos que de los trabajos aquí recogidos puedan también deducirse esas diferencias. (shrink)

Michael Walzer’s article ‘Political action: the problem of dirty hands’ initiated a new wave of discussion over a persistent problem in moral philosophy: are there situations in which ethical rules must be relaxed so as to bring about a greater good? In this article, we consider whether this ‘dirty hands’ approach may be applied to our current climate crisis. One proposed solution to the problem of global warming is the administration of moral enhancements to the population. Assuming that the administration (...) of moral enhancements is a necessary condition in the prevention of a climate crisis, Parker Crutchfield argues that this procedure ought to be covert. This implies lying to the public, and such dishonesty amounts to immoral behavior. We conclude that despite the severity of global warming, there is no justification for a dirty hands approach. Lying to the public in order to save the planet would probably create bigger problems, and it would ultimately be very counterproductive in trying to save the planet. (shrink)

A semantics of pictorial representation should provide an account of how pictorial signs are associated with the contents they express. Unlike the familiar semantics of spoken languages, this problem has a distinctively spatial cast for depiction. Pictures themselves are two-dimensional artifacts, and their contents take the form of pictorial spaces, perspectival arrangements of objects and properties in three dimensions. A basic challenge is to explain how pictures are associated with the particular pictorial spaces they express. Inspiration here comes from recent (...) proposals that analyze depiction in terms of geometrical projection. In this essay, I will argue that, for a central class of pictures, the projection-based theory of depiction provides the best explanation for how pictures express pictorial spaces, while rival perceptual and resemblance theories fall short. Since the composition of pictorial space is itself the basis for all other aspects of pictorial content, the proposal provides a natural foundation for further pictorial semantics. (shrink)

In recent years, many disciplines have become interested in the scientific study of morality. However, a conceptual framework for this work is still lacking. In The Moral Background, Gabriel Abend develops just such a framework and uses it to investigate the history of business ethics in the United States from the 1850s to the 1930s. According to Abend, morality consists of three levels: moral and immoral behavior, or the behavioral level; moral understandings and norms, or the normative level; and (...) the moral background, which includes what moral concepts exist in a society, what moral methods can be used, what reasons can be given, and what objects can be morally evaluated at all. This background underlies the behavioral and normative levels; it supports, facilitates, and enables them. Through this perspective, Abend historically examines the work of numerous business ethicists and organizations--such as Protestant ministers, business associations, and business schools--and identifies two types of moral background. "Standards of Practice" is characterized by its scientific worldview, moral relativism, and emphasis on individuals' actions and decisions. The "Christian Merchant" type is characterized by its Christian worldview, moral objectivism, and conception of a person's life as a unity. The Moral Background offers both an original account of the history of business ethics and a novel framework for understanding and investigating morality in general. (shrink)

Localization Wireless Sensor Networks (WSN) represent a research topic with increasing interest due to their numerous applications. However, the viability of these systems is compromised by the attained localization uncertainties once implemented, since the network performance is highly dependent on the sensors location. The Node Location Problem (NLP) aims to obtain the optimal distribution of sensors for a particular environment, a problem already categorized as NP-Hard. Furthermore, localization WSN usually perform a sensor selection for determining which nodes are to be (...) utilized for maximizing the achieved accuracy. This problem, defined as the Sensor Selection Problem (SSP), has also been categorized as NP-Hard. While different metaheuristics have been proposed for attaining a near optimal solution in both problems, no approach has considered the two problems simultaneously, thus resulting in suboptimal solutions since the SSP is biased by the actual node distribution once deployed. In this paper, a combined approach of both problems simultaneously is proposed, thus considering the SSP within the NLP. Furthermore, a novel metaheuristic combining the Black Widow Optimization (BWO) algorithm and the Variable Neighbourhood Descent Chains (VND-Chains) local search, denominated as BWO-VND-Chains, is particularly devised for the first time in the author’s best knowledge for the NLP, resulting in a more efficient and robust optimization technique. Finally, a comparison of different metaheuristic algorithms is proposed over an actual urban scenario, considering different sensor selection criteria in order to attain the best methodology and selection technique. Results show that the newly devised algorithm with the SSP criteria optimization achieves mean localization uncertainties up to 19.66 % lower than traditional methodologies. (shrink)

This chapter explores logical semantics, that is, the structural meaning of logical expressions like connectives, quantifiers, and modalities. It focuses on truth-theoretical semantics for formalized languages, a tradition emerging from Carnap's and Tarski's work in the first half of the last century that specifies the meaning of these expressions in terms of the truth-conditions of the sentences in which they occur. It considers Tarski-style definitions of the semantics of a given language in a stronger metalanguage, Tarski's impossibility results, and attempts (...) to overcome them in the post-Tarskian tradition. On September 19th, 2005, an Spanish blogger wrote a post against blog nets. In that post he showed a kierkegaardian interpretation of blogging issue. It was the first time someone was using strictly philosophical categories in the blogosphere. On 2006, February, the 23rd, Rafael Herrera Guillén made a philosophical dramatization about this issue in a game of heteronyms.

As we have discussed elsewhere, Franz Boas and John Dewey were intellectual and political allies at Columbia University for over thirty years.1 Dewey advocated for an increased role of anthropology for philosophical insight, and he often used anthropological knowledge as a starting point for his ethics and politics, including such knowledge as learned from Boas. We hold that Boas and Dewey shared a common core understanding of human global and evolutionary diversity, and that this shared understanding itself forms a core (...) component of their progressive projects.However, with regard to the problem of racism in the United States, Boas and Dewey had different engagements. Philosophers have suggested that, in order to understand the particular visual state we are in during picture perception, we should focus on experimental results from vision neuroscience—in particular, on the most rigorous account of the functioning of the visual system that we have from vision neuroscience, namely, the ‘Two Visual Systems Model’. According to the initial version of this model, our visual system can be dissociated, from an anatomo-functional point of view, into two streams: a ventral stream subserving visual recognition, (...) and a dorsal stream subserving the visual guidance of action. Following this model, philosophers have suggested that, since the two streams have different functions, they represent different properties of a picture. However, the original view proposed by the ‘Two Visual Systems Model’ about the presence of a strong anatomo-functional dissociation between the two streams has recently been questioned on both philosophical and experimental grounds. Indeed, the analysis of several new pieces of evidence seems to suggest that many visual representations in our visual system, related to different tasks, are the result of a deep functional interaction between the streams. In the light of the renewed status of the ‘Two Visual Systems Model’, also our best philosophical model of picture perception should be renewed, in order to take into account a view of the process of picture perception informed by the new evidence about such interaction. Despite this, no account fulfilling this role has been offered yet. The aim of the present paper is precisely to offer such an account. It does this by suggesting that the peculiar visual state we are in during picture perception is subserved by interstream interaction. This proposal allows us to rely on a rigorous philosophical account of picture perception that is, however, also based on the most recent results from neuroscience. Unless the explanation offered in this paper is endorsed, all the recent evidence from vision neuroscience will remain unexplained under our best empirically informed philosophical theory of picture perception. Este estudio da cinco pasos. En el primero se caracterizan los orígenes del análisis reflexivo. Bajo el título “origen” se incluyen, principalmente, las motivaciones y el campo de aplicación al cual está referido. En el segundo paso, se presentan las características del análisis reflexivo, sobre todo en términos de supuestos y de la relación del mismo con el canon fenomenológico de estirpe husserliana. En el tercer paso, se valora el alcance del análisis reflexivo como técnica; en cierto modo, se estudia (...) cómo puede operar con y sin la fenomenología como enfoque, teoría o método integral dentro de la investigación. En el cuarto paso, se establece cómo el análisis reflexivo ha encontrado unas alternativas de aplicación, por parte de Lester Embree; sobre todo, se mira el enlace que tiene o puede tener con la individuación al tenor de la lectura de Ideas II de Husserl. Como cierre, en el quinto paso, se establece críticamente el alcance del análisis reflexivo y las posibilidades que ofrece para el desarrollo o continuación de la fenomenología, en el contexto de las vertientes contemporáneas sobre este enfoque.The article is divided into five moments. The first one presents the origins of the reflective analysis; under the title “origin” is included, mainly, the motivations and the scope to which it is referred. The second one refers to the characteristics of the reflective analysis, especially in terms of assumptions and relate to the same lineage husserlian’s phenomenological canon. The third one assesses the scope of the reflective analysis as technique; in this way, it explores how can operate with and without the Phenomenology as approach, theory or method integral within the research. The fourth one sets how reflective analysis has found some alternatives of the application by Lester Embree; most of all, the link that has or can have is regarded with to the individuation in way of Ideas II by Husserl. Finally, it sets critically the scope of the reflective analysis and the possibilities for devel-opment or continuation of Phenomenology in the context of the contemporary approach in this perspective. El artículo reconoce los aportes que la Dra. Julia V. Iribarne realizó en torno a la ética en perspectiva fenomenológica, especialmente en su obra De la ética a la metafísica. Con base en estas contribuciones se responden tres preguntas: ¿cómo la generatividad y la temporalidad se convierten en estructuras de la eticidad? ¿Cómo hay, fenomenológicamente, una metafísica en cuanto se conoce la mismidad y la alteridad trascendentalmente? ¿Es Dios para la ética un fictum o un factum? A modo de colofón (...) se alude a la centralidad de la mente y el esclarecimiento de los estados mentales como avance en el fundamento y despliegue de la ética.This article identify the contributions that Dra. Julia V. Iribarne made around ethics in phenomenological perspective and especially her work Ethics in the way of metaphysics. According to her contributions we could answer these three questions: How generativity and temporality becomes structures of the ethics? How is possible, phenomenologically, a metaphysics if we know self-hood and otherness transcendentally? Is God a fictum or factum for the ethics? As a final reference, we will talk about the centrality of mind and we will try to clarify the rationale and mental states like a development of the ethics. (shrink)

Resumen Tanto la migración como el exilio, al lado del extranjero y el extraño, han sido objeto de la investigación fenomenológica. En este estudio se da un pequeño paso con respecto a la fenomenología de la migración. En particular, se lleva a cabo una profundización en torno a un estrato fundante: el éxodo en sus intrincadas relaciones con estratos tales como la frontera y la diáspora. Así, centramos la atención en el éxodo como experiencia y en los estratos protofundadores de (...) la comprensión de la migración. Con esta mirada, se dan tres pasos, a saber, se caracteriza la relación existente entre 1. El éxodo y la constitución trascendental; se establece la interrelación entre 2. La frontera y la comunidad de pertenencia; y, finalmente, se mira cómo 3. La diáspora opera la constitución trascendental de la esperanza. A manera de 4. Conclusiones se vuelve la atención a la constitución trascendental como fundamento de la ética.Migration like exile, alongside the stranger and the stranger, have been the subject of phenomenological research. In this study a small step is taken regarding the phenomenology of migration. In particular, a deepening is carried out around a founding stratum: the exodus in its intricate relation- ships with strata such as the border and the diaspora. Thus, we focus attention on the exodus as experience and on the foundational layers of the understanding of migration. With this view, three steps are taken, namely, the relationship between the exodus and the transcendental constitution is characterized; the interrelation is established between 2. The border and the community of belonging; and, finally, we look at how 3. The diaspora operates the transcendental constitution of hope. By way of 4. El problema de la enajenación del ser humano es una constante en la obra teórica y narrativa de José Revueltas. El hecho de que el tema carcelario aparezca con frecuencia en sus relatos y novelas, en algunos de los cuales la cárcel deviene un personaje más, obedece precisamente a su interés en dicho problema. Como aquí se muestra, Revueltas no sólo buscaba exponer y analizar la enajenación humana, sino a la vez explorar posibles vías de liberación. De ahí que, mientras (...) que en sus primeros trabajos se centró en el sistema penitenciario, gradualmente pasó a abordar en ellos el encierro en el espacio público y en la propia conciencia. The dissemination and reception of Bernard Bolzano's ideas were not only mediated by his personal circumstances and context but also by the vicissitudes of his work. This paper traces the fate of his works from his death in 1848 to the publication of the first volume of his Gesamtausgabe in 1969, and it does so with the help of one of the last published volumes of this edition, namely the Bolzano‐Gesamtbibliographie 1804–1999. ABSTRACT:Giving without the expectation of reward is difficult to understand in organizational contexts. In opposition to a logic based on self-interest or a sense of duty, a “logic of gift” has been proposed as a way to understand the phenomenon of free, unconditional giving. However, the rationale behind, and effects of, this logic have been under-explored. This paper responds by first clarifying the three logics of action—the logic of exchange, the logic of duty, and the logic of gift—and then explains (...) how their balanced integration promises to enhance organizational life and outcomes. Having explicated the unique character and contributions of the logic of gift, the paper further suggests practical implications for management. Encouraging the logic of gift fosters more humane relationships within organizations and to enable individuals to be generous in ways that inspire trust and promote creativity. (shrink)

Numerous researchers have examined the antecedents of trust between managers and subordinates. Recent studies conclude that their influence varies depending on whether what is being examined is a manager's trust in a subordinate or a subordinate's trust in a manager. However, the reasons given to justify this phenomenon present limitations. This article offers a new theoretical approach that relates the influence of each antecedent to Aristotelian forms of reasoning, ethical, and instrumental. The proposed approach shows that the influence of each (...) antecedent depends on which rationality prevails in the person who trusts. The contribution of this article is to better explain the phenomenon of interpersonal trust formation and its logic, while offering at the same time several practical implications for managers interested in developing an organizational culture based on trust. The article begins with a literature review of more relevant empirical studies analyzing superior–subordinate trust formation and presents some theoretical limitations of the arguments described in these works. Then, it offers a new theorerical approach based on Aristotelian thought to explain the influence of the antecedents of trust in management–subordinate relationships. The theoretical contribution is then confirmed in an empirical study of 163 mid-level managers in Spain. (shrink)

Sociologists often ask why particular groups of people have the moral views that they do. I argue that sociology’s empirical research on morality relies, implicitly or explicitly, on unsophisticated and even obsolete ethical theories, and thus is based on inadequate conceptions of the ontology, epistemology, and semantics of morality. In this article I address the two main problems in the sociology of morality: (1) the problem of moral truth, and (2) the problem of value freedom. I identify two ideal–typical approaches. (...) While the Weberian paradigm rejects the concept of moral truth, the Durkheimian paradigm accepts it. By contrast, I argue that sociology should be metaphysically agnostic, yet in practice it should proceed as though there were no moral truths. The Weberians claim that the sociology of morality can and should be value free; the Durkheimians claim that it cannot and it should not. My argument is that, while it is true that factual statements presuppose value judgments, it does not follow that sociologists are moral philosophers in disguise. Finally, I contend that in order for sociology to improve its understanding of morality, better conceptual, epistemological, and methodological foundations are needed. (shrink)
