Comment on Joseph Raz, From Normativity to Responsibility.

In these brief comments on Bruno Celano’s “Pre-conventions. A Fragment of the Background”, I propose further thoughts on what, following Celano’s analysis, I call embodied conventions. I begin with a number of remarks on Celano’s philosophical method. Then I claim, first, that the social dimension of conventionality remains obscure in his account of embodied conventions, and, second, that his account of pre-conventions is still imprecise due to the ambiguity of the notion of the Background.

El artículo analiza la tesis intencionalista como solución a problemas de indeterminación en la interpretación jurídica. La investigación se limita a la indeterminación producida por dos rasgos del lenguaje, a saber, la vaguedad y la textura abierta. Según la tesis intencionalista el intérprete debe, en estos casos, recurrir a la intención del autor del texto. Para evitar ciertas objeciones a esta tesis, pero también para mostrar sus límites, se analiza su funcionamiento en la interpretación de los contratos y se muestra (...) que la intención no permite solucionar problemas de vaguedad, aunque sí parece servir para, en ciertos casos, resolver problemas de textura abierta. Sin embargo, en la última sección, se exponen las dificultades que surgen cuando se intenta identificar la intención del autor del texto y que precluyen la posibilidad de que permita resolver concluyentemente los problemas de indeterminación. Miguel de Unamuno celebra la locura del Quijote como una afirmación del “yo” en su Vida de don Quijote y Sancho. Para G.K. Chesterton la afirmación radical del “yo” es el elemento fundamental de la locura, pero no algo para ser celebrado. Para Chesterton la locura del Quijote no está tanto en la afirmación de su propio “yo” sino en la afirmación de una realidad olvidada, invisible para quienes se han acostumbrado a vivir en un mundo que ha perdido el (...) juicio: es el único cuerdo en un mundo de locos. Elementos de esta lectura del Quijote pueden encontrarse, a pesar de Unamuno, en la Vida de don Quijote y Sancho; es Unamuno, más que el Quijote, quien afirma su “yo” a costa de la realidad. A hemi-implicative lattice is an algebra \((A,\wedge,\vee,\rightarrow,1)\) of type (2, 2, 2, 0) such that \((A,\wedge,\vee,1)\) is a lattice with top and for every \(a,b\in A\), \(a\rightarrow a = 1\) and \(a\wedge (a\rightarrow b) \le b\). A new variety of hemi-implicative lattices, here named sub-Hilbert lattices, containing both the variety generated by the \(\{\wedge,\vee,\rightarrow,1\}\) -reducts of subresiduated lattices and that of Hilbert lattices as proper subvarieties is defined. It is shown that any sub-Hilbert lattice is determined (up to isomorphism) by (...) a triple (_L_, _D_, _S_) which satisfies the following conditions: _L_ is a bounded distributive lattice, _D_ is a sublattice of _L_ containing 0, 1 such that for each \(a, b \in L\) there is an element \(c \in D\) with the property that for all \(d \in D\), \(a \wedge d \le b\) if and only if \(d \le c\) (we write \(a \rightarrow _D b\) for the element _c_), and _S_ is a non void subset of _L_ such that _S_ is closed under \(\rightarrow _D\) and _S_, with its inherited order, is itself a lattice. Over recent years, various semantics have been proposed for dealing with updates in the setting of logic programs. The availability of different semantics naturally raises the question of which are most adequate to model updates. A systematic approach to face this question is to identify general principles against which such semantics could be evaluated. In this paper we motivate and introduce a new such principle the refined extension principle. Such principle is complied with by the stable model semantics for (single) (...) logic programs. It turns out that none of the existing semantics for logic program updates, even though generalisations of the stable model semantics, comply with this principle. For this reason, we define a refinement of the dynamic stable model semantics for Dynamic Logic Programs that complies with the principle. (shrink)

La oveja (Ovis aries) es el primer animal domesticado para consumo en un hito histórico que marca el inicio de la sedentarización de las comunidades humanas al comienzo del Neolítico. Durante milenios, fueron semejantes al muflón asiático (Ovis orientalis), su ancestro salvaje. Las razas primitivas supervivientes en el norte de Europa son oscuras, mudan el pelo estacionalmente, tienen cuernos en ambos sexos y apenas producen lana. Los ancestros de las modernas surgieron hace unos 3.500 años. Se seleccionaron para producir lana (...) blanca, que crece indefinidamente y se colecta anualmente. Este proceso coincide con la invención de las tijeras de esquilar y con el descubrimiento de tintes como la púrpura. Solo la lana blanca puede teñirse de cualquier color, permitiendo trasladar al tejido las mismas señales que quizá antes nos pintábamos con ocre sobre el cuerpo. La oveja, un herbívoro social muy manejable, sumaba al suministro de alimento el de una fibra abrigada y modificable en su color distintiva de quienes la visten. Un lienzo en blanco donde trasponer las expresiones estéticas antes restringidas al cuerpo, al arte rupestre y al mobiliar. De ahí que diversas mitologías contemplen una relación simbólica especial con ellas. La revolución estética propiciada por las ovejas blancas zozobra en el siglo XX con la aparición de nuevas fibras y el abaratamiento de otras. Hoy, los arquetípicos y blancos rebaños característicos de la iconografía occidental tienden a una coloración mixta al devaluarse la lana. Otras especies domésticas con fibras que solo recientemente se han apreciado comercialmente, como las cabras de angora (Capra hircus) o las llamas (Lama glama), siguen un proceso idéntico al emprendido con las ovejas hace milenios para tornarse blancas. Presentamos las implicaciones estéticas que han estimulado la selección artificial de ovejas con lanas blancas desde un punto de vista transdisciplinar. Siguiendo la corriente bioevolutiva, que entiende nuestra conducta estética y sus manifestaciones como parte de nuestra etología, veremos cómo ese largo proceso estuvo incentivado por nuestro deseo de teñir los tejidos para expresar un fenotipo extendido creando una nueva señal social. Esa nueva señalización, operante en el plano de la selección sexual, se va complicando al desarrollarse nuestras capacidades simbólicas y tecnológicas, siendo sintomática del entorno causal en el que se produce. Since the early 1990s, increasing attention has been paid to the impact of workplace bullying on employees’ well-being and job attitudes. However, the relationship between workplace bullying and job satisfaction remains unclear. This study aims to shed light on the nature of the bullying-job satisfaction relationship in the Italian context. As expected, the results revealed a U-shape curvilinear relationship between workplace bullying and job satisfaction after controlling for demographic variables. In contrast to the curvilinear model, the results support a negative (...) linear relationship between workplace bullying and psychological well-being, in which higher exposure to negative acts at work is associated with diminished well-being. In addition, gender and job position significantly predicted mental health scores where men and managers reported a better psychological well-being than women, blue-collar, and white-collar employees. Practical and theoretical implications are discussed according to these results. (shrink)

Quantum indistinguishability directly relates to the philosophical debate on the notions of identity and individuality. They are crucial for our understanding of multipartite quantum systems. Furthermore, the correct interpretation of this feature of quantum theory has implications that transcend fundamental science and philosophy, given that quantum indistinguishability is a resource in quantum information theory. Most of the conceptual analysis of quantum indistinguishability is restricted to studying the permutational invariance of quantum states, the concomitant quantum statistics and their entanglement. Here, we (...) analyse the role of indistinguishability and non-individuality in other areas of quantum theory. We start by analysing how a very peculiar use of indistinguishability underlies Feynman’s rules for summing amplitudes in interference phenomena. Next, we study how quantum indistinguishability is underestimated in several topics of debate in the quantum physics literature, such as the Einstein–Podolsky–Rosen argument, Bell’s inequalities and the Bell–Kochen–Specker theorem. Finally, we argue that an ontology of truly indistinguishable entities can serve as a basis for a quantum ontology that can give interesting answers to the interpretational problems of quantum mechanics. We claim that, in addition to superposition, contextuality and entanglement, indistinguishability (understood in a robust ontological sense) is one of the central features of quantum physics. -/- . The aim of this study was to implement the teaching personal and social responsibility model in a competitive context analyzing the differences between the intervention and the control group on personal and social responsibility, prosocial behaviors, and self-efficacy in youth soccer players. Participants were 34 youth soccer players between the ages of 14 and 16 years old divided into two different soccer teams of 17 members, corresponding to the control and intervention groups. The implementation of the TPSR model took place (...) during 9 months, including initial and ongoing coach training, program implementation, and a series of expert-led seminars for athletes. The questionnaires used to collect data were the Personal and Social Responsibility Questionnaire, Prosocial Behavior Scale, and two Children’s Self-efficacy Scales. Results indicated that the TPSR intervention group obtained an increase in post-test levels of personal and social responsibility, prosocial behavior, and self-efficacy due to the application of the TPSR model compared with control group that used a conventional sport teaching methodology. The conclusion is that the TPSR model has the potential to be adapted and implemented with flexibility in youth sport competition contexts in order to improve personal and social responsibility, prosocial behavior, and self-efficacy. The goal of this article is to show that formal analysis and reconstructions may be useful to discuss and shed light on substantive meta-theoretical issues. We proceed here by exemplification, analysing and reconstructing as a case study a paradigmatic biochemical theory, the Monod-Wyman-Changeux theory of allosterism, and applying the reconstruction to the discussion of some issues raised by prominent representatives of the new mechanist philosophy. We conclude that our study shows that at least in this case mechanicism and more traditional (...) accounts are not rivals but complementary approaches. (shrink)

In this work, we discuss a formal way of dealing with the properties of contextual systems. Our approach is to assume that properties describing the same physical quantity, but belonging to different measurement contexts, are indistinguishable in a strong sense. To construct the formal theoretical structure, we develop a description using quasi-set theory, which is a set-theoretical framework built to describe collections of elements that violate Leibnitz's principle of identity of indiscernibles. This framework allows us to consider a new ontology (...) in order to study the properties of quantum systems. (shrink)

Em seu ensaio Avoiding the Myth of the Given, McDowell traz uma nova caraterização do conteúdo da experiência perceptual e do modo que tal conteúdo torna possível ao sujeito conhecer. Esta nova caraterização tem sido acusada de gerar uma “ansiedade pluralista”. Escopo deste artigo é reconstruir os problemas que, segundo Corti, surgem a partir da virada argumentativa do filósofo, assim como avaliar se McDowell tem à disposição recursos conceituais para esquivar-se às críticas. Para isso, contamos com a seguinte estrutura de (...) texto: 1. reconstruiremos em detalhe a posição revisada de McDowell acerca da experiência perceptual tal como ela foi exposta em AMG; 2. reconstruiremos o argumento de Corti acerca da possibilidade de que a nova posição de McDowell implique no surgimento de uma “ansiedade pluralista”; 3. discutiremos se é possível fornecer uma interpretação da posição de McDowell que ofereça uma saída para tal ansiedade. El control biológico de especies no nativas que causan daños económicos y ambientales es la tecnología más importante de la Biología de las Invasiones. Si bien hay acuerdo que dicha tecnología es ambientalmente más amigable que el control químico, existen discusiones abiertas sobre los riesgos asociados a la misma. En el presente trabajo analizamos, utilizando como fuentes artículos científicos de revisión, las bases epistémicas subyacentes al desarrollo y la evaluación de riesgos asociados al control biológico. En particular, si sucede o (...) no simplificación epistemológica y su vínculo con la subestimación de riesgos. El análisis muestra que suceden cuatro tipos interrelacionados de simplificación epistemológica: i) interacciones uno-a-uno de tipo fisiológicas, linealizadas y descontextualizadas entre agente de control y especies blanco o no-blanco; ii) predominancia de factores de niveles organísmico e infra-organísmico, en vinculación con teorías y conceptos de la Ecofisiología; lo que obvia interacciones, procesos y mecanismos que suceden a nivel de comunidad y ecosistemas, y los marcos teóricos de la Ecología asociados; iii) exclusión de mecanismos evolutivos relevantes como la adaptación y la plasticidad fenotípica post-introducción; y iv) restricción de temporalidades y espacialidades a aquellas de procesos fisiológicos y comportamentales del nivel organísmico o inferiores. Este escenario deriva en una subestimación, o directamente omisión, de riesgos ambientales como alteraciones potenciales que el evento de control biológico puede imponer sobre especies no-blanco y también sobre procesos y mecanismos comunitarios y ecosistémicos. Science is sometimes depicted, both in scholarly and lay accounts, as a consensual and orderly progression in the direction of truth; at other times, it is portrayed as an arena in which lone geniuses struggle against rivals and authorities to impose unconventional interpretations of reality. The paper introduces the concept of ‘order-conflict dichotomy’ to stabilize the content of these definitions. It then shows, through an in-depth analysis of the Irving trial, an English libel suit involving historical knowledge about World (...) War II and the Holocaust, how these definitions can be used as rhetorical devices to promote professional and situational goals. Six couples of opposing sub-definitions of science are identified by analyzing court records. As a tentative hypothesis derived from the case, it is argued that the conception of science actors deploy in this kind of controversies reflect the overall structure of the market for knowledge about nature and society rather than disciplinary culture. Proponemos una teoría estética basada en un enhebrado cronotópico del discurso creativo que replantea las lógicas de constitución del sujeto. Tomamos como hilo conductor la película La voz de la luna (La voce della Luna, 1990) de Federico Fellini, cuyo surrealismo, lejos de suponer una construcción al azar de un relato, revela una sofisticada narrativa desde lo circunstancial (y no desde el sujeto o el objeto). Es aquí donde confluimos con las tesis más radicales de Antonin Artaud y su (...) proyecto político basado en el teatro de la crueldad y la reificación del fragmento-órgano. Concluimos con un alegato por una narración vital, que trascienda la obra, disipe la posición del sujeto en la misma (lo que Jacques Derrida denomina Forcener le subjectile) para que el sentido de la humanidad, en lo ínfimo y fragmentado, trasparezca. Mi propósito en este trabajo es reconsiderar una de las lecturas más relevantes y provocativas que se han hecho sobre John Dewey en el mundo de habla hispana. En la primera parte reconstruyo las circunstancias que rodearon la difusión, interpretación y traducción de las obras de Dewey en el México de mediados de los años 1940, y en concreto las razones que llevaron a que la visión sociológica que José Medina Echavarría quiso dar de Dewey fuera finalmente desplazada por (...) la filosófica de José Gaos. En la segunda parte analizo la traducción y lectura que Gaos hizo de Experience and Nature de Dewey, teniendo muy presente sus comparaciones con Sein und Zeit de Heidegger . Finalmente, propongo algunas críticas a la visión que Gaos transmite de Dewey como un pensador carente de un tipo de "soberbia diabólica" propia de la verdadera gran filosofía. The purpose of this work is a reconsideration of one of the most relevant and provocative readings of John Dewey written in the Hispanic World. In the first part I reconstruct the circumstances which surrounded the publicity, interpretation and translation of John Dewey's works in the Mexico of the middle 1940's, particularly the reasons why the sociological reading of Dewey that José Medina Echavarría proposed was finally displaced by the metaphysic perspective of José Gaos. In the second part I reconsider Gaos' own translation and interpretation of Experience and Nature, taking in consideration his comparisons with Heidegger's Sein und Zeit . Finally I analyze critically Gaos' view of Dewey as a thinker whose philosophy lacked the "diabolical arrogance" that true great philosophy would seem to require. (shrink)

Freud and the Politics of Psychoanalysis is a sympathetic critique of Freud's work, tracing its political content and context from his early writings on hysteria to his late essays on civilization and religion. Brunner's central claim is that politics is a pervasive and essential component of all of Freud's discourse, since Freud viewed both the psyche and society primarily as constellations of power and domination. Brunner shows that when read politically, Freud's discourse can be seen to unite mechanics and meaning (...) into a plausible, fruitful and internally consistent theory of the mind, therapy, family and society. Part one deals with the medical and political background of Freud's work. It explains how Freud postulated mental principles that were the same for all races and nations. The second part is concerned with the logic and language of Freud's theory of the mind. Brunner also details how Freud introduced dynamics of dominance and subjugation into the very core of the psyche. Part three addresses dynamics of power in the clinical setting, which Freud forged out of a curious blend of authoritarian and liberal elements. Brunner focuses on how this setting creates an arena for verbal politics. He also examines various social factors that influenced the therapeutic practice of psychoanalysis, such as class, gender and education. Part four explores Freud's analysis of the family and large-scale social institutions. Though Brunner is critical of the authoritarian bias in Freud's social theory, he suggests that it provides a useful vocabulary to unmask hidden psychological aspects of domination and subjection. The private sector plays an active role in implementation of mechanisms concerning the mitigation of climate change. In spite of that, the corporate actors play a limited direct role in international arenas when it comes to negotiating the design of climate and energy regime. The climate and energy governance in the United Nations system remains mostly state-centric, but the active participation of corporate actors in negotiation of climate and energy regimes is essential to increase the effectiveness of their governance. Business (...) is not just a subject of a regulatory climate and energy imposed by the state; rather, business is an intrinsic part of the fabric of climate and energy governance, as “rule-maker,” particularly in the many voluntary regimes. However, the architecture in place should guarantee that the private sector does not highjack the decisions and its positions are balanced by other non-governmental actors in the process. This article analyzes the role that the private sector can play in the global climate and energy governance. The private sector does not only play a “rule taker” role in the climate change and energy regime. Indeed, they are not passive observers as they influence through indirect means. The results suggest that the private sector is able to play a key role in global climate and energy governance based on the principle of multi-stakeholder participation in global decision-making, but the architecture should be able to balance the goods and bads of private direct influence in international regimes. La difusión de distintos tipos de teorías paranoicas parece tener una influencia creciente en la opinión pública de las democracias contemporáneas. Se intenta revisar aquí algunas fuentes clásicas que podrían explicar los orígenes y alcances de estas formas de pensar la política. A partir de la revisión de diversas aportaciones, como las de historiadores o teóricos como Freud, Popper y Canetti, se intentará desentrañar algunas características del pensamiento conspirativo sobre la sociedad. Para actualizar el tema se recurre también a reflexiones (...) de pensadores como Eco y Bobbio, entre otros. Según se argumenta, la crisis de legitimidad de nuestros sistemas políticos proporciona un trasfondo para la proliferación de explicaciones paranoicas, alimentadas también por la despolitización y el predominio de las demandas subjetivas en la arena pública. RESUMEN: La violencia es considerada a menudo un elemento consustancial al ámbito internacional: algo que el derecho internacional puede quizá reducir pero no eliminar completamente. Este trabajo se hace eco de las críticas feministas al derecho internacional poniéndolas en relación con los conceptos elaborados por los estudios sobre masculinidades. Que el derecho internacional sea una disciplina históricamente manejada por hombres encuentra su proyección sobre cinco ámbitos: 1) el concepto de estado en tanto que actor principal del derecho internacional, 2) el (...) sistema de fuentes, en particular, los tratados internacionales; 3) la aplicación de las normas internacionales a través de tribunales o paneles de arbitraje; 4) la importancia de la guerra y 5) la doctrina de la responsabilidad de proteger. ABSTRACT: Violence is often seen as an inherent element in the international arena: something that international law can perhaps reduce but not eliminate completely. This work echoes feminist critiques of international law by putting them in relation to the concepts elaborated by studies on masculinities. In spite of its commercial importance and signs of clear concern in public policy arenas, trade credit has not been subjected to systematic, extended analysis in the business ethics literature, even where suppliers as a stakeholder group have been considered. This paper makes the case for serious consideration of the ethics of trade credit and explores the issues surrounding slow payment of debts. It discusses trade debt as a kind of promise, but—noting that not all promises are good ones—goes on (...) to develop an analysis of the ethics of trade credit grounded in an understanding of its fundamental purpose. Making a distinction between “operating” trade credit and “financial” trade credit, the paper provides an account of the maximum period for which it is appropriate for one company to delay payment to another from which it has purchased goods or services. The concern of commentators and policy makers that companies should not take too long to pay their debts is affirmed, but the understanding of what timely payment means is significantly finessed, with one conclusion being that, if debts have not already been settled according to acceptable standard terms of trade, cash should pass quickly back along the supply chain once the customer in the final product market has paid. The analysis has implications not only for companies that take credit but also for external parties that seek to rate companies or set regulations according to speed of payment—an approach that is shown to be misleadingly simplistic, albeit well intentioned. A corresponding important responsibility for suppliers, not to extend excessive credit, also follows from the analysis developed. Having provided a novel analysis of an important business problem, the paper then discusses some of the related practical issues and makes suggestions for further research. (shrink)

In the United Kingdom, the question of how much information is required to be given to patients about the benefits and risks of proposed treatment remains extant. Issues about whether healthcare resources can accommodate extended shared decision-making processes are yet to be resolved. COVID-19 has now stepped into this arena of uncertainty, adding more complexity. U.K. public health responses to the pandemic raise important questions about professional standards regarding how the obtaining and recording of consent might change or be (...) maintained in such emergency conditions, particularly in settings where equipment, medicines, and appropriately trained or specialized staff are in short supply. Such conditions have important implications for the professional capacity and knowledge available to discuss the risks and benefits of and alternatives to proposed treatment with patients. The government’s drive to expedite the recruitment to wards of medical students nearing the end of their studies, as well as inviting retired practitioners back into practice, raises questions about the ability of such healthcare providers to engage fully in shared decision-making.This article explores whether the legal duty on healthcare practitioners to disclose the material risks of a proposed medical treatment to a patient should be upheld during pandemic conditions or whether the pre-eminence of patient autonomy should be partly sacrificed in such exceptional circumstances. We argue that measures to protect public health and to respect autonomous decision-making are not mutually exclusive and that there are good reasons to maintain professional standards in obtaining consent to treatment even during acute pressures on public health systems. Se trataba de los libros Adolfo Sánchez Vázquez: los trabajos y los días y En torno a la obra de (...) Adolfo Sánchez Vázquez, editados por Federico Álvarez y Gabriel Vargas Lozano, respectivamente. Publicado originalmente con el título “La empecinada herejía de Adolfo Sánchez Vázquez” en la mencionada revista (núm. 203, La Habana,1996, pp.142-147), el texto fue revisado y actualizado para la presente edición. El título del comentario hace alusión a la permanente actitud de principios de Sánchez Vázquez, quien mantuvo, primero, una actitud crítica (...) ante el marxismo ortodoxo y dogmático que se difundía desde la URSS y el llamado socialismo real y, después, asumió estoicamente la defensa del marxismo cuando aquellos habían desaparecido. The article addresses the relationship between modernity and coloniality in the field of colonial theories, both postcolonial and decolonial, emphasizing the problems of representation and putting in the foreground the problem of not having a language suitable to express the tensions that the same relationship produces. For this, it discuss the crossroads of the coloniality and modernity, present in representative authors of these theories, and it assumes such a crossroads as a cultural and theoretical arena. From there, a reading (...) exercise is proposed, as an example, in texts by Joseph Conrad and Frantz Fanon. Finally, the article discusses some nuances of the problem of representation that could affect our understanding of the processes of subjectivity, their histories and the morphologies of our knowledge. Este artigo objetiva mapear, no interior dos livros A sociedade dos indivíduos, Norbert Elias por ele mesmo e Envolvimento e alienação, bem como na coletânea Escritos e ensaios, a discussão de Norbert Elias sobre a democratização como um processo de transformação global da sociedade. Através de análises de longa duração, ele demonstrou que os processos civilizacionais foram constituídos pelos embates em torno da desconcentração do poder. Assim, a busca por melhores formas de distribuição de recursos e de oportunidades de poder (...) estiveram, ao longo dos últimos cinco séculos, no centro dos conflitos e das tensões que produziram inúmeras mudanças e/ou expectativas de mudanças nas sociedades atuais. Ele demonstrou que não é possível compreender os processos de democratização sem se levarem em conta os diversos jogos configuracionais que vão se estabelecendo entre os muitos grupos que lutam para adentrar a arena política com o intuito de construir novas oportunidades de poder. Is Economics an ‘objective’ or ‘positive’ science, independent of ethical and political positions? The financial crisis that began in 2007 gave rise to renewed doubts regarding the ‘objectivity’ of economics and brought into the public arena a debate that was previously confined to academia. A remarkable feature of the public debate on the value neutrality of economics since then was that it not only involved indictments of ideological biases in economic theory, but also the attribution of the crisis itself (...) to the unethical orientation of economic agents, of economists acting as experts and of ‘economic science’ itself. The contributors to this volume believe that economists of all persuasions are once again compelled to probe the normative foundations of their discipline and give a public account of their doubts and conclusions. A partir da análise dos pressupostos teórico-sociais que ligam o relato inicial de Habermas acerca da esfera pública ao enquadramento westfaliano do espaço público, Nancy Fraser propõe a necessidade de uma reestruturação da esfera pública a partir de um enquadramento transnacional, diante da existência de arenas discursivas que transbordam os limites do Estado Nação, com forte influência na realidade social. Neste contexto, Fraser enfatiza que o conceito de esfera pública foi desenvolvido não apenas para compreender os fluxos de comunicação, mas (...) também para contribuir com uma teoria política normativa da democracia. Nessa teoria, uma esfera pública é concebida como um espaço para a geração comunicativa da opinião pública. Na medida em que o processo é inclusivo e justo, a publicidade deve desacreditar pontos de vista que não podem resistir ao escrutínio crítico, com o propósito de garantir a legitimidade daqueles que participam do processo. Assim, importa quem participa e em que condições. Nestes termos, duas ideias são centrais para a análise da esfera pública: legitimidade normativa e a eficácia política da opinião pública. A ausência desses elementos torna o conceito vazio de crítica e ação política, de acordo com Fraser. Portanto, a autora busca repensar a teoria da esfera pública habermasiana, que é implicitamente guiada por um imaginário político westfaliano, uma visão que não mais corresponde à realidade globalizada contemporânea.
