The actions of pregnant women can cause harm to their future children. However, even if the possible harm is serious and likely to occur, the law will generally not intervene. A pregnant woman is an autonomous person who is entitled to make her own decisions. A fetus in-utero has no legal right to protection. In striking contrast, the child, if born alive, may sue for injury in-utero; and the child is entitled to be protected by being removed from her parents (...) if necessary for her protection. Indeed, there is a legal obligation for health professionals to report suspected harm, and for authorities to protect the child's wellbeing. We ask whether such contradictory responses are justified. Should the law intervene where a pregnant woman's actions risk serious and preventable fetal injury? The argument for legal intervention to protect a fetus is sometimes linked to the concept of ‘fetal personhood’ and the moral status of the fetus. In this article we will suggest that even if the fetus is not regarded as a separate person, and does not have the legal or moral status of a child, indeed, even if the fetus is regarded as having no legal or moral status, there is an ethical and legal case for intervening to prevent serious harm to a future child. We examine the arguments for and against intervention on behalf of the future child, drawing on the example of excessive maternal alcohol intake. (shrink)

In clinical practice, and in the medical literature, severe congenital malformations such as trisomy 18, anencephaly, and renal agenesis are frequently referred to as ‘lethal’ or as ‘incompatible with life’. However, there is no agreement about a definition of lethal malformations, nor which conditions should be included in this category. Review of outcomes for malformations commonly designated ‘lethal’ reveals that prolonged survival is possible, even if rare. This article analyses the concept of lethal malformations and compares it to the problematic (...) concept of ‘futility’. We recommend avoiding the term ‘lethal’ and suggest that counseling should focus on salient prognostic features instead. For conditions with a high chance of early death or profound impairment in survivors despite treatment, perinatal and neonatal palliative care would be ethical. However, active obstetric and neonatal management, if desired, may also sometimes be appropriate. (shrink)

Premiere traduction francaise etablie sur l'edition critique du texte latin, cet ouvrage rend accessible a un plus large public la Summa de anima de Jean de la Rochelle qui revet un triple interet. Elle offre d'abord une presentation magistrale de l'enseignement portant sur l'ame dans les annees 1230-1235 a Paris. Elle permet de la sorte d'evaluer l'etat de la reflexion sur l'ame a l'oree de du travail de reinterpretation de l'aristotelisme tel que le vehiculait la tradition greco-arabe par Albert le (...) Grand et Thomas d'Aquin. Elle constitue enfin une tentative, emanant d'un des premiers maitres en theologie franciscains, d'integration de la philosophie greco-arabe (notamment celle d'Avicenne, qui rencontre ici le Pseudo-Augustin, Augustin, Jean Damascene et Philippe le Chancelier) a la reflexion theologique. Ce texte prepare ainsi les grandes syntheses des Sommes posterieures au premier rang desquelles figure evidemment la Summa fratris Alexandri qui incorpore, au livre II, des chapitres entiers. O objetivo principal deste artigo é esclarecer como Brentano define a relação entre (a) o conhecimento de nossos próprios fenômenos de consciência e (b) o conhecimento de fenômenos de consciência de outros sujeitos. Por um lado, Brentano argumenta, seguindo a tradição moderna, que o conhecimento dos próprios atos mentais é absolutamente fundamental. Ao mesmo tempo, porém, ele quer mostrar com sua Psicologia do ponto de vista empírico uma clara alternativa ao introspeccionismo. Mostraremos como Brentano busca unir estes dois objetivos e (...) como ele também aderiu a esta linha em sua Psicologia Descritiva. Sua psicologia como um todo pode, portanto, ser entendida como um apelo ao pluralismo epistemológico. (shrink)

A l'instar de ses confrères des années 1250-1260 à l'Université de Paris, Siger de Brabant prit activement part à un mouvement de prise de conscience et de revendication intellectuelle, d'émancipation de la raison contre l'autorité du dogme et le dogmatisme en général, et joua un rôle essentiel dans l'émergence d'un nouveau style, d'une nouvelle morale, d'une nouvelle forme d'existence : en un mot, à la vie philosophique. Il proposa une nouvelle éthique, établie à partir de la lecture d'Aristote, mais une (...) lecture essentiellement rationaliste qui, aux yeux des autorités, s'écartait en tous points de la sagesse chrétienne - affirmant notamment que c'est en cette vie que l'on peut trouver le. bonheur, et non dans l'autre. Siger de Brabant contribua ainsi à une renaissance de la philosophie, qui commence par la Logique qui ordonne la pensée et le discours du philosophe, lui donne aussi son style, au sens littéraire du terme - ce dont le Traité de l'éternité du monde est une bonne illustration.
