MacCormick and Weinberger's normative institutionalism, or neo‐institutionalist theory, is propounded as “a socially realistic development of normativism.” This theory blends normativism and realism and represents the coherent outcome of two components of each author's thought: normativism from the standpoint of legal theory; neo‐empiricism from the standpoint of philosophy generally. Scandinavian legal realism, or normative realism, is the only school of jurisprudence that can be understood as a direct offspring of one of the philosophical currents (i.e., the Uppsala school) belonging to (...) contemporary neo‐empiricism. This is why it inevitably becomes a touchstone for those legal theories – like MacCormick and Weinberger's neo‐institutionalist theory–which are not direct offshoots, but owe much to the principles and methods of neo‐empiricism. La Filosofía del Derecho contemporánea plantea retos importantes, que según Carla Faralli se sistematizan en dos. Por una parte, la apertura a los hechos; y por otra a los valores políticos y éticos. La tradicional conversación del iusnaturalismo con positivismo y el realismo jurídico parece haber sido superada, especialmente después de la obra de Hart. Y en este periodo, lo cierto es que las consecuencias del realismo jurídico han derivado en modos de proponer el concepto, aplicación e interpretación (...) del Derecho, mas ajustados con la realidad. En este sentido, la apertura a la economía, protagonizada por el análisis económico del Derecho; la critica abierta al análisis económico llevada a cabo por el movimiento Critical legal Studies; y las argumentaciones de Derecho y Literatura ofrecen alternativas importantes, que se analizan en este articulo. Should officeholders be held individually responsible for submitting to systemically corrupt institutional practices? We draw a structural analogy between individual action under coercive threat and individual participation in systemic corruption, and we argue that officeholders who submit to corrupt institutional practices are not excused by the existence of a systemic coercive threat. Even when they have good personal reasons to accept the threat, they remain individually morally assessable and, in the circumstances, they are also individually blameworthy for actions performed in (...) their institutional capacity. Feminist philosophers of biology bring the tools of feminist theory, and in particular the tools of feminist philosophy of science, to investigations of the life sciences. While the critical examination of the categories of sex and gender (which will be explained below) takes a central place, the methods, ontological assumptions, and foundational concepts of biology more generally have also enjoyed considerable feminist scrutiny. Against the standard reading of Isaiah Berlin's thought that drives a wedge between his early and subsequent work, this article suggests that his late normative anti-reductionism has roots in the early writings on meaning, semantics and truth. Berlin's anti-reductionist objection to logical positivists in the realm of semantics evince a sensitivity to reductionism, a recognition of the irreducibility of propositional meaning, a plea for the embededness of language in a temporal continuum, an anti-dualist call, and a celebration of the plural (...) and open-ended character of propositions, all of which keep broad affinity with his mature value pluralism in ethics and politics. The unity of concerns in Berlin's work brings about two implications. First, it sheds light on the fact that Berlin's ethical and political pluralism rests on views about semantics and ontology as well. Second, it offers a basis on which to deflect some current moral realist readings of his value pluralism, offering instead a history-laden understanding of his pluralism that provides more compelling grounds to understand the relationship between the latter and liberalism in Berlin's work. A lack of diversity remains a significant problem in many STEM communities. According to the epistemic approach to addressing these diversity problems, it is in a community’s interest to improve diversity because doing so can enhance the rigor and creativity of its work. However, we draw on empirical and theoretical evidence illustrating that this approach can trade on the epistemic exploitation of diverse community members. Our concept of epistemic exploitation holds when there is a relationship between two parties in which (...) one party accrues epistemic benefits from another party’s knowledge and epistemic location and, in doing so, harms the second party or sets back their interests. We demonstrate that the ironic outcome of this nominal application of the epistemic approach is that it undermines the epistemic benefits which it promises. Indeed, we show that epistemic exploitation undermines the relationships and interactions among community members that produce rigor and creativity. Our central argument is that for communities to reap the benefits of an epistemic approach to diversity, to implement a genuine epistemic approach, they need to develop cultures that ameliorate the harms faced by, and protect the interests of, their diverse community members. The concept of reason is pervasive in our ordinary practices, but there is a large and divisive disagreement about their role in the foundation and explanation of morality. Such disagreement depends on three related issues, which concern the definition of “moral reasons,” their sources and functions. This chapter first takes into account material and formal definitions of moral reasons and clarifies the role of reasons in the explanation and justification of intentional action. Second, it addresses the source of reasons and (...) considers whether reasons are subjective or objective, personal or impersonal, and how they are related to the agent’s values, integrity, and authenticity. Moral theories differ in their account of the contents of moral reasons, but also in their epistemological account of how moral reasons are produced or recognized. Third, the chapter discusses the claim that morality is a cooperative enterprise, proposing an analysis of internalist and externalist accounts of reasons, and their prospects in addressing the phenomena of coordination and moral compliance. Background Ethical decision making in intensive care is a demanding task. The need to proceed to ethical decision is considered to be a stress factor that may lead to burnout. The aim of this study is to explore the ethical problems that may increase burnout levels among physicians and nurses working in Portuguese intensive care units . A quantitative, multicentre, correlational study was conducted among 300 professionals.Results The most crucial ethical decisions made by professionals working in ICU were related to (...) communication, withholding or withdrawing treatments and terminal sedation. A positive relation was found between ethical decision making and burnout in nurses, namely, between burnout and the need to withdraw treatments , to withhold treatments and to proceed to terminal sedation . This did not apply to physicians. Emotional exhaustion was the burnout subdimension most affected by the ethical decision. The nurses' lack of involvement in ethical decision making was identified as a risk factor. Nevertheless, in comparison with nurses , it was the physicians who more keenly felt the need to proceed to ethical decisions in ICU.Conclusions Ethical problems were reported at different levels by physicians and nurses. The type of ethical decisions made by nurses working in Portuguese ICUs had an impact on burnout levels. This did not apply to physicians. This study highlights the need for education in the field of ethics in ICUs and the need to foster inter-disciplinary discussion so as to encourage ethical team deliberation in order to prevent burnout. Neoliberal ideology and exclusionary policies based on racialized identities characterize the current contexts in North America and Western Europe. Nursing knowledge cannot be abstracted from social, political and historical contexts; the task of examining the influence of race and racial ideologies on disciplinary knowledge and inquiry therefore remains an important task. Contemporary analyses of the role and responsibility of the discipline in addressing race‐based health and social inequities as a focus of nursing inquiry remain underdeveloped. In this article, we examine (...) nursing's engagement with ideas about race and racism and explore the ways in which nursing knowledge and inquiry have been influenced by race‐based ideological discourses. Drawing on Henry and Tator's framework of democratic racism, we consider how strategic discursive responses—the discourses of individualism, multiculturalism, colour‐blindness, political correctness and denial—have been deployed within nursing knowledge and inquiry to reinforce the belief in an essentially fair and just society while avoiding the need to acknowledge the persistence of racist discourses and ideologies. Greater theoretical, conceptual and methodological clarity regarding race, racialization and related concepts in nursing inquiry is needed to address health and social inequities. (shrink)

Bien qu’apparus au début du XX e siècle, ce n’est que dans la deuxième moitié du siècle que l’on observe un changement dans l’engagement évangélique vis-à-vis de la société : d’un retrait du monde à une « ouverture vers l’activité politique », marquée par le thème du combat spirituel pour les territoires. En Afrique de l’Ouest, (...) cette nouvelle visibilité dans l’espace public s’est concrétisée par l’élection de présidents évangéliques, comme Matthieu Kérékou au Bénin en 1996, ou Laurent Gbagbo en Côte d’Ivoire en 2000. Mais au sein d’une même société, les relations entre évangélismes et politique peuvent ainsi être multiples. Je prends en considération surtout le traité sur les passions contenu dans la Somme de théologie, mais aussi d’autres textes du maître dominicain : le Commentaire sur les Sentences, les Questions disputées sur la vérité, le bref traité Sur le mouvement du cœur. Tout d’abord, je montre comment l’idée de transmutatio corporalis est essentielle pour la définition thomasienne de la passion, puis j’identifie en (...) quoi consiste cette modification corporelle dans les principales passions. Je termine avec l’analyse de la transmutatio corporalis dans la dynamique entre l’âme et le corps, m’arrêtant notamment sur l’idée de la redundantia, à savoir le processus circulaire par lequel l’âme modifie le corps et le corps modifié intervient sur l’âme. BackgroundIn the last 2 weeks of January 2021, Portugal was the worst country in the world in incidence of infections and deaths due to COVID-19. As a result, the pressure on the healthcare system increased exponentially, exceeding its capacities and leaving hospitals in near collapse. This scenario caused multiple constraints, particularly for hospital medical staff. Previous studies conducted at different moments during the pandemic reported that COVID-19 has had significant negative impacts on healthcare workers’ psychological health, including stress, anxiety, depression, (...) burnout, post-traumatic stress symptoms, and sleep disturbances. However, there are many uncertainties regarding the professional quality of life of hospital nurses and physicians. To address gaps in previous research on secondary traumatic stress, we focused on healthcare workers working in hospitals affected by a major traumatic event: the third wave of COVID-19.ObjectivesThe aim of the present study was to identify the contribution of personal and work-related contextual variables on professional quality of life of healthcare workers.MethodsCross-sectional study with a web-based questionnaire given to physicians and nurses working in a hospital setting. A total of 853 healthcare professionals participated in the survey assessing professional quality of life compassion satisfaction, secondary traumatic stress, and burnout. Factors of professional quality of life were assessed using regression analysis.ResultsMost of the participants showed moderate or high levels of compassion satisfaction, whereas the majority of them experienced moderate levels of burnout and secondary traumatic stress. The analyzed variables demonstrated no differences between professionals who were directly or not involved in the care of COVID-19 patients. Parental status was found to be a significant factor in compassion satisfaction. Female gender was significantly associated with more susceptibility to secondary traumatization. Factors that may potentially contribute to burnout include years of professional experience and the number of work hours per week.ConclusionThe COVID-19 pandemic has created a new challenge for the healthcare system. Burnout and secondary traumatic stress can lead to medical errors and impact standards of patient care, particularly compromising compassionate care. It is therefore recommended that hospitals develop psychoeducational initiatives to support professionals in dealing with barriers to compassion. (shrink)

Starting from the birthplace of childhood, this text elucidates, using Giorgio Agamben, Heraclitus, and Paulo Freire, the coexistence of childhood and time. These authors contribute to the idea that childhood, be it chronological or not, is an inspiration without which it is impossible for us to be inventive in relation to history, philosophy, and education. It thus bases itself upon the hypothesis that childhood and time are conceptually indefinable and dilutive of the idea of stability, which escapes the understanding of (...) continuity, since it is not an absolute event. Thus, this text in based on the reading of childhood as a fundamental condition of the existence of human history, which makes possible the movement from language to thought. To think about the understanding of childhood that is at issue in this text, we consider a certain experience of time different from the traditional one, the result of an understanding conceived as chronology and completion, which is present in various readings of childhood. Upon raising these considerations, several questions arise: is there something like a childhood of thought? Can childhood offer a way of not giving up to a new concept of a childlike experience of time? (shrink)

The perspectives from the narratives highlight the importance of diversity, equity, and inclusion in the healthcare sector. The authors of the narratives also reflect (...) on their experience to consider what they wish would have happened in the experience, to offer advice for others that may be faced with similar situations. Access to these stories will deepen the collective understanding among pharmacy colleagues, patients, and society of the experiences that individuals from historically underrepresented groups within pharmacy have experienced. This paper explores the concept of ethos as a facet of the government’s rapidly growing initiative of the ‘specialist school’. Schools accepted on to the scheme are expected to create a new identity, or ethos: but what exactly is meant by that rather nebulous term? And, in reality, is something as all‐consuming as a school ethos, or culture, something that a school can readily conjure up? The aim of this article is to analyze the deontic character of norms of competence, more than to define a concept of competence. Competence is here understood as a power given by the legal system to a certain authority, as the capacity to create, modify or extinguish legal relations or positions. Only a couple of theses are examined to evaluate whether these norms have an autonomous deontic character, a complex modality or present a combination of independent characters. The fact that despite the efforts of contemporary jurists terms like ‘legal philosophy’, ‘legal theory’ and ‘jurisprudence’ do not have established meanings is one of the reasons behind the dispute regarding the function and validity of legal philosophy; a second issue worth considering is the transformations of law due to diverse influences such as globalization or theories on human rights. Para alcançar esse objetivo, serão utilizadas as ferramentas teórico-metodológicas foucaultianas próprias da genealogia e arqueologia na análise de documentos pertencentes ao âmbito da atual política educacional brasileira e de trabalhos científicos sobre a análise de necessidades de professores. The reform of the health care system will include a mandate: Individuals are required to purchase health insurance provided that affordable options are available. But what is affordable health insurance? Three accounts of affordability of health coverage have been advanced. The first two accounts are empirical. The third account is needs-based. All three accounts are inadequate. I propose a fourth, the reasonable tradeoff account, according to which individuals should only be required to make reasonable tradeoffs in order to pay for (...) their health coverage. That is, health insurance is affordable if in order to pay for it one does not to have to sacrifice other benefit(s) that are comparable in importance to the benefits of health coverage. (shrink)

In ‘Parental Virtues: A New Way of Thinking about the Morality of Reproductive Actions’ Rosalind McDougall proposes a virtue-based framework to assess the morality of child selection. Applying the virtue-based account to the selection of children with impairments does not lead, according to McDougall, to an unequivocal answer to the morality of selecting impaired children. In ‘Impairment, Flourishing, and the Moral Nature of Parenthood,’ she also applies the virtue-based account to the discussion of child selection, and claims that couples with (...) an impairment are morally justified in selecting a child with the same impairment. This claim, she maintains, reveals that the flourishing of a child should be understood as requiring environment-specific characteristics. I argue that McDougall's argument begs the question. More importantly, it does not do justice to virtue ethics. I also question to what extent a virtue ethics framework can be successfully applied to discussions about the moral permissibility of reproductive actions. (shrink)
