I take 'informal logic' to be the (descriptive and normative) study of 'real arguments'-arguments which are or have been used with the aim of convincing others of a point of view. I argue that the informal logic tradition thus conceived (i) lends strong support to something like Quine's view that our beliefs really support one another like the filaments in a spider's web--and thus that the traditional view that implication is an asymmetric relation is false; (ii) suggests that the classic (...) division of arguments into deductive and inductive has distorted our thinking about the evaluation of real arguments; and (iii) implies that naturalised epistemology is on the right track. The atheist who begins to argue his case by saying, ‘Suppose there is an omniscient Being of the sort in which Christians believe ...’ is employing a very familiar move in argumentation. However, most books on argumentation theory ignore ‘suppositions’ completely. Searle omits suppositions entirely from his taxonomy of speech acts and this appears to lead to a similar omission in Speech Acts in Argumentative Discussions by van Eemeren and Grootendorst.This paper argues that ‘suppositional argument’ is elegant, powerful and extremely (...) common, that the correct way to understand it is based on Gottlob Frege's distinction between ‘asserted’ and ‘unasserted’ propositions and hence that suppositions are neither assertions nor (and this is more important) assertives. The paper discusses the connections between suppositions and conditionals; it argues that argumentation theory which ignores suppositions is systematically misleading; and it concludes by indicating some possible developments in argumentation theory. A generation before Beardsley, legal scholar John Henry Wigmore invented a scheme for representing arguments in a tree diagram, aimed to help advocates analyze the proof of facts at trial. In this essay, I describe Wigmore's "Chart Method" and trace its origin and influence. Wigmore, I argue, contributes to contemporary theory in two ways. His rhetorical approach to diagramming provides a novel perspective on problems about the theory of reasoning, premise adequacy, and dialectical obligations. Further, he advances a novel solution (...) to the problem of assessing argument quality by representing the strength of argument in meeting objections. (shrink)

I have long been fascinated by the process of argument, so it seemed natural to study philosophy and logic at university, then, as a University teacher, to teach them. Since I gradually realised these subjects didn’t help students to reason and argue well, I tried to devise materials which would. This led first to my writing The Logic of Real Arguments and later, Critical Thinking: An Introduction. If you wish to teach thinking skills it is important to assess whether your (...) methods work, and I have developed several tests of critical thinking for different contexts, including a new UK Critical Thinking examination, now taken by thousands of school students. I worked with Richard Paul, Michael Scriven , Robert Swartz, Robert Ennis and many others. The emergence of the Informal Logic and Critical Thinking movement was an exciting time and I feel fortunate to have been part of it. (shrink)

The various ‘impulses to philosophy’ which are the subject of this series of lectures, include a fascination with the general process of reasoning and argument—with the ‘game of logic’. We are all aware of the importance of reasoning in our lives and how difficult it can be to tell ‘good’ reasoning from ‘bad’.

This text offers an account of how philosophers in the 20th century have challenged the ideas of the modern philosophers of the 17th century on fundamental questions in epistemology. Featuring examples, self-study questions and further readings, the text introduces and critically defines logical analysis, foundationalism and coherentism.

I first support Alec Fisher's thesis that premises and conclusions in arguments can be unasserted first by arguing in its favor that only it preserves our intuition that it is at least possible that two arguments share the same premises and the same conclusion although not everything that is asserted in the one is also asserted in the other and second by answering two objections that might be raised against it. I then draw from Professor Fisher's thesis (...) the consequence that in suppositional arguments the falsity (or unacceptability) of a supposition does not tell unfavorably in the evaluation of the argument, because the falsity (or unacceptability) of a (nonredundant) premise counts against an argument if and only if that premise is asserted. Finally, I observe that, despite the fact that they are neither expressed nor even alluded to, implicit assumptions in arguments are always asserted, unless the conclusion, but none of the explicit premisses, is unasserted. Hence, apart from an exceptional case of the kind just mentioned, the falsity (or unacceptability) of implicit assumptions always counts against an argument. (shrink)

Trope theory is a leading metaphysical theory in analytic ontology. One of its classic statements is found in the work of Donald C. Williams who argued that tropes qua abstract particulars are the very alphabet of being. The concept of an abstract particular has been repeatedly attacked in the literature. Opponents and proponents of trope theory alike have levelled their criticisms at the abstractness of tropes and the associated act of abstraction. In this paper I defend the concept of a (...) trope qua abstract particular by rejecting arguments that purport to show that tropes should not be understood as abstract and by arguing that the abstractness of tropes plays an indispensable role in one of our more promising trope-theoretic analyses of universals and of concrete objects. The concept of instantiation is realized differently across a variety of metaphysical theories. A certain realization of the concept in a given theory depends on what roles are specified and associated with the concept and its corresponding term as well as what entities are suited to fill those roles. In this paper, the classic realization of the concept of instantiation in a one-category ontology of abstract particulars or tropes is articulated in a novel way and defended against unaddressed objections.

Breaking off the ordinary flow of experience, the passions create a state of exception. In their suddenness and intensity, they map a personal world, fix and qualify our attention, and impel our actions. Outraged anger drives us to write laws that will later be enforced by impersonal justice. Intense grief at the death of someone in our life discloses the contours of that life to us. Wonder spurs scientific inquiry. The strong current of Western thought that idealizes a dispassionate world (...) has ostracized the passions as quaint, even dangerous. Intense states have come to be seen as symptoms of pathology. A fondness for irony along with our civic ideal of tolerance lead us to prefer the diluted emotional life of feelings and moods. Demonstrating enormous intellectual originality and generosity, Philip Fisher meditates on whether this victory is permanent-and how it might diminish us. From Aristotle to Hume to contemporary biology, Fisher finds evidence that the passions have defined a core of human nature no less important than reason or desire. Traversing the Iliad, King Lear, Moby Dick, and other great works, he discerns the properties of the high-spirited states we call the passions. Are vehement states compatible with a culture that values private, selectively shared experiences? How do passions differ from emotions? Does anger have an opposite? Do the passions give scale, shape, and significance to our experience of time? Is a person incapable of anger more dangerous than someone who is irascible? In reintroducing us to our own vehemence, Fisher reminds us that it is only through our strongest passions that we feel the contours of injustice, mortality, loss, and knowledge. This book develops an alternative account of rights according to which rights forfeiture has a much smaller role to play because rights themselves are more contextually contingent. For example, those who threaten to cause harm without a right to do so have weaker claims not to be killed than innocent bystanders or those who have a right to threaten to cause harm. By framing rights as the output of a balance of competing claims, and by laying out a detailed account (...) of how to balance competing claims, Walen provides a more coherent account of when killing in war is permissible. The standard of proof in criminal trials in many liberal democracies is proof beyond a reasonable doubt, the BARD standard. It is customary to describe it, when putting a number on it, as requiring that the fact finder be at least 90% certain, after considering the evidence, that the defendant is guilty. Strikingly, no good reason has yet been offered in defense of using that standard. A number of non-consequentialist justifications that aim to support an even higher standard have been (...) offered; all are morally unsound. Meanwhile, consequentialist arguments plausibly support a substantially lower standard — in some cases so low as to undermine the idea that punishment is what is at stake. In this paper, I offer a new retributive justification that supports excluding the instrumental benefits of punishment from the balance that sets the standard. The resulting balance supports a standard arguably in the ballpark of the customary understanding of BARD: a standard requiring that the fact finder have a high, though not maximally high, degree of confidence that the defendant is guilty.
