An extended illustration from Merleau-Ponty’s Phenomenology of Perception describes the interplay of habit, sedimentation, and intersubjectivity in the practice and performance of a skilled organist. This paper takes up Merleau-Ponty’s example in order to describe some of the phenomenological characteristics of embodied musical performance. These characteristics point toward an intersubjective event of “consecration,” as Merleau-Ponty describes it, in which the musician adopts the role of rhetor, inviting the audience into a shared dwelling place.

Professor Gallie of Queen’s University, Belfast takes his history seriously, in the spirit of R G Collingwood, and like Collingwood, he gives the impression of knowing what the historian is about. He inspires confidence by reference to a wide range of historical writing, instead of the one or two faded examples which tend to turn up again and again in books on the philosophy of history. Gallie’s primary purpose may be seen as a blow against the kind of systematised history (...) which Marxism stands for. He is opposed to this and to all sociological approaches to history because they misrepresent the nature of the task which confronts the historian. For Gallie, history is essentially narrative. Narrative is indeed too weak a word. In Gallie’s view, the historian tells a story. Our attention is held because the element of the unexpected is always present as it is in a story. A rational predictable construction of a Marxist type is ruled out because of the multiplicity of contingent events round which history revolves. History for this reason is distinct from science. The historian, in Gallie’s view, is not concerned with events in so far as they are specific instances of general laws. The scientist who ignores history, however, does so at his peril. Men who assume that scientific progress is inevitable and regard history as irrelevant are disregarding the fact that scientific development has taken place in some societies but not in others. Gallie’s pages on this topic are among the most illuminating in the book. Where he is perhaps open to criticism is in pressing the analogy of history to story telling too far. It may be argued that what the historian is after is surprise. He is trying to show us that the past is not as we thought it was but different. This may be achieved in ways other than story telling. For example, the sociologist or anthropologist may teach us to look at the past in a new light. Place medieval England and twentieth century Africa in juxtaposition and handy dandy, which is the justiciar and which is the thief? This method of illuminating the past is analogous to putting two photographs together or two caricatures. Whatever it is, it cannot be described as story telling. If we regard surprise as our criterion, we may also rule out both the plodding story tellers, who bore us with banalities, and the Namierites who are equally predictable in their own sphere. In a word, we will banish the bores from history. Professor Gallie in this entertaining book may be said to have banished boredom from his own pages. Recent studies have shown the importance of integrating multisensory information in the body representation for constituting self-consciousness. However, one idea that has received only scant attention is that our body representation is also constituted by knowledge of bodily visual characteristics . Here in two experiments we used a full body crossmodal congruency task in which visual distractors were presented on a photograph of the participant, another person, who was either familiar or unfamiliar, or an object. Results revealed that during the (...) ‘self-condition’ CCEs were enhanced compared to the ‘other condition’. The CCE was similar for unfamiliar and familiar others. CCEs for the object condition were significantly smaller. The results show that presentation of an irrelevant image of a body affects multimodal processing and that the effect is enhanced when that image is of the self. The results hold intriguing implications for body representation in social situations. (shrink)

Those who want to know anything about strike action by Italian nurses will find very little written about it. This contribution intends to show that, whatever they are prepared to admit, Italian nurses are not used to strike action because they mostly think of their profession as a form of mission. Even if we could agree with the idea of nursing as a profession subscribing to an ideal of service, we have to distinguish between a real profession and philanthropic work; (...) vocational motivation is not enough to make a good professional. Historically, nurses perceived strikes as contradictory to human need and action; patients must never be left alone. However, Italian nurses are now interested in a dramatic transformation of many aspects of their professional life, becoming conscious of the duty to protect themselves from every kind of exploitation, even if the typical idealism and dedication of nurses makes them vulnerable. Martial wrote about himself and his participation in the everyday life of Rome more than any other extant poet of the post-Augustan Principate. More particularly, dozens of his epigrams describe the life of the ordinary client and his treatment by great and often arrogant patrons. Unfortunately for social and literary historians, however, Martial was writing satirical epigrams, not autobiography. Consequently, his poetry cannot be taken at face value as a direct reflection of Roman life. With regard to literary patronage, the (...) difficulties of interpretation have allowed modern scholars to reach diametrically opposed conclusions. One editor and commentator baldly labelled Martial ‘a chronic beggar’ who ‘despite his numerous friends and the many patroni to whom he paid court,…dragged on a hand-to-mouth existence’. In a recent and more detailed study, on the other hand, Martial is portrayed as a man of independent means, who looked to his powerful amici not for financial support so much as for help in publicizing his work and for protection in literary squabbles. Abstract:The law of insider trading has progressed from an expansive approach, according to which all trading on nonpublic information was considered illegal, to a constricted approach, under which corporate outsiders are permitted to trade on nonpublic information provided such trading does not breach a fiduciary duty. This article analyzes both the former, expansive theory and the currently utilized constricted theory, within a framework of basic tenets of the American capitalist social contract regarding legitimacy of property claims. The existing constricted approach (...) to the regulation of insider trading is found to be deficient in meeting the expectations of two core components of the social contract: it discourages procedural equality of opportunity, and it endorses claims to property that are not characterized by legitimate methods of acquisition or transfer. Because the old, expansive regulatory interpretation was more consistent with the terms of the social contract in regard to property claims, it served our economic and ethical expectations more effectively than the system presently in place. Accordingly, the article culminates in a recommendation that the expansive approach to regulating insider trading be reestablished under Unites States law. (shrink)

The article is dedicated to the famous folklorist, literary critic, ethnographer, candidate of philological science, and doctor of historical science, Lev Grigorievich Barag, whose research and teaching activity for several decades was linked to the Bashkir State University. The authors of the article present main milestones of his scientific work as well as brief annotated overview of the major works of this outstanding Russian philologist in fairytale folklore and mark his contribution to the study of one of the most important (...) pages in the Russian literature of the 18th century, D. I. Fonvizin’s comediography. Multifaceted activities of Professor Barag are described, who successfully combined practical work of collecting folklore with research that was focused on the comparative study of fairytale epos. The authors consider the question of what place in Russian philology took this researcher, who made significant additions, refinements in the analysis of not only Eastern Slavic, but Turkic fairy story repertoire and who became one of the creators of the most authoritative index of East Slavic fairy stories and laid the foundations for the development of the study of Bashkir folklore. The main features of the Barag’s polemical research strategy aimed at the justification of potentially prorealistic method of Fonvizin-playwright were identified. Attention is drawn to the postulated by Barag judgments that anticipated modern scientific ideas about the processes of genre decanonization, about semiotic mechanism of transformation of the ‘unfamiliar‘ to ‘familiar‘, about genre originality of ‘The Minor‘ as a socio-psychological comedy, about trust of the author of ‘The Brigadier-General‘ in evaluative point of view of ‘nonpositive‘ characters. The molecular cloning of new neuroactive growth factors and their receptors has greatly enhanced our understanding of important interactions among receptors and singnaling molecules. These studies have begun to illuminate some of the mechanisms that allow for specificity in neuronal signaling. Model cell systems, such as the PC‐12 pheochromocytoma cell line, express receptors for these different neurotirophic factors, leading to comparisons of signaling pathways for these factors. Upon binding their ligands, these receptors undergo phosphorylation on tyrosine residues, which directs their (...) interaction with signaling proteins containing src homology (SH2) domains, sequences that mediate associations with tyrosine‐phosphorylated proteins. These SH2 proteins translate the tyrosine kinase activity of receptors into downstream events that result in the specific cellular response. Investigations such as these have revealed that molecular specificity in signaling pathways may arise from combinatorial diversity in interactions between receptors and key regulatory proteins. Objective: To explore the accounts and perspectives of junior doctors who were offered an HIV test by their employing National Health Service (NHS) trust and discuss ethical issues posed by this new policy. Design: Qualitative in-depth interview study. Setting: 4 NHS hospital trusts. Participants: 24 junior doctors who had been offered an HIV test as part of their pre-employment occupational health checks. Results: The manner in which HIV tests were offered to junior doctors varied both between and within the NHS (...) trusts. Overall, the doctors were highly critical of the way the HIV test was offered. Recurrent themes surrounding a lack of discussion and information regarding the indications for the test and implications of a positive result influenced the the doctors’ perception of their experiences. As a consequence of the shortcomings of how the test was offered, most of the doctors held the misperception that HIV testing was mandatory and many felt unable to decline the test. The majority of doctors referred to patient protection as adequate justification for being offered an HIV test. Conclusions: Junior doctors offered an HIV test under new Department of Health occupational health guidance were disparaging about how the test was offered. The findings of this study affect thousands of junior doctors in the UK, and the impact of these results is extensive. Participants’ suggestions regarding how the process of offering an HIV test can be improved are discussed and ethical issues regarding the new Department of Health policy are highlighted. (shrink)
