By significantly diminishing the role intentions play in communication, in Imagination and Convention Lepore and Stone attempt to overthrow the Gricean paradigm which prevails in the philosophy of language. The approach they propose is attractive to theorists of legal interpretations for many reasons. Primary among these is that the more general dispute in the philosophy of language between Griceans and non-Griceans mirrors the dispute between intentionalists and non-intentionalists in legal interpretation. The ideas proposed in Imagination and Convention naturally support the (...) non-intentionalist camp, which makes them unique in the contemporary philosophy of language.In this paper I argue that despite an almost universal acceptance for the Gricean paradigm in legal interpretation, a strong, externalist approach to language, one in which interpretation is based on conventions, not intentions, better reflects the nature of legal language. The latter functions in societies as a written, public discourse to which many individuals contribute; the number of contributions renders the identification of individual intentions impossible, making it badly suited to a Gricean, intention-based analysis. Lepore and Stone’s discourse-based, non-Gricean alternative provides a better tool for the theorist of legal interpretation to analyse legal language. In what follows, I first present an overview of the disputes in legal interpretation that may be affected by Imagination and Convention. In the second section, I analyze several of Lepore and Stone’s theses and apply them to issues in legal interpretation, paying particular attention to their concept of “direct intentionalism.” In the last section, I outline some proposals for finishing the anti-Gricean revolution, which involves Ruth Millikan’s idea of conventions as lineages. The recent global economic collapse brings new calls for reform and change as well as a re-examination of the ethical foundations underpining it. Most professors as well as students remain profoundly unhappy with the Business Curricula. The curricula appear to swing between technological training and academic theory. There is little genuine focus on the central issue of the problem: the students’ and faculty’s assumptive world which drives the selection of the materials chosen for presentation as well as the decision-making process. In the pragmatic quest to achieve status within academe, business schools appear to have forgotten that their subject matter is not one cognate domain but a mixture of several areas including mathematics, economics, anthropology, sociology, psychology, logic and planning. Course structures must be redesigned as consilient. That is, each course contains in it the links to other courses and is not expected to be complete in themselves; the new structures proposed are no longer under the direct control of one instructor but each course is under the control of a committee. This creates a linkage between courses that together from a linked chain of knowledge where the strength of the curriculum is tied to the consilient strength of the courses. The result is an organic and developmental model for teaching and learning with a strong ethical foundation as well as developed moral links to effective decision making. (shrink)

Where one stands to engage with the world is not as some New Age Psychologists continue to argue, completely free and self-determined. Rather, it is formed largely beyond one’s control and is fraught with both dangers and opportunities. This pre-determined point of view is referred to as the Assumptive World (Parkes, 1975). This is defined as a “strongly held set of assumptions about the world and the self that is confidently maintained and used as a means of recognizing, planning and (...) acting…Assumptions such as these are learned and confirmed by the experience of many years” (Parkes, 1975, p. 132). There are, further, levels and intensities of assumptions, as refined by Janoff-Bulman, R. (1992). These assumptions form the centre point of our world and our consciousness. They are so much a part of us that we tend not to challenge them. Though unchallenged, these assumptions nevertheless drive our behaviors, set our expectations, and operationalize our moral views. There are hundreds of different cultures in the world, and each one has its own set of norms, characteristics, and values. What in one country is perceived normal, ethical or unethical, right or wrong, may not be the same somewhere else in the world. The first civilizations begun in Africa and Europe many thousands of years ago when people were hunters (...) and nomads, it is not unreasonable to suspect that many of those traits and characteristics have been socially transferred and/or inherited by future generations. The authors discussed the reasons for the recent economic collapse as caused by the lack of large businesses and global corporations losing touch with the people they serve. Losing touch has caused a distancing of understanding of the customers as people by these businesses and corporations. An antidote to this is that decisions that have to be made in global businesses as well as domestic organizations reflect some level of empathy. The objective is to highlight the fact that these businesses (...) are corporate citizens and in themselves must be aware of the culture in which they conduct themselves. The authors discuss how empathie decision-making can become part of the corporate fabric without losing any sense of appropriate business judgment. A process is defined to enable the empathie process. Finally, a straw man is set up to fund/enable the process while creating a positive and profitable business environment. (shrink)

Habituation is defined as a decline in responding to a repeated stimulus. After more than eighty years of research, there is an enduring consensus among researchers on the existence of 9-10 behavioral regularities or parameters of habituation. There is no similar agreement, however, on the best approach to explain these facts. In this paper, we demonstrate that the Sometimes Opponent Processes (SOP) model of stimulus processing accurately describes all of these regularities. This model was proposed by Allan Wagner as a (...) quantitative elaboration of Priming Theory, which states that the processing of a stimulus, and therefore its capacity to provoke its response, depends inversely on the degree to which the stimulus is pre-represented in short-term memory. Using computer simulations, we show that all the facts involving within-session effects or short-term habituation might be the result of priming from recent presentations of the stimulus (self-generated priming). The characteristics involving between-sessions effects or long-term habituation would result from the retrieval of the representation of the stimulus from memory by the associated context (associatively-generated priming). Informational theories of semantic content have been recently gaining prominence in the debate on the notion of mental representation. In this paper we examine new-wave informational theories which have a special focus on cognitive science. In particular, we argue that these theories face four important difficulties: they do not fully solve the problem of error, fall prey to the wrong distality attribution problem, have serious difficulties accounting for ambiguous and redundant representations and fail to deliver a metasemantic theory of representation. Furthermore, we argue that these difficulties derive from their exclusive reliance on the notion of information, so we suggest that pure informational accounts should be complemented with functional approaches. Free will has been the object of debate in the context of addiction given that addiction could compromise an individual’s ability to choose freely between alternative courses of action. Proponents of the brain-disease model of addiction have argued that a neuroscience perspective on addiction reduces the attribution of free will because it relocates the cause of the disorder to the brain rather than to the person, thereby diminishing the blame attributed to the person with an addiction. Others have worried that (...) such displacement of free will attribution would make the person with a drug addiction less responsible. Using the paradigmatic literature on the seductive allure of neuroscience explanations, we tested whether neuroscience information diminishes attributions of free will in the context of addiction and whether respondent characteristics influence these attributions and modulate the effect of neuroscience information. We performed a large-scale, web-based experiment with 2,378 German participants to explore how attributions of free will in the context of addiction to either alcohol or cocaine are affected by: (1) a text with a neurobiological explanation of addiction, (2) a neuroimage showing effects of addiction on the brain, and (3) a combination of a text and a neuroimage, in comparison to a control group that received no information. Belief in free will was measured using the FAD-Plus scale and was, subsequent to factor analysis, separated into two factors: responsibility and volition. The investigated respondent characteristics included gender, age, education, self-reported knowledge of neuroscience, substance-use disorder (SUD), and having a friend with SUD. We found that attributions of volition (in the cocaine-subsample) were reduced in the text and neuroimage-treatment compared to the control group. However, respondent characteristics such as education and self-reported knowledge of neuroscience were associated with lower attributions of responsibility for both substances, and education was associated with lower attribution of volition for the alcohol sub-sample. Interaction analyses showed that knowledge of neuroscience was found to generally decrease attribution of responsibility. Further research on attribution of free will should consider the effects of context and respondent characteristics, which appeared surprisingly larger than those induced by experimental treatments. This paper identifies and addresses persistent gaps in the consideration of ethical practice in ‘technology for good’ development contexts. Its main contribution is to model an integrative approach using multiple ethical frameworks to analyse and understand the everyday nature of ethical practice, including in professional practice among ‘technology for good’ start-ups. The paper identifies inherent paradoxes in the ‘technology for good’ sector as well as ethical gaps related to (1) the sometimes-misplaced assignment of virtuousness to an individual; (2) difficulties in (...) understanding social constraints on ethical action; and (3) the often unaccounted for mismatch between ethical intentions and outcomes in everyday practice, including in professional work associated with an ‘ethical turn’ in technology. These gaps persist even in contexts where ethics are foregrounded as matters of concern. To address the gaps, the paper suggests systemic, rather than individualized, considerations of care and capability applied to innovation settings, in combination with considerations of virtue and consequence. This paper advocates for addressing these challenges holistically in order to generate renewed capacity for change at a systemic level. (shrink)

Martin Seel wonders how it is possible to liberate oneself from wanting to be right. In the following, we will ask whether the idea of a wanting to be right is so much as intelligible. For if one thinks about thinking and asks what it means to think something, then the idea of wanting to be right seems to have no place. Both the possibility and the necessity of a liberation from wanting to be right seem to dissolve. And yet, (...) we will show, there is wanting-to-be-right. But we do not understand the idea of wanting-to-be-right merely by thinking about thinking. Rather, we understand the idea of wanting-to-be-right only because thinking is something that takes place between two whose thoughts can contradict each other. If my thought meets your thought, and your thought negates my thought, then it is possible that we both want tobe right. This is the existential core of the idea of a liberation from wanting to be right: It is about the liberation from conflict and the hope for reconciliation. (shrink)

In this paper, we use some elements of the philosophical theories of Wilfrid Sellars and Robert Brandom for examining the interactions between humans and machines. In particular, we adopt the concept of the space of reasons for analyzing the status of artificial intelligent agents. One could argue that AIAs, like the widely used recommendation systems, have already entered the space of reasons, since they seem to make knowledge claims that we use as premises for further claims. This, in turn, can (...) lead to a sense of alienation because AIAs do not quite play by the rules of the space of the reason. We, therefore, ask somewhat pointedly whether aliens have entered the space of reasons. A closer look reveals that it is a misconception to consider AIAs as being in the space of reasons. In fact, they should be seen as very sophisticated tools. Since these tools affect our own acting in the space of reasons, special regulations are required for their proper use. (shrink)

Like many ethics debates surrounding emerging technologies, neuroethics is increasingly concerned with the private sector. Here, entrepreneurial visions and claims of how neurotechnology innovation will revolutionize society—from brain-computer-interfaces to neural enhancement and cognitive phenotyping—are confronted with public and policy concerns about the risks and ethical challenges related to such innovations. But while neuroethics frameworks have a longer track record in public sector research such as the U.S. BRAIN Initiative, much less is known about how businesses—and especially start-ups—address ethics in tech (...) development. In this paper, we investigate how actors in the field frame and enact ethics as part of their innovative R&D processes and business models. Drawing on an empirical case study on direct-to-consumer (DTC) neurotechnology start-ups, we find that actors engage in careful boundary-work to anticipate and address public critique of their technologies, which allows them to delineate a manageable scope of their ethics integration. In particular, boundaries are drawn around four areas: the technology’s actual capability, purpose, safety and evidence-base. By drawing such lines of demarcation, we suggest that start-ups make their visions of ethical neurotechnology in society more acceptable, plausible and desirable, favoring their innovations while at the same time assigning discrete responsibilities for ethics. These visions establish a link from the present into the future, mobilizing the latter as promissory place where a technology’s benefits will materialize and to which certain ethical issues can be deferred. In turn, the present is constructed as a moment in which ethical engagement could be delegated to permissive regulatory standards and scientific authority. Our empirical tracing of the construction of ‘ethical realities’ in and by start-ups offers new inroads for ethics research and governance in tech industries beyond neurotechnology. (shrink)

ABSTRACT This article interprets a recently recovered manuscript, Tratado de astronomía y la reformaçión del tiempo, composed by Antonio Sánchez in New Granada c.1696, in the context of the Spanish and Renaissance cosmographies. Sánchez’s Tratado proposes a spherical astronomy, in which celestial bodies – including comets — move in orbs containing pyramidal knots that explain the changing speed observed in the motion of planets. From this astronomy and following the peninsular style of repertorios, Sánchez derives two major conclusions: the corrected (...) length of the solar year and a revised birth date of Jesus. Taking as center of reference Vélez, where Sánchez was based, these claims led to conclusions in domains ranging from calendric astronomy to eschatology, including the incorporation of the indigenous peoples into salvation narrative and a demonstration of the arrangement of the celestial orbs at the Last Judgment. Sánchez’s Tratado constitutes an expansion of the Spanish mathematical cosmography that sheds light on the production of knowledge in the Spanish-American world and, at the same time, provides elements to reassess our understanding of the global circulation of Renaissance and early modern ideas. The discovery of Neptune was one of the greatest achievements of nineteenth-century astronomy. Using nothing but calculus and some observations of the Uranus’ anomalous motion, Adams and Le Verrier got to determine, independently, the possible place and mass of a hypothetical planet, which would produce its observational discovery. In this paper I will demonstrate that the methods used by these astronomers were influenced by Newton’s method of analysis and synthesis. Considering this, I will also expose, that some astronomy’s general epistemological (...) principles could be deduced when we consider these investigation methods. (shrink)

Some stories generate in us a peculiar experience of intense narrative engagement. This common experience, which we call narrative immersion, has been the object of a vast literature in psychology and other disciplines. Philosophers, however, have only recently engaged with this topic and the tendency has been to explain it by postulating specific kinds of mental states. We propose a different approach, explaining narrative immersion by means of a particular distribution of attention over the content of ordinary mental states. First, (...) we provide a characterization of narrative immersion based on studies by psychologists and other theorists. Then, we discuss alternative views and develop our own proposal. We articulate how attention works as we engage with the narrative, and how the adequate distribution of attention over the mental states involved in understanding the storyworld can offer the resources to explain the characteristic features of narrative immersion. Unlike alternative proposals, ours avoids the need to postulate controversial mental states. (shrink)

En este trabajo se ofrece una propuesta de aplicación práctica del concepto de Pathosformeln acuñado por el historiador del Arte alemán Aby Warburg para los estudios literarios, estableciendo un vaso comunicante desde las imágenes representativas y visuales estudiadas por éste, hacia las imágenes mentales originadas en las descripciones de un texto literario, y las emociones que ellas comunican. Para ello, se escoge un variado corpus de ocho crónicas latinoamericanas, desde modernistas hasta el siglo XXI, cuyo tema sea la prostitución travesti, (...) acotando luego el ejemplo de aplicación a la exacerbación de la feminidad por parte de los protagonistas, y el punto de vista de los narradores al respecto, apoyado a su vez en la noción de performatividad de género de Judith Butler. Mediante citas textuales y comparación entre las representaciones de la prostituta travesti en estos textos de no ficción, se discute la aplicabilidad del concepto, así como las diferencias con el ampliamente estudiado uso de éste en la historiografía de las artes visuales. El campo interpretativo sobre la obra de Newton ha sido ampliamente discutido y, particularmente, el tema de las hipótesis no ha sido la excepción. El objetivo de este texto es mostrar que la filosofía natural de Newton pareciera, en principio, rechazar la hipótesis, pero en realidad no es opuesta a la formulación de estas, si diferenciamos a qué tipo de hipótesis se hace referencia. Así pues, se muestra, en primer lugar, cómo desarrolla Newton su filosofía natural, y cómo es contrapuesta (...) a las hipótesis. Luego se muestra que bajo condiciones determinadas las hipótesis son aceptadas. Y, por consiguiente, se concluye que la filosofía de Newton no rechaza radicalmente las hipótesis, sino que, por el contrario, se puede valer de su formulación para el progreso de la investigación científica, dependiendo a qué tipo de hipótesis se haga referencia. My paper examines the potential of Gaston Bachelard’s concept of phenomenotechnique through a critique of its historical reception and an analysis of its epistemological implications. Vis-a-vis constructivist and pragmatist interpretations, I argue that the core issue at stake in this concept is not just to regard scientific knowledge as ‘fabricated’ through technical means, but also to understand the radical difference that lies between the experience of a world given to and measured by scientists, and one that is ontologically expanded by (...) the conceptual creations of science. In his reflections on the ‘phenomenotechnical realisation’ of noumena in microphysics, mathematics and chemistry, Bachelard not only anticipated a new epistemic modality which has become eminent now in computerised, data-centric approaches to nature and culture; he also became one of the first philosophers to explore the human experience of a reality inherently built from, and no longer just described by mathematical tools and models. Past public announcement operators have been defined in Hoshi and Yap :259–281, 2009) and Yap, to describe an agent’s knowledge before an announcement occurs. These operators rely on branching-time structures that do not mirror the traditional, relativization-based semantics of public announcement logic, and favor a historical reading of past announcements. In this paper, we introduce reverse public announcement operators that are interpreted on expanded models. Our model expansion adds accessibility links from an epistemic model \ to a filtrated submodel of (...) the canonical model for \. Here \ is the minimal normal modal logic together with \ axioms for the universal operator U. This yields a highly general pre-announcement version of \ that makes our operators potentially useful for studying non-standard interpretations of rescinded announcements in PAL. Indeed, we find that our reverse announcement operators cannot be represented by product update, and that they have an intimate connection with the knowledge forgetting of Zhang and Zhou :1525–1537, 2009). We show that the logic resulting from adding reverse announcements to PAL is sound and complete. (shrink)

This paper issues a highly controversial point: is there possible that a concept of ‘revolution’ can legitimize the historical revolutionary action and, if yes, how could this be possible? This debate on revolution is a subsequent part of a larger puzzle: the hermeneutics of the historical fact. Roughly explained, the concept of ‘revolution’ is the major piece of a ’revolutionary rhetoric,’ which generates the interpretation of the historical fact. Samples are offered by means of the concept of ‘revolution’ issued by (...) modern historiography. The case focuses on three main parts: a brief debate on the concept of ‘revolution’ viewed by the apologists of the French Revolution and their adversaries; a critique of Marx’s and Lenin’s ideology of revolution; finally, an illustration of a rhetorical dismantle of ‘revolution’ at hand in Kenneth Burke’s comments on Marxist ‘revolution.’. RESUMEN El objetivo de este artículo es proponer una reinterpretación del concepto de comunidad a la luz de las transformaciones tecnológicas y de las formas de comunicación recientes, las cuales ponen la idea de lo social no como precepto teórico, sino como elemento a descubrir en los diferentes estudios planteados. Se busca una transversalización teórica de los tres autores, tomando elementos esenciales de sus obras para proponer una nueva clave interpretativa que permita tomar el concepto de comunidad no como un (...) presupuesto teórico, sino como un producto inmanente, resultado de las conexiones cotidianas que se realizan entre los sujetos de manera espontánea en el campo de lo social. ABSTRACT Taking as a starting point the objective of this article is the reinterpretation of the concept, forced by the technological and communication transformations that place the ideas of social and community, not as theoretical precepts, but as elements to discover on the studies proposed. A theoretical transversalization of the three authors will be sought, taking essential elements from their works to propose a new interpretative key that allows us to take the concept of community, not as a theoretical presupposition, but as an immanent product resulting from the daily connections made between the subjects, spontaneously, on the social field.
