We show in this paper that some expressions indicating source of evidence are part of propositional content and are best analyzed as special kind of epistemic modal. Our evidence comes from the Japanese evidential system. We consider six evidentials in Japanese, showing that they can be embedded in conditionals and under modals and that their properties with respect to modal subordination are similar to those of ordinary modals. We show that these facts are difficult for existing theories of evidentials, which (...) assign evidentials necessarily widest scope, to explain. We then provide an analysis using a logical system designed to account for evidential reasoning; this logic is the first developed system of probabilistic dynamic predicate logic. Japanese has a large number of evidential and modal expressions. Many of the inferential evidentials – mitai, yoo, rashii – also have an adjectival use. On this use, they make a claim about the prototypicality of some object or individual with respect to another class of object, in the case of rashii, or about the similarity of these two objects, for yoo and mitai. This paper provides a compositional semantics for these adjectives, claiming that they are evaluated in terms of (...) the degree to which they instantiate a set of properties (conventionally) associated with a class of object. ABSTRACTLove is the basis for a moral psychology of forgiveness. I argue for an account of love based on Roy Bhaskar's conception of its five circles, and of the ethical nature of human beings as concrete universals/singulars. Linking this to work of ‘The Forgiveness Project’, I argue that forgiveness can be understood metaphysically in terms of its relation to love of self, of the other, of the relation of self and other, of self, other and the wider community, and of (...) self and other in their ontological depth as unique individuals. Forgiveness involves both a ‘giving to’ and a ‘giving up’, and this can lead to a profound sense of identity between a victim and a perpetrator. Forgiveness is different for each person; it may draw upon a public/legal setting as a proxy for universal judgement; and it confronts social-structural and political elements which may block its development. How does the human animal who thinks and loves relate to criminal justice? This essay takes up the idea of a moral psychology of guilt promoted by Bernard Williams and Herbert Morris. Against modern liberal society’s ‘peculiar’ legal morality of voluntary responsibility, it pursues Morris’s ethical account of guilt as involving atonement and identification with others. Thinking of guilt in line with Morris, and linking it with the idea of moral psychology, takes the essay to Freud’s metapsychology in Civilization and (...) Its Discontents. Two conflicting routes to guilt are noted in Freud, one involving internalisation of external anger to suppress destructive instincts, the other loving identification with others in the process of self-formation. This second route is developed through the psychoanalytic thought of Hans Loewald and Jonathan Lear. Following Loewald, the moral psychology of self-formation makes loving identification with others the root of responsibility, guilt and atonement. Following Lear, the moral psychology of guilt developed on these lines renders psychoanalysis part of a broadly understood philosophical project following Aristotelian and Socratic principles. Underlying Morris’s account of guilt is the possibility of ‘prospective identification’, understood as the moral and psychological ground of guilt and reconciliation. This is the rational core of criminal justice, which maintains an uneasy relationship with law’s ‘peculiar’ morality. (shrink)

Should the truth-value of statements be thought of as epistemically constrained or as determined by objective factors that stand quite apart from our best knowledge, evidence, or powers of conceptual grasp? The anti-realist/realist debate turns ultimately on this disagreement. My article takes its lead from a famous pronouncement by US Defense Secretary Donald Rumsfield to the effect that there are ‘known knowns’, i.e. ‘things that we know we know’; ‘known unknowns’, or ‘things we know we do not know’; and lastly, (...) ‘unknown unknowns’, ‘things we don’t know we don’t know’. Whether Rumsfeld was talking gobbledegook, making some acute logical points, or just pulling the wool with regard to Iraq’s disputed weapons capability is matter for debate. Still, his remarks may be useful for clarifying certain fundamental issues about knowledge and truth, especially in the context of assertions - by anti-realist philosophers such as Michael Dummett - that truth cannot possibly transcend our best powers of proof or ascertainment. On the other hand such scruples may have just the opposite (obfuscating) effect when we are faced with a complex and case-specific question, such as whether or not Iraq truly possessed weapons of mass destruction. My article contends that a wide range of reliably knowledge-conducive procedures, while indeed they fall short of absolute, indubitable truth, nonetheless offer grounds for arriving at a reasoned assessment of the evidence and for not consigning statements of the Dummettian ‘disputed class’ to a limbo of ultimate undecidability. The Bush administration's response to the terrorist attacks of September 11, 2001, has been uniformly hostile to this notion, and it has instead promoted a jingoistic politics of self‐assertion by an America largely identified with the executive branch of its government. This is doubly disturbing, as the executive branch has sought to free itself from international law, multinational commitments, and domestic judicial regulation, even (...) as it has sought to validate itself by demonizing its enemies. This essay draws out the disturbing echoes here of Carl Schmitt's work of the 1920s, in particular of Schmitt's conception of the sovereign as the ungrounded ground of the law and the political as the site of mortal conflict between friend and enemy. The essay argues that Schmitt's position in the twenties, for all of its evident problems, is superior to that of Bush, Wolfowitz, and Ashcroft in at least two senses: Schmitt condemns the idea of waging war for profit and recognizes that such wars will often be disguised as moral crusades waged against the “inhuman”; and he acknowledges that claiming to fight a war for humanity denies one's enemies their humanity, leaving them open to torture and even extermination. Metaphysicians go on busily doing metaphysical thinking all over the world, and apparently with a modicum of self-assurance that they are not talking nonsense or pursuing an illusory will-of-the-wisp. Yet other philosophers of empirical, analytical, phenomenological, or other turns of mind seem to have more and more difficulty in understanding just how metaphysicians give meaning and positive content to the vast abstract concepts by which they seek to describe and explain the entire spectrum of reality extending far beyond present or (...) perhaps even possible human experience. Since there is no way of gaining direct insight into dimensions of reality beyond human experience, and since in order to be applied to the whole range of reality these concepts must abstract from purely human experience, it is hard for them to see—and it is a serious problem in itself—how these all-embracing terms can be anything more than empty, formal, verbal symbols or conceptual constructions, with no positive existential content describing reality itself across its whole spectrum. Even the metaphysician himself, though when left alone he may have a sure sense of how to do metaphysical thinking fruitfully, when questioned to explain and justify what he is doing, and is convinced is worth doing, can feel embarrassed and struck dumb as to how to articulate and justify the principles behind the procedures he is following. The Italian philosopher Giorgio Agamben is having an increasingly significant impact on Anglo-American political theory. His most prominent intervention to date is the powerful reassessment of sovereignty and the politics of life and death laid out in his multivolume _Homo Sacer_ project. Agamben argues that in both the modern world and the ancient, politics inevitably involves a sovereign decision that bans some individuals from the political and human communities. For Agamben, the Nazi concentration camps—in which some inmates are reduced to (...) a form of living death—are not a political aberration but instead the place where this essential political decision about life most clearly reveals itself. Engaging specifically with _Homo Sacer_, the essays in this collection draw out and contend with the wide-ranging implications of Agamben’s radical and controversial interpretation of modern political life. The contributors analyze Agamben’s thought from the perspectives of political theory, philosophy, jurisprudence, and the history of law. They consider his work not only in relation to that of his major interlocutors—Hannah Arendt, Michel Foucault, Carl Schmitt, Walter Benjamin, and Martin Heidegger—but also in relation to the thought of Plato, Pindar, Heraclitus, Descartes, Kafka, Bataille, and Derrida. Norris also discusses the emergence of anti–realism as a strongly marked trend within recent analytic philosophy, one that denies the existence of objective (‘recognition–transcendent’) truths in mathematics, the physical sciences, history and other disciplines. Thus statements are thought of as possessing a truth–value just insofar as we possess some adequate proof–procedure or some means of finding them out through empirical or other methods of enquiry. Norris offers a range of arguments against this anti–realist position and brings out its convergence with various postmodernist lines of thought. Through a running commentary on Derrida’s work in relation to these developments he shows how deconstruction has been misconstrued by sociologists, cultural critics and educational theorists whose understanding has often been based on a limited acquaintance with the primary texts. Above all Norris calls for a renewed engagement with the philosophic discourse of modernity and a willingness to challenge postmodern scepticism and value–relativism in a spirit of open–minded critical debate. The simultaneous perception of multimodal sensory information is important for effective reactions to the external environment. In relation to the effect on time perception, voluntary movement and rhythmic stimuli have already been identified in previous studies to be associated with improved accuracy of temporal order judgments. Here, we examined whether the combination of voluntary movement and rhythmic stimuli improves the just noticeable difference in audio-tactile TOJ Tasks. Four different experimental conditions were studied, involving two types of movements and two types (...) of stimulus presentation. In the voluntary movement condition, after the auditory stimulus participants moved their right index finger voluntarily and naturally, while in the involuntary movement condition, their right index finger was moved by the tactile device. The stimuli were provided in a rhythmic or one-time only manner by hitting inside the first joint of the participants' right index finger using a tactile device. Furthermore, in the rhythmical tactile conditions, tactile stimuli were presented rhythmically to the right index finger 5 times consecutively. On the other hand, in the one-time tactile conditions, tactile stimuli was presented one-time only to the right index finger. Participants made an order judgment for the fifth tactile stimuli and the first and only auditory stimuli. In our TOJ tasks, auditory-tactile stimulus pairs were presented to participants with varying stimulus-onset asynchronies. For the two stimuli presented at a time that were shifted by the SOA, the participants were asked to judge which one was presented first, and they were given a two-choice answer. Using a non-parametric test, our results showed that voluntary movement and rhythmic tactile stimuli were both effective in improving the JNDs in TOJ Tasks. However, in the combination of voluntary movement and rhythmic tactile stimuli, we found that there was no significant difference in JNDs in our experiments. (shrink)

Daniel Dennett once invited us to consider super-Martians who were highly advanced scientifically yet lacked all intentional concepts. They spoke the language of austere physics and were capable of perceiving and describing the world at the micro-level. If such beings could accurately report happenings in their environment, make predictions, and generally live out their lives wholly within the scientific image, what would they be missing, Dennett wondered, by virtue of lacking intentional concepts? This article addresses the long-standing problem of how to understand Mill’s famous harm principle in light of his failure to specify what counts as “harm” in On Liberty. I argue that standard accounts restricting “harm” to only certain negative consequences fail to do justice to the text, and that this fact forces us to rethink Mill’s defense of individual liberty. I then offer a new account of that defense in which “harm” is understood in an expansive sense, despite apparent problems (...) for such a view. (shrink)

My aim in this chapter is to push back against the tendency to emphasize Mill’s break from Bentham rather than his debt to him. Mill made important advances on Bentham’s views, but I believe there remains a shared core to their thinking—over and above their commitment to the principle of utility itself—that has been underappreciated. Essentially, I believe that the structure of Mill’s utilitarian thought owes a great debt to Bentham even if he filled in that structure with a richer (...) conception of human nature and developed it in more liberal directions. This commonality is revealed, in particular, in Mill’s own institutional designs and practical reform proposals in Considerations on Representative Government and related writings. If this is right, then the tendency of interpreters to highlight their differences rather than their similarities has been to the detriment of both Mill and Bentham scholarship, and so to our understanding of the rise of liberal utilitarianism. The focus of this essay is on how we overcome the past by dealing with it. In this setting, the analysis is of the relationship between ‘moral transactions’ concerning blame, guilt, responsibility, apology and forgiveness and the possibility of transition away from states of trauma. The first section draws on previous work to set out a position on human love as the basis for an understanding of guilt and the ‘moral grammar’ of justice. The second section considers Martha Nussbaum’s claim (...) in Anger and Forgiveness that the idea of transition should be prioritized at the cost of a moral transactional analysis that would engage the moral grammar of blame, guilt, responsibility, apology and forgiveness. The latter is seen as potentially obstructing the transition to a better world. I suggest to the contrary there are grounds for thinking that a successful transition requires relevant moral transactions. (shrink)
