The author makes the claim that human rights have become an important institution of international relations, their inherent powerlessness notwithstanding. In the first step of the analysis, the author discusses the positive correlation between a nationâs socioeconomic well-being and the safe guarantee of human rights. However, the social and political disembeddedness of human rights and their universalist character actually constitute their inherent weakness, which is analyzed in the second part. In the third part, which deals with the future development of (...) human rights, the author makes the claim that the process of globalization does not only create the functional networks of economic, political, and military power elites, but also offers hope for the emergence of a global moral community in which the idea of human rights may become an essential institutional pillar. The following remarks deal only with one aspect of Kennedy's article: the attempt to demonstrate Schmitt's imprint on Habermas' work. Here Kennedy has to bear the burden of proof because of the gap between Schmitt, the harbinger of politics as a sphere of existential decision, and Habermas, the theoretician of apolitical rationality. Before dealing with two questions raised by Kennedy — Schmitt's and Habermas’ conception of democracy; and the distinction between legality and legitimacy, it is advisable to briefly review Schmitt's (...) conceptual apparatus. Kennedy begins by ascribing to Schmitt the view that liberal democracy is a deceptive compromise which does not resolve “the material claims to equality.”. (shrink)

Starting from the presupposition that European democracy is necessary to the survival and development of the European Union, the author deals with the process which may entail a European constitution, and discusses the elements of the present legal structure of the EU which are conducive to a European Democracy. In particular, the author focuses on the incomplete, polycentric, and dynamic character of a possible EC/EU constitution, and on the duality of its legitimating principle. This claim is that these characteristics necessitate (...) some institutional modifications of democratic principles if compared with national democracy, and that Euro‐democracy is possible if we do not simply apply the standards of democracy valid for Member States, but succeed in developing criteria which are adequate to the institutional qualities of the EC/EU. Finally, the author maintains the legal character of the regulatory power of the Community, and invokes the mutual legal bonds linking the Member States and their peoples as the source of the Community. This chapter explores Carl Schmitt’s response as a political, legal, and constitutional theorist to the permanent crisis of the Weimar Republic during its short-lived existence between 1919 and 1933. On the foundation of his conceptual edifice, it shows why Schmitt came to the conclusion that the Weimar Constitution did not provide an appropriate political system for the German people in their “natural” form. While the founders of Weimar sought to protect the polity’s diversity and contradictions, Schmitt regarded their constitution as (...) inherently nondemocratic. A focal point of the analysis is Schmitt’s claim that democracy and dictatorship are by no means mutually exclusive. The chapter demonstrates why Schmitt’s faith in the constituent power of a homogenous German people invariably led to his preference for “democratic dictatorship” and a rejection of the Weimar constitution’s system of parliamentary democracy. This article builds upon the distinction between pluralism and plurality, the latter in the sense of variety or diversity. Plurality is an empirical fact, such as the biological diversity of the human species. In contrast, pluralism is a normatively underpinned social pattern according to which the diversity of interests, opinions, values, ideas, etc., of individuals and groups is recognized as a constitutive element of a political order. Pluralism can materialize only if a political order is not based upon the claim (...) of one undisputable truth. An embryonic form of pluralism through law emerged in ancient Greece with the institution of courts in which the parties to a legal dispute could argue over what the law said and hence officially present divergent meanings of justice. For the modern development the separation of law and justice was a major step towards pluralism insofar as the authority of the polity and the binding force of the law were no longer based upon the contention of one exclusive truth – auctoritas, non veritas facit legem. This Hobbesian principle banned religious, moral, philosophical and political discourses to the pre-political domain of privacy and secrecy from which pluralism could not result. Referring to the distinction between regulative and constitutive norms I submit that only the latter, not the former, can function as sources of pluralism. (shrink)

In diesem Band erortern in zwanzig Beitragen namhafte Philosophen und Theologen aus dem In-und Ausland Fragen der Erkenntnistheorie in systematischer wie philosophiehistorischer Perspektive. Zum einen stehen dabei Grundfragen der Erkenntnistheorie im Blickfeld, wie etwa der grundsatzlichen Frage nach Wahrheit und Methode, Erinnerungsvermogen oder dem der Evidenz. Zum anderen erortert ein zweiter Themenkreis spezielle Themen wie dem der Wesenserkenntnis, Analogie und Personalitat. Ein dritter Kreis umfasst (...) Fragen nach der Existenz der Welt und der Bedeutung des Realismus fur die Ethik. Dem anschliessend befassen sich weitere Beitrage mit der Religionsphilosophie, insbesondere der Bedeutung naturlicher Gotteserkenntnis und dem Begriff des Wunders. In recent decades, there has been a proliferation of alternative food networks which promote an agenda of reconnection, allegedly linking consumers and producers to the socio-ecological origins of food. Rarely, however, does the AFN literature address “origins” of food in terms of animals, as in the case of meat. This article takes a relational approach to the reconnection agenda between humans and animals by discussing how the phenomenon of animal welfare and “happy” meat are enacted by producers and consumers in (...) mundane, embodied, and nuanced ways. Utilizing hybrid conceptualizations of human–animal relations through “natureculture” and “being alongside”, we demonstrate that consumers and producers of AFNs perform natureculture entanglements daily, often considering humans and animals as part of one another and the ecological system. Nonetheless, we also point to how participants in AFNs set boundaries to distance themselves from moments of animal life and death, explaining away uncomfortable affective naturecultures through commodification logics. Drawing on qualitative data from consumers and producers of food networks in Austria, we introduce the concept of “human–animal magnetism” to illustrate that the draw for humans to care about other animal lives exists within a spectrum of attraction and disassociation, engendered through specific human–animal interactions. Ultimately, we offer a cautiously hopeful version of alterity in AFNs of meat in which more caring human–animal relations are possible. (shrink)

Social technology can improve the quality of older adults' social lives and mitigate negative mental and physical health outcomes associated with loneliness, but it should be designed collaboratively with this population. In this paper, we used participatory design methods to investigate how robots might be used as social facilitators for middle-aged and older adults in both the US and Japan. We conducted PD workshops in the US and Japan because both countries are concerned about the social isolation of these older (...) adults due to their rapidly aging populations. We developed a novel approach to participatory design of future technologies that spends 2/3 of the PD session asking participants about their own life experiences as a foundation. This grounds the conversation in reality, creates rapport among the participants, and engages them in creative critical thinking. Then, we build upon this foundation, pose an abstract topic, and ask participants to brainstorm on the topic based on their previous discussion. In both countries, participants were eager to actively discuss design ideas for socially facilitative robots and imagine how they might improve their social lives. US participants suggested design ideas for telepresence robots, social distancing robots, and social skills artificial intelligence programs, while Japanese participants suggested ideas for pet robots, robots for sharing experiences, and easy-to-operate instructor robots. Comparing these two countries, we found that US participants saw robots as tools to help facilitate their social connections, while Japanese participants envisioned robots to function as surrogate companions for their parents and distract them from loneliness when they were unavailable. With this paper, we contribute to the literature in two main ways, presenting: A novel approach to participatory design of future technologies that grounds participants in their everyday experience, and Results of the study indicating how middle-aged and older adults from the US and Japan wanted technologies to improve their social lives. Although we conducted the workshops during the COVID-19 pandemic, many findings generalized to other situations related to social isolation, such as older adults living alone. (shrink)

Po studiích germanistiky ve Vídni, Berlíně a Curychu pokračoval ve studiu filosofie a teologie u jezuitů (E. Przywara, H. de Lubac). Před nadějnou akademickou dráhou dal přednost pastorační službě u studentů. V Basileji navázal úzké kontakty s K. Rahnerem a K. Barthem. S lékařkou a mystičkou Adriennou von Speyr založil sekulární institut Johannesgemeinschaft (1944) a nakladatelství, ve kterém vydával její díla. Roku 1950 (...) jezuitský řád opouští. Před druhým vatikánským koncilem vystupoval jako katolický progresivista, po něm jako kritik katolického modernismu, v němž viděl ohrožení biblických tradic. S Henri de Lubacem a Josephem Ratzingerem roku 1972 spoluzakládal mezinárodní katolickou revui Communio. Svou rozsáhlou a rozmanitou publikační činnost završil trilogií Herrlichkeit–Theodramatik–Theologik (1961–1987), v níž uvažuje o Bohu v estetických souvislostech, v kategoriích transcendentálií pravdy, dobra a jejich ztělesnění – krásy.The article recalls the 110th anniversary of the birth of the Swiss Catholic theologian and philosopher (metaphysician) Hans Urs von Balthasar (1905 Luzern–1988 Basel). He studied German in Vienna, Berlin and Zurich and after that he continued his studies in philosophy and theology at the Jesuits (E. Przywara, H. de Lubac). He preferred pastoral ministry among students to a promising academic career. In Basel he established close contacts with K. Rahner and K. Barth. Together with the doctor and mystic Adrienne von Speyr he founded the secular institute Johannesgemeinschaft (1944) and a publishing house, in which he published her work. In 1950 he left the Jesuit order. Before the Second Vatican Council he acted as a progressive Catholic, afterwards as a critic of Catholic modernism, in which he saw the threat of biblical traditions. With Henri de Lubac and Joseph Ratzinger in 1972 he co-founded the International Catholic review Communio. His extensive and diverse publications he completed with trilogy The Glory of the Lord–Theo-Drama–Theo-Logic (1961–1987), in which he contemplates God within aesthetic contexts, within categories of transcendentals truth, goodness and their embodiment – beauty. Ethological theory standardly attributes representational content to animal signals. In this article I first assess whether Ruth Millikan’s teleosemantic theory accounts for the content of animal signals. I conclude that it does not, because many signals do not exhibit the required sort of cooperation between signal‐producing and signal‐consuming devices. It is then argued that Kim Sterelny’s proposal, while not requiring cooperation, sometimes yields the wrong content. Finally, I outline an alternative view, according to which consumers alone are responsible for conferring (...) representational status and determining content. BackgroundBiobanking biospecimens and consent are common practice in paediatric research. We need to explore children and young people’s (CYP) knowledge and perspectives around the use of and consent to biobanking. This will ensure meaningful informed consent can be obtained and improve current consent procedures.MethodsWe designed a survey, in co-production with CYP, collecting demographic data, views on biobanking, and consent using three scenarios: 1) prospective consent, 2) deferred consent, and 3) reconsent and assent at age of capacity. The survey was disseminated (...) via the Young Person’s Advisory Group North England (YPAGne) and participating CYP’s secondary schools. Data were analysed using a qualitative thematic approach by three independent reviewers (including CYP) to identify common themes. Data triangulation occurred independently by a fourth reviewer.ResultsOne hundred two CYP completed the survey. Most were between 16–18 years (63.7%, N = 65) and female (66.7%, N = 68). 72.3% had no prior knowledge of biobanking (N = 73).Acceptability of prospective consent for biobanking was high (91.2%, N = 93) with common themes: ‘altruism’, ‘potential benefits outweigh individual risk’, 'frugality', and ‘(in)convenience’.Deferred consent was also deemed acceptable in the large majority (84.3%, N = 86), with common themes: ‘altruism’, ‘body integrity’ and ‘sample frugality’. 76.5% preferred to reconsent when cognitively mature enough to give assent (N = 78), even if parental consent was previously in place. 79.2% wanted to be informed if their biobanked biospecimen is reused (N = 80).ConclusionProspective and deferred consent acceptability for biobanking is high among CYP in the UK. Altruism, frugality, body integrity, and privacy are the most important themes. Clear communication and justification are paramount to obtain consent. Any CYP with capacity should be part of the consenting procedure, if possible. (shrink)

Progressive supranuclear palsy is a movement disorder with prominent tau neuropathology. Brain diseases with abnormal tau deposits are called tauopathies, the most common of which is Alzheimer's disease. Environmental causes of tauopathies include repetitive head trauma associated with some sports. To identify common genetic variation contributing to risk for tauopathies, we carried out a genome-wide association study of 1,114 individuals with PSP and 3,247 controls followed by a second stage in which we genotyped 1,051 cases and 3,560 controls for the (...) stage 1 SNPs that yielded P ≤ 10-3. We found significant previously unidentified signals associated with PSP risk at STX6, EIF2AK3 and MOBP. We confirmed two independent variants in MAPT affecting risk for PSP, one of which influences MAPT brain expression. The genes implicated encode proteins for vesicle-membrane fusion at the Golgi-endosomal interface, for the endoplasmic reticulum unfolded protein response and for a myelin structural component. © 2011 Nature America, Inc. The 14th century Συναξάριον τοῦ τιμημένου Γαδάρου (in English: the Tale of the heroic donkey) could be described as an aitiological story. In medieval Greek there was a synonymous word, νικóν (nikón), which alternatively to the more common word γάδαρος (ghádharos) meant donkey. The word νικóν recalls the verb (nikó) and even reminds us of the homophonous participe derived from the same verb. The tale explains how the word νικóν came into being. Due to a fatal error in the editio (...) princeps by W. Wagner (Carmina Graeca medii aevi, 1874) the pointe of the Tale is not intellegible in the printed text. K. Tsantsanoglu in 1971 realised the problems of Wagner's edition, but his article did not lead to a re-evaluation of this fine piece of late-Byzantine literature. The present article offers: a new edition of the Tale of the heroic donkey, based on a completely new reading of the single manuscripts that preserves it; a new reading of the texts, focussing on questions of rhetorics and literary genre; a full glossary, based on the new edition. Corporate social responsibility (CSR) has become an increasingly significant managerial concept, yet the manager as an agent of corporate bureaucracy has been substantially missing from both the analytical and conceptual literature dealing with CSR. This article, which is both interpretative in nature and specific in reference to the U.K. cultural context, represents an attempt at addressing this lacuna by utilising qualitative data to explore the perceptions of managers working in corporations with developed CSR programmes. Exploring managerial perceptions of motives for (...) CSR initiatives, methods of stakeholder engagement, organisational integration of CSR and its impact on managerial work, this study concludes that an instrumental approach dominates, which indicates an external-internal organisational paradox in the design and execution of CSR initiatives. This paper is organised in three interconnected parts. First, contemporary political economic approaches to understanding the structure of the global economic system are outlined and synthesised. Specifically, it is suggested that the current structural configuration of the globe is a transitional phase between the spatially-bounded configuration hypothesised by world-system theory and the configuration hypothesised by globalisation theorists. Second, the contemporary problem of environmental degradation is situated in a global structural context. Third, an outline and critique of Ulrich Beck 's (...) theory of the ' Risk Society ' is presented to illustrate the increasing inadequacy of nation-state-centric theories in explaining the dynamic linkage between global capitalism and local environmental degradation. This is a tribute to Ulrich Beck and a rumination on his legacy in work on cosmopolitanism, translation, anxiety, and memory. Historical transitions and symbolic transmissions open up urgent questions about the connection between the structure of collective memory and the system of cosmopolitical thought. Public memory is embedded in an affective matrix of anxiety which is capable of creating the conciliatory conditions of political virtue and of fueling the terror of political passion. The vicious and sudden turn of (...) cosmopolitan memory from reconciliation to revenge is less surprising if anxiety is seen as the translational moment that mediates relations between remembering and forgetting. Anxiety forces the discourse of cosmopolitan memory to confront its own alterity, negotiating a knife-edge balance between sympathy and antipathy. The ethics of cosmopolitanism is an anxious ethics of the past that refuses to die, confronting a future that will not wait to be born. (shrink)
