The Force, Frailty, and Future of Human Rights under Globalization.Ulrich K. Preuss - 2000 - Theoretical Inquiries in Law 1 (2).
The author makes the claim that human rights have become an important institution of international relations, their inherent powerlessness notwithstanding. In the first step of the analysis, the author discusses the positive correlation between a nationâs socioeconomic well-being and the safe guarantee of human rights. However, the social and political disembeddedness of human rights and their universalist character actually constitute their inherent weakness, which is analyzed in the second part. In the third part, which deals with the future development of (...)

The Critique of German Liberalism: Reply to Kennedy.Ulrich K. Preuss - 1987 - Telos: Critical Theory of the Contemporary 1987 (71):97-109.
The following remarks deal only with one aspect of Kennedy's article: the attempt to demonstrate Schmitt's imprint on Habermas' work. Here Kennedy has to bear the burden of proof because of the gap between Schmitt, the harbinger of politics as a sphere of existential decision, and Habermas, the theoretician of apolitical rationality. Before dealing with two questions raised by Kennedy — Schmitt's and Habermas’ conception of democracy; and the distinction between legality and legitimacy, it is advisable to briefly review Schmitt's (...)

The Constitution of a European Democracy and the Role of the Nation State.Ulrich K. Preuss - 1999 - Ratio Juris 12 (4):417-428.
Starting from the presupposition that European democracy is necessary to the survival and development of the European Union, the author deals with the process which may entail a European constitution, and discusses the elements of the present legal structure of the EU which are conducive to a European Democracy. In particular, the author focuses on the incomplete, polycentric, and dynamic character of a possible EC/EU constitution, and on the duality of its legitimating principle. This claim is that these characteristics necessitate (...)

  10. Carl Schmitt and the Weimar Constitution.Ulrich K. Preuß - 2016 - In Jens Meierhenrich & Oliver Simons (eds.), The Oxford Handbook of Carl Schmitt. New York, NY: Oxford University Press USA.
This chapter explores Carl Schmitt’s response as a political, legal, and constitutional theorist to the permanent crisis of the Weimar Republic during its short-lived existence between 1919 and 1933. On the foundation of his conceptual edifice, it shows why Schmitt came to the conclusion that the Weimar Constitution did not provide an appropriate political system for the German people in their “natural” form. While the founders of Weimar sought to protect the polity’s diversity and contradictions, Schmitt regarded their constitution as (...)

    Law as a source of pluralism?Ulrich K. Preuß - 2015 - Philosophy and Social Criticism 41 (4-5):357-365.
This article builds upon the distinction between pluralism and plurality, the latter in the sense of variety or diversity. Plurality is an empirical fact, such as the biological diversity of the human species. In contrast, pluralism is a normatively underpinned social pattern according to which the diversity of interests, opinions, values, ideas, etc., of individuals and groups is recognized as a constitutive element of a political order. Pluralism can materialize only if a political order is not based upon the claim (...)

Naturecultures and the affective (dis)entanglements of happy meat.Heide K. Bruckner, Annalisa Colombino & Ulrich Ermann - 2019 - Agriculture and Human Values 36 (1):35-47.
In recent decades, there has been a proliferation of alternative food networks which promote an agenda of reconnection, allegedly linking consumers and producers to the socio-ecological origins of food. Rarely, however, does the AFN literature address “origins” of food in terms of animals, as in the case of meat. This article takes a relational approach to the reconnection agenda between humans and animals by discussing how the phenomenon of animal welfare and “happy” meat are enacted by producers and consumers in (...)

Social technology can improve the quality of older adults' social lives and mitigate negative mental and physical health outcomes associated with loneliness, but it should be designed collaboratively with this population. In this paper, we used participatory design methods to investigate how robots might be used as social facilitators for middle-aged and older adults in both the US and Japan. We conducted PD workshops in the US and Japan because both countries are concerned about the social isolation of these older (...)

    Místo filosofie v díle Hanse Urse von Balthasara K 110. Výročí Jeho Narození.Tomáš Ulrich - 2015 - Studia Philosophica 62 (1):125-133.
Článek připomíná 110. výročí narození švýcarského katolického teologa a filosofa (metafyzika) Hanse Urse von Balthasara (1905 Luzern–1988 Basilej). Po studiích germanistiky ve Vídni, Berlíně a Curychu pokračoval ve studiu filosofie a teologie u jezuitů (E. Przywara, H. de Lubac). Před nadějnou akademickou dráhou dal přednost pastorační službě u studentů. V Basileji navázal úzké kontakty s K. Rahnerem a K. Barthem. S lékařkou a mystičkou Adriennou von Speyr založil sekulární institut Johannesgemeinschaft (1944) a nakladatelství, ve kterém vydával její díla. Roku 1950 (...)

    A consumer‐based teleosemantics for animal signals.Ulrich E. Stegmann - 2009 - Philosophy of Science 76 (5):864-875.
Ethological theory standardly attributes representational content to animal signals. In this article I first assess whether Ruth Millikan’s teleosemantic theory accounts for the content of animal signals. I conclude that it does not, because many signals do not exhibit the required sort of cooperation between signal‐producing and signal‐consuming devices. It is then argued that Kim Sterelny’s proposal, while not requiring cooperation, sometimes yields the wrong content. Finally, I outline an alternative view, according to which consumers alone are responsible for conferring (...)

BackgroundBiobanking biospecimens and consent are common practice in paediatric research. We need to explore children and young people’s (CYP) knowledge and perspectives around the use of and consent to biobanking. This will ensure meaningful informed consent can be obtained and improve current consent procedures.MethodsWe designed a survey, in co-production with CYP, collecting demographic data, views on biobanking, and consent using three scenarios: 1) prospective consent, 2) deferred consent, and 3) reconsent and assent at age of capacity. The survey was disseminated (...)

Progressive supranuclear palsy is a movement disorder with prominent tau neuropathology. Brain diseases with abnormal tau deposits are called tauopathies, the most common of which is Alzheimer's disease. Environmental causes of tauopathies include repetitive head trauma associated with some sports. To identify common genetic variation contributing to risk for tauopathies, we carried out a genome-wide association study of 1,114 individuals with PSP and 3,247 controls followed by a second stage in which we genotyped 1,051 cases and 3,560 controls for the (...)

Das Συναξάριον τιμημένου γαδάρου: Analyse, Ausgabe, Wörterverzeichnis.Ulrich Moennig - 2009 - Byzantinische Zeitschrift 102 (1):109-166.
The 14th century Συναξάριον τοῦ τιμημένου Γαδάρου (in English: the Tale of the heroic donkey) could be described as an aitiological story. In medieval Greek there was a synonymous word, νικóν (nikón), which alternatively to the more common word γάδαρος (ghádharos) meant donkey. The word νικóν recalls the verb (nikó) and even reminds us of the homophonous participe derived from the same verb. The tale explains how the word νικóν came into being. Due to a fatal error in the editio (...)

Corporate social responsibility (CSR) has become an increasingly significant managerial concept, yet the manager as an agent of corporate bureaucracy has been substantially missing from both the analytical and conceptual literature dealing with CSR. This article, which is both interpretative in nature and specific in reference to the U.K. cultural context, represents an attempt at addressing this lacuna by utilising qualitative data to explore the perceptions of managers working in corporations with developed CSR programmes. Exploring managerial perceptions of motives for (...)

This paper is organised in three interconnected parts. First, contemporary political economic approaches to understanding the structure of the global economic system are outlined and synthesised. Specifically, it is suggested that the current structural configuration of the globe is a transitional phase between the spatially-bounded configuration hypothesised by world-system theory and the configuration hypothesised by globalisation theorists. Second, the contemporary problem of environmental degradation is situated in a global structural context. Third, an outline and critique of Ulrich Beck 's (...)

This is a tribute to Ulrich Beck and a rumination on his legacy in work on cosmopolitanism, translation, anxiety, and memory. Historical transitions and symbolic transmissions open up urgent questions about the connection between the structure of collective memory and the system of cosmopolitical thought. Public memory is embedded in an affective matrix of anxiety which is capable of creating the conciliatory conditions of political virtue and of fueling the terror of political passion. The vicious and sudden turn of (...)
