To fulfill their crucial duty of relieving suffering in their patients, physicians may have to administer palliative sedation when they implement treatment-limitation decisions such as the withdrawal of life-supporting interventions in patients with poor prognosis chronic severe brain injury. The issue of palliative sedation deserves particular attention in adults with serious brain injuries and in neonates with severe and irreversible brain lesions, who are unable to express pain or to state their wishes. In France, treatment limitation decisions for these patients (...) are left to the physicians. Treatment-limitation decisions are made collegially, based on the presence of irreversible brain lesions responsible for chronic severe disorders of consciousness. Before these decisions are implemented, they are communicated to the relatives. Because the presence and severity of pain cannot be assessed in these patients, palliative analgesia and/or sedation should be administered. However, palliative sedation is a complex strategy that requires safeguards to prevent a drift toward hastening death or performing covert euthanasia. In addition to the law on patients' rights at the end of life passed in France on April 22, 2005, a recent revision of Article 37 of the French code of medical ethics both acknowledges that treatment-limitation decisions and palliative sedation may be required in patients with severe brain injuries and provides legal and ethical safeguards against a shift towards euthanasia. This legislation may hold value as a model for other countries where euthanasia is illegal and for countries such as Belgium and Netherlands where euthanasia is legal but not allowed in patients incapable of asking for euthanasia but in whom a treatment limitation decision has been made. Our aim in this paper is to extend the semantics for the kind of logic of ground developed in (deRosset and Fine, 2023). In that paper, we very briefly suggested a way of treating universal and existential quantification over a fixed domain of objects. Here we explore some options for extending the treatment to allow for a variable domain of objects.

This paper is concerned with the semantics for the logics of ground that derive from a slight variant GG of the logic of (Fine, 2012) that have already been developed in (deRosset and Fine, 2023). Our aim is to outline that semantics and to provide a comparison with two related semantics for ground, given in (Correia, 2017) and (Kraemer, 2018). This comparison highlights the strengths and difficulties of these different approaches.

But what exactly does it mean to say that a subject has or lacks the requisite capacity to decide? This question has to do with what (...) is commonly called “decisional capacity”, a central concept in health care law and ethics, and increasingly an independent topic of philosophical inquiry. -/- Decisional capacity can be defined as the ability of subjects to make their own medical decisions. Somewhat similar questions of capacity arise in other contexts, such as capacity to stand trial in a court of law and the ability to make decisions that relate to personal care and finances. However, the history behind the more general legal notions of capacity to stand trial and capacity to manage one’s life is different and operates somewhat differently in law (Roth, Meisel, & Litz 1977; Zapf & Roesch 2005). For the purposes of this discussion the notion of decisional capacity will be limited to medical contexts only; most notably, those where decisions to consent or to refuse treatment or participation in clinical research are concerned. L’enseignement n’est plus réservé aux futurs médecins mais aussi, à travers l’Education sanitaire, aux futurs malades que sont les gens bien portants. La part qui (...) se déroule en Faculté n’est plus qu’une préparation à la Formation permanente. La recherche n’est plus réservée seulement à un étroit sérail, mais s’inscrit dans les préoccupations de tous au service de tous. L’informatique offre au médecin le moyen le plus sûr de faire rayonner le savoir et de mieux organiser le service public qu’est aujourd’hui la médecine. L’hôpital enfin est appelé à devenir le foyer de toutes les activités médicales, la « Maison » du malade aussi bien que celle du médecin. Le paradoxe du médecin est celui de la médecine tout entière. Son excès sur tous nos possibles apporte dans la proximité même l'offrande du lointain. Ce qui nous saisit reste insaisissable et, comme autrui, l'est d'autant plus qu'il s'approche. Ainsi Platon fait de l'effroi le premier présent de la beauté, et pour Dostoïevski et Rilke elle n'est que le commencement (...) du terrible. Cette joie douloureuse, démesurée comme tout amour, est la dimension oubliée par l'esthétique, qui la relègue dans le sublime, distingué du beau. Il faut surmonter l'esthétique pour penser la beauté, si elle est le visage même de l'Etre. Les questions qu'elle fait surgir ne sont pas régionales, elles mettent en cause l'être entier de l'homme et les voies selon lesquelles il peut se perdre ou se trouver. La beauté nous éprouve, et cette épreuve décide de tout. Tel est le sens du mythe du Phèdre de Platon, dont Heidegger médita ce qu'il nous donne toujours à penser. La beauté qui se suffit pourtant nous appelle, et nous impose, sans esquive possible, la charge de lui répondre et de lui correspondre. Cette réponse ne saurait résider dans le jugement esthétique, elle peut seulement être l'acte de louer. Elle ne répond à la beauté qu'en la communiquant, et de la blessure qu'elle reçut ne veut pas guérir, mais accroître le chœur de ceux qui souffrent d'elle. Necessitists hold that, necessarily, everything is such that, necessarily, something is identical to it. Timothy Williamson has posed a number of challenges to contingentism, the negation of necessitism. One such challenge is an argument that necessitists can more wholeheartedly embrace possible worlds semantics than can contingentists. If this charge is correct, then necessitists, but not contingentists, can unproblematically exploit the technical successes of possible worlds semantics. I will argue, however, that the charge is incorrect: contingentists can embrace possible worlds semantics (...) as wholeheartedly as necessitists. Williamson offers a criterion for a class of models of quantified modal logic to be intended, and argues on its basis that contingentists must deny that there is an intended class of models. I argue that Williamson’s criterion is objectionable, supply an alternative that does not support Williamson’s argument, and adapt Williamson’s construction of an intended model structure to the needs of contingentist metaphysics. Over the last twenty years, archaeologists have used various process-oriented modes of enquiry to undermine the belief that humans are special. Barad (2007) developed Bohr’s indeterminist interpretation of quantum mechanics into agential realism which offers an ontological basis for distributing agency away from humans and plays a crucial role in underwriting some posthumanist archaeological agendas. But its origins in quantum physics make agential realism difficult to understand and evaluate. Despite the challenge, the first two parts of this paper are devoted (...) to each task in turn, with limited success. Part three turns to the archaeological literature, where the evaluation of agential realism turns out to be even more inadequate and so I advise against its use in support of process-oriented approaches in archaeology. The final section turns to the activity of an art workshop and introduces a playful approach to working with clay. Clayful phenomenology is a way of investigating the relationship between gesture, material and ideation. During sculpting, phenomenological experience is not subjective, stable and external but is generated within a transient creative system where entities, ideas and agency reciprocally, emerge as ephemeral manifestations. Clayful phenomenology and agential realism are ontologically similar and both are controversial but agential realism has a wall of quantum conceptual complexity standing between it and a judgement about credibility whereas playing with clay can be assessed directly, through experience. SNODENT is a dental diagnostic vocabulary incompletely integrated in SNOMED-CT. Nevertheless, SNODENT could become the de facto standard for dental diagnostic coding. SNODENT's manageable size, the fact that it is administratively self-contained, and relates to a well-understood domain provides valuable opportunities to formulate and test, in controlled experiments, a series of hypothesis concerning diagnostic systems. Of particular interest are questions related to establishing appropriate quality assurance methods for its optimal level of detail in content, its ontological structure, its construction and (...) maintenance. This paper builds on previous–software-based methodologies designed to assess the quality of SNOMED-CT. When applied to SNODENT several deficiencies were uncovered. 9.52% of SNODENT terms point to concepts in SNOMED-CT that have some problem. 18.53% of SNODENT terms point to SNOMED-CT concepts do not have, in SNOMED, the term used by SNODENT. Other findings include the absence of a clear specification of the exact relationship between a term and a termcode in SNODENT and the improper assignment of the same termcode to terms with significantly different meanings. An analysis of the way in which SNODENT is structurally integrated into SNOMED resulted in the generation of 1081 new termcodes reflecting entities not present in the SNOMED tables but required by SNOMED's own description logic based classification principles. Our results show that SNODENT requires considerable enhancements in content, quality of coding, quality of ontological structure and the manner in which it is integrated and aligned with SNOMED. We believe that methods for the analysis of the quality of diagnostic coding systems must be developed and employed if such systems are to be used effectively in both clinical practice and clinical research. Several recent philosophical projects, notably Bruno Latour's empirical meta-physics, Tristan Garcia's formal ontology, Graham Harman's object-oriented philosophy, and Markus Gabriel's new realism, have insisted there is a need for an “egalitarian” or “flat” ontology that would grant an equal ontological status to entities of every kind, whether actual, abstract, material, or fictional. This article groups all of these projects under the heading of “ontological liberalism” and argues that they are inherently problematic, as they sacrifice conceptual coherence and explanatory usefulness in (...) the name of indefinite inclusion. Focusing on Gabriel's recent books Why the World Does Not Exist and Fields of Sense, and with continual reference to Peter Wolfendale's work on the topic, this essay offers a broad but detailed critique of ontological liberalism, with an eye to alternatives emerging from the discipline of anthropology. Susan Haack has recently attempted to discredit religion by showing that science is an extended and enhanced version of common sense while religion is not. I argue that Haack’s account is misguided not because science is not an extended version of common sense, as she says. It is misguided because she assumes a very restricted, and thus inadequate, account of common sense. After reviewing several more realistic models of common sense, I conclude that common sense is rich enough to allow (...) various kinds of extensions. Just as science can be correctly seen as an enhanced version of common sense, so also religion. (shrink)

Popper has argued that the repetition of tests yields diminishing returns. His argument has been criticised by Musgrave for involving an inductive element. This paper argues that Musgrave's solution robs the concept of corroboration of it's force. An alternative solution is suggested on the basis of a differentiation between replication and repetition. It is argued that one then does receive diminishing returns in agreement with the structure of corroboration in general.

One, it is said, went insane, another became a heretic, a third died and only the (...) fourth emerged unscathed. A modern variation of this story might go like this. Four or perhaps  philosophers entered the jungle of nationalism and for the most part went insane. There were those who embraced nationalism and consequently abandoned the universality of philosophy for the promotion of xenophobia, racism and even Nazism. Others remained internationalist and hence became futile—philosophical Canutes—commanding the raging beasts of nationality to be still. No one struggled harder with nationalism than Bertrand Russell. In , writing as an internationalist, he announced the demise of the principle of nationality only to see nationalisms explode in every region of the world (see his “National Independence and Internationalism”, Papers ). He opposed it relentlessly and without compromise until near the end of his life when he found himself endorsing wars of national liberation. Nationalism is often depicted as a howling beast. It would be better to think of it as an anaconda that wraps itself around everyone who ventures into its domain. Joan Cocks’ Passion and Paradox is an important book on nationalism and the intelligentsia. She traces the intellectual encounter with nationalism of a number of figures—Karl Marx, Rosa Luxemburg, Isaiah Berlin and the Scottish nationalist Tom Nairn, among others. All are exiles, most are Jews, and all try to hack their way through a jungle of conundrums of nationalist thought. Her accounts of these thinkers sometimes read like complex legal briefs, but are always illuminating. Though an internationalist, she sees the power of nationalist imperatives. Her approach to the contradictory strains of nationalism and hostility to nationalism echoes that of Hegel. She presents critical but sympathetic accounts of each side of the nationalist problematic and shows how their difficulties might be resolved in a higher synthesis. Alas! her resolution suffers from the unworldliness that she finds in other versions of internationalism. Her argument begins with a personal experience. In the early ’s she joined a group of Arabs and Jews against the Gulf War. In the course of their associ- Reviews  ation she learned that the Jews were all internationalists, while the Arabs were outspoken nationalists. This experience presumably demonstrated that a happy collusion of nationalism and internationalism was possible. But, of course, there was another side: those prosecuting the war she opposed were also nationalists. Her central thesis addresses the tragedy of opposition. It states that nationalism is “dilemmatic”, that is, that “all paths of thought obscured equally telling contrary thoughts; all courses of action were strewn with causes for regret and remorse” (p. ). The horns of the dilemma are the valid claims of the internationalist who sees the underlying self-destructive deep structures of nationalism on one side, and the claims of the national particularistic who is engaged in the compelling theatre of national liberation and the protection of local customs and roots on the other. Her book is an account of how her thinkers are framed by this dilemma, locked in by the imperatives of either side. In the period between the Gulf War and the composition of this book in  Cocks was able to observe what she identifies as the destructive logic of nationalism. The ’s were a period of postmodernist celebration of the local, a sensibility that helped to legitimate nationalism. The explosion of nationalism that followed the breakup of the Communist imperium was a time of liberation of the imprisoned nations—a springtime when it was good to be alive. But as the decade wore on the concealed pit bulls came out—in Yugoslavia, in Rwanda and elsewhere. In Cocks’ view nationalism showed an inner logic, of a sort that Russell called attention to in the early ’s—a logic that led from euphoria to self-destruction (see his Prospects). Does the kind of socialist ideal articulated by G. A. Cohen in Why Not Socialism? add anything substantial to the Rawlsian conception of justice? Is it an ideal that Rawlsians should want to take on board, or is it ultimately foreign to their outlook? I defend a mixed answer to these questions. On the one hand, we shouldn’t underestimate the extent to which Rawls's theory already addresses the concerns that motivate Cohen’s appeal to the socialist ideal. Within the bounds of (...) a society living up to Rawls’s two principles of justice, I maintain, there would be little room left for an ideal of social relations to do any independent work. On the other hand, Cohen’s ideal may still have an important role to play within Rawlsian theory – not within the confines of a given society but on the international stage, beyond the liberal state as we know it. This asymmetry between the domestic and the international case stems from the fact that Rawls's principles of justice apply in full strength only at the domestic l... (shrink)

L’opposition majeure consiste dans l’idée défendue par Ruyer selon laquelle on ne saurait concevoir ce qu’est l’esprit sans définir un domaine, intérieur au sujet, qu’on peut identifier avec sa subjectivité. Une telle idée est comprise par Ryle comme un mythe, celui de l’intériorité. Il y a en revanche une volonté commune (mais bien différente) à Ruyer et Wittgenstein de s’émanciper de la (...) science.
