The orthodox view of proper names, Millianism, provides a very simple and elegant explanation of the semantic contribution of referential uses of names–names that occur as bare singulars and as the argument of a predicate. However, one problem for Millianism is that it cannot explain the semantic contribution of predicative uses of names. In recent years, an alternative view, so-called the-predicativism, has become increasingly popular. According to the-predicativists, names are uniformly count nouns. This straightforwardly explains why names can be used (...) predicatively, but is prima facie less congenial to an analysis of referential uses. To address this issue, the-predicativists argue that referential names are in fact complex determiner phrases consisting of a covert definite determiner and a count noun—and so, a referential name is a definite description. In this paper, I will argue that despite the appearance of increased theoretical complexity, the view that names are ambiguous between predicative and referential types is in fact superior to the unitary the-predicativist view. However, I will also argue that to see why this ambiguity view is better, we need to give up the standard Millian analysis. Consequently, I will first propose an alternative analysis of referential names that retains the virtues of Millianism, but provides an important explanatory connection to the predicative uses. Once this analysis of names is adopted, the explanation for why names are systematically ambiguous between referential and predicative types is both simple and elegant. Second, I will argue that the-predicativism has the appearance of being simpler than an ambiguity view, but is in fact unable to account for certain key properties of referential names without making ad hoc stipulations. MILLIANISM and DESCRIPTIVISM are without question the two most prominent views with respect to the semantics of proper names. However, debates between MILLIANS and DESCRIPTIVISTS have tended to focus on a fairly narrow set of linguistic data and an equally narrow set of problems, mainly how to solve with Frege's puzzle and how to guarantee rigidity. In this article, the author focuses on a set of data that has been given less attention in these debates—namely, so-called predicative uses, bound uses, (...) and shifted uses of names. The author first shows that these data points seem to favor a DESCRIPTIVIST view over a MILLIAN view, but the author then introduces an alternative view of names that not only provides a simple and elegant way of dealing with the data, but also retains rigidity without becoming subject to the problems raised by Frege's puzzle. Todd (2016) proposes an analysis of future-directed sentences, in particular sentences of the form 'will(φ)', that is based on the classic Russellian analysis of definite descriptions. Todd's analysis is supposed to vindicate the claim that the future is metaphysically open while retaining a simple Ockhamist semantics of future contingents and the principles of classical logic, i.e. bivalence and the law of excluded middle. Consequently, an open futurist can straightforwardly retain classical logic without appeal to supervaluations, determinacy operators, or any further (...) controversial semantical or metaphysical complication. In this paper, we will show that this quasi-Russellian analysis of 'will' both lacks linguistic motivation and faces a variety of significant problems. In particular, we show that the standard arguments for Russell's treatment of definite descriptions fail to apply to statements of the form 'will(φ)'. (shrink)

The-Predicativism is the view that names are count nouns. For example, the meaning of the name ‘Louise’ is roughly the property of being called Louise. Moreover, proponents of this view maintain that names that are ostensibly in argument position of a predicate are covert definite descriptions. In recent years, The-Predicativism has acquired a number of new supporters, mainly Elbourne (), Matushansky (), and Fara (). And while it was pointed out by Kripke () that these kinds of views generally struggle (...) with capturing the rigidity of proper names, these new views are alleged to solve this problem. In this paper I argue that the more recent versions of the view continue to struggle. In particular, I show that the views fail to provide an explanatory and/or empirically adequate analysis of rigidity. My discussions of these views are then supplemented with a general diagnosis of the problem and an explanation of why it is unlikely to be solved by The-Predicativism. (shrink)

Since the famous debate between Russell (Mind 14: 479–493, 1905, Mind 66: 385–389, 1957) and Strawson (Mind 59: 320–344, 1950; Introduction to logical theory, 1952; Theoria, 30: 96–118, 1964) linguistic intuitions about truth values have been considered notoriously unreliable as a guide to the semantics of definite descriptions. As a result, most existing semantic analyses of definites leave a large number of intuitions unexplained. In this paper, I explore the nature of the relationship between truth value intuitions and non-referring definites. (...) Inspired by comments in Strawson (Introduction to logical theory, 1964), I argue that given certain systematic considerations, one can provide a structured explanation of conflicting intuitions. I show that the intuitions of falsity, which proponents of a Russellian analysis often appeal to, result from evaluating sentences in relation to specific questions in context. This is shown by developing a method for predicting when sentences containing non-referring definites elicit intuitions of falsity. My proposed analysis draws importantly on Roberts (in: Yoon & Kathol (eds.) OSU working papers in Linguistics: vol. 49: Papers in Semantics 1998; in: Horn & Ward (eds.) Handbook of pragmatics, 2004) and recent research in the semantics and pragmatics of focus. (shrink)

In 'The Reference Book' (2012), Hawthorne and Manley observe the following contrast between (1) and (2): -/- (1) In every race John won. (2) In every race, the colt won. -/- The name 'John' in (1) must intuitively refer to the same single individual for each race. However, the description 'the colt' in (2) has a co-varying reading, i.e. a reading where for each race it refers to a different colt. This observation is a prima facie problem for proponents of (...) so-called The-Predicativism which is the view that the name in (1) is really a covert definite description, viz. 'the John'. If the The-Predicativism is correct, (1) and (2) are therefore syntactically equivalent, but this makes it mysterious why only (2) would have a co-varying reading. In a recent paper, Fara (2015) argues that there is a simple and elegant way for proponents of The-Predicativism to explain this contrast. This explanation relies on discerning some subtle syntactic differences between (1) and (2) which in turn are based on assumptions about nominal restrictions a la Stanley and Szabó (2000). In this short paper, I demonstrate that Fara's proposed explanation has a variety of serious shortcomings and hence that the contrast between (1) and (2) remains a significant problem for Predicativism. In recent years, a new argument in favor of Donnellan’s (Philos Rev 77: 281–304, 1966) semantic distinction between attributive and referential descriptions has been proposed by Michael Devitt and Marga Reimer. This argument is based on two empirical premises concerning regularity of use and processing ease. This paper is an attempt to demonstrate (a) that these empirical observations are dubious and fail to license the conclusion of the argument and (b) that if the argument were sound, it would severely overgenerate. The general lesson of the paper is that empirical observations about (a) how frequent an expression E is used to mean M and (b) how easy and fast M is processed cannot be taken to provide reliable evidence about the lexically encoded semantic properties of E. It is sometimes argued that certain sentences of natural language fail to express truth conditional contents. Standard examples include e.g. Tipper is ready and Steel is strong enough. In this paper, we provide a novel analysis of truth conditional meaning using the notion of a question under discussion. This account explains why these types of sentences are not, in fact, semantically underdetermined, provides a principled analysis of the process by which natural language sentences can come to have enriched meanings in (...) context, and shows why various alternative views, e.g. so-called Radical Contextualism, Moderate Contextualism, and Semantic Minimalism, are partially right in their respective analyses of the problem, but also all ultimately wrong. Our analysis achieves this result using a standard truth conditional and compositional semantics and without making any assumptions about enriched logical forms, i.e. logical forms containing phonologically null expressions. It is widely agreed that sentences containing a non-denoting description embedded in the scope of a propositional attitude verb have true de dicto interpretations, and Russell's (1905) analysis of definite descriptions is often praised for its simple analysis of such cases, cf. e.g. Neale (1990). However, several people, incl. Elbourne (2005, 2009), Heim (1991), and Kripke (2005), have contested this by arguing that Russell's analysis yields incorrect predictions in non-doxastic attitude contexts. Heim and Elbourne have subsequently argued that once certain (...) facts about presupposition projection are fully appreciated, the Frege/Strawson analysis of definite descriptions has an explanatory advantage. In this paper, I argue that both Russell's analysis and the Frege/Strawson analysis face a serious problem when it comes to the interaction of attitude verbs and definite descriptions. I argue that the problem observed by Elbourne, Heim, and Kripke is much more general than standardly assumed and that a solution requires a revision of the semantics of definite and indefinite descriptions. I outline the conditions that are required to solve the problem and present an analysis couched in dynamic semantics which can provide a solution. I conclude by discussing some further issues related to propositional attitude verbs that complicate a fully general solution to the problem. (shrink)

The overarching topic of this dissertation is the semantics and pragmatics of definite descriptions. It focuses on the question whether sentences such as ‘the king of France is bald’ literally assert the existence of a unique king or simply presuppose the existence of such a king. One immediate obstacle to resolving this question is that immediate truth value judgments about such sentences are particularly unstable; some elicit a clear intuition of falsity whereas others simply seem awkward or strange. Because of (...) these variations, truth value judgments are generally considered unreliable. In the first chapter of the dissertation, an explanation of this phenomenon is developed. It is observed that when these types of sentences are considered in the context of a discourse, a systematic pattern in judgments emerges. This pattern, it is argued, should be explained in terms of certain pragmatic factors, e.g. whether a speaker’s utterance is interpreted as cooperative. A detailed and general explanation of the phenomenon is then presented which draws importantly on recent research in the semantics and pragmatics of questions and focus. It is shown that the behavior of these judgments can be systematically explained, that truth value judgments are not as unreliable as standardly assumed, and that the proposed explanation best supports the conclusion that definite descriptions presuppose rather than assert existence. In the second chapter, the following problem is investigated. If definite descriptions are assumed to literally assert existence, a sentence such as ‘Hans wants the ghost in his attic to be quiet’ is incorrectly predicted to be true only if Hans wants there to be a ghost in his attic. This prediction is often considered evidence against Russell’s quantificational analysis and evidence in favor of the referential analysis of Frege and Strawson. Against this claim, it is demonstrated that this problem is a general problem about the existence commitments of natural language determiners, i.e. not an argument in favor of a referential analysis. It is shown that in order to avoid these undesirable predictions, quite radical changes to the semantic framework are required. For example, it must be assumed that a sentence of the form ‘The F is G’ has the open sentence ‘x is G’ as its asserted content. A uniform quantificational and presuppositional analysis of definites and indefinites is outlined which by exploiting certain features of so-called dynamic semantics unproblematically assumes that the asserted contents indeed are open sentences. In view of the proposed quantificational/presuppositional analysis, the dissertation is concluded by a rejection of the argument put forward by Reimer and Devitt that definite descriptions are ambiguous between attributive and referential uses. Reimer and Devitt’s argument is based primarily on the assumption that definite descriptions are conventionally used to communicate singular thoughts and that the conventional meaning of a definite description therefore must be fundamentally indexical/directly referential. I argue that this argument relies crucially on tacit assumptions about semantic processing for which no empirical evidence is provided. I also argue that the argument is too general; if sound, it would be an argument for an indexical treatment of most, if not all, other determiners. I then conclude by demonstrating that the view does not explain any new data and thus has no clear motivation. In short, this dissertation provides a detailed pragmatic explanation of a long-standing puzzle about truth value judgments and then outlines a novel dynamic semantic analysis of definites and indefinites. This analysis solves a significant problem about existence commitments — a problem that neither Russell’s nor the Frege/Strawson analysis are equipped to handle. This analysis is then defended against the claim that definite descriptions are ambiguous. (shrink)

New technologies and practices, such as drug testing, genetic testing, and electronic surveillance infringe upon the privacy of workers on workplaces. We argue that employees have a prima facie right to privacy, but this right can be overridden by competing moral principles that follow, explicitly or implicitly, from the contract of employment. We propose a set of criteria for when intrusions into an employee''s privacy are justified. Three types of justification are specified, namely those that refer to the employer''s interests, (...) to the interests of the employee her- or himself, and to the interests of third parties such as customers and fellow workers. For each of these three types, sub-criteria are proposed that can be used to determine whether a particular infringement into an employee''s privacy is morally justified or not. (shrink)

In this paper, the nature of the contract of employment is explored from an ethical point of view. It is argued that certain normative arguments should be taken into account in order to justify such a contract. Furthermore, an argument is developed against the claim that (a) the individual’s freedom of decision and (b) the practice of institutional arrangements are sufficient to justify a contract of employment. The dimensional analysis offered shows that further conditions are needed: (a) must be elaborated (...) and interpreted to the extent that this condition is not sufficient – rather sub-criteria regarding the agent’s state of knowledge must be met; and (b) should be supplemented by a demand for fairness. A tentative analysis of existing work contracts is the starting point for the ethical analysis. The aim is to show what a legitimate, or reasonable, contract of employment will require. Finally, some important normative implications and consequences regarding the contract’s normative status are discussed. (shrink)

In this article, we distinguish between three approaches to ethics in school, each giving an interpretation of the expression ‘ethics in school’: the descriptive facts about ethics approach, roughly consisting of teaching empirical facts about moral matters to students; the moral fostering approach, consisting of mediating a set of given values to students; and the philosophical ethics (PE) approach, consisting of critically discussing and evaluating moral issues with students. Thereafter, three influential arguments for why there ought to be ethics in (...) school are discussed, and each argument is interpreted given each approach to ethics in school, respectively. Thereby, we evaluate which interpretation of ‘ethics in school’ produces the strongest arguments, and thus, which approach is best supported by these arguments. At first glance, one of the most obvious places to look for moral progress is in individuals, in particular in moral development from childhood to adulthood. In fact, that moral progress is possible is a foundational assumption of moral education. Beyond the general agreement that moral progress is not only possible but even a common feature of human development things become blurry, however. For what do we mean by ‘progress’? And what constitutes moral progress? Does the idea of individual moral (...) progress presuppose a predetermined end or goal of moral education and development, or not? In this article we analyze the concept of moral progress to shed light on the psychology of moral development and vice versa; these analyses are found to be mutually supportive. We suggest that: moral progress should be conceived of as development that is evaluated positively on the basis of relatively stable moral criteria that are the fruit and the subject of an ongoing conversation; moral progress does not imply the idea of an end-state; individual moral progress is best conceived of as the development of various components of moral functioning and their robust integration in a person’s identity; both children and adults can progress morally - even though we would probably not speak in terms of progress in the case of children - but adults’ moral progress is both more hard-won and to a greater extent a personal project rather than a collective effort. There are deep connections between education and the question of life's meaning, which derive, ultimately, from the fact that, for human beings, how to live—and therefore, how to raise one's children—is not a given but a question. One might see the meaning of life as constitutive of the meaning of education, and answers to the question of life's meaning might be seen as justifying education. Our focus, however, lies on the contributory relation: our primary purpose is to investigate whether and (...) how education might contribute to children's ability to find meaning in life or at least deal with the question. This issue is not only theoretically interesting —it also has practical urgency. For people have a need for meaning that, if unfulfilled, leads to personal and potentially social crises—a need that often expresses itself first and strongly in adolescence; and there are reasons to have doubts about the contribution of today's traditional formal education system to the meaningfulness of children's lives. We argue for the importance of frameworks of values, as well as for a greater emphasis on the affective dimension of meaning, though we reject pure subjectivism. The underlying purpose of this article, however, is not to argue for a particular comprehensive position, but to persuade philosophers of education of the importance of the issue of life's meaning in thinking about education today. Various authors see human flourishing as the overarching aim to which education should contribute. We ask whether fostering _wonder_ can help education attain this aim. We discuss two possibilities: firstly, it may be that having a sense of wonder as adults (possibly fostered by and/or refined due to education) contributes to flourishing itself. Secondly, it may be that fostering wonder in education increases the likelihood that education promotes flourishing, which it might do simply by increasing children’s intrinsic interest in what (...) they learn. We argue that there are many plausible connections between wonder and human flourishing (relating to its epistemic and aesthetic dimensions, among others), and that we have reason to believe that early experiences can influence adults’ capacity for wonder. Furthermore, wonder increases the likelihood that education ‘succeeds’; and it supports people’s ability to live well by heightening their appreciation for the world, helping to uncover baseless beliefs, and increasing their awareness of possible goods. In sum, while having a sense of wonder may not be a constitutive element of human flourishing, it is hard to imagine education for human flourishing that is not also wonder-full education. (shrink)

In this article Doret J. de Ruyter and Anders Schinkel argue that parents' ideals can enhance children's autonomy, but that they may also have a detrimental effect on the development of children's autonomy. After describing the concept of ideals and elucidating a systems theoretical conception of autonomy, de Ruyter and Schinkel explore the ways in which the ideals of parents may play a role in the development of their children's autonomy. They show that abstract and complex ideals of parents (...) (be it ideals for their children, ideals with regard to their parenthood, or their personal ideals) are most likely to enhance their children's autonomy. They also explain that an authoritative parenting style is most conducive to autonomy, although whether or not it does benefit children's autonomy also depends on the types of ideals pursued by parents. BackgroundHealthcare professionals are exposed to advertisements for prescription drugs in medical journals. Such advertisements may increase prescriptions of new drugs at the expense of older treatments even when they have no added benefits, are more harmful, and are more expensive. The publication of medical advertisements therefore raises ethical questions related to editorial integrity.MethodsWe conducted a descriptive cross-sectional study of all medical advertisements published in the Journal of the Danish Medical Association in 2015. Drugs advertised 6 times or more were compared (...) with older comparators: comparative evidence of added benefit; Defined Daily Dose cost; regulatory safety announcements; and completed and ongoing post-marketing studies 3 years after advertising.ResultsWe found 158 medical advertisements for 35 prescription drugs published in 24 issues during 2015, with a median of 7 advertisements per issue. Four drug groups and 5 single drugs were advertised 6 times or more, for a total of 10 indications, and we made 14 comparisons with older treatments. We found: ‘no added benefit’ in 4 of 14 comparisons, ‘uncertain benefits’ in 7, and ‘no evidence’ in 3 comparisons. In no comparison did we find evidence of ‘substantial added benefit’ for the new drug; advertised drugs were 2 to 196 times more expensive per Defined Daily Dose; 11 safety announcements for five advertised drugs were issued compared to one announcement for one comparator drug; 20 post-marketing studies were requested for the advertised drugs versus 10 studies for the comparator drugs, and 7 studies assessed both an advertised and a comparator drug at 3 year follow-up.Conclusions and relevanceIn this cross-sectional study of medical advertisements published in the Journal of the Danish Medical Association during 2015, the most advertised drugs did not have documented substantial added benefits over older treatments, whereas they were substantially more expensive. From January 2021, the Journal of the Danish Medical Association no longer publishes medical advertisements. (shrink)

The era of ‘big data’ studies and computational social science has recently given rise to a number of realignments within and beyond the social sciences, where otherwise distinct data formats – digital, numerical, ethnographic, visual, etc. – rub off and emerge from one another in new ways. This article chronicles the collaboration between a team of anthropologists and sociologists, who worked together for one week in an experimental attempt to combine ‘big’ transactional and ‘small’ ethnographic data formats. Our collaboration is (...) part of a larger cross-disciplinary project carried out at the Danish Technical University, where high-resolution transactional data from smartphones allows for recordings of social networks amongst a freshman class. With a parallel deployment of ethnographic fieldwork among the DTU students, this research set-up raises a number of questions concerning how to assemble disparate ‘data-worlds’ and to what epistemological and political effects? To address these questions, a specific social event – a lively student party – was singled out from the broader DTU dataset. Our experimental collaboration used recordings of Bluetooth signals between students’ phones to visualize the ebb and flow of social intensities at the DTU party, juxtaposing these with ethnographic field-notes on shifting party atmospheres. Tracing and reflecting on the process of combining heterogeneous data, the article offers a concrete case of how a ‘stitching together’ of digital and ethnographic data-worlds might take place. Video games are ideal platforms for the study of skill acquisition for a variety of reasons. However, our understanding of the development of skill and the cognitive representations that support skilled performance can be limited by a focus on game scores. We present an alternative approach to the study of skill acquisition in video games based on the tools of the Expert Performance Approach. Our investigation was motivated by a detailed analysis of the behaviors responsible for the superior performance of (...) one of the highest scoring players of the video game Space Fortress. This analysis revealed how certain behaviors contributed to his exceptional performance. In this study, we recruited a participant for a similar training regimen, but we collected concurrent and retrospective verbal protocol data throughout training. Protocol analysis revealed insights into strategies, errors, mental representations, and shifting game priorities. We argue that these insights into the developing representations that guided skilled performance could only easily have been derived from the tools of the Expert Performance Approach. We propose that the described approach could be applied to understand performance and skill acquisition in many different video games and help reveal mechanisms of transfer from gameplay to other measures of laboratory and real-world performance. Human flourishing is the topic of an increasing number of books and articles in educational philosophy. Flourishing should be regarded as an ideal aim of education. If this is defended, the first step should be to elucidate what is meant by flourishing, and what exactly the concept entails. Listing formal criteria can facilitate reflection on the ideal of flourishing as an aim of education. We took Aristotelian eudaimonia as a prototype to construct two criteria for the concept of human flourishing: (...) human flourishing is regarded as intrinsically worthwhile and flourishing means ‘actualisation of human potential’. The second criterion has three sub-criteria: flourishing is about a whole life, it is a ‘dynamic state’ and flourishing presupposes there being objective goods. (shrink)

Here, we describe the development of a semi‐quantitative high‐content microscopy‐based assay for detection of three major classes (IgG, IgA, and IgM) of SARS‐CoV‐2 specific antibodies in human samples. The possibility to detect antibodies against the entire viral proteome together with a robust semi‐automated image analysis workflow resulted in specific, sensitive and unbiased assay that complements the portfolio of SARS‐CoV‐2 serological assays. Sensitive, specific (...) and quantitative serological assays are urgently needed for a better understanding of humoral immune response against the virus as a basis for developing public health strategies to control viral spread. The procedure described here has been used for clinical studies and provides a general framework for the application of quantitative high‐throughput microscopy to rapidly develop serological assays for emerging virus infections. Perceptual processes differ from cognitive, this paper argues, in functioning to be causally controlled by proximal stimuli, and being modular, at least in a modest sense that excludes their being isotropic in Jerry Fodor's sense. This claim agrees with such theorists as Jacob Beck and Ben Phillips that a function of stimulus-control is needed for perceptual status. In support of this necessity claim, I argue, inter alia, that E.J. Green's recent architectural account misclassifies processes deploying knowledge of grammar as perceptual. (...) _Pace_ Beck and Phillips, however, I argue a function of stimulus-control is insufficient for perceptual as opposed to cognitive status. One consideration in favour of such insufficiency, noted but (I argue) not convincingly rebutted by these theorists, concerns perpetually grounded demonstrative thought. Two other considerations trade on the fact that a function of stimulus-control can arise not from blind nature but intentional design or social institutions, where so-functioning processes may but need not be perceptual. I offer two cases where such processes are cognitive, viz. skilful play-by-play announcing of ongoing events, and voluntary visualizing of ongoing events under the guidance of apt play-by-play announcements, dubbed announcement-driven visualizing (ADV). The cognitive status of these three diverse phenomena cannot be explained by an absence of a perception-like representational format or content (for ADV has such) or by a presence of personal-level mental states causally mediating between stimuli and outputs (for perception has such). A bettter explanation invokes, I argue, the non-modular character of the generating process. (shrink)

The common neurotrophin receptor (p75NTR) regulates various functions in the developing and adult nervous system. Cell survival, cell death, axonal and growth cone retraction, and regulation of the cell cycle can be regulated by p75NTR‐mediated signals following activation by either mature or pro‐neurotrophins and in combination with various co‐receptors, including Trk receptors and sortilin. Here, we review the known functions of p75NTR by cell type, receptor‐ligand combination, and whether regulated intra‐membrane proteolysis of p75NTR is required for signalling. We highlight that (...) the generation of the intracellular domain fragment of p75NTR is associated with many of the receptor functions, regardless of its ligand and co‐receptor interactions. J. L. Austin's claim that language ‘used not seriously’ is ‘parasitic’ upon ‘normal use’ has proved a puzzle to literary scholars, who have often taken this to mean that they are not allowed to apply the insights of speech-act theory to their own object of research. This article explores how, when read together, Michel Serres’ definition of the parasite as a ‘thermal exciter’ and Deleuze's concept of ‘minor literature’ bring out the hidden potential inherent in Austin's claim. More specifically, the (...) article argues that Austin's reference to literature as a parasitic entity might become a promising conceptual gift, allowing us to generate a new model for approaching the world-shaping potential of literary texts. We use a theorem from M. J. Schervish to explore the relationship between accuracy and practical success. If an agent is pragmatically rational, she will quantify the expected loss of her credence with a strictly proper scoring rule. Which scoring rule is right for her will depend on the sorts of decisions she expects to face. We relate this pragmatic conception of inaccuracy to the purely epistemic one popular among epistemic utility theorists.

Dietmar Wetzel unternimmt eine diskurskritisch-vergleichenden Lektüre zweier Theorielinien der neueren Sozialphilosophie: identitäts- versus alteritätsorientierte Konzepte. Das Denken des Ethischen und des Politischen wird dabei anhand einer Beschäftigung mit Schlüsselbegriffen, Konstellationen und Figuren der Gegenwartsgesellschaft thematisch an Gerechtigkeit, Geschlecht, Dritte(m) und Gemeinschaft ausgerichtet. Soziologische Essays, dem Intellektuellen, der Hausfrau, dem Grenzpolizisten und dem Flüchtling gewidmet sind, komplementieren die Analysen. So kann gezeigt werden, daß differenztheoretische Positionen (Lévinas/Derrida) den Begriff der Gerechtigkeit um Aspekte der Fürsorge und der moralischen Gefühle erweitern müssen (Benhabib, (...) Cornell). Da im Übergang der Ich-Anderer-Beziehung zu "ordentlichen Bezügen" das Dritte eine grundlegende Rolle spielt, läßt sich Gemeinschaftsbildung nicht mehr im Sinne natural bzw. religiös begründeter Nachbarschaft (Kommunitarismus), sondern nur als stets neu zu legitimierende und variierende Kultivierung von Andersheit begreifen. Die Reedition der von den Verfassern nunmehr Excerpta Vaticana et Laurentiana genannt wird, findet ihre Begründung darin, dass der Erstherausgeber, der berühmt Rechtshistoriker Contardo Ferrini offenbar auf eine Kollationierung beider Codices verzichtet hat und im Übrigen, aus welchen Gründen auch immer, bei der Edition selbst nicht unwesentliche Versehen verschuldet hat. Der Codex Vaticanus Palatinus ist wohl in der ersten Hälfte des 14. Jahrhunderts entstanden, der Codex Laurentianus 80.6 in der ersten Hälfte des 15. Jahrhunderts. Grundsätzlich sind die Verfasser der Meinung, (...) die mit zahlreichen plausiblen Argumenten vorgetragen wird, dass der Schreiber des Codex Laurentianus 80.6, ein gewisser Stephanus of Medea, als Vorlage den heutigen Codex Vaticanus Gr. 19 vor sich liegen hatte, und als intelligenter Kopist verschiedene Emendationen vorgenommen hat. Eine große Mehrheit der Fragmente der Excerpta Vaticana et Laurentiana von 1–193 muss einem Juristen Anatolius zugeschrieben werden. Jene Person, die sie zusammengestellt hat, muss ein altes Manuskript mit der Summa Codicis des Anatolius verwendet haben. In dieser Summa waren die Termini technici immer noch in lateinischer Sprache verfasst. Zur Selektion der Texte führen die Verfasser an, dass überdurchschnittlich großes Interesse dem Strafrecht und dem Familienrecht gewidmet ist, während etwa Eigentumserwerb, Erbrecht und große Teile des Obligationenrechtes kaum Behandlung finden. Die Exzerpierung der Summa Codicis muss aus diesem Grunde von jemand vorgenommen worden sein, der eine besondere Affinität gerade zu diesen Bereichen des Rechtes hatte. Nach diesen grundsätzlichen und grundlegenden Ausführungen, die ich allesamt nicht nur begrüße, sondern voll mittragen möchte, widmen sich die Verfasser kurz aber prägnant der Person des Anatolius (24–30). Ein Anatolius wird zusammen mit sieben anderen Antecessores in der Constitutio Omne genannt, sowie in der Constitutio Tanta vom 16. Dezember 533 als einer der vier Professoren, denen die Kompilation der Digesten anvertraut worden war. Er bekleidete die Funktion eines Magister Officiorum und wurde aus diesem Grunde als Vir Illustris bezeichnet. Anatolius entstammte einer Juristenfamilie aus Beirut und lehrte dort selbst als Professor. Zachariae von Lingenthal (Griechische Bearbeitung des Codex 70) und Van der Waal (Comentar 111) hatten die Ansicht vertreten, dass es zwei Anatoli gegeben habe: Der eine Mitglied der justinianischen Kompilation, der andere der Autor des Codex-Kommentares. Dem gegenüber vertreten die Autoren die Ansicht, dass Anatolius ein einziger gewesen sei, der, nachdem er maßgeblich an der Kompilation in Konstantinopel mitgearbeitet hatte, etwa zwischen 530 und 533 als Lehrer nach Beirut zurückgekehrt sei, um dort an einer der prestigeträchtigsten Universitäten des Reiches die neue juristische Studienordnung durchzusetzen und ruhmreich zu begründen. Der Kommentar des Codex diente dazu, einen grundsätzlichen lateinischen Text griechischen Studenten zu verdeutlichen, und zwar ausgehend von einer reinen Übersetzung bis zu einem juristischen Kommentar. Die Autoren lösen die Quellenproblematik derart, dass sie davon ausgehen, dass Anatolius das Buch 4 seines Kommentares noch in Konstantinopel vollendet und mit dem 8. Buch des Kommentares in Beirut wieder begonnen hat. Die klare und deutliche Argumentationsweise der Autoren, unpolemisch aber doch tiefgreifend, sollte in Zukunft übernommen werden. (shrink)

Descartes nimmt in Anspruch, daß sein Argument des Deus malignus über die Einwände der Skeptiker hinausgehe. Was fügt es dem Traumargument hinzu? Die verbreitete Ansicht, der Dämon stelle die Erkenntnis mathematischer und logischer Wahrheiten in Frage, wird im folgenden diskutiert und zurückgewiesen. Die richtige Interpretation lautet: Die Annahme des Dämons unterstützt den Skeptizismus und verstärkt die Zweifel an der Existenz äußerer Objekte. Es werden drei Einwände gegen diese Interpretation erörtert und zurückgewiesen. Eine andere Auffassung vertritt Frankfurt: Die Rolle des Traumarguments (...) sei wesentlich begrenzt; die durch den Dämon aufgeworfenen Zweifel seien umfassender. Eine genaue Analyse der Entwicklung des Traumarguments in der Ersten Meditation führt zur Widerlegung dieser Interpretation. (shrink)
