The effectiveness of information retrieval technology in electronic discovery (E-discovery) has become the subject of judicial rulings and practitioner controversy. The scale and nature of E-discovery tasks, however, has pushed traditional information retrieval evaluation approaches to their limits. This paper reviews the legal and operational context of E-discovery and the approaches to evaluating search technology that have evolved in the research community. It then describes a multi-year effort carried out as part of the Text Retrieval Conference to develop evaluation methods (...) for responsive review tasks in E-discovery. This work has led to new approaches to measuring effectiveness in both batch and interactive frameworks, large data sets, and some surprising results for the recall and precision of Boolean and statistical information retrieval methods. The paper concludes by offering some thoughts about future research in both the legal and technical communities toward the goal of reliable, effective use of information retrieval in E-discovery. This book explores the puzzling phenomenon of new veiling practices among lower middle class women in Cairo, Egypt.

Skow ([2007]), and much more recently Callender ([2017]), argue that time can be distinguished from space due to the special role it plays in our laws of nature: our laws determine the behaviour of physical systems across time, but not across space. In this work we assess the claim that the laws of nature might provide the basis for distinguishing time from space. We find that there is an obvious reason to be sceptical of the argument Skow submits for distinguishing (...) time from space: Skow fails to pay sufficient attention to the relationship between the dynamical laws and the antecedent conditions required to establish a complete solution from the laws. Callender’s more sophisticated arguments in favour of distinguishing time from space by virtue of the laws of nature presents a much stronger basis to draw the distinction. By developing a radical reading of Callender’s view we propose a novel approach to differentiating time and space that we call temporal perspectivalism. This is the view according to which the difference between time and space is a function of the agentive perspective. (shrink)

During the past decade ethical theory has been in a lively state of development, and three basic approaches to ethics - Kantian ethics, consequentialism, and virtue ethics - have assumed positions of particular prominence.

In The Methods of Ethics, Sidgwick took seriously egoism, utilitarianism, and commonsense morality. Virtue ethics was treated as part of commonsense morality. Three Methods, reflecting recent tastes, considers Kant, consequentialism, and virtue ethics. Oddly, it does not reflect the major development since Sidgwick—the revival of contractualism.

The emphasis on duly in Kant's ethics is widely held to constitute a defect. Marcia W. Baron develops and assesses the criticism, which she sees as comprising two objections: that duty plays too large a role, leaving no room for the supererogatory, and that Kant places too much value on acting from duty. Clearly written and cogently argued, Kantian Ethics Almost without Apology takes on the most philosophically intriguing objections to Kant's ethics and subjects them to a rigorous yet (...) sympathetic assessment. This paper offers an account of Susan Haack’s philosophy of law and points out several aspects within the legal pragmatist tradition that deserve further discussion. Firstly, a systematic presentation of legal pragmatism as it is defended by Haack, who follows Justice Oliver W. Holmes here, is given. Secondly, the limits of an evolutionary perspective of law recommended by legal pragmatism are considered. Finally, the paper discusses whether legal pragmatism is able to handle different legal traditions, thereby focusing on Anglo-American common (...) law and European civil law. (shrink)

Stanovich & West (S&W) have two goals, one concerned with the evaluation of normative models, the other with development of prescriptive models. Individual differences have no bearing on normative models, which are justified by analysis, not consensus. Individual differences do, however, suggest where it is possible to try to improve human judgments and decisions through education rather than computers.

Between 1906 and 1909 the biologist Ronald Ross and the classicist W.H.S. Jones pioneered interdisciplinary research in biology and history in advancing the claim that malaria had been crucial in the decline of golden-age Greece. The idea had originated with Ross, winner of the Nobel Prize for demonstrating the importance of mosquitoes in the spread of the disease. Jones assembled what, today, we would call an interdisciplinary network of collaborators in the sciences and humanities. But early negative reviews of Jones’s (...) Malaria and Greek History by classicists and historians ended the project, despite a positive reception among malariologists. Today, the “Jones hypothesis” is often used to exemplify the naïvete of past scholarship, and few examine Jones’s evidence and reasoning. In this age of renewed interdisciplinarity, a review of what went wrong is timely. Jones and Ross knew they were opening new methodological territory and struggled with the challenges of multiple ways of knowing. Over 100 years later, malaria remains an important site of historical-biological research, yet integration is elusive. After reviewing the Jones-Ross relationship, Jones’s interdisciplinary campaign, and the reception of the hypothesis among classicists/ancient historians and in malariology, we conclude by highlighting some of the specific challenges faced by those exploring the interface of biology and history. Immanuel Kant’s _Groundwork for the Metaphysics of Morals _is_ _one of the most important texts in the history of ethics. In it Kant searches for the supreme principle of morality and argues for a conception of the moral life that has made this work a continuing source of controversy and an object of reinterpretation for over two centuries. This new edition of Kant’s work provides a fresh translation that is uniquely faithful to the German original and more fully annotated than (...) any previous translation. There are also four essays by well-known scholars that discuss Kant’s views and the philosophical issues raised by the _Groundwork. _J.B. Schneewind defends the continuing interest in Kantian ethics by examining its historical relation both to the ethical thought that preceded it and to its influence on the ethical theories that came after it; Marcia Baron sheds light on Kant’s famous views about moral motivation; and Shelly Kagan and Allen W. In the age of change in the institutional and conceptual setting in which the ancient tradition of Jewish learning would go forward, what we see in the two most important figures of the transitional generation is only the end of the old, not the beginning of the new. Saul Lieberman continued the received tradition that learning means exegesis of texts, but did not fully master the logic of that received tradition and so distorted it. Salo W. Baron undertook (...) a new intellectual tradition, one that pursued historical study in place of the exegesis of texts, but did. not really grasp the requirements of the kind of new history that he proposed to write. Announcing the advent of social history into the academy of Jewish learning, what he wrote as the economic part of that social history was merely the paraphrase of received texts, with glosses that look suspiciously like a kind of free-associative exegesis. While the one scholar demonstrated the decadence of an old tradition of learning, the other succeeded in showing only the difficulty of actually mastering the discourse of an entirely new academic world.
