Cet article questionne la fabrique de la décision pénale en temps de guerre et en situation d’annexion. Il s’appuie sur les jugements pour homosexualité rendus par le tribunal de Strasbourg entre 1942 et 1945. Les données statistiques recueillies permettent d’établir que les Alsaciens jugés durant cette période sont majoritairement jeunes et appartiennent aux classes populaires. Ils sont condamnés pour la plupart à de lourdes peines de prison pouvant aller jusqu’à la perpétuité et cela « dans l’intérêt de la (...) préservation du peuple ». Effet arbitraire de l’« annexion sexuelle », certains sont poursuivis pour des faits antérieurs à l’introduction du droit pénal allemand en Alsace, d’autres immédiatement internés en camp au lendemain de leur libération. Mais plus que simplement des actes, ce sont des identités déviantes qui sont jugées. D’une part au moyen d’une comptabilité des orgasmes qui serait but et preuve d’une activité sexuelle « anormale » ; d’autre part en établissant une hiérarchie des masculinités déviantes qui tend à faire exister le criminel avant le crime. Using ethnographic data gathered at a mandated, community-based drug treatment program for women offenders, this article analyzes how gendered notions of the self and of autonomy shape penal governance. This study examines how psychological models of women's deviance, racialized visions of motherhood, and therapeutic techniques of the self come into tension with expectations of responsible, autonomous citizenship. The program prioritized therapeutic ways of governing its clients over those that emphasized economic self-reliance, rational decision making, and normalizing gender. This is because (...) staff attributed criminal and addictive behaviors to women's inadequate self-understanding and lack of emotional autonomy in personal relations. Staff discouraged women's motherhood and paid labor because they saw these external obligations as a threat to women's autonomous selfhood. This research complicates claims that contemporary forms of penal treatment manage offenders through rational incentives and personal responsibility by pointing to the ways that subject formation is a gendered process. Foucault prononce en 1981 un cours qui marque une inflexion décisive dans son chemin de pensée et le projet ébauché dès 1976 d'une Histoire de la sexualité. C'est le moment où les arts de vivre deviennent le foyer de sens à partir duquel pourra se déployer une pensée neuve de la subjectivité. C'est le moment aussi où Foucault problématise une conception de l'éthique comprise comme l'élaboration patiente d'un rapport de soi à soi. L'étude de l'expérience sexuelle des Anciens permet ces (...) nouveaux déploiements conceptuels. Dans ce cadre, Foucault analyse des écrits médicaux, des traités sur le mariage, la philosophie de l'amour ou la valeur pronostique des rêves érotiques, afin d'y retrouver le témoignage d'une structuration du sujet dans son rapport aux plaisirs (aphrodisia) antérieure à la construction moderne d'une science de la sexualité, antérieure à la hantise chrétienne de la chair. L'enjeu est en effet d'établir que l'imposition d'une scrupuleuse et interminable herméneutique du désir constitue l'invention du christianisme. Mais pour cela, il importait de ressaisir la spécificité irréductible des techniques de soi antiques. Dans cette série de leçons, qui annoncent clairement L'Usage des plaisirs et Le Souci de soi, Foucault interroge particulièrement le primat grec de l'opposition actif/passif sur les distinctions de genre, ainsi que l'élaboration par le stoïcisme impérial d'un modèle de lien conjugal prônant une fidélité sans faille, un partage des sentiments, et conduisant à la disqualification de l'homosexualité. In these lectures Michel Foucault presents for the first time his approach to the question of power that will be the focus of his research up to the writing of Discipline and Punish and beyond. His analysis starts with a detailed account of Richelieu’s repression of the Nu-pieds revolt and then goes on to show how the apparatus of power developed by the monarchy on this occasion breaks with the system of juridical and judicial institutions of the Middle Ages and opens out onto a “judicial State apparatus”, a “repressive system”, whose function is focused on the confinement of those who challenge its order. Michel Foucault systemizes the approach of a history of truth on the basis of the study of “juridico-political matrices” that he had begun in the previous year’s lectures and which is at the heart of the notion of “knowledge-power”. In these lectures Foucault develops his theory of justice and penal law. The appearance of this volume marks the end of the publication of the series Foucault’s courses at the Collège de France. Automated decision making for sentencing is the use of a software algorithm to analyse a convicted offender’s case and deliver a sentence. This chapter reviews the moral arguments for and against employing automated decision making for sentencing and finds that its use is in principle morally permissible. Specifically, it argues that well-designed automated decision making for sentencing will better approximate the just sentence than human sentencers. Moreover, it dismisses common concerns about transparency, privacy and bias as unpersuasive or inapplicable. The (...) chapter also notes that moral disagreement about theories of just sentencing are plausibly resolved by applying the principle of maximising expected moral choiceworthiness, and that automated decision making is better suited to the resulting ensemble model. Finally, the chapter considers the challenge posed by penal populism. The dispiriting conclusion is that although it is in theory morally desirable to use automated decision-making for criminal sentencing, it may well be the case that we ought not to try. (shrink)

Constructive deviance, rule-breaking to benefit the organization, is an emerging topic in the scholarly research and is considered to be an ethical decision. Despite the value of guiding constructive deviance in organizations, the effect of ethics-oriented leadership on employees’ constructive deviance remains unclear. This research identifies leader moral humility as a new antecedent of constructive deviance and examines how and when leader moral humility influences employee constructive deviance. Drawing on social–cognitive theory, we propose that leader moral humility fosters employee moral (...) identity, which in turn triggers employees to exhibit constructive deviance. Moreover, the mediating effect of moral identity is more pronounced when normative conflict with organizational rules is high, as this conflict inspires identity-driven behavior. Two studies with scenario-based experimental and time-lagged field methods provided general support for our hypotheses. Study 1 reveals that leader moral humility positively affects constructive deviance via employee moral identity. Study 2 replicates and extends Study 1 to support the moderating role of normative conflict. These findings enrich the understanding of constructive deviance by shedding light on the moral cognitive process in the relationship between leader moral humility and employee constructive deviance and by identifying the boundary condition for the relationship. La phénoménologie de la vie développée par Michel Henry a revêtu ultimement l’aspect d’une phénoménologie de la chair et celui d’une phénoménologie de l’incarnation, toutes deux entées sur les intuitions décisives du christianisme. En premier lieu, l’article montre que si la phénoménologie de la chair s’édifie sans référence explicite à la différence sexuelle, comme si être une chair dispensait quelqu’un d’être un homme ou une femme, il en va tout autrement pour la phénoménologie de l’incarnation dans laquelle la découverte de (...) la différence sexuelle et celle de son rapport à l’angoisse occupent une place centrale. En deuxième lieu, l’article montre qu’être un homme ou une femme signifie autre chose qu’être une chair car leur irruption dans la phénoménologie de la vie a pour effet d’en brouiller les termes. Cet article montre que les discours qui rendent compte de l’usage sexuel des psychoactifs révèlent tout autant les règles sociales dominantes qui assignent à chaque sexe un code de conduite spécifique dans l’acte sexuel que l’idéologie normative en vigueur dans un sous-groupe particulier. L’analyse, centrée sur l’usage de psychoactifs associé à la pénétration anale entre hommes, s’appuie sur cinquante entretiens ouverts et semi-directifs avec des usagers de psychoactifs s’identifiant comme gay et des informateurs clés, dans le cadre de l’enquête ethnographique (...) Homosexualité masculine et usage de substances psychoactives en contextes festifs gais. On voit dans ce contexte, comment la consommation de psychoactifs, par ses effets attendus sur les inhibitions sexuelles, “autorise” l’actualisation de fantasmes ou de pratiques contrevenant aux prescriptions sociales en matière de genre ou de sexualité, et permet de répondre à l’injonction de performance valorisée dans ce sous-groupe. Diane Vaughan’s popular book, The Challenger Launch Decision: Risky Technology, Culture and Deviance at NASA, advances a thesis that I termed the “cog in the machine manifesto”: since the Challenger disaster was the result of the determined, mechanistic movement of the parts of the organizational system; once the mechanism was set in motion, the disaster was inevitable, and could not have been prevented. In order to expose the fallacies of the cog in the machine manifesto, I consider an alternative umbrella (...) thesis and four sub-theses. The umbrella thesis proposes that the causes of the Challenger disaster were the lack of an overall 'safety first' ethos, and irresponsible choice and poor decision-making practices in the lead up to and including the final risky decision. The four sub-theses are as follows: (1) the widespread justification that one always faces inherent risk when one operates in the realm of risky technology (a thesis foreshadowed by Vaughan’s book) is an illicit and misleading justification when one considers that there is no binding necessity to employ the risky technology; (2) the real culprit is not so much "risky technology," which locates the risk in the technology, but "risky assessment," which locates the risk in the decision to employ technology while not basing that decision on known safe designs and continued use on performance data; (3) the decision to choose an Orbiter without a passenger and crew abort system is proof in and of itself of a lack of a "safety first" management priority; (4) an analysis of the fateful eve of the Challenger launch teleconference launch decision makes it impossible to construe it as a banal, routine and inevitable organizational mistake. A careful examination of the “cog in the machine manifesto” and similar frameworks that purport to explain moral disasters will reveal that the language of risky technology, organizational complexity, and inevitable accidents is deeply pernicious and should thus be avoided at all costs. Definition of the problemFrom an ethical point of view we analyse the ruling of the German Federal Joint Committee (Gemeinsamer Bundesausschuss, G‑BA) of September 2019 to revise the guidelines about the coverage of noninvasive prenatal tests (NIPT) by mandatory health insurance, in order to include them under specified conditions. The decision contains four essential elements: a definition of the aim of NIPT testing (to avoid invasive testing), a criterion of access (test must be “necessary” for the pregnant woman to tackle (...) her individual situation), statements about the process of decision-making (after counselling by a physician and case by case) and a normative contextualization (termination of pregnancy under § 218 a German penal law) which is to be found in its explanations. There are tensions in the proposed model that oscillate about two axes: (1) The suffering that results from a possible birth of a child with trisomy or from not knowing about the genetic condition of the fetus can ultimately only be evaluated subjectively, from the perspective of the pregnant woman. (2) The meaning of an individual decision in the case-by-case model remains unclear because when judging about individual cases general points of view also need to be considered. However, we argue that the model of the G‑BA could be a sociopolitically and ultimately also ethically defensible pragmatic solution, exactly because of its paradoxes and its inherent flexibility. Although risky decision-making has been posited to contribute to the maladaptive behavior of individuals with psychopathic tendencies, the performance of psychopathic groups on a common task of risky decision-making, the Iowa Gambling Task (IGT; Bechara, Damasio, Damasio, & Anderson, 1994), has been equivocal. Different aspects of psychopathy (personality traits, antisocial deviance) and/or moderating variables may help to explain these inconsistent findings. In a sample of college students (N = 129, age 18–27), we examined the relationship between primary and secondary psychopathic (...) features and IGT performance. A measure of impulsivity was included to investigate its potential as a moderator. In a joint model including main effects and interactions between primary psychopathy, secondary psychopathy and impulsivity, only secondary psychopathy was significantly related to risky IGT performance, and this effect was not moderated by the other variables. This finding supports the growing literature suggesting that secondary psychopathy is a better predictor of decision-making problems than the primary psychopathic personality traits of lack of empathy and remorselessness. Can parents who choose not to vaccinate their children be held legally liable for any harm that results? The state of laboratory and epidemiological understanding of a disease such as measles makes it likely that a persuasive causal link can be established between a decision to not vaccinate, a failure to take appropriate precautions to isolate a non-vaccinated child who may have been exposed to measles from highly vulnerable persons, and a death. This paper argues that, even if a parent (...) chooses to not vaccinate a child under a state law permitting exemptions, that decision does not create complete protection against liability for the adverse consequences of that choice. Les deux auteures présentent une réflexion à plusieurs dimensions, composée d’analyses et de pratiques poétiques, sur la vocation et le travail de l’avocate pénaliste confrontée ici, d’une part, aux individuations extrêmes engendrées et révélées par les crimes sexuels et leurs sanctions, y compris capitales, et, d’autre part, aux déterminants globaux d’une culture collective du viol qui résiste et tend à perdurer, malgré les dénonciations et les démonstrations.

Fruit de l’avènement des statistiques et de l’intelligence artificielle, la justice prédictive est porteuse de nombreuses promesses de nature économique, technologique et même sociologique. Loin d’être une menace, le recours aux algorithmes donnerait la possibilité de prédire des décisions à venir dans des litiges similaires à ceux analysés. Si l’essentiel de la littérature sur la question concerne le contentieux civil, le sujet mérite d’être examiné en matière pénale au regard des principes qui gouvernent le droit pénal et la procédure pénale.

Twenty-four U.S. states have enacted HIV exposure laws that prohibit HIV-positive persons from engaging in sexual activities with partners to whom they have not disclosed their HIV status. There is little standardization among existing HIV exposure laws, which vary substantially with respect to the sexual activities that are prohibited without prior serostatus disclosure. Logical analysis and mathematical modeling were used to explore the HIV prevention effectiveness of two types of HIV exposure laws: “strict” laws that require HIV-positive persons to disclose (...) their serostatus to prospective partners prior to any sexual activity and “flexible” laws that require seropositive status disclosure only prior to high-risk sex . These laws were compared relative to each other and to a no-law alternative. The results of these analyses indicate that, under most circumstances, both strict and flexible exposure laws can be expected to reduce HIV transmission risk relative to the no-law alternative, with flexible exposure laws producing the greater reduction in risk. This study demonstrates how logical analysis and mathematical modeling techniques can make an important contribution to the construction of a rational basis for decisions about a highly contested public health policy issue. Cette étude analyse la pensée actuelle sur les décisions-fin-de-vie (DfdV) en France d’un point de vue hollandais. Un nombre limité d’interviews avec des ‘opinion-leaders’ français est pris comme base du project. Jusqu’au jour présent, le domaine des DfdV en France a été troublé en l’absence de définitions et de législation plus spécifiques. Les médecins français pourront faire face à un dilemme en soignant un malade mourant, pris en étau entre le caractère illégal officiel de l’euthanasie d’une part et l’obligation professionnelle (...) de traiter chaque cas de façon particulière d’autre part. La conséquence de l’environnement réglementaire incertain est une déresponsabilisation des médecins français vis-à-vis de leurs collègues et des patients. L’adoption de réformes législatives, en ayant la possibilité d’augmenter le nombre de cas d’euthanasie, se heurtait en France à des arguments cartésiens, paternalistes et religieux. En Novembre 2004, l’Assemblée Nationale a adopté une proposition de loi ayant pour but de rendre plus transparente la mise en pratique des limitations et des arrêts de traitement et de reduire la crainte des médecins de poursuites pénales. Cette proposition de loi a été par la suite approuvée par le Sénat. Aux Pays-Bas, l’euthanasie–la terminaison active de la vie–est légale et régulée par des critères précis. L’approche hollandaise fait référence au concept anglo-saxon d’autonomie du patient et correspond à la préférence générale de la société hollandaise pour la révélation et la régulation des activités controversielles plutôt que de tolérer leur existence sub rosa. Depuis l’entrée en vigueur de la régulation sur l’euthanasie aux Pays-Bas le nombre de cas rapportés a augmenté, mais pas le nombre d’euthanasies. Les règles sont respectées et la qualité de la communication entre médecin et patient est élevée. La vigilance Française pour l’autonomie professionnelle offre un exemple de valeur pour les Hollandais. Les Hollandais, de leur part, fournissent des exemples concrets pour la régulation du domaine des DfdV en France dont on a fait un début récemment. (shrink)

Dans le débat sur la nature du national-socialisme entre « fracture de la civilisation » et expression de « l’ambiguïté essentielle de la modernité », cet article étudie la radicalisation progressive du discours sur les « asociaux » dans les dernières années de Weimar et examine si l’on y trouve déjà la préparation idéologique et pratique de la politique d’extermination des nazis (euthanasie, stérilisation forcée, « mort par le travail »). Le biologisme, l’économisme, la criminologie et l’eugénisme ou « hygiène (...) raciale » apparaissent comme les racines du discours sur les asociaux sous Weimar. On voit que des auteurs parlaient déjà, dans les années vingt, d’« éliminer les vies ne méritant pas d’être vécues » et préconisaient la stérilisation, l’avortement et l’euthanasie dans certains cas. S’appuyant sur l’exemple de mesures pratiques et de discussions sur l’internement d’« asociaux », l’auteur montre que les idées eugénistes étaient répandues non seulement chez les hommes politiques de droite, mais aussi largement à gauche. L’évolution de l’État social sous Weimar, de ses débuts prometteurs jusqu’à la crise de sa fin, est d’abord rapidement esquissée ; puis l’auteur étudie en détail la montée de l’agressivité dans les années de crise, où l’on voit les cercles chargés de l’assistance prendre de moins en moins l’individu et de plus en plus la Volksgemeinschaft comme référence de leur action. Avec une fréquence croissante est avancée l’idée de réserver les prestations sociales à ceux qui les « mériteraient » et que la société n’aurait plus d’argent pour entretenir des « poids morts ». Ainsi cette étude montre-t-elle que la question de la continuité entre Weimar et le nazisme ne peut, dans ce domaine, être globalement affirmée ou infirmée et qu’au contraire seule l’étude attentive des projets de loi, des institutions et des biographies permet d’identifier des continuités. In this short essay the author deals with the fundamental question of whether the Inference to the Best Explanation (IBE) model has sufficient grounds to be considered as a substitute of the current criminal standard of proof (proof Beyond All Reasonable Doubt). Why is the ethics of punishment an important academic field? The standard answer given by philosophers, legal scholars, and other theorists is that academic engagement in the ethics of punishment is justified by the importance of informing and guiding penal practice. In this article, this view is referred to as the Impact Assumption. The purpose of the article is to consider what this assumption implies for the way research within this field should be conducted. First, I argue that the way (...) research is currently being disseminated, the nature of the research itself, and the lack of interest among legislators and other decision-makers, constitute serious challenges to the satisfaction of the Impact Assumption. Second, I suggest that these challenges can be overcome, but that this will require a significant expansion and reorientation of the entire field. (shrink)

This chapter will discuss ethical issues connected with neuroscientific research on prisoners, focusing specifically on whether participating in such research should always be disregarded when making decisions about early release from prison. It was once routine in some jurisdictions for a prisoner’s participation in medical research to count as “good behaviour”, which could be given weight in decisions about early release. However, medical ethicists now widely regard this practice as ethically problematic, because prisoners might feel pressurised to participate in medical (...) research programmes by the desire to escape a coercive and harsh prison environment, and thus their agreement to take part in the programme might not satisfy the freedom requirement for valid consent. Yet, there may be a tension between traditional medical ethics and theories of punishment (a tension which also arises in other contexts at the interface between medicine and punishment). From the perspective of retributive or communication/reform-based theories of punishment, it might seem unfair for parole boards to disregard willingness to participate in medical research, if the prisoner were motivated by altruistic considerations. This altruism might indicate that the prisoner “deserves” a shorter sentence or may be a sign that the prisoner has reformed. This chapter will consider whether/how this tension between traditional medical ethics and penal theories can be resolved. For example, if the medical research involves relatively safe interventions such as fish oil pills or transcranial direct current stimulation (tDCS), then the above-mentioned worries about prisoners’ ability to provide free consent may be less pressing than if the risks of side-effects were greater. Furthermore, the validity of consent also seems to depend partly on whether the prison conditions are humane or excessively harsh. In addition, problems also arise in this context from within penal theories. Ironically, transparency about what factors will be taken into account in decisions about early release, which would presumably be encouraged by communication/reform theories, could raise the possibility that the prisoner was motivated to participate in the research programme by a desire for early release rather than altruism, thus making it harder to determine whether participation is a genuine sign of reform. The first article of the cycle “The role of skeptical evidence in the First and Second ‘Meditations’” compares the Cartesian and Sextus Empiricus’ concepts of doubt in, respectively, “Metaphysical meditations” and “Outlines of Pyrrhonism”. The article starts with the current state of the problem “Descartes and skepticism” and admits the existence of consensus about Cartesian perception of skeptical tradition: Cartesius was influenced by all skeptical movements, known in his time, and created a generalized notion that contains elements of both Academic (...) and Pyrrhonian origin. This consensus is the source of many contemporary studies on how different skeptical doctrines influenced certain parts of Cartesian philosophy. This article attempts to analyze possible Descartes’ use of Sextus Empiricus’ notion of phenomenon. Sextus clearly states in “Outlines of Pyrrhonism” that one cannot doubt phenomenon as something perceived directly. The article proves that Sextus’ thesis about the “sensory” nature of phenomenon is metaphorical, so far as it includes both sensuality and the experience of thinking; the phenomenon is realized through a wide range of passive states of mind that all have irresistible force of influence; the impact of phenomena is always mediated by our self, because all skeptical phrases are strictly correlated with the first person singular. Some researchers distinguish Sextus’ isostenia, as one of such insurmountable states, from Cartesian doubt at the First Meditation, which is allegedly based on a purely volitional decision. The article proved that this argument is artificial, since Descartes’ volitional decision is caused by initial inability to take the dubious as if it were certain. Thus, Cartesian approach can be considered a specific kind of isostenia. Such parallelism is a reason to assume a key role of Sextus’ understanding of insurmountable power of phenomena in Cartesian anti-sceptical argumentation. The translator of the first Ukrainian version of Plato’s Cratylus indicates the difficulties in translating the dialogue, emphasizing the external and internal aspects of those difficulties. The external aspect consists in the different etymology of Greek and Ukrainian words, and the internal one lays in the problem of choice between “Latinization” and “Ukrainization” of the translated text. The author made one of his translation principles to avoid excessive Latinization and justifies his decision.

The paper aims to prove the hypothesis that Sextus Empiricus’ Neo-Pyrrhonism is significantly influenced by the Cartesian meditation as a genre of philosophizing. It refutes theses about the non-predicativity of Sextus’ language and about Sextus’ epochê as an automatic result of the action of opposite things or statements, and it argues that both Sextus and Descartes distinguish between internal agreement with clarity and the personal acceptance of this agreement which depends on a volitional decision. Sextus’ recognition of the clarity of (...) appearance as appearance gives Descartes the only chance to refute the skepticism of Sextus, which is invulnerable to external criticism. Therefore, Descartes developed meditation as a special model of purely immanent criticism, focused on dealing with states of clarity and evidence. The author’s hypothesis is that the key elements to which this model appeals are the “history of a skeptic” set out in Outlines of Pyrrhonism and the conception of skeptical expressions. This hypothesis can be tested further by proving or disproving the thesis that the discourse of I, II, and at least partially of III Meditations is based on the pattern of skeptical expressions, focused on the internal states of the speaker, and not on clarifying the “objective” state of affairs. Phronesis is essential for good decision‐making and actions. This literature review shows how phronesis has been discussed and related to elements of the field of administration and organizations. A search in the database systems Scopus, EBSCO, Web of Science, and Scielo, based on eligibility criteria, resulted in 43 theoretical and 14 empirical works. The analysis of these studies showed the most significant empirical contributions, the most cited authors, methods, journals, and central themes addressed in studies on phronesis to understand ethics (...) in business. From a virtue ethics perspective, we discuss the major theoretical and empirical contributions, as well as the implications of a restricted understanding of phronesis when it is treated apart from other elements of the virtue ethics framework. We present a synthesis of the concepts of phronesis, based on dimensions of magnitude and amplitude of the conceptions, ranging from formal to substantive phronesis, and covering individual, organizational, or societal levels of analysis. We argue that a substantive conception of phronesis within virtue ethics may improve our understanding of ethics because it assumes the interdependence of phronesis and moral virtues, integral anthropology, and the common good. We present a future research agenda, considering the study's limitations and findings. (shrink)

The article describes the founding principles, work program, and accomplishments of a Reference Group with both expert and layperson stakeholders for the corrosion of copper canisters in a proposed deep repository in Sweden for spent nuclear fuel. The article sets the Reference Group as a participatory effort within a broader context of stakeholder and public participation. It is argued that for the future it will be necessary to more precisely define the roles of different approaches to public participation in relation (...) to the actual societal decision-making procedures, and the issue is raised whether an increasing level of their institutionalization is required. In particular, the focus is set on the safe-space approach to stakeholder participation designed to suit situations where independence and autonomy are crucial elements for the participants. Calvin's three foci here, trinitarian in intent, are Christologically informed. Comprising teleological, deontological, and contextual vectors for ethical consideration, they are to (...) work together as orientational constants—a kind of global positioning system—functioning as faith's response to the triune God. This eschatology becomes a key to puzzles in Calvin's ethics: such as why he is reluctant to prescribe patterns of conduct; why he gives such prominence to Christians' freedom; or again, how his world-weary expressions cohere with his astounding activism. A recent qualitative study published in Neuroethics by Schembs and colleagues explores how functional neurodiagnostics of consciousness inform surrogate decision making in cases of disorders of consciousness. In this commentary, we argue that the chosen methodology significantly limits the scope of the potential conclusions and suggest an embedded ethnographic approach of co-presence as an alternative.

On Choice of Time Metric. What criteria ought to be satisfied by those observable processes which, accompanied by a function assigning values to intervals of that processes, serve as the standard for measurement of time? In how far do the criteria which can reasonably be established admit of an unambigous definition of time metric? That are the questions to which I have addressed myself in the paper. Peter Janich has aimed at solving the problem with careful avoidance of any reference (...) to physical theory. Although this paper owes a great deal to his ‘Protophysik der Zeit’, reasons will be ad-vanced that it is in principle impossible to give a foundation of time metric without any reference to physical theory. It follows that taking results of physical theory into account is unavoidable as far as a definite decision concerning the choice of time metric is aspired. At first sight reference to law-like assertions on the duration of temporal intervals appears to be paradoxical for it means to take something which originally ought to be submitted to experimental test as the standard for measurement. Poincaré is fairly conscious of this problem, yet explicitly acknowledges that there is a mutual relationship between definition of time metric and physical theory. It will be shown that this kind of mutual relationship which even might be termed as circular does not void physical theory of empirical content. Thus in the final part I am concerned to free the position which recommends reference to physical theory from its paradoxical image in order to advance a conventionalist account as a sceptical, but nevertheless fully satisfying solution. There are several ontological and consequently also methodological mistakes in contemporary mainstream economics. Among them, the so-called ergodic axiom is play significant role. It is understandable that the real economy elaborated as formalized mental model looks like dynamic system on first sight. However, that is right only of dynamical systems in mathematical formalism. Economy that is in our understanding societal and/or collective economy is complex evolving organism. If we imagine such organism in the form of dynamical system that is as (...) clear mathematical formalism, we are losing their crucial authentic character. The significant irredeemable attribute of societal economy is lying in his complex evolving network process character created by large population of people with different decision-making and complex realizing among them. Going from these imaginations the two entities in a question that is dynamical system with their ergodicity and societal economic organism as complex evolving network are qualitative very different ones. That is the reason why we cannot accede with endeavours to draw on living economy straitjacket of ergodic axiom. To articulate that cause by other words ergodic dynamical systems are applicable for physical and partly for chemical entities and only scarcely are fit for living organisms. On the other hand however, as clear method the ergodic dynamical system have good applying for didactical approaches in economics where helping in better understanding some types of complexities in dynamics. The purpose of that essay is to discuss problems around usability of ergodic dynamical system theory and methods in economics in the age of advanced ICT knowledge based society. (shrink)

BackgroundSuicide research aims to contribute to a better understanding of suicidal behaviour and its prevention. However, there are many ethical challenges in this research field, for example, regarding consent and potential risks to participants. While studies to-date have focused on the perspective of the researchers, this study aimed to investigate the views and experiences of members of Human Research Ethics Committees (HRECs) in dealing with suicide-related study applications.MethodsThis qualitative study entailed a thematic analysis using an inductive approach. We conducted semi-structured (...) interviews with a purposive sample (N = 15) of HREC Chairs or their delegates from Australian research-intensive universities. The interview guide included questions regarding the ethical concerns and challenges in suicide-related research raised by HREC members, how they dealt with those challenges and what advice they could give to researchers.ResultsThe analysis identified four main themes: (1) HREC members’ experiences of reviewing suicide-related study applications, (2) HREC members’ perceptions of suicide, suicide research, and study participants, (3) Complexity in HREC members’ decision-making processes, and (4) HREC members’ relationships with researchers.ConclusionsReliance on ethical guidelines and dialogue with researchers are crucial in the assessment of suicide-related study applications. Both researchers and HREC members may benefit from guidance and resources on how to conduct ethically sound suicide-related studies. Developing working relationships will be likely to help HRECs to facilitate high quality, ethical suicide-related research and researchers to conduct such research. (shrink)

A patient is diagnosed with the persistent vegetative state (PVS) when they show no evidence of the awareness of the self or the environment for an extended period of time. The chance of recovery of any mental function or the ability to interact in a meaningful way is low. Though rare, the condition, considering its nature as a state outwith the realm of the conscious, coupled with the trauma experienced by the patient's kin as well as health care staff confronted (...) with painful decisions regarding the patient's care, has attracted a considerable amount of discussion within the bioethics community. At present, there is a wealth of literature that discusses the relevant neurology, that elucidates the plethora of ethical challenges in understanding and dealing with the condition, and that analyses the real-world cases which have prominently featured in the mainstream media as a result of emotionally charged, divergent views concerning the provision of care to the patient. However, there is scarcely anything in the published scholarly literature that proposes concrete and practically actionable solutions to the now widely recognized moral conundrums. The present article describes a step in that direction. I start from the very foundations, laying out a sentientist approach which serves as the basis for the consequent moral decision-making, and then proceed to systematically identify and deconstruct the different cases of discord, using the aforementioned foundations as the basis for their resolution. A major intellectual contribution concerns the fluidity of the duty of care which I argue is demanded by the sentientist focus. The said duty is shown initially to have for its object the patient, which depending on the circumstances, can change to the patient's kin, or the health care staff themselves. In conclusion, the proposed framework represents the first comprehensive proposal regarding the decision-making processes involved in the deliberation on the provision of life sustaining treatment to a patient in a PVS. Carlos Alchourrón, Peter Gärdenfors and David Makinson published in 1985 a seminal article on belief change in the Journal of Symbolic Logic. Researchers from various disciplines, from computer science to mathematical economics to philosophical logic, have continued the work first presented in this seminal paper during the last two decades. This paper explores some salient foundational trends that interpret the act of changing view as a decision. We will argue that some of these foundational trends are already present, although only (...) tacitly, in the original article by the AGM trio. Other accounts decidedly depart from the view of contraction and revision presented in this seminal paper. I shall survey various types of theories that progressively depart form the axiomatic treatment defended by AGM. First, I consider theories where rational agents are considered as maximizers as opposed to optimizers ). Second, I consider which feasible set to use in contraction understood as a cognitive decision. This leads to rethink the very notion of what minimal change in contraction is. I shall conclude with some philosophical reflections concerning the sort of epistemological voluntarism that is tacit in seeing change in view as a rational choice. Este trabajo explora algunos aspectos fundacionalmente salientes que interpretan el acto de cambio de vista como una decisión. Argumentaremos que algunos de esos aspectos fundacionales ya estaban presentes, aunque solo tácitamente, en el artículo original del trío AGM. Otros abordajes parten decididamente de la contracción y revisión tal como fueran presentadas en el trabajo seminal. Inspeccionaré varios tipos de teorías que progresivamente parten del tratamiento axiomático defendido por AGM. Primero, considero teorías donde los agentes racionales aparecen como maximizadres opuestos a los optimiadores ). Segundo, me pregunto cuál conjunto derrotable debe usarse en una contracción entendida como una decisión cognitiva, lo cual lleva a repensar la importante cuestión de en qué consiste la noción de cambio mínimo en la contracción. Concluiré con algunas reflexiones filosóficas acerca de la suerte de voluntarismo epistemológico que está tácito en la concepción del cambio como una opción racional. (shrink)

Normative accounts in terms of similarity can be deployed in order to provide semantics for systems of context-free default rules and other sophisticated conditionals. In contrast, procedural accounts of decision in terms of similarity (Rubinstein 1997) are hard to reconcile with the normative rules of rationality used in decision-making, even when suitably weakened.

In this article the paradoxical role of legal science in legal practice is discussed. On the one hand, legal scientists do not agree on the criterions of the scientific character of legal science. On the other hand, even in the legal cases that are especially complicated it is possible to arrive at theoretically unquestionable decisions. The author of the article concludes that legal practice is based on fundamental theoretical insights; however, in legal practice these insights are used more intuitively than (...) reflectively. Therefore, the aim of the article is to rationally reconstruct these theoretical insights with reference to the ideas of modern schools of legal philosophy. For this purpose the ideas of the theory of natural law are discussed. It is concluded that in legal practice two provisions of natural law are applied: legal decisions ought to be reasonable and must include existential ends (basic values). The evolution of the legal positivism is discussed in the article and it is concluded that legal positivism offers the criterions of the scientific character of legal science by framing the procedural rules of the democratic process of lawmaking. These rules anticipate such conditions: consensus concerning decision making; equal participation of all members of legal discourse confirming normative decisions; the acceptability of consequences after the realisation of normative decisions; the possibility to reaffirm normative decisions, if necessary. The ideas of virtue jurisprudence are discussed and it is claimed that virtue jurisprudence as a criterion of the scientific character of law proposes such theoretical position: the decisions concerning human rights must supply the value system (hierarchy) and the virtues which are formed and justified in the long legal tradition. The article represents the use of these criterions of the scientific character of legal science by Jurgen Habermas to debate about legal prohibition of the improvement of the human genome by using modern technologies of genome engineering in the Convention of Human Rights and Biomedicine (Oviedo, 1997).
