This book provides a systematic analysis of many common argumentation schemes and a compendium of 96 schemes. The study of these schemes, or forms of argument that capture stereotypical patterns of human reasoning, is at the core of argumentation research. In Biro and Siegel we argued that a theory of argumentation mustfully engage the normativity of judgments about arguments, and we developedsuch a theory. In this paper we further develop and defend our theory.

According to the Bayesian paradigm in the psychology of reasoning, the norms by which everyday human cognition is best evaluated are probabilistic rather than logical in character. Recently, the Bayesian paradigm has been applied to the domain of argumentation, where the fundamental norms are traditionally assumed to be logical. Here, we present a major generalisation of extant Bayesian approaches to argumentation that utilizes a new class of Bayesian learning methods that are better suited to modelling dynamic and conditional (...) inferences than standard Bayesian conditionalization, is able to characterise the special value of logically valid argument schemes in uncertain reasoning contexts, greatly extends the range of inferences and argumentative phenomena that can be adequately described in a Bayesian framework, and undermines some influential theoretical motivations for dual function models of human cognition. We conclude that the probabilistic norms given by the Bayesian approach to rationality are not necessarily at odds with the norms given by classical logic. Rather, the Bayesian theory of argumentation can be seen as justifying and enriching the argumentative norms of classical logic. (shrink)

Philosophy’s adversarial argumentation style is often noted as a factor contributing to the low numbers of women in philosophy. I argue that there is a level of adversariality peculiar to philosophy that merits specific feminist examination, yet doesn’t assume controversial gender differences claims. The dominance of the argument-as-war metaphor is not warranted, since this metaphor misconstrues the epistemic role of good argument as a tool of rational persuasion. This metaphor is entangled with the persisting narrative of embattled reason, which, (...) in turn, is linked to the sexism-informed narrative of the “man of reason” continually warding off or battling “feminine” unreason. Use of argumentation methods applied to legal reasoning is a relatively new field of study. In this paper we describe the impact that Walton’s conception of argumentation schemes had on AI and Law research. We will discuss developments in argumentation in AI and Law before Walton’s schemes became known in that community, and the issues that were current in that work. We will then show how Walton’s schemes provided a means of addressing all of those issues, and so supplied a unifying perspective from which to view argumentation in AI and Law.

This paper demonstrates how argumentation schemes can be used in decision support systems that help clinicians in making treatment decisions. The work builds on the use of computational argumentation, a rigorous approach to reasoning with complex data that places strong emphasis on being able to justify and explain the decisions that are recommended. The main contribution of the paper is to present a novel set of specialised argumentation schemes that can be used in the context of a (...) clinical decision support system to assist in reasoning about what treatments to offer. These schemes provide a mechanism for capturing clinical reasoning in such a way that it can be handled by the formal reasoning mechanisms of formal argumentation. The paper describes how the integration between argumentation schemes and formal argumentation may be carried out, sketches how this is achieved by an implementation that we have created and illustrates the overall process on a small set of case studies. This paper uses the language of formal dialectics to explore how argumentation schemes and their critical questions can be characterized as an extension to traditional dialectical systems. The aim is to construct a dialectical system in which the set of locutions is extended to include scheme-based moves the set of structural rules describes the roles that critical questioning can play; and the set of commitment rules distinguishes between exceptions and assumptions.

To create a programming environment for contract dispute resolution, we propose an extension of assumption-based argumentation into modular assumption-based argumentation in which different modules of argumentation representing different knowledge bases for reasoning about beliefs and facts and for representation and reasoning with the legal doctrines could be built and assembled together. A distinct novel feature of modular argumentation in compare with other modular logic-based systems like Prolog is that it allows references to different semantics in the (...) same module at the same time, a feature critically important for application of argumentation in legal domains like contract dispute resolution where the outcomes of court cases often depend on whether credulous or skeptical modes of reasoning were applied by the contract parties. In this paper, I explore the relationship of virtue, argumentation, and philosophical conduct by considering the role of the specific virtue of intellectual humility in the practice of philosophical argumentation. I have three aims: first, to sketch an account of this virtue; second, to argue that it can be cultivated by engaging in argumentation with others; and third, to problematize this claim by drawing upon recent data from social psychology. My claim is that philosophical argumentation can (...) be conducive to the cultivation of virtues, including humility, but only if it is conceived and practiced in appropriately ‘edifying’ ways. The aim of this chapter is to explore the relationship between metaphor and reasoning, by claiming that argumentation might act as a bridge between metaphor and reasoning. Firstly, the chapter introduces metaphor as a framing strategy through which some relevant properties of a source domain are selected to understand a target domain. The mapping of properties from the source to the target domain implicitly forces the interpreter to consider the target from a specific perspective. Secondly, the chapter presents metaphor (...) as an implicit argument where some inferences can be drawn from the comparison between the source and the target domain. In particular, this chapter aims to understand whether and to what extent such an argument might be linked to analogical reasoning. The chapter argues that, in case of faulty analogy, this kind of argument might have the form of a quaternio terminorum, where metaphor is the middle term. Finally, the chapter presents the results of an experimental study, aiming to test the effect of the linguistic nature of the middle term on the detection of such faulty analogy. The chapter concludes that a wider context is needed to make sense of an analogical argument with novel metaphors, whilst in a narrow context, a lexicalised metaphor might be extended and the overall argument might be interpreted as metaphoric. This volume focuses on the role language plays at all levels of the argumentation process. It explores the effects that specific linguistic choices may have in the production and the reception of arguments and in doing so, it moves beyond the first, necessary, descriptive stance provided by current literature on the topic. Although political argumentation is not institutionalized in a formal sense, it does have recurrent patterns and characteristics. Its constraints include the absence of time limits, the lack of a clear terminus, heterogeneous audiences, and the assumption that access is open to all. These constraints make creative strategic maneuvering both possible and necessary. Among the common types of strategic maneuvering are changing the subject, modifying the relevant audience, appealing to liberal and conservative presumptions, reframing the argument, using condensation symbols, employing (...) the locus of the irreparable, and argumentative use of figures and tropes. It is difficult to evaluate strategic maneuvering in political argumentation, however, because the activity types dictate wide latitude for the arguers, so there are few cases of unquestionable derailment. A pervasive aspect of human communication and sociality is argumentation: the practice of making and criticizing reasons in the context of doubt and disagreement. Argumentation underpins and shapes the decision-making, problem-solving, and conflict management which are fundamental to human relationships. However, argumentation is predominantly conceptualized as two parties arguing pro and con positions with each other in one place. This dyadic bias undermines the capacity to engage argumentation in complex communication in contemporary, digital society. This book (...) offers an ambitious alternative course of inquiry for the analysis, evaluation, and design of argumentation as polylogue: various actors arguing over many positions across multiple places. In this contribution, I will develop a comprehensive tool for the reconstruction and evaluation of argumentation from expert opinion. This is done by analyzing and then combining two dialectical accounts of this type of argumentation. Walton’s account of the ‘appeal to expert opinion’ provides a number of useful, but fairly unsystematic suggestions for critical questions pertaining to argumentation from expert opinion. The pragma-dialectical account of ‘argumentation from authority’ offers a clear and systematic, but fairly general framework (...) for the reconstruction and evaluation of this type of argumentation. The philosophical literature that tackles foundational questions about normativity often appeals to normative reasons—or considerations that count in favor of or against actions—and their interaction. The interaction between normative reasons is usually made sense of by appealing to the metaphor of (normative) weight scales. This paper substitutes an argumentation-theoretic model for this metaphor. The upshot is a general and precise model that is faithful to the philosophical ideas.

Norms—that is, specifications of what we ought to do—play a critical role in the study of informal argumentation, as they do in studies of judgment, decision-making and reasoning more generally. Specifically, they guide a recurring theme: are people rational? Though rules and standards have been central to the study of reasoning, and behavior more generally, there has been little discussion within psychology about why (or indeed if) they should be considered normative despite the considerable philosophical literature that bears on (...) this topic. In the current paper, we ask what makes something a norm, with consideration both of norms in general and a specific example: norms for informal argumentation. We conclude that it is both possible and desirable to invoke norms for rational argument, and that a Bayesian approach provides solid normative principles with which to do so. (shrink)

This book shows how research in linguistic pragmatics, philosophy of language, and rhetoric can be connected through argumentation to analyze a recognizably common strategy used in political and everyday conversation, namely the distortion of another’s words in an argumentative exchange. Straw man argumentation refers to the modification of a position by misquoting, misreporting or wrenching the original speaker’s statements from their context in order to attack them more easily or more effectively. While deductive validity provides the limiting upper bound for evaluating the strength and quality of inferences, by itself it is an inadequate tool for evaluating arguments, arguing, and argumentation. Similar remarks can be made about rhetorical success and dialectical closure. Then what would count as ideal argumentation? In this paper we introduce the concept of cognitive compathy to point in the direction of one way to answer that question. It is a feature of our argumentation rather than (...) my argument or your argument. In that respect, compathy is like the harmonies achieved by an accomplished choir, the spontaneous coordination of athletic teamwork, or the experience of improvising jazz musicians when they are all in the flow together. It is a characteristic of arguments, not a virtue that can be attributed to individual arguers. It makes argumentation more than just the sum of its individual parts. The concept of cognitive compathy is brought into focus by locating it at the confluence of two lines of thought. First, we work up to the concept of compathy by contrasting it with empathy and sympathy in the context of emotions, which is then transplanted into epistemic, cognitive, and argumentative soil. Second, the concept is analytically linked to ideal argumentation by way of authenticity in communication. In the final section, we explore the extent to which argumentative virtues are conducive to producing compathetic argumentation, but reach the unhappy conclusion that the extra value of compathetic argumentation also transcends the evaluative reach of virtue argumentation theory. Robert Alexy develops his influential theory of legal reasoning exploring the nature of legal argumentation and its relation to practical reasoning. In doing so he sheds light on fundamental questions of law and rationality, which are as crucial to practising lawyers and law students as they are to scholars of legal theory.

Feminists note an association of arguing with aggression and masculinity and question the necessity of this connection. Arguing also seems to some to identify a central method of philosophical reasoning, and gendered assumptions and standards would pose problems for the discipline. Can feminine modes of reasoning provide an alternative or supplement? Can overarching epistemological standards account for the benefits of different approaches to arguing? These are some of the prospects for argumentation inside and outside of philosophy that feminists consider. (...) -/- The further concern is that the academic study of argumentation – in philosophy and other disciplines – has failed to account for the type of reasoning needed for social justice movements. What resources for addressing these concerns can be found in informal logic and interdisciplinary argumentation theory? Since part of the perceived problem derives from assuming that arguing is a contest, are more collaborative epistemological frameworks better? Central to Perelman and Olbrechts-Tyteca’s philosophical revival of rhetoric and dialectic is the importance given to the temporal character of argumentation. Unlike demonstration, situated within the “empty time” of a single instant, the authors of The New Rhetoric understand argumentation as an action that unfolds within the “full time” of meaningful human life. By taking a broader view of his work beyond The New Rhetoric, I first outline Perelman’s understanding of time and temporality and the challenge that it (...) poses for the study of argumentation. Next, I emphasize the distinction between argumentation’s internal and external temporal structures, and then show how Perelman problematizes a static view of a number of basic argumentative concepts by bringing out their essentially temporal character. Finally, in clarifying what is at stake in Perelman’s account, I conclude by drawing attention to a number of issues in contemporary argumentation studies that may benefit from a reconsideration of Perelman’s analysis of time. This paper is part of a research program centered around argumentation networks and offering several research directions for argumentation networks, with a view of using such networks for integrating logics and network reasoning. In Section 1 we introduce our program manifesto. In Section 2 we motivate and show how to substitute one argumentation network as a node in another argumentation network. Substitution is a purely logical operation and doing it for networks, besides developing their theory further, (...) also helps us see how to bring logic and networks closer together. Normative theories of argumentation tend to assume that logical and dialectical rules suffice to ensure the rationality of argumentative discourse. Yet, in everyday debates people use arguments that seem valid in light of such rules but nonetheless biased and tendentious. This article seeks to show that the rationality of argumentation can only be fully promoted if we take into account its ethical dimension. To substantiate this claim, I review some of the empirical evidence indicating that people’s inferential reasoning (...) is systematically affected by a variety of biases and heuristics. Insofar as these cognitive illusions are typically unintentional, it appears that arguers may be biased despite their well-intended efforts to follow the rules of critical argumentation. Nevertheless, I argue that people remain responsible for the rationality of their arguments, given that there are a number of measures that they can (and ought to) take to avoid such distortions. I highlight the importance of argumentational virtues and critical thinking to rational debates, and describe a set of indirect strategies of “argumentative self-control”. (shrink)

Philosophers deny a proposal for actions can be deduced from arguments for or against the proposal because they may be incompatible. Nevertheless, people in general, and politicians especially, make decisions and present arguments they believe are convincing. We studied politicians who made decisions in complex situations. They spoke about possible actions, their consequences, the probabilities of these consequences and their evaluations, but rarely indicated why their arguments led to their choice. We hypothesized implicit argumentation rules involved and checked whether (...) they predicted those choices. We found seven implicit informal logic rules involved. We also found a random sample of people made the same choices based on the same arguments, suggesting basic warrants by which people argue about decisions. (shrink)

This book provides an argumentation model for means-end reasoning, a distinctive type of reasoning used for problem-solving gand decision-making. Means-end reasoning is modeled as goal-directed argumentation from an agent's goals and known circumstances, and from an action selected as a means, to a decision to carry out the action. The first question is the one of the relationship between the semantic analysis of modality and the structure of arguments. The second question is the one of the distinctive place, or role, of modality in the fundamental structure of arguments. These two questions concern how modality, as a semantic category, relates to the fundamental structure of arguments. It explores the role of modal expressions as argumentative indicators by using the Italian modal system as a case study. Computational models have shown how polarisation can rise among deliberating agents as they approximate epistemic rationality. This paper provides further support for the thesis that polarisation can rise under condition of epistemic rationality, but it does not depend on limitations that extant models rely on, such as memory restrictions or biased evaluation of other agents’ testimony. Instead, deliberation is modelled through agents’ purposeful introduction of arguments and their rational reactions to introductions of others. This process induces polarisation dynamics on its (...) own. A second result is that the effect size of polarisation dynamics correlates with particular types of argumentative behaviour. Polarisation effects can be soothed when agents take into account the opinions of others as premises, and they are amplified as agents fortify their own beliefs. These results underpin the relevance of argumentation as a factor in social-epistemic processes and indicate that rising issue polarisation is not a reliable indicator of epistemic shortcomings. In their extensive overview of various concepts of presumption Godden and Walton recognise “the heterogeneous picture of presumptions that exists in argumentation theory today”. I argue that this heterogeneity results from an epiphenomenal character of the notion of presumption. To this end, I first distinguish between three main classes of presumptions. Framework presumptions define the basic conditions of linguistic understanding and meaningful conversation. The “presumption of veracity” is their paradigm case. I argue that such presumptions are satisfactorily covered by (...) the Principle of Charity, or else Gricean maxims or satisfaction conditions for speech acts. Formal presumptions are general presumptive rules of argument, theorised as topoi or acceptable inference warrants, including institutional warrants. Material presumptions are acceptable outcomes of nested or outsourced arguments, which entitles arguers to use them as acceptable premises or opinions in further arguments without the typical burden of proof. If this is correct, then the study of presumption always collapses into the study of other, likely more fundamental, concepts. Does it render presumptions, by Occam’s Razor, altogether redundant in argumentation theory? I tentatively answer this question from a consistently conversational perspective on argumentation; I argue that the pragmatic grounds for presumptions are to be found in the conditions for speech act performance in the institutional social world, as developed by Searle.
