In den letzten Jahren hat sich eine Vielfalt unterschiedlicher Gremien zur Ethikberatung entwickelt: vom Konsil mit einem einzelnen Berater bis zum Ethikkomitee. In dem Band werden die Ethikberatung, ihre Entwicklung und Anwendung, sowie die Gründung von Gremien in Krankenhäusern, Pflegeeinrichtungen, Hospizen und von niedergelassenen Ärzten anhand von Fallbeispielen erläutert. Dabei schlagen die Autoren eine Brücke zwischen traditioneller philosophischer Ethik und anwendungsbezogener klinischer Ethik. Auch rechtliche Fragen werden erörtert.

Many recent gene knockout experiments cause anatomical changes to the jaw region of mice that several investigators claim are evolutionary reversals. Here we evaluate these mutant phenotypes and the assertions of atavism. We argue that following the knockout of Hoxa-2, Dlx-2, MHox, Otx2, and RAR genes, ectopic cartilages arise as secondary consequences of disruptions in normal processes of cell specification, migration, or differentiation. These disruptions cause an excess of mesenchyme to accumulate in a region through which skeletal progenitor cells usually (...) migrate, and at a site of condensation that is normally present in mammals but that is too small to chondrify. We find little evidence that these genes, when disrupted, cause a reversion to any primitive condition and although changes in their expression may have played a role in the evolution of the mammalian jaw, their function during morphogenesis is not sufficiently understood to confirm such hypotheses. Transhumanists share the belief that an outcome in which humans have radically advanced intelligence, near immortality, deep friendships with AI creatures, and elective body characteristics is a very desirable end, both for one's own personal development and for the development of our species as a whole. This chapter employs science fiction thought experiments to discuss the most important philosophical element of the transhumanist picture ‐ its unique perspective on the nature and development of persons. Examining the enhancement issue from the (...) vantage point of the metaphysical problem of personal identity presents a serious challenge to transhumanism. The reduplication problem suggests that sameness of pattern is not sufficient for sameness of person. Perhaps one should react to the reduplication case in the following way: one's pattern is essential to one's self despite not being sufficient for a complete account of one's identity. (shrink)

A background assumption of this paper is that the repertoire of inference schemes available to humanity is not fixed, but subject to change as new schemes are invented or refined and as old ones are obsolesced or abandoned. This is particularly visible in areas like health and environmental sciences, where enormous societal investment has been made in finding ways to reach more dependable conclusions. Computational modeling of argumentation, at least for the discourse in expert fields, will require the possibility of (...) modeling change in a stock of schemes that may be applied to generate conclusions from data. We examine Randomized Clinical Trial, an inference scheme established within medical science in the mid-20th Century, and show that its successful defense by means of practical reasoning allowed for its black-boxing as an inference scheme that generates (and warrants belief in) conclusions about the effects of medical treatments. Modeling the use of a scheme is well-understood; here we focus on modeling how the scheme comes to be established so that it is available for use. (shrink)

Although a focus on individual differences can help resolve issues concerning performance errors and computational complexity, the understanding/acceptance axiom is inadequate for establishing which decision norms are most appropriate. The contribution of experience to automatic and controlled processes suggests difficulties in attributing interactional intelligence to goals of evolutionary rationality and analytic intelligence to goals of instrumental rationality.

This chapter first explains why it is likely that the alien civilizations we encounter will be forms of superintelligent artificial intelligence (SAI). Next, it turns to the question of whether superintelligent aliens can be conscious – whether it feels a certain way to be an alien, despite their non‐biological nature. The chapter draws from the literature in philosophy of AI, and urges that although we cannot be certain that superintelligent aliens can be conscious, it is likely that they would be. (...) It then turns to the difficult question of how such creatures might think, and attempts to identify some goals and cognitive capacities likely to be possessed by superintelligent beings. The chapter discusses Nick Bostrom's recent book on superintelligence, which focuses on the genesis of SAI on Earth. Finally, it isolates a specific type of superintelligence that is of particular import in the context of alien superintelligence, biologically‐inspired superintelligences (BISAs). (shrink)

This paper analyses and (tentatively) rejects Julian Fink's argument for the existence of normative process-requirements. According to Fink, only process-requirements allow us to give appropriate normative credit to a subject S who violates certain state-requirements but is undergoing a process that will eventually lead to their satisfaction. I will show that Fink's argument applies, at best, only to a restricted set of cases—namely, when S's undergoing a process has not resulted in the formation of new mental states. In these remaining (...) cases, however, it is implausible to give S normative credit for undergoing the relevant process. Thus, we can assign the correct degree of the corresponding normative property solely in terms of state-requirements. To the extent that this holds, Fink's argument does not entail that there are normative process-requirements. (shrink)

Es wird versucht, unter Verzicht auf ein bestimmtes philosophisches Vorverstandnis Leibniz' Naturrechtsgedanken aus dem vorhandenen Quellenmaterial vom Text her zu erschliessen, zu ordnen und im historischen Zusammenhang zu verstehen.

The Rule of law often is considered to be a criterion for legal positivistic thinking. According to this maxim: can the Chinese Legalistic thinking of Shang Yang and Han Fei be considered as a sort of Legal Positivism? There are many positions shared by both, like the idea of a positive law or the binding character of the law despite of person and sympathies or even the concept of the law as a system. There is, however a important difference between (...) them: legal positivism can be best described as “rule of the law” whereas Legalism best fits the idea of “rule by the law”, since there were no secondary rules stating how the legislator had to make the law. On the other hand, the strongest approach to draw a parallel between both is the commonly shared concept of realism of the law as social construction. (shrink)

Abraham Lincoln's 1838 Lyceum speech is of interest for its explicit argument - that extra-legal violence is not a legitimate inference from popular sovereignty - but especially for the manner in which Lincoln led his listeners to this conclusion, which many of them would have resisted. His defence of American political institutions relies on informal, non- institutional, rhetorical means. By employing such means, Lincoln addressed a gap in the American framers' view of a representative's duty: he sought to change public (...) opinion as well as represent it. Lincoln's response to violence invites comparison with that of the abolitionists, who were frequently its targets. Both saw rhetoric as a necessary complement to formal institutions, but Lincoln goes further than the abolitionists in considering the dangers in an appeal from popular opinion to rights. (shrink)

Der Autor interpretiert Nicolas Poussins Gemälde »Et in Arcadia ego« (1638–1640) mit der Inschrift »Auch in Arkadien gibt es mich, den Tod« als Darstellung eines Erkenntnisprozesses und schlägt vor, das zuvor moralisch verstandene »Memento mori« als Aufforderung zur Selbsterkenntnis zu begreifen. Damit formuliert er eine Gegenposition zum Programm des »Transhumanismus«, der die Abschaffung des Todes anstrebt. Sodann geht er von Freuds Hinweis auf die Verleugnung des je eigenen Todes aus und interpretiert die Struktur dieser Einstellung mit Freuds spätem Begriff der (...) »Ichspaltung«. Dabei zeigt sich, dass die mit der Ichspaltung verbundene Allmachtsphantasie auf Verleugnung statt auf Anerkennung von Unverfügbarkeit abzielt, deren Repräsentant der Tod ist. »Memento mori« wird so zu einer emotional erkennenden Erfahrung von Unverfügbarkeit als zentralem Aspekt der Conditio humana.
