Is it morally justifiable to force non-consenting pregnant women to submit to caesarean surgery to save their fetus in distress? Even though proponents and opponents largely agree on the interests at stake, such as the health and life of the fetus and the respect for bodily integrity and autonomy of pregnant women, they disagree on which moral weight to attach to these interests. This is why disagreements about the justifiability of forced caesareans tend to be pervasive and intractable. To sidestep (...) this deadlock, we will focus on conditions that give rise to the ‘caesarean dilemma’ in the first place, namely the conflict between inherent norms and values medical professionals are committed to by virtue of being a medical professional. Using the reflective equilibrium, we will test the opponents’ and proponents’ considered judgments about forced caesareans against the norms and values they—as medical professionals—are committed to and determine whether they are coherent. Subsequently we will identify the proponents’ incoherencies between the considered judgments and norms and values they are committed to and conclude that as long as these incoherencies are in place, forced caesareans are morally impermissible. There is an increasing interest in the possibility of using nudges to promote people's health. Following the advances in developmental biology and epigenetics, it is clear that one's health is not always the result of one's own choices. In the period surrounding pregnancy, maternal choice behaviour has a significant influence on perinatal morbidity and mortality as well as the development of chronic diseases later in life. One's health is thus a matter of one's own as well as one's maternal choices. (...) Therefore, self-regarding and other-regarding nudges should be considered as viable strategies to promote health. In this article, we introduce the concept of other-regarding nudges. We use the harm principle and the principle of beneficence to justify these other-regarding nudges. We conclude by stressing the importance of a fair assessment of expectations towards the nudgee, when determining whether a nudge is aimed at preventing harm or promoting a good. (shrink)

In Doubts on Avicenna, Ayman Shihadeh offers an extended study and critical edition of Sharaf al-Dīn al-Masʿūdī’s al-Mabāḥith wa-l-Shukūk, a key and hitherto unstudied source for twelfth-century Arabic philosophy. This text inaugurates the long commentarial tradition on Avicenna’s Ishārāt.

According to Tāj al-Dīn al-Subkī, al-Ghazālī was the renewer of the Muslim faith at the end of the 5th / 11th century, whereas al-Rāzī was the renewer of faith at the end of the 6th / 12th century. That al-Ghazālī deserves such an honour can hardly be disputed, and his importance in the history of Islamic thought is generally recognised. However, the same cannot, as easily, be said of al-Rāzī, whose historical significance is far from being truly appreciated, and some (...) of the most important books of whom still await publication. Much is known about his views on particular philosophical and theological problems, and about the historical backgrounds to, and the relations amongst, some of these views. Some rather general observations on his thought are also common; for instance, that he is a heavily philosophising Ash‘arī mutakallim, a master dialectician, and an influential critic of Ibn Sīnā. Drawing on two years of ethnographic fieldwork in Egypt focused on organ transplantation, this paper examines the ways in which the “scientific” criteria of determining death in terms of brain function are contested by Egyptian doctors. Whereas in North American medical practice, the death of the “person” is associated with the cessation of brain function, in Egypt, any sign of biological life is evidence of the persistence, even if fleeting, of the soul. I argue that this difference does not exemplify (...) an irresolvable culture clash but points to an unsettling aspect of cadaveric organ procurement that has emerged wherever organ transplantation is practiced. Further, I argue that a misdiagnosis of the problem, as one about “religious extremism” or a “civilizational clash,” has obfuscated unresolved concerns about fairness, access, and justice within Egyptian medical spheres. This misdiagnosis has led to the suspension of a cadaveric procurement program for over 30 years, despite Egypt’s pioneering efforts in kidney transplantation. (shrink)

BACKGROUND: In today’s world of increased awareness regarding the concepts of corporate social responsibility (CSR) and corporate governance (CG), many firms in the developed countries consider noncompliance with CSR and CG standards as an important source of risk to their reputations with stakeholders. OBJECTIVE: The aim of this study is to investigate the relationship between the corporate social responsibility disclosure (CSRD) index and corporate factors, namely, board size, board independence, board meetings, CEO duality, a firm’s size, leverage, profitability and age. (...) This is the first known study in the case of Saudi Arabia to use the GRI 4th edition indicators to construct the CSRD index and evaluate Saudi listed firms. Results: The results show that profitability and size factor have positive and significant association with CSR disclosure in listed Saudi firms. While CG characteristics have no impact on CSR disclosure except board independence which has a negative impact. Conclusion: The average of CSRD index among Saudi firms is too low, it is about 11% that means Saudi firms disclose 11% of the information that they have to provide for stockholders according to GRI guidelines. This paper seeks to determine the extent of anti-corruption information disclosure in the sustainability reports originating from Gulf countries. Focus primarily on the fight against corruption, this study utilizes a deeply-rooted content analysis technique of corporate sustainability reporting, covering 66 Gulf Cooperation Council (GCC) firms during 2014. Strengthened by the application of institutional theory, insight into the results points to a state of limited maturity regarding the disclosure of anti-corruption procedures in the region. More specifically, the results highlight the compliance (...) in the reporting of conduct code, while reporting information on whistle-blowing was significantly less in comparison. Firms in Qatar and UAE ultimately release better informed reports; inclusive of detailed information on internal anti-corruption practices. (shrink)

The objective of this article is twofold. First, it investigates mereology in medieval Islamic theology, particularly the theologians’ claim that the whole is identical to its parts and accordingly that at least some attributes common to the parts must by extension be attributed of the whole. This claim was refuted by philosophers and, from the eleventh century onwards, an increasing number of theologians. Second, it offers a new interpretation of the standard theological proof from accidents for creation ex nihilo, to (...) which this problem was central. Dans cet article, je voudrais étudier la version dite réaliste de la thèse d’indispensabilité qui donne lieu aux arguments les plus sérieux en faveur du platonisme en philosophie des mathématiques. Comme le dit très clairement Hartry Field (université de New York City), le meilleur représentant de cette version dite réaliste de la thèse d’indispensabilité n’est autre que Quine (1908- 2000). Je vais essayer donc de démontrer, contre le philosophe de New York City, comment les arguments d’indispensabilité ne justifient la thèse (...) platonicienne en philosophie des mathématiques que s’ils sont mis en relation structurelle avec ce que j’appellerai « les arguments métascientifiques ». J’essaierai donc de comprendre la nature des relations entre les arguments d’indispensabilité et les arguments métascientifiques, qui constituent, de mon point de vue, avec le réalisme onto-logique, les bases sur lesquelles s’élabore la théorie pragmatico-platonicienne et extensionnelle des mathématiques de Quine. In the present paper, I assume that the notion of “truth” in philosophy would not have been clarified and tackled properly, if philosophers did not take into account earlier Arabic Medieval research contributions and build upon previous research findings. In the first place, I embark on the scrutiny of the rich aspect (or nature) of the Arabic Lexicon in terms of the “truth” meaning. In the second place, I take on the assumption that Arabic linguistic traditions imply different kinds of (...) truths, depending on various spheres of human thoughts and actions based on the logical approach to “truth” (from Al-Kindi up to Averroes via Al-Farabi and Avicenna) and the term “al-haqiqha” as transliterated from Arabic, remain central. In conclusion, I take on an approach to “truth” that gives worth to logical perspectives at the very heart of Medieval Arab traditions in the light of what I would label as the “Omni-cultural Universality of Logic and Science”. In Islamic law paternity is treated as a consequence of a licit sexual relationship. Since DNA testing makes a clear distinction between legal and biological paternity possible, it challenges the continued correlation between paternity and marriage. This article explores the foundations of paternity regulations in the Islamic ethico-legal tradition, with a particular focus on what is termed here “the licit sex principle,” and investigates the extent to which a harm-based argument can be made either by appeal to or against Islamic (...) paternity regulations. It argues that in Islamic bioethics the definition of harm and its boundaries is a function of both: (1) identification of legal and religious rights and the extent to which these rights are violated; and (2) balancing and reconciling perceived harm against both specific principles in relation to a given issue and also the overarching objectives of Islamic law. This study aims at measuring the level of unacceptability of certain unethical behaviours for educators in accounting/finance as well as marketing/management in their various roles. The research was conducted utilising a quantitative approach based on the Integrated Social Contracts Theory in order to compare norms of ethically acceptable/unacceptable behaviours of A/F and M/M educators in the context of Kuwait. The population for this study consisted of educators from A/F and M/M from different Business Schools in Kuwait. The results of the (...) study indicate there is general agreement on unacceptable behaviours in academia between the two groups; however, in general, A/F faculty tend to rate nearly all unethical behaviors as slightly more unacceptable than do M/M faculty. While this may possibly indicate that A/F faculty are slightly more ethical, more likely it reflects different ways of perceiving the world among quantitatively vs. qualitatively-oriented faculty. We also compare the results to a prior similar survey conducted by Siegel and Jackson. It seems that the perceived ethics of behaviours differs somewhat among educators in different parts of the world. This study is expected to assist the development of an ethical code in Kuwaiti academe. This in turn will help students to learn about codes of ethics which will govern their future conduct as professionals. (shrink)

Religious fundamentalism has been suspected as a product of simple cognitive structuring. On the other hand, recent publications have shown that cognitive structure formation is not as simple as was previously thought. The concept of the Ability to Achieve Cognitive Structure revealed that not everyone was able to form simple cognitive structure. This study employed a total of 187 Indonesian university students as participants. By the mean of Structural Equation Modeling, this study treated the desire for simple cognitive structure as (...) a “new” latent variable and examined its relation with intratextual fundamentalism using AACS as moderator. The desire for simple structure was reflected by the Need for Cognitive Structure, the Dogmatism, and the RWA. The fundamentalism was reflected by the Intratextual Fundamentalism Scale. The result showed that fundamentalism, among other things, was a product of desire for simple cognitive structure. This study also showed that AACS moderated the relation in which high AACS would lead to higher fundamentalism while low AACS would not. Implications of the findings for social psychology and cross-cultural understanding of religious fundamentalism were discussed. (shrink)

Foucault, dans son Histoire de la sexualité, esquissa une anthropologie du plaisir dans l'Antiquité gréco-romaine. Ce travail avait constitué un virage, car depuis Mai 68, l'intellectuel avait fait de l'engagement le vecteur des résistances modernes. Or, cette approche fut l'objet d'une critique acerbe de la part de Baudrillard. Dans son Oublier Foucault (1976), le sociologue reprochait au philosophe de garder intacte l'instance du pouvoir comme grille d'intelligibilité ultime. Dès lors, la façon dont Foucault a orienté sa recherche, en se focalisant (...) sur la subjectivité, l'éthique de soi, l'esthétique de l'existence et le style de vie, ne serait-elle pas une manière de concéder à la critique de Baudrillard une part de vérité? Les mouvements de libération avaient provoqué chez Foucault l'espoir d'un agencement fructueux entre une sexualité renouvelée et une nouvelle culture. Or, l'évolution des sociétés a montré une adéquation entre cette nouvelle culture socio-sexuelle et la société de consommation. Cette culture n'est-elle pas devenue un modèle d'intégration à la société post-moderne, une matrice du "nouvel esprit du capitalisme", et le garant d'un nouvel ordre établi? (shrink)

Abstract: The discovery of DNA paternity tests has stirred a debate concerning the definition of paternity and whether the grounds for such a definition are legal or biological. According to the classical rules of Islamic law, paternity is established and negated on the basis of a valid marriage. Modern biomedical technology raises the question of whether paternity tests can be the sole basis for paternity, even independently of marriage. Although on the surface this technology seems to challenge the authority of (...) Islamic law in this area, the paper argues that classical Islamic rulings pertaining to paternity issues continue to hold higher authority even in cases of conflict with modern technology-based alternatives. Through closer analysis, the paper traces the emergence of a differentiation in the function of DNA tests between identity and paternity verification. While the former is accepted without reservation, the latter is approved only when it does not violate the rulings of Islamic law. (shrink)

Formulating sound and acceptable embryo research policy remains challenging especially in a pluralistic world. This challenge has acquired a new dimension of complexity with the advent of so-called embryo models, which are derived from stem cells. In this article, we present a normative strategy to facilitate the process of sound policy-making in the field of human embryology. This strategy involves seeking neutral agreements on higher level theories and doctrines as well as seeking agreements on the level of concrete policy proposals. (...) By going high and low, the plurality of reasonable moral and epistemic convictions of stakeholders involved in the domain of human embryology is respected while the process of policy-making in this area is improved. This paper examines Hanafi’s concept of Occidentalism in the epistemological approach. It aims to investigate the character, study source, research method,validity, and objectives of Occidentalism. The paper findings demonstrate that Occidentalism is a science which aims to dismantle the myth of Western superiority and, in turn, to build an equal civilization. The study root of Occidentalism is the formation, structure, and fate of the European consciousness. The formation comprises the exposed and unexposed sources of the European consciousness. The structure en (...) compasses the ideologies of nationalism, Zionism, Nazism, Facism, and racialism. Fate relies on the model of the relationship between the East and the West. Afterward, Hanafi employs two research methods: historical-dialectical and phenomenology. Lastly, science can be recognized as Occidentalism if it has a five fold standard: there is the dialectic of the East and the West, positioning European consciousness as the study object, self-liberation as the spirit to liberate the East from Western hegemony, dismantling the myth of cosmopolite culture, and the accomplishment of an equal civilization. On political epistemology of Muhammadiyah, an Islamic organization in Indonesia.

Extremism has been a problematic term to define and suggests different and opposing meanings. This study explores how Twitter users conceptualize extremism in Arabic and express their opinions/arguments to construct the term. A corpus of tweets was collected from Twitter API using the word ‘تطرف أو متطرف’ in Arabic for extremist/extremism. A topic modeling algorithm was then applied to the dataset to uncover latent associated concepts underlying extremism, followed by a critical discourse analysis using Van Dijk’s Sociocognitive approach. The discursive (...) and linguistic strategies used by Twitter users to support and justify their views of extremism were examined. The findings demonstrate an ideological influence that controls the concept of extremism, keeping it open to manipulation to serve shared interests and goals. Arab users of Twitter use extremism to promote their groups’ positive schema against others-negative schema. (shrink)

The post-New Order Indonesian politics has provided a political opportunity structure for the state towards democratization. It has a double-edged sword whatsoever: on the one hand democratization could lead to the civic engagement, but on the other hand, it provides a hot bed for the flourishing of anti-civic organization. As for the latter, following the fall of authoritarian regime of new Order in 1998, Indonesians have also witnessed the birth of transnational Islamist and radical organizations threatening the state’s integrity and (...) peaceful coexistence of the citizens. Amid the public appearance of these radical organization, an issue of ideological infiltration and sabotage of radical organization upon mainstreaming moderate Muslim organizations, such as Nahdlatul Ulama and Muhammadiyah do exist. This article tries to reveal the impacts of a such infiltration practices and the extent that radical narratives win the minds and hearts of important Muslim leaders. Taking a closer a look to Muslim leaders in Sampang district in the island of Madura, the centrum of traditionalist Muslim in Indonesian Islamo-landscape, finds out that intolerant and radical ideologies do resonate clearly among the leaders. This finding resort as an alarm and counter-narrative to the long-admired Islamic traditionalism as an important backbone for moderate Islam in Indonesia. (shrink)

This article presents the edition of a late 3rd/9th- or early 4th/10th-century search warrant for stolen goods (P.Cair.EgLib.inv. 536v). The scribe reports that two black men (aswadayn) were traveling on two donkeys, one of which was also loaded with a saddlebag of money, jewellery and clothes. Upon reaching the Upper Egyptian village of Saqāwa, the two black men were assaulted and murdered, and the goods and donkeys stolen. This document corroborates descriptions in historical works of frequent rebel attacks in various (...) regions of Egypt in the 3rd/9th and 4rd/10th centuries. (shrink)

The purpose of this paper is to problematize the place of religious authority in politics and education. Specifically, this essay highlights the role of religious authority in establishing a moral order that values compliance and conformity at the expense of liberty and critique. In doing so, the essay reflects on Israeli politics and Islamic political thought. Pondering on both, the essay explains how the authority conferred through the use of religious language creates a condition of hyper-solidarity. Under conditions of hyper-solidarity, (...) religious authority becomes pervasive, permeating, and more entrenched and difficult to challenge. It becomes increasingly difficult to be critical, because to criticize is to forgo that hyper-solidarity, and to assume a position of exteriority. Therefore, obedience becomes a choice and a position taken in favor of stability, consistency, and continuity of the group. (shrink)

Onun bu konudaki değerlendirmeleri genellikle cerh ve ta'dil eleştirilerini yapanlarla uyumlu olmuştur. O, İmam Darukutni’nin cerh ve ta’dildeki bazı sözlerinden nakilde bulunurdu. Bazen de diğer bazı âlimlerin sözlerinden alıntı yapardı. Görüşüyle uyumlu olduğunu gösteren sözlerde yorum yapmazdı. Büyük imamlar, râvinin cerh sebebini öğrenmek için İbn Hinzâbe'nin kitabına başvurmuşlardır ki bu, onun yeteneğini ve kitaplarının âlimler arasındaki yerini göstermektedir. Akabinde kullandığı cerh lafızlarını işlemeye çalıştık ki bu konuda ekseriyetle kullandığı kelime “zayıf” lafzıdır. Cerh'de İbn Hinzâbe'nin sözlerini nakledenler arasında, zamanında hadiste müminlerin emiri olan Hafız İbn Hacer de vardır. Bu, Vezir İbn Hinzabe'nin konumunu ve rical ilmindeki bilgisini gösterir. Sonrasında, diğer münekkit alimlerin sözleriyle kıyaslayarak tadil lafızlarına değindik. Taʿdîlde kullandığı lafızlar; sika, şeyhun salih, sadûk, muğrakun fi’l-kitâbe ve daha başka lafızlardır. Vezir Ebu'l-Fadl İbn Hinzabe, bazı ricalin şeyhlerinin isimleri gibi küçük meselelerde olumsuz yorumlara maruz kalmıştır. Bazı görüşleri de büyük imamlar tarafından tercih edilmiştir. (shrink)

Face detection plays important roles in many applications such as human–computer interaction, security and surveillance, face recognition, etc. This article presents an intelligent enhanced fused approach for face recognition based on the Voronoi diagram and wavelet moment invariants. Discrete wavelet transform and moment invariants are used for feature extraction of the facial face. Finally, VD and the dual tessellation are used to locate and detect original face images. Face recognition results based on this new fusion are promising in the state (...) of the art. (shrink)
