The social ecological model (SEM) is a conceptual framework that recognizes individuals function within multiple interactive systems and contextual environments that influence their health. Medical Legal Partnerships (MLPs) address the social determinants of health through partnerships between health providers and civil legal services. This paper explores how the conceptual framework of SEM can be applied to the MLP model, which also uses a multidimensional approach to address an individual’s social determinants of health.

I argue that we are subject to ‘aesthetic luck’ in four senses: constitutive, upbringing, sociogeographic, and circumstantial. I review evidence from our practices, philosophy, and science. I then consider what challenges aesthetic luck raises to the communicability of aesthetic judgments, the formation of one’s aesthetic character, and the goal of a life well lived, as well as possible answers to those challenges.

Humanitarian healthcare work presents a range of ethical challenges for expatriate healthcare professionals, including tragic choices requiring the selection of a least-worst option. In this paper we examine a particular set of tragic choices related to the prioritization of care and allocation of scarce resources between individuals in situations of widespread and urgent health needs. Drawing on qualitative interviews with clinicians, we examine the nature of these choices. We offer recommendations to clinical teams and aid organizations for preparing and supporting (...) frontline clinicians in their efforts to determine the least-worst option, and in their responsibility for making such choices. Frustration in traffic is one of the causes of aggressive driving. Knowledge whether a driver is frustrated may be utilized by future advanced driver assistance systems to counteract this source of crashes. One possibility to achieve this is to automatically recognize facial expressions of drivers. However, only little is known about the facial expressions of frustrated drivers. Here, we report the results of a driving simulator study investigating the facial muscle activity that comes along with frustration. Twenty-eight participants were video-taped (...) during frustrated and non-frustrated driving situations. Their facial muscle activity was manually coded according to the Facial Action Coding System. Participants showed significantly more facial muscle activity in the mouth region. Thus, recording facial muscle behavior potentially provides traffic researchers and assistance system developers with the possibility to recognize frustration while driving. (shrink)

Unter Off-Label-Use versteht man den zulassungsüberschreitenden Einsatz eines Arzneimittels außerhalb der von Zulassungsbehörden genehmigten Anwendungsgebiete. Er ist in der medizinischen Praxis weit verbreitet und fächerübergreifend zu beobachten. Der Beitrag gibt eine Einschätzung der Off-Label-Anwendung aus ethischer Sicht. Dazu wird die Off- Label-Anwendung zunächst von anderen, sachlich verwandten Anwendungsweisen abgegrenzt. Danach wird über die aktuelle Verbreitung des Off-Label- Use informiert. Sodann wird gezeigt, dass sich bekannte Problemlagen aus der Medizinethik bei der Off-Label-Anwendung in spezifischer Weise verschärfen. Schließlich wird diskutiert, wie eine (...) ethisch akzeptable Off-Label-Anwendung von Arzneimitteln ausgestaltet werden könnte und auf welchen Ebenen sie ansetzen müsste. (shrink)

Human rights defenders (HRDs) fight for various human rights and address concerns related to corruption, employment, the environment, and other issues. They also challenge powerful state and private stakeholders and seek justice for human rights abuses. Therefore, HRDs are increasingly becoming targets of violent attacks and abuse with the aim of silencing them. This article begins by providing a brief definition of HRDs and then proceeds to outline the risks associated with their work in defending human rights. It also identifies (...) the perpetrators responsible for these violations. The article categorises the types of abuses against HRDs into two main categories, with a particular focus on the widespread tactic of using the legal system to target and silence defenders in Europe, which is also emerging globally. It introduces a taxonomy of various types of violations through the legal system. By categorising the types of violations against HRDs and establishing a taxonomy to aid in identifying these tactics, the article seeks to deepen understanding and awareness of the varied abuses experienced by HRDs, as well as their deviation from human rights standards, providing a valuable resource for academics, practitioners, and defenders. Die allogene Transplantation von Blutstammzellen aus dem Körper von Kindern, die der Spende nicht selbst zustimmen können, in den Körper eines kranken Geschwisterkindes wirft schwierige ethische Fragen auf. Wie kann ein risikobehafteter, fremdnütziger medizinischer Eingriff ethisch gerechtfertigt werden? In dieser Arbeit werden Argumente kritisch untersucht, nach denen das Spenderkind eine Pflicht habe, bei der Transplantation mitzumachen. Die Idee der Pflicht ist nachvollziehbar aus der Perspektive der Eltern, die zwar in einem Fürsorgekonflikt sind (ein Kind zu Gunsten der Rettung des anderen (...) verletzen zu müssen), aber selbst eine Pflicht haben, für das Leben des kranken Kindes zu kämpfen. Eine Analyse des Pflichtbegriffs zeigt jedoch, dass die Erfüllung einer Pflicht daran gebunden ist, entscheidungskompetent zu sein. Drei Wege werden untersucht, eine solche Pflicht dennochzuzuschreiben: i) die Eltern übertragenihre Pflicht auf das Kind; ii) die Interessen des Spenderkindes implizieren eine Pflicht; iii) Geschwisterkinder haben aufgrund ihrer vertrauten Familienbeziehungen Pflichten untereinander, die auch die Pflicht zu spenden beinhalten. Alle drei Zuschreibungsstrategien werden als unhaltbar kritisiert. Das Ergebnis lautet, dass die Pflicht, einem Geschwisterkind Körpergewebe zu spenden, einem nicht-einwilligungsfähigen Kind nicht zugeschrieben werden kann. Andere philosophische Ansätze zur Stammzellspende von Kindern an Familienangehörige müssten entwickelt und geprüft werden. (shrink)

With increased urbanization, ecological challenges such as climate change and loss of biodiversity, and stress-related disorders globally posing a major threat to public health and wellbeing, the development of efficient multiple-use strategies for urban green spaces and infrastructures is of great importance. In addition to benefits such as climate and water regulation, food production, and biodiversity conservation, green spaces and features have been associated with various health and wellbeing outcomes from a psychological perspective. Research suggests links between exposure to green (...) environmental qualities and restoration from psycho-physiological stress and attention fatigue, promotion of physical activity, increased neighborhood satisfaction and even reduced mortality. Especially strong associations have been observed in urban and socio-economically challenged areas. Usually such salutogenic, i.e. health-promoting, effects are explained through theories related to the notion of biophilia, i.e. the idea that humans share innate tendencies to attend to natural environments and features that have been beneficial during evolution. This paper assumes an ecological approach to perception and behavior to be fruitful in order to analyze the salutogenic potential of environments such as urban green spaces and to step beyond the “green vs. gray” dichotomy that has been prevalent through much of the research on health-promoting environments. Through an analysis of environmental affordances for certain perceived qualities such an approach is explored through a proposed concept for urban green space use and management, the edible forest garden. Such gardens, based on agroecological principles, have emerged as one of the most promising models regarding ecologically sustainable food production. In addition to potential contributions of importance for urban sustainability and biodiversity, we argue that the inclusion of edible forest gardens in urban green spaces – today globally dominated by lawns – also potentially could reinforce several affordances of salutogenic importance, both in terms of e.g. social cohesion but also in regard to restoration from psycho-physiological stress and attention fatigue. Increased opportunities for contact with nature and processes of food production may also reinforce pro-environmental behaviors in the population and thus also affect long-term sustainability. Platão, ao tratar da negação no diálogo Sofista, afirma que sempre que enunciamos o que não é, não enunciamos algo contrário ao que é, mas algo diferente. A negação significa cada parte da natureza da diferença em antítese ao que é. Tal tratamento da negação resulta da necessidade de resolver alguns problemas colocados pelo eleatismo. Propõe-se indicar esses problemas e examinar o tratamento que Platão dá ao nãoser como diferença.

No Teeteto, em uma tentativa de denir o conhecimento, Platão trata da unidade e da complexidade segundo um modelo de análise dos complexos em elementos simples não analisáveis. Wittgenstein, no parágrafo 46 das Investigações Filosócas, cita esse argumento do Teeteto, introduzindo uma crítica à sua própria noção de objeto, no Tractatus. Nosso tema será um exame das noções de elemento e composto, apresentadas no Teeteto e retomadas no Sosta, tendo como horizonte a aproximação, feita por Wittgenstein, entre o objeto do (...) The Parmenides is known as the dialogue in which Plato makes a criticism of his theory of forms. Through paradoxes, the character Parmenides criticizes the theory of forms presented by Socrates in the dialogue, targeting the relation they have with sensibles and with each other, call for participation, and the discoursive consequences of this relation. I present a reading of the Parmenides that suggests that the self-criticism points out inconsistencies in the Platonic theory of participation as it is presented in (...) the Parmenides, and that will be corrected later in the Sophist. The catalogue contains lists of questions found in Latin commentaries on Aristotle’s De sensu, De memoria and De somno et vigilia composed between 1260 and 1320, approximately, plus a selection of commentaries by notable later medieval authors. Most of the texts included are inedita. The catalogue provides information about the title of each question and its location in the relevant manuscript.

In this article, we suggest an alternate approach to interpreting the US Constitution, using founding-era translations. We demonstrate how both symmetries and asymmetries in structure and vocabulary of the languages involved can help in deciding nowadays’ problems of constitutional interpretation. We select seven controversial passages of the US constitution to illustrate our approach: Art. I, § 8, cl. 3 ; Art. II, § 1, cl. 5 ; Art. II, § 2, cl. 3 ; Art. I, § 6, cl. 1/Art. I, (...) § 8, cl. 10/Art. IV, § 2 ; and Art. IV, § 2, cl. 1. Since these passages have recently been debated by constitutional scholars, reassessing them using our method can establish the additional value of our approach to constitutional practice. We presume that our approach is not limited to interpreting the US constitution, but suggest that constitutional hermeneutics in general could profit from adding a translation approach to the toolkit. Development of ontology development tools and ontology-enhanced software applications requires thorough understanding of ontology languages in order to implement them according to their specification. We present a formal specification of the ontologies part of the Web Services Modeling Language WSML documentation as a conceptual model in ORM2. Such an approach abstracts the semantics about ontological constructs, axioms, and properties from their implementation in arbitrary formats, thereby making the model easily understandable and reusable. This formal model in ORM2, which is understandable (...) by both logician and software developer, can be used as any other conceptual model to develop applications, thereby ensuring smooth transition from theory to implementations that are faithful to the theory. Scholars have explored the influence of the field of cybernetics on scientific thought and disciplines. However, from the inception of the field, ‘‘cyberneticians’’ had explicitly envisioned applications reaching beyond the purview of scientific disciplines; cybernetics was remarkable for its portability and potential application in a wide variety of contexts. This article explores connections between cybernetics and experimental music from 1950-1980, which was a period of experimentation with electronic techniques in recording, composition, and sound production and manipulation. Examples include musicians, engineers, (...) instrument builders, composers, and scientists in collaboration with musicians who invoked cybernetic themes in their work. These uses of cybernetics were more diverse than accounts of cybernetics within the sciences suggest, presenting a major difficulty in addressing cybernetics as a homogeneous or monolithic discourse. In particular, cybernetic discourse in music often exhibited themes of openness and indeterminacy, rather than the ‘‘command and control’’ of the ‘‘closed world.’’. (shrink)

The scholarship of Ulf Hannerz is characterized by its extraordinary breadth and visionary nature. He has contributed to the understanding of urban life and transnational networks, and the role of media, paradoxes of identity and new forms of community, suggesting to see culture in terms of flows rather than as bounded entities. Contributions honor Hannerz' legacy by addressing theoretical, epistemological, ethical and methodological challenges facing anthropological inquiry on topics from cultural diversity policies in Europe to transnational networks in Yemen, and (...) from pottery and literature to multinational corporations. A well-worn trope used by phenomenologists is that things that remain invisible or unnoticed in the course of our everyday being in the world reveal themselves in instances of breakdown. This paper borrows this trope to explicate one instance of breakdown, that of traumatic spinal cord injury (TSCI). We use the phenomenology of Heidegger, especially his formulation of ecstatic temporality presented in Being and Time, to illuminate the temporal issues surrounding this radical rupture in Dasein’s being in the world through (...) data collected from field observations of inpatient rehabilitation, interviews with persons with TSCI, and with their rehabilitation providers. Specifically, we explore the breakdown in temporality (the rupture on thrown projection) that occurs in persons who experience TSCI across three interconnected existential dimensions – understanding, attunement (mood), and falling. We conclude by discussing the value this approach to human temporality might have for both social scientists interested in human temporality and to practitioners interested in research related to the rehabilitation process. In this article I would like to show that Charles Darwin conscientiously developed his theory of natural selection conforming to criteria of John Herschel, one of the leading philosophers of science at his time. Therefor I will present Herschel's methodology and search for the criteria in Darwin's _Origin of Species_. I conclude with Herschel's negative reaction to Darwin's theory, showing that Herschel himself probably could not comply with his own criteria. _German_ In diesem Aufsatz möchte ich zeigen, dass sich Charles (...) Darwin bei der Entwicklung seiner Theorie gewissenhaft an den wissenschaftstheoretischen Kriterien seiner Zeit orientierte, die maßgeblich von John Herschel geprägt wurden. Dazu werde ich zuerst die Methodologie Herschels vorstellen, um anschließend Darwins _Entstehung der Arten_ auf diese wissenschaftstheoretischen Kriterien hin zu untersuchen. Abschließend soll an der Reaktion Herschels auf Darwins Theorie gezeigt werden, dass Herschel seine eigenen Kriterien nicht erfüllt hat, weil er sich nicht von seinem,,Vorurteil der Meinung“ befreien konnte. On 14 January 1999, the woman theologian Christina Landman published an article in the religious column, Godsdiens Aktueel, of the Afrikaans daily newspaper Beeld under the heading ‘Poligamie, ditsem!’ (Yes, for polygamy!). In the article, Landman pondered whether polygamy – which is allowed in South Africa for indigenous cultures – would not be an advantage for the Afrikaans society where extra-marital affairs were allegedly high. There was an immediate and long-running reaction to this article in the Afrikaans, as well (...) as in the English media, nationally and internationally, in the printed media, as well as on radio and television. This article will isolate themes in the responding letters of Afrikaans readers. The rejection of polygamy by Afrikaans readers rests on arguments that it is unbiblical, dehumanising to women and impractical. On the other hand, those Afrikaans readers who opt for polygamy argue that multiple-partner-relationships can save marriages from ending in divorce because of extra-marital affairs and can lighten the burden on overworked women. Contribution: This article contributes to the debate on polygamy and in particular from the Afrikaans population in South Africa whose culture and religion forbid polygamy. The discussion and findings as thematised in this article contribute to a body of knowledge not been dealt with in academic research. (shrink)

Microaggressions are a new moral category that refers to the subtle yet harmful forms of discriminatory behavior experienced by members of oppressed groups. Such behavior often results from implicit bias, leaving individual perpetrators unaware of the harm they have caused. Moreover, microaggressions are often dismissed on the grounds that they do not constitute a real or morally significant harm. My goal is therefore to explain why microaggressions are morally significant and argue that we are responsible for their harms. I offer (...) a conceptual framework for microaggressions, exploring the central mechanisms used for identification and the empirical research concerning their harm. The cumulative harm of microaggressions presents a unique case for understanding disaggregation models for contributed harms, blame allocation, and individual responsibility within structural oppression. Our standard moral model for addressing cumulative harm is to hold all individual contributors blameworthy for their particular contributions. However, if we aim to hold people responsible for their unconscious microaggressions and address cumulative harm holistically, this model is inadequate. Drawing on Iris Marion Young's social connection model, I argue that we, as individual perpetrators of microaggressions, have a responsibility to respond to the cumulative harm to which we have individually contributed.
