This paper presents an account of the moral boundaries of organizations. We define an organization’s moral boundary to encompass all of the actions for which it could be held morally responsible. Our theory requires us to view organizations as subjects that act in the world, rather than as objects that are used as tools; that is, it requires us to focus on corporate moral agency. We present a process model for determining whether a given action lies within an organization’s moral (...) boundary, and we discuss how an organization’s moral boundary can be created, destroyed, or modified as a result of deliberate choices by human and organizational actors. Our article contributes to the literature by conceptualizing the distinction between organizations as subjects and organizations as objects, and so clarifying the distinction between legal and moral boundaries; by recentering the discussion of boundaries on organizational actions rather than on contingent institutional features; and by adding nuance to the assignment of moral responsibility in complex organizational networks and in situations where one corporate moral agent depends upon another for its existence. This book grew out of previously published papers of mine composed over a period of years; they have been reworked (sometimes beyond recognition) so as to form a reasonably coherent whole. Part One treats of informative inference. I argue (Chapter 2) that the traditional principle of induction in its clearest formulation (that laws are confirmed by their positive cases) is clearly false. Other formulations in terms of the 'uniformity of nature' or the 'resemblance of the future to the past' seem (...) to me hopelessly unclear. From a Bayesian point of view, 'learning from experience' goes by conditionalization (Bayes' rule). The traditional stum bling block for Bayesians has been to fmd objective probability inputs to conditionalize upon. Subjective Bayesians allow any probability inputs that do not violate the usual axioms of probability. Many subjectivists grant that this liberality seems prodigal but own themselves unable to think of additional constraints that might plausibly be imposed. To be sure, if we could agree on the correct probabilistic representation of 'ignorance' (or absence of pertinent data), then all probabilities obtained by applying Bayes' rule to an 'informationless' prior would be objective. But familiar contra dictions, like the Bertrand paradox, are thought to vitiate all attempts to objectify 'ignorance'. BuUding on the earlier work of Sir Harold Jeffreys, E. T. Jaynes, and the more recent work ofG. E. P. Box and G. E. Tiao, I have elected to bite this bullet. In Chapter 3, I develop and defend an objectivist Bayesian approach. (shrink)

The opioid epidemic demands the development, implementation, and evaluation of innovative, research-informed practices such as diversion programs. Aritürk et al. have articulated important bioethical considerations for implementing diversion programs in resource-constrained service environments. In this commentary, we expand and advance Aritürk et al.’s discussion by discussing existing resources that can be utilized to implement diversion programs that prevent or otherwise minimize the issues of autonomy, non-maleficence, beneficence, and justice identified by Aritürk et al.

What makes ethical accounts natural law ethical is, I argue, commonly misrepresented in teaching within much of the philosophical academy. Yet those immersed in the field of natural law and ethics rarely give definitions/brief characterisations of what makes ethical accounts natural law ethical. I suggest theoretical reasons for the lack. I argue that bringing natural law into ethics is best understood as leading to theoretically unitary accounts, not simply collections of positions detachable from each other: an overlooked and significant point (...) when defending natural law ethical accounts. My arguments throughout rely on the metaethical/normative ethical distinction, which is relatively little used in the natural law literature. I argue that the distinction helps clarify what is distinctive of natural law ethical accounts in general, especially to the secular contemporary philosophical academy, where appreciation of natural law ethical accounts is commonly appreciably lower than in philosophical contexts with a religious ethos. As mariculture—the cultivation of aquatic organisms in marine environment—intensifies to meet the demands of sustainable blue growth and national policies, novel ethical challenges will arise. In the context of ethics, primary concerns over aquaculture and mariculture tend to stay within differing value-based perspectives focused on benefits to human and non-human subjects, specifically animal welfare and animal rights. Nonetheless, the burgeoning field of feminist blue humanities provides ethical considerations that extend beyond animal subjects (including humans), often because of its concerns with (...) new materialist, posthumanist, and other relations-based theories. This article examines feminist blue humanities and the contributions it may bring to understanding contemporary and future ethical challenges posed by mariculture and its intensification, especially the cultivation of low-trophic organisms. By offering an overview of feminist blue humanities, this article explores some of its particularities by drawing out three major ethical concerns facing contemporary mariculture, specifically material reconfigurations, radical alteration of the lives of low-trophic species through industrialization and increases in maricultural waste products. Public reason liberalism demands that political decisions be publicly justified to the citizens who are subjected to them. Much recent literature emphasises the differences between the two main interpretations of this requirement, justificatory and political liberalism. In this paper, I show that both views share structural democratic deficits. They fail to guarantee political autonomy, the expressive quality of law, and the justification to citizens, because they allow collective decisions made by incompletely theorised agreements. I argue that the result can only (...) be avoided by changing public reason’s role in collective decision-making. Instead of incompletely theorised agreements, we should demand agreement both on the public reasons themselves and on the other premises that justify political decisions. In this way, it is always possible to point to a procedure-independent reason that justifies democratic decisions, and the reasoning of the state is public and contestable. Finally, I explain how this, in turn, implies that only political liberalism can be rescued—by accepting what I will call strong political liberalism. Modifying justificatory liberalism in the necessary way will inevitably open the door to an objectionable form of perfectionism. (shrink)

Summary In this contribution, I discuss the perceptual potential of certain genres of experimental and contemporary music, commonly grouped under the label “sound-based music”. The sonic patterns typical of this music are mostly associated, during listening, with visual and tactile sensory qualities and can evoke mental representations as shapes in motion. These are the result of physical-acoustic energies organized according to a perceptual grammar whose organization follows a series of Gestalt and kinaesthetic principles. The paper explores the nature of the (...) relationship between sound patterns of sound-based music and their mental images. Based on morphodynamic theory, it is proposed the emergence of cognitive image schemas, which are at the centre of this relationship. The image schemas depict the forces and tensions of our experience of the world (e.g., figure-background, near-far, superimposition, compulsion, blockage), as being the cognitive and experiential response to the incoming sound patterns. The sense of this music activates precisely the basic structures of sensorimotor experience by which we encounter a world that we can understand and act within, leading to a rich series of high-level associations and responses. In this essay, I revisit and extend my arguments for a view of science that is pluralistic, perspectival and pragmatist. I attempt to resolve mismatches between metaphysical assumptions, epistemological desiderata, and scientific practice. I consider long-held views about unity of science and reductionism, emergent properties and physicalism, exceptionless necessity in explanatory laws, and in the justification for realism. My solutions appeal to the partiality of representation, the perspectivism of theories and data, and the interactive co-construction of warranted claims for realism.

Psychiatric diagnosis and prognosis is fraught with important philosophical and conceptual problems. This chapter focuses on some epistemological issues and moral issues that arise in contemporary psychiatric practice. It examines various clinical and actuarial techniques for psychiatric diagnosis, ordered very loosely in terms of how "structured" or "automated" they are. The chapter makes the case for assessing psychiatric treatments with controlled experiments, raises several epistemological dangers that arise from relying on uncontrolled investigations, and considers some of the unique methodological and (...) ethical issues that arise when trying to assess talk therapy. This article examines Harold Ramis’s 2005 noir comedy _The Ice Harvest_ as the critically dystopian counter-panel to his beloved 1993 film _Groundhog Day_, a film frequently discussed within the paradigm of utopia. While starkly different in genre, tone, and reception, the two films comprise a dialectical dyad that registers the historical transition from the utopian cultural effervescence of the early 1990s to the tragic foreclosure of imaginative horizons and the dystopian transformation of economic, political, and social landscapes in the new (...) millennium. In _The Ice Harvest_, the author argues, this is achieved through a strategic reactivation of film noir as a variant of the critical dystopia. (shrink)

Herodotus gives a lengthy description of the important council of the Greek allies which took place at Samos after Mycale in 479, but Thucydides fails to mention it. This is likely not because of succinctness in his treatment of the period. Throughout the Pentecontaetia, Thucydides presents the events which led to the Peloponnesian War in a somewhat indirect and passive way in order to attribute its causality to historical forces of deeper import. His desire to accentuate the role of Athenian (...) growth and Spartan fear of that growth in making the war inevitable commended the omission of events which by their nature might focus attention instead on the deliberate policy choices of the protagonists. Thucydides’ decision to omit other key events during the Pentecontaetia may stem from the same motivation. (shrink)

The paper deals with the conception of logical empiricism developed by Eino Kaila. Eino Kaila, being a thinker close to the Vienna Circle, departs from some of the central ideas of logical positivism. He identifies a limited number of problems in metaphysics that are meaningful and need to be solved, but he declares the rest of metaphysics to be a logical fallacy. For Eino Kaila, it is not the principle of verification (as a criterion of meaning) but the principle of (...) testability that plays the most important role. In addition, he revises the principle of translatability, insisting that it is impossible to translate a single sentence into the language of experience, but it is possible to translate the whole theory to which the sentence belongs. This is related to his structuralist position in the philosophy of science and his understanding of scientific theories as ‘rationalisations’ as opposed to simple inductive generalisations. The paper compares Eino Kaila’s views expressed during the period of his active interaction with the Vienna Circle be regarded as a predecessor of later critics of logical positivism (in particular, W.V.O. A hypothetical scenario is presented in which a female patient is admitted to a private hospital to undergo a mastectomy and breast reconstruction. The surgeons and anaesthetists conducting the different procedures charge three times the medical aid rates. When the patient asks what the co-payments are likely to be, she is informed by the doctors’ accounts section that they can only provide this information after each procedure. The patient’s medical scheme also advises her that it cannot determine the likely co-payments (...) unless she completes the assessment form sent to her. The form requires her to include the costs reflected against the relevant ICD10 codes. The patient cannot complete the form because the doctors’ accounts sections have not informed her about the proposed procedures and the likely costs of each. This article builds on a previous article discussing doctors’ overarching responsibility to disclose medical treatment costs in advance. The present article outlines the legal requirements in the South African Constitution, the National Health Act and the Health Professions Act, and refers to the Promotion of Access to Information Act and Consumer Protection Act. Similar to the earlier article, this article addresses the ethical requirements of the Health Professions Council of South Africa and the internationally recognised biomedical ethical principles. Furthermore, it also refers to the National Patients Charter, the government’s policy document on health care services. (shrink)

Professor Maurice Cranston, who died suddenly on 5 November 1993, was a man of many talents. Pre-eminent as a biographer of Locke and Rousseau, he was also distinguished for his own contribution to political philosophy and for his capacity to expound the political thought of others in clear, simple language. He did this with great success not only in the lecture room but also in numerous broadcast talks and discussions, notably on the Third Programme of the BBC. In his academic (...) work he was particularly well informed on French political thought, contemporary as much as classical, and he wrote extensively on Sartre and more briefly on Camus and Foucault. He was himself fluent in the French language and he translated Rousseau's Social Contract and Discourse on Inequality for the Penguin Classics series. He was proficient in German and Italian too, and he knew enough Danish to translate a book on Wittgenstein written in that language. His love of literature often led him to illustrate philosophical points with apt examples from classical novels. He even wrote a couple of novels himself in his youth. It will be plain from this brief catalogue that he was an eminently civilized person. He was, in addition, an exceptionally friendly man and engagingly modest about his own abilities. (shrink)

The 19th-century missionary literary genre provides us with a window into how the missionaries viewed African cultural systems, such as polygamy. In their minds, polygamy was one of the obstacles to converting Africans to Christianity. Baptism functioned as a theatre of power and submission. To access baptism, a convert had to abandon and strip themselves of that which made them Africans and adopt Western colonial Christian norms and principles. In this article, we argue that the condemnation of polygamy by missionaries (...) was a wielding of power within the colonial matrix of power. We further maintain that the decolonisation of Christianity cannot be achieved without a critical analysis of the impact of the missionaries in the deformation and labelling of African cultural identities as heathen and uncivilised. Contribution: The cultural transfer that was achieved through Christianisation, civilisation and colonisation has led to what Biko referred to as the flight from the black self and what Du Bois referred to as double consciousness. The article applies the intersectionality of theoretical lenses of Africana critical thought, Foucauldian notion of power, negritude and decoloniality. (shrink)

Thinking About Thinking: Mind and Meaning in the Era of Techno-Nihilism addresses our existential crisis by reminding us of the conditions for meaning that have been obscured by the modern technological mentality. Madden weaves together disparate insights from Wittgenstein, Hegel, Aristotle, Heidegger, Merleau-Ponty, Nietzsche, Sophocles, and others in an attempt to account for our mindedness in terms of its inextricable connection to a world capable of inspiring our care. The authors attempt to speculatively reconstruct the concept of the “So­viet computer game”. They propose to consider gaming practices associ­ated with computers as a derivative of the accepted ideological guidelines that accompany the Soviet project of machine modernization. Within this framework, the concept of the Soviet computer game appears as an unre­alized historical alternative to the normative game design that has devel­oped in countries with market economies. Despite the industry — or the electronic entertainment market — not having had the (...) time to be properly established in the USSR, there were a number of discursive attitudes re­garding the game as such, and the gaming function of computing devices in particular. Even early Soviet pedagogical theories assumed that “playing like a Soviet” involves performing activities structurally similar to labor, where the player becomes part of production. Later, cybernetic discourse, through game theory, indicated the possibility of formalizing any prag­matic activity as a game model; with the advancement of programming, the pragmatics of digital gaming as a way of educating and solving utili­tarian tasks was developed. Based on the memoir archive of Soviet cyber­netics, and publications in the late-Soviet press, the authors demonstrate that the Soviet computer game was not seen an entertainment product, but a representative model for solving problems in an algorithmic form. Thus, the article is not about specific games that could be called Soviet, but about the logic that guided and set the tone for the interpretation of certain computer-game phenomena in the USSR. Raphael examines the moral philosophy of Adam Smith (1723-90), best known for his famous work on economics, The Wealth of Nations, and shows that his thought still has much to offer philosophers today. Raphael gives particular attention to Smith's original theory of conscience, with its emphasis on the role of 'sympathy' (shared feelings).

In the Preface to his recent philosophy of biology (1988) and in his earlierGrowth of Biological Thought(1982), Ernst Mayr emphasized that recent progress in evolutionary biology is a result of conceptual clarification, not a consequence of improved measurements or better scientific laws. Although complete agreement on the meaning of key concepts is not essential for all communication in science (see Hull 1988, pp. 6-7,513), we likewise believe that conceptual clarification is perhaps the most important key to progress in community ecology. In order to investigate some of the reasons that might explain why community ecology has been unable to arrive at a widely accepted general theory, in this essay we analyze “stability,” one of its most important foundational concepts. This article asks how military ethics should respond to adversaries deliberately conducting hostilities below the threshold of war. Three options are considered: a novel, limited force paradigm; an expanded hostilities paradigm, i.e., within the law of armed conflict; and an international law enforcement paradigm derived primarily from human rights law. None is problem-free. Mindful of under-deployed classic just war reasoning arguments for discrimination between vices opposed to peace, this article argues against an expanded hostilities paradigm and shows that the retributive, (...) ‘equilibrium of justice’ test used sometimes to support such an expansion is necessary but not sufficient. It explains the need for further examination of whether/how Aquinas and his interpreters can/should conceive of actions under the paradigm of war occurring against non-state actors. (shrink)

Focusing on David B. Riazanov career and his pioneering efforts in producing a complete edition of the works of Marx and Engels, the article explains why Riazanov’s variety of Marxism was unacceptable to the Soviet regime, and why from 1924 Lenin was credited with being an outstanding Marxist theoretician, whereas previously he had been regarded only as a skilled political activist. The concept of Leninism as a new stage of Marxism was put forward by Bukharin and elaborated on by Stalin (...) and Zinoviev. Georg Lukács attempted to show that Lenin’s thought had the internal coherence that Bukharin postulated. In support of Lenin’s theoretical credentials, his ‘Philosophical Notebooks’ began to be published from 1925. However, neither Riazanov nor his associate Abram M. Deborin subscribed to the official doctrine that Leninism was a new and higher stage of Marxism. For this stance they fell victim to Stalin’s repression. (shrink)
