The Chilean social outbreak that originated in October 2019 was a manifestation of the constituent power. The people, with a political sense, protested against the unworthy conditions through which life is currently structured in Chilean society. Fundamental rights seek to protect human dignity, a concept that is difficult to grasp. Dignity understood from formalism cannot explain why there are people without material conditions of existence. A material conception of dignity helps to better understand the meaning of the revolt. The current (...) constituent moment invites us to think about the convenience of applying a transformative constitutionalism, which broadens the concept of citizenship and advances in social rights. The article approaches Salomon Maimon’s reinterpretation of the notions of the thing in itself and the given within the framework of criticism. For Maimon they do not refer to a transcendence that is directly unattainable by knowledge. In this attempt, he tries to explain the given on the basis of the action of constitutive understanding. With this, he triggers the passage from transcendental Kantian philosophy to the idealism of Fichte. Nonetheless, his position faces the subsequent problem of explaining how the (...) constitution of the given from understanding (infinite) can become compatible with the criticism it takes on. On affirming that an uncognoscible item is the basis of knowledge, namely, infinite understanding, he set aside the explanation of knowledge in terms of what is revealed in it and in doing so would be resorting to external uncognoscible conditions. RESUMEN En este trabajo intento determinar, a partir de textos escogidos de todas las épocas de la producción teórica de Carl Schmitt, de qué manera este autor entiende la comprensión jurídica y de qué manera este modo de comprensión tiene alcances generales para la comprensión práctica. En la medida en que el derecho tematiza las condiciones y los polos de la comprensión, la posición del jurista se distancia tanto de la inclinación hacia el polo ideal, que Schmitt identifica con la (...) racionalidad tecnológica, cuanto de la inclinación hacia el polo real, que Schmitt liga a ciertas formas del romanticismo y el pensamiento teológico. RESUMO Neste artigo, tento determinar, a partir de textos selecionados de todos os períodos da produção teórica de Carl Schmitt, como esse autor entende a compreensão jurídica e como esse modo de compreensão tem alcance geral para a compreensão prática. Na medida em que o direito estuda as condições e os polos de compreensão, a posição do jurista distancia-se da inclinação para o polo ideal, que Schmitt identifica com a racionalidade tecnológica, bem como da inclinação para o polo real, que Schmitt conecta com certas formas de romantismo e pensamento teológico. De acordo com as interpretações mais conhecidas (por exemplo, Hofmann, Strauss, Löwith ou Kuhn), o pensamento jurídico e político de Carl Schmitt mantém distância de Aristóteles. Este artigo tem a intenção de mostrar que a concepção de direito de Schmitt, apesar de ser desenvolvida em um contexto diferente, contém semelhanças significativas com o entendimento de direito em Aristóteles. Para mostrar essa proximidade, considera-se especialmente a noção de totalidade presente no conceito aristotélico de polis, que implica que a unidade política é (...) o principal modo de se realizar o direito. According to mostly known interpretations (e.g.: Hofman, Strauss, Löwith or Kuhn), the legal and political thought of Carl Schmitt keeps distance from Aristotle's. This article intends to show that Schmitt's concept of law, despite developed in a different context, holds significant likelihood with Aristotle's comprehension of law. With the Purpose of building this proximity, the notion of entirety present in the Aristotelic concept of polis implies that political unit is the main way to accomplish law. (shrink)

En este artículo se analiza el comentario de Maimon al intento kantiano de vincular sensibilidad y entendimiento. En la Crítica de la razón pura, Kant distingue dos facultades de conocimiento, que deben ser unidas para que el conocimiento objetivo sea posible. Maimon cuestiona que la vinculación sea realizable. Luego de exponer el punto de partida kantiano, se analizan los argumentos maimonianos, planteando dificultades sistemáticas que afectarían al intento de vinculación kantiano.

El presente artículo indaga si ¿es el sujeto un ser autónomo en la deliberación política o sonlos pensamientos, las posturas y las formas de la organización política mediadas por las distintas herramientas comunicacionales a las que se ve expuesto quienes lo determinan? Así, analiza larelación que existe entre mass media y política, con la capacidad deliberativa del individuo altomar decisiones en el contexto político, a partir de Chomsky y Han. La metodología es cualitativa con diseño documental, el instrumento son fichas (...) bibliográficas aplicadas a fuentes primarias y secundarias. Se usan bases de datos con el algoritmo: “Neoliberalismo, psicopolítica, big data, medios de comunicación de masas y democracia”. Se analizan 13 libros y 20 artículos. Se identifican las nuevas formas y herramientas de organización política y la relación entre política y medios de comunicación. Se concluye que: 1) el neoliberalismo direcciona la idea de libre mercado hacia el individuo mismo, 2) es necesaria una ciudadanía crítica que tenga un rol más activo en lademocracia, 3) se identifica a la psicopolítica como una nueva forma de organización política, 4) lanueva herramienta de la política es el big data, 5) se evidencia que la relación entre política y massmedia está vinculada con los grupos de poder y 6) la emocionalización de la comunicación políticadisminuye la autonomía individual. Olympic combat sports are unconventional physical activity strategies to train middle-aged and older people with and without health problems. This systematic review aimed to assess the available body of published peer-reviewed articles related to the effects of Olympic combat sports interventions on health-related quality of life in adults aged 45 and older. The search was carried out in five generic databases until July 2021 and the protocol was registered in PROSPERO. The PRISMA guidelines were followed and the Downs and Black (...) checklist was used to assessed the methodological quality of the studies. After reviewing 1,151 records, only seven studies met the inclusion criteria, adding 212 participants with a mean age of 63.7 years. Six studies provided data to calculate the effect size in the Olympic combat sports groups. Three studies reported beneficial changes with a small ES for the total score of the health-related quality of life. Two studies reported a beneficial change with a small ES and strong ES for physical health. One study reported improvements with a small ES for emotional and functional well-being. In conclusion, interventions based on Olympic combat sports produce beneficial effects with a small and moderate ES on health-related quality of life in male and female aged 45 and older who are healthy participants, participants with Parkinson's disease, and participants with breast cancer.Systematic Review Registration:https://www.crd.york.ac.uk/prospero/, PROSPERO: CRD42021244161. Unfounded—conspiracy and health—beliefs about COVID-19 have accompanied the pandemic worldwide. Here, we examined cross-nationally the structure and correlates of these beliefs with an 8-item scale, using a multigroup confirmatory factor analysis. We obtained a two-factor model of unfounded (conspiracy and health) beliefs with good internal structure (average CFI = 0.98, RMSEA = 0.05, SRMR = 0.04), but a high correlation between the two factors (average latent factor correlation = 0.57). This model was replicable across 50 countries (total N = 13,579), (...) as evidenced by metric invariance between countries (CFI = 0.96, RMSEA = 0.06, SRMS = 0.07) as well as scalar invariance across genders (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03) and educational levels (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03). Also, lower levels of education, more fear of COVID-19, and more cynicism were weakly associated with stronger conspiracy and health beliefs. The study contributes to knowledge about the structure of unfounded beliefs, and reveals the potential relevance of affective (i.e., fear of COVID-19) and cognitive (i.e., cynicism) factors along with demographics, in endorsing such beliefs. In this note, the problem of tracking random references and rejecting random perturbations in a quadrotor, both generated by an auxiliary system named exosystem, is solved by extending the deterministic tracking problem to the area of stochastic processes. Besides, it is considered that only a part of the state vector of the quadrotor is available through measurements. As a consequence, the state vector of the plant must be estimated in order to close the control loop. On this basis, a controller (...) to track random references and to reject random perturbations is developed by combining a Kalman filter to estimate the references and perturbations of an exosystem and an observer to estimate the states of a quadrotor. Besides, to obtain a more practical controller, the analysis is carried out in discrete time. Numerical simulations are used in a quadrotor to confirm the validity and effectiveness of the proposed control. (shrink)

In this study, we propose considering membership in the Ethics Officer Association (EOA) as a proxy for the firm's commitment to ethical decision making, and we analyze the influence of firm- and CEO-specific characteristics on this commitment. While we observe a positive relationship between membership and firm size, we also document a negative relationship between EOA membership and the executive's time in position and, to a more modest extent, accounting returns. Background:Decision-making and assessment in emergency situations are complex and result many times in ethical conflicts between different healthcare professionals.Aim:To analyse and describe situations that can generate ethical conflict among nurses working in emergency situations.Methods:Qualitative analysis. A total of 16 emergency nurses took part in interviews and a focus group.Ethical considerations:Organisational approval by the University Hospital, and informed consent and confidentiality were ensured before conducting the research.Result/conclusion:Two categories emerged: one in ‘ethical issues’ and one in ‘emotions and feelings in caring’. The (...) four ethical subcategories are presented: Autonomy, the first sub category: first, the nurse’s ability to practise care on an emergency ward and, second, to support the patient and/or relatives in terms of care and medical treatment. The conflicts arise when the nurse ends up in the middle between the patient and the physician responsible for the diagnosis and treatment from a nature scientific perspective. Reification of injured body: patient was often reified and fragmented, becoming just a leg or arm. Different factors contributed in this perspective. Pain: pain relief was often inadequate but more effectively treated in the emergency medical services than at the emergency department. The nurses highlighted the phenomenon of suffering because they felt that pain was only an object, forgetting the patients’ care need, like separating mind from body. Death: the nurses felt that the emergency services are only prepared to save lives and not to take care of the needs of patients with ‘end-of-life’ care. Another issue was the lack of ethical guidelines during a cardiac arrest. Resuscitation often continues without asking about the patient’s ‘previous wishes’ in terms of resuscitation or not. In these situations, the nurses describe an ethical conflict with the physician in performing their role as the patient’s advocate. The nurses express feelings of distress, suffering, anger and helplessness. (shrink)

Resumen El objetivo principal del artículo es ahondar en la experiencia de la tortura desde una postura fenomenológica con la finalidad de dilucidar las diferencias entre las posibles representaciones de la muerte que una persona puede experimentar y la vivencia de la tortura. De acuerdo con esta investigación, primero explicaré en qué sentido se tomará el fenómeno de la muerte, dando paso a la relación que el dolor y la tortura mantienen, para mostrar que la terrible naturaleza de esta actividad (...) no se encuentra ligada al violento proceso afectivo desencadenado mediante el dolor, sino a la impotencia que el ser humano siente al saberse torturado por otro. De esta forma, se rompe cualquier nexo que el torturado pueda tener con el mundo. La tortura no genera una experiencia realmente dada de la muerte, pero sí proporciona al sujeto trascendental la vivencia más cercana que podría tener de su propia muerte.The main objective in the article is to delve in the experience of torture from a phenomenological stance to elucidate the differences between the possible representations of death that a person can experience and the experience of torture. According to this investigation, first I explain in what sense the phenomenon of death will be understood, to give way to the relation that pain and torture have. In order to show that the terrible nature of torture it is not bound to the affective violent process that is triggered by pain, rather to the helplessness that the human being feels when it knows that he is being tortured by the other. In this way, the tortured breaks any nexus that it may have with the world. Torture does not generate a truly given experience of death, but it does provide the transcendental subject with the closest experience that he may have of his own death. (shrink)

RESUMEN Se realizó un estudio descriptivo transversal cuanti-cualitativo, en función de la caracterización sicológica de los adolescentes con ideación suicida, atendidos en la consulta de Sicología del Centro Comunitario de Salud Mental “Joaquín de Agüero” del área de salud Pirre, Finlay y Norte en la provincia de Camagüey, en el período comprendido desde enero hasta diciembre de 2016. Por ello el objetivo del presente trabajo está dirigido a exponer los principales resultados del proceso de investigación al que se alude. Se (...) operó con un universo de 16 adolescentes. Se utilizó un muestreo intencional puro con criterios de inclusión y exclusión, la muestra quedó conformada por 13. Se emplearon métodos de nivel teórico, empíricos:, Test funcionamiento familiar, Idaren, Ideren, Autoestima de Coopersmith) y métodos estadísticos. Predominó el grupo etario entre 13 a 15 años, sexo femenino, escolaridad secundaria y estado civil soltero. Prevalecieron las familias nucleares monoparentales y reensambladas. El poco tiempo a compartir con los hijos pobre comunicación y conflictos con los padres son factores de riesgo en el funcionamiento familiar. La autoestima se comportó a niveles bajo, con carencia afectiva, sentimientos de soledad, falta de apoyo y poca tolerancia a las frustraciones. Se constataron niveles altos de ansiedad como estado y rasgo, la depresión como estado alto y como rasgo bajo y se encontró dañada la tríada afectiva. ABSTRACT A descriptive transversal quantitative-qualitative study was carried out in order to do a psychological characterization of teenagers with suicidal ideation. They were treated in the psychology consultation of the Joaquin de Aguero Mental Health Community Center from the Pirre, Finlay and North policlinics health area in Camaguey province from January to December 2016. Therefore, this paper is aimed at showing the main results of the research process which is made reference to. Sixteen teenagers were selected as population. A pure intentional sampling with inclusion and exclusion criteria was used and the final sample was 13 teenagers. Different methods were used: theoretical, empirical ), Family functioning test, Idaren, Ideren, Coopersmith Self-esteem) and statistical methods. It prevailed an age bracket between 13 and 15-year-old high school single teens. It prevailed nuclear single-parent and rejoined families. The short time parents share with children as well as the poor communication and the conflicts between them are family functioning risk factors. Self-esteem levels were low, with affection deprivation, loneliness feelings, lack of support and little tolerance towards frustrations. High anxiety levels such as state and trait were confirmed, as well as high state and low trait. The affective triad was found to be damaged. (shrink)

El perfeccionamiento de la disciplina Filosofía y Sociedad en la Educación Superior es una de la exigencias en los Lineamientos al VI Congreso del Partido Comunista de Cuba lo cual contribuye a la preparación de un profesional a la altura de los cambios científico tecnológicos que actualmente despliega la Educación Médica Superior cubana. Para el logro de este propósito se aplicó la simulación educativa como herramienta didáctica avanzada en temas de Ciencia Tecnología y Sociedad en la disciplina Filosofía y Sociedad, (...) la que permitió a los educandos desarrollar habilidades investigativas, un pensamiento científico, político, económico y social así como elevar su nivel creativo y productivo. Development of the discipline of Philosophy and Society in Higher Education is one of the requirements in the guidelines to the 6th Congress of the Communist Party of Cuba which contributes to the preparation of a professional at the height of the scientific-technological changes that Cuban Higher Medical Education currently deploys. For the achievement of this purpose the educational simulation was applied as a teaching tool advanced in terms of science, technology and society in the discipline of Philosophy and Society, which helped the students to develop research skills, scientific, political, economic and social thinking as well as raise their creative and productive level. The aim of this research is to develop and validate a measurement scale for consumer’s perceptions of corporate social responsibility using the three-dimensional social, environmental and economic conceptual approach as a theoretical basis. Based on the stages of measurement scale creation and validation suggested by DeVellis and supported by Churchill Jr.’s :64–73, 1979) suggestions, five different empirical studies are developed expressly and applied to consumers of tourist services. This research involves 1147 real tourists from 24 countries in two different cultural (...) and geographical contexts. A three-dimensional 18-item scale is proposed for measuring consumer perceptions of corporate social, environmental and economic responsibilities. This paper presents the complete development of the scale, as well as the implications and limitations of the main findings and the managerial implications. (shrink)

Cloth, $49.95.Desmond Clarke, commentator on Cartesian natural philosophy, has now published an interpretation of Descartes's dualism, a theme which can hardly be said to be underrepresented in the literature. The monograph is divided into nine chapters concerned with explanation, sensation, imagination and memory, the passions, the will, language, (...) thought, substance, and property dualism—yes, property dualism.The book pushes forward a reading of Descartes's theory of mind, made from a perspective which Clarke has adopted over the last three decades or so, that maintains that Descartes was primarily (and willingly) a scientist and incidentally (and reluctantly) a philosopher. From this viewpoint, according to Clarke, natural philosophy provides the paradigm for genuine explanation in Descartes's metaphysics. Furthermore, given that Descartes rejects Scholastic substantial forms and real qualities as explanatorily infertile and since substances are equally unfruitful, substances play no explanatory role in his system of philosophy. Substance dualism is not at the center of Descartes's philosophy of mind; his account of explanation is. This makes Descartes not a substance dualist; but a property dualist. So argues, in very broad strokes, Clarke. [End Page 116]Unlike us, Descartes did not draw a sharp distinction between philosophy and science. For him, these two realms of enquiry were part of a unified realm of knowledge, what he deemed scientia or philosophy in the wider sense. Hence his use of the instructive metaphor of philosophy as a tree, whose roots are metaphysics, the trunk physics, and the branches the other sciences which he reduces to three principal ones, namely medicine, mechanics, and morals (Letter Preface to Picot, French translation of the Principles of Philosophy, Oeuvres de Descartes, ed. C. Adam and P. Tannery [Paris: Vrin, 1989], 14). However, Descartes did distinguish the roots from the trunk, that is, metaphysics (or "first philosophy") from physics (or "natural philosophy"). Commentators on Descartes's system of philosophy ignore his natural philosophy at their peril, for it does shed considerable light on his metaphysics. But, likewise, Descartes's philosophy greatly illuminates his science. It is for this reason that I want to cast doubt on Clarke's apparent scientific imperialism in which Descartes's methodological, epistemological, and metaphysical concerns are forced to play second fiddle to his scientific views. We cannot neatly fit Descartes's metaphysical views into Clarke's scientific mold, nor can we force them in, without incurring serious error. I do not think that one has to choose between one and the other as being primary, between the tree of knowledge and the inverted tree of knowledge. We need to keep in mind that in Descartes's system of philosophy, both science and philosophy are interconnected and that both parts elucidate each other.Clarke's attempt to eliminate substance from Descartes's account of mind is problematic. True, the term 'substance' is an extremely ambiguous one and Descartes's comments about it are often blurred and puzzling. On the one hand, one must concede that the concept of substance plays a small role in Descartes's natural philosophy, in which although the material universe is depicted in terms of extended substance or res extensa, physics is ultimately unwrapped by way of laws describing the behavior of particles in virtue of their size, shape, and motion. But, in contrast, substance plays a far more prominent role in his metaphysics, not to mention in his theology. This leads to a related point. Clarke overlooks the importance of theology for Descartes's philosophical project and the role of God in Cartesian natural philosophy.The level of argument drops considerably in the final chapter, where Clarke offers an uncritical and not very clear survey of naming and necessity, the identity theory, anomalous monism, and property dualism. This chapter seems in tension with his disapproval of anachronistic readings of Descartes (8-9) and contains some serious slips. Clarke's answer to his own question "Was Descartes, then, a substance dualist" is a mind boggling "Yes and no" (258), and his claim that Descartes was a property dualist, collapses under... (shrink)

Tanto en la _Fundamentación de la metafísica de las costumbres_, cuanto en la _Crítica de la razón práctica_, Kant intenta probar la libertad. La argumentación en ambas obras es distinta. El presente trabajo hace foco especialmente en la justificación de la segunda _Crítica_. En ella, Kant plantea que de la libertad sabemos gracias al hecho de (...) la consciencia moral o de una ley que vincula al sujeto incondicionadamente. Fan culture has grown immensely over the past few years. People are constantly looking up to celebrities and personalities as role models for their fashion, identity, and success. During the stage of adolescence, it is normal for teenagers to admire well- known people and form fan attachments as part of their identity formation. However, this admiration of a specific media figure can be associated with one's personality, cognitive processes, and psychological well-being. Thus, the current study aims to investigate the correlation (...) between celebrity admiration and the self-esteem of 238 Filipino male teenagers. The research instruments, namely Celebrity Attitude Scale (CAS) and Rosenberg Self-Esteem Scale (RSES) were both utilized through google forms. Results have shown high scores on celebrity admiration and the normal range of self-esteem of the participants. Using Pearson’s r correlation coefficient, it was found that celebrity admiration and self-esteem of Filipino male teenagers have a significant relationship that exists in a negative direction. Citizenship regimes are institutionalized systems of formal and informal norms that define access to membership, as well as associated rights and duties. This paper studies illegalized migration as one of the major tests to assess whether citizenship regimes are fair institutions, based on a historical analysis of legislation meant to reduce illegalized migration in the United States between 1995 and 2022. We build our empirical research starting from a simple observation: despite the great number of bills introduced to reduce illegalized (...) migration to the US, most of such initiatives fail to become law. In fact, 93.5% of all immigration initiatives did not even pass the chamber of Congress in which they were originally presented. Such a high rate of failure shows that these proposals are motivated by electoral aspirations, rather than coming from a genuine wish to help migrants or grant them citizenship. Furthermore, there is also an economic interest that justifies the maintenance of low-cost disposable immigrant labor, with no right to citizenship. Our analysis is an example of how state regulation processes seem to work to formalize, rather than alleviate or eradicate, the precarious legal statuses of illegalized migrants. We conclude that a globalized phenomenon such as citizenship requires going beyond merely institutional and formal conceptions. We need to rethink the institutional notion of citizenship, as a merely status held under the authority of a state and consider it from a cosmopolitan perspective and a multilateral basis. But as long as citizenship remains under the responsibility of states, illegalized migrants will continue to experience precarious citizenship. (shrink)

This paper seeks to answer two questions: Is Leopoldo Zea’s position on the neocolonialist system of his days outdated with regard to the situation many of us are living in Mexico and other countries in the world, subject to neocolonial domination right now; or is it possible and pro-per to consider his position as a way of criticism and even as an action proposal to the colonialist outlook nowadays? Why do we hold one position or another? To answer both questions (...) the term ‘neocolonialism’ will be defined and positioned within a historical and theoretical framework. In addition, we will discuss some of the ways this system of domination in Latin American countries is recently manifested. Also, we will offer some of the most important insights Zea had into account when understanding, describing and explaining this situation, and some possible proposals for reflection and action into it.
