El artículo examina, críticamente, la solución que propone Ronald Dworkin para el problema de si los ideales políticos de libertad e igualdad entran en conflicto. El núcleo de mi crítica es que la solución de Dworkin depende de un supuesto dudoso, a saber: que no puede haber casos de colisión entre dos obligaciones de igual importancia. Siguiendo una idea de Ruth Marcus, afirmo, finalmente, que la existencia de dilemas valorativos genuinos no implica, como pretende Dworkin, tener que reconocer que el (...) sistema de principios del agente es internamente inconsistente, ya que esta clase de problema surge más bien de factores circunstanciales. El artículo plantea dudas sobre la interpretación que Crelier hace de la ética kantiana en relación con los conflictos de deberes o dilemas. Argumentamos que, a pesar de las declaraciones de Crelier en sentido contrario, él no logra articular una interpretación de la ética de Kant en la que los dilemas morales sean admisibles. En la interpretación de Crelier, sostenemos, los dilemas que son admisibles son sólo aparentes o epistémicos. Pero no queda cabida para aquellos dilemas en los que ninguno (...) de los deberes es, objetivamente, superior a otro deber en conflicto. (shrink)

This introduction just aims to be a fast foreword to the special topic now turned into an e-book. The Editorial "Decision-Making Experiments under a Philosophical Analysis: Human Choice as a Challenge for Neuroscience" alongside with my opinion article "Neurophilosophical considerations on decision making: Pushing-up the frontiers without disregarding their foundations" play the real role of considering in more details the articles and the whole purpose of this e-book. What I must highlight in this foreword is that our intention with such (...) a project was to deepen into the very foundations of our current paradigms in decision neuroscience and to philosophically moot its foundations and repercussions. Normal Science (a term coined by Philosopher Thomas Kuhn) works under a research consensus among a scientific community: A shared paradigm, consolidated methods, widespread convictions. Pragmatically, winning formulas must be kept, although, not at any cost. What differentiates a gifted and revolutionary scientist from a more bureaucratic colleague is the capacity and willingness of constantly reevaluating, depurating and refining his/her own paradigm. That is best strategy to avoid that a paradigm itself would gradually come under challenge. In my view, some achievements, in this sense, were brought about in our project. The e-book will be inspiring and informative for both neuroscientists that are concerned with the very foundations of their works and for philosophers that are not blind to empirical evidence. Kant once said: “Thoughts without content are empty, intuitions without concepts are blind”. Paraphrasing Kant we could say: Philosophy without science is empty, science without philosophy is blind. El presente proyecto de investigación se ubica en el marco del equipo Innova de la Universidad de Deusto. “El equipo Innova es un equipo de investigación interfacultaticio que tiene como propósito el desarrollo de la innovación desde una perspectiva multifocal, ya que trata aspectos tan diversos como: organizativos, formativos y estructurales.” En este contexto se espera que la presente investigación pueda realizar una aportación sustancial en lo relativo al papel que desempañan las Competencias Genéricas en los procesos de educación superior. (...) Se estima que los resultados por alcanzar en este trabajo habrán de responder a demandas que se presentan en el contexto educativo actual, en el marco de una sociedad caracterizada por la complejidad. Uno de los aspectos innovadores que define a esta indagación es, en el concierto de la interdisciplinariedad mencionada líneas arriba, el abordar cuestiones centrales del saber pedagógico bajo la perspectiva de la Hermenéutica filosófica. Puntualmente se toman aquí dos temas que son muy caros para la Pedagogía, el primero de ellos es ‘el problema de la comprensión’ y el otro lo concerniente a la ‘significatividad’. En la literatura preponderante en el ámbito pedagógico el abordaje de estas dos categorías se realiza recurriendo a los aportes de la psicología cognitiva. En el presente trabajo se asume este dato, pero se aborda sistemáticamente desde otro campo disciplinar como es la Hermenéutica filosófica. Las disciplinas filosóficas en general y en este caso particular la Hermenéutica, entran en diálogo con diversos campos científicos, como aquí lo hacen con la Pedagogía, bajo una perspectiva crítica y, a la vez, totalizante. Es decir, procuran reunir los aportes de los diversos campos científicos al tiempo de atender las articulaciones y las tensiones que entre ellos puedan surgir, al abordar el problema desde un horizonte más amplio que el que cae bajo el específico objeto de estudio de cada disciplina. Se busca, de este modo, una adecuada articulación entre los aportes específicos de cada campo científico bajo una lectura integradora que es propia de la Filosofía. Este posicionamiento es fundamental y, en este sentido innovador, al procurar enriquecer el campo de las Competencias Genéricas mediante las ‘Competencias Semánticas’, que se mueven en el ámbito de la significatividad y el sentido, requisitos imprescindibles para que un sujeto pueda posicionarse personal y comunitariamente en una sociedad compleja. Para lograr este cometido se ha recurrido a una metodología de investigación cualitativa de análisis de contenido, que se ha aplicado a una selección de obras que refieren a la hermenéutica de H-G. No presente artigo, analisamos as abordagens de António Damásio e Gerald Edelman sobre a consciência e fazemos um paralelo com as teses apresentadas pelo filósofo John Searle. Recorremos também às críticas dos filósofos Bennett e Hacker como pedras de toque da viabilidade de algumas teses. Desse modo, apresentamos uma revisão sistemática da obra de Damásio, Edelman e Searle, a fim de promover um diálogo produtivo entre as ideias defendidas por estes autores, os quais, segundo nossa interpretação, assumem uma teoria do (...) campo unificado da consciência. Pegaso Zorokin es una novela experimental que fue publicada en 2012 en cinco volúmenes de la revista digital [Radiador] Magazine. Está compuesta por veintitrés capítulos sin aparente conexión entre ellos. Esta estructura complica una lectura global y pone en crisis la idea de novela. Sin embargo, es posible encontrar continuidad dentro de los fragmentos si se atiende a los puentes hipertextuales dentro del texto. Estas conexiones logran la unidad buscada. La conformación de la novela es muy similar a la de (...) cualquier red social digital. El objetivo de este artículo es explicar este funcionamiento dinámico. El trabajo analítico fue realizado bajo un método semiótico que involucra los conceptos semiósfera y persona semiótica de Yuri Lotman; hipertextualidad de Gerard Genette y propagabilidad de Gabrielle Marino. El análisis fue aplicado a tres de las cinco entregas de la novela de Arana, demostrando que el texto está compuesto por una red interna cohesionadora. (shrink)

This article sets forth a compositional model of ideology by drawing on the tradition of historical materialism and further developing its insights into the aesthetic composition of reality. It demonstrates how ideology is not simply a set of false beliefs but is rather the process by which social agents are composed over time in every dimension of their existence, including their thoughts, practices, perceptions, representations, values, affects, desires, and unconscious drives. By working through a number of diverse debates and authors—ranging (...) from Karl Marx and Friedrich Engels to Louis Althusser, Eduardo Galeano, Rosaura Sánchez, and Paulo Freire—it thereby elucidates how ideology is best understood as an aesthetic process that includes aspect of sense and sense-making, and that therefore requires a collective, cultural revolution as its antidote. El artículo problematiza el abordaje de la ética en la investigación en psicología con infancias en el siglo XX y su articulación con los códigos y principios éticos. Se elaboran tres puntos de inflexión con la literatura en la materia, a saber: (1) un cuestionamiento en la producción de universales que ponen siempre la exclusión de un singular susceptible de ser sometido a suplicio, (2) desplazamiento de la idea de que existe una buena y una mala lectura de los documentos (...) prescriptivos para instalar un énfasis en la multiplicidad de lecturas y usos que se desprenden de los marcos legales, normativos, deontológicos y heurísticos; y (3) una observación de la figura del investigador realzando su carácter marcado en una posición dentro de dinámicas socio-histórico-materiales. Son abordados dos casos de experimentación con infancias en psicología, correspondientes al caso del Pequeño Albert por John B. Watson y Raslie Rayner en 1920, y el protocolo experimental de la Situación Extraña realizado en la década de 1970 por Mary Ainsworth y que fue la base de la Teoría del Apego inventada por John Bowlby. Se concluyen una serie de desafíos para la formación en ética de la investigación en psicología que exceden los márgenes de un enfoque centrado en el conocimiento y manejo de marcos legales, normativos, deontológicos y heurísticos para la resolución de dilemas éticos. Proportionality is generally taken for granted or enthusiastically promoted or accepted with minor qualifications. A Critique of Proportionality and Balancing presents a frontal challenge to this orthodoxy. It provides a comprehensive critique of the proportionality principle, and particularly of its most characteristic component, balancing. Divided into three parts, the book presents arguments against the proportionality test, critiques (...) the view of rights entailed by it, and proposes an alternative understanding of fundamental rights and their limits. Multiple studies show that periodic reanalysis of genomic test results held by clinical laboratories delivers significant increases in overall diagnostic yield. However, while there is a widespread consensus that implementing routine reanalysis procedures is highly desirable, there is an equally widespread understanding that routine reanalysis of individual patient results is not presently feasible to perform for all patients. Instead, researchers, geneticists and ethicists are beginning to turn their attention to one part of reanalysis—reinterpretation of previously classified variants—as a means of (...) achieving similar ends to large-scale individual reanalysis but in a more sustainable manner. This has led some to ask whether the responsible implementation of genomics in healthcare requires that diagnostic laboratories routinely reinterpret their genomic variant classifications and reissue patient reports in the case of materially relevant changes. In this paper, we set out the nature and scope of any such obligation, and analyse some of the main ethical considerations pertaining to a putative duty to reinterpret. We discern and assess three potential outcomes of reinterpretation—upgrades, downgrades and regrades—in light of ongoing duties of care, systemic error risks and diagnostic equity. We argue against the existence of any general duty to reinterpret genomic variant classifications, yet we contend that a suitably restricted duty to reinterpret ought to be recognised, and that the responsible implementation of genomics into healthcare must take this into account. The use of genomic testing in pregnancy is increasing, giving rise to questions over how the information that is generated should be offered and returned in clinical practice. While these tests provide important information for prenatal decision-making, they can also generate information of uncertain significance. This paper critically examines three models for approaching the disclosure of variants of uncertain significance (VUS), which can arise from forms of genomic testing such as prenatal chromosomal microarray analysis (CMA). Contrary to prevailing arguments, we (...) argue that respect for reproductive autonomy does not justify adopting a model on which an offer to disclose VUS is a routine part of genetic counselling. Instead, we contend that a commitment both to solidarity between healthcare providers and pregnant women and to the acceptance of a novel principle of caution under normative uncertainty means that we should instead adopt a model of VUS disclosure that imposes a strong presumption against offering to disclose VUS. The upshot of this is that it should be standard practice to only offer to disclose VUS when this is requested by the woman undergoing CMA. We defend our position against claims that arise from an alleged right to such information and that a presumption against an offer will lead to inequity. (shrink)

Los estudios de acción colectiva y de cooperación en la provisión de bienes públicos hechos desde la sociología analítica son instrumentos de gran utilidad y relevancia tanto para la reflexión sociopolítica como para el diseño de políticas públicas democráticas. En ese sentido, pensar la acción colectiva -en sentido amplio como el terreno de la constitución de lo social y de la configuración de resultados sociales relevantes desde los intereses de los diversos grupos que componen lo social- es y debiera ser (...) de gran provecho para los cientistas sociales interesados en definir y diseñar entornos sociales más horizontales y justos territorialmente. El presente artículo recoge algunas notas de estudio emanadas de una investigación realizada en algunas ciudades hispanoamericanas respecto de los temas citados. (shrink)

En este documento se intentará argumentar que los procesos de constitución de provisión de bienes públicos involucran necesariamente un problema de acción colectiva y que el diseño de políticas públicas son procesos de carácter esencialmente político y no técnico, como se promueve desde el neoliberalismo. De esta manera, para ser democráticos y pretendidamente no conflictivos deben ser necesariamente deliberativos.

A common objection to the use of balancing tests in human rights adjudication is that it is not possible to perform a quantitative comparison between gains and losses for rights or the public good by means only of rational criteria. Here I provide a general account of the incommensurability objection, with the aim of making explicit its scope, and of dispelling some common misconceptions surrounding it. Relying on this account, I engage with recent defences of balancing against the incommensurability objection.

A pesar de su singular condición urbana, de su atractivo internacional, y de ser la segunda ciudad en importancia de Chile, Valparaíso no cuenta con una suficiente historiografía de su pasado urbano. Este artículo pretende ser un aporte a ella, teniendo a los cerros como protagonistas, para estudiar su la etapa inicial de poblamiento. Se centra en el proceso en que se fueron instalando viviendas - que constituyeron una fisonomía urbana particular, además de barrios-, en los distintos cerros de Valparaíso, (...) diferenciando etapas tanto en alturas como en cerros. Se pone especial atención, también, en los tipos de viviendas pobres y serranas de esa época y, finalmente, en las conclusiones, se plantean algunos problemas de investigación futura, relativos al urbanismo histórico de los cerros de Valparaíso. Despite its singular urban condition, its international appeal, and being the second largest city in Chile, lacks of good good historiography on its urban past. This article aims to contribute to it, taking the hills as protagonists, in order to study the initial stage of settlement. It focuses on the process that were installed housing - which constituted a particular urban appereance and neighborhoods -, in the differents hills of Valparaiso, differing stages in heights, and hills. Special attention is placed also in the types of poor and in hills housing, including huts, tenements and cités, and, finally, in the conclusions, I proposed a few research problems about the historic urbanism in the hills of Valparaíso. In recent years, many disciplines have become interested in the scientific study of morality. However, a conceptual framework for this work is still lacking. In The Moral Background, Gabriel Abend develops just such a framework and uses it to investigate the history of business ethics in the United States from the 1850s to the 1930s. According to Abend, morality consists of three levels: moral and immoral behavior, or the behavioral level; moral understandings and norms, or the normative level; and (...) the moral background, which includes what moral concepts exist in a society, what moral methods can be used, what reasons can be given, and what objects can be morally evaluated at all. This background underlies the behavioral and normative levels; it supports, facilitates, and enables them. Through this perspective, Abend historically examines the work of numerous business ethicists and organizations--such as Protestant ministers, business associations, and business schools--and identifies two types of moral background. "Standards of Practice" is characterized by its scientific worldview, moral relativism, and emphasis on individuals' actions and decisions. The "Christian Merchant" type is characterized by its Christian worldview, moral objectivism, and conception of a person's life as a unity. The Moral Background offers both an original account of the history of business ethics and a novel framework for understanding and investigating morality in general. (shrink)

In international law and the ethics of war, there are a variety of actions which are seen as particularly problematic and presumed to be always or inherently wrong, or in need of some overwhelmingly strong justification to override the presumption against them. One of these actions is assassination, in particular, assassination of heads of state. In this essay I argue that the presumption against assassination is incorrect. In particular, I argue that if in a given scenario war is justified, then (...) assassination of the enemy state's leader is also justified, and in fact ought to be pursued as a means short of war. I defend this position on both consequential and deontic grounds, arguing that assassination is both more discriminate than war and serves to harm only those most responsible for the situation which justifies war in the first place. I conclude by arguing that a norm of assassination, far from being a destabilizing force, as some have argued, would in fact serve to reinforce international norms of rights and respect for persons by making clear that tyrants and would-be oppressors cannot hide behind military forces or notions of sovereignty to protect themselves from judgment and retribution. Adding a transparent truth predicate to a language completely governed by classical logic is not possible. The trouble, as is well-known, comes from paradoxes such as the Liar and Curry. Recently, Cobreros, Egré, Ripley and van Rooij have put forward an approach based on a non-transitive notion of consequence which is suitable to deal with semantic paradoxes while having a transparent truth predicate together with classical logic. Nevertheless, there are some interesting issues concerning the set of metainferences validated by this (...) logic. In this paper, we show that this logic, once it is adequately understood, is weaker than classical logic. Moreover, the logic is in a way similar to the paraconsistent logic LP. (shrink)

This paper focuses on the extension of AGM that allows change for a belief base by a set of sentences instead of a single sentence. In [FH94], Fuhrmann and Hansson presented an axiomatic for Multiple Contraction and a construction based on the AGM Partial Meet Contraction. We propose for their model another way to construct functions: Multiple Kernel Contraction, that is a modification of Kernel Contraction, proposed by Hansson [Han94] to construct classical AGM contractions and belief base contractions. This construction (...) works out the unsolved problem pointed out by Hansson in [Han99, pp. 369]. (shrink)

Until now, North American and European philosophies have been engaged in debates about the possibility of a postmetaphysical philosophy and the consequences of the linguistic turn for the assessment of modernity; they have done so, however, without departing from the narrow horizons of their respective nationalistic perspectives. In this incisive critique, Dussel demonstrates how most of thse philosophies have either failed to give historically faithful analyses of the genesis of the "myth" of modernity, or have never engaged in a serious (...) questioning of their own Eurocentric presuppositions. He shows how North American and European philosophers have presupposed a no-longer-acceptable philosophy of history that has led them to fall into a "developmental fallacy," the belief that there is a linear sequence that moves from the premodern, underdeveloped, or on the way to industrialization, to the modern, developed, and industrialized. Por un lado, que el modelo chileno se conforma a partir de una versión específica del concepto de libertad, esto es, de una versión específicamente liberal y conservadora de este; y por otro, que en la teoría política podemos encontrar una amplia gama de acepciones distintas sobre el concepto de libertad, lo que dice relación con el pluralismo conceptual, semántico y doctrinario propio de la filosofía política (...) moderna. Seguidamente, hace una revisión panorámica tanto de la libertad liberal y sus derivados, como de la comunitarista y la republicana estándar, centrándose en la idea republicana democrática de libertad material que propone Antoni Domènech, que es la perspectiva de diseño institucional que el autor del texto suscribe. . This paper argues that legal philosophy is a social practice undertaken by participants whose views have primacy over non‐participants. This social practice is dynamic, constructive and based on understanding and explanation, in order to meet normative expectations. Legal Philosophy should include Legal Ontology, Legal Epistemology and a Theory of Justice. It is usually claimed that legal philosophy is a branch of a genus called philosophy, but there is no one single definition of it.
