Throughout Western philosophy, there have been frequent attempts to uncover the history of morals. The basic idea is that moral convictions may emerge through an historical process, as opposed to, say, deriving from rational deliberation. This effort to trace back the origins of morals has been pursued in different ways with different objectives. Nietzsche’s On the Genealogy of Morals may be the most famous example, but it is not alone.1 Other efforts can be found within British (...) moral philosophy, for example, and in the Marxist tradition, with roots in Hegel. In order to clarify the relationship between morality and law, it is necessary to define both concepts precisely. Cultural realities refer to concepts which are more specifically defined if we focus towards the genealogy of those realities, that is to say, their motivation, function and aim. Should we start from legal anthropology, comparative law and history of law, law arises as a social technique which coactively imposes ways of solving conflicts, protecting fundamental values for a society's co-existence. Values subject (...) to being protected are proposed by morality, the latter making subordination of law to morality inevitable. This explains that a great number of modern constitutions include a reference to fundamental moral values, that is to say, they have explicitly positivised moral contents. Legal reasoning, at all levels and expressions, needs to appeal to the aforementioned values. Constitutional reasoning, international law, legislative activity and judicial practice are studied to verify the latter. This subordination of law to morality sets out a serious problem: moralities are cultural realities which are only valid for a specific society. In order for law not to fall in a not very rational legal relativism, law should not be subordinated to morality, but to ethics, the latter understood as cross-cultural morality. “The genealogy of morals” is, most famously, a pair of genealogies: that of the good/evil dichotomy in the First Treatise, and that of the bad conscience in the Second Treatise. But the straightforward presentation of these two narratives is subverted even before it begins. Nietzsche classifies the book not as a treatise or inquiry but as a “polemic”; voices interrupt the narrative to insist that much is left unsaid; the narratives are framed by, of all things, reflections on (...) the scientific conscience; Nietzsche declares the entire enterprise to be a contribution to the critique of “the value of values”; the two genealogies of the first two Treatises overlap and various points and ultimately converge in a discussion of the “meaning” of the “ascetic ideal.” Whatever one makes of these complications, two tentative conclusions can be drawn. The so-called “analytical” appendix to the first part of Spinoza’s Ethics has at times puzzled scholars. It notably breaks with the geometrical method adopted in most of the text, and includes an impassioned argument against teleology, popular morality, and, ultimately, the faculty of imagination. In this essay I seek to resolve this interpretive difficulty by side-by-side comparison with philosophical resources from one of Spinoza’s main influences. In particular, I argue that analysis of the appendix to the first part of his (...) Ethics is benefitted by comparison with certain Maimonidean arguments regarding the “imagination”—themselves part of a long tradition of debate on the powers of the imaginative faculty in ancient and medieval philosophy—contained in The Guide of the Perplexed. I introduce and trace this connection across both texts. This helps us to better appreciate both the appendix and its place within the Ethics and Spinoza’s sustained, complicated relationship with Medieval Judaism’s greatest thinker. (shrink)

SummaryPedigree structures of 161 uncle/niece-aunt/nephew and 4420 first cousin consanguineous marriages registered during the 19th and 20th centuries in two large and very different Spanish regions have been analysed and their genetic consequences evaluated. The frequencies of the different pedigree subtypes within each degree of relationship were quite similar in both populations despite significant heterogeneity in inbreeding patterns. The mean X-linked inbreeding coefficient for each type of cousin mating was calculated and compared to that expected for autosomal genes. Preferentiality and avoidance of close consanguinity along with specific types of pedigrees are discussed on the basis of premarital migration and sociocultural rules still deeply rooted in certain human groups. On the Genealogy of Morality is Nietzsche's most influential book but it continues to puzzle, not least in its central claim: the invention of Christian morality is an act of revenge, and it is as such that it should arouse critical suspicion. In The Will to Nothingness, Bernard Reginster makes a fresh attempt at understanding this claim and its significance, inspired by Nietzsche's claim that moralities are 'signs' or 'symptoms' of the affective states of moral agents. The relation between (...) morality and affects is envisioned as functional, rather than expressive: the genealogy of Christian morality aims to reveal how it is well suited to serve certain emotional needs. One particular emotional need, manifested in the affect of ressentiment, plays a prominent role in the analysis of Christian morality. This is the need to have the world reflect one's will, which is rooted in a special drive toward power, or toward bending the world to one's will. Revenge is plausibly understood as aiming to bolster or restore power, and the invention of new values is a particular way to do so: by altering the agent's will, it alters what counts as power for her. By revealing how it is well suited to play such a functional role in the emotional economy of moral agents, the genealogical inquiries arouse critical suspicion toward Christian morality. The use of this moral outlook as an instrument of revenge is problematic not because it is immoral, but because it is functionally self-undermining. (shrink)

The first is found in the tradition of those whom Nietzsche calls "English psychologists"; the second is Nietzsche's own. I begin by giving an account of the resources of "English" genealogy as represented by Paul Rée and especially Charles Darwin. On the basis of that discussion, I consider Nietzsche's objections to English genealogy in detail. I argue that (...) as they stand, these objections are inconclusive; while they are, at least to a certain extent, effective against Rée, they fail as objections to the fundamental insights of Darwin. Moreover, I argue that on reflection, the rival genealogy that Nietzsche puts forward is not nearly as well supported and cannot plausibly bear the weight of explanation alone. Someone once correctly said: “where your treasure is, there your heart will be also”;1 our treasure is where the beehives of our knowledge are. We are always on the way to finding it; as winged creatures and honey-gatherers of the spirit, we truly care (...) for only one thing from the heart: to “bring something home.” Whatever else concerns life, the so-called “experiences” – who among us has enough seriousness for them? Or enough time? In these matters we have been, I fear, somewhat distracted: our hearts have not quite been in it, and not even our ears! More often, like some divine scatter-brain absorbed-in-himself into whose ear the bell has tolled the twelve strikes of noon at full power, who then suddenly wakes up and asks himself, “What was really just struck?”, just like that we rub our ears afterwards and ask, completely amazed, completely embarrassed, “what did we really experience?” and further, “who are we really?” and afterwards, as said, count the twelve trembling bell-strikes of our experience, our life, our being – ugh! and miscount them . . . We necessarily remain strangers to ourselves, we do not understand ourselves, we must get ourselves wrong, for us the saying “Each is furthest from himself” holds for all eternity – we are not “knowing ones” with respect to ourselves. _Ressentiment_—the hateful desire for revenge—plays a pivotal role in Nietzsche’s _On the Genealogy of Morals_. _Ressentiment _explains the formation of bad conscience, guilt, asceticism, and, most importantly, it motivates the "slave revolt" that gives rise to Western morality’s values. _Ressentiment_, however, has not enjoyed a thorough treatment in the secondary literature. This book brings it sharply into focus and provides the first detailed examination of Nietzsche’s psychology of _ressentiment_. Unlike other books on the _Genealogy_, it uses _ressentiment_ as a (...) key to the _Genealogy_ and focuses on the intriguing relationship between _ressentiment_ and justice. It shows how _ressentiment_, despite its blindness to justice, gives rise to moral justice—the central target of Nietzsche’s critique. This critique notwithstanding, the _Genealogy_ shows Nietzsche’s enduring commitment to the virtue of _non-moral_ justice: a commitment that grounds his provocative view that moral justice spells the ‘end of justice’. John Stuart Mill, whose relevance for Nietzsche’s late work has been documented by recent research, is not directly mentioned in On the Genealogy or Morality (1887). This article argues that Mill’s On Liberty (1859) nevertheless played a crucial role in the development of the Genealogy. Following a source-based methodology, three major references demonstrate how Nietzsche used On Liberty as a resource as he initiated and developed his own exploration into the origin of morality. After tracing Nietzsche’s reading of (...) Mill through pencil marks in his copy of On Liberty, I discuss the reappearance of Mill’s motives and terminology as well as the explanatory power of Mill as a source for the respective sections in the Genealogy. It becomes clear to what extent Nietzsche adapts Mill and how he turns Mill’s own weapons against him through skillful transformations. The article concludes that instead of delivering the “better” Mill, Nietzsche builds up a fruitful tension between a then-common take on morality and its transgression. (shrink)
