The answers to these two questions would have been obvious years ago: Human beings, of course, machines are instruments of human design! But now days when we speak so much of progress, science and technology as if progress, science and technology were in themselves values to be venerated, there are many people that think that machines as they become more and more complex and intelligent through human design, may in fact become alive so that they may supplant us as a (...) natural outcome of that very venerated progress and expansion of intelligence. Also many people seems to think that evolution is changing its nature so that technology is becoming the guiding force in the flow of the cosmic change in relation to us. I do not hold this view. I do not look at progress, science or technology as if they were values in themselves, nor do I think that biological or cosmic evolution is changing its nature or character. I think that the question that we human beings must face is that of what do we want to happen to us, not a question of knowledge or progress. The question that we must face is not about the relation of biology with technology, or about the relation between art and technology, nor about the relation between knowledge and reality, nor even about whether or not metadesign shapes our brains. I think that the question that we must face at this moment of our history is about our desires and about whether we want or not to be responsible of our desires. (shrink)

Raz holds that necessarily all legal authorities, even de facto authorities, make a claim to legitimate authority. He does not say that legitimacy is a necessary property of law. This view, which I call the claim view, constitutes my focal point in this paper. Many commentators have criticized this view. I discuss and dismiss three critiques of the claim view: the verification critique (the claim view is not empirically confirmed), the legalistic critique (law claims legal authority, not moral authority), and (...) the semantic critique (legal obligations are semantically distinct from moral obligations). I submit that Raz equates the meaning of legal duties with that of moral duties and yet denies that legal statements entail moral propositions. In other words, I distinguish the semantic identity thesis from the semantic entailment thesis. Instead of a semantic interpretation of the claim view, I defend a presuppositional ascription of a general claim to moral authority to authoritative duty‐imposing and normatively committed uses of legal language by official spokesmen. I show that law’s claim to authority does not prove the truth of the sources thesis, because conceptual confusion or insincerity can affect the epistemic reliability of the propositions embodied in the claim, and because blatant immorality can altogether cancel law’s pragmatically presupposed claim to moral authority. I also argue that the claim view can only warrant two qualified versions of exclusive legal positivism, one of which is almost tautological, the other self‐contradictory. Finally, I suggest that exclusive legal positivism cannot be defended on conceptual grounds. (shrink)

From the second half of the last century, there has been a widespread view in the Anglophone world that Kant’s transcendental deduction (aka TD) aims to vindicate our common-sense view of the world as composed of public and objective particulars against some unqualified forms of skepticism. This widespread assumption has raised serious doubt not only about the success of TD but also about the very nature of its argument in both editions of the Critique. Yet, if there is a connection (...) between TD and global skepticism, the intriguing question is: Who is this skeptic? According to Strawson, “the skeptic” is a hypothesis of a purely sense-datum experience. In contrast, the fact that TD turns on the key notion of self-consciousness has induced several other scholars to assume that the skeptic is no none but a Cartesian external-world skeptic. None of those readings find textual support or are compatible with the very structure of the first Critique. The question is: Does this mean that TD aims only to undermine empiricism, as Guyer suggests? I do not believe so. I am pretty convinced that TD addresses a peculiar form of global skepticism, namely “Hume’s challenge to reason.” Assuming that we cognize (erkennen) and experience (erfahren) appearances as objects as a requirement of Newtonian physics, TD aims to provide a justification of the principle that nature is uniform that is superior to Hume’s justification. This paper is a defense of the so-called phenomenal-concept strategy, based on a new view of phenomenal concepts as special de re modes of presentation of the phenomenal character of experience. Phenomenal concepts can be explained in physical terms as mental particulars (as phenomenal files) created in the individual’s mind to pick out the phenomenal character of experience by representing certain physical properties as those represented by the experiences themselves (metarepresentation). They are individuated by two fundamental relations: the perceptual (acquaintance) (...) relation the creature bears to the physical properties represented by its own experience and the relation the creature bears to itself (self-acquaintance) as the subject undergoing those experiences. Mary’s newly acquired phenomenal file presents the phenomenal character of her new experience of red by means of the new relation she bears to herself as the creature standing in the experiential relation to the color red. Our purpose in this essay is to introduce new concepts in a wide and recursive view of the systemic consequences of the following biological facts that I and we have presented that can be resumed as: that as living systems we human beings are molecular autopoietic system; that living systems live only as long as they find themselves in a medium that provides them with all the conditions that make the realization of their living possible, that is, in the continuous (...) conservation of their relation of adaptation to the circumstances in which they find themselves; that as a living system exists only in a relation of adaptation with the medium that operates as its ecological niche, its reproduction necessarily occurs as a process of systemic duplication or multiplication of the ecological organism-niche unity that it integrates; that the worlds of doings that we generate as languaging beings in our conversations, explanations, reflections and theories are part of our ecological niche; and that we human beings as living beings that exist in languaging, are biological–cultural beings in which our cultural and our biological manners of existences can be distinguished but cannot be separated. Of the systemic consequences of these biological facts that we consider in this essay, we wish to mention two as the principal: that the diversification of manners of living produced in biological evolution is the result of differential survival in a changing medium through the conservation of adaptation, and not through competitive survival of the best; and that we in our living as languaging human beings are the epistemological fundament of all that we do and know as such. No doubt I shall repeat things that I have said in other publications (Maturana and Varela 1980 and 1988), and I shall present notions that once they are (...) said appear as obvious truisms. But the reader it is not invited to attend to the truisms, rather he or she is invited to attend to the consequences that they entail for the understanding of biological processes. Autopoiesis 1.1 Origins of the notion In November 1960, a first year medical student asked me the question “What began three thousand eight hundred million years ago so that you can say now that living systems began then?” I realized that I could not properly answer that question, so I said “I cannot answer this question now, but if you come back next year I shall propose an answer then.” Thus I accepted the question of the student to be answered later, and as I did so, I accepted also the question for myself. I realized that to answer this question I had to create a living system, either conceptually or practically, because I had to be able to say what kind of systems were living system to be able to say how they began. While in the attempting to answer the dual questions of what kind of systems are living systems, and of how did they begin so that I could now speak of their origin, it became obvious to me that living systems exist as autonomous entities in the form of self contained closed molecular dynamics of self production, open to the flow of molecules through them. Indeed, one can say that living systems arose in the history of the earth in the moment in which some spontaneous networks of molecular autocatalytic processes became closed upon themselves.. No caminho dos trabalhos que versam sobre as questões envolvendo a autonomia da arte, categoria da Estética desde a modernidade, este artigo visa desenvolver explanações sobre dois autores, Arthur Schopenhauer e Herbert Marcuse que, devedores da estética kantiana, possuem perspectivas que permitem reflexões sobre a autonomia da arte, ainda que Marcuse se posicione como um crítico da perspectiva representada por Schopenhauer. Designadamente, este artigo apresentará a compreensão estética do filósofo Arthur Schopenhauer - na obra principal deste autor, O Mundo Como (...) Vontade e Representação – sobretudo o lugar do gênio artístico na obra do filósofo alemão, bem como apresentará os apontamentos do filósofo Herbert Marcuse na obra Dimensão Estética, de 1977, que sintetiza as principais questões da estética do autor. Eugenio Bulygin sostiene que la teoría de la clausura necesaria de los sistemas normativos de Joseph Raz se origina en el error de tomar a los permisos débiles o negativos como soluciones normativas. Bulygin cree que Raz omite advertir que los enunciados jurídicos son proposiciones normativas de segundo nivel y que las únicas permisiones capaces de cerrar el sistema jurídico son las permisiones fuertes o explícitas. En este trabajo sostengo que Raz se refiere a un tipo de clausura que es (...) inconcebible en el contexto de un programa reduccionista como el de Bulygin. Una vez que se visualiza que los enunciados jurídicos son proposiciones prácticas del primer nivel, parece obvio que la regla de clausura de Raz es un teorema deóntico. Eugenio Bulygin claims that Joseph Raz's theory on the necessary closure of normative systems derives from the error to take weak or negative permissions as normative solutions. Bulygin believes that Raz fails to notice that legal statements are second-level normative propositions and that the only permissions capable of closing a normative system are strong or explicit permissions. In this paper I argue that Raz focuses on one kind of closure that is inconceivable within the context of a reductionist program such as Bulygin's. Once one visualizes that legal statements are first-level practical claims, it seems obvious that Raz's closure rule is a deontic theorem. (shrink)

En este trabajo critico la interpretación moralizada de la obligación política en Hobbes que defiende Luciano Venezia. Exploro una lectura diferente que evita una dicotomía tajante entre las razones prudenciales y las razones morales y subraya en cambio la discontinuidad entre la normatividad subjetiva de la ley natural y la normatividad objetiva de la ley positiva. Sostengo que el contrato de sujeción política establece obligaciones objetivas recién cuando el soberano exige el cumplimiento de los contratos. La obligación política es entonces (...) una forma de obligación jurídica. Además, enfatizo que la comunidad moral de Hobbes solo es posible dentro del Estado. In this paper, I criticize Luciano Venezia's moralized interpretation of the Hobbesian concept of political obligation. I explore a different reading that avoids a clear-cut dichotomy between prudential and moral reasons and underscores instead the discontinuity between natural law's subjective normativity and civil law's objective normativity. I contend that the pact of political subjection establishes objective obligations only when the sovereign requires the fulfillment of contracts. Political obligation is then a form of legal obligation. In addition, I emphasize that Hobbes's moral community is only possible within the State. (shrink)

Tras señalar que las investigaciones sobre la relación entre medicina y estado durante el Tercer Reich han alcanzado un desarrollo casi exponencial, el artículo postula que durante el nazismo la medicina fue servil instrumento de una estrategia global de subyugación, dirigida tanto a los pueblos sometidos por las armas como hacia la propia población alemana. Señala que el terror adujo argumentos para legitimar el exterminio de “vidas sin valor”, y condujo a desarrollar experimentos con seres humanos sobre la base de (...) una “racionalidad de fin de los tiempos”, donde los médicos participantes parecían estar liberados de todo principio de ética médica. Podemos afirmar que las investigaciones realizadas sobre esta “medicina sin humanidad” han influido profundamente en nuestra visión actual. Y la sobria constatación de que es posible tal ruptura de límites éticos puede crear bases sociales y culturales para prevenir su repetición. (shrink)

This paper aims to offer a new metaphysical view of both the representational content and the phenomenal or conscious character of visual experience inspired by Kaplan’s semantics of demonstratives. In Kaplan’s famous account, the character or meaning of a demonstrative type is understood as the function of a particular token of that type (vehicle of content) in the context of the demonstration of the singular content in the context in question. By way of analogy, I want to suggest that the (...) phenomenal character of experience can be best modeled as a function from tokens of experience in the context of experiential contact to their singular contents: that is, the instantiation of properties with which the subject is in experiential contact in those contexts. Since the meaning of demonstratives can also be described by its token-reflexive rule (the object demonstrated by this token demonstrative in this context of demonstration), we can also think of the phenomenal character as a token-reflexive property of representing whatever is normally causally responsible for this token experience in the context of experiential contact. This is what I call Reflexionism, inspired by Tye’s Kaplanianism (Tye 2009, 113-4, 2014). For example, phenomenal yellowness is the token-reflexive property of representing whatever is causally responsible for the relevant brain pattern in the context of experiential contact under normal conditions. Una revisión somera de la teorí­a contemporánea de la democracia ofrece el siguiente panorama: por un lado, una valoración positiva de la forma efectiva de la democracia, es decir, la democracia liberal y representativa porque provee estabilidad, se respetan las libertades y tienen altos niveles de legitimidad; y, por el otro, una crí­tica de la democracia por ineficiente, representativa y no participativa y por liberal en oposición a social. El problema, evidentemente, es el siguiente: la democracia, ¿podrí­a ser como deberí­a (...) ser o sólo puede ser como de hecho es? Evidentemente, no se puede ofrecer a esta pregunta una respuesta definitiva y, en su lugar, se revisan los argumentos de aquellos autores que defienden a la democracia liberal y representativa como la única forma de gobierno posible en el mundo moderno con la intención de determinar si tienen o no razón, es decir, si la democracia representativa y liberal es, en efecto, la única forma de democracia posible. Dos ejemplos clásicos de esta tesis se encuentran en las obras de Publius y Alexis de Tocqueville."œThe conditions of a possible democracy: The Federalist and Tocqueville"A superficial review of the contemporary theory of democracy ofers the following panorama. On the one hand, a positive appraisal of the efective form of democracy, that is, liberal and representative democracy because it provides stability, freedom is respected and there are high levels of justice. On the other, a criticism of democracy for being ineficient, representative and non-participatory, and for being liberal in opposition to social. Obviously the problem is the following: could democracy be what it should be or can it only be de facto? Obviously a definite answer cannot be given to this question and, instead, the arguments of those authors who defend liberal and representative democracy as the only possible form of government in the modern world are revised with the intention of determining whether they are right or not, that is, if representative and liberal government is, in efect, the only form of possible government. Two classic examples of this thesis are found in the works of Publius and Alexis de Tocqueville. (shrink)

:A good deal of contemporary moral nonconsequentialism assumes that agents have perfect knowledge about the various features and consequences of their options. This assumption is unrealistic. More often than not, moral agents can only assess with a certain degree of probability the factual circumstances that are morally relevant for their decision making. My aim in this essay is to discuss the problem of moral decisions under risk from the point of view of nonconsequentialism. Basically, I analyze how objective moral principles (...) can be transformed into subjective, decisional prescriptions, and argue that the standard nonconsequentialist approach to moral decision making, which focuses on probability thresholds, is wrong. In accordance with the fundamental postulates of nonconsequentialism, I seek to solve the problem of risk in moral choice by proposing a theory about the marginal moral value of various options. Actions can vary along various dimensions, and each of these dimensions can offer a different moral value function. Nonconsequentialist marginalism can level the playing field with consequentialism. Whereas consequentialism can simply borrow the notion of expected utility from economics, nonconsequentialism must introduce the notion of expectational obligation to formulate a general principle of moral choice under risk. I finally suggest that further empirical work is needed to delineate the shape of various moral value functions that are critical for applying the general principle of moral decision making under risk to well-known cases. Context: At the conference “The Ethical Meaning of Francisco Varela’s Thought,” which took place on 28 May 2011 in Sassari, Italy, Humberto Maturana, Michel Bitbol, and Pier Luigi Luisi participated in two discussions. Purpose: In this edited transcription of the discussions, the participants talk about several aspects of autopoiesis, the observer, ontology, making distinctions and distinguishing different domains, perception and illusion, and transcendence. Results: The discussions shed light on how constructivist concepts are perceived by individual authors. Concepts such as (...) “transcendence” and “objectivity” are understood in different ways. Contributors were asked: What will political theory look and sound like in the next century and beyond? What claims might political theorists or their descendants be making in ten, twenty-five, fifty, a hundred years’ time? How might they vindicate those claims in their future contexts? How (...) will the consistent concerns of political theorists evolve into the questions critical for people decades or centuries from now? What new problems will engage the political theorists (or their rough equivalents) of the future? What forms might those take? La disolución del poder colonial en la América española creó una serie de interrogantes respecto al ordenamiento jurídico-político de los futuros estados soberanos. En este sentido, Simón Bolívar (1783–1830) insistió en la idea de que el control político de los territorios liberados por él debía estar al mando de un poder central conservador capaz de garantizar los derechos ciudadanos sin menoscabo de la estabilidad sociopolítica del orden republicano. Aunque algunos aspectos del ideario constitucional bolivariano resultaron inaceptables para sus contemporáneos, sus (...) medidas para asegurar el goce de los derechos civiles y políticos de los americanos se ajustaban a la realidad social de su tiempo. Con base en una amplia consulta bibliográfica, el presente artículo examina la concepción bolivariana del cuerpo político a la luz de las circunstancias sociohistóricas a las que el Libertador debió hacer frente. A pesar de los importantes cuestionamientos que han sido realizados a la “Teoría” de la Transición Demográfica, ésta continúa representando el marco interpretativo más usualmente utilizado por los investigadores de la temática poblacional, los cuales tratan de enriquecerla con lo “observado” en diferentes contextos, buscando las regularidades de las problemáticas poblacionales manifestadas en los mismos con lo acontecido en otras regiones, generalmente de países desarrollados. En tal sentido en el presente artículo se analizan aspectos demográficos o sociales poco explorados, en (...) el marco de dicha teoría, que no obstante, pueden haber tenido un peso importante en la explicación de los cambios poblacionales tales como la sexualidad y la nupcialidad y asociado a ello el comportamiento reproductivo de las mujeres así como las relaciones de violencia en el marco de la familia y la afectación de todo ello a grupos vulnerables como son los jóvenes. El interés de análisis se centra en los aspectos referidos, considerando como contexto espacial a los estados limítrofes con los Estados Unidos, en los que los indicadores sociodemográficos sugieren un relativamente avanzado proceso de transición demográfica, lo que pudiera estar vinculado a la influencia norteamericana, escenario que es complejizado por una intensa corriente migratoria desde otras partes del país hacia la región del norte de México. In this review I present the approach, the structure and briefly the main ideas of the first chapters of this manual on recognition, chapters that are the ones that articulate the work. Synoptically, I then report the content of the articles that make up the book. The review ends with a brief assessment of the scope and importance of this manual for the subject it deals with, for its original presentation and the timeliness of its publication.

Even though management scholars have offered several views on the process of corporate sustainability, these efforts have focused mainly on the technical aspects of sustainability while omitting the fundamental role played by individual moral competences. Therefore, previous work offers an incomplete and somewhat reductionist view of corporate sustainability. In this article, we develop a holistic framework of corporate sustainability in which both the moral and technical aspects of sustainability are considered. We do so by integrating the ethical, normative perspective of (...) the Catholic social teaching with the competitive view of the natural resource-based view. This framework highlights the importance of CST principles and ideas in developing executive moral competences such as moral sensitivity and awareness, and moral cognition and motivation. Moral competences, in turn, influence the organizational selection of environmental strategies, giving leaders the intrinsic motivation to promote both a longer-term stance on corporate sustainability efforts and a relentless search for greener business models. Such strategies move the firm closer towards achieving environmental sustainability. Hence, by bridging the individual, normative-ethical with the organizational, implementational levels of corporate sustainability, our framework provides a more realistic, coherent, and complete perspective on the complex process of achieving corporate sustainability.
