Many arguments have been made against gene editing. This paper addresses the commonly invoked argument that gene editing violates human dignity and is ultimately a subversion of human nature. There are several drawbacks to this argument. Above all, the concept of what human dignity means is unclear. It is not possible to condemn a practice that violates human dignity if we do not know exactly what is being violated. The argument’s entire reasoning is thus undermined. Analyses of the arguments involved (...) in this discussion have often led to the conclusion that gene editing contravenes the principle of genetic identity (genetic immutability) thereby subverting a requisite of human dignity and ultimately threatening human nature. This paper refutes these arguments and shows that any opposition to gene editing cannot rely on the human dignity argument. (shrink)

Este artículo reflexiona sobre la segregación socio-espacial en contextos urbanos, comprendiéndola como una dimensión particular de los procesos de estructuración social en las ciudades capitalistas. Concretamente, se aborda el caso de la ciudad de Córdoba (Argentina). Se parte del supuesto de que el crecimiento urbano por expansión que se registra durante la década del `80, es el resultado de un doble proceso de larga duración. Por un lado, políticas de desarrollo urbano que buscan incrementar la productividad y atraer inversiones privadas (...) que re-cualifiquen espacios estratégicos de la ciudad. Por otro lado, y subsidiario del proceso anterior, la progresiva ocupación diferencial del área periférica de acuerdo a posiciones y condiciones de clase. Se concluye que la suburbanización que se registra en la ciudad forma parte de una política general de (re)valorización urbana orientada hacia el capital privado, y que ya desde los primeros años de la transición democrática pueden observarse en Córdoba incipientes marcas de una periferia segmentada en términos de clase. La estrategia metodológica articula el análisis de datos provenientes de fuentes secundarias (indicadores urbanos, socio-demográficos y habitacionales) con el abordaje cualitativo de intervenciones urbanas y marcos normativos sancionados a mediados de la década del ’80. O tema central deste artigo é a persuasão e como ela aparece no pensamento político arendtiano. Nos ocuparemos desta tópica no intuito de mostrar sua fecundidade e seus limites no que concerne à esfera dos assuntos humanos. Em Arendt, as reflexões sobre a persuasão são suscitadas em referência à atividade política do discurso e ao papel da argumentação persuasiva. Nossa aposta é que uma investigação acerca das nuances da persuasão em Arendt comporta duas direções distintas e, portanto, assumiremos duas linhas (...) de pensamento que nos possibilitarão uma incursão neste debate. Com efeito, examinaremos a perspectiva arendtiana no que concerne à persuasão, por um lado, quando o tema aparece na recuperação da experiência da _polis_ grega, por outro, quando ele é tangenciado pelo relato do julgamento de Adolf Eichmann. Isto posto, nossa principal pretensão é explorar como a questão da persuasão é formulada de maneira contrastante no pensamento arendtiano. Para tanto, a modulação constitutiva do debate será demonstrada a partir de considerações pontuais no tocante à presença da persuasão em dois espaços de natureza pública, quais sejam, a _ágora_ grega e o tribunal. Recent years have seen mounting challenge to the model of the criminal trial on the grounds it is not cost-effective, not preventive, not necessary, not appropriate, or not effective. These challenges have led to changes in the scope of the criminal law, in criminal procedure, and in the nature and use of criminal trials. These changes include greater use of diversion, of fixed penalties, of summary trials, of hybrid civil–criminal processes, of strict liability, of incentives to plead guilty, and of (...) preventive orders. The paper will assess the implications of these changes for the function of the criminal law, assessing the reasons behind them, and examining whether or not they are to be welcomed. Identifying the larger import of these changes draws attention to the changing relationship between state and citizen as well as changes in the nature of the state itself. These can in turn be attributed to a jostling among the different manifestations of the authoritarian state, the preventive state, and the regulatory state. These changes have profound normative implications for a liberal theory of the criminal law that require its re-articulation and its defence. A modest start may be to insist that where the conduct is criminal and the consequences are punitive the protections of criminal procedure and trial must be upheld. (shrink)

The concept of Smart Healthy Age-Friendly Environments (SHAFE) emphasises the comprehensive person-centred experience as essential to promoting living environments. SHAFE takes an interdisciplinary approach, conceptualising complete and multidisciplinary solutions for an inclusive society. From this approach, we promote participation, health, and well-being experiences by finding the best possible combinations of social, physical, and digital solutions in the community. This initiative emerged bottom-up in Europe from the dream and conviction that innovation can improve health equity, foster caring communities, and sustainable development. (...) Smart, adaptable, and inclusive solutions can promote and support independence and autonomy throughout the lifespan, regardless of age, gender, disabilities, cultural differences, and personal choices, as well as promote happier and fairer living places. The New European Bauhaus initiative gathers “beautiful, sustainable, and inclusive projects and ideas” to inspire a positive transformation around us. The New European Bauhaus 2024 Festival took place between 9-13 April. “Designing the perfect New European Bauhaus neighbourhood: New European Bauhaus meets SHAFE” was a Satellite Event of the Festival, held as an online workshop, organised by the SHAFE Foundation on April 9th, 2024. At the event, a group of 50 participants with a multidisciplinary background discussed how to meet the challenges of the European Garcia family to enable them to live in a perfect neighbourhood. The White Paper presents the findings of the participants with the New European Bauhaus inspiring projects and ideas to house the European Garcia family in their neighbourhood. The White Paper recommends developers, designers, planners, and policymakers to include person-centred design of social and physical environments and technologies. Although awareness of person-centred design is growing, many initiatives still hamper the inclusion of citizens or end-users throughout the development of products and services. (shrink)

The Director-General of the WHO has suggested that China’s approach to the COVID-19 crisis could be the standard of care for global epidemics. However, as remarkable as the Chinese strategy might be, it cannot be replicated in other countries and certainly not in Europe. In Europe, there is a distribution of power between the European Union and its member states. In contrast, China’s political power is concentrated in the central government. This enables it to take immediate measures that affect the (...) entire country, such as massive quarantines or closing borders. Moreover, the Chinese legal framework includes restrictions on privacy and other human rights that are unknown in Europe. In addition, China has the technological power to easily impose such restrictions. In most European countries, that would be science fiction. These conditions have enabled China to combat epidemics like no other country can. However, the WHO might have been overoptimistic. The Chinese standard of care for treating COVID-19 also raises problematic issues for human rights, and the real consequences of these actions remain to be seen. (shrink)

O texto analisa como o problema da coisa em si em Kant, enquanto fundamento real ou não do fenômeno, foi reelaborado pelos filósofos pós-kantianos e como estes buscaram solucionar o possível dualismo da filosofia crítica. A investigação se concentra sobretudo na resposta de Schopenhauer ao problema, evidenciado pela primeira vez pelo filósofo Friedrich Heinrich Jacobi, um dos grandes críticos da filosofia transcendental e do idealismo.

The present study assessed business students’ responses to an innovative interactive presentation on academic integrity that employed quoted material from previous students as launching points for discussion. In total, 15 business classes ( n = 412 students) including 2nd, 3rd and 4th year level students participated in the presentations as part of the ethics component of ongoing courses. Students’ perceptions of the importance of academic integrity, self-reports of cheating behaviors, and factors contributing to misconduct were examined along with perceptions about (...) the presentation. Discussion sessions revealed that academic misconduct is a complex issue. For example, knowledge of what constitutes misconduct was not consistent across domains (e.g. exam contexts versus group work), penalties were not wholly known, and there was variation in perceived responsibility for reporting and representing academic integrity. Survey measures revealed that self-reported academic misconduct was more prevalent than expected with only 7.5% of students indicating they had never cheated in any way. Furthermore, results showed gender and year of study as predictive factors for issues related to academic misconduct. In general, students were receptive to this form of presentation. The implications of such instructional interventions for enhancing ethical behaviors in higher education classrooms are discussed. (shrink)

O presente trabalho objetiva discutir as possíveis contribuições da Hermenêutica Filosófica de Gadamer para a pesquisa em Psicologia. Nessa direção, parte da problematização do modo como o conhecimento é produzido na Psicologia, com realce para a insuficiência do horizonte técnico-científico para aproximar-se dos fenômenos humanos. Recorre à Hermenêutica Filosófica de Gadamer na busca do desvelamento de outras possibilidades para tal fazer. Para tanto, parte da compreensão da hermenêutica, não na função de método, mas compreendida como condição humana originária. Aborda inicialmente (...) o reconhecimento da influência de Heidegger para o desenvolvimento da Hermenêutica Filosófica de Gadamer e, em seguida, tece uma possível articulação entre o horizonte aberto por Gadamer e a pesquisa em Psicologia, enfocando as compreensões do filósofo acerca da compreensão, do jogo e do diálogo. Por fim, ressalta as contribuições abertas pela Hermenêutica Filosófica para descortinar “direcionamentos” inspiradores às pesquisas no contexto da Psicologia na busca de compreender os fenômenos existenciais. Tal caminho, na medida em que não busca conclusões teoréticas e explicativas, ao manter-se na direção da pergunta, realça a dimensão compreensiva e hermenêutica originária da existência como radicalmente singular e possibilita a tessitura de diálogos entre Psicologia e Hermenêutica Filosófica. Although Chinese law imposes informed consent for medical treatments, the Chinese understanding of this requirement is very different from the European one, mostly due to the influence of Confucianism. Chinese doctors and relatives are primarily interested in protecting the patient, even from the truth; thus, patients are commonly uninformed of their medical conditions, often at the family’s request. The family plays an important role in health care decisions, even substituting their decisions for the patient’s. Accordingly, instead of personal informed consent, (...) what actually exists is ‘family informed consent’. From a Western perspective, these features of Chinese law and Chinese culture might seem strange, contradicting our understanding of doctor-patient relationship and even the very essence of self-determination and fundamental rights. However, we cannot forget the huge influence of cultural factors in these domains, and that ‘Western’ informed consent is grounded on the individualistic nature of Western culture. This article will underline the differences between the Western and the Chinese perspectives, clarifying how each of them must be understood in its own cultural environment. But, while still respecting Chinese particularities, this paper advocates that China adopt patient individual informed consent because this is the only solution compatible with human dignity and human rights. ABSTRACTWhile Spinoza stipulates an ideal moral person in the propositions on the ‘free man’ in Ethics IV, this account does not seem to be intended to function as a pedagogical tool of political relevance. Hence, it does not seem to correspond to the purpose of moral exemplarism. If we look for that kind of practical guidance, Spinoza’s political works seem more relevant. Interestingly, when we approach Spinoza’s political theory with moral exemplarism in mind, we find that instead of constructing his (...) exemplar on the idea of a supremely moral person, he emphasizes the concept of ingenium to chisel out an imperfect model of human behavior. We argue that the purpose of this is to avoid a utopian and inefficient political theory and to work out a moral practice that is capable of assisting people and communities in ethical self-transformation. In recent decades, psychological research on the effects of mindfulness-based interventions has greatly developed and demonstrated a range of beneficial outcomes in a variety of populations and contexts. Yet, the question of how to foster subjective well-being and happiness remains open. Here, we assessed the effectiveness of an integrated mental training program The Art of Happiness on psychological well-being in a general population. The mental training program was designed to help practitioners develop new ways to nurture their own happiness. This (...) was achieved by seven modules aimed at cultivating positive cognition strategies and behaviors using both formal and informal practices. The program was conducted over a period of 9 months, also comprising two retreats, one in the middle and one at the end of the course. By using a set of established psychometric tools, we assessed the effects of such a mental training program on several psychological well-being dimensions, taking into account both the longitudinal effects of the course and the short-term effects arising from the intensive retreat experiences. The results showed that several psychological well-being measures gradually increased within participants from the beginning to the end of the course. This was especially true for life satisfaction, self-awareness, and emotional regulation, highlighting both short-term and longitudinal effects of the program. In conclusion, these findings suggest the potential of the mental training program, such as The Art of Happiness, for psychological well-being. (shrink)

We show that a new interpretation of quantum mechanics, in which the notion of event is defined without reference to measurement or observers, allows to construct a quantum general ontology based on systems, states and events. Unlike the Copenhagen interpretation, it does not resort to elements of a classical ontology. The quantum ontology in turn allows us to recognize that a typical behavior of quantum systems exhibits strong emergence and ontological non-reducibility. Such phenomena are not exceptional but natural, and are (...) rooted in the basic mathematical structure of quantum mechanics. (shrink)

The events surrounding COVID-19, combined with the mandatory quarantines widely imposed in Asia and Europe since the virus outbreak, have reignited discussion of the balance between individual rights and liberties and public health during epidemics and pandemics. This article analyses this issue from the perspectives of precaution and necessity. There is a difficult relationship between these two seemingly opposite principles, both of which are frequently invoked in this domain. Although the precautionary principle encourages the use of quarantines, including mandatory quarantines, (...) and associated restrictive measures, the principle of necessity puts a break on such measures. The COVID-19 pandemic reveals once again the different interrelations between these two principles. However, the alleged conflict between the PN and the PP is based on a superficial analysis. The relation between these two principles is far more complex, as this article will demonstrate. (shrink)

This article aims to show that the practice of attention can create an openness to the truth, from where ethics arises. It does so by exploring the role attention plays, according to Ricoeur, in Freud’s thought. Ricoeur shows how in the first stage of Freud’s thinking – that of the Project of a Scientific Psychology – attention is one of the instances in which a purely mechanical quantitative explanation can be questioned. Further on, with the introduction of narcissism, Ricœur shows (...) that attention, insofar as it opens a space for the “wounding truth,” opposes narcissism. Finally, the article explains how in the therapeutic setting an attentional epochē allows the therapist to be “the reality principle in flesh and in act,” so that the ego can gain control. According to Ricœur, this non-judgmental gaze opens a space of truthfulness for the patient’s self-knowledge which, although not being the totality of ethics, constitutes its threshold. (shrink)

Greenwashing is a phenomenon that is linked to scandals that often occur at the supply-chain level. Nevertheless, research on this subject remains in its infancy; much more is needed to advance our understanding of stakeholders’ reactions to greenwashing. We propose here a new typology of greenwashing, based on the locus of discrepancy, i.e. the point along the supply-chain where the discrepancy between ‘responsible words’ and ‘irresponsible walks’ occurs. With three experiments, we tested how the different forms of greenwashing affect stakeholders’ (...) reactions, from both ethical and business perspectives. We developed our hypotheses by building on attribution theory, which seeks to account for how observers construct perceptions about events. We had anticipated that the more internal, controllable and intentional the discrepancy is, the greater the blame attributed to a company is, and the lower the intention to invest will be. When greenwashing occurs at a company level, this results in a higher level of blame attribution, while the intention to invest falls. Indirect greenwashing refers to a misbehaviour perpetrated by a supplier who claims to be sustainable, and which results in a less negative impact on a supplied company. We also propose the vicarious greenwashing, which occurs when the behaviour of a supplier is in breach of a company’s claims of sustainability. This type of greenwashing is nevertheless detrimental to investment. The findings here advance our understanding of how greenwashing shapes stakeholders’ reactions, and highlight the need for the careful management of the supply-chain. (shrink)

Most courts around the world have been refusing wrongful life actions. The main argument invoked is that the supposed compensable injury cannot be classified as such, since life is always a blessing no matter how hard and painful it is.In opposition to mainstream scholars and the dominant case law, this article sustains that life must be distinguished from living conditions, the former being the real injury at stake, since some living conditions are so intolerable that in themselves they justify a (...) compensation within wrongful life actions. Este trabajo explora los contactos entre la narrativa de los decadentes mexicanos y la ciencia, en especial la medicina y la antropología criminal. La hipótesis central es que de estas disciplinas científicas los decadentes absorbieron y reelaboraron artísticamente no meras nociones, sino valoraciones y códigos de representación de la realidad. Partiendo de presupuestos teóricos del análisis del discurso y centrándose en la figura de la prostituta, el artículo se aproxima a Alberto Leduc (1867-1908), en cuya obra se constata la apropiación (...) de un repertorio léxico, unas estrategias descriptivo-narrativas, unos tópicos y un modo de encuadrar la realidad propios del discurso de la ciencia, que él pone a dialogar con su sensibilidad modernista-decadente. O presente artigo tem por objetivo tomar partido diante do texto de GuéroultFichte et Schopenhauer, abordando as diferenças entre ambos ao enfrentarem a questão doeu. Partimos do problema da coisa-em-si kantiana, considerada como causa do fenômeno,e as respectivas soluções propostas por Fichte e Schopenhauer, para nos posicionarmos emrelação às críticas de Guéroult a Schopenhauer, que evidenciam sobretudo as incoerênciasdo idealismo desse último. O nosso propósito é afinal, não deixando de dar razão aGuéroult, realçar a especificidade da filosofia schopenhaueriana no que (...) se refere ao “eu”,mostrando que a força e originalidade de seu pensamento estaria justamente na falha quecomete ao abandonar o rigor do idealismo de Fichte, salientado e louvado por Guéroult. En la actual campaña electoral uruguaya de 2019, se perfila un cuadro de descontentos generalizados que desborda claramente los estándares tradicionales de la política del país. Muchos de estos descontentos se articulan con diversos factores que los autores han venido destacando en trabajos anteriores, como señales de una mutación gradual pero efectiva de la política uruguaya. En continuidad con ese abordaje de investigación, en el artículo se indagará acerca de las posibilidades efectivas de que esta mutación política adquiera proporciones realmente (...) significativas en las actuales circunstancias, con la posibilidad de confirmación de "cisnes negros" que parecen atisbarse en la campaña electoral en curso. Para ello, luego de algunos discernimientos teóricos y metodológicos, se trabajará el itinerario de distintos indicadores de opinión pública a nivel nacional durante el período 1995-2017, vinculados con el objeto de estudio planteado. A partir de esos insumos, se realizarán algunas breves consideraciones de proyección analítica. (shrink)

En este trabajo proponemos mostrar que las múltiples experiencias de opresión –como efecto de las imbricaciones simultáneas entre instancias de diferenciación social y relaciones de poder- tienen como reverso experiencias de lucha, organización y resistencia colectiva como formas de participación política. Para el abordaje de las desigualdades entrecruzadas y diversas formas de violencia proponemos un enfoque interseccional por su carácter multidimensional y complejo, así como por sus raíces de lucha. Para ello, en primera instancia, trazaremos genealogías políticas que permitan historizar (...) la interseccionalidad y anudarla a sus luchas y demandas fundacionales. Analizaremos en esta dirección, las experiencias de la Combahee River Collective y de laThird World Women's Alliance, organizaciones feministas negras de la década del setenta en los Estados Unidos que buscaban enfrentar las desigualdades estructurales producidas por las articulaciones entre distintos sistemas de dominación y que direccionaron su participación política antiimperialista, anticapitalista, anticolonialista y antisexista. En un segundo momento, proponemos recuperar las genealogías críticas de la interseccionalidad para repolitizar y recomplejizar la perspectiva crítica. Finalmente, proponemos subvertir los binarismos dicotómicos y excluyentes bajo los cuales se han estructurado espacios de jerarquías y privilegios; que reproducen violencias y desigualdades. O artigo atualiza um tema fundamental da Conferência de Puebla, a opção preferencial pelos pobres, através do diálogo com o tema da aversão pelos pobres, ou aporofobia, estudado pela filósofa Adela Cortina. Apresenta os significados da opção preferencial pelos pobres, inaugurada em Medellín e solenemente proclamada em Puebla e mostra como esta opção foi assumida pelo magistério posterior, tanto na América Latina quanto no magistério universal; em seguida, sistematiza os aspectos da aporofobia ressaltados por Adela Cortina e, ao final, propõe (...) cinco desafios teológico-pastorais: redescobrir a opção pelos pobres como graça, perceber a necessidade do envolvimento emocional com os pobres, descobrir a riqueza dos pobres e recusar o discurso do ódio, refletir sobre caminhos para eliminar a pobreza e contribuir para uma nova economia. Em tudo isto, o magistério de Francisco mostra-se profundamente iluminador. Podemos dizer que, com o Papa Francisco, é aprofundado um caminho profético de inclusão, convivência e responsabilidade globais, que visibiliza e inclui os pobres e, assim, enfrenta a aporofobia. Ora, a idéia de um finalismo na natureza para explicação do mundo orgânico esta intimamente ligada à predominância da Vontade sobre o Intelecto e, assim, à tentativa de banir da filosofia qualquer traço de teologia: a saber, ao propósito de negar qualquer inteligência externa ordenadora que possa ser formada (...) como causa transcendente do mundo.
