This paper explores why respondents to a telephone public-opinion survey often give reasons for answering as they do, even though reason-giving is neither required nor encouraged and it is difficult to see the reasons as attempts to deal with disagreement. We find that respondents give reasons for the policy claims they make in their answers three times as frequently as they give reasons for value or factual claims, that their reasons tend to involve appeals to personal experience, and that they (...) often talk about their thought processes, especially when the evidentiary stakes are high. We then explore several ways of explaining these findings. We suggest that one useful approach is to see the reason-giving in the survey interviews as deliberative, reflexive argumentation of the sort described as `critical thinking. We further suggest that the reason such argumentation is often conducted out loud in the interviews, rather than internally, is that it functions in the service of rhetorical ethos, in particular the need to display the fact that one is human, with human autonomy and agency. Doing this may be particularly important in contexts such as anonymous survey interviews in which people are at risk of being treated like machines. (shrink)

Background In this study, we examined the ethical implications of Egypt’s new clinical trial law, employing the ethical framework proposed by Emanuel et al. and comparing it to various national and supranational laws. This analysis is crucial as Egypt, considered a high-growth pharmaceutical market, has become an attractive location for clinical trials, offering insights into the ethical implementation of bioethical regulations in a large population country with a robust healthcare infrastructure and predominantly treatment-naïve patients. Methods We conducted a comparative analysis (...) of Egyptian law with regulations from Sweden and France, including the EU Clinical Trials Regulation, considering ethical human subject research criteria, and used a directed approach to qualitative content analysis to examine the laws and regulations. This study involved extensive peer scrutiny, frequent debriefing sessions, and collaboration with legal experts with relevant international legal expertise to ensure rigorous analysis and interpretation of the laws. Results On the rating of the seven different principles (social and scientific values, scientific validity, fair selection of participants, risk-benefit ratio, independent review, informed consent and respect for participants) Egypt, France, and EU regulations had comparable scores. Specific principles (Social Value, Scientific Value, and Fair selection of participants) were challenging to directly identify due to certain regulations embodying 'implicit' principles more than explicitly stated ones. Conclusion The analysis underscores Egypt's alignment with internationally recognized ethical principles, as outlined by Emanuel et al., through its comparison with French, Swedish, and EU regulations, emphasizing the critical need for Egypt to continuously refine its ethical regulations to safeguard participant protection and research integrity. Key issues identified include the necessity to clarify and standardize the concept of social value in research, alongside concerns regarding the expertise and impartiality of ethical review boards, pointing towards a broader agenda for enhancing research ethics in Egypt and beyond. Although legal terms are conventionally considered to have self-referential, self-closed meaning independent of context, a legal term only acquires its meaning within a given context. As long as the context varies, the meaning of the same legal term as a signifier may change correspondingly. Based on case studies by applying semiotics, we argue that a legal term is just a sign within its sign system; a legal term as an individual sign does not have any inherent meaning, and its meaning (...) can only exist in the relationship with other signs or sign systems. In other words, a legal term only denotes in a particular temporal and spatial context. Through this study, we conclude four propositions about a legal term as a sign: first, the connection of a legal term with a legal concept is relatively arbitrary; second, the meaning of a legal term exists in a sign system; third, a legal term can be subject to multiple interpretations; fourth, the defining of a legal term may be affected by other sign systems. And what might I have offered those involved if they had called an ethics consult at the time? One of this physician's implicit questions was, “How might this have unfolded in a better way?”When difficult choices must be made, how can a narrative approach help? A narrativist focuses less on principles, rules, and law than would a (...) philosopher or a lawyer. This is not to say that we ignore the law or are unaware of bioethical principles. Since the 1930s, scientists studying the neurological disease scrapie had assumed that the infectious agent was a virus. By the mid 1960s, however, several unconventional properties had arisen that were difficult to reconcile with the standard viral model. Evidence for nucleic acid within the pathogen was lacking, and some researchers considered the possibility that the infectious agent consisted solely of protein. In 1982, Stanley Prusiner coined the term `prion' to emphasize the agent's proteinaceous nature. This infectious protein hypothesis was denounced (...) by many scientists as `heretical'.This two-part essay asks why the concept of an infectious protein was considered controversial. Some biologists justified their evaluation of this hypothesis on the grounds that an infectious protein contradicted the `central dogma of molecular biology'. Others referred to vague theoretical constraints such as molecular biology's `theoretical structure' or `framework'. Examination of the objections raised by researchers reveals exactly what generalizations were being challenged by a protein model of infection.This two-part survey of scrapie and prion research reaches several conclusions: A theoretical framework is present in molecular biology, exerting its influence in hypothesis formation and evaluation; This framework consists of several related, yet separable, generalizations or `elements', including Francis Crick's Central Dogma and Sequence Hypothesis, plus notions concerning infection, replication, protein synthesis, and protein folding; The term `central dogma' has stretched beyond Crick's original 1958 definition to encompass at least two other `framework elements': replication and protein synthesis; and From the study of scrapie and related diseases, biological information has been delineated into at least two classes: sequential and what I call `conformational'.In Part I of this essay, a brief review of the central dogma was given, and the developments in scrapie research from 1965 to 1972 were traced. This section summarized many of the puzzling, non-virus-like properties of the scrapie agent. Alternative hypotheses to the viral explanation were presented, including early versions of a protein-only hypothesis. Part II of this essay will follow the developments in scrapie and prion research from the mid-1970s through 1991. The growing prominence of a protein-only model of infection will be countered by continued objections from many researchers to a pathogen devoid of nucleic acid. These objections will help illuminate those generalizations in molecular biology that were indeed challenged by a protein-only model of infection. (shrink)

ExcerptThe reasons why individual nations and even individual people subscribe to notions of human rights vary enormously. Rationales range from idealism to realpolitik and sound in competing registers of theology, social contract, nature, utility, and game theory.1 Pervasive in discussions of human rights is the dignity of each person as both a reality and a normative guide. Capacious and ambiguous, this notion of dignity may invite agreement precisely because different people project different meanings onto it. Its recognition, though, can inspire (...) attitudes of respect and civility even when we disagree. Dignity thus serves less as a foundation and more as a lodestar, an aspiration. Justice Thurgood Marshall once explained, “A child born to a [B]lack mother in a state like Mississippi… has exactly the same rights as a white baby born to the wealthiest person in the United States. Recent neuroimaging studies of language processing are examining the neural substrate of phonology because of its critical role in mapping sound information onto higher levels of language processing (e.g., words) as well as providing codes in which verbal information can be temporarily stored in working memory. However, the precise role of the inferior frontal cortex in spoken and written phonological tasks has remained elusive. Although lesion studies have indicated the presence of selective deficits in phonological processing, the location of lesions (...) underlying these impairments has not revealed a consistent pattern. Despite efforts to refine methods and tasks, functional neuroimaging studies have also revealed variability in activation patterns. Reanalysis of evidence from these neuroimaging studies suggests that there are functional subregions within the inferior frontal gyrus that correspond to specific components of phonological processing (e.g., orthographic to phonological conversion in reading, and segmentation in speech). The Renaissance movement known as humanism eventually spread from Italy through all of western Europe, transforming early modern culture in ways that are still being felt and debated. Central to these debates—and to this book—is the question of whether the humanist movement contributed to the secularization of Western cultural traditions at the end of the Middle Ages. A preeminent scholar of Italian humanism, Riccardo Fubini approaches this question in a new way—by redefining the problem of secularization more carefully to show (...) how humanists can at once be secularizers and religious thinkers. The result is a provocative vision of the humanist movement. _Humanism and Secularization_ offers a nuanced account of humanists contesting medieval ideas about authority not in order to reject Christianity or even orthodoxy, but to claim for themselves the right to define what it meant to be a Christian. Fubini analyzes key texts by major humanists—isuch as Petrarch, Poggio, and Valla—from the first century of the movement. As he subtly works out these authors’ views on religion and the Church from both biographical and textual information, Fubini reveals in detail the new historical consciousness that animated the humanists in their reading of classical and patristic texts. His book as a whole shows convincingly just how radical the humanism of the first half of the fifteenth century was and how sharply it challenged well-entrenched ideas and institutions. In ‘Zones of Indeterminacy: Art, Body and Politics in Daoist Thought’, Peng Yu foregrounds the concept of Xu from Zhuangzi’s philosophical writings, and relates this to questions about the political body. Xu refers to a Daoist notion of ambiguity, though it remains unclear as to how to fully define the term. The article explores its meaning through reference to debates of the body, but also liubai painting, which refers to the idea of ‘leaving blankness’, associated with Chinese ink painting. For (...) This paper deals with how telematic technologies such as the cellular phones, Internet, telerobotics and other varieties of telematic communication and control are placing into discussion the nature of knowledge and its scope. These technologies offer us knowledge by description and representation instead of physical contact, a fact that is often seen with suspicion since they are perceived as technologies of delusion in a culture characterized by its conspicuous materialism. What are the possible roles for our mediated activities in relation (...) with the comprehension of our environment and the construction of subjectivity? Telematic mediation necessarily deals with the immaterial aspects of technologies such as the changing concepts of reality and nature, future possibilities of an ethereal afterlife achieved through spiritual or technological means and the concept of distance that can render mediated communication delusory and unsatisfying while acting as an agent of delocalization. This view is supported by our traditional Platonic view that perceives representation of things as a palpable degradation while neglecting the constructive aspects of those fictional endeavours. In the summer of 2017, much of the world was riveted by the case of Charlie Gard, a baby in London whose parents wanted an experimental treatment and whose doctors thought that further treatment would be futile. The case worked its way through the British courts and, eventually, was even heard by the European Court of Human Rights. Pope Francis and President Trump weighed in. If nothing else, the case revealed how controversial the issues around medical futility and shared decision-making (...) still are. Many ethical issues resolve over time. If you travel through airports, you can’t help but notice it. Jodi Picoult’s novels are everywhere. From Charlotte to Kansas City to Los Angeles, airport bookstores are consistently stocked with three or four or more of her most recent heavy volumes of fiction. Read one and you might mutter that it seems designed for a relatively mindless flight from one coast to the other. Read several and you might agree with National Public Radio’s disparaging view that the books are “lurid (...) tales of family strife . . . garnished heavily with medical jargon, legalese, and a punitive finger pointed at a mother.” It’s not hard to find negative comments about Picoult’s novels.
