The dissertation involves an examination of recent work in Social Epistemology. In particular, I am concerned with the question of how one's social position could affect judgments regarding evidence and confirmation. To answer this question I undertake an investigation of feminist epistemology and philosophy of science. Feminist epistemologists have raised criticisms of the traditional analysis of knowledge by arguing against the primacy of the individual and for a more thorough-going analysis of the community in accounts of knowledge. This shift, in (...) my view, is an important contribution toward a more complete theory of knowledge. Yet feminist epistemology is a controversial contributor to the area of social epistemology generally construed. Thus, in the first chapter I offer a defense of the contributions of feminist epistemology to analytic philosophy, against its various critics. ;In Chapters Two and Three I examine feminists' reliance on Naturalistic models of theory-choice such as Quinean Holism or the later Wittgenstein's Social Constructivism. I argue that the reliance on these models is a tactical mistake for feminists since these models are based on problematic accounts of meaning and truth. Alternatively, I advocate the adoption of a realist meaning theory along the lines proposed by Katz, as well as a rationalized epistemology in the service of explaining deductive and inductive inference. My argument involves showing how realism and rationalism entail the kind of strong program of justification and rational censure which is required if feminists want to successfully condemn existing biased practices. ;Consequently, I propose a reformulation of the distinction between a context of discovery and context of justification. My reformulation differs from the past positivist distinction in that "discovery" rather than being wholly random and subjective, is instead reflective of patterns of social experience. "Justification" is conceived of as more sensitive to the epistemic privilege of varying social standpoints. However, a separation is still maintained between how one comes to arrive at a belief and the methods for justifying that belief. My conclusion is that a partnership between rationalized epistemology and feminist theory can provide rich possibilities for both disciplines. (shrink)

In the late 1970s and early 1980s, Richard Rorty advocated that his confréres kick the ‘philosophy habit’-that is, adopt a post-positivist, post-metaphysical style of interpretation. Philosophers largely ignored Rorty’s clarion call. Unburdened by the kind of Selbstverständnis of scholarly mission held by most analytics, members of departments of literature instead became the most important advocates for reading literature philosophically during the last two decades of the twentieth century. Though the academic Left, especially practitioners of ‘theory’, largely celebrated and encouraged this (...) development, Rorty, in the late 1990s, came to view it as harmfully elevating ‘cultural politics’ above ‘real politics’, which would ultimately lead to the abandonment of civic responsibilities. While heavy-handed and partial, Rorty’s critique of the uses of philosophy by literary critics was not only perceptive, but can be helpful for understanding how the contemporary academic Left might move forward as well. The paper develops a conception of marital love as a complex recognitive relation, which I articulate by juxtaposing it against other recognitive relations that figure in Hegel's theory of modern civil society (i.e., respect and esteem). Drawing on Hegel's early writings, I argue that, if love is to provide its unique sort of recognition, it must obtain between “living beings who are equal in power”—a peculiar form of equality that I name (drawing on Stanley Cavell's work) “dynamic equality.” I conclude (...) that it is by Hegel's own lights that we should reject his notorious conception of the sexual difference. However, I also offer reasons why, from Hegel's early 19th century perspective, he could consider the following two conditions as compatible: (1) equality within marriage and (2) sexual hierarchy outside marriage, namely, in civil society. Einstein’s razor, a corollary of Ockham’s razor, is often paraphrased as follows: make everything as simple as possible, but not simpler. This rule of thumb describes the challenge that designers of a legal system face—to craft simple laws that produce desired ends, but not to pursue simplicity so far as to undermine those ends. Complexity, simplicity’s inverse, taxes cognition and increases the likelihood of suboptimal decisions. In addition, unnecessary legal complexity can drive a misallocation of human capital toward comprehending and (...) complying with legal rules and away from other productive ends. While many scholars have offered descriptive accounts or theoretical models of legal complexity, most empirical research to date has been limited to simple measures of size, such as the number of pages in a bill. No extant research rigorously applies a meaningful model to real data. As a consequence, we have no reliable means to determine whether a new bill, regulation, order, or precedent substantially effects legal complexity. In this paper, we begin to address this need by developing a proposed empirical framework for measuring relative legal complexity. This framework is based on “knowledge acquisition”, an approach at the intersection of psychology and computer science, which can take into account the structure, language, and interdependence of law. We then demonstrate the descriptive value of this framework by applying it to the U.S. Code’s Titles, scoring and ranking them by their relative complexity. We measure various features of a title including its structural size, the net flow of its intra-title citations and its linguistic entropy. Our framework is flexible, intuitive, and transparent, and we offer this approach as a first step in developing a practical methodology for assessing legal complexity. (shrink)

I evaluate Temkin’s claims through the lens of social choice theory, pursue some of its larger implications and applications, and conclude with a very general worry having to do with the intimate connection between transitivity and logical consistency, namely whether, if Temkin is right, this would not bring all (...) moral reasoning to an abrupt halt. : Metaphysics B considers two sets of views that hypostatize mathematicals. Aristotle discusses the first in his B.2 treatment of aporia 5, and the second in his B.5 treatment of aporia 12. The former has attracted considerable attention; the latter has not. I show that aporia 12 is more significant than the literature suggests, and specifically that it is directly addressed in M.2 – an indication of its importance. There is an immediate problem: Aristotle spends most of M.2 refuting the (...) view that mathematicals are separate; but the B.5 mathematicals are inherent. I argue that the B.5 inherence is compatible with the M.2 separateness, and further, that aporia 12 is more than just a puzzle about the hypostatization of mathematicals. His interviewer immediately expresses surprise at Levinas's comments that suggested he saw the traditions of philosophy and biblical theology as in some sense harmonious (quoted in Robbins 2001, 239). Levinas responds (...) by elaborating on this connection he sees. For him, the lived experience of Judaism is above all a sense of belonging to humanity and, in turn, to a supreme order of responsibility (240). Although his intellectual life focused on the sacred texts of Judaism, this life included non-Jewish books, which he believed expressed a similar concern or a similar responsibility—a concern for the meaning of life. This list of such books includes Hamlet, Macbeth, King Lear, The Miser, and The Misanthrope, in addition to the novels of Tolstoy and Dostoyevsky.In Levinas's view, these novels are not exercises of philosophyper se; as mentioned above, they express the same concerns that occupy philosophy, but they express these concerns in a different idiom. They do not offer a philosophical argument; instead, they use figurative language and literary narrative to convey their messages. These interpretations are found in the collections of midrashim and the Talmud. One need know only a little bit about Hebrew and the construction of the Hebrew texts in order to see why these interpretations are significant. There are three grammatical concerns with the Hebrew language: first, biblical Hebrew does not contain vowels, though it does employ vowel aspirations; second, it is a language based on root letter combinations, and the meaning of these combinations alters, depending on the vowel aspirations that are inserted. For example, "Kiddish," the Hebrew blessing over wine, is based on a combination of Hebrew letters that are transliterated into English as KDSH. Raoul Moati intervenes in the critical debate that divided two prominent philosophers in the mid-twentieth century. In the 1950s, the British philosopher J. L. Austin advanced a theory of speech acts, or the "performative," that Jacques Derrida and John R. Searle interpreted in fundamentally different ways. Their disagreement centered on the issue of intentionality, which Derrida understood phenomenologically and Searle read pragmatically. The controversy had profound implications for the development of contemporary philosophy, which, Moati argues, can profit greatly by returning (...) to this classic debate. In this book, Moati systematically replays the historical encounter between Austin, Derrida, and Searle and the disruption that caused the lasting break between Anglo-American language philosophy and continental traditions of phenomenology and its deconstruction. The key issue, Moati argues, is not whether "intentionality," a concept derived from Husserl's phenomenology, can or cannot be linked to Austin's speech-acts as defined in his groundbreaking _How to Do Things with Words_, but rather the emphasis Searle placed on the performativity and determined pragmatic values of Austin's speech-acts, whereas Derrida insisted on the trace of writing behind every act of speech and the iterability of signs in different contexts. This is the story of Lisa 1 —a woman like so many others who has been abused—and of her healing journey using music and creative arts experiences. It is also a story about how music, song, poetry, art, and dance awakened her to a new consciousness and provided the necessary empowerment she needed in order to reclaim the woman she had been before experiencing the trauma of abuse. While the question of how utilization of music and the creative arts encourages (...) personal transformation and healing is also deserving of a theoretical exploration, in this article I have chosen to foreground Lisa's story as narrative, in order to also engage the reader with the transformative potential of empowerment that comes through listening. I have chosen an approach that foregrounds Lisa's experience over theory explicitly, for, it is with the process of "finding voice" and of engaging the listener in that process, that transformation of consciousness and empowerment occurs. Our everyday language is drenched with terms and labels that refer to the social groups that are distinguished in our world. This influences the way we interact with ourselves and others. In this paper I discuss (1) how closely intertwined this labeling is with our nature as linguistic beings, what we should think (2) of our widespread and deeply entrenched inclination to socially categorize ourselves and others vis-a-vis (3) the harm it does according to an enormous amount of literature that (...) has appeared in the past decades. In my discussion I steer clear of the heated discussion surrounding wokeness and the so-called culture wars, but discuss some of the tensions beneath it. My discussion is aimed at those who do not exactly know how to relate to the increased and omnipresent social categorisation in our daily practices, but would prefer to approach one another outside of those categories, aware of the potential harm it might do. I conclude with a short reflection on the notions of playfulness and symmetry, and how these might help us improve our attitude towards the other. (shrink)

Existing research has shown that norm violations influence causal judgments, and a number of different models have been developed to explain these effects. One such model, the necessity/sufficiency model, predicts an interac- tion pattern in people’s judgments. Specifically, it predicts that when people are judging the degree to which a particular factor is a cause, there should be an interaction between (a) the degree to which that factor violates a norm and (b) the degree to which another factor in the (...) situation violates norms. A study of moral norms (N = 1000) and norms of proper functioning (N = 3000) revealed robust evidence for the predicted interaction effect. The implications of these patterns for existing theories of causal judgments is discussed. (shrink)

Mereological principles are sometimes used to support general claims about the structure and arrangement of objects in the world. I focus initially on one such mereological principle, the weak supplementation principle (WSP). It is not obvious that (WSP) is prescribed by ordinary thinking about parthood. Further, (WSP) is not needed for a fairly strong formal characterization of the part–whole relation. For these reasons, some arguments relying on (WSP) might be countered by simply denying (WSP). I argue more generally that there (...) is no reason to assume that one core mereology functions as a common basis for all plausible metaphysical theories. (shrink)
