Hohfeld’s analysis on the different types of rights and duties is highly influential in analytical legal theory, and it is considered as a fundamental theory in AI&Law and normative multi-agent systems. Yet a century later, the formalization of this theory remains, in various ways, unresolved. In this paper I provide a formal analysis of how the working of a system containing Hohfeldian rights and duties can be delineated. This formalization starts from using the same tools as the classical ones by (...) Kanger and Lindahl used, but instead of focusing on the algebraic features of rights and duties, it aims at providing a comprehensive analysis of what these rights and duties actually are and how they behave and at saying something substantial on Power too—maintaining all along the Hohfeldian intentions that these rights and duties are sui generis and inherently relational. In recent work, Mark Johnson has argued that a scientifically updated version of John Dewey’s pragmatism affords human beings the opportunity to feel at home in the world. This feeling at home, however, is not fully problematized, nor explored, nor resolved by Johnson. Rather, Johnson and his collaborators, Don Tucker (2021) and Jay Schulkin (2023), defend this updated pragmatism within the historical development of the sciences of life and mind from the twentieth century to the present day. A central theme (...) in this defense is the affinity pragmatism has with neurophenomenology, especially the enactivism seen in 4E cognition. Another theme is the future orientation of pragmatism, especially as it is focused on developments in cybernetics and artificial intelligence. Given Johnson’s previous work on expanding the number of E’s to 7, and other pragmatist suggestions for more, I argue that neuropragmatism’s development of Dewey’s conception of experience as organism-environment transaction (symbolized by the diphthong, Œ) is critical for understanding what Johnson and Tucker call the cybernetic revolution as an enchanting and welcoming future instead of a disenchanting and alienating one. Every day, people make decisions about who owns what. What cognitive processes produce this? The target article emphasises the role of biologically evolved intuitions about competition and cooperation. We elaborate the role of cultural evolutionary processes for solving coordination problems. A model based fully on biological evolution misses important insights for explaining the arbitrariness and historical contingency in ownership beliefs.

There is ample research on how metaphors of life vary both cross-culturally and within culture, with age emerging as possibly the most significant variable with regard to the latter dimension. However, no representative research has yet been carried on whether variation can also occur across time. Our paper attempts to fill this gap in the literature by exploring whether a major crisis, such as the COVID-19 pandemic, can induce variation in how life is metaphorically conceptualized throughout society. By drawing on (...) the results of a nationwide, representative survey on the metaphorical preferences for life among Hungarian adults carried out during the second wave of the COVID-19 pandemic, we hypothesized that the pandemic would induce a revolutionary change (in the sense of the change being swift, as opposed to gradual) in how Hungarian adults metaphorically conceptualize life, as compared to the metaphorical preferences of the pre-COVID-19 era. We expected this variation to manifest itself in the emergence of novel metaphorical source domains and a realignment in metaphorical preferences. Our results, however, indicate that novel conceptualizations emerged only as one-off metaphors; Hungarians mostly rely on a stock collection of life metaphors even in times of crises, with changes happening mostly in the form of shifts in metaphorical preferences. Our study also found that the choice of preference of the source domains showed less alterations among older adults – implying that the older we get, the more resistant to change our metaphorical conceptualizations become, even under extreme conditions such as COVID-19. This paper arose out of the 2017 international conference on AI and law doctoral consortium. There were five students who presented their Ph.D. work, and each of them has contributed a section to this paper. The paper offers a view of what topics are currently engaging students, and shows the diversity of their interests and influences.

Recent work in neurophilosophy has either made reference to the work of John Dewey or independently developed positions similar to it. I review these developments in order first to show that Dewey was indeed doing neurophilosophy well before the Churchlands and others, thereby preceding many other mid-twentieth century European philosophers’ views on cognition to whom many present day philosophers refer (e.g., Heidegger, Merleau-Ponty). I also show that Dewey’s work provides useful tools for evading or overcoming many issues in contemporary neurophilosophy (...) and philosophy of mind. In this introductory review, I distinguish between three waves among neurophilosophers that revolve around the import of evolution and the degree of brain-centrism. Throughout, I emphasize and elaborate upon Dewey’s dynamic view of mind and consciousness. I conclude by introducing the consciousness-as-cooking metaphor as an alternative to both the consciousness-as-digestion and consciousness-as-dancing metaphors. Neurophilosophical pragmatism—or neuropragmatism—recognizes the import of evolutionary and cognitive neurobiology for developing a science of mind and consciousness. However, as the cooking metaphor illustrates, a science of mind and consciousness cannot rely on the brain alone—just as explaining cooking entails more than understanding the gut—and therefore must establish continuity with cultural activities and their respective fields of inquiry. Neuropragmatism advances a new and promising perspective on how to reconcile the scientific and manifest images of humanity as well as how to reconstruct the relationship between science and the humanities. The present paper—taking the example of the English translation of the Hungarian Civil Code of 2013—aims to give an overview on the legal and terminology-related challenges and pitfalls that might occur during the process of translating a civil code with civil law traditions into the language of the common law world. An attempt is made to categorise terminology-related conceptual problems and elaborate how the different types of translation methods could be applied; moreover, how a kind of legal-linguistic checks-and-balances can be (...) achieved through the well-dosed combination, having also the ratio of similarities to differences of legal concepts behind the respective terms in mind. Legal translators must act beyond the role of a simple translator: they must be comparatists, being aware of the legal origin of the relevant concepts and using the methods of comparative private law and translation studies at the same time, since both law and language are system-bound and are heavily influenced by the cultural and social environment. The authors strive to identify the significance of those problems from the perspective of how language-related aspects can perform some fine-tuning on the comparative methodology and findings, whether they are barriers only or provide also an opportunity to verify or refute prima facie comparative results. Comparative law—no doubt—supports legal translation, but their relationship is reciprocal: legal-linguistic subjects and problems emerging in the course of legal translation supply valuable feedback and further sources of inspiration. Over the past three decades, cognitive science has been making a turn towards pragmatism. Here we outline steps towards completing this turn. As a handful of cognitive scientists and philosophers have been arguing more recently, the insights of William James, John Dewey, and George Herbert Mead are not only being re-discovered, they are also proving rather prescient in light of growing research. The new field of neuropragmatism aims to take these insights seriously and further into new directions for both pragmatism (...) and cognitive science. In this manifesto, a brief history of the relationship between classical pragmatism and the sciences of life and mind is offered as a background for twelve proposed theses of neuropragmatism. These theses serve as general guidelines for further philosophical and scientific research. To illustrate the possibilities and consequences of this neuropragmatic framework, neuropragmatist views on traditional questions of philosophy of mind, such as the mind-body relationship, are situated among other leading philosophical perspectives, like enactive, embodied, and embedded theories of cognition and mentation. Such views, however, when taken from a neuropragmatist perspecitve, have significant consequences for the philosophical project of reconciliation be- tween what Wilfrid Sellars called the scientific and manifest images of humanity. The difference in conceptions of experience and subesequently science are crucial for understanding the difference between Sellarsian neurophilosophy and neuropragmatism, as well as how to reach rapprochement between the sciences and the humanities. Some consequences of direct realism and William James’s philosophy of mind are considered in terms of American naturalism as seen in the debate between John Dewey and Roy Wood Sellars. Sellars’s critical realism and evolutionary naturalism is compared and contrasted with Dewey’s pragmatic realism and emphatically evolutionary naturalism. Though these naturalisms are similar, there are significant differences between methodology, their critiques of James’s reflex arc concept in his Principles of Psychology, and the mind-body problem. Sellars’s critical realism and naturalism retains (...) a priori commitments to fixed categories and concepts, whereas Dewey’s emphatically evolutionary pragmatic naturalism is empirical and sees continuities where Sellars insists on discontinuities. One significant difference is Sellars’s maintaining a place for introspection as methodologically appropriate and Dewey’s’ rejection of it. These differences are illustrated through Sellars’s modification of the reflex arc to include an organic but interpretative step, and Dewey’s radical criticism of approaches like James’s and Sellars’s as recapitulating the Cartesian dualism that such views intended to overcome. These differences are finally contrasted in Sellars’s maintaining a privacy of mind by constraining it to the brain in a dual-aspect theory, while Dewey advocates mind as sociocultural, expanding mind into body and world. I address the problem of caring for our body-mind through neuropragmatism, cybernetics, and Larry Hickman’s work on John Dewey and the philosophy of technology. The problems of body-mind health are related to Emma Dowling’s The Care Crisis. I address this crisis by drawing on Jay Schulkin’s conception of viability as the creative tension between stability and precarity. From this, I extend body-mind health to questions of democracy, leading to the proposal of body-mind-world as an elaboration of neuropragmatism’s evolutionary and ecological (...) conception of experience as Œ and Hickman’s distinction between the merely valued nature-as-nature and the valuable nature-as-culture. Neuropragmatism offers a non-dualistic conception of experience from which scientific inquiries can provide resources for sociocultural critique. This reconstructive effort addresses what Emma Dowling calls the care crisis without succumbing to what Mike W. Martin calls therapeutic tyranny. This tyranny relies on problematic dualisms, between mind/body, mind/world, and fact/value, that are also found in neuropsychoanalysis. While pragmatism and psychoanalysis more generally share an evolutionary perspective and can overlap in therapeutic approaches, neuropsychoanalysis diverges from this effort in its dual-aspect monism and (...) positivistic conception of science. Where neuropsychoanalysis seeks to reconcile the first-person subjectivity of lived experience with the third-person objectivity of science, neuropragmatism offers reconstruction. In taking the neuropragmatic turn, neuropsychoanalysts can better utilize Freudian therapies in conjunction with active inference principles, such as the free-energy principle and allostasis. Along with neuropragmatism’s conception of experience as organism-environment dynamic engagement, neuropsychoanalysis can benefit from allostatic approaches to experience and inquiry without reducing experience to brute mechanism or denying the utility of such mechanisms for prediction and intervention. Understanding the value-ladenness of experience, primary and secondary, in everyday waking life and in reflective inquiry, empowers people to better care for themselves without succumbing to merely coping with neoliberal oppression. Cognitive science and its philosophy have been far too long consumed with representation. This concern is indicative of a creeping Cartesianism that many scientists and philosophers wish to evade. However, their naturalism is often insufficiently evolutionary to fully appreciate the lessons of pragmatism. If cognitive neuroscience and pragmatism are to be mutually beneficial, the representational-friendly scientists and the anti-representational pragmatists need an alternative to representation that still accounts for what many find so attractive about representation, namely intentionality. I propose that (...) instead of representations we philosophers and scientists begin thinking in terms of cultural affordances. Like Gibsonian affordances, cultural affordances are opportunities for action. However, unlike Gibsonian affordances, which are merely biological and available for immediate action in the immediately present environment, cultural affordances also present opportunities for thinking about the past and acting into the future—tasks typically attributed to representations. A comprehensive exploration of pragmatic themes emerging from neuroscientific research,illustrating why neurophilosophy should take this advancing pragmatist direction seriously.

An online survey of 654 Australians found that the NP seniors is associated with positive personal characteristics of health and well-being such as ‘like to travel’, ‘lead an involved and active life’, ‘are vibrant and full of purpose’. Older people is also associated with positive characteristics, but somewhat less so than seniors and more socially oriented. Older people are seen to ‘benefit the workforce through their experience’, ‘have wisdom and can always be turned to for advice’, ‘play an important role (...) in their extended family’s life’. By contrast, the characteristics of those typically referred to by the elderly are negative in that the referents are incompetent or impose a burden on society, cf. ‘are frail and fall more often’, ‘are often victims of mental and physical abuse’, ‘are unable to look after themselves and depend on others for help’. The referents of old people and oldies have no particular set of characteristics assigned to them; perhaps that is why they only figure in the one characteristic ‘are tight-fisted with money’ that itself is not strongly associated with any one of the five NPs. Social media is an endless source of texts and images about almost everything. Accordingly, the number of analyses based on this source increases daily. Among the numerous methods social media can be analysed by, our attention focusses on discourse analysis. DA is a complex approach which makes it possible to capture not only the linguistic characteristics of given texts, but also their socially constructive and socially constructed features. Therefore, we carried out a systematic examination of the articles at one of (...) the largest academic databases, EBSCO available in 2019 which used DA in social media research. Our investigation studies not only the geographical distribution of this corpus, but the different self-proclaimed DA approaches. Furthermore, we developed a three-level scale in order to capture the methodological complexity of the collected articles. At one end of the scale there are those research papers where discourse appears only as a label for the textual material gathered, without further indication of any DA theories or methodologies. The other end, however, refers to those research projects which applied DA both in their theoretical and methodological frameworks, providing complex discourse analytical investigations of social media texts. This way we were able to demonstrate the wide array of DA perspectives employed in social media research. (shrink)

William James’s lead continues to provide a balancing act of inquiry and truth with plurality and conflict. First, this article considers this balancing act in neuroscience, both what we have been learning since James published The Principles of Psychology and in how neuroscience is done. As pragmatists have long argued against dualisms and absolutes, the authors situate contemporary understanding in its historical context. Humans have evolved as brains-in-bodies-in-cultures and navigate such worlds through good-enough strategies, not a disembodied reason. Embodied intelligence (...) is laden with instinct, habit, and emotion as much as it is about consciousness. Truth, for James, is focused on nuanced success outcomes, both modest and broad. James’s sense of fallibility is critical in terms of comfort and discomfort in a social group. More prosocial behavior tends to be honest and less sociopathic, of course unless it is myopic and only in group orientation, which it often is. Understanding ourselves through the neuroscience does not answer most of the questions nor solve all the problems. However, such understanding is an important tool in aiding our coping efforts, especially regarding contemporary life. (shrink)

Pragmatism has resurged explicitly in neopragmatism and implicitly in neurophilosophy. Neopragmatists have focused primarily on ideals, like human freedom, but at the expense of science. Neurophilosophers have focused primarily on scientific facts, but with an eye toward dismissing aspects of our self-conception like free will as illusory. In both cases, these resurgences are impoverished as each neglects what Dewey referred to as the method of intelligence. Neurophilosophical pragmatism - neuropragmatism - aims to overcome the deficiencies of neopragmatism and neurophilosophy by (...) carrying forth the project of reconstruction by taking both the methods and results of experimental inquiry as the means for attaining ends-in-view such as human freedom. This article provides an overview of some of the key changes brought about by the groundbreaking Framework Agreement (known as the Ohrid Agreement) in Macedonia since its signing in 2001. A power-sharing arrangement, it saved Macedonia from the brink of civil war. This article describes how the Ohrid Agreement restored peace by addressing the constitutional status of minorities, their equitable representation in the public sector and issues connected with higher education in the 2002–2006 period. It further assesses the merits of (...) decentralization as a remedy for safeguarding a unitary state in a multi-ethnic environment. It consequently argues that the Ohrid Agreement and the ensuing reforms have been important steps in the right direction revitalizing Macedonia by empowering not only the sizeable Albanian population but other less numerous communities as well. However, daunting challenges remain ahead. The perception and language gap between the two main ethnic communities hinder efforts for a truly functioning multi-ethnic state. Moreover, the new government formed after the July 2006 general elections has stirred controversy and caused tensions affecting its Euro-Atlantic perspective. To what extent this will affect Macedonia’s multi-ethnic democracy remains to be seen. (shrink)

I propose we discuss pluralistic humanism as an alternative to both atheism and traditional theism in an effort to establish a democratic faith to which we, despite our differences, can bind ourselves. I draw on the thought of American pragmatists to articulate a constructive criticism of new atheists. This criticism primarily focuses on the unacknowledged affinities between religion and scientific atheism – namely, a naive realism and a conversion experience – with the hope of using such common ground as a (...) starting point for not only shared experience but for self-examination. I conclude with the proposal that we take up a Deweyan conception of democracy as a common faith aimed at effecting religious or spiritual experiences despite the traditional oppression of institutional religion. We address Mark Tschaepe’s response to Tibor Solymosi, in which Tschaepe argues that neuropragmatism needs to be coupled with humility in order to redress “dopamine democracy,” Tschaepe’s term for our contemporary situation of smartphone addiction that undermines democracy. We reject Tschaepe’s distinction between humility and fallibility, arguing that audacious fallibility is all we need. We take the opportunity presented by Tschaepe’s constructive criticism of neuropragmatism to reassert some central themes of neuropragmatism. We close with discussion of Bywater’s method of (...) apprenticeship, as an imaginative education for creative democracy, thereby rejecting Tschaepe’s claim that neuropragmatism lacks a pedagogical method. Roy Scranton argues for a new philosophical humanism as the best response to the existential crisis of the Anthropocene, the new geological epoch for which human industrial activity is responsible. This threat from climate change, Scranton argues, is better met through what he calls photohumanism than by science, technology, engineering, and mathematics alone. This new humanism shares many affinities with pluralistic humanism. A key concern is political action, which is problematized by what Tschaepe calls dopamine democracy. Scranton shares this concern, (...) but his approach puts too great an emphasis on binaries, such as culture and nature, mind and body, and life and death. I offer the philosophical method of reconstruction, as situated within pluralistic humanism and the philosophy of John Dewey. In introducing the need for reconstruction as a method for doing philosophy in a new but ancient sense of learning to die, I reconstruct photohumanism and offer the Deweyan ideal of democracy for overcoming the problem of the Anthropocene. The tension between naturalism and humanism is at its greatest when it comes to ethics and morality. By drawing on the affinity between the evolutionary humanistic philosophies of classical pragmatist John Dewey and contemporary pragmatist Daniel Dennett, I modify Dennett’s ethical technology, Moral First Aid, to include a kit as well as Dennett’s proposed manual. The contents of this kit draw on Dewey’s reconstructed moral genealogy in which three factors, goods, rights, and virtues, become stock parts for the technoscience of (...) ethics. Lacking in Dennett’s account is an adequate ideal by which to measure moral success. I propose that moral first aid take up Dewey’s moral ideal of democracy as the guide for resolving moral exigencies. (shrink)

The formal analysis of normative systems has traditionally focused on their deontic dimension rather than on their potestative dimension; yet, a growing amount of works aims at shedding light on the notion of power, its norm changing potential and its general interactions with deontic concepts. The present article contributes to this line of inquiry by adopting the following perspective: a normative system can be metaphorically seen as an agent that allocates abilities (powers) in order to promote the fulfillment of certain (...) desires (deontic directives), and in doing so regulates its behavioural domain. Our analysis emphasizes the instrumental nature of power, while clarifying the distinction between ‘being allowed’ and ‘being enabled’ and unveiling new patterns of interaction between deontic and potestative concepts. Operationally, we formulate this framework in terms of conditional rules, and provide a corresponding logic programming (ASP) implementation. (shrink)

In his essay, “Affording our Culture: “Smart” Technology and the Prospects for Creative Democracy,” Tibor Solymosi addresses my challenge for neuropragmatism to counter what I have elsewhere called dopamine democracy. Although I believe that Solymosi has begun to provide an explanation for how neuropragmatism may counter dopamine democracy, especially with his conceptions Œ and cultural affordances, I respond with a helpful addition to his approach by returning to the theory of inquiry as put forth by John Dewey. In (...) particular, I focus on the phases of inquiry as colored by Dewey’s concept of humility. Solymosi does not pay adequate attention to the function of inquiry necessary for combatting dopamine democracy. His account of cultural affordances and education is strengthened by using Dewey’s concept of humility as a guiding disposition for neuropragmatic inquiry. Recognizing humility as an instrument of neuropragmatic inquiry provides us with a tool to better address the pitfalls of dopamine democracy, especially misinformation and incentive salience. My argument proceeds by first articulating dopamine democracy as a problem and Solymosi’s concept of cultural affordances and how he understands these as neuropragmatic tools to address the problem through education. I present humility as an instrumental concept derived from Dewey’s work on inquiry. I then suggest how humility may serve neuropragmatic inquiry to assist in combatting the problems of dopamine democracy. (shrink)
