Comparative law is a subject always in motion. Scholarly discussion about its methodology is always vivid, in search of better tools to make the different possible comparative endeavors. The paper explores the concept of lawscape and its link with comparative legal methodology. The concept of lawscape will be linked with other relevant concepts in comparative law, like those of legal pluralism, legal transplants, legal formants and legal fluxes to make the necessary connections and find its space within the tools of (...) comparative law. Emotion-processing impairment represents a risk factor for the development of somatic illness, affecting negatively both health-related quality of life and disease management in several chronic diseases. The present pilot study aims at investigating the associations between alexithymia and depression, anxiety, and HRQoL in patients with Hashimoto’s thyroiditis ; examining the association between these three psychological conditions together with HRQoL, and thyroid autoantibodies status as well as thyroid echotexture in patients with HT; and comparing the intensity of all these clinical psychological (...) features in patients with HT versus controls. Twenty-one patients with serologically or ultrasonographically verified HT and 16 controls with non-toxic goiter or postsurgical hypothyroidism were recruited for this study. Serum thyrotropin and free thyroxine, as well as thyroid autoantibodies, were assayed. Alexithymia, depression, anxiety, and HRQoL were assessed with Toronto Alexithymia Scale; Beck Depression Inventory, second edition; Hamilton Anxiety Rating Scale; and Health Survey Short-Form 36, respectively. A negative relationship between the difficulty to describe feelings and the cognitive component of depression was found. Besides, patients with seronegative HT had lower somatic anxiety than patients with HT who tested positive. Besides, no statistically significant difference was found between patients with HT and controls with regard to somatic anxiety. The present study suggests the relevance of alexithymia in patients suffering from HT, which may be intertwined with a possible state of underreported depression that is mainly expressed through physical complaints. Promoting the capability to describe and communicate feelings could contribute to psychological elaboration and coping with the disease and, consequently, to the improvement of self-management and perceived HRQoL. In an era increasingly characterized by pluralism and globalization, intercultural pedagogy represents a starting point for addressing the challenges that today’s society confronts us with daily. Throughout history, cultures have changed through interactions, exchanges, and hybridization, leading to the formation of an increasingly pluralistic and multicultural society. Against this background, it is crucial to develop approaches based on dialogue and mutual recognition. However, acceptance and willingness to encounter require an educational path that is promoted by schools from childhood, especially in (...) view of the monocultural mentality that too often characterizes more and more people and prevents the opening of a path that counteracts ethnocentrism in favor of a broader perspective. From this point of view, intercultural pedagogy proves to be the only approach that can guarantee the formation of individuals ready to create a truly multicultural society. (shrink)

Quine maintained that philosophical and scientific theorizing should be conducted in an untyped language, which has just one style of variables and quantifiers. By contrast, typed languages, such as those advocated by Frege and Russell, include multiple styles of variables and matching kinds of quantification. Which form should our theories take? In this article, I argue that expressivity does not favour typed languages over untyped ones.

According to the singular conception of reality, there are objects and there are singular properties, i.e. properties that are instantiated by objects separately. It has been argued that semantic considerations about plurals give us reasons to embrace a plural conception of reality. This is the view that, in addition to singular properties, there are plural properties, i.e. properties that are instantiated jointly by many objects. In this article, I propose and defend a novel semantic account of plurals which dispenses with (...) plural properties and thus undermines the semantic argument in favor of the plural conception of reality. After a brief outline of Enoch’s defense of robust realism in his Taking Morality Seriously, I focus on Enoch’s taking-morality-seriously thought by making explicit the assumptions I see involved in it. Enoch’s argument from impartiality is then reconstructed to show how these assumptions are at work. Next, I explain the reasons why Enoch does not succeed in converting these assumptions into a positive argument for the thesis implied by robust realism that there is a moral objectivity. Finally, I conclude that (...) the critical analysis provided casts a shadow on the reliability of the taking-morality-seriously thought as a basis of a theoretical inquiry into the nature of morality. This study provides a scoping review of the recent conceptual developments about the deviant work behavior and counterproductive work behavior constructs. It also examines the specific types of deviant work behavior that have been more consistently investigated in the last decade, and whether they cover the interpersonal or organizational type of deviant behavior. In addition, individual, group, and organizational predictors of deviant work behaviors are examined. A scoping review of reviews was conducted on Scopus and Web of Science databases and (...) 54 studies published from 2010 to June 2021 were taken into account. Results show that more recent conceptualizations are based on well established models in the literature and consider the hierarchical structure of these two constructs. Recent reviews examine the relationships of deviant work behavior with job performance and ethical behavior constructs, the multilevel nature of deviant work behavior, and the consequences for the actor of the deviance. The specific types of deviant work behavior more frequently reviewed in the last decade are workplace abuse, incivility, ostracism, bullying and sexual harassment, and abusive and destructive leadership; this evidence suggests a much greater attention to interpersonal, rather than organizational, forms of deviant work behavior. Regarding antecedents, results show the continuing prevalence of personality factors antecedents. Limitations of the study and theoretical and practical implications for the field are also provided. Semantic theories based on a hierarchy of types have prominently been used to defend the possibility of unrestricted quantification. However, they also pose a prima facie problem for it: each quantifier ranges over at most one level of the hierarchy and is therefore not unrestricted. It is difficult to evaluate this problem without a principled account of what it is for a quantifier to be unrestricted. Drawing on an insight of Russell’s about the relationship between quantification and the structure of (...) predication, we offer such an account. We use this account to examine the problem in three different type-theoretic settings, which are increasingly permissive with respect to predication. We conclude that unrestricted quantification is available in all but the most permissive kind of type theory. (shrink)

Plural expressions found in natural languages allow us to talk about many objects simultaneously. Plural logic — a logical system that takes plurals at face value — has seen a surge of interest in recent years. This book explores its broader significance for philosophy, logic, and linguistics. What can plural logic do for us? Are the bold claims made on its behalf correct? After introducing plural logic and its main applications, the book provides a systematic analysis of the relation between (...) this logic and other theoretical frameworks such as set theory, mereology, higher-order logic, and modal logic. The applications of plural logic rely on two assumptions, namely that this logic is ontologically innocent and has great expressive power. These assumptions are shown to be problematic. The result is a more nuanced picture of plural logic's applications than has been given thus far. Questions about the correct logic of plurals play a central role in the final chapters, where traditional plural logic is rejected in favor of a "critical" alternative. The most striking feature of this alternative is that there is no universal plurality. This leads to a novel approach to the relation between the many and the one. In particular, critical plural logic paves the way for an account of sets capable of solving the set-theoretic paradoxes. (shrink)

What is absolutely unrestricted quantification? We distinguish two theoretical roles and identify two conceptions of absolute generality: maximally strong generality and maximally inclusive generality. We also distinguish two corresponding kinds of absolute domain. A maximally strong domain contains every potential counterexample to a generalisation. A maximally inclusive domain is such that no domain extends it. We argue that both conceptions of absolute generality are legitimate and investigate the relations between them. Although these conceptions coincide in standard settings, we show how (...) they diverge under more complex assumptions about the structure of meaningful predication, such as cumulative type theory. We conclude by arguing that maximally strong generality is the more theoretically valuable conception. (shrink)

Plural logic is widely assumed to have two important virtues: ontological innocence and determinacy. It is claimed to be innocent in the sense that it incurs no ontological commitments beyond those already incurred by the first-order quantifiers. It is claimed to be determinate in the sense that it is immune to the threat of non-standard interpretations that confronts higher-order logics on their more traditional, set-based semantics. We challenge both claims. Our challenge is based on a Henkin-style semantics for plural logic (...) that does not resort to sets or set-like objects to interpret plural variables, but adopts the view that a plural variable has many objects as its values. Using this semantics, we also articulate a generalized notion of ontological commitment which enables us to develop some ideas of earlier critics of the alleged ontological innocence of plural logic. This paper reports the framework, method and main findings of an analysis of cultural milieus in 4 European countries. The analysis is based on a questionnaire applied to a sample built through a two-step procedure of post-hoc random selection from a broader dataset based on an online survey. Responses to the questionnaire were subjected to multidimensional analysis-a combination of Multiple Correspondence Analysis and Cluster Analysis. We identified 5 symbolic universes, that correspond to basic, embodied, affect-laden, generalized worldviews. People in this (...) study see the world as either a) an ordered universe;b) a matter of interpersonal bond;c) a caring society;d) consisting of a niche of belongingness;e) a hostile place. These symbolic universes were also interpreted as semiotic capital: they reflect the capacity of a place to foster social and civic development. Moreover, the distribution of the symbolic universes, and therefore social and civic engagement, is demonstrated to be variable across the 4 countries in the analysis. Finally, we develop a retrospective reconstruction of the distribution of symbolic universes as well as the interplay between their current state and past, present and future socio-institutional scenarios. ABSTRACT Carl Schmitt is generally considered as the father of exceptionalism – the theory that the heart of politics lies in the sovereign power to issue emergency measures that suspend everyday normality. This is why his name comes up anytime state governments, whether liberal or not, impose limits on constitutional rights and freedoms to cope with emergencies. This article problematises such a received understanding. It argues that Schmitt held an exceptionalist view for a limited period of time and that even (...) in that period his thinking cannot be regarded as unshakably exceptionalist. This interpretation offers a new entry point to Schmitt’s overall theory. While it can hardly be defended from allegations of reactionary conservatism, it remains a juristic theory of the legal order that tries to answer the question of what ensures the stability of social life. The backdrop of this view is an institutional theory of law and politics that is hardly reconcilable with any form of exceptionalism. In this light, the core of Schmitt’s thinking turns out to be the exaltation of legal science as a jurisgenerative practice that shelters a community’s institutional practices and the traditional identity. Im folgenden Beitrag möchte ich einige Überlegungen zu einer hermeneutischen Vorgehensweise in der Anthropologie anstellen, die das Paradigma der “klassischen” philosophischen Anthropologie in der Perspektive der Postmoderne überdenken. Ich plädiere für ein anthropologisches Projekt, das die Tradition der Lebensphilosophie fortsetzt, insbesondere den Anspruch von Otto Friedrich Bollnow auf eine bildlose Anthropologie. Ich versuche, plausibel zu machen, dass die Anthropologie nicht die Natur des Menschen und seine Stellung im Kosmos untersuchen, sondern Identitäten im praktischen Sinn beschreiben sollte. Einen hermeneutische Anthropologie hat (...) dann eine doppelte Aufgabe: Sie arbeitet an den Bildlichkeiten, die Identitäten bilden, sowohl auf der sozialen als auch auf der persönlichen Ebene; zur gleichen Zeit spielt sie eine praktische Rolle, indem sie an Verantwortung für die Lebensgestaltung appelliert. Die mythologische Gestalt des Hermes, der Seelenführer und Beschützer der Übergänge, passt dann perfekt zu dieser Doppelrolle einer hermeneutischen Anthropologie, die nicht nur Theorie macht, sondern auch Bewusstsein und neue Möglichkeiten des menschlichen Fortschritts schafft. In this paper, I will compare the Aristotelian and the Middle-Stoic concepts of liberality as stated by Cicero in the De Officiis, which refers to Panaetius. For both concepts, liberality is a principal virtue of socio-political life, but they start from different premises: the individual life in case of Aristotle, and social bonds in the case of Middle-Stoicism. I will try to point out that Aristotle, led by the dualism of reason and passions, is bound to think of liberality as (...) an individual character virtue that prevails over the natural attachment to wealth and assets. Because of his dualism, Aristotle must exclude non-economic beneficence from the domain of liberality. In comparison, the Middle-Stoic approach is mainly based on the idea of sociability. This model does not undervalue goods, but it states that virtues mature from the balanced development of natural impulses, based on the combination of sociability and self-preservation, rather than from an ascetic effort. More particularly, the virtue of liberality originates from the social dimension of moral good. The liberal citizen can make virtuous use of money in certain cases, but he does not necessarily need it. The social sense is crucial, and it leads to the personal support of others, thereby creating and strengthening social bonds. (shrink)

This paper discusses Max Scheler’s early works, written between 1899 and 1906 in a neo-Kantian context. The very little attention the literature paid to them was almost always guided by the only aim to single the themes out which can be used as signs of Scheler’s future „conversion“ to phenomenology. In consequence of this predominant approach, the neo- Kantianism that characterizes Scheler’s early works has been treated as a vague notion and never examined as such. The paper specifies this notion (...) through an examination of Scheler’s early works which shows their most significant theoretical debts (to R. Eucken, W. Windelband and particularly to H. Cohen) and the questions they deal with, i.e. the relation between knowledge and morality as different kinds of objective forms of experience; the methodological problem in philosophy; the development of a transcendental logic as general science of objectivity. L’articolo mette in luce due paradossi, il primo dei quali è dato dal fatto che proprio in quelle terre dove si affermò la radicale impostazione anti-umanistica del protestantesimo ebbe a scaturire una straordinaria fioritura dell’umano fino alla consacrazione della libertà come principio della ricerca scientifica e del vivere civile. Il secondo paradosso è dato dalla manifestazione in quelle stesse terre meno di un secolo fa dell’ideologia nazista. La tesi sostenuta è che il principio protestante di fatto affermatosi nella coscienza europea (...) consiste non tanto nella teoria teologica della giustificazione (sola Gratia, sola Fide, sola Scriptura) quanto nella affermazione filosofica e politica della libera coscienza personale, il cui evento decisivo fu la dichiarazione di Lutero alla Dieta di Worms. Ma proprio il carattere abissale della libertà e il destino di interpretazione infinita cui la consegnò Lutero sono anche all’origine di quel disagio della coscienza e dell’esistenza da cui sorse il malessere che portò al totalitarismo.Nel sostenere la tesi enunciata l’articolo si struttura secondo quattro movimenti: 1) argomentazione sul carattere radicalmente anti-umanistico del protestantesimo; 2) argomentazione sui notevoli effetti umanistici storicamente prodotti dalla Riforma protestante; 3) argomentazione sulle possibili connessioni tra il terreno preparato dalla Riforma nella società tedesca e il sorgere in essa dell’ideologia nazionalsocialista; 4) considerazioni finali sulla dialettica della libertà umana. In this paper, I try to identify the reasons why the dialogue between sociocultural anthropology and animal rights theories and movements continues to be difficult and scarce. At first sight this weakness of communication is surprising, if one looks at the amount of anthropological studies on human/animal relationships, in most cases pointing to how animals are considered in many cultures as non-human subjects or persons. For understanding the roots of this state of affairs, I compare the ways anthropologists and animal (...) rights theorists and activists have engaged with the issue of the differences and commonalities between human beings and nonhuman animals. For this aim, I contrast the search, among philosophers and activists, for a universal rational ethical foundation of animal rights, to which natural sciences’ findings can give support, with sociocultural anthropologists’ focus on the embeddedness of human/animal relationships in symbolic systems and in political relationships. In spite of the paradigmatic shifts intervened in a century and half of sociocultural anthropology, I show, through a critical review of the recent works of Ingold, Descola, Viveiros de Castro and Kohn, that even today this difference in approach is far to be overcome. This paper presents a case study of the “electric hypothesis” of the causes of earthquakes, which emerged in the second half of the eighteenth century as part of the first studies of seismology. This hypothesis was related to Franklin’s views on atmospheric electricity and developed in a period when electric phenomena were widely studied, and was essentially based on solid empirical evidence and confirmed by model experiments. Even though it resulted from scientific reasoning, the theory remained strongly empirical, and was (...) supported by Italian scholars who were familiar with seismic events. Among these, Giuseppe Saverio Poli, a follower of Franklin, was able to provide a careful and comprehensive explanation of the disastrous earthquake of 1783, which occurred in Calabria, a region of southern Italy, and the St. Anne earthquake of 1805, by drawing not just upon the electric evidence, but all the relevant phenomenology available. We outline here the emergence, the development, and the later evolution (up to the beginning of the nineteenth century) of the “electric earthquake” paradigm by focusing on different works by Poli, including a previously unknown manuscript containing a thorough account of the Calabria earthquake prepared by the Neapolitan scholar for the Royal Society. The present case study therefore offers the opportunity to illustrate how electrical science shaped earthquake science to a degree not usually appreciated in the literature, and is also supported to some extent by the transition from Enlightenment scientific ideals to the Romantic conception of unity in the natural world, in search of common causes among phenomena belonging to different fields. This article focuses on certain dimensions of Plotinus’ notion of the noetic self, which so far have not received sufficient scholarly atten­tion. The evidence of Enn. V 8 makes clear the assumption about the inexhaustible generativity of the noetic self. This generativity implies an intimate relation with the notions of image and suddenness: the former is intended as a medium of unconditional self-transparency, whereas the latter is understood as pointing to the unlimited newness that is char­acteristic of the noetic life, (...) which, according to Plotinus, consists in an indissoluble unity of identity and alterity. The aforesaid notions make it reasonable to view Plotinus’ concept of noetic self as pointing to a predominantly relational and dynamic ontology, in which essentialism presupposes no staticity whatsoever, but can rather be seen as a perspective that leads to the development of a harmonious and non-narcissistic creativity. This article aims to demonstrate that Aimnastos of Plataia (Th. 3.22.5) is identical with a character who appears twice in Herodotus (9.64.2; 72.2). In addition to providing evidence in favor of this identification, this study also comments on Aimnastos’ son, Lakon, and on the presentation of this character in Thucydides. Thucydides seems to correct Herodotus on the actual status of this Plataian family.

Summary This paper concentrates on the literary sources of the battle of Delion and reopens the debate on the relevance of Euripides’ Supplices for the narrative of this event. Thucydides is read with a particular focus on the speech of Pagondas, which can be understood through the current reconstruction of the history of Boiotia in the latter half of the fifth century BCE. Finally, Diodorus is considered as a useful source for a few pieces of information on the aftermath of (...) the battle that have previously been disregarded. (shrink)

A prominent objection against the logicality of second-order logic is the so-called Overgeneration Argument. However, it is far from clear how this argument is to be understood. In the first part of the article, we examine the argument and locate its main source, namely, the alleged entanglement of second-order logic and mathematics. We then identify various reasons why the entanglement may be thought to be problematic. In the second part of the article, we take a metatheoretic perspective on the matter. (...) We prove a number of results establishing that the entanglement is sensitive to the kind of semantics used for second-order logic. These results provide evidence that by moving from the standard set-theoretic semantics for second-order logic to a semantics which makes use of higher-order resources, the entanglement either disappears or may no longer be in conflict with the logicality of second-order logic. In linguistics, the dominant approach to the semantics of plurals appeals to mereology. However, this approach has received strong criticisms from philosophical logicians who subscribe to an alternative framework based on plural logic. In the first part of the article, we offer a precise characterization of the mereological approach and the semantic background in which the debate can be meaningfully reconstructed. In the second part, we deal with the criticisms and assess their logical, linguistic, and philosophical significance. We identify four (...) main objections and show how each can be addressed. Finally, we compare the strengths and shortcomings of the mereological approach and plural logic. Our conclusion is that the former remains a viable and well-motivated framework for the analysis of plurals. (shrink)

Semantic interpretations of both natural and formal languages are usually taken to involve the specification of a domain of entities with respect to which the sentences of the language are to be evaluated. A question that has received much attention of late is whether there is unrestricted quantification, quantification over a domain comprising absolutely everything there is. Is there a discourse or inquiry that has absolute generality? Questo saggio, risultato del lavoro seminariale svolto presso la Fondazione Centro Studi Campostrini, avanza una proposta teoricasulla base di un’ipotesi. L’ipotesi è che quando usiamo il vocabolariodella credenza diciamo qualcosa di specifico e irriducibile adaltre nozioni. Alla ricerca del nucleo di irriducibilità e specificitàdella credenza Giuseppe Di Salvatore scarta tutte quelle forme dicredenza che dipendono in maniera più o meno diretta da unaconsiderazione in termini di conoscenza o da un’implicazione dellaverità. Se alcuni tipi di giustificazione della credenza possono essereutili (...) a individuarne l’irriducibilità, solo le credenze primitive, unacomplessa nozione di “credenza soggettiva” e un originale modellofiduciario della credenza fungono da buoni candidati per difenderela specificità della credenza. Dopo la discussione di alcune tesi diLudwig Wittgenstein e il ricorso a fonti eterogenee, da William Jamesa Henry Habberley Price fino a Niklas Luhmann, l’autore proponela nozione originale di “credenza progressiva” come il migliorcandidato che confermi l’ipotesi di partenza. In essa una precisaidea di rischio e la fiducia, al cui dibattito è dedicata un’ampiaattenzione, contribuiscono a delineare la credenza progressivainsieme ad alcuni suoi aspetti soggettivi, così profilandola comeuna postura sperimentale. The expression oikoi stratiōtikoi, used in Constantine VII Porphyrogenitus as opposed to oikoi politikoi, designates all those families who were bound to military service. They, in the tenth century, were listed in various enlistment registers that were periodically updated, among which one was kept in Constantinople. There is solid evidence to argue that such an administrative practice originated in the eighth century, coinciding with a significant transformation in the enrolment of soldiers and their maintenance. A conscription procedure was devised in (...) the age of the Isaurians, which, although it is not known whether it was on a voluntary or compulsory basis, entailed the entry in the military records (in Constantinople and the provinces) of every person in charge (oikodespotēs) of the family that had assumed the military burden. This implied in later periods a strong uncertainty in the relationship between service and its performance because registration rested on an ambiguous vocabulary. The ambiguity, in fact, was rooted in the polysemy of the concept of oikos, family unit, home and patrimony at the same time. While such a notion allowed the recruitment in thematic armies to function flexibly through the wide network of the family’s cognate and agnatic structure, precisely because the oikos was also a set of economic interests, it exposed the landed patrimony of military families to splitting and erosion. This ambiguity ended with Constantine VII’s famous law of 949, which regulated the property regime of the stratiōtikoi oikoi, a regime that, as the same provision explicitly states in several points, already existed previously throughout the empire. The law provided a precise economic quantification of the assets needed for each ‘military family’ to perform the service. Historiography has generally interpreted Constantine VII’s measure as an act breaking with the previous tradition, since military service appears in it much more markedly connoted as a patrimonial burden, rather than as a personal one. However, this ‘oppositional’ interpretation does not seem adequate for understanding the concept of oikos stratiōtikos, which from the outset must have implied a profound interrelationship between the personality of the service and its patrimonial basis, since the one did not exist without the other. Liberal theory seems to be caught in an impasse. On the one hand, since it has social order as its object, it appears to be committed to resolving the problem of disagreement between the various conceptions; on the other, insofar as it is philosophical theory, it seems destined to cause conflict. How, then, can liberalism offer a solution which guarantees the duration in time of a society, without, however, proposing a theory that would merely be one among others? And how (...) can it do this without adopting reductionist strategies, and by trying to remain faithful to the idea that a society should be ordered by a conception of justice?
