This book articulates and defends an interpretation of Schopenhauer's ethics as an original and credible contribution to the history of ethics. It presents Schopenhauer's ethics of compassion in direct tension with his resignationism and aims to show surprising continuities with Kant's ethics.

By the start of the twenty-first century, the notion of ‘the sublime’ had come to seem incoherent. In the last ten years or so considerable light has been shed by empirical psychologists on a related notion of ‘awe’, and a fruitful dialogue between aestheticians and empirical psychologists has ensued. It is the aim of this paper to synthesize these advances and to offer what I call a ‘two-tiered’ theory of the sublime that shows it to be a coherent aesthetic category. (...) On this theory, sublime experiences begin in an ‘awe response’ (the ‘thin sublime’) and might, with the additional element of temporally-extended reflection, turn into a ‘thick sublime’ response. Building on accounts of the sublime as a species of ‘aesthetic awe’ (Clewis, 2019a and 2019b; Arcangeli, et al., 2020) I aim to show that this two-tiered theory helps to explain why sublime experiences seem to have a basic, primordial core, but also seem to be historically and culturally quite variable (as Nicolson, 1963 [1959]; Battersby, 2007; and McMahon, 2017 have stressed). On this model, the cultural and historical variability comes in largely at the point of the temporally-extended reflection characteristic of the thick sublime, due to the cognitive stock that the subject brings to the encounter. Thus, sublime experiences really lend themselves to being interpreted quite variously by the subject (as well as by the theorist) of these experiences, as, for example, affording insight into the Divine, our moral vocation, or our metaphysical unity with the entire universe, among other lofty thoughts. This argument has emphasized the professional character of Darwin's early activities, largely in order to balance the usual portrayal of the amateurishness of his early training and field of study. Arguing this way has revealed the interplay between Darwin's personal interests and his professional obligations, the latter being particularly important for the period from October 1836 to July 1837. In several instances, notably the treatment of his collections, the progress of his thought followed the professional lead directly. In the absence (...) of such a lead Darwin did not pursue certain issues, if only for lack of time. Thus the subject of man did not figure in his initial formulation of a transmutationist position. Only after the commitment to the new point of view had been made did the issues emerge which will be treated in Part II of this article. However, we may close by noting Darwin's inherited disposition on the subject: in the summer of 1837 Darwin responded to Lyell's claim that the change from irrational animal to rational man represented “a phenomenon of a distinct kind from the passage from the more simple to the more perfect forms of animal organization and instinct” with a fanciful doodle in the margin.121 The thoughts behind the bemused scribbling were to occupy a good portion of Darwin's time for the next two years. Should journalists resist business constraints they perceive as a threat to their professional integrity? This article suggests that the answer, at least sometimes, is yes. But in choosing a resistance strategy, journalists should not consider the "take this job and shove it" stance as the only option with moral integrity-or even as the best ethical option. This article develops a model of resistance strategies using the experiences of journalists at one newspaper to illustrate the range of options available for resisting (...) business constraints within a news organization. The types of strategies identified vary along the ethical dimensions of (a) consideration of organizational, as well as professional, goals; and (b) openness with regard to journalists' preference for professional goals. This year, in 2022, we were delighted to meet face-to-face again on November 18–19 in conjunction with the annual meeting of the American Academy of Religion (AAR). Because we are (...) an AAR "related scholarly organization," all of our events were scheduled through, and publicized by, AAR's staff. President Mark Unno not only presided at the board's table but also graciously ran a video conference, primarily to accommodate board and committee members who were outside the United States or dealing with travel-prohibiting health issues.The 2020 and 2021 fully online governance meetings, led by then-president Leo Lefebure, had been well organized, well run, highly effective, and a lot of fun. But as I watched the attentive eyes around the table this year and listened to the laughter, empathetic sighs, and plans for follow-up conversations, it seemed to me that meeting in person, in some ways, more powerfully supports the society's aim to foster in-depth Buddhist-Christian dialogue and comparative studies. Mark, then vice president, had organized the 2020 and 2021 online paper sessions carefully for online audiences. We were thrilled that these beautifully crafted and moderated presentations drew audiences that were amazingly broad in terms of both size and diversity. Planned as emergency extensions of the society's efforts to create, through our blog and Facebook page, safe online spaces for Buddhist-Christian dialogue and comparative studies, these sessions drew an international audience whose breadth astounded us! Conversations that had begun in these sessions could not, however, be quickly continued over a meal or coffee. Mark is convinced, however, that this early debate was a necessary foundation for developing a more robust mutual learning community. Humans may be the only creatures conscious of having a future, but all too often we would rather not think about it. Likewise, our societies, unable to deal with radical uncertainty, do not make policies with a view to the long term. Instead, we suffer from a sense of powerlessness, collective irrationality, and perennial political discontent. In _The Future and Its Enemies_, Spanish philosopher Daniel Innerarity makes a plea for a new social contract that would commit us to moral and (...) political responsibility with respect to future generations. He urges us to become advocates for the future in the face of enemies who, oblivious to the costs of modernization, press for endless and unproductive acceleration. His accessible book proposes a new way of confronting the unknown—one grounded in the calculation of risk. Declaring the classical right-left divide to be redundant, Innerarity presents his hopes for a renewed democracy and a politics that would find convincing ways to mediate between the priorities of the present, the heritage of the past, and the challenges that lie ahead. One typically thinks of the relevance of Kant’s aesthetic theory to Western art in terms of Modernism, thanks in large part to the work of eminent critic and art historian Clement Greenberg. Yet, thinking of Kant’s legacy for contemporary art as inhering exclusively in “Kantian formalism” obscures a great deal of Kant’s aesthetic theory. In his last book, Arthur Danto suggested just this point, urging us to enlarge our appreciation of Kant’s aesthetic theory and its relevance to contemporary art, because, (...) for Danto, “Kant had two conceptions of art.” In this essay, I support and build on Danto’s claim that there are really two conceptions of art at work in Kant’s third Critique, and that the second conception offers a non-Modernist/formalist way that Kant’s aesthetic theory remains relevant to post 1960s art. My ultimate aim is to highlight another facet in the continuing relevance of Kant’s aesthetic theory to post-Expressionist contemporary art, namely, the explicit attention to the differential aesthetic values of nature and art respectively. I shall do this by putting it in dialogue with the art practice of Latvian-American artist, Vija Celmins whose illustrious career since 1960s has made her an ‘artist’s artist’ but who has also recently garnered much wider attention with a retrospective titled “To Fix the Image in Memory.” Celmins takes up artistically a problematic that is quite central philosophically to the concerns of the third Critique, and thus her work illustrates another way in which Kant’s aesthetic theory is of great continuing relevance to the artworld today. In this paper, we present a Lacanian perspective on football, while notably fathoming its normative dimension. Starting with a defining imperative, the prohibition against ‘handling’ or touching the ball with your hands, diverging football historically from rugby, we will subsequently focus our attention on the role of the foot, the eye (notably the eyes of the audience) and the ‘object a’ (in the context of gender). Against this backdrop, we will address pressing issues such as the troubled position of the (...) referee (as an ‘impossible profession’), the commercialisation of football, and the rising tides of violence, match—fixing and other instances of systemic deviance. As we will argue, football exemplifies modern sport as an arena defined by prohibitions and desire, by inclusion and exclusion, by purity and abuse, culminating in recent challenges involved in gender trouble. Symbolical practices, like modern football, are based on in- and exclusion. Instead of more regulations and dichotomies, we advocate careful attention to the delicate art of handling desire in practice. (shrink)

Digital communication now pervades all spheres of life, creating new possibilities for commodification: personal data and communication are the new resources of surplus value. This in turn brings about a totally new category of threats to privacy. With recourse to the culture industry critique of early critical theory, this article seeks to challenge basic theoretical assumptions held within a liberal account of privacy. It draws the attention to the entanglement of technical and socio-economic transformations and aims at elaborating an alternative (...) framing which takes into account that privacy is not in the first place a pre-political space for individual freedom but a constituted sphere in which social power relations are reproduced in a particularly deceitful way. With recourse to positions of critical theory, this article revisits the conceptual ambiguity of liberation and oppression and looks to draft prospects for a socio-theoretical justification and critique of privacy, updated for the digital age. Following the tradition of critical theory, the argument focuses on (new) forms of domination in and by privacy. It aims to prepare the ground for a critique of the social’s increasing commodification as well as an idea of privacy understood as reflexive participation in social practices. (shrink)

In most circles today, it is taken to be an uncontroversial fact that human beings are having an impact on Earth's climate, and one that is exceedingly worrisom.

This article examines the nature and structure of witness and defendant narrative accounts in the evidential portions of courtroom trials, using the O.J. Simpson, Oklahoma Bombers and Louise Woodward trials as a database. The article proposes a means of distinguishing narrative from non-narrative accounts, using Labov's definition of the `minimal narrative' as a starting point, and puts forward a modified model of narrative structure. A range of narrative structures are explored, and the model is used to analyse a series of (...) representative example narratives taken from the trial data. Different types of narrative fragmentation produced by multiple tellers of the same narrative are also examined, along with the frequent disjunction between `tellers' and `knowers'. Lastly, the article explores the relationship between narrative structures and narrative fragmentation and the discourse strategies used by lawyers in direct and cross-examination. (shrink)

Adaptation to novel visuomotor transformations for example when navigating a cursor on a computer monitor by using a computer mouse, can be explicit or implicit. Explicit adjustments are made when people are informed about the occurrence and the type of a novel visuomotor transformation and intentionally modify their movements. Implicit adjustments, in contrast, are made without reportable knowledge of a novel visuomotor transformation and without a change intention. The relation of implicit adjustments to explicit adjustments needs further clarification. Here we (...) show that these two types of adjustment occur at the same time and remain functionally independent. The size of total adjustment turned out to be the sum of explicit and implicit adjustments measured in isolation, even when both processes produce opposite outcomes. In perspective our results demonstrate that automatic, implicit processes of motor control are not superseded by intentional, explicit ones, but only superposed. (shrink)

The rise of genomic technologies has catalyzed shifts in the health care landscape through the commercialization of genome sequencing and testing services in the genomics marketplace. The development of consumer genomics into a growing array of information technologies aimed at collecting, curating, and broadly sharing personal data and biological materials reconstitutes the meaning of health and reframes patients into biocitizens. In this context, the good biocitizen is expected to assume personal responsibility for health through consumption of genomic information and acquiescence (...) to public and private efforts at data surveillance and aggregation. These shifts raise fundamental questions about how competing interests of the public, the state, and corporate entities will be reconciled and what trade‐offs are demanded for the promise of precision health. Scholarship has intrinsic value, of course; but when good scholarship can stimulate change for the better in an area as fundamental to human dignity as health care and the relief of suffering, there is a special satisfaction. This has been our experience since 1996, when the first of now four special issues of this journal focused on legal, regulatory, ethical, professional, and financial issues in medical treatment for pain.With the generous and steadfast support of the Mayday Fund, the American Society (...) of Law, Medicine & Ethics has generated a significant body of scholarship published in the Journal of Law, Medicine & Ethics. This research has proven absolutely essential in changing public policy to support better care for those who suffer pain.Over these years, the Mayday Project at ASLME has tackled many of the real and perceived barriers to effective pain relief. The nationally embedded and relatively broad-based economies characteristic of developed industrial countries are usually seen as the incarnation of a modern economy. These economies are largely internally oriented and are based, to a relatively great extent, on production and services based on local and national needs. Their provenance is generally assumed to have been processes of development that began in the sixteenth century and that, in the nineteenth century, accelerated with the expansion of industrial production and the growth of global (...) trade. This article challenges that assumption. It argues that today’s modern economies represent, not the culmination of long-term processes, but a recurring phenomenon within capitalism. It argues that, in the history of capitalism, there have been phases of nationally embedded and global free market capitalism – periods when capital is relatively more, and relatively less, free from the regulation of nation state. Today’s nationally embedded economies represent, not a further point along a unilinear developmental trajectory, but a return to features of the moral economies that characterized both European and non-European societies before the nineteenth century. This contribution argues, first, that pre-national forms of state were not displaced or supplanted by a new, national form. What we call the nation-state was not the successor to imperial or city-states but was itself a form of the European imperial city-states that had driven the expansion of capitalism in previous centuries. It argues, second, that national states emerged only after 1945 and only in a handful of states where, through welfare reforms and market and industry regulation, investment and production (...) were made to serve the expansion and integration of national markets. Third, with the dismantling of Keynesian policies in these states, pre-national (pre-Keynesian) structures are resurfacing. What scholars describe as the emergence of ‘post-national spatialities’ and of ‘global cities’ and city regions represents the resurgence of a durable and historically dominant form of state: the imperial city-state form. The ‘re-scaling’ of nation-states and growing prominence of ‘global cities’ and ‘city regions’ are heralding the end of the brief history of actually existing nation-states and the re-deployment of the imperial city-state model. John McCumber's Time in the Ditch: American Philosophy and the McCarthy Era provides a compelling account of a repressed part of philosophy's history and its tragic consequences for subsequent decades of philosophic practice in the U.S. Political values and interests originating in McCarthyism got encoded within abstract conceptual frameworks, propelling analytic philosophy to an undeserved position of authority while depriving it of critical self-understanding. This comment identifies residues of McCarthyism still playing out in the Science Wars, and the career of (...) critical philosophic projects in both other disciplines and philosophy's feminist and multicultural fringes.
