Le verdissement du droit de l’urbanisme a commencé dès l’apparition du droit de l’environnement et s’est depuis largement développé. Néanmoins, s’agissant d’un principe aussi novateur que le principe de précaution, l’impact de celui-ci a véritablement peiné à émerger et l’on pouvait donc s’attendre à ce que la Charte de l’environnement lui donne une impulsion décisive. Toutefois, plus de quinze ans après l’entrée en vigueur de ce texte, le constat est celui d’une influence qui reste à la marge du droit de (...) l’urbanisme. Le droit écrit, tout d’abord, est resté singulièrement imperméable à ce principe, que ce soit sous forme d’une consécration officielle ou au travers de règles et mécanismes d’application. Du côté de la jurisprudence administrative, ensuite, on constate que si la nouvelle Charte a conduit à un spectaculaire revirement de jurisprudence, le Conseil d’État a fixé des conditions d’application telles que le principe reste encore à l’état virtuel. This article offers a critical reading of what Julia Kristeva calls ‘woman’s primary homosexuality’ and discusses homophobia in Kristeva’s work. If we are to draw conclusions on the merits and limitations of Kristeva’s theories of sexuality, homophobia needs to be assessed within the aesthetic and ethical contexts that typify Kristeva’s overall oeuvre. The article shows that we can apply Kristeva’s semiotic/symbolic model of signification to sexuality and argues for the construction of ‘primary homosexuality’ as the manifestation of resistance to authorized (...) sexual identity. The article also shows why the political demands to recognize lesbianism as a valid form of sexuality and especially as an intelligible lifestyle go against Kristeva’s understanding of what resistance entails. In this paper, I will argue that Rawls’s duty of assistance offers an incomplete picture of our international social and economic responsibilities. I will start by presenting the two main interpretations of the ‘Rawlsian circumstances of egalitarian distributive justice’ – the first requiring the existence of a ‘certain kind’ of cooperation, the second the existence of a ‘certain kind’ of interaction with the will – and then show that none of them rules out the applicability of international principles of egalitarian (...) distributive justice. My argument will draw on societies’ participation in the World Trade Organisation (WTO). So, in the second section I will show that even though this organization is not endowed with a centralized coercive authority, its participants are asked to accept significant constraints on their behaviour and are therefore owed a special justification for these constraints. I will also suggest that the alleged voluntariness of this organization may not only be contested (especially when developing societies are involved), but may also not be sufficient to rule out requirements of distributive equality. In the third section, I will show that, as any system of cooperation, the WTO gives rise to requirements of fairness and that, given the purpose it claims to serve, not all inequalities that can be traced back to so-called ‘domestic’ factors can be considered justified. More specifically, I will argue that the fairness of the WTO requires that all its participants be given a fair chance of benefiting from global market competitions, and that this is likely to entail significant egalitarian distributive duties among societies. This paper concentrates on the way Kant's distinction between duties of right and duties of virtue operates at the interstate level. I argue that his Right of Nations (V ölkerrecht) can be interpreted as a duty to establish a kind of interstate distributive justice (that is, as a duty to secure states in their independence and territorial possessions), which is called for to secure domestic distributive justice and to protect individuals' freedom and private property. Or at least this is 'ideal (...) theory' for, as I specify, this cosmopolitan linkage is compromised by Kant's endeavour to accomodate the existence of non-republican states. (shrink)

This study seeks to gain knowledge about key conditions in the process of digitalization using a socio-technical systems design as a theoretical framework and a case-study approach. Semi-structured interviews with 15 relevant stakeholders are conducted to learn about barriers to and enablers of the development and implementation process in a manufacturing company. After conducting a thematic analysis, eight higher-ranked themes relevant to the digitalization process are identified. These are grouped to describe the overarching phenomena, resulting in four enablers and four (...) barriers. The study takes a holistic view of digitalization in its investigation of the development and subsequent implementation processes. The findings contribute to the literature via three key takeaways for stakeholders of a digitalization process in manufacturing. First, it is vital to understand and strengthen the role of the key enablers identified in this paper. Second, managers should observe and identify barriers in their own organizations, related both to technical and social aspects. Third, some of the enablers described in this paper can serve managers as helpful tools to approach the expected barriers to digitalization. This paper also challenges the research literature by arguing that research conducted on digitalization that sets new standards and premises for the working life in industry needs to use up-to-date socio-technical design concepts and theories. This article opens with the questioning of a now established scholarly category, `French feminism'. It proposes that theoretical and polemical understandings of `French feminism' have been founded on an opposition to its counterpart, `Anglo-American feminism'. The measure of this opposition has been defined mostly as geographical, linguistic and cultural. But underneath such constructions often lies the old sameness vs difference debate that has captivated feminism since the suffragettes. The article argues for a less oppositional and less discounting definition of the (...) two strands of feminism. It proposes to read oppositional classifications as motivation for a dialogue addressed to the `other ' of theoretical constructs; questioning the likelihood of foregoing oppositional classification. The article revisits the idea that writing may be gendered and asks whether we can define what a “woman writing” practice might be. We do this through a comparative study of the work of Julia Kristeva and Judith Butler. Both have expressed reservations about, even objected to, the essentializing of gender and therefore of writing as a woman. They have, however, provided us with useful tools to define what a non-essentialist understanding of “woman” might entail. The article proposes to do (...) three things: first, to look at the way each author presents “woman” and what I term “woman writing” in their work; second, to find, beyond epistemic differences, the common grounds shared by the two authors; and third, to clarify the places where the two disagree. In a concluding part, we will highlight how that disagreement is reconciled in revisiting Kristeva’s and Butler’s use of loss in their apprehension of “woman,” allowing us to formulate a non-essentialist definition of “woman writing.”. La thématique des questions d’un point de vue diachronique est l’objet de cet article. Dans un premier temps, est proposé un tour d’horizon des questions ouvertes et fermées depuis le vieil anglais avant de nous intéresser à l’apparition et à l’évolution des pronoms relatifs en wh-. Sont ensuite analysés les syntagmes nominaux thématisés et les prédications existentielles, puis les questions tags ainsi que la grammaticalisation des questions fermées.

On the basis of a comparative analysis of Hugo Grotius and Immanuel Kant, it shows how different the meaning of this idea can be within a theory of property or territory. The first part is devoted to Grotius’s account of why and how the institution of property was progressively introduced. It highlights the (...) importance this account attaches to the intention of the first distributors for a good understanding of property laws, and in particular, for an understanding of their non-application in situations of extreme necessity. The second part takes the opposite path and shows that although Kant rejects the very existence of a right of necessity, the idea that one might be liberated from a law is not completely absent from, and even plays a crucial role in, his account of property. Clarification of this role ultimately leads us back to the idea of original possession in common of the Earth. (shrink)

The internet is a major part of our lives today. This applies to politics as well, and accordingly, the question of whether it is possible to realize democracy on the internet has arisen. Using the arguments of Hannah Arendt, the paper aims to determine what online democracy should look like. It is argued that the internet's decentralized structure is advantageous because it facilitates the implementation of the Arendtian system of political councils. Due to the character of online political platforms – (...) mainly social media – these political councils should ideally revolve around shared issues that simultaneously create the common world on the internet. At the same time, clear rules need to be laid down for the functioning of these online political councils. Based on Arendt's arguments, it is claimed in the paper that these rules include the principles of mutual promises and covenants on the issues themselves. It is also argued that because Arendt emphasizes the role of appearing in the public sphere, the process of authentication – that is, verifying that there is a concrete person with a physical body behind each online account that wants to actively participate in a particular online political council – is required. The use of airbrushed “thin ideal” models in advertising creates major ethical challenges: This practice deceives consumers and can be harmful to their emotional state. To inform consumers they are being deceived and reduce these negative adverse effects, disclaimers can state that the images have been digitally altered and are unrealistic. However, recent research shows that such disclaimers have very limited impact on viewers. This surprising result needs further investigation to understand how women who detect that images have been airbrushed (...) are still harmed by them. Three studies reported in this article address this question. The authors identify a typology, based on a combination of three emotional reactions experienced by women who are exposed to the airbrushed thin ideal. In further analyses, they investigate how detection of airbrushing—whether spontaneous or with the help of a disclaimer—relates to these emotional reactions and women’s attitudes to altered images. Results show that detection of airbrushing does not systematically protect women from either wanting to look like airbrushed thin models or the negative emotions triggered by exposure to thin ideal images, nor does it always generate defensive reactions toward ads using such images. Women who detect that images have been airbrushed may still process these images as realistic. In addition to discussing this irrational process of self-deception, this article suggests policy interventions to prevent it. (shrink)

The main purpose of this article is to bring into relief the difficulties faced by generous interpretations of the Kantian problem of poverty and to propose an alternative interpretation which (a) agrees with some generous interpretations that Kant's juridical treatment of poverty is to be understood by analogy with his juridical treatment of slavery, but which (b) departs from generous interpretations in general by arguing that this analogy is not to be understood in terms of “dependence” as such, but in (...) terms of “depersonification.” More specifically, it argues that what makes slavery and poverty unjust for Kant is not that they entail a human being finding herself (completely) dependent on the choice of another human being, but that they entail a human being being deprived of her juridical personality. The Kantian problem of poverty is ultimately a problem of juridical depersonification, and this problem of juridical depersonification does not arise in all (complete) dependence relations. (shrink)

Autant que la position de la femme dans la société, le principe de la matrilinéarité juive est révélateur des normes qui régissent le lien social. Le système de filiation matrilinéaire s’est installé dans le judaïsme sur la base de l’interprétation du dit talmudique affirmant Ton fils né d’une idolâtre n’est pas ton fils mais le sien (Qid. 68b). Il entérinait un processus enclenché quelques siècles plus tôt, à l’époque de la Mishna, autour du premier siècle de l’ère, mettant un terme (...) à la longue tradition biblique qui ne percevait de filiation que patrilinéaire, et instaurait, ce faisant, un modèle de transmission de la judéité qui perdure jusqu’à nos jours. Cette transformation majeure était-elle due à une évolution interne de la pensée rabbinique rationalisant la judéité au regard des affiliations? Ou à des contraintes extérieures liées à l’imposition de nouvelles réglementations du statut de la personne? Les deux hypothèses d’interprétations sont débattues – et parfois se rejoignent – dans les recherches menées sur la filiation ou l’identité juive. Cet article examine les conditions de la transmission de l’identité de la personne, telles qu’elles ont été traitées et définies au long des siècles par l’institution de normes juridiques et sociales régulant la filiation, la conversion et l’héritage, toutes normes qui éclairent les évolutions du statut de la femme dans l’histoire du judaïsme entre l’Antiquité tardive et le Moyen Âge. Considering the sensory dimension of clinical decision-making is a challenge for the training of health professionals. Therefore, how can we help them stimulate a form of sensory acuity? We conducted a study in partnership with the Simulation Laboratory of a Canadian hospital to understand the sensory work accomplished by nurses during a clinical decision-making. To do this, we analyzed the interactions occurring during focus groups to reveal the sensory work performed by nurses during the clinical evaluation of patients (personas).

The 2008 crisis has revived debates on the relevance of laissez-faire, and thus on the role of the State in a modern economy. De fait, la théologie contemporaine pense l’expérience croyante. La question pourrait se formuler ainsi : où (...) et comment peut se faire la prise en charge théologique de la vie spirituelle, du capital chrétien d’expérience spirituelle ? Est-ce par une discipline propre, la théologie spirituelle ? Qu’est-ce qui la caractériserait ? Pour réfléchir ainsi au devenir de la théologie spirituelle, on commencera par observer, avec quelques exemples d’élaborations théologiques significatives, comment la théologie contemporaine prend en compte la dimension expérientielle de la foi chrétienne. Mais prendre en compte cette part constitutive d’expérience, est-ce pour autant prendre en charge l’expérience spirituelle ? Si oui, une théologie spirituelle n’aurait plus de raison d’être ; si non, quelle est la vocation d’une telle théologie ?In his inventory of “theological loci”, Melchior Cano did not at all include spiritual experience and “spirituals” do not even appear in his listing as theologians… Following after a period of peaceful distinction, the border that has arisen between theology and spirituality - on the basis of an evolution of theology towards scientificity and under the influence of the questions raised by nominalism – seems now to have become porous, if not to have altogether vanished. In fact, contemporary theology reflects on believing experience. We could put the question this way: where and how can theology take charge of spiritual life, valorizing the Christian capital of spiritual experience ? Is it through a specific discipline, spiritual theology? What would characterize it ? In order to think through the way spiritual theology is developing, we shall begin by observing, thanks to a few examples of significant theological texts, how contemporary theology takes into account the experiential dimension of Christian faith. However, is taking into account this constitutive part of experience the same as taking charge of spiritual experience ? If so, a spiritual theology would no longer have a raison d’être; if not, what then is the task of such a theology ? (shrink)

En 1761, Marguerite Goubler est reconnue comme femme alors qu’elle sert depuis plus d’un an dans un régiment de cavalerie. Son dossier, conservé aux Archives de la guerre, laisse deviner un destin hors du commun, celui d’une aventurière qui s’illustre sur les champs de bataille et fait la fierté de ses officiers. En même temps, la comparaison avec d’autres dossiers de femmes engagées dans les armées montre qu’il existe une sorte de paradigme de la femme-soldat aux XVIIe-XVIIIe siècles, qu’illustrent notamment (...) de nombreux romans, ce qui peut expliquer la relative indulgence voire l’admiration des autorités à leur égard. ‘The regulation of gender in menopause theory’ offers a critical commentary on some key theories of menopause experience. It aims to show that the theorisation of menopause keeps to the same epistemic and ideological lines as hegemonic understandings of gender identity. Narratives of menopause has become one of the means by which one can learn to cite women’s gender correctly. In reverse, relating menopause experience against the grain of established narratives is becoming the means by which one may resist epistemic (...) bias and dominant ideology of gender. Moreover, I am proposing that while menopause experience is an important aspect of gender identity formation and its resistance, it is also becoming a new area for identity politics in general, and more particularly the site of dissident narratives. In three experiments, picture quality between test items was manipulated to examine whether subjects’ expectations about the fluency normally associated with these different stimuli might influence the effects of fluency on preference or familiarity-based recognition responses. The results showed that fluency due to pre-exposure influenced responses less when objects were presented with high picture quality, suggesting that attributions of fluency to preference and familiarity are adjusted according to expectations about the different test pictures. However, this expectations influence depended on subjects’ (...) awareness of these different quality levels. Indeed, imperceptible differences seemed not to induce expectations about the test item fluency. In this context, fluency due to both picture quality and pre-exposure influenced direct responses. Conversely, obvious, and noticed, differences in test picture quality did no affect responses, suggesting that expectations moderated attributions of fluency only when fluency normally associated with these different stimuli was perceptible but difficult to assess. Depuis 1893 jusqu’à la fin de sa vie, la question de l’individualisme des sociétés modernes n’a cessé de hanter Durkheim. Dès De la division du travail social, il fait en effet le constat que la montée de l’individualisme, en faisant éclater les structures du monde traditionnel, a conduit à une profonde crise sociale qu’il interprète avant tout comme une crise morale. Dès lors, il s’agira pour lui de repenser les conditions d’un consensus renouvelé adapté à la dynamique de la modernité. (...) Dans cette étude, nous montrerons que la réponse apportée par Durkheim à cette crise des sociétés modernes n’a cependant pas été univoque. Si en 1893, il pensait pouvoir fonder la cohésion sociale sur la solidarité fonctionnelle liée à la division du travail, c’est un tout autre modèle qu’il mobilisera à partir de 1898 et de son célèbre texte sur L’individualisme et les intellectuels. Cet article veut mettre en évidence la logique de ces deux modèles en montrant que c’est seulement à partir d’une réflexion sur la double nature de l’individualisme moderne que Durkheim trouvera le fondement d’une nouvelle et authentique solidarité.
