This article investigates a high-profile and ongoing dilemma for healthcare professionals, namely whether the existence of a duty of care to genetic relatives of a patient is a help or a hindrance in deciding what to do in cases where a patient’s genetic information may have relevance to the health of the patient’s family members. The English case ABC v St George’s Healthcare NHS Trust and others considered if a duty of confidentiality owed to the patient and a putative duty (...) of care to the patient’s close relatives could coexist in this context. This article examines whether embracing the concept of coexisting duties could enable HCPs to respect duties in line with their clinical judgement, thereby providing legal support and clarity to professionals to allow them to provide the best possible genetics service to both the patient and their family. We argue that these dual duties, framed as a novel, composite duty to consider the interests of genetic relatives, could allow HCPs to exercise and act on their professional judgements about the relative value of information to family members, without fears of liability for negligence or breach of confidence. The dominant, individualistic understanding of autonomy that features in clinical practice and research is underpinned by the idea that people are, in their ideal form, independent, self-interested and rational gain-maximising decision-makers. In recent decades, this paradigm has been challenged from various disciplinary and intellectual directions. Proponents of ‘relational autonomy’ in particular have argued that people’s identities, needs, interests – and indeed autonomy – are always also shaped by their relations to others. A common trait of all realistic political theories is the rejection of a conception of political theory as applied moral philosophy and an attempt to preserve some form of distinctively political thinking. Yet the reasons for favouring such an account of political theory can vary, a point that has often been overlooked in recent discussions by realism’s friends and critics alike. While a picture of realism as first-and-foremost an attempt to develop a more practical political theory which does not reduce (...) morality to politics is often cited, in this paper we present an alternative understanding in which the motivation to embrace realism is grounded in a set of critiques of or attitudes towards moral philosophy which then feed into a series of political positions. Political realism, on this account, is driven by a set of philosophical concerns about the nature of ethics and the place of ethical thinking in our lives. This impulse is precisely what motivated Bernard Williams and Raymond Geuss to their versions of distinctively realist political thought and is important to emphasise because it demonstrates that realism does not set politics against ethics (a misunderstanding typically endorsed by realism’s critics) but is rather an attempt to philosophise about politics without relying on understandings of morality which we have little reason to endorse. While ethical norms for conducting academic research in the United Kingdom are relatively clear, there is little empirical understanding of how university research ethics committees (RECs) themselves operate and whether they are seen to operate well. In this article, we offer insights from a project focused on the Scottish university context. We deployed a three-sided qualitative approach: (i) document analysis; (ii) interviews with REC members, administrators, and managers; and (iii) direct observation of REC meetings. We found that RECs have diverse (...) operation and vary in terms of what members understand to be the remit of their REC and what should constitute the content of ethics review. Overall, though, most participants perceive university RECs as operating well. When asked what they consider to be areas for further improvement, most commented on: implementation of an online system; more experience with how to evaluate various kinds of research projects; best practice exchange and training opportunities; more accurate reflection of the REC role as part of the university’s workload allocation model; and greater recognition of the importance of research ethics governance in the university’s research environment, and, for the members themselves, their career advancement. Based on our findings and subsequent discussions during an end-of-project roundtable with stakeholders, we propose a model of collaboration that can address some of the identified areas that could benefit from further improvement. This model would facilitate a heightened awareness of the importance of supporting REC members in their own effort in assisting students and staff alike in undertaking as ethically robust research as possible. This article argues in general support of the sIRB rule, but also draws on recent empirical research to highlight several residual weaknesses in the US regulatory structure for research ethics review, and suggests ways in which these weaknesses might be addressed in future regulatory reforms to improve upon the sIRB rule.

In this article, we consider the possible application of the European General Data Protection Regulation to “citizen scientist”-led health research with mobile devices. We argue that the GDPR likely does cover this activity, depending on the specific context and the territorial scope. Remaining open questions that result from our analysis lead us to call for lex specialis that would provide greater clarity and certainty regarding the processing of health data by for research purposes, including these non-traditional researchers.

I propose some arguments suggested by Descartes' text for the conclusion that we are not identical to our bodies. I suggest that a natural extension of those arguments leads to Plantinga's Replacement Argument. I conclude that even if such an argument is plausible, its conclusion does not establish the further claim that we can exist without a body.

How we read Kant's Critique of Pure Reason has a huge influence on how convincing we find the parts of which it is composed. This thesis will argue that by taking its arguments and concepts in isolation we neglect the unifying architectonic method that Kant employed. Understanding this text as a response to a single problem, that of the possibility of synthetic a priori judgement, will allow us to evaluate it more fully. We will explore Kant's attempts to relate the (...) a priori and the synthetic in the Introduction, Metaphysical Deduction and Analytic of Principles of the Critique of Pure Reason. Having developed this reading at length we will be able to reassess Kant's relation to the work of Gilles Deleuze. Deleuze's critique of Kant and his tendency to make selective use of his work has so far characterised their relations. However, by reading Kant's Critique of Pure Reason in terms of its unifying method we will open up a new means of relating these two thinkers. Whilst Deleuze rejects many key Kantian concerns and concepts he embraces his methodological concern with the ability of problems to unify our thought. The problem-setting and forms of argument that emerge within Kant's architectonic method will be related to Deleuze's account of experience. This thesis will contribute to both Kant and Deleuze studies on the basis of the reading of the Critique of Pure Reason it will present. By showing how Kant's text is to be read as a whole we will be able to challenge the conclusion that the arguments he makes ultimately rely upon a notion of 'subjective origin'. The problem of accounting for 'the actual' through its relation to 'the virtual' in Deleuze's thought will be re-assessed on the basis of his newly established relation with Kant. Understanding Kant's method in the Critique of Pure Reason will be shown to strengthen both his own account of experience and that offered by Deleuze. (shrink)

This paper considers the line drawn between art and the everyday; and some attempts to erase it by artists and art theorists. We look at the sensibility of artists who notice and make work from everyday experience. In modernity the conscription of everyday materials and objects to collage and assemblage develops this sensibility within an aesthetic conception of visual art. Looking at Duchamp’s readymades, we consider his claim that these objects are chosen with indifference to their aesthetic properties. We then (...) consider the aesthetic requirements of a medium that directs response to works of art. Briefly, with our conception of a medium in mind, we deliberate upon Modernism, Minimalism, and Conceptualism; and the border between the poetic and poetry. We conclude with a lesson to be drawn from Jim Jarmusch’s 2016 film, Paterson. Along the way, we cling to some of Kant’s insights concerning the fine arts. (shrink)

These philosophers call such a hypothetical being a ‘zombie’, and they use the possibility of zombies to defend central claims in the philosophy of mind. In this essay, I use Wittgensteinian ideas to argue, against such philosophers, that the notion of a zombie is incoherent. I argue first that the possibility of (...) zombies would entail a radical form of skepticism about other minds. I then use that result to argue that philosophers who believe zombies are possible cannot account for the meaningfulness of terms like ‘pain’, ‘qualia’, and ‘phenomenal consciousness’. Since philosophers who think zombies are possible require such terms to define their position, I conclude that such philosophers employ words to which they have given no meaning. I close the essay by reflecting on the nature of these arguments and by drawing some Wittgensteinian lessons about the character of our mental concepts. (shrink)

This article and checklist present the contents of the Spencer Album of Marcantonio Raimondi prints, long considered to be lost. By examining its composition and tracing its provenance from the Spencer collection at Althorp House to the John Rylands Library, Manchester, we offer new insight into how attitudes toward Marcantonio Raimondi‘s work evolved during the eighteenth and nineteenth centuries, particularly in Great Britain. Our article also explores Victorian collecting practices and the importance of the graphic arts for Mrs Rylands‘s vision (...) for the Library to be dedicated to her late husband‘s memory. (shrink)

Rylands English MS 60, compiled for the Spencer family in the eighteenth century, contains 130 printed portraits of early modern artists gathered from diverse sources and mounted in two albums: 76 portraits in the first volume, which is devoted to northern European artists, and 54 in the second volume, containing Italian and French painters. Both albums of this ‘Collection of Engravings of Portraits of Painters’ were initially planned to include a written biography of each artist copied from the few sources (...) available in English at the time, but that part of the project was abandoned. This article relates English MS 60 to shifting practices of picturing art history. It examines the rise of printed artists’ portraits, tracing the divergent histories of the genre south and north of the Alps, and explores how biographical approaches to the history of art were being replaced, in the eighteenth century, by the development of illustrated texts about art. One response to the problem of logical omniscience in standard possible worlds models of belief is to extend the space of worlds so as to include impossible worlds. It is natural to think that essentially the same strategy can be applied to probabilistic models of partial belief, for which parallel problems also arise. In this paper, I note a difficulty with the inclusion of impossible worlds into probabilistic models. Under weak assumptions about the space of worlds, most of the propositions (...) which can be constructed from possible and impossible worlds are in an important sense inexpressible; leaving the probabilistic model committed to saying that agents in general have at least as many attitudes towards inexpressible propositions as they do towards expressible propositions. If it is reasonable to think that our attitudes are generally expressible, then a model with such commitments looks problematic. (shrink)

Life sciences research is increasingly international and data-intensive. Researchers work in multi-jurisdictional teams or formally established research consortia to exchange data and conduct research using computation of multiple sources and volumes of data at multiple sites and through multiple pathways. Despite the internationalization and data intensification of research, the same ethics review process as applies to single-site studies in one country tends to apply to multi-site studies in multiple countries. Because of the standard requirement for multi-jurisdictional or multi-site ethics review, (...) international research projects are subjected to multiple ethics reviews of the same research protocol. Consequently, the reviews may be redundant and resource-consuming, whilst the opinions delivered by ethics committees may be inconsistent both within and across jurisdictions. :In this essay, I critically engage with a methodological approach in contemporary political theory — unconstrained utopianism — which holds that we can only determine how we should live by first giving an account of the principles that would govern society if people were perfectly morally motivated. I provide reasons for being skeptical of this claim. To begin with I query the robustness of the principles unconstrained utopianism purportedly delivers. While the method can be understood as offering existence proofs, because (...) we can devise other situations in which morally flawless decision making would unearth alternative sets of principles, I argue that such proofs tell us surprisingly little about how we should live in general. Drawing on this point, I contend that normative models that wish away certain phenomena that are uncontroversially central to any account of politics cannot plausibly claim to tell us how we should live in political society. I conclude by offering a more positive sketch of why avoiding this brand of utopianism might not represent a problematic capitulation to the morally nonideal and suggest that theorizing in light of certain constraints may be a precondition of good normative theorizing itself.
