An influential line of thinking in behavioral science, to which the two authors have long subscribed, is that many of society's most pressing problems can be addressed cheaply and effectively at the level of the individual, without modifying the system in which the individual operates. We now believe this was a mistake, along with, we suspect, many colleagues in both the academic and policy communities. Results from such interventions have been disappointingly modest. But more importantly, they have guided many (though (...) by no means all) behavioral scientists to frame policy problems in individual, not systemic, terms: To adopt what we call the “i-frame,” rather than the “s-frame.” The difference may be more consequential than i-frame advocates have realized, by deflecting attention and support away from s-frame policies. Indeed, highlighting the i-frame is a long-established objective of corporate opponents of concerted systemic action such as regulation and taxation. We illustrate our argument briefly for six policy problems, and in depth with the examples of climate change, obesity, retirement savings, and pollution from plastic waste. We argue that the most important way in which behavioral scientists can contribute to public policy is by employing their skills to develop and implement value-creating system-level change. (shrink)

이 글은 환경실용주의의 선구자 중의 한 명인 라이트의 논의를 중심으로 ‘환경실용주의와 도시환경윤리’에 관해 살펴보는 데 그 목적을 두고 있다. 이를 위해 환경실용주의가 대두하게 된 배경과 함께 환경실용주의에 대한 라이트의 기본적 입장을 밝힌다. 라이트에 따르면 환경실용주의의 주요과제는 사회구성원들의 태도와 행동, 정책적 선호도를 장기적인 환경의 지속가능성을 지지하는 방향으로 바꿔나갈 수 있도록 동기를 부여하는 일이다. 라이트는 그 동기를 부여하기 위한 방안으로 도시환경윤리를 전개한다. 필자는 라이트의 도시환경윤리의 특징을 세 가지 핵심 개념, 곧 도시, 자발적 참여, 공화주의를 중심으로 정리하면서 그 실체를 드러내고자 했다. 이어서 필자는 (...) 라이트의 환경실용주의와 도시환경윤리에 관한 논의에서 얻을 수 있는 교훈을 결론으로 도출함과 함께 그 과제를 제시하였다. Dynamic stability of the knee and weakness of the extensor muscles are considered to be the most important functional limitations after anterior cruciate ligament injury, probably due to changes at the central level of motor control rather than at the peripheral level. Despite general technological advances, fewer contraindicative surgical procedures, and extensive postoperative rehabilitation, up to 65% of patients fail to return to their preinjury level of sports, and only half were able to return to competitive sport. Later, it becomes (...) clear that current rehabilitation after knee surgery is not sufficient to address the functional limitations after ACL reconstruction even years after surgery. Therefore, new therapeutic tools targeting the central neural system, i.e., the higher centers of motor control, should be investigated and integrated into current rehabilitation practice. To improve motor performance when overt movement cannot be fully performed, several techniques have been developed to increase physical and mental activation without the need to perform overt movements. Among the most popular cognitive techniques used to increase physical performance are motor imagery and action observation practices. This review, which examines the available evidence, presents the underlying mechanisms of the efficacy of cognitive interventions and provides guidelines for their use at home. (shrink)

이 글은 데카르트의 정신지도를 위한 규칙에서 보편 수리학의 관점에서 비례의 개념을 해명하는 것을 목표로 한다. 보편 수리학이란 데카르트 자신의 설명에 따르면, “순서와 척도에 관해 연구될 수 있는 것을 모두 설명하는 어떤 일반적인 학문”이다. 구체적으로 말하자면 측량할 수 있는 모든 크기를 그 차원이나 존재 방식과 무관하게 어떤 보편적 인식 원리에 따라 규정하고 인식하는 것이 보편적 수리학의 과제인 것이다. 그런데 이런 보편 학문의 이념을 실현하는 것을 불가능하게 만들었던 장벽이 있었는데, 그것이 수와 도형의 통약 불가능성 그리고 같은 도형에서도 차원이 다른 도형들 사이의 연산 (...) 불가능성이다. 그런데 데카르트는 『정신지도를 위한 규칙』에서 수와 도형 사이의 장벽과 도형의 상이한 차원에 따른 연산 불가능성을 비례의 개념을 통하여 극복한다. 그리고 이를 통해 대수와 기하의 장벽을 허물고 보편적 수리과학의 기초를 마련했다. 이 글은 『정신지도를 위한 규칙』에서 비례의 개념이 어떻게 보편적 수리과학의 기초가 되는지를 주요 구절들을 통해 간단 명료하게 보이려는 시도이다. When a series of corporate scandals erupted soon after the collapse of the 1990s bull market in equities, policy makers and reformers chiefly responded by augmenting and refining the checks and balances surrounding publicly traded corporations. Through measures such as the Sarbanes-Oxley Act of 2002, securities regulations were intensified and corporate governance was tightened. In essence, reformers followed the tradition of modern political philosophy, developed in the 17th and 18th centuries, in its insistence that pro-social outcomes are best produced through (...) institutional mechanisms that harness self-interest. The empirical evidence, however, suggests the institutional approach will do little to prevent future ethical breakdowns. To corroborate this finding, we survey the literature on board composition, auditor consulting practices, shareholder activism, and executive compensation. Consequently, we look to another stream of political philosophy, the ancient tradition comprising Plato and Aristotle, which argues that social groupings, such as corporations, work best when led by individuals of good character. Applying the ancient view to modern commercial realities, the paper concludes that Benjamin Franklin's attempt to connect virtuous character with enlightened self-interest offers a compelling ethic for corporate leaders. The Patient Preference Predictor (PPP) proposal places a high priority on the accuracy of predicting patients’ preferences and finds the performance of surrogates inadequate. However, the quest to develop a highly accurate, individualized statistical model has significant obstacles. First, it will be impossible to validate the PPP beyond the limit imposed by 60%–80% reliability of people’s preferences for future medical decisions—a figure no better than the known average accuracy of surrogates. Second, evidence supports the view that a sizable minority of (...) persons may not even have preferences to predict. Third, many, perhaps most, people express their autonomy just as much by entrusting their loved ones to exercise their judgment than by desiring to specifically control future decisions. Surrogate decision making faces none of these issues and, in fact, it may be more efficient, accurate, and authoritative than is commonly assumed. (shrink)

들뢰즈의 주체화 전략은 타자-되기를 꾀하는 과정이며, 주체 기능을 수행하는 행위자를 생산한다. 행위자는 본질적인 정체성을 갖지 않지만, 집단적인 행위들을 통해서 후험적으로(a posteriori) 구성되는 주체성을 지닌다. 이러한 들뢰즈의 주체화는 버틀러가『윤리적 폭력 비판:자기 자신을 설명하기』(Giving an Account of Oneself)에서 윤리적 주체를 주요하게 설명한 바와 교차한다. 버틀러는 주체화를 타자와 관계 맺는 말 걸기 구조에서 작동하며, 자기를 설명하기를 통한 자기 제작 과정으로 규명한다. 이러한 주체화의 구조에서, 나는 나를 다 설명할 수 없으며, 말 걸기의 수신자인 타자를 요청한다. 이로부터 버틀러는 책임의 출처를 나의 한계 인식과 내 안에 (...) 있는 타자성으로 설명한다. 책임은 어떤 능동적인 주체의 의지에서 비롯된 행위가 아니라, 주체화의 구조에서 비롯한 것이며, 내 안의 이질성을 승인하고 인간 조건의 취약함과 수동성에서 야기된 상황을 떠맡는 행위이다. 취약성은 우리가 확고한 경계로 철저히 분리된 존재가 아니라, 서로에게 자비를 바라는 존재임을 일깨운다. 인간 중심주의에서 벗어난 탈근대의 주체화는 자기를 완벽하게 아는 것이 아니며, 자신의 한계와 자신의 구성 조건의 맥락성을 인정하고 이해하면서 그 한계를 넘어서는 것이다. 이러한 탈근대의 주체화는 윤리적 전회를 통과하면서, 타자성과 이질성을 주체화의 내적 구조로 받아들이고, 공동체와의 연결성을 승인하면서, 새로운 윤리적 규칙을 모색하는 윤리적 주체를 형성한다. 본 논문의 목적은 마르틴 하이데거(M. Heidegger)와 장-폴 사르트르(J.-P. Sartre)의 현상학적 신체론의 유사성을 드러내는 것이다. 널리 알려져 있듯이 두 현상학자는 서로 신체에 대해서 현상학적으로 제대로 접근하지 못했다고 비판한다. 그러나 잘 살펴보면 두 사람의 신체론에서는 몇 가지 공통점이 발견된다. 우선 하이데거는 ‘탈존’(Ex-sistenz) 혹은 ‘세계형성’(Weltbildung)이, 그리고 사르트르는 ‘무화’(néantisation)하면서 존재함이 신체적으로 존재함보다 더 존재론적으로 앞선다고 주장하지만, 공통적으로 우리가 신체적으로 존재하면서만 탈존하고 무화할 수 있다고 주장한다. 두 사람에게 있어서 신체는 탈존 혹은 무화가 일어나는 장소로 간주되는 것이다. 두 번째로 두 사람 모두 전통적인 견해와는 다르게 감각과 (...) 지각이 분리되어 있지 않다고 본다. 우리는 대상이 가지는 각각의 성질들을 독립적으로 감각하고서 그것을 대상으로서 구성해내는것이 아니다. 우리는 단번에 대상을 ‘~으로서’ 지각한다. 세 번째로 신체는 ‘결여’의 형식으로 자신을 드러낸다는 점을 두 사람은 인정한다. 우리가 신체를 통해서 대상과 관계 맺을 때 신체는 자신을 드러내지 않는 방식으로 자신과 대상을 드러내는 것이다. 이러한 공통점들은 두 철학자가 우리의 신체에 대해서 현상학적으로 접근했기 때문에 드러날 수 있는 신체현상이라 할 수 있을 것이다. Used wisely the concepts of race and ethnicity in research have great potential, but used unwisely they can do immense damage. We need to consider the potential issues that might require a change of emphasis or application of ethics in a multi-ethnic society. Doing no harm is the most important ethical pillar in the ethnicity and health field. Ethnic differences can be used in damaging ways. Without the ethic of beneficence in place it is better not to draw attention to (...) ethnic differences. Respect is the pre-condition for autonomy. Autonomy of ethnic minority populations to live in their own traditional way is not easy to achieve in multi-ethnic societies. There are difficult issues in multi-ethnic societies that require great sensitivity to create a sense of fairness and justice. Justice is the core value that underpins equity. There is a deep paradox – to promote equality, we may need to treat people and groups unequally. Ethical codes need to be modified to emphasize the importance of including ethnic minority populations in research and not bypassing them, as has been happening. It is correct, for example, that potential research participants' personal details are guarded. If such a person, however, does not read it may be unethical to send written information about a project. It may be more ethical to tele phone or even call at the doorstep of such a person. The history of racism in research is worrying, not least the fear that it might return. We need a governing code of conduct. Ethical research can help ethnic minority groups to move from the shadows of society and participate in a vibrant, healthy, multi-ethnic society. (shrink)

불교의 모든 경전의 분류는 십이부경으로 구성되어 있으며, 이것은 오늘날 우리가 말하는 문학적 표현 방법이다. 「이세간품」의 교설은 모두 문학적 갈래에 속한다는 것을 전제로, 제Ⅱ장에서는 12분교와 문학과의 연관성을, 제Ⅲ장은 ｢이세간품｣에 보이는 12분교의 문학적 특징을 분석해보았다. 그 결과를 도출해보면 첫째, 십이분교는 십이부경, 십이분성교, 십이분경이라 이명하며, 서술형식 등에 따라 삼장의 불교 경전을 12가지로 분류한 것으로, 불교의 총칭이다. 십이분교는 수다라․기야․수기․가타 ․우타나․인연․비유․본사․본생․방광․미증유법․ 논의가 있다. 둘째, 십이분교의 정의에 대한 언급은 부처님의 원음이라 할 수 있는 초기경전인 잡아함경·부파불교·초기 대승경전인 화엄경의 「십무진장품」등까지 전승된 교설로 모든 불교경전의 교설에까지 상용된 경전서술의 표현방법이다. (...) 셋째, 문학과 십이분교의 절점은 일상적인 문학적 표현방법을 불교에선 12가지 항목의 갈래로 조금 더 세분화했다. 문학이 우리 삶에 대한 표현이라면, 불교교설 또한 우리 삶에 대한 내용을 본질로 삼고 있다는 점에서 상통한다. 12분교는 불교의 심오한 교설을 조금 더 쉽게 이해하기 위한 표현방법론으로서 사용되었기 때문에, 십이분교는 문학과 깊은 접점 관계에 있다. 넷째, 「이세간품」에는 12분교 전체 항목이 드러나진 않고, 구체적으로 나타나는 십이분교는 9종류로 ①수다라②응송③수기④풍송⑤자설 ⑥비유⑦본생⑧방광⑨미증유법이다. 품에서 가장 많이 사용된 것은 수다라와 운문, 풍송이다. 다섯째, 화엄수행 단계인 52계위 등에서 주로 사용된 수사법은 철학적 의미와 언어형식인 은유적 표현과 비유와 강조법 등이 혼용되었다. 이러한 수사적 표현을 통해본 「이세간품」의 핵심은 보살도의 실천을 총괄함에 있다. 이것이 보혜의 물음에 보현이 2천 가지로 대답한 요지이며, 이것은 곧 12분교가 화엄수행의 52계위 함의를 발현한 맑고 강직한 마음을 상징적으로 금강보주와 바다 등의 문학에 비유하고 있다는 것을 엿볼 수 있다. 묵자에 대한 통상적 견해에 따르면, 묵자의 인간은 철저히 손익계산에 따라서만 움직이는 이기적 존재로 이해된다. 하지만 『묵자』의 여러 곳에서 우리는 인간의 이기적 욕구와는 구분되는 도덕적 행위의 동기들, 예컨대 겸애(兼愛)나 비공(非攻)을 그 자체로 훌륭하고 좋은 것으로 여기는 도덕적 태도나 믿음, 타인의 은덕에 대한 감사의 태도 또는 보은을 해야 한다는 생각, 자신을 이롭게 하기 위해 남을 해치면 안 된다거나 특정 행위의 불인(不仁)함과 죄의 정도가 심할수록 그 행위의 불의(不義)함도 심해진다는 도덕적 믿음 등이 중요하게 다루어지고 있음을 볼 수 있다. 이는 묵자의 인간을 철저히 이기적 존재로만 (...) 바라보는 기존 학계의 통념과 배치될 뿐 아니라, 이러한 자기 이익과는 무관한 도덕적 행위의 동기들이 묵자철학에서 수행하는 이론적 역할은 무엇인가 하는 문제를 제기한다. 본고에서는 이 문제를 이익의 기반이 상대적으로 확고하여 이익에 대한 호소가 잘 먹혀들지 않았던 당시의 지배층을 설득하기 위한 특별한 논변의 필요성, 그리고 개인의 이익보다 사회 전체의 이익을 앞세우는 묵가의 공리주의적 도덕을 사회구성원들로 하여금 어떻게 내면화하고 실천하도록 할 것인가 하는 물음과 관련하여 설명한다. 이 논문은 조선유교가족규범의 형성과 전개가 그저 단일하고 매끈하였던 것이 아니라, 굴절과 균열의 전개 과정을 내포하고 있었음을 밝힌다. 이러한 작업을 통해 유교가족규범이 단지 외부의 이질적인 것이 삽입되거나 규범에 순응하는 것으로서가 아니라, 유교전통 안에서 미끄러짐, 불복종이 일어나는 속에서 구성된 것임을 강조할 것이다. 또한 가족 문제를 단지 이념이나 제도에 의해서가 아니라 감정, 경험, 서사에 주목해서 연구함으로써 유교가족에대한 새로운 이해의 장을 열 수 있음을 보여준다. 이 같은 문제의식을 효과적으로 다루기 위해 논문에서는 다음과같은 논의의 층위를 구성한다. 하나는 조선 전기의 불교와 유교, 조선 후기의 유교와 천주교가 (...) 중첩되는 지점에서 일어나는 중층성을 드러내는 것이다. 이를 통해 유교와 비유교가 만나는 지점에서일어나는 가족규범의 다양한 층과 결이 발생했음을 살펴볼 것이다. 다른 하나는 전형적인 유교가족규범, 젠더규범 내부에서 일어나는 복종과 불복종, 공고화와 균열의 이중성을 주목할 것이다. 이러한 논의 안에서 매우 안정되어 보이는 유교가족규범과 젠더 규범의 내부가 사실은 불안정하고 불확정적이었음을 보여줄 것이다. 이렇게 조선시대 가족을 논의함으로써 조선유교를 단일한 개념으로 포획하는 관념을 해체하고 혼종적이고 다양하며 개방적이고복수적인 정체성을 드러낼 수 있다. 또한 조선유교 및 조선가족규범을 이해하는 시각의 다양화를 제시할 수 있다. 이 글은 아렌트의 탄생철학을 바탕으로 인간 출생의 실천은 정치적 행위이며 따라서 인 간 출생은 정치적 행위에 의해서 이루어진 기적적인 사건임을 드러내고자 한다. 아렌트에 따르면 인간 출생이라는 것은 사적 영역인 가정에서 이루어지는 재생산의 문제에 국한된 것이 아니라 사회적 관계에서 발생하는 정치적 문제로 확장되어서 다루어져야 한다. 인간 출생의 사건은 인간들 사이의 상호 존중과 신뢰로부터 용서와 약속을 사회 속에서 실현하 는 정치적 행위이기 때문에 새로운 형태의 더 나은 방향으로의 인간 사회를 예고하는 정치 적 사건이다. 따라서 우리 사회의 초저출산 현상을 타개하기 위해서는 인간 출생의 (...) 실존적 의미인 탄생성, 즉 새로운 시작에서 출발하는 정치적 행위를 실천하도록 만드는 상호 존중 과 신뢰에 근간한 사회적 관계와 제도가 요구된다. 이 논문에서 필자는 대화가 자기인식 및 자기이해에 기여한다는 존 하드윅의 논의에서 출발하여, 대화의 특성을 분석함으로써 자기이해를 돕는 소통과 치유의 공동체 모델을 탐구할 것이다. 구체적으로 집단철학상담의 대화공동체를 모델로 삼아, 진정한 대화와 소통은 치유공동체로 발전해 나가는 출발점이 된다는 것을 논의하고자 한다. 즉 진정한 대화는 단지 커뮤니케이션을 위한 것이 아니라 자기이해와 자기인식을 촉진하는 역할을 한다는 것, 나아가 자기이해를 증진시키는 대화공동체는 치유공동체로 발전해 나갈 수 있다는 것을 보일 것이다. 여기서 소통과 치유는 별개의 독립적인 문제가 아니라 긴밀한 연관을 갖는다는 것이 드러날 것이다. 나아가 집단철학상담의 사례를 (...) 통해, 어떻게 한 공동체는 소통과 치유의 공동체로 발전해 나갈 수 있는지 그 조건들을 검토하고 논의할 것이다. 본고는 소위 ‘신-하이데거주의자’인 G. 하만의 사물개념을 소개하고 비판하는 것을 목적으로 삼는다. 이를 통해서 하이데거의 사물개념을 재조명하는 기회를 가질 것이다. 2장에서 논자는 하이데거적 사물개념 일반을, 3장에서는 하이데거 사물개념에 대한 G. 하만의 해석을 다룬다. 그리고 4장에서는 G 하만의 해석을 비판적으로 살펴본다. 논자는 G. 하만이 후설과 하이데거를 하나의 사물체계 속에서 살펴보며, 더 나아가 초기 하이데거의 도구분석 구조를 중기를 넘어 후기까지 적용시킴으로써 하이데거의 사물개념을 일관성 있게 해석한다는 데에 의미를 두고 싶다. 그러나 이러한 해석은 전통적 하이데거 해석에서 벗어나는 경향을 띈다. 더군다나 그는 하이데거 철학에서 시간개념을 (...) 부정한다. 본고는 이것이 과연 정당한지 살펴볼 것이다. Something of the relation of my work on substance concepts to Gibsonian theories of perception–action is discussed. What historical relations tie a particular substance concept to a particular substance is discussed.

This paper advocates learned in the religious context of liberation, the "theology," a concept can be reasonably applied to religious traditions other than Christianity. According to that "beyond the world community and how the phenomenon of contact" as a general theological issues, and Consciousness-only school of Buddhism, one of the major literature of the "photo Mahayana theory of" how to respond to this issue. In the "photo Mahayana theory" in this issue of "inaction of the Dharma Realm to save sentient (...) beings in the phenomenal world and promising" in the form of presentation. This stands for "photo Mahayana theory" to this problem, but through three Buddha body of theory. In short, the body of law to the Buddha Dharma and sentient beings as a contact intermediary. On the one hand, body of law as a Buddha in the phenomenal world to attend the results, which do not transcend the phenomenal world; other hand, the body of law were no wisdom to properly recognize the judicial system, and therefore associated with the Dharma Realm. Further, the body of law can not smell, good enough for practical enlightenment through the body of living beings must engage with the changes in the body, while the body of law and the relationship between the other two, is equivalent to no difference between the intellect and wisdom after that relationship. Finally, the "photo Mahayana theory" liberation school structure and Christianity's "Christology" of relief to make a simple comparison study architecture, and as a conclusion. This paper begins with arguing that within the larger context of soteriology, the notion of "theology" can be legitimately applied to other religious traditions than Christianity. Following this, I propose that the issue of how the realm of transcendence could relate to the realm of phenomenon can serve as an example of a general theological issue across religious boundaries. I then investigate how this issue is discussed in the Mahāyānasamgraha as a seminal text in the Buddhist Yogācāra tradition. In the Mahāyānasamgraha, the above issue is formulated as the question of how unconditioned Dharma-realm could save the sentient beings in the conditioned world. I argue that the asnwer provided in the Mahāyānasamgraha hinges on its theory of three bodies of the Buddha. In short, the Dharma-body bridges between the Dharma-realm and sentient beings. On the one hand, the Dharma-body is the result of a bodhisattva's enduring practice in the phenomenal world, and hence does not transcend over the phenomenal world; on the other hand, the Dharma-body correctly knows the Dharma- realm through the non-discriminating cognition , and hence relates to the Dharma-realm. Furthermore, since sentient beings cannot see the Dharma-body, they can be taught only by the Enjoyment-body and the Transformation-body of the Buddha. The relation between the Dharma-body and the other two bodies is identical to the relation between the non-discriminating cognition and the subsequently-acquired cognition . Finally, this paper ends with a brief comparison between the soteriological scheme in the Mahāyānasamgraha and the scheme reflected in the issue of Christology. (shrink)

The purpose of this study is to examine the topic of older people in the world from the perspective of the Social Teaching of the Church. As explained in Christifideles Laici , the Catholic Church believes that the laity is summoned to pave the way for the arrival of God’s Kingdom, and people who are at an advanced age should still respond to God’s calling through their own unique way of contribution. In Familiaris Consortio it is emphasized that the Church (...) should help older people manifest their roles both in families and religious groups. Although it is mentioned in these two apostolic exhortations that older people are blessed with wisdom, it is not explained as they actually acquire such a blessing. In order to address this issue and elaborate on the meaning of older people’s wisdom, Grün’s theory on the nature of older people’s wisdom and where such a blessing comes from is made reference to in this study. Moreover, it is emphasized in the apostolic exhortation of Familiaris Consortio that older people are often marginalized in today’s industrialized and urbanized society and neglected in their families, while also enduring psychological and/or physical pain. Addressing this issue, the value of older people’s work and their unshirkable missions and duties are explained in the present study by examining the nature and value of man’s work as mentioned in Laborem Exercens . Sen’s “capability approach” is also utilized in the present study as a way to examine older people’s values and the deprivation of their capability, allowing an in-depth analysis of this topic. The findings of this study reveal that Grün’s theory of older people’s wisdom being shaped by their life-experiences is significantly complementary to the messages on older people in Christifideles Laici and Familiaris Consortio . While Sen’s capability approach does not offer a complete set of values or cultural system that solves this problem, the approach of “civilization of love” proposed in the Social Teaching of the Church is very useful in helping one contemplate on the problems faced by older people around the world. 본 논문은 신불해와 한비자의 관계를 기존의 ‘술(術)’이나 ‘형명(形名)’이라는 전통적 이론틀 에서 벗어나 정치, 언어, 마음이라는 포괄적이고 현대적인 관점에서 분석해보고자 하였다. 신불 해는 전기 법가로 평가되는 신도, 신불해, 상앙 중에서 ‘명(名)’의 중요성을 가장 강조한 철학자 이며, 정치는 언어에 의해 운용되는 행위임을 지적하였다. 한비자는 신불해의 관점을 적극적으 로 수용하며, 동시에 신불해가 언어의 기능을 과신했다고 비판한다. 한비자가 언어의 기능을 어 느 정도 불신하는 데에는 의사소통의 어려움 때문이다. 의사소통은 기본적으로 언어라는 기호로 이루어지며, 상대방을 설득할 때 주요한 수단으로 사용된다. 그런데 상대방을 설득할 때 중요한 것은 (...) 기호에 대한 나의 해석을 상대방에게 전달하는 것이 아니라 상대방의 해석을 알아맞히는 것이다. 그러나 상대방의 마음을 알아맞히는 것은 굉장히 힘든 일이다. 특히 첨예하게 이익이 대 립하는 군신 간의 관계에서 이루어지는 의사소통은 더욱 힘들기 마련이다. 그리고 한비자는 언어라는 기호로 이루어진 정치적 규칙이 규범성을 가지는 이유는 강제적 인 제재에서 기인한다고 보았다. 다시 말하면, 한비자는 ‘언어의 규약성’과 ‘규약적 기호의 규범 성’은 별개라고 생각했다. 『한비자』 「정법」에서 한비자의 신불해에 대한 비판은 이런 맥락에 서 이해될 수 있다. 한나라 소후는 신불해의 조언대로 신하들에게 ‘술’을 쓰고 있었지만, 신하들 사이에서 법이 제대로 기능하지 못하고 있었기 때문에 패자(覇者)가 될 수 없었다. 왜 냐하면 신하들은 신법과 구법 중에 자신의 이익에 부합한 규칙을 따르고 있었기 때문이다. 한 비자는 신하들의 자의적인 법해석을 막는 방법은 강제적인 제재밖에 없다고 생각했다. 한비자는 법이라는 사회적 구성물이 저절로 규범적 효과를 가지지 못한다는 것을 인식했기 때문에 상앙 의 상벌 이론을 끌어와 신불해의 이론을 보완하고자 하였다.
