According to a two-level criterion for combination tests in the field of ordinary language, moral 'ought'-sentences may be taken to imply 'I intend'-sentences partly semantically and partly pragmatically. If so, a trenchant linguistic analysis of the concept of moral obligation cannot do without a non-classical logic which allows to model these important kinds of ordinary-language implications by means of purely syntactical derivations. For this purpose, an integrated logic of conviction and intention has been tentatively devised by way of a doxastically, (...) buletically, and pragmatically extended calculus of natural deduction. This system of buletic logic cannot even be launched without one or two derivation rules of deductive closedness. However, these very closedness rules appear to be responsible for buletic paradoxes which are analogous to paradoxes long since known from other, less exotic branches of logic but at first sight look much more virulent. After having scrutinized two potential strategies for coping with the paradoxes of buletic logic, finally we can convince ourselves that these paradoxes, as well as their familiar non-buletic counterparts, are but apparent paradoxes, provided we consistently lean on C-CT and do not let pragmatical considerations intrude into purely logical ones. In connection with his discussion of the three Ulpian formulae, Kant introduces three “leges,” namely the “lex iusti,” the “lex iuridica,” and the “lex iustitiae,” which he then defines in § 41 of the Doctrine of Right. The three “leges” correspond to the attributes “right,” “juridical,” and “established as right.” These three attributes in turn relate to the possibility, the reality, and the (material) necessity of our rights and juridical duties. The three “leges” and attributes have certain consequences for the (...) division of public justice, public justice being constitutive of the juridical state, into “iustitia tutatrix,” “iustitia commutativa,” and “iustitia distributiva.” This article provides a comprehensive account of all these concepts from § 41 of the Doctrine of Right. It also explains what until now has seemed to be a rather cryptic comment Kant makes at the end of his discussion of the Ulpian formulae regarding internal and external legal duties, and those legal duties that contain the derivation of the external legal duties from the principle of the internal legal duties through subsumption. Der ursprünglich und a priori vereinigte Wille wird von einer ursprünglichen Gemeinschaft aller Menschen am Erdboden hervorgebracht, die ihrerseits auf einem ursprünglichen Recht eines jeden auf einen Platz auf dieser Erde gründet. Das ursprüngliche Recht auf einen Platz selbst folgt aus dem ursprünglichen Freiheitsrecht. Der ursprünglich vereinigte Wille richtet sich auf die Aufteilung des Erdbodens. Dadurch wird der ursprüngliche Erwerb von Sachen, (...) insbesondere von Grundstücken, möglich. Kant formuliert diese Möglichkeit in dem Postulat des § 2 der Rechtslehre, das ein Erlaubnisgesetz der praktischen Vernunft enthält: "Es ist möglich, einen jeden äußeren Gegenstand meiner Willkür als das Meine zu haben." Das Postulat folgt nicht analytisch aus dem ursprünglichen Freiheitsrecht. The originally and a priori united will flows out of the original community of all human beings on the earth's surface, which in turn is based on each person's original right to a place on this earth. The original right to a place on the earth's surface follows analytically from the original right to freedom. The originally united will commands us to divide the surface of the earth. This will to divide the land makes original acquisition possible. Kant formulates this possibility in § 2 of the Doctrine of Right, which contains a permissive law of practical reason: "It is possible to have any external object of my choice as mine." This postulate does not follow analytically from the original right to freedom. Instead it is based on a reductio ad absurdum and thus contains a synthetic principle of law a priori. The postulate of public law is added to the will to divide the earth's surface and requires entering a juridical state in order to secure property rights to things. This postulate is also a synthetic principle of law a priori. Founding a juridical state presupposes the original contract. Ownership of land logically precedes the founding of any state, because a state can be founded only if the people intending to found it have a state territory. (shrink)

This article attemps to provide a good defense for battered women who kill their sleeping husbands, particularly in cases where it is judged that she was mistaken in her assumption of the need to exercise self-defense. Proceeding from the distinction between the imputation of an act to an actor and the imputation of blame to an actor for criminally prohibited conduct , the article moves on to a discussion of the relevance of mistakes as to justifying circumstances under the criminal (...) law. Although some attention is given to the theoretically sound solution to the problem raised by the unknowingly justified actor, primary emphasis is placed on the putatively justified actor. The argument is advanced that the false assumption of justifying circumstances negates the imputation of wrongful conduct to an actor, rather than negating the imputation of blame to him for his wrongful conduct. Accordingly, criminal liability can only attach to an individual acting in putative self-defense, for example, if that individual was negligent for making the mistake . The standard for judging negligence in the United States is that of the so-called "reasonable person". A great deal of discussion in the U.S. scholarly literature has been revolving around the question of whether an "objective" or "subjective" standard of reasonableness should be employed when determining whether an individual acted reasonable and thus non-negligently. This article argues for a "subjective" standard for the criminal law, as opposed to an "objective" standard, which is claimed to have more relevance for tort law . Finally, the claim is made that a battered woman who kills her sleeping husband should be given the benefit of the self-defense justification under the U.S. law approach to self-defense. If the woman is mistaken as to the need to exercise self-defense, then wrongful conduct should be imputed to her only on the basis of whether her mistake was subjectively unreasonable and thus negligent . Der Aufsatz liefert Argumente dafür, daß eine "battered woman" für die Tötung ihres schlafenden Ehemannes strafrechtlich nicht zur Verantwortung gezogen werden kann, und zwar insbesondere dann nicht, wenn sie irrig Umstände annimmt, die, wenn sie vorlägen, die Handlung der Frau unter Notwehrgesichtspunkten rechtfertigen würden. Die Unterscheidung zwischen der Zurechnung eines Vorgangs als Handlung und der Zurechnung einer rechtswidrigen Tat zur Schuld wird vorangeschickt . Dann wird die strafrechtliche Relevanz von Irrtümern über rechtfertigende Umstände besprochen. Zwar wird die theoretisch richtige Lösung auch solcher Fälle diskutiert, bei denen der Täter rechtfertigende Umstände verkennt. Doch wird die Betonung auf die Fälle der Putativnotwehr gelegt, wobei die These vertreten wird, daß die irrige Annahme von rechtfertigenden Umständen die Zurechnung des Vorgangs als Totschlagshandlung und nicht erst die Zurechnung zur Schuld ausschließt. Daraus läßt sich entnehmen, daß der Täter, der in Putativnotwehr handelt, strafrechtlich nur dann verantwortlich ist, wenn sein Irrtum auf Fahrlässigkeit beruht . In den U.S.A. wird die Frage, ob jemand fahrlässig gehandelt hat oder nicht, danach beantwortet, ob eine "reasonable person" in der gegebenen Situation genauso wie der Täter gehandelt hätte. Zur Zeit findet eine lebhafte Diskussion darüber statt, ob dieser Maßstab "objektiv" oder "subjektiv" aufzufassen sei. Anders ausgedrückt: Es wird die Frage gestellt, ob die Geschworenen die Annahmen eines Durchschnittsmenschen oder aber die eines Menschen mit den persönlichen Merkmalen und Erfahrungen des Angeklagten in ihren Überlegungen darüber heranziehen sollten, ob dieser hypothetische Mensch einem Irrtum wie dem des Angeklagten erlegen wäre. Der Aufsatz spricht sich, was strafrechtliche Urteile angeht, für den "subjektiven" und gegen den "objektiven" Maßstab aus, der statt dessen für die deliktsrechtlichen Urteile der angemessenere zu sein scheint . Die Ergebnisse dieser Argumentationen werden dann auf den Fall der "battered woman" angewandt. Es wird gezeigt, daß die geschundene Frau, die ihren schlafenden Ehemann tötet, nach dem U.S. Model Penal Code unter Notwehrgesichtspunkten gerechtfertigt sein kann. Sollte es im Einzelfall so sein, daß die Frau sich über die Erforderlichkeit der Notwehrhandlung geirrt hat, dann kann ihr die Handlung nur dann zugerechnet werden, wenn der Irrtum im "subjektiven" Sinne fahrlässig gewesen ist. One of the most troubling aspects of dealing with past injustice in the former East Block is the conflict between positive law and law as the expression of higher principles of justice. In his Die Metaphysik der Sitten, Kant attempts to give content to, and place limitations on, what one may reasonably call "law". The purpose of this paper is to examine Kant's theories of commutative justice in a state of nature and distributive justice in a civil state in an (...) effort to define principles that are binding for every legal system. The paper examines two sets of four cases, namely 1) equity, necessity, pardons and duels; and 2) gifts, loans, bona fide purchasers and oaths, where Kant establishes limitations on state power with respect to the individual and to the society of individuals as a whole. Kant's legal system reveals itself to be a system devoted to liberal individualism and the maximum of protection of individual liberties. Einer der am meisten beunruhigenden Aspekte beim Umgang mit vergangenem Unrecht im früheren Ostblock besteht in dem Konflikt zwischen positivem Recht einerseits und Recht als Ausdruck höherer Prinzipien der Gerechtigkeit andererseits. In seinem Werk Die Metaphysik der Sitten versucht Kant, Inhalt und Grenzen dessen zu bestimmen, was man vernünftigerweise als "Recht" bezeichnen kann. Die Aufgabe dieses Beitrags besteht darin, Kants Theorien kommutativer Gerechtigkeit im Naturzustand sowie distributiver Gerechtigkeit im bürgerlichen Zustand zu untersuchen, um auf diese Weise Prinzipien zu ermitteln, die für jedes Rechtssystem bindend sind. Es werden dabei zwei Gruppen von je vier Fällen näher betrachtet, und zwar 1) Billigkeit, Notstand, Duell und Gnadenerweis sowie 2) Schenkung, Leihe, Gutglaubenserwerb und Eidesleistung, in denen Kant der staatlichen Macht im Hinblick auf das Individuum und die Gesellschaft der Individuen insgesamt Grenzen zieht. Learning disabilities are highly prevalent on college campuses, yet students with learning disabilities graduate at lower rates than those without disabilities. Academic and psychosocial supports are essential for overcoming challenges and for improving postsecondary educational opportunities for students with learning disabilities. A holistic, multi-level model of campus-based supports was established to facilitate culture and practice changes at the institutional level, while concurrently bolstering mentors’ abilities to provide learning disability-knowledgeable support, and simultaneously creating opportunities for students’ personal and interpersonal development. Mixed (...) methods were used to investigate implementation of coordinated personal, interpersonal, and institutional level supports for undergraduate science, technology, engineering, and math (STEM) students with learning disabilities. A one-group pre-test post-test strategy was used to examine undergraduate outcomes. Participants included 52 STEM undergraduates with learning disabilities, 57 STEM graduate student mentors, 34 STEM faculty mentors, and 34 university administrators and personnel as members of a university-wide council. Enrolled for two years, undergraduates were engaged in group meetings involving psychoeducation and reflective discussions, development of self-advocacy projects, and individual mentorship. Undergraduates reported improved self efficacy (p =.001), campus connection (p <.001), professional development (p ≤.002), and self advocacy (p <.001) after two academic years. Graduate student mentors increased their understanding about learning disabilities and used their understanding to support both their mentees and other students they worked with. Council members identified and created opportunities for delivering learning disability-related trainings to faculty, mentors and advisors on campus, and for enhancing coordination of student services related to learning and related disorders. Disability-focused activities became integrated in broader campus activities regarding diversity. This research explicates a role that college campuses can play in fostering the wellbeing and the academic and career development of its students with developmental learning and related disorders. It offers an empirically tested campus-based model that is multilevel, holistic, and strengths-based for supporting positive outcomes of young people with learning disabilities in STEM. Moreover, findings advance the knowledge of supports and skills that are important for self-regulating and navigating complex and multi-faceted disability-related challenges within both the post-secondary educational environment and the young adults’ sociocultural context. Background: The factors influencing parents’ willingness to enroll their children in biobanks are poorly understood. This study sought to assess parents’ willingness to enroll their children, and their perceived benefits, concerns, and information needs under different consent and data-sharing scenarios, and to identify factors associated with willingness. Methods: This large, experimental survey of patients at the 11 eMERGE Network sites used a disproportionate stratified sampling scheme to enrich the sample with historically underrepresented groups. Participants were randomized to receive one of (...) three consent and data-sharing scenarios. Results: In total, 90,000 surveys were mailed and 13,000 individuals responded (15.8% response rate). 5737 respondents were parents of minor children. Overall, 55% (95% confidence interval 50–59%) of parents were willing to enroll their youngest minor child in a hypothetical biobank; willingness did not differ between consent and data-sharing scenarios. Lower educational attainment, higher religiosity, lower trust, worries about privacy, and attitudes about benefits, concerns, and information needs were independently associated with less willingness to allow their child to participate. Of parents who were willing to participate themselves, 25% were not willing to allow their child to participate. Being willing to participate but not willing to allow one’s child to participate was independently associated with multiple factors, including race, lower educational attainment, lower annual household income, public health care insurance, and higher religiosity. Conclusions: Fifty-five percent of parents were willing to allow their youngest minor child to participate in a hypothetical biobank. Building trust, protecting privacy, and addressing attitudes may increase enrollment and diversity in pediatric biobanks. (shrink)

This research investigates the perceptions of five constituent groups of an accredited business school — their perceptions of others'' ethics, of their own ethics and ideal values, and of how business ethics can be improved. Self-described behavior from the constituent groups is quite similar, yet is decidedly different from that which respondents felt others would do. Undergraduate business students tended to have the lowest estimation of others'' ethics in addition to the least ethical self-described behavior compared with other constituent groups. (...) All constituents were solidly in favor of improving ethics by developing principles of business ethics, requiring ethics courses in business schools and introducing industry codes of ethics. People are much more ethical than they are perceived to be. Knowing that others are more ethical may in turn cause other people to act more ethically. Similarly, believing that others are less ethical may encourage less ethical behavior. (shrink)

Non-invasive prenatal testing is at the forefront of prenatal screening. Current uses for NIPT include fetal sex determination and screening for chromosomal disorders such as trisomy 21. However, NIPT may be expanded to many different future applications. There are a potential host of ethical concerns around the expanding use of NIPT, as examined by the recent Nuffield Council report on the topic. It is important to examine what NIPT might be used for before these possibilities become consumer reality. There is (...) limited research exploring views of women on possible future uses of NIPT, particularly those of women who have undergone NIPT. In this study, we examined the views of women who undertook NIPT previously on the acceptability of and interest levels in using NIPT for a number of current and possible future applications. These included several medical conditions encompassing psychiatric, neurodevelopmental and adult-onset conditions as well as non-medical traits such as intelligence. One thousand women were invited to participate and 235 eligible surveys were received. Women generally reported an interest in using NIPT for medical conditions that severely impacted quality of life and with an onset earlier in life and stressed the importance of the accuracy of the test. Concerns were raised about the use of NIPT for non-medical traits. Respondents indicated that termination of pregnancy was not their only reason for testing, particularly in the case of sex. These results can further inform the ethical debate around the increasing integration of NIPT into healthcare systems. (shrink)

Prior research found correlations between reflection test performance and philosophical tendencies among laypeople. In two large studies (total N = 1299)—one pre-registered—many of these correlations were replicated in a sample that included both laypeople and philosophers. For example, reflection test performance predicted preferring atheism over theism and instrumental harm over harm avoidance on the trolley problem. However, most reflection-philosophy correlations were undetected when controlling for other factors such as numeracy, preferences for open-minded thinking, personality, philosophical training, age, and gender. Nonetheless, (...) some correlations between reflection and philosophical views survived this multivariate analysis and were only partially confounded with either education or self-reported reasoning preferences. Unreflective thinking still predicted believing in God whereas reflective thinking still predicted believing that (a) proper names like ‘Santa’ do not necessarily refer to entities that actually exist and (b) science does reveal the fundamental nature of the world. So some robust relationships between reflection and philosophical tendencies were detected even among philosophers, and yet there was clearly more to the link between reflection and philosophy. To this end, demographic and metaphilosophical hypotheses are considered. (shrink)

The return of genetic research results after death in the pediatric setting comes with unique complexities. Researchers must determine which results and through which processes results are returned. This paper discusses the experience over 15 years in pediatric cancer genetics research of returning research results after the death of a child and proposes a preventive ethics approach to protocol development in order to improve the quality of return of results in pediatric genomic settings.

We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. Mistrust and fear of research often exist in minority communities because of assumptions, preconceived ideas, and historical abuse and racism that continue to influence research participation. The research establishment is full of well-meaning ‘outsider’ investigators who recognize discrimination, health disparities, and insufficient health care providers in minority communities, but struggle in breaking through this history of mistrust. This article provides ethical insights from one such ‘insider-outsider’, community-based participatory research project implemented via community health advisors in the Mississippi Delta. Both community-based (...) participatory research and community health advisors provide opportunities to address the ethical issues of trust, non-maleficence, and justice in minority communities. Universalism in philosophy, argue Penny Enslin and Mary Tjiattas, tends to be regarded as an affront to particular affiliations, an act of injustice by misrecognition. While agreeing with criticisms of some expressions of universalism, they take the view that anti-universalism has become an orthodoxy that deflects attention from pressing issues of global injustice in education. In different ways, recent reformulations of universalism accommodate particularity and claims for recognition. Defending a qualified universalism, they argue, through a discussion of the Education for (...) All campaign, that the present focus on recognition should be widened to address redistribution and representation as elements of global justice in education.In her response to Enslin and Tjiattas, Sharon Todd expresses sympathy for their aspiration towards a ‘qualified universalism’, but she seeks to go beyond the dichotomy of universalism versus anti-universalism by way of a discussion of aspects of the work of Judith Butler. Butler’s emphasis on cultural translation offers a way, it is claimed, to think about the universal that transcends the oppositional relation between culture and commitment to universals. In the light of this she advocates an approach that involves neither universalism nor anti-universalism but ‘critique of universality’. Thus, the task of translation, on Butler’s account, prevents universality from being a standard or home-base from which we can judge the world and turns it instead into an ongoing struggle for intelligibility.In their rejoinder, Enslin and Tjiattas reject any charge that their own account has fallen into a simple dichotomisation of universalism and anti-universalism, and reaffirm their commitment to a form of universalism in which (a) partial or contextual considerations count in ethical deliberations, and (b) values and principles are subject to reflexive renegotiation in democratic deliberations, which provides the means of their justification and the source of their legitimacy. This yields, they claim, a non-standard form of contractualism that is both culturally sensitive and open-ended. They suggest in conclusion that the debate between themselves and Todd raises questions about whether the analytical and continental traditions can concede one another’s place in the philosophy of education. Women’s health activists laid the groundwork for passage of the law that created the U.S. Food and Drug Administration in 1906. The pharmaceutical and food industries fought regulatory reforms then and continue to do so now. We examine public health activism in the Progressive Era, the postwar era and the present day. The women’s health movement began in the 1960s, and criticized both the pharmaceutical industry and the medical establishment. In the 1990s, patient advocacy groups began accepting industry funds; thousands (...) of commercially-funded groups now dominate the advocacy landscape. As pharma funding became normalized, concerns arose regarding a) the lack of transparency and public accountability regarding funding, b) the distortion of groups’ agendas, and c) the ability of pharma-funded groups to dominate the discourse and override less well-resourced patient and health advocacy groups. Although industry-funded groups argue that funding allows them to provide useful services, the trade-off in health risks, exorbitant prices and distorted information is far too high. Sincerity is beside the point; patients and the industry have differing interests when it comes to drug safety and efficacy, drug information and drug prices. A growing resistance movement is asserting the values of its activist predecessors and opposing the prevailing culture of pharma-funded advocacy. (shrink)

ABSTRACT A rereading of the American scientific literature on sex determination from 1902 to 1926 leads to a different understanding of the construction of the Mendelian‐chromosome theory after 1910. There was significant intellectual continuity, which has not been properly appreciated, underlying this scientific “revolution.” After reexamining the relationship between the ideas of key scientists, in particular Edmund B. Wilson and Thomas Hunt Morgan, I argue that, contrary to the historical literature, Wilson and Morgan did not adopt opposing views on Mendelism (...) and sex determination. Rather, each preferred a non‐Mendelian explanation of the determination of sex. Around 1910, both integrated the Mendelian and non‐Mendelian theories to create a synthetic theory. One problem was the need to avoid an overly deterministic view of sex while also accepting the validity of Mendelism. Morgan’s discovery of mutations on the X chromosome takes on different significance when set in the context of the debate about sex determination, and Calvin Bridges’s work on sex determination is better seen as a development of Morgan’s ideas, rather than a departure from them. Conclusions point to the role of synthesis within fields as a way to advance scientific theories and reflect on the relationship between synthesis and explanatory “pluralism” in biology. (shrink)

Responsibility is a moral quality of caring that is central to child health policies. In contemporary UK these policies are based on behavioural psychology and underpinned by individualism, an ideology central to neoliberal governance. Amid the complexities of “obesity” and inequalities, there is a multi-layered stigmatisation of parents as moral associates. Few studies consider the lived realities of food policy processes from the standpoint of class. This critical qualitative research draws on theorists who explain processes of power and class: Foucault, (...) Gramsci, Bourdieu and Marx. Its objectives are: (a) to understand the lived experience of parents as they interact with food policy; (b) to explore how parents resist stigmatisation; and (c) to reflect on implications for policy and practice. Methods: Using purposive sampling, 31 ethnographically-informed interviews were carried out in a London borough, with policy actors: policymakers, implementers and parents as policy recipients, including 12 working-class mothers. Results: A core theme of “responsibilities” emerged with four interconnecting sub-processes that provide insight into how stigmatisation and resistance evolve through policy. Discussion: As have others, this study reveals the idea of responsibility as fundamental to the processes of soft power. Child health is a priority for participants and a “ruling idea”. The diffusion of responsibility throughout policy leads to confusion about where it lies. New subjectivities are formed in line with ideas of governmentality. Parents engage with policy at multiple sites that elicit symbolic violence, and stigma sows social divisions. Against this background, working-class parents are left in a state of cognitive dissonance between being made responsible (responsibilisation), and feeling responsible (self-blaming) for their children’s weight while lacking the material resources to provide an optimal nutritious diet. Resistance is interwoven and is essentially found in parents’ policy alternatives that diverge from UK government policy. Conclusion: Critical qualitative research using multiple theorists is valuable in understanding how parents interact with policy in a complex social world. With UK policy failing, useful insights are provided into how involving parents in policymaking might determine a meaningful collective responsibility, with a political ethic of care and unity between parents that would advance health equity. Objective Analyze racial differences in comfort with medical research using an alternative to the traditional approach that treats white people as a raceless norm.Methods Quantitative analysis of survey responses (n = 1,570) from Black and white residents of the US to identify relationships between perceptions of research as a right or a risk, and comfort participating in medical research.Results A lower proportion of white respondents reported that medical experimentation occurred without patient consent (p < 0.001) and a higher proportion of (...) white respondents reported that it should be their right to participate in medical research (p = 0.02). Belief in one’s right to participate was significantly predictive of comfort (b = 0.37, p < 0.001). Belief in experimentation without consent was significantly predictive of comfort for white respondents but not for Black respondents in multivariable analysis.Conclusions A rights-based orientation and less concern about the risks of medical research among white respondents demonstrate comparative advantage. Efforts to diversify medical research may perpetuate structural racism if they do not (1) critically engage with whiteness and its role in comfort with participation, and (2) identify and respond specifically to the needs of Black patients.
