Whilst there are not yet laws specifically relating to nanotechnology and its products in any country, the technology and its products are not unregulated. Regulatory frameworks created for conventional technologies and products will be expected to apply to nanotechnology and its products. For example, new medicines are regulated in Australia by the Therapeutic Goods Administration. If a new medicine incorporates nanotechnology, then it should still be regulated as a medicine. However, whether the expectation that pre-existing regulatory frameworks will apply is (...) correct and, if so, whether the application of such frameworks is adequate are important issues to be answered. This paper considers these questions, drawing on lessons learnt from significant regulatory reviews undertaken in the United Kingdom, United States and Australia. (shrink)

Based on the experiences of two high profile voluntary data collection programs for engineered nanomaterials, this article considers the merit of an international online registry for scientific data on engineered nanomaterials and environmental, health and safety (EHS) data. Drawing on the earlier experiences from the pharmaceutical industry, the article considers whether a registry of nanomaterials at the international level is practical or indeed desirable, and if so, whether such an initiative—based on the current state of play—should be voluntary or mandatory. The article commences with an examination of the success and failures of voluntary reporting schemes in the UK and the US, as well as the International Council of Nanotechnology’s EHS Database and the OECD’s Working Party on Manufactured Nanomaterials. The article then examines the history of clinical trials registries, including the key motivations behind their creation, the role of self-regulation, and the perceived benefits thereof. Key lessons of the rise of clinical trials registration are highlighted, as are crucial considerations that must be addressed by policy makers should a multi-lateral public registry for data on nanoscale materials and EHS research be perceived to be a desirable option. The article concludes by arguing that while the creation of a registry to record information generated on nanomaterials is not straightforward, this reason alone should not deter industry from taking a proactive approach to the dissemination of fundamental data and research findings. Scientific knowledge and technological expertise continue to evolve rapidly. Such innovation gives rise to new benefits as well as risks, at an ever-increasing pace. Within this context, regulatory regimes must function in order to address policymakers’ objectives. Innovation, though, can challenge the functioning and effectiveness of regulatory regimes. Questions over fit, effectiveness, and capacity of these regimes to ensure the safe entry of such technologies, and their products, onto the market will be asked in parallel to their development. With this (...) in mind, this article examines the strengths and weaknesses of current regulatory frameworks, including those designed for biotechnology, cosmetics, novel organisms, and foods, in order to inform and help shape Australia’s regulatory landscape around innovation. By focusing on Australia, the article illustrates the need to assess future changes to regulatory frameworks using a careful balancing of key factors. These include, for example, horizon scanning and monitoring, availability of appropriate data, existing health, safety, environmental, ethical, and social risks and impacts, and regulatory capacity. The article argues that rather than using one of these factors in isolation, a careful assessment of where each factor stands can lead regulators to an approach that properly manages the potential risks of emerging technologies. It appears that indexicals must have fine-grained senses for us to explain things involving human action and emotions, and we typically identify these different senses with different modes of expression. On the other hand, we also express the very same thought in very different ways. The first problem is the problem of cognitive significance. The second problem is what Branquinho (1999) has called the problem of cognitive dynamics. The question is how we can solve both of those problems at the (...) same time. Vojislav Božičković (2021) offers one solution in which the cognitive dynamics runs through the objects of the attitudes. I discuss this solution and offer an alternative in which the theory of cognitive dynamics has no use for the objects of the attitudes to unify expressions of attitudes. When we say or believe “the same thing” using different modes of expressions, it is by virtue of our deploying a dynamic theory of attitude expression. Like Lewis Carrol’s Red Queen, we must run to stay in place. (shrink)

Peirce’s theory of signs accounts for these meanings and also for the role of the interpreter. His theory draws attention to the static and dynamic nature of signs. Sign interpretation can be viewed as a continuous dynamic and evolving process. The author argues that the standard view about language, seen as fairly stable abstract system of communication, is a myth. Standard view is badly mistaken and the alternative picture is offered in which there is a core part of our linguistic competence that is fixed by biology and this provides a basic skeleton which is fleshed out in different ways on a conversion-by-conversation basis. Why certain people communicate with each other? The answer to this question is not because they speak (...) the same language. We cannot see how communication can emerge from the standard picture of language if we do not start investigating the nature of our linguistic coordination strategies, since there is not a thing there -- a language -- that helps us to communicate. According to a number of authors it is possible to give tenseless (B-series) truth conditions for tensed sentences by utilizing token indexicals in something like the following fashion. (1a) An utterance u of 'Past S' is true iff at some time earlier than u, S is true (1b) An utterance u of 'Pres S' is true iff at some time overlapping u, S is true This strategy has been challenged on the grounds that it will break down in cases like (...) (2). (2) There was no spoken language A number of strategies have been attempted to circumvent this difficult, including the introduction of possible utterances, etc. In this paper I argue that such moves are unnecessary — that the problem turns on scope interactions with hidden modals in the theorems of the T-theory. In accounts of indexicals, we encounter two problems: the problem of cognitive significance and the problem of cognitive dynamics. The problem of cognitive significance leads us to posit finer-grained sense content to account for the explanation of our actions and emotions. Meanwhile the problem of cognitive dynamics calls us to show how two episodes of thought can have the same fine-grained sense content even though they are expressed in different ways in different times and places. Bojislav Bozickovic offers a solution (...) to the problem of cognitive dynamics by using objects to tie together different ways in which a sense content might be expressed, and arguing that the sense expressions might become untied if we come to wonder if we are talking about the same object. I argue that this strategy raises a number of questions, and may lead to destabilization of our thought contents based on past and future concerns about object identity. (shrink)

ABSTRACT Tensism is the view that tense is not merely a property of language and the mind, but of the world itself. Perspectivalism extends this idea to all perspectival properties be they person or locational. One challenge that perspectivalism faces is the problem of expressing the contents of the beliefs and utterances of persons that are in other perspectival positions. One proposed solution to this problem is to allow for semantic theories that "realign" the expression of contents so that the (...) contents expressed by persons in other perspectival positions can be re-expressed from one's own perspectival position. In this paper I argue that a similar semantic realignment strategy could be deployed in helping perspectivalists generally come to grips with a puzzle raised by the Special Theory of Relativity. In short, the strategy is to realign the expression of contents in another inertial frame so that they are expressed from within your inertial frame. As we will see, the strategy is not puzzle free.
