Profondément liées aux pratiques ascétiques et aux recherches spirituelles monastiques, les oeuvres mystiques syriaques ne se confondent cependant pas avec elles. Elles construisent des visions théologiques qui participent nécessairement aux débats dans les institutions ecclésiales, que ce soit chez les syriaques occidentaux ou les syriaques orientaux. Redevables de l'héritage philosophique grec, des auteurs syro-occidentaux ont élaboré des pensées mystiques et l'oeuvre du Pseudo-Denys a été déterminante dans la mystique sacramentaire de la théologie miaphysite. C'est du côté oriental que la tradition (...) mystique a été la plus riche et a fleuri, en Mésopotamie mais aussi sur les bords du golfe Arabo-Persique dans le Bet Qatraye, où l'on se souvient d'écrivains fameux comme Isaac de Ninive, Dadisho du Qatar, Martyrios Sandona, Jean de Dalyatha ; mais qui connaît Shubhalmaran, Hananisho de Bet Qoqa ou Beh Isho de Kamul? En privilégiant des analyses thématiques et l'étude de motifs mystiques essentiels, l'ouvrage vise à attirer l'attention sur des oeuvres et des auteurs qui, dans la formation et l'évolution des cultures syriaques, ont joué un rôle tout au long de l'histoire du Proche-Orient chrétien et musulman et qui se révèlent précieux pour l'historien. The din and deadlock of public life in America--where insults are traded, slogans proclaimed, and self-serving deals made and unmade--reveal the deep disagreement that pervades our democracy. L'objectif est de proposer un cadre théorique et des outils méthodologiques pour la détermination du statut du film : fictionnel ou non-fictionnel.

This paper assumes that the realization of a teaching action implies the conceptualisation and the theorization of practice, a positioning that allows to put things into perspective with respect to the professional activity and to learners, as well as a complex linguistic and cognitive positioning towards academic knowledge and institutional injunctions. This hypothesis is confronted with the scriptural positioning that young pre-service teachers adopt for the writing of their professional report, and is viewed through the lens of the point of (...) view issue. After having considered this issue in its various dimensions, the paper focuses on the linguistic concept of point of view, then analyses its relations to the adjacent notion of empathy and, more specifically, of empathic mobility. Finally, it explains how these linguistic technics, correlated to the empathic mobility and to the related abilities, contribute to the professionalization of (young) teachers by allowing them to problematize their own point of view; this problematization is achieved through a reflexive distance from the point of view of (institutional or academic) authority figures or from their own research objects and by taking into consideration their current situation and their experience in order to better emphasize the complexity of their research object and to better prepare for their professional activity. Dans les quatre essais qui composent ce livre s'ébauche ce que Foucault nommerait une analytique de la démocratie contemporaine en rupture ouverte avec les courants dominants de la science politique et de la philosophie politique. Il ne s'agit pas en effet de s'y demander ce qui définirait à proprement parler un régime démocratique, quelles seraient les normes de la culture démocratique, à quelles valeurs se réfèrent les usages démocratiques, en quoi consiste la vie démocratique, quelles en sont les institutions appropriées, (...) (etc) - mais de partir d'une tout autre question : de quelle espèce est l'opération contemporaine consistant à faire valoir le nom de la démocratie comme celui de la seule figure d'organisation et de vie politique acceptable et conforme aux exigences d'une vie civilisée? Qu'est-ce qui est en jeu dans le balisage de notre présent par l'ensemble des discours tendant à accréditer la notion d'un horizon indépassable de "la démocratie", comme horizon du politique et de la vie commune? De quoi cet usage du mot démocratie est-il la manifestation ou le symptôme? Il s'agirait donc bien de déplacer l'angle du questionnement, de se situer dans un autre champ. On ne se demandera pas dans ces textes ce qu'est en vérité la démocratie contemporaine, on n'en dénoncera pas les faux-semblants ou les illusions, on n'opposera pas à ces mensonges ou ces trahisons allégués ce qu'elle devrait être - on s'interrogera plutôt sur le point suivant : sous quelles conditions sommes-nous astreints aujourd'hui à parler de la démocratie, quels sont les principes d'agencement qui président à l'établissement de l'ordre des discours régissant la formation des énoncés à propos de "la démocratie" aujourd'hui? Ce qui constitue donc la trame de ces textes, ce ne sont pas des questions de définitions adéquates, ce n'est pas la critique des apparences fallacieuses ou des impostures des appareils de la démocratie contemporaines, c'est plutôt l'analyse du champ de forces et des jeux stratégiques de pouvoir qui s'établissent autour du nom de la démocratie dans nos sociétés. On oppose traditionnellement deux approches méthodologiques en sciences sociales : le holisme et l'individualisme. Il est tentant d'identifier cette opposition à celle du structuralisme et de l'atomisme. Ainsi, dans Les institutions du sens, Vincent Descombes propose de récuser l'individualisme méthodologique et de lui substituer une approche « holiste structuraliste », susceptible de permettre d'échapper aux mirages des « entités collectives » aussi bien qu'aux aportes de l'atomisme logique et du psychologisme, en mettant en avant la notion d'institution et celle d'esprit (...) objectif. Cette analyse passe par une critique logique radicale des arguments de Karl Popper en faveur du « nominalisme méthodologique ». On conteste cette présentation des thèses de l'auteur de Misère de l'historicisme, en montrant que sa philosophie n'est en rien un psychologisme et un atomisme, mais qu'elle accorde au contraire une importance capitale à la notion de « causalité structurale » comme à celles d'institution et d'esprit objectif. L'individualisme institutionnel n'est peut-être pas en ce sens un obstacle à la compréhension du problème plus général du tout et des parties. La querelle des sciences sociales et celle des universaux sont décidément solidaires l'une de l'autre. One commonly distinguishes two different approaches in the methodology of the social sciences, namely (methodological) individualism and holism. One can be tempted to identify this opposition to that between atomism and structuralism. For instance, in his book Les institutions du sens, Vincent Descombes argues that we have to substitute for methodological individualism a holistic but not collectivistic approach, so as to be able to escape the illusions of collectivism as well as the traps of logical atomism and of psychologism, putting a premium on the notions of institution and of « objective spirit ». (Similar proposals had been made independently by Philipp Pettit in his The Common MindJ. Descombes' target is mainly Popper's argument against essentialism and holism in The Poverty of Historicism, which he submits to a radical logical criticism. This paper disputes this rendering of Popper's view, which is emphatically anti-psychologistic and not ontologically nominalistic, and which gives a great significance to the very notions of institution, of objective spirit and even of structural causality. His « institutional individualism » is perhaps not a bad tool for handling partially the notorious problem of the hole and the parts. The modern controversy about the methods used in the social sciences and the venerable one about universals are decidely interconnected. (shrink)

Les systèmes sociaux complexes étudiés par Elinor Ostrom et les chercheurs associés caractérisent souvent des réseaux de petite ou de moyenne échelle, tant pour des ressources matérielles qu’informationnelles. Mais d’un point de vue citoyen, les outils, institutions des collectifs sociopolitiques peuvent-ils être pensés sous l’angle des ressources communes et, à ce titre, donner lieu à l’émergence d’une gouvernance participative, en étant vus comme à préserver par les concernés? Pour favoriser une telle lecture, il nous faut clarifier quelques apports de l’école (...) d’Ostrom, amorcer une analyse sociale des composantes d’une gouvernance des communs fondée sur la participation et identifier certaines questions à creuser ultérieurement, notamment les problèmes posés dans le cadre d’une économie largement financiarisée et abstraite des besoins matériels les plus immédiats. The notions of subjectivity, affect, emotion, and moral feelings today impregnate the whole of society, and they are becoming increasingly perceptible in the area of scientific knowledge as well.1 This preoccupation with emotions developed initially in the wake of the advent of a more permissive society in the 1970s, and then with changes in the organization of capitalism, where flexible work has replaced the Taylorist and Fordist models of divided labor, and also with the crisis of the social welfare system (...) in the 1980s. Teaching business ethics and corporate social responsibility should neither be misconstrued as a plea for moral rectitude, nor as a limited utilitarian recipe for managing public interest issues or stakeholders — as it too often is. Rather, teaching CSR should allow students to recognize corporations as social institutions so that they can gauge their impact on a social scale and better weigh the values that inform them.However, this vision of CSR training has not found many supporters in North American schools (...) of management, even as the demand for ethics education continues to increase. Our paper endeavours to clarify the bipolar origins of the rising concern around ethics in the business world and how demand for more ethical corporate management is impacting demand for ethics education in management programs. We have noted that despite the intensity of demand, there is a great deal of skepticism and strong resistance to the integration of ethics and social responsibility into the education of management students. Therefore, while providing a preliminary assessment of ethical training in North American schools of management, we raise questions regarding current objectives and those that could be pursued. With these factors in mind, teaching choices that inspired the development of a new course in economic and social ethics can be presented and justified. (shrink)

Spinoza, comme la tradition judéo-chrétienne, affirme la toute-puissance divine, mais dans une perspective profondément différente. En effet, la conception traditionnelle selon laquelle « Dieu peut tout » suppose que Dieu possède le pouvoir de manipuler la nature et les circonstances à sa guise. Cette idée justifie l’institution d’un culte par les hommes afin d’implorer la miséricorde de Dieu en leur faveur. Or cette interprétation du pouvoir de Dieu ne diffère en rien de celle des hommes de pouvoir, qui peuvent modifier (...) la situation d’un homme selon leur bon plaisir. Spinoza critique cette interprétation qui attribue à Dieu un comportement humain. Il part de l’idée d’infini, au sens de ce qui ne peut être entravé par autre chose, pour montrer qu’il n’y a rien en dehors de Dieu capable de le limiter. Spinoza pose l’infinité de Dieu comme gage de sa liberté. À l’idée d’infini s’ajoute la compréhension de la nature de Dieu qui conditionne celle de sa puissance. Cette puissance, loin de prendre la forme d’une action arbitraire, suit les lois qui lui sont d’emblée fixées par la nature dont elle constitue l’expression nécessaire, à la fois complète et parfaite. Résumé Le mode d’organisation par problèmes qui caractérise les Éléments de Géométrie d’Alexis Clairaut (1741) trouve plausiblement son origine dans l’introduction d’une catégorie éditoriale nouvelle dans une des éditions françaises des huit livres d’Euclide par le père Jésuite Claude-François Milliet-Dechales (1677) : celle des « Usages » adjoints à certaines propositions. La transformation de cette nouveauté éditoriale dans les commentaires de Jacques Ozanam au texte de Dechales en 1690, puis sa réélaboration dans son Cours mathématiques de 1693, conduit à un (...) dispositif d’introduction à la géométrie très proche de ce que proposera ensuite Clairaut, moyennant plusieurs simplifications drastiques. Cette reconstruction est étayée par la lecture que proposera plus tard La Chapelle, dans ses Institutions de Géométrie (1746) aussi bien des « Usages » de Dechales et d’Ozanam que de la méthode d’exposition de Clairaut. Nous montrons au passage que La Chapelle s’inspire largement de cette dernière. (shrink)

Un empire - la domination exercee par la Bible et les autorites - fit naitre en retour le reve d'exercer un pouvoir par l'activite intellectuelle, fondee sur une maitrise du Livre et materialisee par les productions de textes. Ainsi s'etablit le savoir scolastique. Le present ouvrage propose une etude du sens et des moyens de l'activite de pensee lors d'un des beaux matins de l'Occident medieval. Alain Boureau montre d'abord comment se forma une communaute intellectuelle, qui etait aussi une corporation (...) sociale, source de promotion et d'exclusion, d'exaltation libre et de dures contraintes. L'institution s'etablit autour d'un texte d'enseignement et de debat, les Sentences de Pierre Lombard. Un savoir nouveau en terre chretienne impliquait de maitriser les elements de l'heritage religieux et ancestral: la Bible, les principes de la foi et la patristique. Apres avoir analyse les techniques textuelles mises en pratique, que sont l'abstraction intellectuelle et son complement, la casuistique, l'analyse universelle et l'elaboration des distinctions, Alain Boureau oppose la formation d'un langage rationnel dans la communaute scolastique au discours institutionnel qui se solidifia, et a la grande singularite d'une parole individuelle issue de la langue commune. L'Empire du livre constitue, apres La Religion de l'Etat, le deuxieme volume de la serie La Raison scolastique. Alain Boureau, directeur d'etudes a l'EHESS, est medieviste. The purpose of this paper is to discuss the connections and links that existed between Buchanan and Italian economists. We show that, even though Buchanan had read them, it was only after having spent one year in Italy—1955–1956—that Buchanan paid attention to these economists. Here, Francesco Forte played a particularly important role. It did not only transform Buchanan’s conception of the public debt but also lead him to pay more attention to law, institutions and political phenomena.

Alain Loute | : Cet article tente de montrer que différents conflits et tensions mis au jour par les éthiques du care sont occultés par l’éthique ricoeurienne. Dans un premier temps, l’auteur prend ses distances avec les critiques adressées par Tronto, suivant lesquelles Ricoeur développerait une éthique abstraite et conceptuelle. Dans un second temps, il prend appui sur des travaux portant sur les chaînes de care, l’intersectionnalité et la division genrée du travail, afin de montrer que dans nos sociétés, le (...) concept de care est traversé par une tension fondamentale : il désigne tout à la fois une pratique normative et des rapports de domination. Cette tension semble difficilement appréhendable chez Ricoeur, car, entre les relations interpersonnelles et le point de vue des institutions, la perspective des relations intergroupes fait défaut. Par ailleurs, en ne précisant pas véritablement la forme que peut prendre la sagesse pratique sur le plan collectif, il ne permet pas vraiment de penser les conditions d’une politisation des enjeux du care. L’article se termine en soutenant que les éthiques du care, quant à elles, tentent de trouver des réponses à ces tensions par des actions proprement collectives : par exemple en ce qui a trait à la réorganisation du travail du soin et à la discussion publique des besoins. | : This article attempts to show that different conflicts and tensions revealed by the ethics of care are overshadowed by Ricoeur’s ethics. Firstly, the author distances himself from the criticism developed by Tronto, who claims that Ricoeur develops an abstract and conceptual ethics. Secondly, he references the literature on the “care chain,” “intersectionality,” and the gender division of labour care to show that, in our societies, the concept of care is fraught with a fundamental tension: it designates normative practices and domination. This tension seems hardly comprehensible in Ricoeur because, between interpersonal relationships and institutions, the level of inter-group relations is lacking in Ricoeur’s ethics. Furthermore, without actually specifying the form that practical wisdom can take at the collective level, it is not really possible to think through the conditions of politicizing the issues of care. The article ends by showing that the ethics of care, meanwhile, attempts to resolve these tensions through proper collective actions: reorganization of care work, public discussion of needs, etc. (shrink)

Nous nous attachons dans cet article aux derniers cours du philosophe qui font place à une thématique de l’autonomie, de la liberté avec les thèses sur le « souci de soi ». Nous discutons la possibilité de considérer la relation épimélétique comme une forme de relation pédagogique, et nous demandons pourquoi (...) et comment la question de la sexualité permet de réévaluer la question pédagogique, fait basculer la problématique de la répression et de la domination à celle de la formation du sujet. Nous revenons d’abord sur les discussions antérieures autour de l’hypothèse répressive (I). Puis nous envisageons la façon dont se met en place l’équation entre relation épimélétique, relation érotique et relation pédagogique dans Subjectivité et Vérité (II). Enfin, nous abordons la problématique du « souci de soi » dans L’herméneutique du sujet en relation au « souci des autres », à la question politique et aux institutions (III). Em seguida, visa-se o modo pelo qual se situa a equação entre relação epimeléica, relação erótica e relação pedagógica em Subjetividade e Verdade (II). In recent years the sociology of literature has developed on the basis of another formula: literature is part of the larger social order. It is not the “expression of society” but an integral part of it. The idea is simple, the implications are great. Literature as part of the social order goes beyond a study of the external social manifestations of literature, beyond the sociology of the book, author, and reader practiced, for example, by Robert Escarpit—a sociology which leads inevitably (...) to a positivist outlook.5 Nor can we be satisfied with a wholesale borrowing of sociological concepts that does no more than provide the tools for arguments in favor of one or another theory of literature.6 Whatever the interest of these theories , a sociology of literature becomes possible only when it includes the sociology of the theories elaborated on the subject itself. 5. Two opposite statements must be rejected with the same rigor. First (1) is that a few countries have identified themselves with modernity by their scientific, technical and economic achievement and that the rest of the world, which is lagging behind the ‘advanced countries’, must follow in their footsteps and imitate their example. The article first of all sets out the falsity of such a statement, because there is not one but many western paths of modernization, and indicates that it is (...) nothing but a colonialist ideology, which spread from European and American societies and cultures and destroyed all independent efforts of modernization in other countries, in particular China. The hegemony of the western capitalist model is more than challenged by other ways of modernization, for though the soviet model has failed, other countries are ‘emerging’ or have already emerged. Second (2) the opposite representation defends the idea of a complete multiculturalism including political regimes and human rights. It fights against the previous colonialist model and supports a total relativism. But this view makes impossible the communication between completely different countries and cultures and reciprocal fear leads to an extreme conflict between ‘civilizations’, such as S. Huntington has described. This view leads to the conclusion that war is inevitable if each civilization has a complete internal unity and a complete control on all its activities. But the world is not divided into various theocratic states: no single theocratic state commands the whole or the majority of Muslim population. The central problem remains real and difficult: how to combine unity and diversity, the difference between cultures and the capacity for them to communicate with each other? The most useful idea is to elaborate one general definition of modernity, as a culture which is based on universalistic principles. The western mode of modernization is not the only possible one; nor is it at all sure that the western process of separation of temporal and spiritual powers is the only possibility. We cannot assert that universalism must penetrate social life only through political institutions and citizenship. It is beyond any reasonable doubt that modernity, with its universalistic components, cannot be identified with only one type of social organization and cultural values. (shrink)

Les déplacements des Roms ne s'effectuent pas uniquement de l'Est à l'Ouest du continent, mais traduisent une reprise générale de la circulation des familles selon des mobiles principalement économiques. Les conséquences culturelles de ce phénomène sont inattendues. Displacement of Roma do not occur only in the East to the West of the continent, but reflect a general recovery in the movement of families into mobile mainly economic. The cultural consequences of this phenomenon are unexpected. If the logic of family networks both flexible and centripetal is not challenged by the exploration of new lands, the xenophobic discourse against Gypsies do not disappear and therefore restrict the role of smugglers culture that they fulfill traveling. Since the 1980s, two different paradigms have reshaped industrial societies: the Neoliberal paradigm and a Research and Innovation paradigm. Both have been conceptualized and translated into strong policies with massive economic and social consequences. They provide divergent responses to the environmental transition. The Neoliberal paradigm is based on economic models and geopolitical solutions. The Research and Innovation paradigm's goal is to manage knowledge differently in order to reorient the evolution of society. Since the mid-1990s, a version of the Research and (...) Innovation paradigm has led to the design of large-scale research and innovation policies. This book examines how these policies have evolved and how they can be extended and reformed to respond to present and future environmental constraints. It studies the transformation of the conception, organization and role of science and technology in the evolution of industrial societies and explores the future of these developments. The book offers three unique lines of enquiry. The first is to focus not specifically on economics, sociology, political science or history, but on knowledge creation from an institutional and reflexive point of view. The second is to establish a convergence between the British school of science and technology studies and the research trends opened by the work of Michel Foucault. Both introduced trans-disciplinary and policy-oriented research associating case studies, long-term perspectives and theory. The third is to consider climate change as the overwhelming challenge of our time. The book is an insightful guide for students, scholars and researchers across the humanities and social sciences, including philosophy, political science, law, economics, business and media. Les références à la pensée de Karl Popper, dans les ouvrages contemporains de didactique ou de pédagogie, sont rares et se bornent généralement au rappel convenu des thèses les plus connues de l'épistémologie faillibiliste. L'oeuvre poppérienne comporte pourtant de nombreux autres aspects, ordinairement négligés, par lesquels elle se rapporte de façon beaucoup plus directe et essentielle aux questions éducatives. L'intérêt de Popper pour ces dernières est manifeste dans les écrits de jeunesse, rédigés durant sa période de formation à l'Institut (...) pédagogique de Vienne dans les années 1920. Il se montre encore, quoique de façon plus souterraine, dans l'oeuvre de la maturité, à travers les nombreux développements que le philosophe consacre à l'analyse de la subjectivité et à la question de l'apprentissage. De là, le projet de ce livre. En prenant pour guide la double métaphore du "seau" (Bucket) et du "projecteur" (Searchlight), au moyen de laquelle Popper oppose la théorie erronée de "l'esprit-réceptacle" à sa propre conception de l'activité mentale, celui-ci se propose d'interroger l'oeuvre poppérienne dans son ensemble, les écrits de jeunesse comme les textes de la maturité, sous l'angle d'une théorie du sujet humain et de sa formation. Il s'agit par là, d'une part, de jeter un éclairage sur le lien trop souvent méconnu qui unit de l'intérieur la pensée de Popper aux préoccupations d'ordre psychologique et pédagogique ; d'autre part, de montrer en quoi la prise en compte des thèses poppériennes peut contribuer à renouveler en profondeur la réflexion contemporaine sur l'apprentissage et l'éducation. Depuis quelques décennies, des réflexions éthiques sont menées sur les problèmes posés par les nouveaux réseaux de communication et d’information, avec comme élément clé l’ordinateur comme moteur et cadre de la transformation contemporaine à cet égard. Comme nous le rappelons, il est habituel d’aborder ce vaste domaine par sous-chantiers, avec des chapitres spécifiques sur la vie privée, etc. ; mais du même coup, en fonction de la complexité des enjeux, il devient clair que c’est l’ensemble de notre perspective sur ces (...) questions qui doit être modifiée, on ne peut se contenter d’une approche encyclopédique y allant par secteurs successifs. Le but de l’article est de montrer en quoi le cadre développé par Elinor Ostrom (prix Nobel 2009 en économie), appelé Institutional Analysis and Development, est susceptible de nous fournir des outils pertinents pour traiter les questions d’éthique qui se posent à l’heure des réseaux, même si ce modèle a des limites que nous mentionnerons. Ce qui suppose de présenter cette approche en soulignant son secteur initial d’émergence, la gouvernance des ressources naturelles. (shrink)

La médiation nord-américaine s’est imposée comme modèle dans le monde occidental. Elle fut enseignée à l’origine à la Harvard School of law et au London Chartered Institute of arbitrators. Sans être exclusive, elle offre une méthode qui n’est nullement uniforme, mais variable suivant le contexte et les enjeux.

Les écrits de Fernand Deligny ont circulé entre plusieurs mains bien avant d’être publiés. Félix Guattari et Jean Oury l’ont accueilli à la clinique de La Borde de 1965 à 1967. En juillet 1967, Deligny quitte la clinique de La Borde pour s’installer dans la propriété de famille des Guattari à Gourdas dans les Cévennes. C’est ainsi que la tentative et non l’institution des Cévennes dirigée par Deligny commence. Il s’agit d’une tentative parce que Deligny refuse toute forme d’institutionnalisation. Plus (...) tard, Mannoni, Dolto et d’autres lui confieront des enfants. Il est indéniable que la conception de la cartographie delignienne a profondément marqué et influencé celle de Guattari et par voie de conséquence la lecture deleuzienne et guattarienne de la carte comme dispositif territorial. La place de Giambattista Vico (1668-1744) dans le siècle des Lumières, comme dans l'histoire des idées, est difficile à déterminer. Tenu à l'écart des courants dominants de son époque, il n'a été lu et étudié que bien après sa mort. Sa pensée n'a cessé depuis de faire l'objet d'interprétations diverses et contradictoires : certains la jugent tournée vers le passé, nourrie de l'humanisme grec et latin revivifié par le christianisme ; d'autres y voient la préfiguration des grandes visions modernes de (...) l'histoire. Son oeuvre, écrit Alain Pons, dépasse l'opposition entre Anciens et Modernes ; elle a l'ambition de fonder une science nouvelle, non pas du monde naturel mais du monde des hommes, sous la forme d'une étude des nations. Pour ce faire, le philosophe napolitain unit intimement deux savoirs distincts : une philosophie de l'esprit humain qu'il ne veut pas réduire à la pure raison, et une philologie qui explore le savoir historique accumulé depuis la plus lointaine antiquité. Cette lecture met en lumière la façon dont, selon Vico, naissent, vivent et peuvent mourir les nations, et comment se construisent chez elles les "choses humaines" - religions, langages, coutumes, lois, institutions politiques. Elle donne son relief à l'intuition fondamentale qui fait l'originalité du philosophe : c'est dans le temps de l'histoire et dans la vie des nations que l'homme accomplit son humanité. La Science nouvelle (1744) ouvre certaines voies dans lesquelles vont s'engager la philosophie moderne et les sciences humaines. Elle aide à comprendre les interrogations, les espoirs et les craintes que le destin des nations fait toujours naître. (shrink)

We propose adding a temporal dimension to stakeholder management theory, and assess the implications thereof for firm-level competitive advantage. We argue that a firm’s competitive advantage fundamentally depends on its capacity for stakeholder management related, transformational adaptation over time. Our new temporal stakeholder management approach builds upon insights from both the resource-based view (RBV) in strategic management and institutional theory. Stakeholder agendas and their relative salience to the firm evolve over time, a phenomenon well understood in the literature, and requiring (...) what we call level 1 adaptation. However, the dominant direction of stakeholder pressures can also change, namely, from supporting resource heterogeneity at the firm level to fostering industry homogeneity, and vice versa. When dominant stakeholder pressures shift from supporting heterogeneity towards stimulating homogeneity in industry, the firm must engage in level 2 or transformational adaptation. Stakeholders typically provide valuable resources to the firm in an early stage . Without these resources, which foster heterogeneity (in line with RBV thinking), the firm would not exist. At a later stage , stakeholders also contribute to inter-firm homogeneity via isomorphism pressures (in line with institutional theory thinking). Adding a temporal dimension to stakeholder management theory has far reaching implications for this theory’s practical relevance to senior level management in business. (shrink)

Is democracy an inevitable hostage of capitalism, or can it reinvent itself to meet the challenge of globalization? In an exclusive, (...) previously unpublished dialogue, Alain Badiou, a key figure of the radical left and a leading advocate of the communist idea, and Marcel Gauchet, a major exponent of anti-totalitarianism and a champion of liberal democracy, confront one another. Two opposite statements must be rejected with the same rigor. First (1) is that a few countries have identified themselves with modernity by their scientific, technical and economic achievement and that the rest of the world, which is lagging behind the ‘advanced countries’, must follow in their footsteps and imitate their example. The article first of all sets out the falsity of such a statement, because there is not one but many western paths of modernization, and indicates that it is (...) nothing but a colonialist ideology, which spread from European and American societies and cultures and destroyed all independent efforts of modernization in other countries, in particular China. The hegemony of the western capitalist model is more than challenged by other ways of modernization, for though the soviet model has failed, other countries are ‘emerging’ or have already emerged. Second (2) the opposite representation defends the idea of a complete multiculturalism including political regimes and human rights. It fights against the previous colonialist model and supports a total relativism. But this view makes impossible the communication between completely different countries and cultures and reciprocal fear leads to an extreme conflict between ‘civilizations’, such as S. Huntington has described. This view leads to the conclusion that war is inevitable if each civilization has a complete internal unity and a complete control on all its activities. But the world is not divided into various theocratic states: no single theocratic state commands the whole or the majority of Muslim population. The central problem remains real and difficult: how to combine unity and diversity, the difference between cultures and the capacity for them to communicate with each other? The most useful idea is to elaborate one general definition of modernity, as a culture which is based on universalistic principles. The western mode of modernization is not the only possible one; nor is it at all sure that the western process of separation of temporal and spiritual powers is the only possibility. We cannot assert that universalism must penetrate social life only through political institutions and citizenship. It is beyond any reasonable doubt that modernity, with its universalistic components, cannot be identified with only one type of social organization and cultural values. (shrink)

The unity of the sociology now termed classical was not that of a theory or discourse about social organization, social actors or the ways in which social wholes change; it was the study of society defined as a set of interdependent mechanisms ensuring the integration or combination of mutually opposed elements: the individualism of the actors and the internalization of institutional norms in the service of collective integration. The primary historical reason for the decline of this classical sociology is that (...) its most stable foundation, the opposition between haves and have-nots along with that between men and women, was slowly undermined by a series of great social movements based at once on a quest for liberation and on the idea of equality It was the crisis in the earlier representations of social life which provoked, beyond the decline of the earlier sociology, the creation of a new intellectual space in which a constellation of forms of thought arose which constitute today what may be called contemporary sociology, and which is a sociology of ultramodernity. It is no longer in terms of objective situations or evaluations, economic or otherwise, that the social actor is explained. It is the cultural actor, his image of himself and his demands that govern a rapidly increasing part of social life. Th roughout the world and in all sectors of social life, actors are making a comeback. Reversal of the conception and role of institutions leads us to see them as instruments for the defence of individuals against norms. Today’s sociology is better explained by its future than by its past. The new sociology is already constituted as a set of questions and sensibilities, more widespread across the planet than any other previous form of social thought. But this de facto existence of the new sociology is not – not yet – accompanied by suffi cient self-refl ection. (shrink)

This paper discusses how the general and abstract concept of legitimacy applies to international institutions, using the United Nations Security Council as an example. We argue that the evaluation of the Security Council’s legitimacy requires considering three significant and interrelated aspects: its purpose, competences, and procedural standards. We consider two possible interpretations of the Security Council’s purpose: on the one hand, maintaining peace and security, and, on the other, ensuring broader respect for human rights. Both of these purposes are minimally (...) morally acceptable for legitimacy. Second, we distinguish between three different competences of the UNSC: 1) the decision-making competence, 2) the quasi-legislative competence, and 3) the referral competence. On this basis, we argue that different procedural standards are required to legitimise these competences, which leads to a more differentiated understanding of the Security Council’s legitimacy. While maintaining that the membership structure of the Council is a severe problem for its legitimacy, we suggest other procedural standards that can help to improve its overall legitimacy, which include broad transparency, deliberation, and the revisability of the very terms of accountability themselves. In order to address to the relation between philosophy and mathematics it is first necessary to distinguish the grand style and the little style. The little style painstakingly constructs mathematics as the object for philosophical scrutiny. It is called the little style for a precise reason, because it assigns mathematics to the subservient role of that which supports the definition and perpetuation of a philosophical specialisation. This specialisation is called the ‘philosophy of mathematics’, where the ‘of’ is objective. The philosophy (...) of mathematics can in turn be inscribed under the area of specialisation that supports the name ‘epistemology and history of science’, an area to which corresponds a specialised bureaucracy in the academic authorities and committees whose role it is to manage the personnel of researchers and teachers. But in philosophy, specialisation is invariably the means by which the little style insinuates itself. In Lacan terms, this occurs through the collapse of the discourse of the Master, which is rooted in the signifier of the same name, the S1 that gives rise to a signifying chain, onto the discourse of the University, that perpetual commentary which adequately represents the second moment of all speech, that is, the S2 which only exists by making the Master disappear under the commentary which exhausts it. The little style of the philosophy of mathematics, and of its epistemology, strives for such a disappearance of the ontological sovereignty of mathematics, its instituting aristocratism, its unrivalled mastery, by confining its dramatic and almost incomprehensible existence to a generally dusty compartment of academic specialisation. The purpose of this paper is to discuss the methodological foundations of the law and economics movement, with a special emphasis on the role and place of individuals in law and economics. Reviewing the works of the main contributors—the founders, indeed—to the law and economics movement, we show that all of them considered that the analysis of legal phenomena had to start from individual behavior, even as these very behaviors were embedded, to various degrees, though not determined, in legal and (...) institutional frameworks. They all use social, systemic, institutional, and anti-reductionist individualistic methodology. This is not inconsistent or contradictory. Indeed, methodological individualism does not imply to conceive human beings as (isolated) atoms living as if they were suspended in a social vacuum. (shrink)

This volume surveys 150 law books of fundamental importance in the history of Western legal literature and culture. The entries are organized in three sections: the first dealing with the transitional period of fifteenth-century editions of medieval authorities, the second spanning the early modern period from the sixteenth to the eighteenth century, and the third focusing on the nineteenth and twentieth centuries. The contributors are scholars from all over the world. Each 'old book' is analyzed by a recognized specialist in (...) the specific field of interest. Individual entries give a short biography of the author and discuss the significance of the works in the time and setting of their publication, and in their broader influence on the development of law worldwide. Introductory essays explore the development of Western legal traditions, especially the influence of the English common law, and of Roman and canon law on legal writers, and the borrowings and interaction between them. The book goes beyond the study of institutions and traditions of individual countries to chart a broader perspective on the transmission of legal concepts across legal, political, and geographical boundaries. Examining the branches of this genealogical tree of books makes clear their pervasive influence on modern legal systems, including attempts at rationalizing custom or creating new hybrid systems by transplanting Western legal concepts into other jurisdictions.
