Atheism is a familiar kind of skepticism about religion. Moral error theory is an analogous kind of skepticism about morality, though less well known outside academic circles. Both kinds of skeptic face a "what next?" question: If we have decided that the subject matter (religion/morality) is mistaken, then what should we do with this way of talking and thinking? The natural assumption is that we should abolish the mistaken topic, just as we previously eliminated talk of, say, bodily humors and (...) unicorns. The fictionalist, however, offers a less obvious recommendation. According to the fictionalist, engaging in the topic in question provides pragmatic benefits that do not depend on its truth-in a way roughly analogous to engaging with a novel or a movie. The religious fictionalist maintains that even if we were atheists, we should carry on talking, thinking, and acting as if religion were true. The moral fictionalist maintains a similar view regarding moral talk, thought, and action. Both forms of fictionalism face serious challenges. Some challenges can be levelled at either form of fictionalism (or at any form of fictionalism), whereas others are problems unique to moral fictionalism or to religious fictionalism. There are important questions to be asked about the relationship between these two kinds of fictionalism. Could moral fictionalism be plausible even if religious fictionalism is not (or vice versa)? Background: Patients today interact with physicians, physician groups, and health plans, each of which may follow distinct ethical guidelines.Method: We systematically compared physician codes of ethics with ethics policies at physician group practices and health plans, using the 1998–99 policies of 38 organisations—18 medical associations , nine physician group practices , and 12 health plans —selected using random and stratified purposive sampling. A clinician and a social scientist independently abstracted each document, using a 397-item health care ethics taxonomy; a reconciled (...) abstraction form was used for analysis. This study focuses on ethics policies regarding professional obligation towards patients, resource allocation, and care for the vulnerable in society.Results: A majority in all three groups mention “fiduciary obligations” of one sort or another, but associations generally address physician/patient relations but not health plan obligations, while plans rarely endorse physicians’ obligations of advocacy, beneficence, and non-maleficence. Except for occasional mentions of cost effectiveness or efficiency, ethical considerations in resource allocation rarely arise in the ethics policies of all three organisational types. Very few associations, groups, or plans specifically endorse obligations to vulnerable populations.Conclusions: With some important exceptions, we found that the ethics policies of associations, groups, and plans are narrowly focused and often ignore important ethical concerns for society, such as resource allocation and care for vulnerable populations. More collaborative work is needed to build integrated sets of ethical standards that address the aims and responsibilities of the major stakeholders in health care delivery. (shrink)

In his contribution to this volume, Paul Bloomfield analyzes and attempts to answer the question “Why is it bad to be bad?” I too will use this question as my point of departure; in particular I want to approach the matter from the perspective of a moral error theorist. This discussion will preface one of the principal topics of this paper: the relationship between morality and self-interest. Again, my main goal is to clarify what the moral error theorist might say (...) on this subject. The recent Common Rule revision process took almost a decade and the resulting changes are fairly modest, particularly when compared to the ambitious ideas proposed in the advance notice of proposed rulemaking and notice of proposed rulemaking. Furthermore, the revision process did not even attempt to tackle any of the Common Rule subparts pertaining to vulnerable populations where commentators think the rules unduly restrict important research. We believe that this was a missed opportunity to make desirable changes, and that given (...) the usual process the next opportunity to revisit the Common Rule is unacceptably remote. In this article, we argue that the Common Rule should be regularly reassessed, with a mechanism for making substantive changes. Drawing on lessons learned from the recent revision process, we make recommendations about ways to structure future attempts to maximize the ability to make timely and necessary changes. (shrink)

Much new global genetic research employs whole genome sequencing, which provides researchers with large amounts of data. The quantity of data has led to the generation and discovery of more incidental or secondary findings and to vigorous theoretical discussions about the ethical obligations that follow from these incidental findings. After a decade of debate in the genetic research community, there is a growing consensus that researchers should, at the very least, offer to return incidental findings that provide high‐impact, medically relevant (...) information, when it is not unduly burdensome to the research enterprise to do so. Much as genetic research has been limited to U.S. and European settings, the incidental findings debate has primarily focused on research conducted in high‐income countries. In a 2015 paper, Alberto Ortiz‐Osorno, Linda Ehler, and Judith Brooks note salient differences between the circumstances of research participants in low‐ and high‐resource settings that alter the analysis of when and why incidental findings should be offered to research participants. In this article, we expand on their analysis and present a framework for thinking about how investigators’ obligations to return genomic data might change in low‐resource settings, particularly in settings where participants do not have access to the medical care needed to treat, assess, or monitor incidental findings that are actionable in settings with plentiful resources. Evidence-based practice in education involves basing decisions about what to do on evidence about the relative effectiveness of available interventions (e.g. programmes, products, practices). This article considers two influential critiques of evidence-based education (EBE) pertaining to its treatment of values. The ‘general critique’ condemns EBE for excluding values from decisions about what to do in education. The ‘specific critique’ condemns EBE for relying on a deterministic view of causality in education which disregards the complex, value-laden nature of educational contexts. I (...) argue that virtually all versions of EBE escape the general critique, including the dominant intervention-centred approach that relies on experimental research to discover ‘what works’, because the predictions EBE aims to support are only one premise in a broader normative argument. Further, intervention-centred EBE can avoid much of the specific values-based critique because it is consistent with a probabilistic, rather than deterministic, understanding of causality. However, I argue that only a context-centred approach to EBE that relies on evidence about the specific target setting from local sources in addition to evidence from theory and mixed methods research can fully address the specific critique by accommodating critics’ descriptive claims about the nature of educational contexts. In "A Serpentine Gesture": John Ashbery's Poetry and Phenomenology Elisabeth W. Joyce examines John Ashbery's poetry through the lens of Maurice Merleau-Ponty's conception of phenomenology. For Merleau-Ponty, perception is a process through which people reach outside of themselves for sensory information, map that experiential information against what they have previously encountered and what is culturally inculcated in them, and articulate shifts in their internal repositories through encounters with new material. Joyce argues that this process reflects Ashbery's classic statement (...) of poetry being the "experience of experience." Through incisive close readings of Ashbery's poems, Joyce examines how he explores this process of continual reverberation between what is sensed and what is considered about that sensation and, ultimately, how he renders these perceptions into the 'serpentine gesture' of language. Respect for patient autonomy has served as the dominant ethical principle of genetic counselling, but as we move into a genomic era, it is time to actively re-examine the role that this principle plays in genetic counselling practice. In this paper, we argue that the field of genetic counselling should move away from its emphasis on patient autonomy and toward the incorporation of a more balanced set of principles that allows counsellors to offer clear guidance about how best to obtain (...) or use genetic information. We begin with a brief history of how respect for patient autonomy gained such emphasis in the field and how it has taken on various manifestations over time, including the problematic concept of nondirectiveness. After acknowledging the field's preliminary move away from nondirectiveness, we turn to a series of arguments about why the continued dominance of patient autonomy has become untenable given the arrival of the genomic era. To conclude, we describe how a more complete set of bioethical principles can be adapted and used by genetic counsellors to strengthen their practice without undermining patient autonomy. (shrink)

More than a decade of exacting scientific research involving paleontological fragments and ancient DNA has lately produced a series of pronouncements about a purportedly novel population of archaic hominins dubbed “the Denisova.” The science involved in these matters is both technically stunning and, socially, at times a bit reckless. Here I discuss the responsibilities which scientists incur when they make inductively risky pronouncements about the different relative contributions by Denisovans to genomes of members of apparent subpopulations of current humans. This (...) science is sensational: it is science which empirically speculates, to the public delight’s and entertainment, about scintillating topics such as when humans evolved, where we came from, and who else we were having sex with during our early hominin history. An initial characterization of sensational science emerges from my discussion of the case, as well as a diagnosis of an interactive phenomenon termed amplified inductive risk. (shrink)

Different types of consent are used to obtain human biospecimens for future research. This variation has resulted in confusion regarding what research is permitted, inadvertent constraints on future research, and research proceeding without consent. The National Institutes of Health Clinical Center's Department of Bioethics held a workshop to consider the ethical acceptability of addressing these concerns by using broad consent for future research on stored biospecimens. Multiple bioethics scholars, who have written on these issues, discussed the reasons for consent, the (...) range of consent strategies, and gaps in our understanding, and concluded with a proposal for broad initial consent coupled with oversight and, when feasible, ongoing provision of information to donors. This article describes areas of agreement and areas that need more research and dialogue. There is a perennial philosophical dream of a certain natural order for the natural kinds. The name of this dream is ‘the hierarchy requirement’. According to this postulate, proper natural kinds form a taxonomy which is both unique and traditional. Here I demonstrate that complex scientific objects exist: objects which generate different systems of scientific classification, produce myriad legitimate alternatives amongst the nonetheless still natural kinds, and make the hierarchical dream impossible to realize, except at absurdly great cost. Philosophical hopes (...) for a certain order in nature cannot be fulfilled. Natural kinds crosscut one another, ubiquitously so, and this crosscutting spells the end of the hierarchical dream. Although almost completely ignored, Aquinas’s account of persons with severe intellectual disabilities is key to his understanding of human persons and their salvation. Aquinas extensively addresses questions of human impairment, and for Aquinas physical and mental impairment are not nearly as important as moral or spiritual impairment. Contrary to those who focus on Aquinas’s account of rationality and suppose he thinks that a person must exercise rationality in order to be moral and in the image of God, Aquinas’s view is (...) that persons with severe mental impairments have a distinct spiritual advantage, due to the impeccability of the gift of wisdom given them in their baptism. In the contemporary Thomist literature on ethics, there is far more discussion—and a far more developed discussion—of the nature and role of a virtue-habitus than a gift-habitus. Why might there be so little discussion (...) of the gifts and their distinctive habitus? Is it because Aquinas devotes many more questions to the virtues than to the gifts? Is it because the majority of self-professed Thomist ethicists have not been taught the gifts, and are either unaware or have merely a notional awareness that the gifts have a principle of action distinct from and superior to that of the virtues?1 Regardless of the reason, this paper seeks to mitigate the current paucity of analysis of the gifts and the gift-habitus.This paper will discuss Aquinas's doctrine of the gifts of the Holy Spirit from a resolutely gift-centered perspective. I do so because discussions of the gifts often presume a virtue-centered perspective. That is, treatments of the gifts typically interpret what Aquinas says about the gifts through the lens of a pre-existing virtue framework, the gifts then being made to fit into that pre-existing framework. I will argue that we see this not only in interpretations of Aquinas on the gifts, but also in English translations of the Summa theologiae [ST] on the question of the gifts. [End Page 47]As a result, in contemporary scholarship on Aquinas's ethics, the virtues typically receive extended treatment, whereas the gifts of the Holy Spirit receive no treatment at all. And when the gifts are addressed, their treatment is brief, with the main point being that the gifts provide assistance to the virtues, like a spiritual butler. In the best-case scenario, the gifts are like Jeeves to the virtues' Bertie—undoubtedly wiser, but rarely listened to.The paper is divided into four sections. The first section compares and contrasts a gift-habitus and a vinue-habitus. The second section focuses on Aquinas's notion of instinctus. The instinct of the Holy Spirit (divine instinct) is the principle of motion Aquinas associates with the gifts of the Holy Spirit (ST I-II, q. 68, aa. 1–2). I argue that—contrary to the judgment of most commentators—instinctus is a highly appropriate term to describe the character of the work of the Holy Spirit. In this section I also show how Aquinas's doctrine of instinctus has been made "invisible" in part by various translations of the ST, including the translation of Fr. Shapcote.2In the third section, I analyze Aquinas' argument that the gifts are more perfective of human beings than the virtues (ST I-II, q. 68, a. 8). This analysis also constitutes a "case study" of the ways in which Shapcote's translation (the dominant English translation for the last hundred years) contributes to misunderstandings of Aquinas's views on the relationship between the gifts and the virtues. In comparing and contrasting the virtues and gifts, an original part of my argument is my claim that, while charity sometimes operates from a virtue-habitus, at other times it operates according to a gift-habitus. Commentators have failed to adequately account for the fact that truly perfect (simpliciter) charity cannot be attained solely by the operations of virtue.
