Fetal pain has long been a contentious issue, in large part because fetal pain is often cited as a reason to restrict access to termination of pregnancy or abortion. We have divergent views regarding the morality of abortion, but have come together to address the evidence for fetal pain. Most reports on the possibility of fetal pain have focused on developmental neuroscience. Reports often suggest that the cortex and intact thalamocortical tracts are necessary for pain experience. Given that the cortex (...) only becomes functional and the tracts only develop after 24 weeks, many reports rule out fetal pain until the final trimester. Here, more recent evidence calling into question the necessity of the cortex for pain and demonstrating functional thalamic connectivity into the subplate is used to argue that the neuroscience cannot definitively rule out fetal pain before 24 weeks. We consider the possibility that the mere experience of pain, without the capacity for self reflection, is morally significant. We believe that fetal pain does not have to be equivalent to a mature adult human experience to matter morally, and so fetal pain might be considered as part of a humane approach to abortion. The question of whether a fetus can experience pain is an immense challenge. The issue demands consideration of the physical and psychological basis of being and the relation between the two. At the center of this debate is the question of how it is that we are conscious, a question that has inspired the writing of some of our most brilliant contemporary philosophers and scientists, with one commentary suggesting surrender. In my earlier review I attempted to draw together the various (...) strands of thinking that had attacked the question of fetal pain and relate them back to the bigger question of consciousness. In their vituperative response, Benatar and Benatar bite off my finger before looking to where I am pointing. I will examine each of their criticisms and attempt to redirect the readers' interest towards examining the subjectivity of pain and the mediating links between physiology and experience. (shrink)

This paper examines the question of whether a fetus can feel pain. The question is divided into four sub questions: What is pain? What is the neurology of pain processing? What is the fetus? Are there good reasons for holding that fetuses feel pain? Pain is suggested to be a multi‐dimensional phenomenon drawing on emotional and sensory processes – a consequence of a gradual development involving a number of noxious events rather than an automatic consequence of injury or disease. The (...) non‐automaticity of pain is emphasised in the discussion of pain neurology that defies explanations based on a specialised neuronal ‘pain‐centre’. The development of the fetus is considered with respect to developmental neurobiology, behavioural and neurological responses to stimulation, and hormonal and neurochemical responses to noxious stimulation. While acknowledging that the development of the fetus is complex, especially after 26 weeks gestation, considerable development is still to occur, even after birth. The fetal pain literature is criticised for tending to exaggerate fetal development. Finally, the difficulty of explaining the subjectivity of pain in materialist terms is discussed. Pain is suggested to arise with development of the necessary neurological, cognitive and emotional structures. Pain experience is placed at approximately 12 months of age, though this is within the context of a continuum of awareness rather than a straight ‘on‐off’ switch. The major moral implication of this stance is to place the burden of proof for analgesic use onto clinical measures, rather than relying upon the, so far, poorly supported assumption of pain awareness. Discussions of socioeconomic liability and compensation must necessarily start from an understanding of the socioeconomic, legal, and scientific basis for identifying, assessing, managing, and apportioning blame for hazards related to innovations. Public discussions about the nature of the liability challenge related to genetically modified (GM) crops and other modified organisms have focused less on direct, traditional health, public safety, technical, or environmental failures (e.g., innovations that generate hazards directly for users or indirectly to bystanders) and more on socioeconomic concerns, such (...) as comingled product that offends product quality standards. This article examines the theoretical and legal underpinnings of the current risk analysis framework used in most Organization for Economic Cooperation and Development countries and uses it to assess two areas of significant controversy—the release of herbicide-tolerant canola and flax varieties in Western Canada. The article offers lessons for the management of liabilities arising from the introduction of GM crops. (shrink)

There is a striking parallel between w v o quine's 'indeterminacy of translation' thesis and k o apel's 'indeterminacy of textual interpretation thesis. both arguments are based on what is essentially the same 'sceptical dilemma'. the key to resolving these 'hermeneutic problems' is to recognize that such a 'sceptical problem' is unintelligible. this is precisely the point of wittgenstein's discussions of rule-following. many have misunderstood this, however, for they have misconstrued what was intended to be read as a "reductio ad (...) absurdum" establishing the "unintelligibility" of the dilemma, as a sceptical attack on the possibility of our ever solving the problem. In his latest contribution to the application of Darwinian evolutionary thinking to the social sciences, W. G. Runciman conceives of human behavior as resulting from three levels of selection - biological, cultural, and social. These give rise, respectively, to evoked, acquired, and imposed patterns of behavior. The biological level is hardly controversial, but to draw a distinction between separate cultural and social selective processes is more problematic. Runciman takes memes to be the variants competitively selected at the cultural level and (...) the practices constituting rule-governed roles to be the variants competitively selected at the social level - thus preserving separate spheres of research for anthropology and sociology. It is not clear, however, what drives cultural and social evolution. Nor are the three levels theoretically well integrated. The book's strength lies in the numerous examples provided of how the application of selectionist theory illuminates and enriches sociological and historical explanations and contributes to the construction of historical narrative. In lieu of an abstract, here is a brief excerpt of the content:274 HISTORY OF PHILOSOPHY poisoning, spying, etc., which would render postwar mutual confidence impossible, shall not be countenanced. It is mainly with an eye to these preliminary articles that Professor Wilhelm Miiller argues for Kant's relevance to contemporary political problems. Miiller begins by drawing an analogy between the Peace of Basle (1795) and the Treaty of Versailles: in both instances, it is claimed, secret reservations at the treaty table, (...) the identification of defeated nation with "guilty" nation, and the deprivation of an entire "guiltless" people of "the most primitive right to live" helped lay the foundations for future wars. Miiller sees in the willful dispersion, through motives of revenge and greed, of the possessions of conquered nations after both World Wars a "reversion to the wildest barbarism." He defends Kant's stricture against standing armies as being "simply and logically irrefutable" in spite of Kant's toleration--understandable in 1795--of limited and voluntary militias adequate for national defense. He infers from Kant's warning against national economic dependency the urgent need to exclude international capitalism from world politics. He suggests that Kant's principle of non-interference in the internal affairs of nations has been violated in the splitting of East from West Germany. And he insinuates that the present form of government in the U.S. is democratic and republican only in name, being in actuality a capitalist oligarchy whose two-party system tends to degenerate into a one-party system. Professor Miiller is entitled to his views. The reader, however, is entitled to a more objective exposition of Kant's essay and perhaps even to hope for a more critical and searching appraisal of Kant's doctrines. One opportunity for the latter surely offers itself in regard to Kant's analogy between personal and international morality. The analogy might conceivably break down over the difficulty of assigning collective moral and legal responsibility. If, as Kant maintains, a state is a moral person, it should follow that it and not merely its constituent members taken singly has moral responsibility for what it undertakes. Leaving aside the question of whether or not Kant thought through the implications of his premise, it is clear that Professor Miiller has not done so. Whereas he considers atrocious the branding of the German people as guilty of international crime in either World War, he allows himself the judgment that the "Christian" people of Europe and America were guilty of mass-murder on both occasions. The inconsistency is evident. Left unexamined and even unmentioned are the following: Kant's well-known ethical principles--the concept of practical reason, the phenomenal-noumenal duality, the notion of design in nature, the doctrine of the Categorical Imperative binding on any rational will--upon which he explicitly grounds Perpetual Peace; his efforts to refute the notion of theoretical conflict between morality and politics; his misleading use of the language of the social contract theorists throughout the essay; his proposal, anticipatory of later British philosophers, that the principle of publicity is a necessary if not sufficient condition of morally proper legislation. In lieu of an abstract, here is a brief excerpt of the content:HUME'S THEORY OF IMAGINATION* Historians of philosophy seem increasingly to agree with the view that David Hume is the greatest philosopher ever to have written in English. This high esteem of the Scottish empiricist, however, is a phenomenon of the last decades. As late as 1925 Charles W. Hendel could write "that Hume is no longer a living figure." And Stuart Hampshire reports that in the Oxford of (...) the Thirties the results of Humean philosophizing were regarded as "extravagances of 2 scepticism which no one could seriously accept." A cursory glance at the Hume bibliography edited by Roland Hall demonstrates that it has become standard practice in the English-speaking world to seek an understanding of Hume's arguments when analysing philosophical problems. Critical literature nevertheless continues to neglect the majority of his arguments. It is sufficient, I think, to mention Hume's remarks on space and time, his theory of emotions, his inquiries into the problem of justice, his economic writings and those on the psychology of roliqion. Dut 3 even in the frequently quoted passages of the Treatise Hume's central notion is not, in my opinion, at the heart of the analysis. Here I refer to Hume's remarks on the phenomenon of imagination (fancy). Although he mentions this curious faculty of our cognition on almost every page, there are only a few sporadic attempts at an interpretation of this "supreme Humean faculty." This may be due to the fact that until quite recently the 'problem of imagination' has hardly even belonged to the marginal topics of modern philosophy. This paper therefore attempts to demonstrate not only that Hume dealt with the phenomenon of imagination, but also that an analysis of this concept is of paramount significance for the understanding of his entire philosophy. In the first three sections three different faculties or functions of the imagination will be distinguished. Not only the artist's - 91 92. works, but also the insights of the scientist and the illusions of metaphysicians are, according to Hume, decisively based on this very cognitive faculty. Section 4 contains a brief discussion of the sceptical arguments of the Treatise, particularly of the Humean analysis of causation. Their impact on Hume's reflections on the problem of imagination is the topic of Section 5. I hope to prove that in the Enquiry Hume interprets these sceptical arguments differently than in the Treatise. While in his early work he feels himself exposed to Pyrrhonian doubts, he assumes the position of an 'academic sceptic' in the Enquiry. The concluding section eventually tries to determine which motives may have been decisive for Hume's change of opinion. I shall defend the thesis that in his late work Hume developed an 'ethics of belief on the basis of natural beliefs, in which the artistic capacity of the imagination assumes a decisive role in justifying philosophical and scientific propositions. 1. The Metaphysical Faculty of the Imagination In the Introduction to the Treatise Hume describes his endeavour as developing a propaedeutic basic science which should provide a better understanding of all products of the human mind (science, mathematics, metaphysics, ethics, aesthetics, politics). In the Abstract he calls his early work "a system of the sciences" (?7). Besides this empirical interest Hume saw the importance of justifying the choice of method, i.e. to extoll the experimental procedure as the only rational one. Metaphysical approaches are interpreted as products of a blind imagination. Beginning with the Introduction to the Treatise it has been a constant motive of Hume's philosophy to constrain metaphysics in order to make way for science. In the sections Of the effects of other relations and other habite (T106-117), Of unphilosophiaal probability 93. (T143-155), Of scepticism with regard to the senses (T187218 ), Of the antient philosophy (T219-225) Hume specifies those beliefs which, in his opinion, are based on figments of our imagination. Finding an appropriate place for STS within the American science and engineering curriculum has never been easy. Convincing science, engineering, and medical students, and their professors, to pay serious attention to the broader context of their respective professions seems to require a sustained dialogue across conventional disciplinary boundaries. Otherwise, STS ends up talking mostly to itself and its critics rather than to its most important audience, students (at all levels) and the general public (especially museum visitors). This essay considers a (...) number of historical and present-day examples to argue that the founding vision of STS as a collaborative enterprise still offers some valuable lessons about how best to reach that audience. In nineteenth-century Europe …. [w]ith rare exceptions liberals approved of colonialism and provided it with a legitimizing ideology …. Liberalism became missionary, ethnocentric, and narrow, dismissing non-liberal ways of life and thought as primitive and in need of the liberal civilizing mission.This is the judgement passed by Professor Bhikhu Parekh in his 1994 essay “Decolonizing Liberalism.” His deference to John Stuart Mill is shown in his making Mill not one of the exceptions, but rather the central object of attack. It would seem indeed that if the charges can be made good against Mill they will hold against nineteenth-century liberalism in general, and perhaps in some degree against twenty-first-century liberalism.Simple piety moves me to offer some defence of Mill's own good judgement, particularly in relation to India. But, in dealing with a phenomenon like liberalism, we need always to maintain a distinction which tends to blur. Doctrines and assertions are one thing. There is a touch of foolhardiness in the attempts to establish a precise identification for the great majority of birds mentioned by the authors of classical antiquity. Only a small minority of the ancient references and descriptions contains features which are indisputably diagnostic, while a probably not much bigger minority of the Mediterranean avifauna possesses characteristics of appearance, behaviour, or voice that would have enabled an ordinary Greek or Roman immediately to distinguish a member of one species from absolutely all (...) others, using the sole aids of his eyes, ears, and the largely inaccurate medley of lore handed down from one generation to the next. Thus any modern attempt to pin down the identity of this or that bird in an ancient author is fraught with many dangers and difficulties which must be recognized at the outset. (shrink)

Although occasionally there may be certain imperfections with these old texts, we feel they deserve to be made available for future generations to enjoy.

Since its publication in 1965, Brian Barry's seminal work has occupied an important role in the revival of Anglo-American political philosophy. A number of ideas and terms in it have become part of the standard vocabulary, such as the distinction between "ideal-regarding" and "want-regarding" principles and the division of principles into aggregative and distributive. The book provided the first precise analysis of the concept of political values having trade-off relations and its analysis of the notion of the public interest has (...) also been significant.
