The exchange of goods and services between individuals is often formalised by a contract in which the parties establish norms to define what is expected of each one. Norms use deontic statements of obligation, prohibition, and permission, which may be in conflict. The task of manually detecting norm conflicts can be time–consuming and error-prone since contracts can be vast and complex. To automate such tasks, we develop an approach to identify potential conflicts between norms. We show the effectiveness of our (...) approach and its individual components empirically using two publicly available corpora, and contribute with a new annotated test corpus for norm conflict identification. This article intends to follow the path of building the notion of object in relation to the démarche Lacanian, as well as locate elements of rapprochement with Winnicott's transitional object. For accomplish our purpose, we begin with the object definition as proposed by Freud - (1) as the correlate of drive; (2) as the correlate of love and (3) in relation to the subject - and indicates the Lacanian option of emphasize the dimension of language in a reading that focuses (...) on Freud's theory and technique as a whole. In this context, Winnicott arises as an author that, proposing the concept of transitional object, allows Lacan's presentation of the distinction between the symbolic and imaginary records in relation to concepts of desire, demand and need while enabling the construction of a proper concept of object. One can consider that, in his formulations, Lacan does criticize the post-freudians for producing a deviation of the technique and doctrine of Freud in disregarding the subject's speech, favoring a practice of interpreting resistance. Winnicott is then greeted as a distinguished author, a post-Freudian psychoanalyst post that doesn't deviates from freudian's precepts and takes the clinic as its main support. The theoretical relations of approximation and distanciation between Lacan and Winnicott, allow us, in the body of this article, to problematize the bound between the concepts of object a and transitional object. ABSTRACT: In the 18th century, Kant evaluated that his historical period was not a time of enlightenment, but rather minority, because of man’s inability to use his own understanding. Adorno updated this problem, interpreting the minority in our presente in terms of loss of experience. Men are no longer apt to experience, because the technical and economic apparatus prevents the clarification and awareness of reality. From this diagnosis, The aim of this article is to investigate Adorno’s educational thought in its (...) possibilities of emancipation. In our point of view, the role of education, in the thoughts of the Frankfurtian, is to recover the critical autonomy of individuals, through dialectical thinking, to rebuild the damaged experience. This paper aims to show that by confronting the ethical alternatives proposed by Nietzsche and MacIntyre as resulting of their critical analyses of the modern moral condition respectively done in Genealogy of the Morals and After Virtue , we can find shared theoretical presumptions that point to those alternatives as convergent in many cases and not simply as excluding each other, even in a opposed direction to the MacIntyre’s point of view concerning that issue.

The paper presents different clustering approaches in legal judgments from the Special Civil Court located at the Federal University of Santa Catarina. The subject is Consumer Law, specifically cases in which consumers claim moral and material compensation from airlines for service failures. To identify patterns from the dataset, we apply four types of clustering algorithms: Hierarchical and Lingo, K-means and Affinity Propagation. We evaluate the results based on the following criteria: entropy and purity; algorithm's ability in providing labels; legal expert’s (...) evaluation; and experimental complexity. The results demonstrate that the most advantageous approach is Hierarchical Clustering, since it has the best entropy and purity numbers, as well as the least difficulty for the expert to analyze the clusters, and the least experimental complexity. The main contribution of the paper is to show the advantages and disadvantages of each approach, especially to identify labels in unstructured and non-indexed legal texts. (shrink)

We aimed to characterize the age of onset of training, age at menarche, menstrual periodicity, and performance perception during the menstrual cycle and examined the impact of these reproductive variables on body composition, morphology, and body weight satisfaction in Brazilian elite futsal players. The study consisted of 115 female Brazilian elite futsal players from the top national teams. Data were collected during the twentieth Women’s Brazil Futsal Cup. Players were interviewed and self-reported their age of onset of training, age at (...) menarche, menstrual periodicity, and the menstrual period, where they performed best. We also asked for what they considered to be their ideal body weight as well as information related to their training. Subsequently, anthropometric measurements were performed to estimate the body composition and determine morphological characteristics. Fifty-nine players were postmenarche-trained and 52 were premenarche-trained. Eighteen, 65, and 28 were classified as early, normal, and late menarche, respectively. Only 11 and 1 had irregular menstrual cycles and were amenorrheic, respectively. Seventy-three, 23, and 9 reported that their game performance was the best at the follicular phase, menses, and luteal phase of the menstrual cycle, respectively. No associations between the four reproductive-related variables were found. Postmenarche-trained players had significant lower age at menarche and higher percentage body fat. The somatotype profile registered lower ectomorphy rate for the postmenarche-trained participants after controlling for covariates. Early menarche group presented higher sum of six skinfold thickness and endomorphy rate compared to normal and late menarche groups. No differences were found when menstrual periodicity groups and best performance groups were compared, except for higher femur width in the regular menstrual cycle group compared to the irregular one. The association between body weight satisfaction and the four reproductive-related variables were not observed. Premenarche-trained Brazilian elite futsal players had the menarche later than the postmenarche-trained athletes. Most of the participants had menarche age classified as “normal,” presented “regular” menstrual cycles and perceived to perform better during the follicular phase of the menstrual cycle. (shrink)

RESUMEN Se postula la posibilidad de una cierta performance del espacio en la teoría de las esferas de Sloterdijk. Dicha performance sería un acto de convertibilidad onto-tecnológica, que remplaza la noción ortodoxa de un espacio de naturaleza euclidiana por la de una espacialidad gobernada por la promesa de la disciplina del diseño o Air design.. De este modo, el ser-en-esferas de Sloterdijk se comprendería mejor como ser-en-el-aire, sobre todo si se considera que la ascesis del Homo sapiens actual sugiere una (...) climatización centrada en el confort del termotopo y en una gestión tecnológica del aire. Por lo mismo, y recurriendo a uno de los argumentos mitológicos del filósofo germano, el concepto de atmoterrorismo (o guerra enfocada en la toxicidad del ambiente) podría entenderse perfectamente como una suerte de venganza titanotécnica fruto del robo del fuego epistémico sagrado. ABSTRACT The possibility of a certain performance of space in Sloterdijk's theory of spheres is postulated. Such a performance would be an act of onto-technological convertibility, which replaces the orthodox notion of a space of Euclidean nature with that of a spatiality governed by the promise of the discipline of design or Air design.. In this way, Sloterdijk's being-in-spheres would be better understood as being-in-air, especially if one considers that the asceticism of today's Homo sapiens suggests an air conditioning centered on the comfort of the thermotope and technological management of air. For the same reason, and resorting to one of the mythological arguments of the Germanic philosopher, the concept of atmoterrorism (or war focused on the toxicity of the environment) could be perfectly understood as a sort of titanotechnical revenge fruit of the theft of the sacred epistemic fire. Jacopo Baboni Schilingi’s interactive musical compositions Argo and Terra play with time, space, and material sound to capture a symbiotic relationship between technology and the most intimate process fundamental to life: breathing. Argo reacts to the artist’s respiration in “real time,” generating an “infinite” sequence of diverse musical arrangements that question the relation between the human body and technology and contingency and programming. Noting the egotistical tendencies of artists, Schilingi likens himself to Odysseus, the master of Argo, the name given (...) to his faithful technological invention. This theme of mastery is revisited in Terra where Schilingi’s hands, covered in sensors, manipulate both the musical composition and the dance movements of a female body, a body whose fertile tension both emerges and withdraws in a battle akin to Heidegger’s earth/world strife. This chapter provides a hermeneutic reading of Argo and Terra within a Heideggerian framework that does not, as Luce Irigaray has noted, forget air. Irigaray states, “Air does not show itself. As such, it escapes as (a) being. It allows itself to be forgotten.” Schilingi’s generative music makes air visible and hauntingly audible, as the music can only be stopped when the artist’s life comes to an end. (shrink)

French theorist Luce Irigaray has become one of the twentieth century's most influential feminist thinkers. Among her many writings are three books (with a projected fourth) in which she challenges the Western tradition's construals of human beings' relations to the four elements--earth, air, fire, and water--and to nature. In answer to Heidegger's undoing of Western metaphysics as a "forgetting of Being," Irigaray seeks in this work to begin to think out the Being of sexedness and the sexedness of Being. This (...) volume is the first English translation of L'oubli de l'air chez Martin Heidegger (1983). In this complex, lyrical, meditative engagement with the later work of the eminent German philosopher, Irigaray critiques Heidegger's emphasis on the element of earth as the ground of life and speech and his "oblivion" or forgetting of air. With the other volumes (Elemental Passions and Marine Lover of Friedrich Nietzsche) in Irigaray's "elemental" series, The Forgetting of Air offers a fundamental rereading of basic tenets in Western metaphysics. Augustine in The City of God does not deny the reality of the old gods but identifies them as dead heroes or as demons. The power of the old gods was still manifest to the Christians of antiquity; it was their moral worth, not their existence, that was to be challenged.Such an interpretation is not found in Muslim accounts of the Greek gods. For all practical purposes Greek polytheism was entirely dead by the time Islam came onto the scene. Indeed, even Arabian polytheism, though still vigorous when Muhammad began his prophetic career, died out within three decades of the proclamation of Islam. Inquiries about existence in Mesopotamia started with the Sumerians. They set an example for the civilizations established in this geography and affected them deeply. According to Sumerian mythology, they are cosmic forces identified with fresh water, salt water and mist that are eternal. With the combination of these cosmic elements, the sky and the earth, which are symbolized by the gods, were formed. The whole they formed was separated from each other by Enlil, who was identified with air, and (...) celestial bodies were formed with the expansion of air. The Semites continued this understanding with its main lines. In the Babylonian Epic of Creation, the beginning of the cosmic process is based on the generational conflict between the gods and is explained with the sacrifice of Tiamat, one of the first cosmic forces. The Chief God Marduk shattered Tiamat and created the universe from her remains, and man from the remains of Kingsu. According to the Mesopotamian mythological tradition, gods were derived from the first cosmic elements, which were eternal, and then they created the universe and man from these cosmic remains. According to Egyptian mythology, the eternal is the ocean. The primary gods, who existed in the eternal ocean, created the universe and humans with their natural secretions. According to many mythological narratives, the dominant god has performed the act of creation by expressing his thoughts or the imagination of the heart. As in Mesopotamian mythology, gods and natural beings were identified with a symbolic language in Egyptian mythology. Greek mythological approaches are gathered in outlines in the works of Homer and Hesiod, who are considered to be the founders of religion. Homer stated that the eternal, the divine ocean, is the source of everything. According to Hesiod, in the beginning, chaos (emptiness) occurred, and then the universe, gods and human beings emerged from this chaos, respectively. These understandings of existence also contain a significant amount of philosophical content. There is a parallelism between the understanding of being in myths and those of philosophers. (shrink)

Scientific observation has led to the discovery of recurring patterns in nature. Symmetry is the property of an object showing regularity in parts on a plane or around an axis. There are several types of symmetries observed in the natural world and the most common are mirror symmetry, radial symmetry, and translational symmetry. Symmetries can be continuous or discrete. A discrete symmetry is a symmetry that describes non-continuous changes in an object. A continuous symmetry is a repetition of an object (...) an infinite number of times. A consequence of continuous symmetry is the existence of conservation laws. A natural system with discrete and continuous symmetries displays several physical properties, such as the existence of long-range order. Geometric shapes exhibit symmetry as mirror reflections of each other. Symmetry in nature has been a model of beauty since the beginning of civilization. Since the earliest times, nature itself has manifestly been a model, evincing regularity in sundry forms and occurrences–from minerals and plants to the anatomy of living beings, to the regularly recurring stellar constellations. For Ancient Greek philosophers, proportion, symmetry, and harmony, were the basics to determine whether something is beautiful or not. Ancient Greek philosophers were known for bringing logic and rational thinking to phenomena that were previously explained by mythology and Gods. They observed the natural world around them and used their knowledge to answer questions about the proportion in observable objects and the origin of Earth. The Greek words _summetria_ and _summetros_ appear frequently in the Timaeus, defined as parts with each other and with the whole. Plato has a very rough concept of symmetry, and when he uses “beauty” to characterize the so-called Platonic Solids in the Timaeus, he seems to be emphasizing their regularity and indirectly their symmetry. Plato believes the four elements (earth, air, fire, water) have been constructed by the Demiurge, or a divine craftsman who appoints order in an otherwise chaotic universe. Minerals are representative examples of beauty, order, and symmetry in inorganic materials. Well-formed minerals (crystals) are a collection of equivalent faces related by symmetry. The goal of this paper is to relate the perspective of symmetry in ancient Greek philosophy with the modern scientific evidence of the geometric description of crystal structures. The five Platonic solids are ideal models of geometrical patterns that occur throughout the world of minerals. In this paper, minerals serve as a model of connecting the symmetry theory in Plato’s philosophy and modern advances in mineralogy. (shrink)

Part I is a general introduction to Part II and to the work of Luce Irigaray.

Have humans always had the desire to inhabit other worlds? From the microscopic scale to the vastness of outer space, it seems our capacity for occupying uninhabitable spaces with our intellect, our bodies, our sensorium, our desire, is fundamental to our being. What are these spaces and how do we come to ‘know’ them? Whether mythological, religious or scientific, these minute or vast worlds are spaces that we unfold, narrate and dwell in. In his short story ‘The Stone Sky’ the (...) novelist Italo Calvino writes of the inhabitants who live in a world that exists beneath the earth’s crust. These inhabitants who occupy the underworld exist in a mutable form that allows them to travel through the dense, dark inner landscape of the earth, through the crystal structures, the nickel sea to the earth’s core, an intricate viscous landscape quite other than the formation of matter on the earth’s surface. Calvino’s narration tells us of what is it to inhabit the interstices of the underworld, to be in a space with little intervening air, to live within the deep time scale of crystal formation. The neuroscientist Christof Koch states that ‘we live in a universe where organised bits of matter give rise to consciousness’ and that we need to extend our understanding of what consciousness really is. Could it be that these other worlds, whether planets only just glimpsed through early telescopes, or nano-landscapes at the scale of the atom are still integrated with our own fundamental make-up? Are they the product of a vastly developed pre-frontal cortex or are they a result of ideas, knowledge and experiences accumulated over billions of years? In this article I will look at the concepts of matter as a carrier of consciousness and of panpsychism as a tool with which to understand our habitation of other worlds. (shrink)

What is commonly known as the Copenhagen interpretation of quantum mechanics, regarded as representing a unitary Copenhagen point of view, differs significantly from Bohr's complementarity interpretation, which does not employ wave packet collapse in its account of measurement and does not accord the subjective observer any privileged role in measurement. It is argued that the Copenhagen interpretation is an invention of the mid‐1950s, for which Heisenberg is chiefly responsible, various other physicists and philosophers, including Bohm, Feyerabend, Hanson, and Popper, having (...) further promoted the invention in the service of their own philosophical agendas. How do we refer to chemical substances, and in particular to chemical elements? This question relates to many philosophical questions, including whether or not theories are incommensurable, the extent to which past theories are later discarded, and issues about scientific realism. This chapter considers the first explicit reference to types of colorless air in late-eighteenth-century chemical practice. Reference to a gas by one chemist was generally intended to give others epistemological, methodological, and practical access to the gas. The article deals with the mythological creativity of G.R.R. Tolkien as a socio-cultural phenomenon associated with the values of European culture. The author proceeds from the hypothesis that the myth is the embodiment of social identity, this function it retains after the loss of its ideological functions. The revival of literary mythology in the XIX-XX centuries there is an attempt to update this feature of the myth. The success of the literary myth is due to the fact that he (...) was able to absorb and Express the basic values of society. Tolkien’s work is one of the successful examples of the literary embodiment of socially significant values, combining both traditional values and value formations characteristic of the modern era. The article shows that Tolkien’s work has organically absorbed the pagan basis, the Christian attitude, and the values characteristic of the XX century. Pagan heroic principle, Christian mercy, the idea of freedom, democracy-all this is organically intertwined in the works of Tolkien, their success is due to the harmony of the whole range of social attitudes represented in the European consciousness of the mid XX century. Currently, the decline in interest in Tolkien is a reflection of the change of value preferences of European culture. (shrink)

"Wisdom in the Open Air" traces the Norwegian roots of the strain of thinking called "deep ecology" - the search for the solutions to environmental problems by examining the fundamental tenets of our culture. Although Arne Naess coined the term in the 1970s, the insights of deep ecology actually reflect a whole tradition of thought that can be seen in the history of Norwegian culture, from ancient mountain myths to the radical ecoactivism of today. Beginning with an introduction to Norway's (...) emphasis on nature and the wild, Reed and Rothenberg explore the birth of the environmental movement in the 1960s and 1970s. What follows is a collection of writings by prominent Norwegian thinkers on humanity and nature, most never before published in English. From Peter Wessel Zapffe, a twentieth-century Kierkegaardian figure, the list goes on to include Arne Naess, activist/critic/artist Sigmund Kvaloy, wilderness educator Nils Faarlund, novelist Finn Alnaes, sociologist Johan Galtung, and social reformer Erik Dammann. Their points of view offer thoughts on the significance of modern life and what it means to be human in the face of deteriorating environmental global trends of the 20th century. "Wisdom in the Open Air" asks and answers a fundamental question concerning the ecomovement: what is the role of deep, often abstract, thinking in the attempt to avert a very real ecological crisis? The main object of this project is how it can become possible to sense an invisible element such as the air. An installation will be created that will aim to provide a sensorial way of dealing with the air and the wind – that is air in motion – with the help of a computer-assisted environment. The objective is to engage the spectator in the navigation of semantic and sensual space that has its own quasi-mythical structure. The attention is focused (...) on the cognition dimension of the human body and senses and the enlargement of perception through the application of new technologies. The wind is a highly abstract phenomenon, with many physical and metaphysical aspects and is one of the basic elements of the physical universe. At the same time, the wind has an enormous impact on our lives, which we perceive, visually and acoustically only through its effects. That is why it has provided material for mythology and art throughout the centuries. In this project, the intention is to create a place where the visitor will be immersed into the landscapes of the winds of the world in order to increase his awareness and knowledge about them by merging technology, myth and body. The research is going to deal with both physical and metaphysical/mythological dimensions of the phenomenon. This starts with an investigation of references to winds and wind phenomena in mythologies world-wide, and extends over the scientific or causal explanations of the wind, as well as the investigation of its auditory and visual manifestations. Data from the Internet will be converted to audio and visual forms in a physical space, in real time. The online data that will be fed into the system are the intensity and direction of the winds at specific default locations on the planet. The visitor’s movements and his/her path in this given area will affect these audio-visual forms. I explore how the "synthesis of history and nature" that defines the Anthropocene might signal the advent of the “new mythology” Schelling hoped would emerge from his Naturphilosophie. The epistemological dimension of this new mythology is to be understood through Schelling’s idea of Mitwissenschaft, in which humanity is the essential active agent in the reflexive system of the world. Such an inquiry derives not from a sentimental longing for an enchanted world, but from the impending “annihilation of nature” (...) Schelling foresaw in 1804. The resulting organic episteme introduces a new realism in which nature, because absolute, becomes normative. (shrink)

The paper aims to investigate the thesis of the so-called Neue Mythologie within the fragment entitled “Das älteste Systemprogramm des deutschen Idealismus” [“The Oldest Systematic Program of German Idealism”]. The latter presents a revolutionary project of social pedagogy linked to the use of the aesthetic character of myth and poetry in the formation of the conscience and the intellect of the people. The program, therefore, formulates a fertile dialogue between the emancipatory potential of the Enlightenment and Jena Romanticism, in that (...) it proposes a re-evaluation of feelings and Sinnlichkeit [sensuousness] in connection to modern rationality and freedom. The links between the rational mythology of the program and Hegelian philosophy will be explored, starting from his early writings, which are strictly concerned with the importance of a popular and sensuous religion (Volksreligion). Secondly, the work will retrace the same sensuous externalization of philosophical ideas within the relationships between art, religion and philosophy in the mature system, addressing the problem of Hegel’s change of heart regarding art and mythology between the two phases of his thought. Habermas explained the attraction of German Idealism to twentieth century Jewish philosophers by appealing to the impact of kabbalah on the German Idealists. Schelling was his principal example. In this article, I trace two lines of Jewish reception of Schelling in the nineteenth century. Among German-Jewish thinkers, Schelling was attractive because of his philosophy of mythology, not because of his relation to kabbalah. Among Galician-Jewish thinkers, Schelling was attractive because of what they took to be his non-mythological version of (...) kabbalah. In both cases, Schelling offered a middle road between, on the one hand, traditionalist rejection of modernity and non-Jewish philosophy and, on the other, varieties of antinomianism. (shrink)

Music can infect us. In the dominant approach, music contaminates listeners through emotional mimicry and independently of value appraisal, just like when we catch other people’s feelings. Musical contagion is thus considered fatal to the mainstream view of emotions as cognitive evaluations. This paper criticizes this line of argument and proposes a new cognitivist account: the value metaphor view. Non-cognitivism relies on a contentious model of emotion transmission. In the competing model (social appraisal), we catch people’s emotions by appraising value (...) through their emotional expressions. Social appraisal debunks the main motivation for non-cognitivism and offers fruitful insights into musical contagion. Combining it with metaphor theory, I claim that musical contagion involves experiencing the music as a metaphor for emotions and values. Just like people infect us as we appraise value through their emotional expressions, music contaminates listeners because they hear it metaphorically-as some emotional expression and hereby appraise it metaphorically-as some value. As infectious music “sounds like” emotions and values, cognitivism is safe. (shrink)

This article traces an emergent tension in an interdisciplinary public health project called Weather Health and Air Pollution. The tension centered on two different kinds of data of air pollution: monitored and modeled data. Starting out with monitoring and modeling practices, the different ways in which they enacted air pollution are detailed. This multiplicity was problematic for the WHAP scientists, who were intent on working across disciplines, an initiative driven primarily by the epidemiologists who imbued the project with meaning and (...) value as the protagonists of “health.” To work collaboratively implies a stable, singular, and shared research object, however: one kind of data, one version of air pollution. In detailing two attempts by researchers to address the inadequacies of modeled and monitored data, this article explores the ways in which difference and multiplicity were negotiated and transformed. In doing so, this article suggests that it is the mobility and instability of data that are particularly fruitful for exploring the facilitation and enactment of new realities, while also making explicit the emergent problematics and partialities which inevitably result. This paper examines the learning and performance of the air traffic control (ATC) work domain. This domain was chosen because it embodies features that represent future work for many other industries (e.g., information service provision mediated by information technologies; a high reliance on communication skills and collaborative work; increasing complexity and intensity of the work activity), within an organisational context undergoing considerable change. In ATC work learning occurs formally as part of accredited training and informally, as part of everyday practice. (...) In this way learning and experience of ATC work shapes – and is shaped by – the way work is organised, which includes the divisions of labour and technological artefacts. ATC work is experienced temporally, complexly, through affect and socially. Controllers learn to use a variety of socio-material resources which include embodiment and artefacts to undertake the work. In so doing the article demonstrates the ways in which learning and performance is not just a cognitive undertaking, but one that draws on embodiment to achieve what here is called “interdependent sentience”. This involves using all their senses to gain an awareness of problems as they emerge to collectively accomplish a seamless air traffic flow in a complex interdependent socio-technical system. The Iliad is rich in references to stories that have only incidental relevance to the main narrative. These digressions, as they are often called, have usually been assumed to reflect a wealth of pre-Homeric legend, some of which must a have been embodied in poetry. The older Analysts tended to explain the digressions in terms of interpolation. Whether regarded as genuinely Homeric or as interpolated these myths were considered as something existing in an external tradition. More recent scholars have been (...) prepared to admit that Homer may invent from time to time. For example, Sir Maurice Bowra observes that ‘the poet seems sometimes to invent a detail which looks as if it referred to some story outside his immediate subject but is in fact an invention brought to serve a passing need’.
