Preoccupation with "the self" is indeed, as Colin Grant suggests, a serious ethical and theological problem, but Grant's effort to recentralize the "displaced" norm of sacrificial love may not be the best way to address it. The contemporary failure to love is rooted in traditional Christian teachings about agape; thus, it is precisely "for the love of God" that I have proposed the creative energy of eros as an alternative interpretation of God's relation to the world. Moreover, the real and (...) important argument between Grant and feminist theologians is not an argument between scripturally grounded theologians and Enlightenment secularists; it is a fully theolog- ical argument between dualists and transformationists. Climate change confronts humanity with a challenge it has never faced before. It combines issues of global justice and intergenerational justice on an unprecedented scale. In particular, it stands to adversely affect the global poor. So far, the global community has failed to reduce emissions to levels that are necessary to avoid unacceptable risks for the future. Nor are the burdens of emission reductions and of coping with climate impacts fairly shared. The shortcomings of both political and individual climate action (...) thus seem like a paradigmatic case for non-ideal theory. Non-ideal theory can be understood as a form of political theorising that compares different responses to (i) failures of agents to comply with the demands of justice and (ii) unfavourable circumstances. Insofar as non-ideal theory also aims to be action-guiding, it asks normative theorists for a more thorough engagement with the empirical context so as to arrive at practical recommendations for the ‘here and now’. This volume examines the normative issues that become relevant when the non-ideal circumstances of the climate context are fully taken into account. It is comprised of three parts: The first collects chapters that reflect on general issues in responding to the shortcomings of current climate action. Chapters in the second part propose more specific practical reforms. The third part examines how moral values ought to be brought into the scientific, political, and public debates under the non-ideal circumstances of this world. (shrink)

Many have argued that that it is morally wrong to benefit from an agent's culpable wronging of a third party. This thought has formed the basis of some arguments that agents can have duties to make up for wrongful acts by others that they could not have stopped, or that occurred before they were born. For example, it has been argued that those who benefited from slavery, colonialism and other shameful events in their nation's history should surrender those benefits, their (...) equivalent value, or provide other forms of redress. Some have also argued that it is morally wrong to benefit from unjust situations caused by third parties even where there is no culpable element. These ideas have potential to be a principle of redress for harms that are caused by the working of very complex systems, such as the global climate system. Geoengineering, the intentional manipulation of the global climate, is a new development in climate science and policy — and one which raises many normative challenges. This article focuses on one specific challenge. The global climate is very complex and there is a real possibility that the best available science will not be able to account for all the consequences of deploying a geoengineering technique. Therefore, any governance regime that allows deployment will have to consider how to organise compensation or redress for any adverse impacts that could not have been predicted at the time of deployment. This article proposes that, with some modification, the principle that agents should surrender benefits that have accrued to them from using geoengineering techniques, can be a good basis for such a scheme. Reflection Principles are commonly thought to produce only strong axioms of infinity consistent with V = L. It would be desirable to have some notion of strong reflection to remedy this, and we have proposed Global Reflection Principles based on a somewhat Cantorian view of the universe. Such principles justify the kind of cardinals needed for, inter alia , Woodin’s Ω-Logic.

Land-based climate mitigation schemes such as REDD+ imply the creation of ‘rights to carbon’ for actions that enhance carbon sinks. In many cases, the legal and normative foundations of such rights are unclear. This article focuses on special rights on the basis of improvement. Considering improvement in relation to carbon sinks requires asking what it means to ‘improve’ an environmental resource. Our answer departs in two significant respects from the standard conception of improvement, namely by reconceiving action in relation to (...) ecosystem services, and accordingly, making the case for a counterfactual baseline to be used to compare an improved and unimproved state. Our modifications potentially allow for a variety of agents to claim special carbon rights on the basis of beneficial interactions with land-based carbon sinks. We give three archetypical examples of agents who may claim pro tanto special rights to carbon based on their interaction with carbon sinks. (shrink)

Chris Armstrong argues that attempts at justifying special claims over natural resources generally take one of two forms: arguments from improvement and arguments from attachment. We argue that Armstrong fails to establish that the distinction between natural resources and improved resources has no normative significance. He succeeds only in showing that ‘improvers’ are not necessarily entitled to the full exchange value of the improvement. It can still be argued that the value of natural and improved resources should be distributed on (...) different grounds, but that the value of improvements should be conceived differently. (shrink)

As educators we are haunted. This haunting takes place on several levels, through our personal histories, through key theoretical ideas we have encountered on our journeys, and by those significant educators who have gone before. This paper highlights how Elwyn S. Richardson continues to haunt education in New Zealand. Also how Elwyn, in turn, was haunted by ‘Wal’ and John Dewey. Rubbing up against neo-liberal reform, philosophers such as Elwyn, give us permission to develop our own personal educational philosophy. Through (...) employing an arts-based autoethnography, we explore how our educational journeys have been haunted by Elwyn. And by drawing on Jacques Derrida’s directive, ‘speak to the ghost’, we summon up Elwyn. To do this we write a series of fictional letters which enable us to reflect on one author’s memories. Through analysis of these letters we demonstrate the importance of the Arts as a method to critically reflect upon, and rise above, the dominant neo-liberal ideology we work within. We speculate here that a strong personal philosophy has the potential to disrupt and engage educators critically with an institutional philosophy that continues to dominate much of mainstream education in New Zealand. Within the rough ground that is the field of education there is a complex web of ethical obligations: to prepare our students for their future work; to be ethical as educators in our conduct and teaching; to the ethical principles embedded in the contexts in which we work; and given the Southern context of this work, the ethical obligations we have to this land and its First Peoples. We put out a call to colleagues whose work has been concerned with (...) the pedagogies of professional ethics, the ethical burdens of institutional injustice, and the application of ethical theory to education’s applied fields. In the responses we received it can be seen that ethical concerns in education are broad ranging, covering terrain varying from the preparation of preservice teachers, ethics in higher education, early childhood and care, educational leadership, relational and communicative ethics. Perhaps it could also be argued that this paper demonstrates Gibbon’s observation that ‘Assumptions about the particularity of this time as new and ripe with opportunity to make a difference through philosophy of education are not new and there’s much to learn from the persistence of wanting to imagine that they are’. However, while the field of ethics is perennially concerned with human relations and pedagogical interventions to improve these, the responses collected here show that educational ethics is far from static. Educational ethics is a field that continues to develop in response to changing contexts. (shrink)

The introduction of novel diagnostic techniques in clinical domains such as genomics and radiology has led to a rich ethical debate on how to handle unsolicited findings that result from these innovations. Yet while unsolicited findings arise in both genomics and radiology, most of the relevant literature to date has tended to focus on only one of these domains. In this article, we synthesize and critically assess similarities and differences between “scanning the body” and “sequencing the genome” from an ethical (...) perspective. After briefly describing the novel diagnostic contexts leading to unsolicited findings, we synthesize and reflect on six core ethical issues that relate to both specialties: terminology; benefits and risks; autonomy; disclosure of unsolicited findings to children; uncertainty; and filters and routine screening. We identify ethical rationales that pertain to both fields and may contribute to more ethically sound policies. Considerations of preserving public trust and ensuring that people perceive healthcare policies as fair also support the need for a combined debate. (shrink)

There has been an increase in recent years in the use of empirical methods in healthcare ethics. Appeals to empirical data cannot answer moral questions, but insights into the knowledge, attitudes, experience, preferences and practice of interested parties can play an important part in the development of healthcare ethics. In particular, while we may establish a general ethical principle to provide explanatory and normative guidance for healthcare professionals, the interpretation and application of such general principles to actual practice still requires (...) interpretation and judgement. And many situations in healthcare practice are complex and may involve a variety of principles, each of which may conflict with the others. Simple surveys or interview studies may not be sufficient if we wish to develop a nuanced approach to ethical practice that can be set out in guidelines, codes or directives. We do not resolve moral questions by plebiscite. In this paper, the authors argue for the use of consensus methods to develop shared understanding of ethical practice, and they argue further for the combination of the Delphi method with the use of vignettes to illustrate the kind of situations that may occur in practice. They develop their argument in part by reference to their experience of using this approach in their recent research. (shrink)

As family physicians, general practitioners play a key role in safeguarding children. Should they suspect child abuse or neglect they may experience a conflict between responding to the needs and interests of the child and those of an adult patient. English law insists on the paramountcy of the interests of the child, but in family practice many other interests may be at stake. The authors argue that uncritical adoption of the paramountcy principle is too simplistic and can lead, paradoxically, to (...) greater harm. They argue for a more subtle and nuanced view of interests and of conflicts of interest in safeguarding children. (shrink)

Doctors’ strikes are legally permissible in the UK, with the situation differing in other countries. But are they morally permissible? Doug McConnell and Darren Mann have systematically attempted to dismiss the arguments for the moral impermissibility of doctors’ strikes and creatively attempted to provide further moral justification for them. Unfortunately for striking doctors, they fail to achieve this. Meanwhile, junior doctors’ strikes have continued in the UK through 2023 and have now extended into 2024. In this response, which focuses on (...) the UK situation and specifically junior doctors’ strikes in the National Health Service (NHS) in England, I will demonstrate a central problem with their arguments—namely that they underplay the harms caused by prolonged doctors’ strikes by ignoring the harms to patients with cancer. This weakens their conclusion that strikes are morally permissible in terms of the conditions and thresholds they set. I then provide a psychological critique of their justification for strikes in terms of the interests of the public. It follows that invoking the controversial concept of supererogatory action is ungrounded but also absurd when you consider time-critical cancer care. If those representing striking doctors wish to maintain a modicum of moral respectability, they should mitigate for patients with cancer and negotiate reasonably and with urgency. (shrink)
